The essay is a critical revision of various of Marx’s approaches in his analysis of capitalism in “Das Kapital”. One can distinguish immanent, normative critiques from transcendental and objectivistic ones. The review of the normative standards used in each case leads to the questions of how Marx determined and used the relationships of justice and law and the capitalist mode of production. Orthodox Marxist views (most recently C. Menke) claim that Marx did not criticise capital as unjust and understood the (...) law of capital only as private law that stabilised domination. Against this, it is shown that he certainly bases his “critical presentation” on an (almost Kantian) constitutional (“rechtsstaatliches”) concept of private law and public law. Thus the “popular prejudice” of “human equality”, defined by Marx as an epochal and systematic condition of the capitalist exchange of goods, becomes apparent as a covert reference to the historical (America, French Revolution),public-lawdeclarations of human rights. And in the chapter “Struggle for the length of the working day” Marx presents the decisions of this dispute between “equal rights” first and foremost in the systematic historical actions of the constitutional powers (legislature, executive and judiciary). At the same time, however, he attempts to ironise and defame this public-law and deliberative, democratic dispute and then to misinterpret it as a violent “civil war”. Because Marx in his further presentation ignores this legal-democratic dispute, including a potential human-rights critique and (possible!) future regulation of capitalism, focussing instead on objectivist concepts of history and development, he can only insufficiently grasp the still challenging relationship between democracy and capitalism. Während der junge Marx noch eindeutig „Entfremdung“ negativ bewertet, analysiert und bewertet der reife Marx des Kapitalbuches Entfremdungsphänomene als differente „Verdinglichungen“ und „Vergleichgültigungen“ und bewertet diese Indifferenzen kontextspezifisch positiv oder negativ. Ihm folgt Georg Simmel, der besonders in seiner „Philosophie des Geldes“ Indifferenz als Signatur der modernen Gesellschaft bestimmt und für ihre negativ bewerteten Auswirkungen positive Kompensationen aufzeigt (...) und verfolgt. In the understanding of Habermas, "right" in the phrase "human rights" is a legal concept, where human rights are legal rights, i.e., legal norms declared in acts of foundations of the State or announced conventions of international law and/or State constitutions. By conceiving of rights in this way and by treating human rights in a threefold approach (placing them between morals, law and politics), he presents different theoretical definitions of human rights. Since the founding of the UN, the protection of human rights has been a national and international challenge. In international human rights covenants, State Parties firstly commit themselves to respecting human rights in their respective constitutional area and to protecting and possibly incorporating them into the relevant constitution, but, secondly, they also submit to an international control. National protection is usually organized by different institutions, but also accompanied by critical NGOs and the national civil public. International protection is on the (...) one hand implemented by a number of international organizations and institutions, but on the other hand is accompanied by a critical, now regionally and internationally operating public. This includes a number of permanent NGOs, but also ad hoc groups, tribunals and the various media and anonymous campaigns on the Internet and the social networks. This paper examines the functions and tasks of such concomitant national and international public spheres and tries to assess their importance for the protection of human rights. (shrink)

In Germany the question whether to uphold or repeal the judicial prohibition on Pre-implantation Genetic Diagnosis is being debated from quite different standpoints. This paper differentiates the major arguments according to their reasons as a) moral, b) evaluative , and c) legal. The arguments for and against PGD can be divided by content into three groups: arguments relating to the status of the embryo, focusing on individual actions in the implementation of PGD, and relating to the foreseeable or probable consequences (...) of PGD.In Germany, from a legal perspective, the status of the embryo does not permit the intervention of PGD; from a purely moral perspective, a prohibition on PGD does not appear defensible. It remains an open question, however, whether the moral argument permitting PGD should be restricted for evaluative reasons. The paper discusses the species-ethical reasons, for which Jürgen Habermas sees worrisome consequences in the wake of PGD to the extent that we comprehend it as the forerunner of a ‘positive eugenics’. It would so disrupt the natural preconditions of our universal morality. The question of whether to prohibit or allow PGD is not merely a question of simple moral and/or legal arguments, but demands a choice between evaluative, moral and species-ethical arguments, and the question remains open. Therefore a somewhat minimal but complex definition of “human rights justice”, as formulated in the international human rights pacts since 1948, is explained. Through this, the different but systematically interrelated human rights (liberty rights, justice rights, political rights, economic, cultural and social rights) can (...) allow for reflected and more comprehensive assessments of progress in different areas of development. But it is also necessary to integrate the specific progress developments into a comprehensive conception of human rights justice, the precise definition of which requires not only the observance of social but ultimately of all human rights, and in particular political participation rights. The role of metaphysics in critique stands as a defining issue for the Frankfurt School theorists. Max Horkheimer himself claims that metaphysics serves as an instrument of domination, leading him to develop an interdisciplinary mate- rialism as a postmetaphysical alternative. Critics such as Georg Lohmann con- tend, however, that Horkheimer’s critique of instrumental reason is aporetic insofar as it undermines all metaphysical claims while implicitly making them. Since Horkheimer narrowly equates metaphysics with identity thinking, this article argues that (...) his appeal to nonidentity thinking as the foundation for critique is better understood as a form of antimetaphysics. This, however, leaves Horkheimer no better situated, since antimetaphysics remains a variant of metaphysics. While Horkheimer reproduces the techniques of domination he sought to avoid, this lapse into metaphysics warns of the difficult path that postmetaphysical thinking must navigate between the antipodes of metaphys- ical and antimetaphysical positions. George Herbert Mead (1863-1931) had a powerful influence on the development of American pragmatism in the twentieth century. He also had a strong impact on the social sciences. This classic book represents Mead's philosophy of experience, so central to his outlook. The present as unique experience is the focus of this deep analysis of the basic structure of temporality and consciousness. Mead emphasizes the novel character of both the present and the past. Though science is predicated on the assumption that (...) the present is predictable based on a thorough knowledge of the past, the experience of the present, says Mead, is an utterly unique moment comparable to no other, and when it is past the novel character of that unique experience is irrevocable. The emergence of novelty within the perceived rational order of reality is the crux of the problem that Mead explores. The present, in his words, is "the emergent event . . . something which is more than the processes that have led up to it and which by its change, continuance, or disappearance, adds to later passages a content they would not otherwise have possessed." The present as "the seat of reality" heavily conditions our retrospective view of the past as much as it helps to shape the future. The novelty of every present experience causes us to reconstruct our preceding experiences to make sense of the past, which is naturally assumed to be the main cause of what we presently experience. Our perspective on reality is thus relative to the conditioning of each new event and it changes continuously as the effects of the present shift our view of the past and future. This emphasis on the integrative, holistic nature of reality, in which everything past, present, and future is a condition of everything else, makes Mead's philosophy highly relevant to today's scientific picture of a quantum universe, where chance and probability play a role in the emergence of reality. Also of great interest is the way in which he extends his basic analysis of temporal-spatial reality to the emergence of mind and consciousness as a natural development of the evolutionary process. This stimulating and provocative work attests to John Dewey's praise of Mead as "the most original mind in philosophy in America" of his generation. (shrink)

Why does scholarship on transnational labor regulation (TLR) consistently fails to search for improvements in working conditions, and instead devotes itself to relentless efforts for identifying administrative processes, semantics, and amalgamations of stakeholders? This article critiques TLR from a pro-worker perspective, through the philosophical work of Georg Lukács, and the concepts of reification and commodification. A set of theoretically grounded criteria is developed and these are applied against selected contemporary cases of TLR. In the totality that is capitalism, reification (...) of social relations of production conceals completely the experiences of workers. In TLR, managerialist and process-oriented scholarship is dominant, verifiable outcomes and positive improvements in conditions of employment are not sought, and worse, meaningless procedures are celebrated as positive achievements. The Archaeology of Semiotics and the social order of things is edited by George Nash and George Children and brings together 15 thought-provoking chapters from contributors around the world. A sequel to an earlier volume published in 1997, it tackles the problem of understanding how complex communities interact with landscape and shows how the rules concerning landscape constitute a recognised and readable grammar. The mechanisms underlying landscape grammar are both physical and mental, being based in part on the mindset of (...) the individual; the same landscape can thus evoke different meanings for different people and at different times. People's perception has greatly influenced the construction of landscapes over millennia but, until recently, the potential of this area has been largely untapped. Apart from chapters focusing solely upon human interaction with landscape, there are several which skilfully integrate artefacts and place with landscape (e.g. Gheorghiu and Sognnes). Other chapters look at the way people have marked the landscape through such mechanisms as rock-art (e.g. Clegg, Devereux, Estévez, Fossati, Kelleher and Skier). Rock-art establishes personal and communal identity in relation to landscape and it is clear that other forms of visual expression were in place which distinctively created special places within the landscape. Landscape constructs can bind cultures together; bringing the old ways of reading the landscape into contemporary life (e.g. Smiseth). Defining early and late prehistoric landscapes and segregating these into, say, mundane domestic and ritualised spaces rely on both clear and subtle archaeologies and in this volume distinct monument clustering and ritualised linearity are considered (e.g. Mason and Nash). A volume such as this cannot escape the influence of New World approaches, such as anthropology, and in many respects chapters by Bender, Muller and Merritt give context to other chapters within the book. Finally, one must consider text as a means of constructing landscape and this is considered by Heyd, who eloquently deconstructs the travel diary of a 17th century Japanese poet. This will be an important volume for archaeologists, landscape scholars and students. The many approaches used are tried and tested, forming an invaluable resource and not just another edited book. Beginning with the assumption that the normative conception of Zen that Dōgen expounded and practiced constitutes at its heart a religio-philosophical practice, I focus on Dōgen’s zazen-only as its primary locus. Specifying the nature of zazen-only on and off the cushion, I seek to foreground the ways in which the transformation of apparent dualities into non-dual dualities is key to understanding Dōgen’s Zen as a religio-philosophical practice. Since this activity implicates more than experience, e.g., valuations, desires, goals, actions, reactions, etc., (...) i.e., the entire psycho-physical existence of the practitioner, it is itself philosophical in the demands it makes on practitioners in the “nitty gritty” of life. Further, the activity of transforming apparent dualities into non-dual dualities relies on two other important concepts that Dōgen utilizes, those of “weighing emptiness” and non-thinking. I, thus, focus on expounding the manner in which grappling with non-dual duality, weighing emptiness, and non-thinking should be seen as loci of Dōgen’s religio-philosophical activities. Lastly, I note that the extent to which someone can engage the philosophical dimensions will depend on the person, their motivations, and that of their teachers. Yet, the more deeply one can penetrate the various issues, ideas, and concepts at stake, the deeper one’s practice-realization.Yet, following Hee-Jin Kim’s treatment of it, weighing emptiness is vital to the dynamicity of practice-realization in the world. This is because weighing emptiness is a way to describe the transformation and engagement with a non-dual duality in the world. While not denying the idea of “equality in emptiness,” it insists that differences must be taken into consideration in realizing the fairness, reasonableness, and justness of the practitioner acting in the world. Despite decades of research, morphogenesis along the various body axes remains one of the major mysteries in developmental biology. A milestone in the field was the realisation that a set of closely related regulators, called Hox genes, specifies the identity of body segments along the anterior–posterior (AP) axis in most animals. Hox genes have been highly conserved throughout metazoan evolution and code for homeodomain‐containing transcription factors. Thus, they exert their function mainly through activation or repression of downstream genes. However, while (...) much is known about Hox gene structure and molecular function, only a few target genes have been identified and studied in detail. Our knowledge of Hox downstream genes is therefore far from complete and consequently Hox‐controlled morphogenesis is still poorly understood. Genome‐wide approaches have facilitated the identification of large numbers of Hox downstream genes both in Drosophila and vertebrates, and represent a crucial step towards a comprehensive understanding of how Hox proteins drive morphological diversification. In this review, we focus on the role of Hox genes in shaping segmental morphologies along the AP axis in Drosophila, discuss some of the conclusions drawn from analyses of large target gene sets and highlight methods that could be used to gain a more thorough understanding of Hox molecular function. In addition, the mechanisms of Hox target gene regulation are considered with special emphasis on recent findings and their implications for Hox protein specificity in the context of the whole organism. This study shows how Kierkegaard's mature theological writings reflect his engagement with the wide range of theological positions which he encountered as a student, including German and Danish Romanticism, Hegelianism and the writings of Fichte and Schleiermacher. George Pattison draws on both major and lesser-known works to show the complexity and nuances of Kierkegaard's theological position, which remained closer to Schleiermacher's affirmation of religion as a 'feeling of absolute dependence' than to the Barthian denial of any 'point of contact', with (...) which he is often associated. Pattison also explores ways in which Kierkegaard's theological thought can be related to thinkers such as Heidegger and John Henry Newman, and its continuing relevance to present-day debates about secular faith.
