This paper provides an overview of how the social licence to operate (SLO) of the Swedish forest industry has been developed over time. For many decades, the SLO has been implicitly operating, shaped by dominant discourses of the day. We can see these SLOs through the agrarian, industrial and post-industrial era. During this era, a focus on bioenergy has seen whole stump removal become a more mainstream practice. This practice gained increasingly widespread acceptance when framed as a necessary response to (...) climate change. However, research has identified problems associated with whole stump removal, including decreased biodiversity, nutrient removal, soil acidification and mechanical soil preparation threatening soil carbon stores. In light of these recent developments, this paper examines the role of knowledge production and accepted discourses in the creation and maintenance of an industry’s SLO. This paper argues that jurisprudential inquiries can be profitably analysed as oriented towards either the explanatory paradigm of discourse or the explanatory paradigm of tradition. The first part of the paper offers a map of the discipline of jurisprudence in accordance with the above two different explanatory orientations. It does so at two levels: 1) ontological ; and 2) epistemological. In the second part the paper, the tension and interaction between the explanatory paradigms of discourse and tradition in the work (...) of five different theorists is considered: 1) Elizabeth Mertz's anthropological linguistics; 2) Nicola Lacey's revision of the relationship between analytical jurisprudence and descriptive sociology; 3) Roger Cotterrell's call for a sociology of legal ideas; 4) Neil MacCormick's concept of law as institutionalised normative order; and 5) Patrick Glenn's notion of a legal tradition. Finally, in the third part, the paper addresses certain implications of the analysis of jurisprudential inquiries by reference to the above two explanatory orientations for comparative and international legal scholarship. The two explanatory orientations are offered as one of many paradigms thanks to which one can recognise the limitations of any one picture of law or legal work. At the metaphilosophical level, the analysis of the paper indicates that there are three options available to jurisprudence, i.e., 1) seek to provide a picture of law or legal work on the basis of one explanatory orientation; 2) maintain pluralism about concepts of law or legal work given their limitations in light of their explanatory orientations; or 3) attempt to combine the elements of both explanatory paradigms in a unified account. The paper argues that insofar as jurisprudence seeks to provide normative resources for responses to certain challenges in the public sphere, it ought to go for option two, namely, for maintaining pluralism about concepts of law and legal work. In this article I propose to discuss some recent theological contributions to the problem of the historicity of the Gospels, and I wish to suggest that philosophical issues may ultimately be relevant to its solution.

T. A. Cavanaugh defends double-effect reasoning (DER), also known as the principle of double effect. DER plays a role in anti-consequentialist ethics (such as deontology), in hard cases in which one cannot realize a good without also causing a foreseen, but not intended, bad effect (for example, killing non-combatants when bombing a military target). This study is the first book-length account of the history and issues surrounding this controversial approach to hard cases. It will be indispensable in theoretical ethics, applied (...) ethics (especially medical and military), and moral theology. It will also interest legal and public policy scholars. (shrink)

The publication in 1957 of the Wolfenden Report occasioned a celebrated controversy in which profound theoretical issues concerning the relation between law and morality, and the legal enforcement of morality were discussed. The principal disputants were Lord Justice Devlin and Professor H. L. A. Hart. It is by now well known that the main recommendation of the Wolfenden Report was the reform of the criminal law so that homosexual behaviour in private between consenting male adults should no longer be a (...) criminal offence. As homosexual behaviour in Christendom was at the outset punishable in the ecclesiastical courts, and subsequently, with the demise of the ecclesiastical courts, in the secular courts, the Wolfenden recommendation on homosexuality marked a major departure from the prevailing state of affairs in which the precepts of Christian morality, especially relating to sexual morals, were at first enforced by the ecclesiastical courts, and then by the secular courts. A simple propositional operator is introduced which generalizes pairwise equivalence and occurs widely in mathematics. Attention is focused on a replacement theorem for this notion of generalized equivalence and its use in producing further generalized equivalences.

Can Martyrdom survive Secularization? is a survey of martyrdom in western society starting with the early Christian martyrs, and narrating its increasing politicization and secularization in more modern times. It argues that martyrdom is a two way street: the courage of men and women in the face of torture and death and the willingness of society to grant them the title of martyr. It recounts the careers of John Brown and his death on a Virginia gallows in 1859, Dietrich Bonhoeffer (...) and his execution by the Nazis in 1945, and Julius and Ethel Rosenberg and the atomic bomb. The story ends with the advent of suicide bombers, the apparent reintroduction of religion as a motive and their role as a political weapon. (shrink)

Kant's readers have disagreed about whether, according to his account of cognition, concepts, representations of the understanding, are involved in intuitions, representations of sensibility. But proponents of the affirmative 'conceptualist' answer and those of the negative 'non-conceptualist' answer have alike presupposed that such involvement should be construed in a particular way: i.e., as the involvement of particular concepts in particular exercises of sensibility. I argue, on the contrary, that it should not be: that though, for Kant, no concepts are applied (...) in exercises of sensibility, nonetheless the understanding, the faculty of concepts, is teleologically internal to sensibility and, therefore, to its exercises. That is, those exercises are per se directed towards the provision to the understanding of objects to which its fundamental concepts, the categories, are applicable, though no act of categorical application is internal to them. This conception of sensibility, available only in light of a careful distinction between capacities and acts, is demanded, I argue, by Kant's conception of a priori knowledge as elaborated in his Transcendental Deduction.
