The eighteenth century was the century of self-organization, but also that of materialism, inasmuch as it was then that certain thinkers proclaimed themselves to be materialists (rather than just being labelled as such by enemies of various sorts). If one seeks to read these two features – one hesitates to call them ‘facts’ or ‘events’ – together, one arrives rather quickly at an influential metaphor, the beeswarm. But a metaphor of or for what? Irreducible organic unity, most broadly – spelled (...) out in the vocabulary of the period in terms of synergy, sympathy and sensibility, but also of cohesion, consensus and conspiration: individual bees have their characteristics, their intentions, and their own purposes, but they also ‘conspire’, ‘cohere’ and ‘consent’ in the name of a larger living unity, the swarm, although this leaves open further questions such as the exact nature of the order or organization yielded or enacted by the swarm (bottom-up? top-down? emergent? etc.). The fascination with the beeswarm is a fascination with organic unity and in some cases (notably Diderot), with the organic or organismic features of living matter itself. This work reflects on hypochondria as well as on the global functioning of the human mind and on the place of the patient/physician relationship in the wider organisation of society. First published in 1711, revised and enlarged in 1730, and now edited and published with a critical apparatus for the first time, this is a major work in the history of medical literature as well as a complex literary creation. Composed of three dialogues between a physician and two of his (...) patients, Mandeville’s Treatise mirrors the digressive structure of a talking cure. Thanks to the soothing and enlightening effects of this casual conversation, the physician Mandeville demonstrates the healing power of words for a class of patients that he presents as men of learning who need above all to be addressed in their own language. Mandeville’s aim was to delineate his own cure for hypochondria and hysteria, which consisted of a talking cure followed by diet and exercise, but also to discuss the practice of medicine in England and continental Europe at a time when physicians were beginning to lose ground to apothecaries. Opposing a purely theoretical approach to medicine, Mandeville takes up the principles presented by Francis Bacon, Thomas Sydenham, and Giorgio Baglivi, and advocates a medical practice based on experience and backed up by time-tested theories. This collection of essays seeks to challenge the notion of the supremacy of the brain as the key organ of the Enlightenment, by focusing on the workings of the bowels and viscera that so obsessed writers and thinkers during the long eighteenth-century. These inner organs and the digestive process acted as counterpoints to politeness and other modes of refined sociability, drawing attention to the deeper workings of the self. Moving beyond recent studies of luxury and conspicuous consumption, where dysfunctional bowels (...) have been represented as a symptom of excess, this book seeks to explore other manifestations of the visceral and to explain how the bowels played a crucial part in eighteenth-century emotions and perceptions of the self. The collection offers an interdisciplinary and cross-cultural perspective on entrails and digestion by addressing urban history, visual studies, literature, medical history, religious history, and material culture in England, France, and Germany. This Element argues that although Kant's political thought does not tackle issues of global poverty and inequality head on, it nonetheless offers important conceptual and normative resources to think of our global socioeconomic duties. In three experiments, picture quality between test items was manipulated to examine whether subjects’ expectations about the fluency normally associated with these different stimuli might influence the effects of fluency on preference or familiarity-based recognition responses. The results showed that fluency due to pre-exposure influenced responses less when objects were presented with high picture quality, suggesting that attributions of fluency to preference and familiarity are adjusted according to expectations about the different test pictures. However, this expectations influence depended on subjects’ (...) awareness of these different quality levels. Indeed, imperceptible differences seemed not to induce expectations about the test item fluency. In this context, fluency due to both picture quality and pre-exposure influenced direct responses. Conversely, obvious, and noticed, differences in test picture quality did no affect responses, suggesting that expectations moderated attributions of fluency only when fluency normally associated with these different stimuli was perceptible but difficult to assess. This paper describes the construction method of a legal application ontology. This method is based on the merging of micro-ontologies built from European community directives. The terminae construction method from texts enhanced by an alignment process with a core legal ontology is used for building micro-ontologies. A merging process allows constructing the legal ontology.

On the basis of a comparative analysis of Hugo Grotius and Immanuel Kant, it shows how different the meaning of this idea can be within a theory of property or territory. The first part is devoted to Grotius’s account of why and how the institution of property was progressively introduced. It highlights the (...) importance this account attaches to the intention of the first distributors for a good understanding of property laws, and in particular, for an understanding of their non-application in situations of extreme necessity. The second part takes the opposite path and shows that although Kant rejects the very existence of a right of necessity, the idea that one might be liberated from a law is not completely absent from, and even plays a crucial role in, his account of property. Clarification of this role ultimately leads us back to the idea of original possession in common of the Earth. (shrink)

The internet is a major part of our lives today. This applies to politics as well, and accordingly, the question of whether it is possible to realize democracy on the internet has arisen. Using the arguments of Hannah Arendt, the paper aims to determine what online democracy should look like. It is argued that the internet's decentralized structure is advantageous because it facilitates the implementation of the Arendtian system of political councils. Due to the character of online political platforms – (...) mainly social media – these political councils should ideally revolve around shared issues that simultaneously create the common world on the internet. At the same time, clear rules need to be laid down for the functioning of these online political councils. Based on Arendt's arguments, it is claimed in the paper that these rules include the principles of mutual promises and covenants on the issues themselves. It is also argued that because Arendt emphasizes the role of appearing in the public sphere, the process of authentication – that is, verifying that there is a concrete person with a physical body behind each online account that wants to actively participate in a particular online political council – is required. ABSTRACTThis essay aims to contribute robust grounds to question the Susskinds’ influential, consequentialist logic when it comes to the legitimacy of automation within the legal profession. It does so by questioning their minimalist understanding of the professions. If it is our commitment to moral equality that is at stake every time lawyers hail the specific vulnerability inherent in their professional relationship, the case for wholesale automation is turned on its head. One can no longer assume that, as a rule, wholesale (...) automation is both legitimate and desirable, provided it improves the quality and accessibility of legal services. The assumption, instead, is firmly in favour of designing systems that better enable legal professionals to live up to their specific responsibility. Considering the sensory dimension of clinical decision-making is a challenge for the training of health professionals. Therefore, how can we help them stimulate a form of sensory acuity? We conducted a study in partnership with the Simulation Laboratory of a Canadian hospital to understand the sensory work accomplished by nurses during a clinical decision-making. To do this, we analyzed the interactions occurring during focus groups to reveal the sensory work performed by nurses during the clinical evaluation of patients (personas).

n spite of their divergences, global justice thinkers tend to agree that fairness in international trade requires the removal of trade barriers and hence of protectionist measures, especially on the part of rich countries. Behind this agreement, we find different kinds of considerations, some of which related to the idea that trade liberalisation is not genuinely, or at least not wrongfully, harming members of rich countries. My main purpose in this paper is to examine this idea in more detail and (...) to show that it faces several difficulties which invite us to reconsider the moral acceptability of at least some protectionist policies. The main purpose of this article is to bring into relief the difficulties faced by generous interpretations of the Kantian problem of poverty and to propose an alternative interpretation which (a) agrees with some generous interpretations that Kant's juridical treatment of poverty is to be understood by analogy with his juridical treatment of slavery, but which (b) departs from generous interpretations in general by arguing that this analogy is not to be understood in terms of “dependence” as such, but in (...) terms of “depersonification.” More specifically, it argues that what makes slavery and poverty unjust for Kant is not that they entail a human being finding herself (completely) dependent on the choice of another human being, but that they entail a human being being deprived of her juridical personality. The Kantian problem of poverty is ultimately a problem of juridical depersonification, and this problem of juridical depersonification does not arise in all (complete) dependence relations. (shrink)
