The notion of virtue in general, and courage in particular, has had a hard time integrating itself into the everyday lexicon of bioethics. Following the lead of enlightenment moral philosophy, which concentrates on the theory of right action as opposed to the ancient Greeks' emphasis on the development of good character, bioethics, with some notable exceptions, has tended to relegate consideration of the virtues to the sidelines of moral argument. Recently, however, there have been calls for the necessity of “moral (...) courage” in the context of clinical ethics. As nurses, physicians, and other health care professionals confront a variety of moral contexts in which the virtue of courage is invoked to "do the right thing," stand up for patients' rights, and uphold the ethical standards of their professions, they are increasingly reminded of their moral duty to exhibit courage in the face of institutional obstacles to the proper care of their patients. For example, a nurse's hesitation to approach a physician to request increased sedation for an agitated patient out of fear of retaliation is represented in one article as a lack of courage.In this paper we offer a critical assessment of such invocations of courage. While we find courage to be an indispensable virtue in some challenging contexts, in other settings we find invocations of courage to be both an unfortunate endorsement of an oppressive status quo that can divert attention from the real problems and an undesirable and potentially destructive strategy within health care institutions whose goal is medically excellent and morally good clinical practice. As we shall argue, a call to virtuousness is not always virtuous. (shrink)

The essays in this book, by a variety of leading Augustine scholars, examine not only Augustine's multifaceted philosophy and its relation to his epoch-making theology, but also his practice as a philosopher, as well as his relation to other philosophers both before and after him. Thus the collection shows that Augustine's philosophy remains an influence and a provocation in a wide variety of settings today.

The advent of digital cameras has provided photographers, with varying levels of expertise, the opportunity to accumulate large repositories of digital images. However, this expansion has also brought the attendant difficulty of image retrieval. This paper reviews the considerable work already carried out on image retrieval and identifies critical constraints in attempting to handle the underlying semantics of photographic images. The authors address the issue of how an amateur photographer, storing several thousand images a year, can effectively and efficiently manage (...) a personal collection. A number of surprisingly simple techniques are proposed utilising a sparse lexical ontology alongside iconic visual clues to identify key representative events in the collection. The photographer’s associated knowledge and experience, often shared by others who are attuned to the context of the collection, are critical to the effective management of the images. The authors recommend the use of existing browsers and a simple keyword table to facilitate concise and effective image storage and retrieval. Photographers can further enrich the representation of their collection by clustering images in accordance with their perceived relevance and aesthetic qualities. The authors argue that these properties can also be exploited to enhance retrieval. (shrink)

Standard descriptions of thermodynamically reversible processes attribute contradictory properties to them: they are in equilibrium yet still change their state. Or they are comprised of non-equilibrium states that are so close to equilibrium that the difference does not matter. One cannot have states that both change and no not change at the same time. In place of this internally contradictory characterization, the term “thermodynamically reversible process” is here construed as a label for a set of real processes of change involving (...) only non-equilibrium states. The properties usually attributed to a thermodynamically reversible process are recovered as the limiting properties of this set. No single process, that is, no system undergoing change, equilibrium or otherwise, carries those limiting properties. The paper concludes with an historical survey of characterizations of thermodynamically reversible processes and a critical analysis of their shortcomings. (shrink)

Landauer’s principle is the loosely formulated notion that the erasure of n bits of information must always incur a cost of k ln n in thermodynamic entropy. It can be formulated as a precise result in statistical mechanics, but for a restricted class of erasure processes that use a thermodynamically irreversible phase space expansion, which is the real origin of the law’s entropy cost and whose necessity has not been demonstrated. General arguments that purport to establish the unconditional validity of (...) the law fail. They turn out to depend on the illicit formation of a canonical ensemble from memory devices holding random data. To exorcise Maxwell’s demon one must show that all candidate devices—the ordinary and the extraordinary—must fail to reverse the second law of thermodynamics. The theorizing surrounding Landauer’s principle is too fragile and too tied to a few specific examples to support such general exorcism. Charles Bennett’s recent extension of Landauer’s principle to the merging of computational paths fails for the same reasons as trouble the original principle. (shrink)

Landauer's Principle asserts that there is an unavoidable cost in thermodynamic entropy creation when data is erased. It is usually derived from incorrect assumptions, most notably, that erasure must compress the phase space of a memory device or that thermodynamic entropy arises from the probabilistic uncertainty of random data. Recent work seeks to prove Landauer’s Principle without using these assumptions. I show that the processes assumed in the proof, and in the thermodynamics of computation more generally, can be combined to (...) produce devices that both violate the second law and erase data without entropy cost, indicating an inconsistency in the theoretical system. Worse, the standard repertoire of processes selectively neglects thermal fluctuations. Concrete proposals for how we might measure dissipationlessly and expand single molecule gases reversibly are shown to be fatally disrupted by fluctuations. Reversible, isothermal processes on molecular scales are shown to be disrupted by fluctuations that can only be overcome by introducing entropy creating, dissipative processes. (shrink)

Einstein proclaimed that we could discover true laws of nature by seeking those with the simplest mathematical formulation. He came to this viewpoint later in his life. In his early years and work he was quite hostile to this idea. Einstein did not develop his later Platonism from a priori reasoning or aesthetic considerations. He learned the canon of mathematical simplicity from his own experiences in the discovery of new theories, most importantly, his discovery of general relativity. Through his neglect (...) of the canon, he realised that he delayed the completion of general relativity by three years and nearly lost priority in discovery of its gravitational field equations. I describe how Einstein’s other statistical papers of 1905 had already developed and exploited the idea that the ideal (...) gas law is another macroscopic signature of finitely many, spatially localized, independent components and that these papers in turn drew on his first two, “worthless” papers of 1901 and 1902 on intermolecular forces. However, while the ideal gas law was a secure signature of independence, it was harder to use as an indicator that there are finitely many components and that they are spatially localized. Further, since his analysis of the ideal gas law depended on the assumption that the number of components was fixed, its use was precluded for heat radiation, whose component quanta vary in number in most processes. So Einstein needed and found another, more powerful signature of discreteness applicable to heat radiation and which indicated all these properties. If stem cell-based therapies are developed, we will likely confront a difficult problem of justice: for biological reasons alone, the new therapies might benefit only a limited range of patients. In fact, they might benefit primarily white Americans, thereby exacerbating long-standing differences in health and health care.

Albany: State University of New York Press, 2007. xi + 228 pp.The existence of the “Universal Declaration of Human Rights by the World’s Religions” (UDHRWR) deserves to be more widely known, and this book not only reproduces the text, drawn up for a conference in Montreal to (...) mark the fiftieth anniversary of the UN’s Universal Declaration of Human Rights (UNUDHR, 1948), but offers a point-by-point comparison of the two documents by Frances Adeney and a series of papers that illuminate the issues raised by such declarations from very different points of view. The premise of the whole undertaking is that religious perspectives were not adequately represented in the UN Universal Declaration of Human Rights, though even this is questioned by some of the contributors. The UDHRWR explicitly mentions the right to change one’s religion, asserting in article 18 (1): “There shall be no compulsion in religion. It is a matter of choice,” and it includes “the rights of nature and the earth” (art. 29 [1]; see also 24 [2]). Article 12 (4 and 5) also asserts the duty and the corresponding right of not denigrating the religions of others. Article 16 (5) mentions monasticism as an institution worthy of protection alongside marriage. [End Page 172]In an extremely detailed examination of the work of the Third Committee, which brought the original UN document to the floor of the General Assembly, Sumner B. Twiss finds abundant evidence that religious issues were debated at great length, with great respect, and from a wide range of cultural and religious backgrounds. The committee included representatives of Christian, Confucian, Marxist, Hindu, Buddhist, and Muslim traditions, and Twiss claims that it is a mistake to regard the document they produced as either Western or secular in intent. The question of the relationship between rights and duties was thoroughly debated, as were the social dimensions of both and the underlying theological and ideological issues. Although religious terminology was eventually omitted, this was agreed in an atmosphere of exemplary tolerance and mutual understanding. Twiss concludes: “The UDHRWR is redressing a nonexistent problem presumably posed by the UDHR” (p. 69).Nevertheless, in the present context of the desecularization or resacralization of the world, a more explicit treatment of religious aspects of human rights seems appropriate, and the papers collected here raise problems that are still with us. Frances Adeney introduces several of them: the distinction between public and private spheres, the relative weighting given to creation and sin, and the relationship between rights and duties. The specifically Christian contribution to the debate, in her view, is the insistence on the universality of human rights derived from the biblical conception of the human as the “image of God,” so that “Christians through the ages have assigned a transcendent worth to human beings” (p. 20). The dimension of community is signaled by the extension of the covenant from ethnic group to faith community, thus linking the covenant family of God to the unity of humankind. Whether this link is strong enough to secure the universality of human rights, however, remains an open question.The Christian ethicist Max Stackhouse counterposes to this the “profound individualism” implicit in human rights thinking: it is this, rather than abstract or absolute universals, that lays the basis for civil society and, in its Christian variants, “provides the safest havens for non-Christian religions to flourish without political control” (p. 49). It is the rights of each individual, not of communitarian entities, that are to be respected. The religions tend to be particularistic, but this does not mean that the sources of human rights thinking are necessarily secular humanist. Stackhouse leaves us with two very significant questions: “... whether we can form a global civil society that does not have a theologically based inner moral architecture,” and whether “human rights principles become more effective without attention to their roots and justifying ultimate legitimations” (p. 50). Measuring neuronal activity with electrophysiological methods may be useful in detecting neurological dysfunctions, such as mild traumatic brain injury (mTBI). This approach may be particularly valuable for rapid detection in at-risk populations including military service members and athletes. Electrophysiological methods, such as quantitative electroencephalography (qEEG) and recording event-related potentials (ERPs) may be promising; however, the field is nascent and significant controversy exists on the efficacy and accuracy of the approaches as diagnostic tools. For example, the specific measures derived from an (...) electroencephalogram (EEG) that are most suitable as markers of dysfunction have not been clearly established. A study was conducted to summarize and evaluate the statistical rigor of evidence on the overall utility of qEEG as an mTBI detection tool. The analysis evaluated qEEG measures/parameters that may be most suitable as fieldable diagnostic tools, identified other types of EEG measures and analysis methods of promise, recommended specific measures and analysis methods for further development as mTBI detection tools, identified research gaps in the field, and recommended future research and development thrust areas. The qEEG study group formed the following conclusions: 1. Individual qEEG measures provide limited diagnostic utility for mTBI. However, many measures can be important features of qEEG discriminant functions, which do show significant promise as mTBI detection tools. 2. ERPs offer utility in mTBI detection. In fact, evidence indicates that ERPs can identify abnormalities in cases where EEGs alone are nondisclosing. 3. The standard mathematical procedures used in the characterization of mTBI EEGs should be expanded to incorporate newer methods of analysis including nonlinear dynamical analysis, complexity measures, analysis of causal interactions, graph theory and information dynamics. 4. and 5. are too long to include here. This article provides critical analysis of Aquinas’s designation of poverty as unqualifiedly evil. This paper provides an analysis of two different meanings of poverty: (a) in relation to things or to the external conditions in which people live and (b) in relation to an action in which people engage or are thwarted. Next, the paper discusses the sense in which poverty is an evil—and particularly, an unqualified evil—in relation to both of these meanings of poverty. Since Aquinas claims that poverty (...) is an unqualified evil so far as it prevents people from attaining the ends of sustaining themselves and assisting others, the final section of the paper discusses possible interpretations of these ends, suggesting that each end can be taken in a narrow, minimalist or subsistence sense and a broader, more holistic or contextualized sense. The parahippocampal cortex and hippocampus are brain structures known to be involved in memory. However, the unique contribution of the parahippocampal cortex remains unclear. The current study investigates memory for object identity and memory of the configuration of objects in patients with small thermo-coagulation lesions to the hippocampus or the parahippocampal cortex. Results showed that in contrast to control participants and patients with damage to the hippocampus leaving the parahippocampal cortex intact, patients with lesions that included the right parahippocampal cortex (...) (RPH) were severely impaired on a task that required learning the spatial configuration of objects on a computer screen; these patients, however, were not impaired at learning the identity of objects. Conversely, we found that patients with lesions to the right hippocampus (RH) or left hippocampus (LH), sparing the parahippocampal cortex, performed just as well as the control participants. Furthermore, they were not impaired on the object identity task. In the functional Magnetic Resonance Imaging (fMRI) experiment, healthy young adults performed the same tasks. Consistent with the findings of the lesion study, the fMRI results showed significant activity in the RPH in the memory for the spatial configuration condition, but not memory for object identity. Furthermore, the pattern of fMRI activity measured in the baseline control conditions decreased specifically in the parahippocampal cortex as a result of the experimental task, providing evidence for task specific repetition suppression. In summary, while our previous studies demonstrated that the hippocampus is critical to the construction of a cognitive map, both the lesion and fMRI studies have shown an involvement of the RPH for learning spatial configurations of objects but not object identity, and that this takes place independent of the hippocampus. St. Ottilien: EOS-Verlag, 2001. 179 pp. The papers collected here represent a significant step forward in European scholarship on Buddhist-Christian relations. As Perry Schmidt-Leukel remarks in his helpful introduction, they are an experiment in correlating auto-interpretation and hetero-interpretation, introspection and extrospection.Each of the first (...) three sections—on China/Japan, Southeast Asia, and Europe—begins with a historical study. Iso Kern clears up some misconceptions about the Jesuits' approach to mission work in China, stating that they did in fact preach Jesus crucified (37) and the doctrine of Atonement (41) in the face of a grave danger that Christianity would simply be absorbed into Buddhism (33). Whereas Buddhism had no specifically religious clash with the state, Christianity did, and this was eventually sealed by martyrdom in both China and Japan. Introducing part 2, Heinz Murmel gives a sober reassessment of the vehement controversies between a certain segment of Buddhism and a certain type of Christianity in Ceylon. Only the high-caste highland nikayas were protected by the British (63); the more popular, rural Buddhists of the lowlands felt excluded and threatened and gave rise to what became known as "Protestant Buddhism." The "great debates" between bitterly anti-Christian monks and Protestant clergymen were not as important as the records may suggest, and even the fiery Anagarika Dharmapala later disclosed that he felt great devotion to Jesus. Finally, Frank Usarski reviews the heated debates between ill-informed Christians and overaggressive Buddhist converts such as Karl B. Seidenstucker as Buddhism established itself in Germany in the early decades of the twentieth century. The History of Religions school seemed to suggest that Christianity was culturally inferior to Buddhism, which was allegedly proved by Christian attitudes to [End Page 178] vegetarianism and the general anti-intellectualism of Christianity. Christianity was inauthentic, derivative, "Buddhism in Jewish garments" (120).Yet even Seidenstucker, the renegade Protestant, converted to Catholicism toward the end of his life.Each historical contribution is followed by an essay on the contemporary situation in the three regions, and these vary greatly in substance. Shizuteru Ueda offers a profound meditation on the significance of Keiji Nishitani for Buddhist approaches to Christianity. If Nietzsche posed the fundamental question of "life without why " (44-45), the thought of Meister Eckhart contains the answer (curiously, Ueda insists that this answer must be European, because Europe "determines the world" [47]). The "ground" on which we stand, interpreted as Nishida's "place (basho) of nothingness," is "ground-less." This is not nihilism but the overcoming of nihilism by nihilism, the shûnyatâ of shûnyatâ (46). Jesus as the Christ is the God/man and therefore the mediator, the absolute in history (53). He occupies the "place" (basho) of infinite openness, unconditioned ultimacy (55). He is thus unique, but not universal: the ultimate "for me" is not necessary "for the whole of mankind" (56). The actual encounter between Buddhist and Christian absolutes takes place in silence.Santikaro Bhikkhu, the friend and translator of Buddhadâsa Bhikkhu in the last eight years of his life, tells how his mentor gradually overcame his initial suspicion ofChristianity, perhaps because he was not confronted with colonial oppression as Dharmapala was in Ceylon. Distinguishing between "people language" and " dhamma language," he eventually arrived at a certain equivalence between the Christian God and Buddhist dhamma understood as a nonpersonal, nondual transcendent that is nevertheless not outside nature (85, 90). What Jesus the Teacher of Wisdom offers in the Sermon on the Mount, if practiced, is sufficient for salvation (93). In the perspective of dhamma language, however, the God of Christian convention is conditioned, and Jesus as Son of God cannot be unique. Though inconclusive and sometimes obscure because of Buddhadâsa's indifferent grasp of English, this is surely an astonishing journey for one who tried to understand each tradition, including his own, from the sources. There follow clarifications of my understanding of Derrida‘s atheism and of my suggestion that he is a natural law theorist. Finally, I argue that my own position of a faith that cannot convert itself into sight a) places no a priori constraints on what we can say about (...) In this first part of a two-part paper, we describe efforts in the early decades of this century to restrict the extent of violations of the Second Law of thermodynamics that were brought to light by the rise of the kinetic theory and the identification of fluctuation phenomena. We show how these efforts mutated into Szilard’s proposal that Maxwell’s Demon is exorcised by proper attention to the entropy costs associated with the Demon’s memory and information acquisition. In the second part (...) we will argue that the information theoretic exorcisms of the Demon provide largely illusory benefits. According to the case, they either return a presupposition that can be had without information theoretic consideration or they postulate a broader connection between information and entropy than can be sustained. In this second part of our two-part paper we review and analyse attempts since 1950 to use information theoretic notions to exorcise Maxwell’s Demon. We argue through a simple dilemma that these attempted exorcisms are ineffective, whether they follow Szilard in seeking a compensating entropy cost in information acquisition or Landauer in seeking that cost in memory erasure. In so far as the Demon is a thermodynamic system already governed by the Second Law, no further supposition about information and entropy (...) is needed to save the Second Law. In so far as the Demon fails to be such a system, no supposition about the entropy cost of information acquisition and processing can save the Second Law from the Demon. (shrink)

The United States is at a crossroad in its treatment of Chapter 11 of the Bankruptcy Code, which deals with reorganization of bankrupt organizations. It is vital that the issues surrounding the debate be properly framed. This paper attempts to do just that by reviewing the evolution of bankruptcy law, assessing the impact of Chapter 11 leniency on societal stakeholders, considering bankruptcy as a strategic option, and addressing the ethical and societal issues that arise from the use of Chapter 11 (...) to avoid massive litigation or to abrogate labor contracts.
