Free software introduces a challenge to the classical conception of individual rights. The model of software licensing given by the General Public License generates the question whether it constitutes an exercise or a wavering of copyright. It is argued in this paper that the later alternative is entrenched in the classical concept of freedom as autonomy, which, by its turn, is reflected in a classical conception of individual rights based on the model of propriety as a dominion over an exclusive (...) object (res). We provide grounds for a concept of non-exclusive individual rights, based on the notion of freedom as reciprocity, in order to obtain more solid legal foundations for the free licensing of software. The concept of freedom as reciprocity and the corresponding reconstruction of non-exclusive subjective rights achieved in this paper is an exercise in general theory of law and thus may be applied to other legal fields where the classical notion of freedom and the property of exclusivity do not fit properly. La historia constitucional brasileña apunta para una lógica liberal y una práctica autoritaria desde la Constitución del Imperio (1824). Este hibridismo constitucional explica algunas dificultades en el paso del Estado de Derecho al Estado Social y su complicada síntesis en el Estado Democrático de Derecho de la Constitución actual. El problema está en el modo como las exigencias del Estado Social se hagan dentro de la ley y no por medio de una práctica autoritaria.

Para o direito, o poder é legítimo quando se subordina às regras jurídicas em vigor. Para o poder, o direito é válido na medida em que se torna instrumento da dominação. As relações entre o direito e o poder têm sido objeto das mais diferentes abordagens na sociologia, política ou filosofia. Entre os estudiosos do direito, contudo, o assunto não tem recebido a devida atenção. Infelizmente, porque a contribuição dos juristas para a discussão é bastante peculiar e, portanto, insubstituível. Este (...) livro resulta das reflexões de um profissional do direito sobre um dos mais relevantes aspectos suscitados pelo tema. Nele, discute-se como a produção do conhecimento jurídico é influenciada pelo poder, em uma sociedade capitalista. Depois de apresentar um panorama significativo da teoria política, de Hobbes e Foucault, passando por Weber e os marxistas, o autor centra a sua análise nos fundamentos jurídicos típicos do capitalismo (igualdade, legalidade e legitimidade), para examinar a forma pela qual a doutrina do direito é instrumentalizada na reprodução do poder, e, em certa medida, reage sobre este para ampliá-lo. Com o presente trabalho, Fabio Ulhoa Coelho, professor de direito comercial e de lógica jurídica da Pontifícia Universidade Católica de São Paulo, obteve por esta instituição o título de doutor em direito. Da Banca Examinadora, que o aprovou com distinção, participaram os juristas Tércio Sampaio Ferraz Jr. (orientador), Dalmo de Abreu Dallari, Celso Bastos, Maria Helena Diniz e Eros Roberto Grau. Em razão do seu aprofundamento, abrangência e atualidade, esta obra não pode faltar na bibliografia das disciplinas de teoria geral do estado e filosofia do direito, em nível de graduação ou pós-graduação, interessando também aos estudiosos das demais áreas das ciências humanas. Introduction Context: In Portugal assisted death was approved in February 2020 by the Parliament, although the law is not yet in force. Objectives To find out what doctors think about those practices. Methods A link to a questionnaire was sent by email three times, at intervals of one week, to the doctors registered in the Northern Section of the Portuguese Medical Association, before the Parliamentary approval. Results The questionnaire was returned by 1148 physicians. A minority of doctors would practice a (...) form of assisted death under the present law or if it was legalized, but a higher percentage think that euthanasia should be legalized, and more would like to have that option if they themselves were in a terminal phase of a disease. Religion has a strong influence on the attitudes of doctors, so too does their contact with patients in a terminal phase, as doctors who deal with more patients with far advanced diseases are more likely to be unfavorable to assisted death. On the other hand, younger doctors are more in favor of these practices. Conclusion The small percentage of questionnaires sent back is a weakness in this study and casts doubts on the generalizability of the conclusions. However, this is, so far, the best approximation to the opinions of Portuguese doctors on assisted death. (shrink)

Com base na crítica que Hume faz ao argumento do desígnio, especialmente nas partes 10 e 11 dos Diálogos sobre a Religião Natural, meu objetivo neste artigo é, a partir de uma análise da relação entre a existência do mal no mundo e a suposta existência de uma divindade possuidora dos atributos tradicionais do teísmo, defender a tese segundo a qual o tratamento que Hume dá ao problema do mal corresponde, digamos assim, à cartada final – o último e decisivo (...) recurso que Philo personagem que articula essa crítica) aciona para mostrar que o argumento do desígnio não fornece bases suficientemente sólidas e consistentes para dar suporte à crença na existência de um Deus maximamente poderoso, justo e benevolente; e que, portanto, a existência do mal no mundo tem uma força argumentativa tal que a improbabilidade da existência de Deus é maior do que com base nos argumentos apresentados nas partes 2 a 8 dos Diálogos. Isso significa que eu tomo aqui o problema do mal como o maior problema para o teísta experimental – cuja argumentação pretende provar a existência de Deus a partir da observação dos fenômenos do mundo. This paper discusses the post-trial access to drugs for patients who participated in clinical trials in Brazil. The ethical guidance for clinical trials in Brazil is arguably one of the clearest in the world in attributing to research sponsors the responsibility for providing post-trial drugs to patients who participated in their experiments. The Federal Constitution recognizes health as a fundamental right to be fulfilled by the State. Based on the Brazilian constitution and on the National Health Council resolutions, courts have (...) been accepting patients' claims and ordering the State and the pharmaceutical companies to provide these patients with the tested treatment in the quantity and duration they need it. This generous interpretation of the duties of the pharmaceutical companies and the State makes the Brazilian model for post-trial access unique when compared to the experience of other countries and thus should be followed with attention by future research in order to assess its consequences for patients, research sponsors, and the public health system. As health policy-makers around the world seek to make progress towards universal health coverage, they must navigate between two important ethical imperatives: to set national spending priorities fairly and efficiently; and to safeguard the right to health. These imperatives can conflict, leading some to conclude that rights-based approaches present a disruptive influence on health policy, hindering states’ efforts to set priorities fairly and efficiently. Here, we challenge this perception. We argue first that these points of tension stem largely from inadequate (...) interpretations of the aims of priority setting as well as the right to health. We then discuss various ways in which the right to health complements traditional concerns of priority setting and vice versa. Finally, we set out a three-step process by which policy-makers may navigate the ethical and legal considerations at play. (shrink)

This paper discusses so-called post-trial access to drugs for patients who participated in clinical trials in Brazil. Brazil is currently a relevant country for the pharmaceutical industry due to the dimensions of its actual and potential market. As a consequence, the number of pharmaceutical trials has been rising. It is the largest market for pharmaceutical companies in Latin America, the 8th biggest in the world and second only to China among the so-called BRICS’s emerging countries. The demand for pharmaceutical products (...) in the country has been increasing by double digits over the last few years, reaching 20% in 2008. Not surprisingly, we are also witnessing a steady increase in the number of applications by national and international pharmaceutical companies before ethical research authorities for authorization to perform clinical trials of drugs. O objetivo desse artigo é analisar a projeção visual do México Revolucionário no Brasil entre os anos de 1910 e 1950. Essa projeção ocorre através da fotografia, pintura mural e gravura. Essas imagens conformam um patrimônio visual que constitui uma plataforma de propaganda política e busca de legitimidade do México Revolucionário. Analiso as imagens como um vetor de intercâmbio do imaginário latino-americano, possibilitada por publicações, exposições e redes de sociabilidade de artistas e intelectuais.

QUEM É MESMO EMPREGADO? DILEMAS DA SUBORDINAÇÃO JURÍDICA E O RETORNO DA DEPENDÊNCIA.

O presente texto parte de um diálogo com um artigo publicado recentemente na revista HOPOS (Journal of the International Society for the History of Philosophy of Science), de autoria dos pesquisadores Fons Dewulf e Massimiliano Simons, intitulado “Positivism in Action: The case of Louis Rougier” (2020). No artigo, os pesquisadores abordam a trajetória pouco frequentada de Louis Rougier, filósofo francês cuja fortuna crítica associou-se à sua participação na rede de intelectuais liberais do pós-guerra e a sua função central na organização (...) do Colóquio Walter Lippmann, ainda em 1938. Os autores abordam a trajetória de Rougier de maneira disciplinarmente inusual: procuram interpretar suas teorias filosóficas à luz de seus comprometimentos políticos, defendendo uma imbricação entre ambas as facetas do pensamento de Rougier. Quero sugerir que uma abordagem disposta a compreender as relações dinâmicas entre uma trajetória intelectual e seu entorno social se beneficia de uma abordagem como essa, às quais pode ser acrescida uma dimensão propriamente institucional das trajetórias intelectuais. Para observá-la, proponho acionar o debate sobre virtudes epistêmicas tal como tem sido pensado por autores como Herman Paul, Lorraine Daston e J. Dongen, com o objetivo de investigar se o debate sobre as non-textual things da atividade intelectual podem ser um caminho para transitar de forma profícua entre texto e contexto. O presente artigo constitui, antes de mais, uma exposição da tentativa feita por Maurice Merleau-Ponty de sistematização de um método psicológico convergente com algumas das principais metas estabelecidas pela Fenomenologia de inspiração husserliana. Constatando de que modo o autor da Fenomenologia da Percepção considera os diversos âmbitos da cultura, a começar pela arte e pela psicanálise, como indicadores da decadência do cartesianismo, o artigo analisa o estatuto da ciência justamente como uma das esferas culturais das quais é possível extrair categorias (...) que exprimam de forma mais precisa e rigorosa o real, mostrando-se de que modo as investigações científicas são indispensáveis para uma identificação dos temas a serem filosoficamente tratados, pois os dados obtidos por tais pesquisas são imprescindíveis para o trabalho filosófico enquanto tal Neste sentido, o autor propõe uma relação entre Filosofia e Ciência que não é mais uma relação de hierarquização, tal como defendia Husserl, mas sim uma de complementaridade, tal como defendia Bergson. Com efeito, postulando-se a não necessidade de fragmentar o real para que se legitime um tal acordo, ou seja, dado que a cisão entre o espiritual e o material não pode mais ser mantida, o artigo sublinha a absoluta necessidade de que Filosofia e Ciência se encontrem. Por outras palavras, a integração entre ambas não depende de que uma e outra se refiram à mesma, e justa, metade da realidade, mas tão-somente que cada uma delas remeta para a mesma camada fenomenal, seja para descrever cientificamente os organismos em seu contacto com o meio seja para expor filosoficamente a nova ontologia ali contida. Em suma, o artigo mostra até que ponto, apesar de realizar a intenção bergsoniana de integrar explicação quantitativa e descrição qualitativa e assimilar a crítica de Husserl ao objectivismo, o método fenomenoló-gico não esgota a tarefa ontológica da filosofia. /// The present article analyzes de attempt made by Maurice Merleau-Ponty in order to systematize a psychological method convergent with some of the main goals established by the phenomenological movement issued from HusserL Taking into account the way in which the author of the Phenomenology of Perception considers the different realms of the cultural sphere, beginning with art and psychoanalysis, as special indicators of cartesianisms decadence, the article analyses the statute of science inasmuch as it is one of the cultural spheres from which it is possible to extract the categories that express in a more precise and rigorous way the real, whereby it is shown in what way scientific research is indispensable for an identification of the themes to be treated philosophically. In this sense, the author proposes a relation between Philosophy and Science that is no more one of hierarchysation, as defended by Husserl, but one of complementarity, such as defended by Bergson. By postulating that there is no longer a necessity for a fragmentation of the real so that such an accord between Philosophy and Science could be reached, and this precisely since there is no longer a way of maintaining a division between the spiritual and the material, the article underlines the necessity that Philosophy and Science must come together. In other words, the integration between the Wo no longer depends of the fact that one and the other refer to the same portion of the real, but only of the capacity that each one of them has of referring to the same set of phenomena, being that in order to achieve a scientific description of organisms in contact with the environment or being that in order to advance a philosophical exploration of the new ontology in it contained. Above all, the article shows the measure in which, regardless of the fact that the methodological approach of phenomenology realizes the bergsonian intention of an integration of quantitative explanation and qualitative description, it. cannot properly be said that such method exhausts the ontological task of Philosophy. Anthropology as Counter-Science. Neste artigo, acompanha-se a formulação do projeto filosófico de Merleau-Ponty em suas primeiras obras, frisando a necessária reforma da fenomenologia husserliana para que os temas existenciais pudessem ser contemplados pela investigação. Porém, uma vez centrada a feno-menologia nas vivências particulares, surge o problema da validade geral das suas teses, cuja resolução pede a extensão da necessidade até a experiência concreta.In this article, I discuss the formulation of Merleau-Ponty’s philosophical project in his early writings and stress the necessary reform of the (...) husserlian phenomenology in order to embrace existential themes. However, once the phenomenology is centered in the particularly experiences, the problem of the general validity of its thesis arises, and the solution requires the expansion of the necessity to the concrete experience. In this article are discussed some problems raised by T. S. Rukmani regarding the Yogasūtra. According to Rukmani, yoga is not a coherent logical system. After stating the general goals of the yoga system, interpretations of some passages of the Yogasūtra are formulated, and the defense is given that one must at least acknowledge the necessity of more exegetical investigation before judging the logical incoherence of the text. Finally, the problematic doctrine of living liberation in Yogasūtra is exposed.

The metamemory approach to memory confidence was extended and elaborated to deal with semantic memory tasks. The metamemory approach assumes that memory confidence is based on the products and processes of a completed memory task, as well as metamemory beliefs that individuals have about how their memory products and processes relate to memory accuracy. In two experiments participants were asked deceptive and nondeceptive questions involving geographical information. In both experiments, as predicted by the metamemory approach to memory confidence, there was (...) a positive confidence/ accuracy relationship for nondeceptive items and a negative relationship for deceptive items. Experiment 2 used items that constrained the memory strategies (e.g., hierarchical reasoning about spatial location) used by the participants. The results supported the hypothesis that the participants were aware of the levels of memory accuracy associated with the different strategies and used that information to generate their memory confidence judgments. Mas as reflexões de Hume sobre a política nem sempre tiveram a atenção que merecem, situação que ultimamente vem se revertendo graças a uma série de estudos que iluminam a sua importância. É por isso mais que oportuna a publicação desta edição dos Ensaios, enriquecida com o estudo de João Paulo Monteiro, que, de forma pioneira em língua portuguesa, soube situar o interesse de Hume pela (...) política no quadro mais amplo de suas preocupações filosóficas, bem como mostrar a relevância de sua ciência política, entendida como uma ciência do possível, fundada na experiência histórica, dedicada ao estudo das leis constitucionais e de seus efeitos sobre a sociedade, de forma comprometida com as questões e impasses políticos de seu tempo. O presente trabalho tem como objetivo compreender as contribuições da perspectiva teórico-metodológica da pesquisa-ação colaborativo-crítica na formação acadêmica e profissional dos autores de dissertações de um grupo de pesquisa. Assim, toma a perspectiva teórica de Jürgen Habermas, baseada nos conceitos de discurso e atos de fala. Assim, o discurso assume a forma de argumentação, de acordo com que os participantes argumentam sobre uma pretensão de validade criticável colocada em diálogo. Fundamenta-se na pesquisa qualitativa do tipo estudo de caso, que busca (...) nos espaços discursivos individuais e coletivos articular com seus participantes, um lugar onde todos têm o direito de falar e colocar seus entendimentos de forma racional, apresentando suas ideias e construindo pela via do diálogo argumentos fortes para chegar a um entendimento mútuo. Procura-se captar por meio dos espaços discursivos, as perspectivas teórico-metodológicas da pesquisa-ação colaborativo-crítica presente nas dissertações, os “silenciamentos” presentes e intencionalidades que permeiam os objetivos das propostas de pesquisa. A partir dos espaços constituídos, foi possível perceber que os autores construíram suas pesquisas coletivamente, sendo os conceitos de colaboração, participação e escuta primordiais para dar continuidade aos movimentos desencadeados. Neste sentido, a utilização da pesquisa-ação como perspectiva teórico-metodológica contribuiu para fundamentar as relações ao longo dos processos de pesquisa. Sobretudo os sujeitos puderam vivenciar a pesquisa como um todo, não apenas metodologicamente, mas teoricamente pela via comunicativa. Sendo assim, por meio da comunicação há uma mudança social, sendo possível estabelecer reflexões profundas do mundo da vida intersubjetivamente partilhado pelos sujeitos. (shrink)

Artificial intelligence has been adopted in a wide range of domains. This shows the imperative need to contribute to making citizens insightful actors in debates and decisions involving the adoption of AI mechanisms. Currently, existing approaches to the teaching of basic AI concepts through programming treat machine intelligence as an external element/module. After being trained, that external module is coupled to the main application. Combining block-based programming and WiSARD weightless artificial neural networks, this article presents the conceptualization and design of (...) a new methodology, AI from concrete to abstract, to endow general people with a minimum understanding of what AI means. The main strategy adopted was to include AI training and classification primitives as blocks that compose an otherwise conventional computer program. This way, the programmer can use these blocks as he/she uses other programming constructs. In order to achieve this purpose, we also propose BlockWiSARD, a block-based programming environment designed to promote the demystification of artificial intelligence via practical activities related to the development of learning machines, as well as through the observation of their learning process. As a beneficial side effect of BlockWiSARD, the difference between a program capable of learning from data and a conventional computer program becomes more evident. In addition, the simplicity of the WiSARD weightless artificial neural network model enables easy visualization and understanding of training and classification tasks internal realization. (shrink)

This book addresses the principle of proportionality, which is currently one of the most important instruments of judicial review, from both analytical and theory of law perspectives. As such, the analysis provided is far more comprehensive and can be applied to all areas of law, not just constitutional law. On the one hand, the volume offers a broad perspective on several aspects related to proportionality, such as its structure, the balancing methodology and the distinction between rules and principles. The main goal of this work is to place the Regional History of Education into the broader context of general history and to create a theoretical structure that includes its main approaches and characteristics while avoiding the frequent confusions and oversights with which it is often associated. Our outline of regional history alludes to its conceptual foundations, defines the object of its analysis and also identifies the convergence of factors that shape this area of study, such as genealogy, multicentrism, comparison (...) and social synthesis. Once these different aspects have been described it will be easier to understand that the past is not only a dependent variable of time but also, to a great degree, of space. (shrink)

El presente trabajo parte del planteamiento del enfoque radical e inclusivo en el que, entre otros aspectos, se señala que hay determinados temas, denominados radicales, que no son socialmente demandados, pese a que su inclusión en educación es clave para la formación. Este es el caso del “amor”, un tema que no se suele tener en cuenta, aunque se puede intuir su impacto significativo en nuestra educación. Desde este enfoque, se entiende el amor como opuesto al egocentrismo, y considera la (...) importancia de incluir estos temas como forma de alcanzar una educación plena. Por ello, nuestro trabajo se centra en comprobar la presencia de este tema radical (el amor) en la legislación educativa vigente en España. El estudio se realiza a través de una metodología de análisis documental, considerando la normativa referente al desarrollo curricular de la Ley Orgánica 3/2020 (LOMLOE), así como sus concreciones a nivel autonómico, utilizando como unidades de análisis la palabra amor y derivadas. El análisis se realiza a través de técnicas cuantitativas, registrando la frecuencia de la presencia del concepto en los Reales Decretos por los que se establecen la ordenación y las enseñanzas mínimas, así como en los documentos derivados del desarrollo posterior que realizan de estas normas las comunidades autónomas en las diferentes etapas educativas (Infantil, Primaria, Secundaria Obligatoria y Bachillerato), asimismo se atendió a los ámbitos de conocimiento donde está este término presente. Los resultados obtenidos indican que el marco normativo curricular estatal y autonómico apenas incluye el concepto amor. Por este motivo, este estudio detecta que los temas relacionados con el amor no son prioritarios en los documentos analizados, por lo que se plantea la necesidad de que desde el ámbito educativo se incluya en los currículos, de las diferentes etapas educativas, el tema del amor que es primordial para la formación. Partindo do presuposto de que Heidegger foi o autor que mais influenciou a obra de Hans-Georg Gadamer, o presente artigo visa esclarecer os contornos desta influência, analisando alguns dos principais temas do pensamento gadameriano, a saber: a historicidade da existência humana, a reabilitação da categoria do preconceito, a arte, a linguagem e a verdade. Mostra ainda como a orientação humanista de Gadamer constitui o principal ponto de divergência relativamente a Heidegger. Defende, por conseguinte, que a hermenêutica filosófica de Gadamer pode (...) ser interpretada como uma apropriação humanista do pensamento heideggeriano. /// Taking for granted that Heidegger was the author that most deeply influenced Gadamer's work, the present article aims at a clarification of such influence by examining some of the key themes of Gadamer's thought: the historicity of human existence, the rehabilitation of prejudice, as well as the reflection on art, language, and truth. The article explains thus how Gadamer's humanism constitutes the main point of divergence from Heidegger. It claims, moreover, that Gadamer's philosophical hermeneutics can be considered a humanistic appropriation of Heidegger's thought. (shrink)
