Recht impliziert Rechthaben. Wer Recht setzt oder sich darauf beruft, glaubt in der Regel, daß er recht hat. Vom Rechthaben aber ist es nicht weit zur Rechthaberei, in der eine Intensivierung des Rechthabens gesehen werden kann. Da diese nun beim Kampf ums Recht mehr oder weniger natürlich erscheint, kann man meinen, Recht beruhe im Grunde auf Rechthaberei. Das aber weist zu einer Kritik des Rechtsbegriffs, denn Intensivierungen gehen meist über das dem Normalen gemäße Maßvolle hinaus.Nach Ausführungen über die der Rechthaberei (...) allgemein angelasteten Übel wird hier die dem Juristischen eigene Rechthaberei behandelt. Sie ist am deutlichsten und bedenklichsten bei modernen rechtsetzenden Ereiferungen in Gesetzen, Verordnungen und Anordnungen, aber auch Gewohnheitsrecht und Naturrecht sind von ihr nicht frei.Neben Rechthabereien beim Schaffen verbindlicher Rechtsnormen werden diese beim Berufen auf solche Normen untersucht. Gerechtfertigt wie sie im Interesse der einzelnen Menschen und der Rechtsordnung auch sein mögen, sollte man nicht vergessen, daß das Recht als bloßes Menschenwerk bloß ein ethisches Minimum ist, erdgebunden aber nicht notwendig ehrverbunden, und deshalb von üblen Rechthabereien auch im Rechtsverkehr absehen.Zum Wohle des Rechten kommt man so vielleicht zu einem von Rechthabereien immer mehr erlösten Recht.Die hier aufgezeigten Probleme wurden in der Hoffnung angeschnitten, rechthaberischen Versuchungen nicht erlegen zu sein. Informed consent is a central concept for empirical and theoretical research concerning pregnancy management decisions and is often taken to be one of the more fundamental goals of the profession of genetic counseling. Tellingly, this concept has been seen by disability communities as salutary, despite longstanding critiques made by disability activists, advocates, and scholars concerning practices involved in genetic counseling more generally. In this chapter, we show that the widespread faith in informed consent is misleading and can be detrimental to (...) the practice of genetic counseling as guided by concerns of justice and equity. We proceed in two steps. First, we explain how informed consent is flawed as a practical concept. Second, we show how the inadequacy of informed consent illuminates the animating core of disability critiques of genetic counseling: the issue of ableism. We argue that the problem of ableism cannot be solved with informed consent because it is not merely a problem of information, but also of epistemic schemas. We suggest that what we call critically informed consent is better suited to move genetic counseling from being aware of the problem of ableism to becoming actively anti-ableist. (shrink)

The conceptual spaces approach has recently emerged as a novel account of concepts. Its guiding idea is that concepts can be represented geometrically, by means of metrical spaces. While it is generally recognized that many of our concepts are vague, the question of how to model vagueness in the conceptual spaces approach has not been addressed so far, even though the answer is far from straightforward. The present paper aims to fill this lacuna.

Seven unknown letters from 1823 to 1831 are published. The famous discoverer of the mammal's egg and founder of the modern embryology Karl Ernst von Baer (1792–1876), born as a German in Estonia and then anatomist and zoologist at Königsberg University, wrote them to his publisher Ludwig F. Froriep in Weimar and his son and successor. Robert F. Baer offered his co-work with a dictionary of natural history (which he criticized), he proposed a map of all research voyages everywhere in (...) the world, and he sent a few small papers about local birds. Compassionate care: a moral dimension of nursingThis paper focuses on the concept of compassion and its meaning for nursing practice. Compassion is often considered to be an essential component of nursing care; however, it is difficult to identify what exactly comprises compassionate care. To begin with, there is a general discussion of the meaning of compassion and an examination of its common usage. An argument then is presented that compassion is more than just a natural response to suffering, rather that (...) it is a moral choice. The paper outlines the extent to which this concept has implications for nursing care, highlighting some of the obstacles that nurses need to overcome in order to maintain this essential moral value of the caring role. The selections contained in these volumes from the papers and letters of Leibniz are intended to serve the student in two ways: first, by providing a more adequate and balanced conception of the full range and penetration of Leibniz's creative intellectual powers; second, by inviting a fresher approach to his intellectual growth and a clearer perception of the internal strains in his thinking, through a chronological arrangement. Much confusion has arisen in the past through a neglect of the develop ment (...) of Leibniz's ideas, and Couturat's impressive plea, in his edition of the Opuscu/es et fragments (p. xii), for such an arrangement is valid even for incomplete editions. The beginning student will do well, however, to read the maturer writings of Parts II, III, and IV first, leaving Part I, from a period too largely neglected by Leibniz criticism, for a later study of the still obscure sources and motives of his thought. The Introduction aims primarily to provide cultural orientation and an exposition of the structure and the underlying assumptions of the philosophical system rather than a critical evaluation. I hope that together with the notes and the Index, it will provide those aids to the understanding which the originality of Leibniz's scientific, ethical, and metaphysical efforts deserve. (shrink)

Reinhold Niebuhr's concept of ideology, a synthesis of the doctrine of sin and sociology of knowledge, denotes any claim to absolute truth with reilsvested interests. Tolerance, its anonym, is based on an acknowledgement of one's own fallibity and need for forgiveness. Niebuhr thus intertwines Luther's two »realms«, without mixing them up. His theory is deemed a major contribution to both theology and political science.

This paper presents a holistic, contextualised case study of reintegration and trust repair at a UK utilities firm in the wake of its fraud and data manipulation scandal. Drawing upon conceptual frameworks of reintegration and organizational trust repair, we analyze the decisions and actions taken by the company in its efforts to restore trust with its stakeholders. The analysis reveals seven themes on the merits of proposed approaches for reintegration after an integrity violation , and novel insights on the role (...) of organizational identity, “changing of the guard” and cultural reforms alongside procedural modifications. The case further supports the dynamic nature of stakeholder salience across the reintegration process. The study both supports propositions from existing frameworks and suggests novel theoretical extensions for future research. (shrink)

The comparator-model, originally developed to explain motor action, has recently been invoked to explain several aspects of the self. However, in the first place it may not be used to explain a basic self-world distinction because it presupposes one. Our alternative account is based on specific systematic covariation between action and perception. Secondly, the comparator model cannot explain the feeling of ownership of thoughts. We argue—contra Frith and Campbell—that thoughts are not motor processes and therefore cannot be described by the (...) comparator-model. Rather, thoughts can be the triggering cause (intention) for actions. An alternative framework for the explanation of thought insertion in schizophrenics is presented. (shrink)

In virtue of what do we enjoy episodes of pleasure? According to the phenomenological theory of pleasure, we enjoy pleasures in virtue of having certain kinds of phenomenal experiences. According to the attitude theory of pleasure, we enjoy pleasures in virtue of having a certain kind of pro-attitude. In this chapter, we show that the attitude theory faces a dilemma. The attitude that is relevant to pleasure—the desire, liking, or favoring—is either necessarily co-instantiated with certain phenomenology, or not. If the (...) attitude theorist denies that the relevant attitudes are phenomenologically enriched in this sense, then their theory has the problematic implication that pleasure can come radically apart from phenomenology. This leads to a *problem of hedonic inversion*. If the attitude theorist instead affirms that the relevant attitudes are phenomenologically enriched, then they undermine their main objection to the phenomenological theory of pleasure. This is the so-called *heterogeneity problem*, according to which pleasures do not feel alike. Either way, the attitudinal theorist faces a difficult challenge in their ongoing debate with phenomenological theorists. (shrink)

In this paper, I present and explore some ideas about how factive emotional states and factive perceptual states each relate to knowledge and reasons. This discussion will shed light on the so-called ‘perceptual model’ of the emotions.

The ‘mineness’ of thoughts has often been accepted as indubitable in philosophy. However, the symptom of thought insertion in schizophrenia seems to be an empirical counterexample to the dictum that every introspected thought is one's own. We present a thorough conceptual analysis of mineness of thought, distinguishing between ownership and authorship . We argue that it is indeed a conceptual truth that introspected thoughts are owned by the introspector. However, there are everyday and pathological cases of thoughts, for which we (...) do not ascribe authorship to ourselves. To explain inserted thoughts, however, we need an additional factor which is constituted by the lack of control over inserted thoughts . We present a review of empirical data on thought control and thought insertion in the light of the conceptual analysis. We conclude with a summary of the most important future direction of research. One oft the most fascinating abilities of humans is the ability to become conscious of the own physical and mental states. In this systematic investigation of self-consciousness, a representational theory is developed that is able to distinguish between different levels of self-consciousness. The most basic levels are already present in such simple animals as ants. From these basic forms, which are also relevant for adult human self-consciousness, high-level self-consciousness including self-knowledge can arise. Thereby, the theory is not only able to (...) integrate developmental considerations but also to sharply distinguish different aspects of the complex phenomenon self-consciousness. Pathological breakdowns of these different aspects, as they can be found in schizophrenia, are explained by specific impairments on different levels of self-representation. In this way, the work shows that a naturalistic theory of self-consciousness is possible, if the analysis starts with very simple and basic mechanisms instead of starting on the »top of the iceberg«. Pattern-based reasons are reasons for action deriving not from the features of our own actions, but from the features of the larger patterns of action in which we might be participating. These reasons might relate to the patterns of action that will actually be carried out, or they might relate to merely hypothetical patterns. In past work, I have argued that accepting merely hypothetical pattern-based reasons, together with a plausible account of how to weigh these reasons, can lead to disastrous (...) consequences. However, in this article, I argue that this problem is not limited to hypothetical pattern-based reasons: it turns out that there are analogous issues for reasons deriving from actual patterns. I then suggest that we can avoid this problem by adopting a different account of the weight of pattern-based reasons. (shrink)

This paper presents arguments from empirical research and from philosophical considerations to the effect that phenomenality and content are two distinct and independent features of mental representations, which are both relational. Thus, it is argued, classical arguments that infer phenomenality from content have to be rejected. Likewise, theories that try to explain the phenomenal character of experiences by appeal to specific types of content cannot succeed. Instead, a dynamic view of consciousness has to be adopted that seeks to explain consciousness (...) by certain ways of processing representations. Therefore, only empirical methods that are able to investigate the dynamics of the mind can be used for the “quest for consciousness” proper. Moreover, the central intuitions about consciousness are best explained when phenomenality and content are clearly distinguished. (shrink)

I argue that we have not only individual reasons for action but also collective reasons for action: reasons which apply to us as a group. I next argue that if we together have a reason to act, then I may have a reason to do my part, but only when others will do theirs. Finally, I argue that collective reasons to do good can never make a difference to what individuals ought to do, but that other kinds of collective reasons (...) can. (shrink)

We defend our multifactorial weighting model of the sense of agency and our critique of the comparator model against the critiques that have been brought forward by and . Building on the specification of our model that emerges from this response, we will suggest a distinct mechanism how weighting of different agency factors might work: internal and external agency cues are constantly weighted according to their reliability in a given situation. Thus, the weighting process underlying the sense of agency might (...) follow the principles of optimal cue integration. We review recent empirical evidence for this hypothesis, demonstrating that the multifactorial weighting model is not only testable, but has in fact already received first empirical support. (shrink)
