In his provocative new book, The Tyranny of the Ideal, Gerald Gaus lays out a vision for how we should theorize about justice in a diverse society. Gaus shows how free and equal people, faced with intractable struggles and irreconcilable conflicts, might share a common moral life shaped by a just framework. He argues that if we are to take diversity seriously and if moral inquiry is sincere about shaping the world, then the pursuit of idealized and perfect theories (...) of justice--essentially, the entire production of theories of justice that has dominated political philosophy for the past forty years--needs to change. Drawing on recent work in social science and philosophy, Gaus points to an important paradox: only those in a heterogeneous society--with its various religious, moral, and political perspectives--have a reasonable hope of understanding what an ideally just society would be like. However, due to its very nature, this world could never be collectively devoted to any single ideal. Gaus defends the moral constitution of this pluralistic, open society, where the very clash and disagreement of ideals spurs all to better understand what their personal ideals of justice happen to be. In this innovative and important work, Gerald Gaus advances a revised and more realistic account of public reason liberalism, showing how, in the midst of fundamental disagreement about values and moral beliefs, we can achieve a moral and political order that treats all as free and equal moral persons. The first part of this work analyzes social morality as a system of authoritative moral rules. Drawing on an earlier generation of moral philosophers such as Kurt Baier and Peter Strawson (...) as well as current work in the social sciences, Gaus argues that our social morality is an evolved social fact, which is the necessary foundation of a mutually beneficial social order. The second part considers how this system of social moral authority can be justified to all moral persons. Drawing on the tools of game theory, social choice theory, experimental psychology and evolutionary theory, Gaus shows how a free society can secure a moral equilibrium that is endorsed by all, and how a just state respects, and develops, such an equilibrium. This study focuses on the prediction of the engagement of small- and medium-sized enterprises (SMEs) in environmental management practices, based on a random sample of 689 SMEs. The study finds that several endogenous factors, including tangibility of sector, firm size, innovative orientation, family influence and perceived financial benefits from energy conservation, predict an SME’s level of engagement in selected environmental management practices. For family influence, this effect is found only in interaction with the number of owners. This article presents a series of experiments which were conducted among native speakers of German to determine the influence of different types of German generics on the cognitive inclusion of women. Results indicate that the inclusion of women is higher with ‘non-sexist’ alternatives than with masculine generics, a tendency which was consistent across different studies. The different alternatives, however, showed different effects which also varied depending on the context. Much of Grünbaum's work may be regarded as a careful development and systematic elaboration of the Riemann-Poincaré thesis of the conventionality of congruence, the thesis that the continuous manifolds of space, time, and space-time are intrinsically metrically amorphous, i.e. are devoid of intrinsic metrics. Therefore, to appreciate Grünbaum's philosophical contributions, one must have a clear understanding of what he means by an intrinsic metric. The second and fourth sections of this paper are exegetical; in them we try to piece together, (...) from his sundry remarks about intrinsic metrics, what Grünbaum means by the term 'intrinsic metric.' We shall argue that, the customary carefulness and precision of Grünbaum's writings notwithstanding, there are residual unclarities and difficulties which beset his conception of an intrinsic metric. In the fifth section we shall propose an explication of Grünbaum's notion of an intrinsic metric which seems on the whole faithful to Grünbaum's intuitions and insights and which also seems capable of performing the philosophical services which his work demands of that notion. Does human nature possess normative significance? If so, what is it and what implications does it have for biotechnology? This essay critically examines three answers to these questions. One answer focuses on human nature as the ground of natural goods or goods dependent on human nature, another answer finds normative significance in the indeterminacy or malleability of human nature, and a third answer treats human nature as a natural sign of divine grace. Kathryn Tanner, who offers the second answer, and (...) Karl Barth, who offers the third, deny that nature has normative status in itself, apart from grace, but differ over the relation of grace to human nature as created. Theologies of human nature routinely reflect the insights of evolutionary biology, for which human biological nature is variable, changing and indeterminate in its boundaries with other living things. However, these theologies do not yet reflect what biotechnology discloses about human biological nature, namely, that it is malleable and indeterminate in its boundaries with machines. Does respect for human biological nature as created by God, or protection of the human person whose nature it is, require us to refrain from taking advantage (...) of its malleability and indeterminacy to select or design functions and traits? Or should we welcome malleability and indeterminacy as conditions for us to fulfill a vocation to determine our nature or bring it to perfection? And do malleability and indeterminacy render obsolete the notion that we look to our nature to determine what our good is? This article answers these questions. (shrink)

There is currently debate between deflationists and anti-deflationists about the ontology of persisting objects. Some deflationists think that disputes between, for example, four-dimensionalists (e.g. Ted Sider and David Lewis) and quasi-nihilists (e.g. Peter Van Inwagen and Trenton Merricks) are merely verbal disputes. Anti-deflationists deny this. Eli Hirsch is a deflationist who maintains that many ontological disputes are merely verbal. Theodore Sider maintains that the disputes are not merely verbal. Hirsch and Sider are thus engaged in a metaontological dispute. In this (...) paper, I argue that Hirsch's metaontological dispute with Sider is, by Hirsch's own lights, itself merely verbal. I conclude that the mere verbalness of his metaontological dispute with Sider suggests that Hirsch's account of what makes a dispute merely verbal may be problematic. (shrink)

Thomas Kuhn's thesis concerning the structure of scientific change was critically examined in relation to the historical problems of social science. The use and interpretation of Kuhn's ideas by psychologists was reviewed and found to center around the proliferation of theoretical views as paradigms, the viewing of theoretical differences as paradigm clashes, and efforts to affirm particular conceptions of psychology's past or future. Such use was seen as curbing discussion of fundamental issues, and to reflect a continuing neglect of the (...) foundational problems peculiar to social science. The relevance of Kuhn's work was seen to rest on a more critical view of his idea of “mature” science, better understanding of the type of social psychology upon which his thesis rests, and greater appreciation of his hermeneutic approach to social-historical analysis. According to the judgement of the European Court of Justice in 2014, human parthenogenetic stem cells are excluded from the patenting prohibition of procedures based on hESC by the European Biopatent Directive, because human parthenotes are not human embryos. This article is based on the thesis that in light of the technological advances in the field of stem cell research, the attribution of the term ‘human embryo’ to certain entities on a descriptive level as well as the attribution of a (...) normative protection status to certain entities based on the criterion of totipotency, are becoming increasingly unclear. The example of human parthenotes in particular demonstrates that totipotency is not at all a necessary condition for the attribution of the term ‘human embryo’. Furthermore, the example of hiPSC and somatic cells particularly shows that totipotency is also not a sufficient condition for the attribution of a normative protection status to certain entities. Therefore, it is not a suitable criterion for distinguishing between human embryos worthy of protection and human non-embryos not worthy of protection. Consequently, this conclusion has repercussions for the patenting question. The strict delineation between an ethically problematic commercial use of human embryos and the concomitant patenting prohibition of hESC-based procedures and an ethically unproblematic commercial use of human non-embryos and the therefore either unrestrictedly permitted or even unregulated patenting of procedures based on these alleged alternatives becomes increasingly blurred. Their contention is that the lack of dialogue between different realms of discourse has led to rigid service response by caregivers that attempt to address (...) losses experienced by individuals with intellectual disabilities. They argue that this situation arises because of the complexity of the cultural meaning of death and the uncertainty of the meaning for individuals with intellectual disabilities.Their essay, in itself, is powerfully cross-disciplinary. They review the concept of bereavement from different perspectives: social science research, psychiatric practice, and underlying cultural meanings. This review indicates that social science research has moved from attempting to develop definitive statements about the meaning of death. From their review, it is possible to discern that there may have been an underlying positivist orientation that assumed that a univocal meaning to the loss experience can be discovered. But the only universal fact about death is that there is a loss. It is a significant life event. Going all the way back to the early work of Holmes and Rahe (1967), it is clear that the impact and meaning of the same life event varies from individual to individual. There are multiple layers of meaning that include at least one's larger culture, subgroup values, family meaning, and finally individual interpretation. Clegg and Landsdall-Welfare see the current findings of social science as pointing to the need to be sensitive to the meaning of the death event for the specific individual. It appears to be inappropriate to impose normative stages onto an individual's grief experience.The finding from the review of psychiatric investigation of loss experiences is that bereavement can contribute to health problems. The loss experience is not necessarily pathologic. This compares to the acknowledgement that depression and anxiety are not necessarily illnesses to be treated, but basic human coping mechanisms that can become problematic. Similarly, the loss experience can be a traumatic experience with negative health implications.Clegg and Landsdall-Welfare acknowledge the limited nature of their review of the role of culture in the meaning of the loss experience. But even so, it is clear that the larger cultural context contributes critically to the individual's experience of loss. Oversimplification and reductionistic approaches to the death experience result in insensitive, stereotypic, formulaic, and consequently unsuccessful intervention strategies.The problem, as Clegg and Landsdall-Welfare see it, is that these discoveries and insights have not been effectively integrated into the discourse about and interventions for loss experiences for individuals with intellectual disability. This failure has occurred because of the strong continued [End Page 87] effect of the normalization orientation in the field of intellectual disability and vulnerability of the meaning of life for individuals with intellectual disability.They caution against hasty attempts to integrate the insights on loss from various sources into the discourse on bereavement in the field of intellectual disability. This fragility leaves them vulnerable to being overwhelmed by the larger discourse with a resulting loss of identity. Their brief mention at the conclusion of their essay of other contested concepts in other clinical services gives rise to thinking further.Clearly, the fundamental challenge for any discussion of the meaning of a loss experience is the complex nature of our understanding of death. First, there are problems with basic definitions of death from the perspective of science. But from an intervention and treatment perspective, the greatest problem has to do with our larger cultural discomfort in even discussing death and loss. The issue of intervention concerning loss for a specific population, such as those with intellectual disability, is in part only a reflection on our confusion concerning intervention in loss for any person, regardless of their disability status. It is far more inclusive in many respects than The Philosopher’s Index.The Database of Classical Bibliography (DCB) is a long-term project sponsored by the N.E.H., the American Philological Association and others to make the full contents of APh accessible from a CD-ROM either from individual PCs or on a local network. Unlike the Thesaurus Linguae Graecae, the DCB CD-ROM comes with its own search software (DCB CompLex) on the disk. This software is set up both for IBM and MAC machines, installs quickly, and operates extremely well. The manual gives clear instructions both for general use and for detailed search strategies. CompLex enables the user to search DCD in many different ways; e.g., by ancient or modern authors and works, by titles, publisher, place of publication, year of publication, journal, modern language, or series name, as well as by APh volumes, years, page numbers, rubrics, and topics. It can also search by any word in a modern language (i.e., in Roman characters) or for words in a Greek index. And CompLex enables one to perform more complex searches utilizing wildcards and Boolean operators in a user-friendly form.DCB Version 2, containing Volumes 45–60 (1974–1989), fulfills the editor’s initial commitment to make a new release available each year with the addition of three to five years, since it includes four years of APh (1973–74 and 1988–89) not on Version 1. Also new in Version 2 is a French interface and manual.DCB has faults, however. It repeats mistakes that appeared in the print version of APh and contains other mistakes that did not originate in APh. Many were noted in reviews of Version 1, but this should not be surprising in a work of such magnitude as either APh or DCB. This article discusses the question of how complex the narrations of Arthurian romances are by comparing them to the ‘simple form’ of fairy tales. In order to achieve this, we identify properties of the European folktale, which we then compare with an Arthurian text corpus consisting of Hartmann von Aue’s ‘Erec’ and ‘Iwein’ as well as Wolfram von Eschenbach’s ‘Parzival’. The typological investigation is carried out using data-driven methods, primarily Social Network Analysis, and focuses on various aspects of characters. By (...) doing this, we gain an in-depth understanding of the relationships between Arthurian romances and fairy tales and of the differences within the genre of the Arthurian romance itself. We show that the results of statistical analysis refuse clear interpretation, thus providing new insights into the well-known objects. (shrink)
