There are important reasons for states to recognize and enforce the judgments of other states’ courts. There are also reasons that may militate against recognition or enforcement of certain foreign judgments, making it appropriate to calibrate or “fine tune” the presumption favoring recognition and enforcement so it is not applied too broadly. Most calibration principles, such as the principle that a judgment from a court lacking jurisdiction should not be recognized, are case-specific. However, one calibration principle that is, to our (...) knowledge, unique to the law of the United States stands out: the principle of systemic calibration, according to which U.S. courts must not recognize or enforce foreign judgments “rendered under a system which does not provide impartial tribunals or procedures compatible with the requirements of due process of law.” In this Article, we aim to shed empirical light on how U.S.-style systemic calibration operates in practice. We find that state-of-origin indicator scores related to systemic adequacy are on average higher when U.S. courts recognize or enforce foreign judgments than when they refuse to do so. Moreover, the probability of recognition and enforcement increases as these indicator scores increase. However, in only six of the 587 opinions in our dataset did a court refuse recognition or enforcement based explicitly on the systemic inadequacy ground. Thus, while the level of systemic calibration in U.S. courts is high, it is mostly achieved implicitly. Finally, even judgments from states with low systemic adequacy scores are sometimes recognized or enforced by U.S. courts. (shrink)

In order to take ethical considerations of patenting biological material into account, the so-called “ordre public or morality clause” was implemented as Article 6 in the EC directive on the legal protection of biotechnological inventions, 98/44/EC. At first glance, this seems to provide a significant advantage to the European patent system with respect to ethics. The thesis of this paper argues that the ordre public or morality clause does not provide sufficient protection against ethically problematic uses of the patent system (...) within the area of life. On the contrary, there are worrisome obstacles to any effective and comprehensive critical analysis of the ethical aspects of bio-patenting, especially in the field of agriculture. These obstacles can be seen as indirect consequences of the implementation of ethical considerations in form of the ordre public and morality clause in the EC Directive. Therefore, Article 6 of the EC Directive on the legal protection of biotechnological inventions seems to ultimately weaken the position of ethics in the debate concerning bio-patenting because the ordre public and morality clause is usually interpreted in an exclusively bio-ethical way in the sense of an “intrinsic ethics,” which is primarily interested in questions regarding the moral status of particular entities. It is argued that an important cause of this phenomenon is that the decisive reasons against bio-patenting are concerns of social ethics, and not bio-ethics. (shrink)

This contribution responds to Nicholas Wolterstorff’s argument for religious toleration and freedom of religion respectively that he develops in his paper ‘Toleration, justice and dignity’. I argue that Wolterstorff conflates religious toleration and the right to freedom of religion, which has problematic implications. Moreover, I reveal gaps in his justification of the special worth or dignity of human persons, and, derived from this, freedom of religion.

BackgroundBiobanking biospecimens and consent are common practice in paediatric research. We need to explore children and young people’s (CYP) knowledge and perspectives around the use of and consent to biobanking. This will ensure meaningful informed consent can be obtained and improve current consent procedures.MethodsWe designed a survey, in co-production with CYP, collecting demographic data, views on biobanking, and consent using three scenarios: 1) prospective consent, 2) deferred consent, and 3) reconsent and assent at age of capacity. The survey was disseminated (...) via the Young Person’s Advisory Group North England (YPAGne) and participating CYP’s secondary schools. Data were analysed using a qualitative thematic approach by three independent reviewers (including CYP) to identify common themes. Data triangulation occurred independently by a fourth reviewer.ResultsOne hundred two CYP completed the survey. Most were between 16–18 years (63.7%, N = 65) and female (66.7%, N = 68). 72.3% had no prior knowledge of biobanking (N = 73).Acceptability of prospective consent for biobanking was high (91.2%, N = 93) with common themes: ‘altruism’, ‘potential benefits outweigh individual risk’, 'frugality', and ‘(in)convenience’.Deferred consent was also deemed acceptable in the large majority (84.3%, N = 86), with common themes: ‘altruism’, ‘body integrity’ and ‘sample frugality’. 76.5% preferred to reconsent when cognitively mature enough to give assent (N = 78), even if parental consent was previously in place. 79.2% wanted to be informed if their biobanked biospecimen is reused (N = 80).ConclusionProspective and deferred consent acceptability for biobanking is high among CYP in the UK. Altruism, frugality, body integrity, and privacy are the most important themes. Clear communication and justification are paramount to obtain consent. Any CYP with capacity should be part of the consenting procedure, if possible. (shrink)

This study aims to reveal patterns of e-petition co-signing behavior that are indicative of the political mobilization of online “communities”. We discuss the case of We the People, a US national experiment in the use of social media technology to enable users to propose and solicit support for policy suggestions to the White House. We apply Baumgartner and Jones's work on agenda setting and punctuated equilibrium, which suggests that policy issues may lie dormant for periods of time until some (...) event triggers attention from the media, interest groups, and elected representatives. In the case study presented, we focus on 21 petitions initiated during the week after the Sandy Hook shooting in opposition to gun control or in support of policy proposals that are alternatives to gun control, which we view as mobilized efforts to maintain stability and equilibrium in a policy system threatening to change. Using market basket analysis and social network analysis we found a core group of petitions in the “support law-abiding gun owners” theme that were highly connected and four “communities” of e-petitioners mobilizing in opposition to change in gun control policies and in favor of alternative proposals. The question of whether cognition can influence perception has a long history in neuroscience and philosophy. Here, we outline a novel approach to this issue, arguing that it should be viewed within the framework of top-down information-processing. This approach leads to a reversal of the standard explanatory order of the cognitive penetration debate: we suggest studying top-down processing at various levels without preconceptions of perception or cognition. Once a clear picture has emerged about which processes have influences on those at (...) lower levels, we can re-address the extent to which they should be considered perceptual or cognitive. Using top-down processing within the visual system as a model for higher-level influences, we argue that the current evidence indicates clear constraints on top-down influences at all stages of information processing; it does, however, not support the notion of a boundary between specific types of information-processing as proposed by the cognitive impenetrability hypothesis. The article outlines a general epistemological theory of argument: a theory that regards providingjustified belief as the principal aim of argumentation, and defends it instrumentalistically. After introducing some central terms of such a theory, answers to its central questions are proposed: the primary object and structure of the theory, the function of arguments, which is to lead to justified belief, the way such arguments function, which is to guide the addressee's cognizing, objective versus subjective aspects of argumentation, designing different types (...) of argument. Then the notion of ' valid argument' is defined and criteria for the adequate use of such arguments are introduced. Finally, this conception is justified as, among others, leading to more true beliefs than competing conceptions. (shrink)

The paper introduces, compares and contrasts formal models of source reliability proposed in the epistemology literature, in particular the prominent models of Bovens and Hartmann and Olsson :127–143, 2011). All are Bayesian models seeking to provide normative guidance, yet they differ subtly in assumptions and resulting behavior. Models are evaluated both on conceptual grounds and through simulations, and the relationship between models is clarified. The simulations both show surprising similarities and highlight relevant differences between these models. Most importantly, however, our (...) evaluations reveal that important normative concerns arguably remain unresolved. The philosophical implications of this for testimony are discussed. (shrink)

The paper examines Davidson′s discussion of Frege on the problem of predication. Simple declarative sentences are unities that are true or false; how do predicates contribute to this kind of semantic unity? According to Davidson, the problem cannot be solved by assigning referents to predicates, since this leads to an infinite regress. Frege famously contributes the idea that predicates are “incomplete” or “unsaturated” functional expressions, mapping objects to truth-values. However, he takes predicates to refer to concepts and thus is exposed (...) to Davidson′s argument. I will show that Davidson is only right with regards to “Frege′s semantics”. Yet Frege′s logical doctrine of the decomposition of a sentence – I shall argue – allows for a resolution of this problem. (shrink)

It will be shown how Dr. Seuss artistically appropriated key aspects of Derridean thought about the functioning of signs even prior to their proper formulation to create a story around them. In so doing, Dr. Seuss provides a salient example of what has been defined as semiomimesis.

Arguments for or against a trend in the evolution of complexity are weakened by the lack of an unambiguous definition of complexity. Such definitions abound for both dynamical systems and biological organisms, but have drawbacks of either a conceptual or a practical nature. Physical complexity, a measure based on automata theory and information theory, is a simple and intuitive measure of the amount of information that an organism stores, in its genome, about the environment in which it evolves. It is (...) argued that physical complexity must increase in molecular evolution of asexual organisms in a single niche if the environment does not change, due to natural selection. It is possible that complexity decreases in co‐evolving systems as well as at high mutation rates, in sexual populations, and in time‐dependent landscapes. However, it is reasoned that these factors usually help, rather than hinder, the evolution of complexity, and that a theory of physical complexity for co‐evolving species will reveal an overall trend towards higher complexity in biological evolution. This article consists of three parts, two introductory, in which the limits and the methods of analysis of dialogues are expounded, and the major part, in which the main features of a philosophical theory of disputation are outlined.It was an essential aim of the philosophical analysis of argumentative dialogues to develop tools of substantiation for cases in which logic doesn't help any more. In the first part of this paper I show that such tools can and will be developed only (...) by analyzing argumentations (“argumentation” in the sense of a monologue in which arguments for a thesis are brought forward), and that the analysis of argumentative dialogues doesn't contribute anything to the development of such tools.The systematically first task of the philosophical analysis of dialogues consists in understanding the general practical aims of philosophically interesting types of dialogue. Only subsequently the rules of the dialogue can be reconstructed as good means for reaching these aims. Dialogical games constructed without referring to such a purpose are externally senseless and useless.The third part is an outline of a philosophical theory of disputation (“disputation” here will mean: (learned) dialogue in which the participants cooperatively though perhaps controversially attempt to find out by means of arguments and mutual criticism whether a thesis is true or false). Disputations contain argumentations, and many functions of a disputation can also be fulfilled by argumentations alone. Certifying the truth of convictions is the specific aim of disputation. This is accomplished by eliminating errors of substantiation and foundation as effectively as possible, in revising false convictions and their foundations, thereby making the remaining convictions more certain. Based on this analysis of the aim of disputation, the basic rules of disputations will be critically reconstructed: possible moves, rules of sequence, and the internal aim and ends of disputations. Promotion of pro-social attitudes and moral behaviour is a crucial and challenging task for social orders. As traditional ways such as moral education have some, but apparently and unfortunately only limited effect, some authors have suggested employing biomedical means such as pharmaceuticals or electrical stimulation of the brain to alter individual psychologies in a more direct way — moral bioenhancement. One of the salient questions in the nascent ethical debate concerns the impact of such interventions on human freedom. Advocates argue (...) that moral bioenhancements do not pose a serious threat to freedom. This contention, however, is based on an overly narrow, if not impoverished, sense of freedom, which comprises only freedom of action and freedom of will. Mind-altering interventions primarily affect another sense of freedom: freedom of mind, a concept that has not received much attention although it should rank among the most important legal and political freedoms. The article introduces three senses of mental freedom potentially infringed upon by moral bioenhancement and places it in a broader perspective. Ignorance of mental freedom has far-ranging consequences for the shape of the political and legal order at large. As many advocates are apparently not aware of the freedoms they seek to undermine, their calls for moral enhancement programmes are dangerously premature. (shrink)

(1) The aim of the paper is to develop a reduction of fallacy theory, i.e. to 'deduce' fallacy theory from a positive theory of argumentation which provides exact criteria for valid and adequate argumentation. Such reductionism has several advantages compared to an unsystematic action, which is quite usual in current fallacy but which at least in part is due to the poor state of positive argumentation theory itself. (2) After defining 'fallacy' (3) some principle ideas and (4) the exact criteria (...) for (argumentatively) valid and adequate arguments of the 'practical theory of argumentation' of the author are expounded. These criteria will be used as the positive basis for the following reduction. (5) In the main part of the paper a systematization, definition and explanation of the main types and many subforms of fallacies of argumentative validity and (6) adequacy is developed, following the list of positive conditions of validity and adequacy. In addition to many new types of fallacies, this systematization contains the most important of the traditionally known and named fallacies; these are explained and the criteria for some of them are corrected or put more precisely. Forms and Concepts is the first comprehensive study of the central role of concepts and concept acquisition in the Platonic tradition. It sets up a stimulating dialogue between Plato s innatist approach and Aristotle s much more empirical response. The primary aim is to analyze and assess the strategies with which Platonists responded to Aristotle s (and Alexander of Aphrodisias ) rival theory. The monograph culminates in a careful reconstruction of the elaborate attempt undertaken by the Neoplatonist Proclus (6th century (...) In this paper, I investigate in detail one theoretical approach to the symptom of thought insertion. This approach suggests that patients are lead to disown certain thoughts they are subjected to because they lack a sense of active participation in the occurrence of those thoughts. I examine one reading of this claim, according to which the patients’ anomalous experiences arise from a breakdown of cognitive mechanisms tracking the production of occurrent thoughts, before sketching an alternative reading, according to which their (...) experiences have to be explained in terms of a withdrawal, on the part of the patients themselves, from certain forms of active engagement in reasoning. I conclude with a discussion of the relationship between this view and the idea that patients’ reports of thought insertion reflect a situation in which the boundaries between the self and the world have become uncertain. While in neo-Aristotelian conceptions of virtue and Bildung the concept of “second nature” describes the successful completion of human education, Hegel uses this term in order to analyze the irresolvably ambiguous, even conflictive nature of spirit. Spirit can only realize itself, in creating (1) a second nature as an order of freedom, by losing itself, in creating (2) a second nature—an order of externality, ruled by the unconscious automatisms of habit. In the second meaning of the term, “second nature” refers (...) to spirit’s inversion of itself: the free enactment of spirit produces an objective, uncontrollable order; "second nature" is here a critical term. On the other hand, the very same inversion of free positing into objective existence is the moment of the success of ("absolute") spirit. The paper exposes this undecidable ambiguity of second nature and claims that its acceptance and development are the conditions of an adequate understanding of the constitution and forms of second nature. This paper considers challenges resulting from the use of advanced artificial judicial intelligence (AAJI). We argue that these challenges should be considered through the lens of value alignment. Instead of discussing why specific goals and values, such as fairness and nondiscrimination, ought to be implemented, we consider the question of how AAJI can be aligned with goals and values more generally, in order to be reliably integrated into legal and judicial systems. This value alignment framing draws on AI safety and (...) alignment literature to introduce two otherwise neglected considerations for AAJI safety: specification and assurance. We outline diverse research directions and suggest the adoption of assurance and specification mechanisms as the use of AI in the judiciary progresses. While we focus on specification and assurance to illustrate the value of the AI safety and alignment literature, we encourage researchers in law and philosophy to consider what other lessons may be drawn. Computational philosophy is the use of mechanized computational techniques to unearth philosophical insights that are either difficult or impossible to find using traditional philosophical methods. Computational metaphysics is computational philosophy with a focus on metaphysics. In this paper, we (a) develop results in modal metaphysics whose discovery was computer assisted, and (b) conclude that these results work not only to the obvious benefit of philosophy but also, less obviously, to the benefit of computer science, since the new computational techniques that (...) led to these results may be more broadly applicable within computer science. The ethics of autonomous cars and automated driving have been a subject of discussion in research for a number of years :28–58, 2016). As levels of automation progress, with partially automated driving already becoming standard in new cars from a number of manufacturers, the question of ethical and legal standards becomes virulent. For exam-ple, while automated and autonomous cars, being equipped with appropriate detection sensors, processors, and intelligent mapping material, have a chance of being much safer than human-driven cars in (...) many regards, situations will arise in which accidents cannot be completely avoided. Such situations will have to be dealt with when programming the software of these vehicles. In several instances, internationally, regulations have been passed, based on legal considerations of road safety, mostly. However, to date, there have been few, if any, cases of a broader ethics code for autonomous or automated driving preceding actual regulation and being based on a broadly composed ethics committee of independent experts. In July 2016, the German Federal Minister of Transport and Digital Infrastructure, Alexander Dobrindt, appointed a national ethics committee for automated and connected driving, which began its work in September 2016. In June 2017, this committee presented a code of ethics which was published in German and in English. It consists of 20 ethical guidelines. Having been a member of this committee, I will present the main ethical topics of these guidelines and the discussions that lay behind them. (shrink)

Keith DeRose has argued that ‘the knowledge account of assertion – according to which what one is in a position to assert is what one knows – ... provides a ... powerful positive argument in favor of contextualism’ (2009: 80). The truth is that it yields a powerful argument against contextualism, at least against its most popular, anti-sceptical versions. The following argument shows that, if we conjoin (such versions of) epistemic contextualism with an appropriate meta-linguistic formulation of the knowledge account (...) of assertion, contextualism cannot coherently be stated. According to Fred Dretske's externalist theory of knowledge a subject knows that p if and only if she believes that p and this belief is caused or causally sustained by the information that p. Another famous feature of Dretske's epistemology is his denial that knowledge is closed under known entailment. I argue that, given Dretske's construal of information, he is in fact committed to the view that both information and knowledge are closed under known entailment. Hence, if it is true (...) that, as Dretske also believes, accepting closure leads to skepticism, he must either embrace skepticism or abandon his information theory of knowledge. (shrink)

The article outlines a general epistemological theory of argument: a theory that regards providingjustified belief as the principal aim of argumentation, and defends it instrumentalistically. After introducing some central terms of such a theory (2), answers to its central questions are proposed: the primary object and structure of the theory (3), the function of arguments, which is to lead to justified belief (4), the way such arguments function, which is to guide the addressee's cognizing (5), objective versus subjective aspects of (...) argumentation (6), designing different types of argument (7). Then the notion of '(argumentatively) valid argument' is defined and criteria for the adequate use of such arguments are introduced (8). Finally, this conception is justified as, among others, leading to more true beliefs than competing conceptions (9). (shrink)
