Our society has long sanctioned, at least tacitly, a degree of conflict of interest in medical practice and clinical research as an unavoidable consequence of the different interests of the physician or clinical investigator, the patient or clinical research subject, third party payers or research sponsors, the government, and society as a whole, to name a few. In the past, resolution of these conflicts has been left to the conscience of the individual physician or clinical investigator and to professional organizations. (...) The public is no longer willing to allow health care providers to wholly govern their own conflicts of interest for several reasons. These include: new forms of health care financing and delivery that provide innovative and lucrative opportunities for physician or insurer enrichment at patient expense; the increased importance of commercial research support as peer-reviewed governmental research support has decreased; evidence that physicians and clinical investigators too frequently resolve conflicts of interest in their own favor; and a general societal mistrust of authority. This volume represents a multidisciplinary effort, drawing from philosophy, medicine, law, economics and public policy to identify and categorize conflicts of interest in medical practice and clinical research, and, where possible, to offer a mechanism for resolving them. Part I addresses conflicts of interest from a theoretical perspective, offering basic concepts and analytical frameworks. The second part discusses two topics prominent in current health care policy debates--self-referral and financial incentives to limit care. Part III examines conflicts of interest generated by pharmaceutical industry involvement in clinical practice and research. The final section deals with conflicts of interest in clinical research in several contexts, including institutional reviews boards, clinical trials, Cooperative Research and Development Agreements between government and private researchers, brokerage of research subjects by Contract Research Organizations, and cost-effectiveness studies. Though Foucault was intrigued by the possibilities of radical social transformation, he resolutely resisted the idea that such transformation could escape the effects of power and expressed caution when it came to the question of revolution. In this article we argue that in one particularly influential line of development of Foucault’s work his exemplary caution has been exaggerated in a way that weakens the political aspirations of post-Foucaldian scholarship. The site of this reduction is a complex debate over the role (...) of normativity in Foucaldian research, where it has been claimed that Foucault’s genealogical approach is unable to answer the question ‘ Why fight?’ The terms of this debate are limited by a dominant though selective interpretation of Foucault’s analytics of power, where power is understood primarily in terms of government, rather than struggle. In response we suggest that if we reconfigure power-as-government to power-as-war, this adjusts the central concern. ‘ Why fight?’ becomes replaced by the more immediate question, ‘ How fight?’ Without denying the obvious benefits of cautious scholarly work, we argue that a reconfiguration of Foucault’s analytics of power might help Foucaldian research to transcend the self-imposed ethic of political quietism that currently dominates the field. Individual choices are often inconsistent with economic theories, which has motivated a variety of ways to measure how far choices are from a given theory. Recent work has investigated the correlation between “measures of rationality” and observable information such as education or income. This paper investigates the sensitivity of this analysis to the units used to measure rationality, in particular we examine measures in percentage expenditure vs dollars expenditure. We find that correlations can change sign when we change the units, (...) but this sensitivity might be mitigated with experimental methods. (shrink)

As someone who’s knowledge of “art” mostly began with the domestic (Western) and Japanese punk and noise scenes of the late 80’s and early 90’s, practices and theories of noise fall rather close to my heart. It is peeking into the esoteric enclaves of weird music and noise that helped me understand what I think I might like art to be: (...) A way of learning about the world through perturbation—exploration by incitement and speculation of possible conditions. What I have always loved about artistic investigations influenced by noisy aesthetics or sensibilities is that they can be simultaneously transcendent and absurd, amusing and revelatory, singular and pluralistic, mindless and intensely penetrating. The provocative friction that noise brings to bear on aesthetic experience, artistic practice, and “the” Art World acts as a kind of impulse response, proposing new energies while revealing underlying structure; noise signals are a simultaneous synthesis and analysis of spaces, subjects and relations. About two weeks prior to Christmas 2011, Joseph Nechvatal was generous enough to spend some time with me at 39 Quai des Grands Augustins, Paris . We each had one glass of red wine, briefly discussed common acquaintances, shared points of interest, and his published writings. We also, I recall, disagreed lightheartedly about how much contemporary relevance the ideas of telematic-artist Roy Ascott have for today’s art-and-technology practitioner (Joseph > Jamie). After the encounter, I read through a PDF version of Immersion Into Noise Joseph was kind enough to send me ( the HTML version is here ). A number of points of entry into cultures of “noise” are available these days. There are the acoustic-spatial approaches of thinkers like Douglas Kahn, Brandon LaBelle and Salome Voegelin; the techno-cultural musicologies of Jonathan Sterne and David Toop; the political writings of Jacques Attali, former adviser to President François Mitterrand, in his Noise: The Political Economy of Music (spoiler alert: It’s not really about music). Enter the new writings of one Joseph Nechvatal, with his invitation of an Immersion Into Noise . Nechvatal has been active for over 20 years in on- and off-line discussions of art, technology, virtuality, as well as his own set of art-theoretical departures and terminologies. A practicing artist, and instructor at the School of Visual Arts in New York City, Immersion Into Noise , is Nechvatal’s third published volume. His writings, broadly, address a concern with the possibilities of a synthesis between the biological and the virtual, and the contemporary artistic resonances that these possibilities suggest. Nechvatal’s project is to try to name contemporary currents of artistic practice within our technologized culture. He comes at this through art history, post-modern philosophy, anthropology and consciousness studies. Portions of Immersion Into Noise have appeared in his PhD dissertation, as well as online art publications like Zing Magazine . An open-access publication, and part of the impressive and heartening activities of the Open Humanities Press, Nechvatal’s book is a somewhat unexpected addition to the Critical Climate Change series edited by Tom Cohen of SUNY University and Claire Colebrook of Penn State. Other titles in the series have address themes of post-globalism and cultures of threat. Joseph Nachvetal’s title is the first to focus entirely on art history, art practice and aesthetics. It is awkward to too easily fit Nechvatal’s writings in with the aforementioned burgeoning canon of cultural and artistic practice in, and writings on, noise (Russolo, Schaeffer, Cage and Yves Klein through to Kahn, LaBelle, Voegelin, et. al). Immersion Into Noise is not primarily an examination of sound-noise or phenomenologies of sound, and the relativist, non-objectivist possibilities arising therefrom in social, public, and exhibition art practices. Although Nechvatal makes mention of sonic practice and experience (his own encounter in 1968 with the technological complex was set in motion at a Jimi Hendrix concert at the Chicago Coliseum), he does so only by way of introducing a broader concept of “art-noise.” The noise-scape can envelope various kinds of involvement in all kinds of art, by artists, audiences, and distributed amalgams of all of these. Midway through the book, we are offered characteristics of an “immersive noise vision theory.” This theory, leading to an even more syncretic thinking about the art experience, is sketched out through further reference to the author’s personal observation, as well as his art-historical research and notes. Personal examples take on the reflex of a kind of art-noise-travel-writing, as Nechvatal visits Ryoji Ikeda’s Datamatics [ver 2.0] installation at the Centre Pompidou, Paris), hears Cecil Taylor at Alice Tully Hall in New York, spends time with the cave paintings of Lascaux, France, and explores the Wagner-inspired Venus Grotto of Linderhof, Bavaria, to name a few. These site-events, to varying degrees, are renderings of noise-art’s potential to “place us back into a ritual position by dragging art down into the felt 360° noise-perspective of the enthusiastic and participatory.” (p.103) The arc of the ideas proposed here position immersiveness, saturation and “scopic all-over tension” as most productively foundational to noise art, or art-noise. An itinerary from the most ancient of artistic expressions (cave drawings) to the most digital of presentations is charted (Ikeda’s minimal/maximal bitwise works for synchronized audio and visual projection). The harsh sonic onslaught of Masami Akita (a.k.a. Merzbow), is, under this analysis, not so far from colossal denseness of the churches of the High Baroque (Nechvatal visits the Rosario Chapel in Santo Domingo Church, Puebla, Mexico). And there is much more here, eaten up by noise: A rethinking of the work of Duchamp, Jackson Pollock, Nicolas Schöffler (whom Nechvatal names the true “the Father of Cybernetic Art”) and the Happenings of Alan Kaprow, all as art-noise in their own right. Each of these artists and moments demonstrate techniques of destabilization, immersiveness, frame-breaking and “all-over fullness and fervor.” Here is writing on art and art history that is as ambitious as it is promising: “wildly visionary,” Nechvatal states as in conclusion. Self-admittedly far-reaching to the point of verging on totalization, we are asked to consider that the moments, spaces, arts and artists Nechvatal appreciates in the book all derive from an increasingly prevalent “noise consciousness.” Along the way we gain an appreciation of noise as a productive and proactive tension in art, rather than an unwanted signal or unwelcome intrusion. Most promising here for me are Nechvatal’s revealing descriptions of the potential for noise to make manifest the material-perceptual framework of individual and collective art experience. How might we allow what we have been repeatedly taught is our contemporary condition of “information overload” to transform itself into a calm, warm, sympathetic kind of inundation. Treatment of experience in this way, dissolves boundaries between the bodily, informational, material and technical complexes that make up our world, and is the promise of a radical, if momentary, Immersion Into Noise. The book collects seventeen new research papers on themes in Indian philosophy, contributed by contemporary scholars from around the world. The principal themes are knowledge and logic, consciousness, existence, and the self. The editor explains that the studies discuss Indian sources in their own context, rather than trying to be comparative or make connections to other traditions. This unfortunate directive is fortunately ignored by the strongest papers. Claus Oetke shows that despite their investigations of inference and syntax, Indian analysts had (...) little interest in formal structure per se. They investigated ways to exploit the formal structure in ordinary cases for the establishment of metaphysical tenets. Metaphysical aspirations rather than sheer formal analysis were the overriding concern. Another contributor describes Indian thought as “relentlessly empiricist in orientation.” Scripture is acknowledged for transcendent things like Dharma and Brahman, “but it is the senses that hold sway over the natural world.” Logic is not enough for inference, which must be grounded in perception. The fourth-century Buddhist Vasubandhu defines inference in terms of perception. The basis of inference is the observation of an object not occurring without the inferred object for one who knows the connection. Eli Franco explains how skepticism invaded Indian thought with the Madhyamaka movement in latter Buddhism, beginning with the great founder Nagarjuna. He denies any means to knowledge, using arguments that often resemble those of Western skepticism. Skepticism about means to knowledge became associated with the later materialist Lokayata school, from ninth century. Indian materialism is an anomaly somewhat like the Chinese rationalism of the Mohists. Pradeep Gokhale provides an overview of the school, which he describes as “a rationalist philosophical movement which attempted to solve individual and social issues merely on empirical, rational, and practical grounds without taking recourse to religion.” Like Epicurus, this materialism is a physical theory demystifying traditional morality and religion, which are replaced by hedonism. Consciousness originates in body and does not exist independent of matter. It is not originally in the elements but arises from them, as intoxication, not originally in molasses, arises by fermentation. Religion is a human creation. Other worlds do not exist. Nothing that we do makes a difference to future lives, which do not exist. Fallacious ideas like life after death vitiate sacrifice and morality. The path to liberation is to follow natural pleasure. Joel Feldman discusses the Buddhist doctrine of momentariness. Things do not endure. The experience of enduring things is a delusive result of imagining things to have a universal character when actually they are merely grouped together according to our desires by means of their exclusion from things that do not fulfill our purposes. We impose this vast delusion on what are in truth momentary self-characterized particulars, each with its own self-nature, producing an effect and then annihilating in a moment by that very self-nature. Destruction is never the work of an external cause. If a thing can self-destruct, then it must be destroyed immediately by its own self-nature as soon as it begins to exist. Papers by Alex Watson and Roy Tzohar survey the spectrum of Indian views on the self. Consciousness as light is an ancient image in Indian thought described in a contribution by Matthew MacKenzie. Isabelle Ratié explains the metaphor of the mirror in Indian thought about consciousness. For Brahminical tradition mirror images are sheer illusion. For the later Buddhists the perceived universe is comparable to an optical refection. The characteristic of reflecting entities like a mirror is the capacity to manifest themselves as something else while remaining what they are, and this is exactly like consciousness, which manifests itself in all the images of phenomenal nature. In all of these papers Indian ideas are repeatedly compared with ideas in Sartre, McGinn, Dretske, Searle, Husserl, Merleau-Ponty, Heidegger, Wittgenstein, and Sellars. (shrink)

Āsakti has its roots in the ancient Indian knowledge system. It precipitates the concept of attachment in the Indian perspective. The following paper explores the psychological perspective of āsakti from the Shrimad Bhagavad Gita while maintaining its philosophical purpose and nature. Āsakti hinders the path of self-realization; hence, from the psycho-philosophical lens, its inquiry with scientific understanding is important for spiritual growth. Āsakti can be understood as a river with five tributaries. Each tributary branches out of the river as an (...) independent water body, but has its traces though in the river. Āsakti is a combination of Rāga (approach), Dveṣa (aversion) and Ahaṁkāra (ego focus), is related to the operation of Triguṇa, moving from āsakti to anāsakti brings peace, happiness and health. In its unregulated form, āsakti leads to intellectual, mental and spiritual decay. Its control and regulation leads to anāsakti, spiritual growth, liberation from bondages and surrenderance to the supreme power. (shrink)

That every first-order theory has a coherent conservative extension is regarded by some as obvious, even trivial, and by others as not at all obvious, but instead remarkable and valuable; the result is in any case neither sufficiently well-known nor easily found in the literature. Various approaches to the result are presented and discussed in detail, including one inspired by a problem in the proof theory of intermediate logics that led us to the proof of the present paper. It can (...) be seen as a modification of Skolem’s argument from 1920 for his “Normal Form” theorem. “Geometric” being the infinitary version of “coherent”, it is further shown that every infinitary first-order theory, suitably restricted, has a geometric conservative extension, hence the title. The results are applied to simplify methods used in reasoning in and about modal and intermediate logics. We include also a new algorithm to generate special coherent implications from an axiom, designed to preserve the structure of formulae with relatively little use of normal forms. (shrink)

Illusionism treats the almost universally held belief in our ability to make free choices as an erroneous, though beneficent, idea. According to this view, it is sadly true, though virtually impossible to believe, that none of a person’s choices are avoidable and ‘up to him’: any claim to the effect that they are being naïveté or, in the case of those who know better, pretense. Indeed, the implications of this skepticism are so disturbing, pace Spinoza, that it must not be (...) allowed to see the light of intellectual day, confined to the nether regions of consciousness. Even those who have ‘done the philosophy’ and disabused themselves here should nevertheless (somehow) continue believing in free will, lest they come to regard our lives as meaningless, spreading despair and social upheaval. Thus, the “Illusionists” who propound this view are themselves circumspect in doing so. -/- But is escaping the (putative) truth really possible here? Could a disabused philosopher ever return to something like his former intellectual innocence? Self-deception may not be possible; but would an attempt at it reveal anything significant about choice formation? If one were to try to regain one’s illusion, what would one realize? I shall argue here that one would reflectively discover precisely the opposite of what the Illusionists contend- that there are indeed free choices. Let us begin by considering the inconsistency that supposedly entails the illusion of free will. (shrink)

It provides a probing exploration of the moral issues involved in disputes about secession, ethno-national conflict, "the right of self-determination of peoples," human rights, and the legitimacy of the international legal system itself. The primary narrative problem of the analyst is, then, not how to tell a normative chronological life history; rather, it is how to tell the several histories of each analysis. From this vantage point, the event with which to start the model analytic narration is not the first occasion of thought—Freud's wish-fulfilling hallucination of the absent breast; instead, one should start from a narrative account of the psychoanalyst's retelling of something told by an analysand and the analysand's response to that (...) narrative transformation. In the narration of this moment of dialogue lies the structure of the analytic past, present, and future. It is from this beginning that the accounts of early infantile development are constructed. Those traditional developmental accounts, over which analysts labored so hard, may now be seen in a new light: less as positivistic sets of factual findings about mental development and more as hermeneutically filled-in narrative structures. The narrative structures that have been adopted control the telling of the events of the analysis, including the many tellings and retellings of the analysand's life history. The time is always present. The event is always an outgoing dialogue. Roy Schafer is clinical professor of psychology and psychiatry at Cornell University Medical College, adjunct professor of psychology at New York University, and a supervising and training analyst at Columbia University's Center for Psychoanalytic Training and Research. _Dialectic_ is now widely regarded as a classic of contemporary philosophy. This book, first published in 1993, sets itself three main aims: the development of a general theory of dialectic, of which Hegelian dialectic can be seen to be a special case; the dialectical enrichment and deepening of critical realism, viz. into the system of dialectical critical realism; and the outline of the elements of a totalizing critique of Western philosophy. The first chapter clarifies the rational core of Hegelian dialectic. (...) Chapter two then proceeds to develop a general theory of dialectic. Isolating the fallacy of 'ontological monovalence', Roy Bhaskar then shows how absence and other negating concepts such as contradiction have a legitimate and necessary ontological employment. He then goes on to give a synoptic account of key dialectical concepts such as the concrete universal; to sketch the further dialectical development of critical naturalism through an account of what he calls four-planar social being; and following consideration of the dialectical critique of analytical reason, he moves on to the real definition of dialectic as absenting absence and in the human sphere, the axiology of freedom. Chapter three extends and deepens critical realism’s characteristic concerns with ontology, science, social science and emancipation not only into the realms of negativity and totality, but also into the fields of reference and truth, spatio-temporality, tense and process, the logic of dialectical universalizability and on to the plane of ethics, where it articulates a combination of moral realism and ethical naturalism, whereby consideration of elemental desire involves commitment to the eudaimonistic society. This is then followed by a sublime discussion of key moments in the trajectory of Western philosophy, the tradition of which can now be seen to be based on what the author calls the unholy trinity of the epistemic fallacy or the reduction of being to knowledge, primal squeeze or the collapse of structure and alethic truth, and ontological monovalence. In this book, Sorensen presents the first general theory of the thought experiment. He analyses a wide variety of thought experiments, ranging from aesthetics to zoology, and explores what thought experiments are, how they work, and what their positive and negative aspects are. Sorensen also sets his theory within an evolutionary framework and integrates recent advances in experimental psychology and the history of science.

Epistemic akrasia arises when one holds a belief even though one judges it to be irrational or unjustified. While there is some debate about whether epistemic akrasia is possible, this paper will assume for the sake of argument that it is in order to consider whether it can be rational. The paper will show that it can. More precisely, cases can arise in which both the belief one judges to be irrational and one’s judgment of it are epistemically rational in (...) the sense that both are supported by sufficient evidence. The latest volume in the Cambridge Histories of Philosophy series, The Cambridge History of Philosophy in the Nineteenth Century brings together twenty-nine leading experts in the field and covers the years 1790-1870. On the occasion of a first conference on Cognitive Science, it seems appropriate to review the basis of common understanding between the various disciplines. In my estimate, the most fundamental contribution so far of artificial intelligence and computer science to the joint enterprise of cognitive science has been the notion of a physical symbol system, i.e., the concept of a broad class of systems capable of having and manipulating symbols, yet realizable in the physical universe. The notion of symbol so (...) defined is internal to this concept, so it becomes a hypothesis that this notion of symbols includes the symbols that we humans use every day of our lives. In this paper we attempt systematically, but plainly, to lay out the nature of physical symbol systems. Such a review is in ways familiar, but not thereby useless. Restatement of fundamentals is an important exercise. (shrink)

A co-authored article with Roy T. Cook forthcoming in a special edition on the Caesar Problem of the journal Dialectica. We argue against the appeal to equivalence classes in resolving the Caesar Problem.

Using labelled formulae, a cut-free sequent calculus for intuitionistic propositional logic is presented, together with an easy cut-admissibility proof; both extend to cover, in a uniform fashion, all intermediate logics characterised by frames satisfying conditions expressible by one or more geometric implications. Each of these logics is embedded by the Gödel–McKinsey–Tarski translation into an extension of S4. Faithfulness of the embedding is proved in a simple and general way by constructive proof-theoretic methods, without appeal to semantics other than in the (...) explanation of the rules. (shrink)
