The paper aims to explore the relationships that exist between party structure, party system, patronage, and the appointments of the political elites. It is focused on the extent to which political parties can control the allocation of jobs as well as find out which are the institutions over whom the political parties can exercise power; the extent to which historical legacies influence patronage patterns; the extent to which party patronage is exercised in a ‘majoritarian’ as (...) opposed to a more ‘consensual’ manner across the spectrum of political parties; and the relationship that exist between the structure of the party, the appointment of political elites and patronage. The conclusion is that the party in public office and its allies in the coalition cabinet control the post of ministers and vice-ministers. While these last ones control the posts of their subordinates, it is hard to understand whether they select the employees from the party pool or from their personal networks. The other finding is that the structure of the party creates strong links between patronage and appointment, these last ones done with the scope of having control over government resources and distribution of resources. This study is an attempt to analyze the factors that have contributed towards the success of the Democratic Party of Albania. It seeks to introduce new dimensions in measuring the success of a political party. The study rejects the elements of ‘office-holding’ and ‘policy – or performance-based’ measures of success, because they are determined by a complex array of economic, political, social and institutional factors. The concept of “party success” is defined in terms of: ‘breadth’ and ‘durability’. (...) At the same time the study aims at ‘emancipating’ the political parties from the past and macro-institutional factors, to which very often are ascribed the reasons for the perceived failure of politics in Albania. The approach used in this study has regarded the political parties as the real political actors that as such should assume the responsibility for the perceived failures. Neither the lack of political culture, nor the communist system, are the main factors to shape the activity and development of political parties in Albania. Both macro-institutional and historical structural approach has limited explanatory power for the success of the Democratic Party. Its success is a direct consequence of the decisions that the political parties themselves, including Democratic Party as one of the key actors, have taken. The research showed that the Democratic Party of Albania has been successful because and when its elite have been able to craft inclusive ideological programs and because of its extensive penetration in the country, which it owes to its structure as a mass party. The party has established patronage linkages with its sympathizers, the rank and file and militants and consequently has ensured their loyalty and maintained an extensive electoral penetration in country. This paper aims to analyse the relationship that exists between state capture, party patronage, and the conduct of electoral processes in the settings of post-communist countries, of which Albania is one. A characteristic of the political developments of the transition period in many post-communist countries has been the phenomenon of state capture, which has occurred mainly through the endemic party patronage and politicization of state institutions. The phenomenon of state capture by the ruling political parties has had (...) a negative conditional impact on the conduct of competitive, free and fair elections in these countries, leading to distrust regarding the credibility and integrity of the process. This study argues that phenomena such as state capture and extensive party patronage as informal practices/mechanisms in the hands of the ruling political parties affect the creation of a skewed playing field and the production of hyper-incumbency advantages in holding electoral contests between political parties, making the possibility of political power rotations difficult. Albania, in the case of its last parliamentary elections, held on 25th April 2021, constitutes the case study (Section IV) to which the theoretical framework of the paper is applied, by identifying the informal practices and methods through state capture that the ruling political party used to provide structural, institutional, and financial advantages in its favour regarding elections. A growing literature looks at how the design of the electoral system shapes the voting behavior of politicians in parliaments. Existing research tends to confirm that in mixed-member systems the politicians elected in the single-member districts are more likely to vote against their parties than the politicians elected on the party lists. However, we find that in South Korea, the members of the Korean National Assembly who were elected on PR lists are more likely to vote against (...) their party leadership than the members elected in single-member districts (SMDs). This counterintuitive behavior stems from the particular structure of candidate selection and politicians' career paths. This suggests that any theory of how electoral systems shape individual parliamentary behavior needs to look beyond the opportunities provided by the electoral rules for voters to reward or punish individual politicians (as opposed to parties), to the structure of candidate selection inside parties and the related career paths of politicians. This thesis explores the party system and political parties in the post-communist Albania. The overarching question of the thesis is what kind of party system has developed and what is the structure and organization of the Albanian political parties. The study analyses the period 1991-2013, that is the period between the first and the last general elections. I argue and test that the Albanian party system is stable and that the Albanian political parties are (...) mass clientelist parties with deep territorial penetration. The members of the parties have ceased to paly their traditional roles of the era of mass party and their attachment tot he party is not ideological but aims to ensure material benefits in return for the support provided to the party in elections times. As parties don't have many tools at hand they use their organizational structure to stabilize electorate, which explains the low level of electoral volatility in Albania and as consequence the stability of the party system. The thesis ahs an institutional embedded and a historically structured framework according to which party strategies are shaped by both the institutional context and the historical setting in which parties are created and operate. Following this line of reasoning, the weak societal roots of parties do not allow for party identification or voter alignment; the early access to public funding reduces the incentives of parties to create strong links with the members and society to collect financial resources and; in line with the features of the patrimonial communism which is characterized by clientelism and nepotism, the Albanian political parties develop the same relationships between the higher echelons of the party and the lower strata of the party structure. On the other hand the lack of media access in the early phase of organization and the need to stabilize the electorate, encourage the Albanian political parties to seek a deep territorial penetration which results in the creation of mass clientelist parties. In order to test the hypothesis I have undertaken three steps: a) the analyses of the Effective Number of Parties and Electoral Volatility; b) the internal distribution of power, the role of the membership and the relationship of the organization with society and; c) the identification of financial resources of the political parties. The goal of this book is to recapture the diminished roles of affect, psychological needs, and the psychodynamic mechanisms that are crucial for understanding political behavior by explaining and extending the contributions of Harold D. Lasswell, the dominant figure in political psychology in the mid-twentieth-century. Although Lasswell was best known for applying psychodynamic theories to politics, this book also demonstrates how his framework accommodated for cognitive processes and social interactions ranging from communications to policy-making. SUMMARY The research focuses on the three main political parties in Albania, namely Socialist Party, Democratic Party and Socialist Movement for Integration. Its objectives are to measure the Intra-Party Democracy(IPD) in the Albanian political parties and to explore the meaning that party members attach to it. The IPD is understood and broken down into categories and sub-categories so that parties in particular and all interested actors in the field of political parties and democracy could understand, which (...) component of IPD parties are performing better and where they are performing worse. IPD is measured against two dimensions: inclusiveness and decentralization. Inclusiveness denotes the extent to which party members have the right to express their opinions and participate in the decision-making process. With decentralization is understood the process which makes possible the decentralization of the decision-making process from the highest national party level to party sub-national levels and party members. In a decentralized party, subnational party units enjoy a certain level of autonomy from the party in the center. The analysis is based on both primary and secondary data. Content analysis of party statutes particularly focuses on measuring IPD, while focus groups with party members and interviews with high-ranking officials of the political parties are used to explore the meaning that party members have on IPD, as well as validate content analysis findings. The main findings are: -/- Content Analysis of Party Statutes: Parties do have rules that govern their internal life, however these rules need to be improved in order to strengthen IPD. Especially problematic were the provisions for the role of the executive committee and party president, which provide these two institutions, especially the leader of the party with powers that don’t hold him/her accountable to the party members and middle level organs. Furthermore, members were not sufficiently involved in the procedures of candidate nominations for MPs, in the election of the national Executive and Executive Committee and in the election of the Party President. The analysis also finds that voting procedures are not sufficiently at place to allow members express their will and participate in the decision-making process and that members are not or little consulted in terms of programmatic issues. The analysis of the relationship between the national and subnational levels of party organization revealed that the center of the party has accumulated power to the detriment of the subnational units which enjoy little autonomy in the decision-making process. -/- Focus Groups and Interviews: The study finds that party members linked system-level democracy with IPD and that they have a very clear understanding if IPD: what it is and how it could be achieved. They linked IPD with the structure and organization of the party, seeing it as an important instrument that allows for decentralization of power and integration of rank and file into the decision-making process. The party members considered the statute as an important educational political tool and invoked it whenever disputes rose or decisions had to be taken. They linked IPD with the electoral system and considered that closed list proportional was a system that strengthened the power in the hands of the few at the party top executive level and weakened IPD. This paper empirically re(dis)covers a moment of conjuncture within Leicester when an opportunity opened up through multicultural/anti-racist education for schools and colleges to develop their ‘multicultural capital’. It does this through the thematic analysis of the key proximate document Report of the Working Party on Multicultural Education as well as drawing on interview data provided by two important agents who helped to implement Leicester’s/Leicestershire’s moment of multicultural education. This moment generated a symbolic, ideational, and conceptual shift within Leicester’s education (...) provision toward a more culturally inclusive position that began to recognise the cultural capital of non-white students. However, this moment was to be lost in the ‘neoliberal epoch’. It is argued in this paper that neoliberal education policy/practice has become an enabling mechanism for renascent colonial ideology. By re(dis)covering this vision for the official recognition of non-white cultural capital, this paper demonstrates the possibilities for alternative directions within Leicester’s schools and colleges that can challenge neoliberal and colonial conceptions of education. It suggests that there are still spaces and structures that can be re(dis)covered in order for this vision to be enabled. (shrink)

The purpose of this article is to systematize and generalize information about the political right-conservative movement in modern Poland. In the course of the study, the potential for support for right-wing parties exists in every society. It can grow due to two groups of factors. The first concerns issues related to the difficult economic situation, the modernization of societies or cultural aspects, which are called demand-related in the literature. The second large group consists of supply factors: factors of possible political (...) success (structure of political opportunities), electoral rules, inter-party competition, the role of the mass media, the structure of political divisions or the role of the winning ideology. Polish right-wing conservatism and nationalism is characterized, both in the past and in the present, by a powerful influence on the social and political life of the Republic of Poland, acting as a fundamental element of the unification of the Polish people. This movement retains its traditional features, which are reflected in the ideology of the Polish ruling party “Law and Justice”, which adheres to a national-conservative orientation with elements of clericalism, maintains close ties with the Catholic Church and organizations close to it. In the period after coming to power (2015), “PiS” slowly but steadily lost its Christian-democratic character and evolved into a conservative political force. This allowed “PiS” to win elections for a long time, and in 2023, it allows it to maintain leading positions in public opinion polls regarding support for political parties. In the field of international relations, supporters of “PiS” operated with judgments that expressed the ideas of nationalism, presenting the Poles as a strong nation that should occupy an important place among other countries. The process of creating right-wing conservative political parties and associations in Poland continues on an ongoing basis. The strengthening of nationalist movements in Poland takes place with the support of the state authorities of the Republic of Poland and is accompanied by a gradual shift of emphasis on controversial historical issues in the direction of nationalist ideology. Despite official Warsaw providing political support to Kyiv in the international arena in connection with the Russian military threat, the authorities of the Republic of Poland have no intention of blocking anti-Ukrainian activities carried out by Polish national-patriotic right-wing movements. This is due to the preparation of the ruling elite for the celebration of the 80th anniversary of the tragic events in Volyn in 2023, as well as the parliamentary election campaign. In the future, the activation of radical right-conservative formations on the territory of the Polish-Lithuanian Commonwealth may lead to protest actions in Poland, the purpose of which will be the dissemination of information unfavorable to our state in the Polish information space, which will have a negative impact on the formation of the foreign policy vector of the Polish-Lithuanian Commonwealth in the Ukrainian direction. The purpose of this article is to highlight the clientelistic strategies and informal practices that the ruling political parties in Albania use during the elections to ensure an unfair advantage in their favour over the opposition challengers. One of the main characteristics of the political developments of the transition period in Albania since 1991 has been the flourishing of informal practices and clientelist networks of political parties within state structures, which has produced an extreme politicization of these institutions. These strategies (...) that in general terms we label as “clientelistic” and that have been used to a large extent by the incumbent political parties have had a direct negative impact on the conduct of free and fair elections in Albania by distorting their main goal: to reflect the will of the people. This is because such clientelist strategies, together with the informal practices/mechanisms that accompany them, have influenced the creation of an unlevelled playing field, and have produced a hyperincumbency advantage in the electoral contests between political parties in Albania. The case of the recent elections held in Albania on 25 April 2021 will be the empirical case of this study, in which are evidenced the electoral containment strategies and practices that the ruling political party used to provide an unfair advantage in its favour and to secure its grip on power. A central question of this chapter is how we can relate the unique ethos of Japan to the ways that influences of international bioethics, civil rights and legal reforms have shifted medical research in Japan from the legacy of the structured paternalism and impunity that allowed abuses to be committed by medical researchers in the World War II era, including in Unit 731 and in medical schools in Japan, to contemporary research agendas and policies. Throughout the twentieth century, Japan has (...) been a centre of research and innovation. The pro-technology attitudes still exist in current Japan, with the evolution of bioethics. Although we can trace the origins of bioethics in Japan back through millennia, with the Ainu indigenous practices and relationships to nature, the sophisticated hierarchical relationships expressed in the seventh century A.D. book the Kojiki, the conversion of forest to rice paddies, emergence of an integrated religious system including Shintoism and Buddhism, and the sophisticated class system supported by linguistics and social relationships, this chapter would argue that one of the most influential influence for this question is the Samurai tradition. This tradition values both autonomy and informed choice, while also allowing the legacy of tolerance of the elite classes to make decisions that may sacrifice some persons for the greater good. While principles of solidarity and social justice are a solid basis for universal health insurance they also allow sacrifices when necessary. Informed consent is now widely accepted, and bioethics is part of a transition which is transforming Japanese society from a paternalistic society to an individualistic one. Among the issues that will be used to illustrate the situation, are the functioning of research ethics committees, large gene bank and epidemiological projects, organ transplantation, truth telling, euthanasia and the public health measures such as mask wearing in the current COIVD-19 pandemic. From a global historical viewpoint, federal systems are the exception rather than the rule, even though examples of federalism can already be found in Greek antiquity. From the 17th century onwards there was a revival of federalism, but in the post-World War II-era of decolonization federal systems did not emerge as the most popular form of government.Still, there is considerable variation among federal systems, i.e. those political systems where governmental authority is constitutionally divided among a central «federal» government and (...) «state» governments in such a way, that each type of government has final decision-making authority in at least a few policy fields ; a federation may be either effective or formal, unitary or decentralized, symmetrical or asymmetrical. In order to explain the extent and the kind of federalism in specific cases, the formallegal structure, the socio-economic environment and the political behaviour of elites as well as citizens should be taken into account. Political behaviour should be taken as the key factor, without disregard, however, for its relationship to social factors and format structures. In order to assess their relative importance, comparative research is required; Western Europe and the Third World offer highly promising prospects for this type of research. On the research agenda of federalism, special attention should be given to topics like the informal federal arrangements in cabinet formation, policy-making and public administration, federal party polities, and the impact of public policies on the federal socio-economic environment. Sixty years of democratic representation in Germany allow us to study the working of a specific type of electoral system, namely a mixed system combining proportional and majoritarian rules, in great detail.

The article attempts to trace the origins and to assess the extent ofparty-system change in Italy in the 1990s. It also examines some hypotheses on the possible causes of such changes. Building on research on anti-party sentiment and on changes in party organization the paper begins with an analysis of the evolution of the party system in the last 30 years which identifies organizational adaptation as a delaying factor in party system change. This (...) is followed by a description of the party system after the 1994 elections based on generally accepted party system characteristics and indicators. The assessment is made difficult by the, perhaps temporary, coexistence of two party-systems, respectively relevant for electoral and inter-election competition. The evidence however, suggests, that party-system transformation is under way, while it might still be inappropriate to talk about structural change. Degeneration of parties and a deep institutional crisis appear to be the factors leading to the explosion of pent-up alienation and antiparty sentiments, and to demands for institutional and constitutional change that preceded and appeared to be the immediate causes of party system transformation. Modern democracy is impossible without political parties. They are necessary in the process of the construction of the political class and building of relations between politicians and ‘ordinary people’. So, in Poland in the twentieth and the twenty-first centuries the significance of parties is also very important. Their history is older than the history of the reborn Poland. Especially in Galicia, an autonomous province of the Hapsburg empire, we can see the activities of many politicians. A part of them in (...) 1895 declared the birth of the Popular Party which is a constant element of the Polish political scene. The second traditional current is the socialistic movement, which is also always legally active in Poland. These two camps represent, in simplification, the ‘two Polands’—the first more traditional, conservative and provincial, and the second more progressive, ‘European’ and urban. Actually, in the typical consciousness of a Polish citizen, the political representation of the ‘black’ country is the party Law and Justice of Jarosław Kaczyński, and the ‘red’ country admires the Citizen Platform with Donald Tusk as a leader. But probably the idea of a twoparty system, like in the Anglo-Saxon world, is still very distant to reality, because in the European continent, the tradition of pluralism in a policentric version is still very significant. In Poland, even in the period of the ‘real socialism’ this conception of the organization of political life was realized, though naturally in the specific version. There were three legal parties and the Polish United Workers’ Party (the PUWP) was the most important. From 1976, the PUWP in the light of the Constitution had the official hegemony in the Republic. It is possible to compare this situation with the period 1926–39, when, after the coup d’état by Marshal Piłsudski, the Government still won in the election and the official elite wanted to create a stable political force with a perspective of permanent rule. But we must remember that between the wars opposition always was legal. In our times of demoliberalism, this is quite normal (though under the Constitution, unconstitutional parties, for example, communist or fascist, are unacceptable); however, interesting is the fact that when you observe sine ira et studio the evolutional trend of the Polish political system, you easily find the tendency of the ‘stabilization’ of the party system in the way of legal operations. From 1997, the laws concerning political parties have changed the possibilities of the conquest of seats in the Seym. Actually, only the parties having 5 per cent (or 8 per cent in coalition) of votes can gain the representation in the Diet. So it is possible to claim that the little parties today are in a more complicated situation than in the first years after the ‘operation of Round Table’ in 1989. The contemporary system is maybe more stable, but less liberal. There are theoreticians who note the danger of the alienation of the political class in the situation of the renewal of the alienation of the political elite, which de facto is more connected with the state than with the society. Many theoreticians emphasize that in the future the role and the character of political structures will be profoundly different from today. Maybe they are prophets, but we can expect that the Polish political parties or ‘post-parties’ and also political structure as a whole will have many similarities with their actual equivalents, because the mentality of the Polish nation, including the politicians, is more or less enduring. Parties are central agents of democratic representation. The literature assumes that this function is an automatic consequence of social structure and/or a product of incentives derived from electoral competition. However, representation is contingent upon the organizational structure of parties. The connection between a party and an organized constituency is not limited to electoral strategy; it includes an organic connection through permanent formal or informal linkages that bind party programmatic positions to social groups’ preferences, regardless of the (...) electoral returns. This article analyzes how the Movimiento al Socialismo in Bolivia and the Frente Amplio in Uruguay developed two different forms of relationship with social organizations that result from the interplay of historical factors traceable to the parties’ formative phases and party organizational attributes. Party organizational features that grant voice to grassroots activists serve as crucial mechanisms for bottom-up incorporation of societal interests and demands. (shrink)

With size, voting discipline, and technical resources superior to those of most Brazilian parties, in the last two decades, the support of the Agrarian Caucus has become crucial for the realization of presidents’ legislative agenda. In a country where 87 percent of the population is urban, how have representatives of the agrarian elites become key players in bargaining on nonagrarian issues? This article argues that Brazilian agrarian elites have been so successful because they have devised an electoral strategy that (...) maximizes their leverage in a fragmented party system with ideologically weak right-wing parties. Empirically, I show how agrarian elites in Brazil finance legislative campaigns, mobilize voters, and subsidize the legislative work of politicians from their ranks, independently of their partisan affiliation. Theoretically, I discuss the advantages of a candidate-centered electoral strategy: self-representation and multipartisanship. While self-representation has granted agrarian elites direct access to agenda-setting positions within Congress, having members in many parties has increased the number of agenda-setting positions they can control and guaranteed their presence in the legislative coalition of right- and left-wing presidents alike. It is the intention in this article to explain the electoral stagnation of the Republican People’s Party (Cumhuriyet Halk Partisi, CHP) in the light of the 2015 parliamentary elections in Turkey. Drawing on theories of voting behavior, the article uncovers the organizational shortcomings within the party and the problem of credibility that have emerged as significant impediments to the party in addressing long-term historical-structural issues, mainly the division of Turkish society between the religious periphery and (...) the secular center. Furthermore, the strong identification between the ruling Justice and Development Party (Adalet ve Kalkınma Partisi, AKP) and its partisans have made party-switching difficult, having been achieved, above all, through the provision of economic benefits and public services and the consolidation of party identification through growing polarization and division in Turkish politics. Last but not least, the changes to the political environment between the June 7 and November 1, 2015 elections, pushed stability and security to the top of the agenda, as well as AKP’s electoral adjustments in the run-up to the November 1 elections inhibited any possible flow of votes to the CHP. For fifty years, Bolivia’s political party system was a surprisingly robust component of an otherwise fragile democracy, withstanding coups, hyperinflation, guerrilla insurgencies, and economic chaos. Why did it suddenly collapse around 2002? This article offers a theoretical lens combining cleavage theory with Schattschneider’s concept of competitive dimensions for an empirical analysis of the structural and ideological characteristics of Bolivia’s party system from 1952 to 2010. Politics shifted from a conventional left-right axis of competition, unsuited to Bolivian (...) society, to an ethnic/rural–cosmopolitan/urban axis closely aligned with its major social cleavage. That shift fatally undermined elite parties and facilitated the rise of structurally and ideologically distinct organizations, as well as a new indigenous political class, that transformed the country’s politics. Decentralization and political liberalization were the triggers that politicized Bolivia’s latent cleavage, sparking revolution from below. The article suggests a folk theorem of identitarian cleavage and outlines a mechanism linking deep social cleavage to sudden political change. (shrink)

Conventional theories of government formation have assumed that the coalition formation process starts after legislative elections are over and the distribution of parliamentary seats becomes common knowledge. This perspective, however, ignores the important constraints that the formation of electoral coalitions may exert on the formation of the government. This article argues that the electoral system of Hungary provides very strong incentives for political parties to build electoral coalitions, which are also identified as alternative governments before the (...) electorate. The first aim of the article is to present the lineage of party organizations integrating several "classical" approaches. Therefore a second aim is to set up a structural model able to catch the evolution of any typeof modern party organization.One assumes that Party Structure is an invariable element which subsumes several organizational translations. Same are protopartisan translations : leagues, armed and unarmed f actions, parliamentary groups. Some are partisan translations : modern party organizations. This assumptions means (...) a corollary: organizations tend to adapt to the kind of party competition they have to afford in order to have accessto governmental power. The model combines the assumptions in a two dimensional matrix.The first dimension is concerned with the organization's major historical goal. A bold new approach to combatting the inherent corruption of representative democracy This provocative book reveals how the majority of modern liberal democracies have become increasingly oligarchic, suffering from a form of structural political decay first conceptualized by ancient philosophers. This article is concerned with the epistemological and methodological problems related to the taxonomy of political parties whett based on noorganizational criteria.The study of parties represents a starting point for modern Political Science : i.e. the seminal researches of Bryce, Ostrogorski and Michels. However this important field of knowledge hasn't known that much progress since the classical Duverger's Political Parties. Why?Two kind of approaches are used in order to classify parties: individualistic versus holistic. «Individualistic classifications» often suffer from a lack (...) of theoretical background. Same of them use a spurious criterium like party names : i.e. Radical means extreme-left in the USA and conservatism in Switzerland, secularist activism in Italy and evangelical left in the Netherlands etc.Some classifications are based on political platforms which is a meaningless criterium: «A general election campaign is about a choice between organizations, not ideas.» The third criterium is far better: policies really implemented by political parties. However when properly used it gives a typology of countries, not parties.«Holistic classifications» either functionnalist or marxist opposed each other : the first stressed on equilibrium, the latter on class warfare. One suggests Rokkan's four cleavages paradigm to classify parties : each side of a cleavage should correspond to a definite «Political Family».Which items to use in order to assess a party to a permanent cleavage line? The historical function performed by the party at its creation. The sociological structure of the party's : electorate, membership and inner group; The linkage structure between the party and a given network of pressure groups, movements and associations. “The Nature of Belief Systems” sets forth a Hobson's choice between rule by the politically ignorant masses and rule by the ideologically constrained—which is to say, the doctrinaire—elites. On the one hand, lacking comprehensive cognitive structures, such as ideological “belief systems,” with which to understand politics, most people learn distressingly little about it. On the other hand, a spiral of conviction seems to make it difficult for the highly informed few to see any aspects of politics but those that confirm (...) the cognitive structures that organize their political perceptions. This is a troubling situation for any consequentialist democratic political theory, according to which what is crucial is the electorate's (and subsidiary decision makers') ability to make informed policy judgments, not their possession of willful but uninformed political “attitudes.” Any political theorist who does not take democracy to be an end in itself (regardless of its consequences) should be concerned about Converse's findings. This article addresses the relationship between the structuralism, especially the anthropological version of the latter in Levi-Strauss and Luhmann’s theory of social systems. The analysis is done through two guiding hypotheses. It reviews the historical background relating structuralism with systems theory and discusses the fundamental concepts that appear in this relationship. Luhmann's systems thinking are contrasted in some of its central concepts with Lévi-Strauss’s structuralist perspective. The paper concludes with a review of the hypotheses presented and some proposals about (...) the perspective of the social systems. El presente artículo aborda las relaciones entre el pensamiento estructuralista, especialmente la variante antropológica de éste en Lévi-Strauss y la teoría de sistemas sociales de Luhmann. El análisis se hace a través de dos hipótesis que guían el desarrollo del texto. Se revisan los antecedentes históricos que relacionan al estructuralismo con la teoría de sistemas y se analizan los conceptos fundamentales que aparecen en esta relación. Posteriormente el pensamiento sistémico de Luhmann se contrasta a partir de algunos de sus conceptos centrales con la perspectiva estructuralista de Lévi-Strauss. Every ten years United States congressional districts are drawn, physically constructing political representation based on domicile. Why do we do it this way? Is territorial representation consistent with the broader normative ends of political representation). ;In section one I argue that territorial constituencies were never intended to represent local "communities of interest." Instead, physical proximity between voters was necessary to achieve the normative aims of representative government in a large nation. I begin in 13 th century England, and proceed through (...) the political theory of Hobbes, Locke, Montesquieu, Burke, the Federalists and their critics. I also provide a novel interpretation of Federalist 10. ;In sum, territory was a habit of mind for the founders of the United States, and thus there were no explicit reasons given for using territory. The silence of territory as a definer of electoral constituencies has continued to the present day. I argue that the continued silence about territorial constituencies constitutes a substantial breech of legitimacy. ;In the second section , I argue that "constituency definition" is a normatively rich institution and how constituencies are defined ought not to be determined by interested third parties. I argue that Hanna Pitkin incorrectly conflated "political representation" and "legitimacy." I argue that citizen consent to constituency definition is a central part of legitimating any representative government. Finally, I argue that there are no persuasive normative arguments for territorial constituencies today. Justifying territorial constituencies on the normative claim that "communities of interest" ought to define constituencies for political representation is simply unpersuasive. If one believes such particularity ought to be represented in one branch of the national legislature, then other kinds of particularity---race, ideology, class, et al---simply dominate. ;In section three I argue against "particularity" for electoral constituencies. I conclude with a thought experiment: randomly assign voters into 435 national, electoral constituencies for life. Having established that the concept of "constituency" is itself normatively robust and separable from "electoral systems," I argue that important considerations of "voice," can be introduced through novel means of reform. Since the Reformation and Enlightenment, the Western world has witnessed the incremental decline of religious influence. Yet, key legal protections and duties incumbent on civilians and state actors in both avowedly secular states and ruling theocracies, predominantly Islamic, are to a lesser or greater extent determined by religious values. Although it is often claimed that the modern secular state encourages the adoption of liberal values and allows for the formulation of general law according to the free will of its people, (...) the historical legacy of law and particularly its synthesis with the Judeo-Christian heritage is apparent. In the UK, the continuing centrality of religion in what purports to be a secular system of laws, is demonstrated by the introduction of elements of Sharia law. In an increasingly culturally-diverse society, the recognition of Islamic law may be interpreted as the tacit acknowledgement of the existing inherent faith influences which continue to inform many legal innovations, and represents an explicit attempt to rebalance the privileging of one set of precepts above another. It is suggested that religion continues to occupy a central position in lawmaking; performing a cultural, political, institutional and, importantly, symbolic role and this is evidenced for instance by the narratives which are imposed on individuals in relation to areas of topical significance such as matrimony, terminal illness, abortion, gender and sexual morality. This paper argues against those pronouncements of the retreat of religion in state affairs and, rather, reveals a set of key structural relations and signifiers which are informed by opinions redolent of, not least of all, a peculiar generic proscriptive religiosity. Words can mean different things to different people. This can be problematic, mainly for those working together in a bureaucratic institution, such as the secret service. Shared, certified, explicit and codified definitions offer a counter to subjective, solitary and/or culturally dominant definitions. It’s true that codified secrecy terms for secret services can be seen to involve a number of political, cultural, subcultural “languages”, but if words come from unclassified or declassified files, memorandums and/or records, one needs a deep understanding of (...) the secret services. A remarkable feature of this bureaucratic language is the evolving nature of, certain “keywords” as important signifiers of historical transformation. Thus, the changes in the language of the secret services depends at least as much on the internal changes of the secret services as on the transformation in the external political-social environment. In spite of the confusion of Hungarian secret services in the revolutions of 1918–1919 and the disintegration of the Austrian-Hungarian Monarchy, in the early 1920’s became a stable system. Between the two World Wars, the Hungarian State Police directed by the Ministry of Internal Affairs, the Military Intelligence and Counter-Espionage directed by the Ministry of Defence, and the Hungarian Royal Gendarmerie directed by both of the Ministries had their own operational service. This structure existed unchanged until 1945. Simultaneously with the forward advance of the soviet troops, government began to re-establish the former system of the secret services in the eastern part of the country. After WWII, in 1946, the “State-protection Department” as political police became independent from the police. However, from the beginning, they remained under the control of the Communist Party. After 1950, the State Security Authority provided special services for the MIA and the Military Political Directorate of the MoD. After quashing the revolution in 1956, in the spring of 1957, the MIA Political Investigation Department was established which—with slight modifications—kept the structure created during the “state protection era”. The MIA III. The State-Protection General Directorate was established in 1962. The reorganization was finalized in the middle of the 1960’s, which resulted in the new system, which—with the structure of Directorates—became the ultimate structure of the state secret police until the abolishment of the MIA General Directorate III in January 1990. These organizational transformations were largely the result of exogenous historical-political changes. Moreover, each new period had a major impact on the organizational communication, language use and vocabulary of the secret services. This study seeks to interpret these historical transformations. In lieu of an abstract, here is a brief excerpt of the content:The Meanings and Function of Anti-System Ideology in the Weimar RepublicBen LiebermanThere are few, if any, ideological terms in the extensive historiography of the Weimar Republic so omnipresent and yet at the same time so obscure as the word “system.” Historical accounts of the Weimar Republic are strewn with references to the “system.” In recent works on the Weimar Republic Hagen Schulze points to the (...) opposition of bourgeois (bürgerliche) parties to the “Weimar ‘system,’ “ Detlev Peukert notes “hatred of ‘the system,’ the political and social order of the Republic”; Knut Borchardt observes the loss of faith in the capacity of “the system” to satisfy expectations; and Hans Mommsen refers to the “political system,” the “party system” and the “parliamentary system.” 1Historians, whatever their other differences, agree that mounting opposition to the System weakened the Weimar Republic, but the usefulness of this observation requires analysis of the meaning or meanings of the System. What, then, was the Weimar System? Surprisingly, many accounts of the Weimar Republic do not even attempt to provide a definition of the System, and the term receives only cursory treatment in several specialized works on ideology of the Weimar era. 2 Anti-System politics does receive attention, but Thomas [End Page 355] Childers’s insightful and pioneering essay on “anti-system politics” concentrates on mobilization against the System rather than on the problem of defining it. 3The best existing analysis of the System in Kurt Sontheimer’s valuable study of anti-democratic thought in the Weimar Republic suggests that historians cannot take the meaning of the term as a given. Sontheimer establishes that the System formed part of the array of anti-democratic thought of the Weimar Republic, but he also notes that the term’s meaning cannot easily be pinned down. The System conveyed a variety of political and economic meanings and ultimately formed a “nationalist counter myth.” 4During the Weimar Republic, attacks against the System emanated from a wide range of sources, most notably from a variety of nationalists as well as from Communists. Nationalists of many leanings detested the System. The DNVP (German National People’s Party), the largest political party of the right for most of the Weimar Republic, hated the System. So, too, did conservative revolutionaries and völkisch (ethnic or racist nationalist) groups including nationalist associations and the National Socialists. At the other end of the political spectrum, attacks against the System also surfaced in the pronouncements of the KPD (German Communist Party). 5No single ideological line of attack doomed the Weimar Republic, but use by an extraordinarily broad range of political groups lent tremendous force to anti-System discourse. Adopted by foes who sometimes agreed on little else, the System was the targets of repeated attacks spread across the German political spectrum and called into question Weimar legitimacy. In one respect, the story related in Terry Pinkard's new book on German idealism is a very old-fashioned one of the "from Kant to Hegel" sort, inasmuch as Hegel's system is here (...) presented as the logical culmination of a single movement of thought, initiated by Kant and carried forward, first by Fichte and then by Schelling; and post-Hegelian philosophy is interpreted as a desperate reaction to the apparent failure of the grand idealist project. In other respects, however, Pinkard offers a welcome variation on this familiar tale by including chapter on less familiar figures and by interpreting the idealist project in the context of some current philosophical concerns.A distinctive feature of this new history is its powerful narrative thrust. Pinkard organizes his tale around a single, central issue, which he calls the "Kantian paradox." The paradox in question is that of self-legislation or self-authorization, a paradox implicit in Kant's claim that one can be bound by laws of which one is also the free author. Though this paradox obviously pertains to Kant's moral philosophy, Pinkard shows that it also extends to the application of any rational norms whatsoever. Pinkard's object is to show how each of the thinkers he discusses responded to this "Kantian paradox," culminating in Hegel's alleged recognition that this paradox is "the basic problem that all post-Kantian philosophies had to solve" (226) and in his effort to provide an essentially social solution to the problem of reason's self-authorization.The book commences with a superb essay on "'Germany' and German Philosophy," examining the relation of "German philosophy" to "Germany" during the period in question, an essay that would be an ideal first assignment for any course on nineteenth-century philosophy. Each of the four major parts of the book begins with a similarly useful, short historical/contextual introduction.Part One is a brilliant summary of the Kantian revolution, not just in epistemology and metaphysics, but also in moral philosophy, aesthetics, and teleology. Without bogging down in unnecessary details or arcane scholarly disputes, Pinkard manages to provide a nuanced account of Kant's arguments and conclusions, emphasizing those tensions and problems in Kant's writings that occupied the attention of the philosophers who followed.Part Two is devoted to the pre-Hegelian "post-Kantians," not just Fichte and the early Schelling, but also Jacobi, Reinhold, Hölderlin, Novalis, Schleiermacher, Frederich Schlegel, and Fries. Pinkard's discussions of these lesser-known figures is welcome and illuminating. The same cannot, unfortunately, be said of his discussion of Fichte. Though the paradox of self-authorization is obviously a central Fichtean concern, Pinkard's account of the Wissenschaftslehre seriously distorts Fichte's project and accomplishments—beginning with Pinkard's failure to distinguish between the Wissenschaftslehre itself, as the name for a complete system of philosophy, and the 1794/95Foundations of the Entire Wissenschaftslehre, which is concerned only with the rudimentary foundations of the same. (This leads him to the mistaken view that Fichte's treatises on right and ethics are "revisions" of the Wissenschaftslehre, [End Page 110] rather than systematic branches of the same.) The account of the Foundations is itself skewed, inasmuch as it fails to take account of how Part III of this text provides a "practical" solution to the "theoretical" impasse of Parts I and II. Instead, Pinkard offers an interpretation of Fichte's early system that simply ignores the centrality thereto of willing and striving, makes no mention of the key role of productive imagination, and characterizes Fichtean intellectual intuition as "an insight into the necessary structure of things themselves" (110). Though Pinkard is aware that the overwhelming majority of Fichte scholars reject such an interpretation, he nevertheless advances it, claiming the right to "argue the opposite view." In the last five years, the Italian political system registered its most important crisis. All parties, existing since the second world war, disappeared or were greatly transformed. The main purpose of this article is to analyse the deepest causes of the first Italian republic's collapse, following some specific interpretations of ltalian political observers.L. Ricolfi bases his theory on the emergence of "Lega" and the return of laïque culture in Italy. The old christian democratic and communist parties will suffer the (...) most from these changes.A. Sofri emphasizes the identity of northern regionalism between the "Lega" and the "Pool of Milan". A real opposition emerges between the judges of Milan and the politicians of Rome.S. Romano and M.L. Salvadori prefer the historical approach: for them, the events of1990-1994 are very similar to what happened in 1922-1926and in 1943-1945. The absence of a pacific alternative and the "ideological war" among political forces produce the effect that every change in Italian politics implies an end of regime.L. Ornaghi and V.B. Parsi deal with the "values" of citizens which, very often, do not correspond to the values of old politicians. Although former Yugoslavia constituted what was widely held to be the most "promising" communist country in terms of potentials for economic reform and political democratization, Serbia remained the only East European country in which the former communist elite managed to defeat its opponents in a series of elections and preserve important elements of institutional and ideological continuity with the old system. Moreover, its regime played a conspicuous role in Yugoslavia's violent collapse. In the specialist literature, the "Serbian exceptionalism" thesis (...) has been elaborated in a number of forms. These are critically reviewed in the first part of the paper, classifying the paradigms according to whether they emphasize: 1) Serbian traditionalist, authoritarian, and collectivist political culture, 2) the affinity between traditional Serbian national populism, Russophile anti-Westernism, and communism, 3) the exclusivist and assimilating character of Serbian nationalism, or 4) the appeals of the contemporary Serbian political elite led by S. Milosevic. In the second part of the paper an alternative explanation is presented that seeks to be both interpretively adequate and causally plausible. It rests on five basic factors: 1) historical legacy ; 2) institutional analysis ; 3) ideology ; 4) leadership and social base ; and 5) the role of the Diaspora.. Stavise, taj je rezim igrao krupnu ulogu u nasilnom raspadu SFRJ. U specijalistickoj literaturi, teza o "srpskoj izuzetnosti" razvijana je u razlicitim formama, cijem kritickom razmatranju je posvecen prvi deo rada. Citizenship is usually seen as a product of modern nation-states, or of other political entities which possess institutional infrastructures and political systems capable of producing a coherent framework that defines the relationship between that system and its members. In this paper, we show that an early system of modern citizenship was created in the absence of a formal state, notably by the cultural elite of a stateless nation. The Polish case illustrates that an elite may become a dominant (...) class in the given society only later, and institutionalize that early citizenship system within the framework of a newly founded state. As a result of the legacy of the emergence of citizenship predating the restoration of statehood, the contemporary Polish citizenship model is influenced by a strong and largely overlooked cultural component that emerged at the turn of the 19th century. This model uses the figure of the intelligentsia member as its ideal citizen. Despite the dramatic political and economic changes in the decades which have passed since its emergence, this cultural frame, which was institutionalized during the interwar period, still defines the key features of the Polish citizenship model. Consequently, we argue that the culturalization of citizenship is hardly a new phenomenon. It can be seen as a primary mechanism in the formation of civic polities within the imperial context. Moreover, it shows that such processes can have many ambiguous aspects as far as their Orientalizing forces of exclusion are concerned. (shrink)

Like the American system ours is federal: i.e., there are two levels of government, neither of which can change the powers of the other or make laws within certain fields assigned to the other. The British system is 'unitary': the British parliament can make laws on any matter, local government has whatever powers the national government delegates to it. Like the British, ours is a system of responsible government . The Government (the Prime Minister and cabinet) is (...) 'responsible' to parliament. This means that at any time, simply by vote of no confidence, carried on whatever grounds, the parliament can remove the Government from office or force it to call an election. In the American system the head of the executive Government, the President, cannot be removed by the Congress (except by impeachment, which requires a kind of trial). As in the British system, a general election can be called at any time (by the Governor General, on the advice of the Prime Minister). There is a maximum term by which an election must be called, but an election can be held short of term. This makes the parliament responsible to the electorate -- for example, if Government policy that has general community support is blocked by the opposition or minor parties, the Government can appeal to the electorate. In the American system the terms of office of the House of Representatives, Senate, and President are all 'fixed', so that an early election cannot be held. If a President dies or resigns, the Vice President serves out the remaining part of his term. There are no circumstances in which the American President can dissolve Congress and call an early election. The U.S. constitution has separation of powers , i.e., the members of the Executive (in our terms, the Government) do not have seats in Congress or participate in its sessions, and they are not removable by Congress and cannot dissolve Congress. The Judiciary is also separate from both Executive and Congress (though judges are appointed by the Senate on the nomination of the President, and can in exceptional cases be removed).. (shrink)

The Belgian polyarchy has developed into a «particracy» in which the political parties have a preponderant impact on the political decisionmaking.As in every polyarchy, the political parties fulfill a set of vital functions in the Belgian system. But that does not explain its «particratie» particularity. The particracy arises as a consequence of four factors. The parties are fixed by the «zuilen» into an «internal-imperialistic» role. The power of the parties increased considerably, an increase of which the politization of the (...) instruments for, and the agencies of, policy is one of the most important, together with the capability of making and unmaking issues. The impact and power of the opponents of the parties in the decision-making process have been diminished to a considerable extent. This weakening involves the king, the parliament, theadministration, the electorate, and, ultimately, the cabinet because of the growing impact of the parties on policy design and policy output as well as on the appointment of ministers. Finally, the choice of the consociational pattern of politics of accomodation by the elite indicates the instrumental function of particracy in Belgian politics. (shrink)

Rachel Ramsey Scholars of seventeenth-century intellectual history have generally relegated John Webb to the footnotes of their work on universal language schemes, architectural history, and Sino-European relations. 1 In this essay I suggest that Webb's An Historical Essay Endeavoring a Probability that (...) the Language of the Empire of China is the Primitive Language (1669), which argues that for 5000 years China preserved the language spoken by Adam and Eve in the Garden of Eden, makes significant contributions to seventeenth-century intellectual history and to our understanding of early modern European perceptions of China. When Webb's Essay is placed within the context of the seventeenth-century debates about the "primitive" language of Eden, China's ancient history, and the idealization of that empire's harmonious and prosperous culture, its deeply political nature becomes apparent.The Jesuit accounts and those of other travelers to China were especially appealing to English readers living in the aftermath of the civil wars and the turmoil of the early years of the Restoration because they offered glimpses of a seemingly ideal state ruled by a stable monarchy and blessed with seemingly infinite resources and unimaginable wealth; however, these accounts included evidence that China had maintained an unbroken historical record that antedated the Flood, thus implicitly challenging the veracity of the Old Testament account of Noah and the Universal Deluge. Webb's Essay solves the problem posed by the Jesuit accounts of China's ancient history by placing them within a revised biblical narrative; this solution makes it possible for him to claim that China's [End Page 483] exemplary status is a result of its possession of the primitive language and its socio-political virtues are the consequence of its Noachian origins. The revised biblical narrative not only made Webb's encomium to that country more acceptable to a bible-reading public and protestant king but offered a politically-safe way for him to criticize the restored English monarchy by contrasting it to an idealized account of China's social and political state. More specifically, the circumstances of Webb's years of service in the Office of the King's Works help us further understand what attracted a seventeenth-century architect to the Jesuit accounts of China and what motivated him to write the first English treatise on the Chinese language. Webb's political career allows us to read AnHistoricalEssay as a politico-theological justification for a reasoned critique of the patronage system which Webb held accountable for his thwarted career ambitions. Webb's Career and the Politics of the Restoration John Webb lived through some of England's most turbulent history and witnessed firsthand the effects of monarchical instability and regicide, the uncertainties of the Commonwealth, and the shortcomings of the Restoration. Born to a Somerset family in 1611 and educated at the Merchant Taylors' school, Webb became Inigo Jones's pupil in 1628 and served as his "Clerk Engrosser" from 1633 to 1641 in the Office of the King's Works, where Jones was Surveyor. During the early years of the English revolution Webb served as his mentor's deputy in London after Jones fled north with Charles I, but he was dismissed from his post in 1643 following an "accusation from one Mr. Carter to the Committee of the Revenue, that the said Mr. Jones was at Oxford." 2 During his absence from the Office of the Works, Webb supposedly sent detailed plans of London's fortifications and smuggled jewelry to the king, for which he was briefly imprisoned. 3 After Charles I's execution in 1649, Webb worked on several country houses, including those of the Earl of Rutland at Belvoir, the Earl of Peterborough at Drayton, and Sir Justinian Isham at Lamport but he was firmly excluded from holding any political post as a former consort of the martyred King. 4 He held an appointment briefly... The book reconstructs the history of Western ethics. The approach chosen focuses the endless dialectic of moral codes, or different kinds of ethos, moral doctrines that are preached in order to bring about a reform of existing ethos, and ethical theories that have taken shape in the context of controversies about the ethos and moral doctrines as means of justifying or reforming moral doctrines. Such dialectic is what is meant here by the phrase ‘moral traditions’, taken as a name for (...) threads of moral discourse, made in turn of other interwoven threads, including transmission of shared codes, appeals to reform of prevailing custom, rational argument about the justification of some precept on the basis of some shared general teaching or principle, and rational argument about the ultimate basis for principles and justification of authoritative teaching. That is, the approach adopted to the reading of ethical texts depends on a firm belief in the fact that philosophers hardly created any ethical doctrine out of nothing. The main point this book tries to highlight is how different philosophical theories emerged and followed each other as a result of attempts at accounting for what was going on in the world of moral traditions. Changes were propelled by controversies between different schools, and highly abstract arguments were the unintended effects of moves made by controversialists forced to transform (and occasionally to turn upside down) their own doctrines in order to face the challenge posed by other arguments. This is the reason why the book examines not only texts that already enjoy pride of place in the history of philosophy (Aristotle, Kant, Hegel), but also other texts usually treated in the histories of religions (the Bible, the Talmud, the Quran), and others considered to be much less philosophical (Plutarchus, Pufendorf). -/- 1. Plato and a response to ethical scepticism. Two different traditions of morality in VI-V century Greece are described. The birth of philosophical questioning of traditional morality and temporal and spatial variation of custom is described within the context of the v century crisis, the demise of traditional aristocratic and tyrannical rule and the birth of democracy. Two conflicting answers to the challenge are reconstructed, namely conventionalist or immoralist theories formulated by the Sophists and the eudemonist and intellectualist Socratic theory. Plato’s own reformulation of Socrates answer to the Sophists is reconstructed. His psychological views, his classification of the four cardinal virtues and his political theory are described as parts of a unitary system, culminating in an extremely realist moral ontology identifying the idea of the good with the essence of the (moral and extra-moral) world itself. -/- 2. Aristotle and the invention of practical philosophy. Aristotle’s invention of practical philosophy as a field separated from first philosophy is shown to be an implication of his break with Plato moral ultra-realism. Aristotle’s agenda in his moral works is arguably dependent on a polemical intention, namely dismantling Socratic intellectualism. The semi-inductive or virtuously circular method of practical philosophy is illustrated, starting with the received opinions of the better and wiser individuals and trying dialectically to sift what is left of mistake and inconsistence in such opinions, finally trying to correct mistakes and make the overall practical science more consistent. The chapter illustrates then the relationship of individual ethics, or ‘monastics’, with the art and the science of the pater familias, or ‘economics’, and the science of the ruler and citizen, or politics. The nature of virtues, or better, excellences of character, is discussed, highlighting the basic role of hexis, or ‘disposition’. Prudence, or better practical wisdom, is the focus of the chapter. Its relationship with bouleusis or deliberation is examined, and its autonomous status vis-à-vis theoretical knowledge is stressed. -/- 3. Diogenes and philosophy as a way of life. The chapter provides an overview of Hellenistic ethics, which almost amounts to Hellenistic schools of philosophy, in so far as ‘philosophy’ became in these centuries primarily the name for a way of life. The typical character of the Cynical movement is highlighted, that of a school of life, not a school aimed at providing any kind of intellectual training was to be provided. -/- 4. Epicurus and ethics as self-care. The peculiar character of the Epicurean school is described, a combination of a science of well-being aiming, more than at pleasure as in the popular view, at reduction of useless suffering, of unnecessary needs, and at a balanced selection of pleasures of the best and most durable kind. -/- 5. Epictetus and ethics as therapy of the passions. The various phases of Stoicism are described, and the shifting place given to ethics in the Stoic system of idea, culminating in the paradoxical view of ethics, its impossibility in principle notwithstanding, as the only truly significant and necessary part of philosophy. Cicero is treated, showing how his own synthesis of various Hellenistic trends is as a truly philosophical enterprise, deserving serious consideration after one or two centuries when he was confined to the role of literate. Epictetus is chosen as the best example of what the Stoic tradition could yield, an art of living based on sophisticated introspection, in turn aimed at making a kind of cognitive therapy possible, dismantling obnoxious passions at their root by systematically correcting false representations. -/- 6. Philo and the reconciliation of Torah and Platonism. A reconstruction of basic ideas from a few books of the Hebrew Bible is provided, starting with the Prophetic tradition and the focus on God’s mercy as the source of motivation and standard for human behaviour. Then a comparative analysis is undertaken of a parallel tradition, namely the three codifications of the Torā (Law or, better, Instruction), highlighting how a core of moral ideas may be recognized as a basis and preamble of codification of civil law, cultural practice, and regulation of ritual purity. The importance of Leviticus is stressed as the turning point when emphasis mercy, typical of the Prophetic tradition, is combined with the legal tradition, yielding the change in sensibility of the Second Temple time. Philo of Alexandria is described as one of the three leading figures – together with Rabbi Hillel and Rabbi Yeshua – at the apex the emergence of the mentioned new sensibility, gradually including mercy as an essential part of justice and establishing the starting point of both the Rabbinic and the Christian tradition. This consists precisely in the precept of one’s neighbour’s love or of the golden rule, two eventually identical precepts whose meaning is arguably more sober and sensible than the long-lasting Christian tradition deriving from John and Augustine has made us believe and no novelty vis-à-vis so-called Ancient-Testament teachings. -/- 7. Augustine and Christianity as Neo-Platonism. The first section examines the moral doctrines of so-called 'ethical Treaties' from the Talmud, a group of treaties, among which the best known is Pirqé Avot, that were left out of the six "orders" of the canon as they did not fit in any of the six groups of issues ritual or legal on which the division was based. According to Maimonides, their peculiar theme is provided by the Deòt, 'opinions', i.e., mental dispositions, that is, the translation of the Greek term hexeis and Arab akhlak (in turn providing in this language the name for ethics as such). The three topics I reconstruct are: i) the notion of Torah: The Torah is understood as the world order itself, or as the ‘Wisdom’ that existed even before creation and was ‘the tool by which the world was built’; however, the Torah is an earthly and human entity, as it was "received" by humans, and from that very moment belongs to them; ii) the relationship between love of God and love of neighbour; the treaties require us to study and practice the Torah ‘for its own sake’, that is, require us to act out of love, not out of fear or hope of reward; iii) the idea of sanctification of daily life: having disappeared with the destruction of the Temple the possibility of any conflict between liturgical service and everyday life, the latter is assumed to be in itself divine service: to give food to the poor has the same value as sacrifices in the Temple, and as an implication, the insistence become recurrent on the goodness of created things in themselves along with a polemic against ascetic currents. The conclusions drawn are: i) the moral teachings of the Talmud and those of Yeshua are, rather than similar, virtually identical; one may safely say that the precept of love and the golden rule are central ones for all Talmudic rabbis, that mercy plays an indispensable role alongside with justice, and the latter is not a different thing from one’s neighbour’s love; ii) a peculiarity of Talmud rabbis facing Yeshua is the idea of study as worship, and knowledge as a source of justice; but this is an idea of Judaism after the Temple's destruction that cannot be attributed to the Pharisees of Yeshua’s time; iii) the relation of study and practice in the Talmud parallels that between faith and deeds in Paul's epistles, that is, respectively faith or learning are a necessary and sufficient condition to be recognized as righteous , but deeds are the inevitable effect of either faith or learning. The sayings ascribed to Yeshua are examined first, yielding the conclusion that a close equivalent may be found for every saying in Talmudic literature and yet the whole is ascribed to one rabbi, with rather consistent stress on God’s mercy and unconditional forgiving as the mark of true imitation of God. Thus, Yeshua’s teaching is pure Judaism. The third section describes briefly the galaxy of Gnostic currents and Manichaeism, trying to sketch the profile of moral teachings resulting from an encounter of Asian spiritual traditions, Hellenistic lore and sparks of teachings from apocalyptic Jewish currents. The last section summarizes the turbulent history of several encounters between Christian currents and Hellenistic philosophical schools. The first one was with late Cynicism. Recent, rather controversial, literature discovered the jargon and a few topics from the Stoic-Cynical popular philosophy in a few books from the New Testament itself. This, far from proving that Rabbi Yeshua had been influenced by cynic preachers, is a proof of the necessity felt by Christian preachers to translate the original ‘Christian’ teaching into a Greek lexicon deeply impregnated with cynic terminology. The second was with Platonism, yielding the mild and temperate moral teaching of Clemens of Alexandria, teaching the sanctity of nature and the human body, the joy of moderate fruition of ‘natural’ kinds of pleasures, and the beauty of the marital life – in short, the opposite of the standard picture of Medieval Christianity. Ambrose of Milan brings about a different kind of synthesis, namely with Middle Platonism, where Stoic themes prevail. The most shocking case is Augustine, where an early Manichean education is overcome in a former phase by a synthesis of Plotinian Neo-Platonism and Christian preaching, yielding a sustained polemic with the Manicheans and rather optimistic views on life and Creation, the body and sexuality, and Hebrew-Judaic tradition not far from Clemens of Alexandria. In a later phase, occasioned by controversy on the opposite front, with such Christian currents as the Pelagians and Donatists, Augustine comes back to heavily anti-Judaic and world-denying ascetic attitudes where is earlier Manichean upbringing seems to emerge again. The tragedy of medieval Christianity will be the later Augustine’s overwhelming influence. A final section is dedicated to the monastic tradition where a curious mixture of world-denying asceticism with an astonishingly penetrating ‘science’ of introspection emerges. -/- 8. Al Farabi and the reconciliation of Islam and Platonism. The Qurān and the qadit, that is, collections of sayings ascribed to the prophet Muhammad contain a wealth of precepts and catalogues of virtues mirroring moral contents from the Jewish and the Christian traditions, among them the basic notion of imitation of the Deity, where mercy is assumed to be its basic trait. An important tradition within Islam, namely Sufism, stressed to the utmost degree the role of mercy, turning Islam into a mystic doctrine centred on retreat from the world, abandonment to God’s will, and a peaceful and fraternal attitude to our fellow-beings. A secular literary tradition originating in the Sassanid Empire, the literature of advice to the Prince had for a time a widespread influence in the newly constituted Arabic-Islamic commonwealth. In a later phase, the legacy of Hellenic philosophy made its way into the intellectual elite of the Islamic world. The first important legacy was Platonic, and the Republic became the main text for Islamic Platonism. Al-Farabi wrote an enjoyable remake of the Platonic Republic, arguing that the citizen’s virtues were the basis on which the political building needs to rest. The secular lawgiver is enlightened by the light of reason in his everyday practice of governance, but room is made for the Prophet as the voice of revealed truth that confirms and completes the rational truth that philosophy may afford. In a second phase also Aristotelian and Stoic influence were assimilated. Miskawayh’s treatise was the masterwork at the time Arabic philosophy reached its Zenith. It is a treatment of the soul’s diseases and their remedies, combining the Aristotelian doctrine of the golden mean with the Stoic doctrine of the passions and elements of Galenic medicine. Towards the eleventh-twelve centuries a war raged among theologians and philosophers, finally won by the former with disappearance of philosophy as such. The newly established mainstream, yet, was no kind of intolerant fanaticism. It drew from the work of mystic theologian Al-Ghazālī, the best heir of Sufism, teaching a tolerant and peaceful attitude to our fellow-beings and a passive attitude to destiny as an expression of the Divine will. -/- 9. Moshe ben Maimon and the reconciliation of Torah and Aristotelian ethics. The encounter between the Talmudic tradition and Hellenic philosophy had taken place a first time in Alexandria at the time of Philo but the two traditions had parted way again. In fact, the kind of Platonic Judaism founded by Philo survived only within Christianity, in the fourth Gospel and then in writings by Clemens of Alexandria. The Talmudic literature had absorbed just less striking traits from the Hellenic Philosophy, namely an idea of ethics as care of the self and a role for the education of character as propaedeutic to theoretical knowledge. In the Arabic-Islamic world, a second round started when Jewish authors writing in Arabic undertook the task to prove the full compatibility of the tradition deriving from Torah and Platonic philosophy. The culmination of this attempt is provided by Moshe ben Maimon who tried to use Aristotelian ethics as a language into which the teaching from the Pirké Avot could be translated. -/- 10. Thomas Aquinas and the reconciliation of Christian morality and Aristotelian ethics. In the first section the fresh start is described of philosophical ethics in Latin Europe at the turn of the Millennium. In a first phase, Anselm and Peter Abelard built on a Platonic and Augustinian legacy. In this phase. remarkable innovations are introduced, including Abelard’s claim of the obliging character of erring consciousness. In a second phase, the rediscovery of Nicomachean Ethics thanks to Latin translation of Arabic versions gives birth to a new wave of ethical studies, recovering the very idea of Aristotelian practical philosophy, with the potential implication of full legitimization of natural morality, i.e. ethics without Revelation. Aquinas’s ethics is a theological ethics out of which it would be vain to try to extract a self-contained philosophical ethics. His treatment of topics in philosophical ethics, yet, does not boil down to repetition of Aristotelian arguments but is rather a creative reshaping of such arguments. For example, he introduces also in the practical philosophy a first principle parallel to the principle of non-contradiction; and he also carries out a synthesis of Aristotelianism, Stoicism, and neo-Platonism. Even though it is essentially moral theology, Aquinas’s doctrine - unlike Augustine – grants full citizenship to "natural" morality, firstly by rejecting the claim that the corruption of human nature due to the original sin is so radical as to leave "pure nature" incapable of moral goodness. The doctrine is presented in a more sophisticated formulation in a few of the Quaestiones, such as De Malo and De Veritate, in the Summa contra Gentes and in the commentaries to Aristotle than in the famous Summa Theologica, but the latter work includes the only or the largest exposition of some decisive part of the theory. Thus, the Summa Theologica should be read for what it is more than criticized for not being what it was not meant to be. It was not meant to be the brilliant synthesis of all that Reason he had been able to produce with what Revelation had added about which the Neo-Thomists used to dream, but rather a manual for the training of preachers and confessors, where theoretical claims are not too demanding and a few serious tensions are left. Besides a jump between the Prima Secundae and the Secunda Secundae, being the former an essay in virtue theory and the latter a handbook for confessors, the most serious tension is perhaps the one between the ethics of right reason presented in most of Ia-IIae and the eudemonistic ethics developed in quaestiones 1-5 of the same part; the alternative ethical theory which also may be found in Augustine, the Stoic view of a cosmic reason eventually coincident with the moral law, was believed by Anselm (followed by John Duns Scotus and William of Ockham) to be incompatible with eudemonism. It is questionable whether Thomas could reduce the tension proving that it is just an apparent tension, in so far as the right reason and bliss derived from knowledge of God tend to coincide, but this is just a conjecture. Thomas’s ethics is a virtue ethic, not a law-based one, and moral judgment focuses on the virtues, particularly charity, not on the commandments and even less on absolute prohibitions; Thomas, however, would not have considered a drastic alternative between law and the virtues such as the one which has been advanced in late twentieth-century philosophy to be justified. Nonetheless, when it discusses ‘special’ virtues, it ceases to be an ethics of virtue and becomes a disappointing and often contradictory discussion of legal and illegal acts. Such a discussion takes most of the time ‘reasonable’ middle positions on controversial issues but not the alternative approach that Aristotelianism would have made possible; even when some occasional Aristotelian claim shows up, such as money’s barrenness as a reason against usury, this seems to be made by an author who apparently ignores the Aristotelian Thomas of the Prima Secundae. It is an ethic of human autonomy which recognizes the binding character of the individual conscience and, potentially, even a duty to disobey unjust laws. It is true that what Thomas writes in his discussion of death penalty and persecution of heretics is simply disgusting, and yet we should blame Thomas the man, not Thomist ethical theory. Finally, Thomas’s ethics is not ethical ‘absolutism’, as both traditionalist Catholic theologians and secularist enemies of dogmatic morality tend to believe. It is instead an ethic of prudential judgment. Exceptions to this approach – or better results of logical fallacies – are such claims as the absolute character of negative precepts and of the existence of "intrinsically evil acts", claims that simply cease to make sense in the light of Thomas’s own distinction between human act and natural act, carrying consequences Thomas did not live long enough to draw or was not consistent enough to dare to draw. -/- 11. Francisco de Vitoria and casuistry. The first topic illustrated is the discussion about the notion of pura natura, namely the human condition after the original sin and before divine revelation. The core notion was already there in Aquinas but was later developed by Caietanus (Thomas de Vio) with a number of interesting implications: firstly a view of human nature as such much more positive than Augustine’s and his followers’ view, including both Calvinists and Jansenists; secondly, the implication that the philosopher’s morality, as opposed to the Christian’s morality, is a quite respectable kind of morality; thirdly, that theocracy and prosecution of the unfaithful lacked justification, with more far-fetching consequences than Aquinas himself had dared to draw. The second topic is casuistry, a new name for a comparatively older way of thinking, which was already there in late Stoicism and Cicero as well as in the Talmudic literature. This is an approach aimed at yielding probable enough solutions for doubtful cases even in absence of completely safe staring points. The genre developed from medieval reference books for confessors and became by the sixteenth-century a sophisticated tool-box for dealing with various fields of applied ethics. Francisco Vitoria, the main authority of Baroque Scholasticism, was a controversial figure, among the proponents of the new discipline of casuistry and a consistent proponent of more separation between the religious and the civil authority, stricter limits to the legitimacy of war, innate rights of non-Christian nations in the New World based on the notion of pura natura, providing a standard of ‘natural’ goodness, previous to revelation, on which the Indian nations were judged to live in a naturally good condition, provided with the institutions of family, justice, and religion had accordingly a right to full respect by Christian sovereigns. Bartolomé de Las Casas, arguing along similar lines, was the leader of a historical battle in defence of the rights of the Indios. -/- 12. Michel de Montaigne and the art of living. A short description of one of the Renaissance Phyrronism, one of the classical philosophies revived in the fifteenth and sixteenth century. Montaigne combines the sceptical epistemology with an understanding of ethics – indeed of philosophy as a whole – in terms of an art of living inspired by two basic ideas, sagesse, that is, practical wisdom as the only kind of rationality available after theology, science, and tradition have declared bankrupt, and an aesthetic ideal of self-transformation through the art of writing and introspection. -/- 13. Pierre Nicole and neo-Augustinianism. The chapter illustrates first the vicissitudes of Augustinianism newly born after the late medieval triumph of Thomist Aristotelianism in the alternative Protestant and Catholic versions processed by the Calvinists and the Jansenists. Then it illustrates the doctrines of Pierre Nicole, Blaise Pascal’s best disciple, on the impossibility of introspection, on the ubiquity of self-deception, on the incurably evil character of the passion of love, and on the two moralities, the one of the man of the world, the morality of honesty which is indispensable for granting peace and order but devoid of any true value for eternal salvation, since the same external behaviour may be prompted by opposite motivations, and the morality of charity, the only true one but also useless to society. The third topic is Pierre Malebranche’s view of self-deception as a ubiquitous phenomenon accounting for human action and responsibility and his reformulated theory of self-love, no less ubiquitous than for Nicole and yet not as incurably evil, given the distinction between morally indifferent and even necessary amour de soi and vicious amour proper, a distinction on which the whole of Rousseau’s moral and political theory rests. -/- 14. Samuel von Pufendorf and the new science of morality. The chapter is dedicated to the discovery of the idea of a ‘new moral science’. Hugo Grotius is discussed first highlighting the real character of his project, much closer to the Thomist idea of a natural law accessible to non-corrupted human reason when human beings are living in a state of pura natura. Then Hobbes’s combination of scepticism, voluntarism, and conventionalism is described and both the continuity with Grotius’s new science, in the search for non-revealed rational morality, and the break with him, in the adoption of voluntarism and refusal of an intellectualist view of natural law, are illustrated. Pufendorf’s work is illustrated as a synthesis of the two previous attempts and the – up to Schneewind underestimated – paradigmatic example of the new science of morality. -/- 15. Richard Cumberland and consequentialist voluntarism. The chapter gives an overview of eighteenth-century Anglican ethics, noticing how the Cambridge tradition gave special weight to natural theology as opposed to positive or revealed theology – and how two Cambridge fellows, John Gay and Thomas Brown, elaborated on Cumberland’s (and Malebranche’s, as well as Leibniz’s) strategy for finding a third way between intellectualist view and voluntarist view of the laws of nature. The result of their elaboration was a kind of a rational-choice account of the origins of natural laws, where a law-giver God chooses among a number possible sets of laws on a maximizing criterion, and God’s maximandum is happiness for his creatures. The chapter notices also how such a solution aimed at solving at once the problem of evil and that of the foundation of moral obligation by proving how God’s choice was justified as far as it was the one minimising the amount of suffering in the world. 16. Richard Price and intuitionism. The chapter describes first the doctrines of the Cambridge Platonists, an example of hyper-rationalist reaction to Calvinism. Secondly it describes the sophisticated and universally ignored – from Sidgwick to Anscombe –version of what was later labelled ‘ethical intuitionism’ – showing how it escapes familiar objections and misrepresentations of intuitionism – from Mill to Rawls – in grounding its argument on transcendental arguments while carefully avoiding recourse to introspection and psychological evidence, which has been taken as a too easy target by critics of intuitionism. Thirdly, the chapter discusses Whewell’s ‘philosophy of morality’, as opposed to ‘systematic morality’, not unlike Kant’s distinction between a pure and an empirical moral philosophy. Whewell worked out a systematization of traditional normative ethics as a first step before its rational justification; he believed that the point in the philosophy of morality is justifying a few rational truths about the structure of morality such as to rule hedonism, eudemonism, and consequentialism; yet a system of positive morality cannot be derived solely from such rational truths but requires consideration of the ongoing dialectics between idea and fact in historically given moralities. Whewell’s intuitionism turns out closer to Kantian ethics than commentators have made us believe until now, and quite different from what Sidgwick meant by intuitionism. -/- 17. Adam Smith and the morality of role-switch. The chapter describes first, Hutcheson’s attempt at basing the ‘new science’ of natural law on different bedrock than Pufendorf and the English Platonists, namely a moral sense, a faculty whose existence is assumed to be proved on an empirical basis. The second step is a reconstruction of Hume’s rejoinder in terms of a new science of man including morality on an ‘experimental’ basis, that is, a ‘Newtonian’ hypothetical-deductive approach, distinguished from Hutcheson’s allegedly uncritical descriptive approach to human nature. The third step is a reconstruction of Adam Smith theory of morality understood as emerging from a spontaneous interplay of exchanges of situations (the most basic meaning of the word ‘sympathy’ as construed by this author). -/- 18. Jeremy Bentham and utilitarianism. The bulk of the chapter is dedicated to the doctrines of Jeremy Bentham. The Enlightenment spirit that suggested the idea of a new morality, free from religion, is illustrated. The notion of utility is illustrated as well as the subsequent formulations of the principle of utility. The idea of felicific calculus is discussed, showing how its inner difficulties prompted several reformulations of the principle of utility in order to avoid undesirable implications of proposed formulations. The role of the thesis of spontaneous convergence between interest and duty is discussed, showing how it left numberless questions open, and the distinction between the virtues of prudence, justice and beneficence is described as a way out of the deadlocks of classical utilitarianism. After Bentham, Mill’s reformed utilitarianism is reconstructed, showing how it is a kind of mixed system – as closer to common sense as it gives up Bentham’s claims to consistency and simplicity – resulting as unintended consequences from the controversies in which Mill was too keen to engage. The hidden agenda of the controversy between Utilitarianism and Intuitionism, going beyond the image of the battle between Prejudice and Reason, is described, showing how both competing philosophical outlooks turn out to be more research programs than self-contained doctrinal bodies, and such programs appear to be implemented, and indeed radically transformed while in progress thanks to their enemies no less than to their supporters. -/- 19. Immanuel Kant, practical reason and judgment. The chapter argues that Kant took from Moses Mendelssohn the idea of a distinction between geometry of morals and a practical ethic. He was drastically misunderstood by his followers precisely on this point. He had learned from the sceptics and the Jansenists the lesson that men are prompted to act by deceptive ends, and he was aware that human actions are also empirical phenomena, where laws like the laws of Nature may be detected. His practical ethics made room for judgment as a holistic procedure for assessing the saliency of relevant moral qualities in one given situation; this procedure yields the same results as the geometry of morals does for abstract cases but does so immediately and without balancing conflicting duties with each other, since what makes for the salient quality of a situation is perceived from the very beginning. Kant's practical philosophy is richer than the received image, making room for an ‘empirical moral philosophy’ or moral anthropology including treatment of commerce, needs, value and price, happiness and well-being; the overall social theory and philosophy of history is less different from Adam Smith's than the received image makes believe; the paradox of happiness is central to Kant's philosophy; a distinction between happiness and well-being is clearly drawn; the distinction plays a basic role in establishing a link between the economic and the moral life. -/- 20. Georg Wilhelm Friedrich Hegel and the critique of abstract universalism. The chapter describes first the Romantic movement and the implications some of its concerns, rescuing passions, community, tradition, the individual as the bearer of a unique destiny, and the longing for organic unity between the individual, mankind and nature. Hegel’s contribution is discussed then, highlighting how, on the one hand, he shared a number of these concerns and on the other he had more rationalist leanings. The notion of morality is the pivotal point of the reconstruction, highlighting how Hegel construes this notion as a key to his own diagnosis of the malaise of modernity – the separation of individual and Gemeinschaft – and how his attack on Kant turns around this very idea. -/- 21. Friedrich Nietzsche against Christianity and the Enlightenment. The chapter illustrates first the idea of deconstruction of the back-world of values. Nietzsche claims to be legitimate heir of the French moralists, Leibniz, Kant and Hegel, in so far as he allegedly carries out to its deepest implications their discovery of what lies behind traditional naïve belief in the existence of an objective realm of values just waiting for description by the philosopher. The two exemplars form which genealogy draws inspiration are the classical philologist’s historical reconstructions of lost meanings and the chemist’s decomposition of elements. Then the genealogy of the notions of good and evil carried out in the first dissertation of Genealogy of morals is illustrated with its paradoxical conclusion that will to power is in fact the only ‘genuine’ kind of goodness. The third point illustrated is the dialectic of ascetism and self-realization with its ambiguous outcome. The suggested interpretation of such outcome is that Nietzsche’s normative ethics is a kind of virtue ethics taking an aesthetic ideal as a normative standard -/- 22. George Edward Moore and ideal utilitarianism. The chapter discusses the ideas of common sense and common-sense morality in Sidgwick. I argue that, far from aiming at overcoming common-sense morality, Sidgwick aimed purposely at grounding a consist code of morality by methods allegedly taken from the natural sciences to reach, also in ethics, the same kind of “mature” knowledge as in the natural sciences. His whole polemics with intuitionism was vitiated by the a priori assumption that the widespread ethos of the educated part of humankind, not the theories of the intuitionist philosophers, was what was worth considering as the expression of intuitionist ethics. In spite of a naïve positivist starting-point, Sidgwick was encouraged by his own approach in exploring the fruitfulness of coherentist methods for normative ethics. Thus, Sidgwick left an ambivalent legacy to twentieth-century ethics: the dogmatic idea of a “new” morality of a consequentialist kind, and the fruitful idea that we can argue rationally in normative ethics albeit without shared foundations. Then it reconstructs the background of ideas, concerns and intentions out of which Moore’s early essays, the preliminary version, and then the final version of Principia Ethica originated. I stress the role of religious concerns, as well as that of the Idealist legacy. I argue that PE is more a patchwork of rather diverging contributions than a unitary work, not to say the paradigm of a new school in Ethics. I add a comparison with Rashdall’s almost contemporary ethical work, suggesting that the latter defends the same general claims in a different way, one that manages to pave decisive objections in a more plausible way. I end by suggesting that the emergence of Analytic Ethics was a more ambiguous phenomenon than the received view would make us believe, and that the wheat (or some other gluten-free grain) of this tradition, that is, what logic can do for philosophy, should be separated from the chaff, that is, the confused and mutually incompatible legacies of Utilitarianism and Idealism. -/- 23. Edmund Husserl and the a-priori of action. The chapter illustrates first the idea of phenomenology and the Husserl’s project of a phenomenological ethic as illustrated in his 1908-1914 lectures. The key idea is dismissing psychology and trying to ground a new science of the a priori of action, within which a more restricted field of inquiry will be the science of right actions. Then the chapter illustrates the criticism of modern moral philosophy carried out in the 1920 lectures, where the main target is naturalism, understood in the Kantian meaning of primacy of common sense. The third point illustrate is Adolph Reinach’s theory of social acts as a key the grounding of norms, a view that basically sketches the very ideas ‘discovered’ later by Clarence I. Lewis, John Searle, Karl-Otto Apel and Jürgen Habermas. A final section is dedicated to Nicolai Hartman, who always refused to define himself a phenomenologist and yet developed a more articulated and detailed theory of ‘values’ – with surprising affinities with George E. Moore - than philosophers such as Max Scheler who claimed to Husserl’s legitimate heirs. -/- 24. Bertrand Russell and non-cognitivism. The chapter reconstructs first the discussion after Moore. The naturalistic-fallacy argument was widely accepted but twisted to prove instead that the intuitive character of the definition of ‘good’, its non-cognitive meaning, in a first phase identified with ‘emotive’ meaning. Alfred Julius Ayer is indicated as a typical proponent of such non-cognitivist meta-ethics. More detailed discussion is dedicated to Bertrand Russell’s ethics, a more nuanced and sophisticated doctrine, arguing that non-cognitivism does not condemn morality to arbitrariness and that the project of a rational normative ethics is still possible, heading finally to the justification of a kind of non-hedonist utilitarianism. Stevenson’s theory, another moderate version of emotivism is discussed at some length, showing how the author comes close to the discovery of the role of a pragmatic dimension of language as a basis for ethical argument. Last of all, the discussion from the Forties about Hume’s law is described, mentioning Karl Popper’s argument and Richard Hare’s early non-cognitivist but non-emotivist doctrine named prescriptivism. -/- 25. Elizabeth Anscombe and the revival of virtue ethics. The chapter discusses the three theses defended by Anscombe in 'Modern Moral Philosophy'. I argue that: a) her answer to the question "why should I be moral?" requires a solution of the problem of theodicy, and ignores any attempts to save the moral point of view without recourse to divine retribution; b) her notion of divine law is an odd one more neo-Augustinian than Biblical or Scholastic; c) her image of Kantian ethics and intuitionism is the impoverished image manufactured by consequentialist opponents for polemical purposes and that she seems strangely accept it; d) the difficulty of identifying the "relevant descriptions" of acts is not an argument in favour of an ethics of virtue and against consequentialism or Kantian ethics, and indeed the role of judgment in the latter is a response to the difficulties raised by the case of judgment concerning future action. A short look at further developments in the neo-naturalist current is given trough a reconstruction of Philippa Foot’s and Peter Geach’s critiques to the naturalist-fallacy argument and Alasdair MacIntyre’s grand reconstruction of the origins and allegedly unavoidable failure of the Enlightenment project of an autonomous ethic. -/- 26. Richard Hare and neo-Utilitarianism. The chapter addresses the issue of the complex process of self-transformation Utilitarianism underwent after Sidgwick’s and Moore’s fatal criticism and the unexpected Phoenix-like process of rebirth of a doctrine definitely refuted. A glimpse at this uproarious process is given through two examples. The first is Roy Harrod Wittgensteinian transformation of Utilitarianism in pure normative ethics depurated from hedonism as well as from whatsoever theory of the good. This results in preference utilitarianism combined with a ‘Kantian’ version of rule utilitarianism. The second is Richard Hare’s two-level preference utilitarianism where act utilitarianism plays the function of eventual rational justification of moral judgments and rule-utilitarianism that of action-guiding practical device. -/- 27. Hans-Georg Gadamer and rehabilitation of practical philosophy. The post-war rediscovery of ethics by many German thinkers and its culmination in the Sixties in the movement named ‘Rehabilitation of practical philosophy’ is described. Among the actors of such rehabilitation there were a few of Heidegger’s most brilliant disciples, and Hans-Georg Gadamer is chosen as a paradigmatic example. His reading of Aristotle’s lesson I reconstructed, starting with Heidegger’s lesson but then subtly subverting its outcome thanks to the recovery of the central role of the notion of phronesis. -/- 28. Karl-Otto Apel and the revival of Kantian ethics. Parallel to the neo-Aristotelian trend, there was in the Rehabilitation of practical philosophy a Kantian current. This started, instead than the rehabilitation of prudence, with the discovery of the pragmatic dimension of language carried out by Charles Peirce and the Oxford linguistic philosophy. On this basis, Karl-Otto Apel singled out as the decisive proponent of the linguistic and Kantian turn in German-speaking ethics, worked out the performative-contradiction argument while claiming that this was able to provide a new rational and universal basis for normative ethics. An examination of his argument is some detail is offered, followed by a more cursory reconstruction of Jürgen Habermas’s elaboration on Apel’s theory. -/- 29. John Rawls and public ethics as applied ethics. Rawls’s distinction between a “political” and a “metaphysical” approach to one central part of ethical theory, namely the theory of justice, is interpreted as a formulation of the same basic idea at the root of both the principles approach and neo-casuistry, both discussed in the following chapter, namely that it is possible to reach an agreement concerning positive moral judgments even though the discussion is still open – and in Rawls’ view never will be close – on the basic criteria for judgment. -/- 30. Beauchamp and Childress and bioethics as applied ethics. The chapter presents the revolution of applied ethics while stressing its methodological novelty, exemplified primarily by Beauchamp and Childress principles approach and then by Jonsen and Toulmin’s new casuistry. -/- . In the early 2000s, the development of local food systems in advanced industrial countries has expanded beyond creation and support of farmers’ markets and community supported agriculture farms and projects to include targeted Buy Local Food campaigns. Non-governmental groups in many U.S. places and regions have launched such campaigns with the intent of motivating and directing consumers toward more local food purchasing in general. This article examines the current manifestations and possibilities for social justice concerns in Buy Local Food campaigns, (...) by considering them within the more general category of “selective patronage“ campaigns. Historical campaign examples, such as Buy Union, Buy American, and Buy Black campaigns, offer instructive comparisons to contemporary consumer campaigns promoting local food. Through examining the construction of threats, intended beneficiaries, products to be avoided, and those to be preferentially selected, the paper demonstrates how selective patronage campaigns have emphasized social justice needs and concerns for designated groups in ways that have been potentially exclusionary of other disadvantaged groups and thus undermining of social justice more broadly. As a contemporary instance of “selective patronage,“ Buy Local Food campaigns exhibit similar contradictory impulses, which are intensified by the conceptual and practical pitfalls in designating “local.“ The article concludes by considering how the challenges and prospects for commitments to social justice in local food consumer campaigns reinforce the importance of emerging initiatives centered on domestic fair trade. The problem of the values of Ukrainian society is one of the most important and debatable problems in modern scientific discourse. This is due to the transition of our state from the traditional model of the state, in which there is authoritarianism, secrecy, to a socially oriented society and a democratic, open state.Accordingly, there is a change in values, which is an integral part of the existence of any society and state. To replace the Soviet system of declaration of (...) surrogatecollective, paternalistic values, which existed for several decades, a new system is formed, which provides a clear orientation of Ukrainians to European values, the significant achievements of the Ukrainian people, the moral recovery of society, increasing values and culture of civil society. Honor and dignity of Ukrainians, which is an indispensable basis for the development of moral culture of society.The purpose and objectives of the article. Based on the achievements of modern science and philosophy, to analyze the essence of the moral culture of the people, the place of human dignity and its importance in moral culture; to characterize and classify the main factors of dignity formation in the moral culture of the people. The research methodology is complex and is based on philosophical-anthropological and philosophical-cultural analysis of the problems of formation of moral culture of the Ukrainian people and its structural element - human dignity. Research results.The most important, synthetic, integral consequence of human development is moral culture. Moral culture is the level of assimilation by an individual or a group of people of existing moral values in society, the degree of their involvement in the moral aspects of activity, a measure of personal moral development. Practical and spiritual factors include, first of all, ethnic stereotypes specific to a certain people (traditions, customs, rituals, typical traits of character and behavior, dominant emotions, folk crafts, entertainment, games), as well as historical memory, established symbols, folk shrines. Historical memory, preserving every page of life, the people’s struggle for social, political and national rights at all stages of its development, serves as a solid foundation on which national self-consciousness is successfully formed.Institutional factors are important for the formation of dignity in the moral culture of the people. These include nation- and state-building activities of public authorities, national elite, political parties, religious and public organizations. If the state creates conditions in society for the assimilation of the historical and cultural experience accumulated by the nation, it contributes to the education of national self-esteem, ie awareness of community members of their belonging to the nation, their duty to the community of like-minded people. Conclusions. Summarizing the results of the study, we can formulate the following conclusions. Human dignity in the moral culture of the Ukrainian people is the result of the interaction of a combination of many factors that determine its structure and content. The process of its formation is quite long, complex and contradictory. This is due to the fact that it is human dignity that provides the spiritual, ideological foundation for the functioning of national communities, contributing to the development of promising guidelines for the development of the nation and the state. Understanding the historical retrospective of state-confessional relations becomes especially relevant in connection with socio-political changes of the XX - the beginning of the XXI centuries. The Roman Catholic Church, as one of the subjects of these relations, increasingly expresses its attitude to socio-political events. Historical experience of the existence of the Roman Catholic Church testifies that the mentioned institution has had a significant impact on all spheres of public life, in particular political. In this context, we note that (...) the beginning of the XXI century. once again reveals the tendencies of the influence of the religious-church factor on the political life of many countries of the world, in the middle of which Ukraine. This influence is characterized by tension, a very complex dynamics, an increase in the interference of the political structure of religious affairs. Considerable interest in this aspect, in view of the sharp change in the political course of party-state leadership in relation to the Roman Catholic Church, is the final period of the Second World War. In the second half of the 80s of the twentieth century communist omnipotence that prevailed in the Soviet Union during the seventy years put the country regularly in the framework of the system of social and economic crisis. In making efforts to keep the pro-government monopoly the Central Commitee of CPSU dares to introduce redecorating of the economic mechanism of the Soviet Union in implementing the policy of acceleration. However, its negative results made the Communist Party elite resort (...) to deepen innovations and apply reforms in the political system of the Soviet Union, known at that time as reconstruction perestroika. Having caused the general public democratization, it called to a policy of openness, which brought out the numerous communist crimes of the past decades that greatly weakened the Communist Party regime. This led to the revival of democracy, and eventually the national liberation movement in the western regions of the USSR, especially in Halychyna and its components - the Pre-Carpathians, where the state-forming bases have deep historical roots. The speaking trumpet of establishment of the communist regime was the Communist Party press, which in this period has launched a massive advertising campaign for undeniable expediency of reconstructive innovations. However, the rapid growth of the national liberation movement led openly to opposing the Communist Party media at all levels, trying to stop a national renaissance in Pre-Carpathians. The opposing range included both promotional measurements and intimidation pressure of power structures. The opposition at that time consisted of illegal anticommunistic publications and periodicals of newly appeared Soviet institutions. Objectively covering events they were promoters of striving patriotic-oriented public of the land to restore the state independence of Ukraine. (shrink)

In accordance with the spirit of the Third Plenary Session of the Eleventh Central Committee of the Chinese Communist Party [December 1978], Comrade Hua Guofeng, in his "Report on the Work of the Government" delivered to the Second Session of the Fifth National People's Congress [address of June 18, 1979], provided a thorough discussion on the strengthening of socialist democracy and improvement of the socialist legal system. This session of the Congress solemnly passed the Electoral Law, the (...) Criminal Law, the Law of Criminal Procedure, and other important laws, opening a new chapter in the establishment of democracy and law in our nation. This is highly significant as a major turning point for workers throughout the nation, lifting the historical lid at all levels so that we may proceed with the four modernizations with a common mind and purpose throughout the nation, to further develop democracy and fulfill the establishment of the legal system. This will affect the consolidation and development of the state system of the dictatorship of the proletariat. It will protect the personal interests of the people, prevent the revival of counterrevolutionaries, and guarantee the realization of the four modernizations. (shrink)
