This article explores the comparison between Derrida and Zhuangzi and their approaches to the question of metaphor and analogy, examining the deconstruction of essentialist and culturalist forms of philosophical comparativism. The author contends that the notion of ‘Western metaphysics’ relies on an implicit comparison between the West and its others, shaped not only by philosophical factors but also by historical, sociological and strategic considerations, as exemplified in Aristotle’s exclusion and subjection of metaphor. Derrida’s approach in ‘White Mythology’, (...) with its ‘internal reading’ and ‘quasi-transcendental’ perspective, challenges the unity and identity of the conventional representation of philosophy as a Western achievement. However, the article also advocates for an ‘external’ and ‘quasi-empiricist’ viewpoint that recognises the erratic character of comparisons, resisting the appropriation of philosophical differences into general categories such as ‘Western’ or ‘Chinese philosophy’. ABSTRACT In this article the development of the thought of two important twentieth-century legal theorists is compared. Although Hans Kelsen is primarily known for his Pure theory of law and Hermann Kantorowicz is one of the founders of the Free law movement, the article will revolve around their respective proposals for the post-War restoration of the international legal order. It is argued that these are based on their respective conceptions of ‘law’ and ‘the state’. By virtue of this (...) class='Hi'>comparison, it is possible to shed light on the basic thinking behind their complex ideas, as well as show how these were formulated and influenced by the political circumstances of their times. Lastly, the article shall concern the concrete post-War influence of Kantorowicz and Kelsen, as a result of the shared and different philosophical, methodological and scientific convictions of both scholars. The current crisis of neoliberalism is calling into question the relevance of key international institutions. We analyze the origins, nature, and possible impacts of the crisis through comparing two such institutions: the International Monetary Fund (IMF) and the World Trade Organization (WTO). Both originated in the post-World War II U.S.-led hegemonic order and were transformed as part of the transition to global neoliberalism. We show that while the IMF and the WTO have been part of the same hegemonic (...) project, their distinct institutional features have put them on significantly different trajectories. Historical differences in the two institutions’ systems of rules have placed the IMF in a more vulnerable position than the WTO, which provides clues to the future contours of global economic governance. The effective solution of environmental problems calls for changes in levels of consumption. Sociologists have described moderation in households of high socio-economic status in affluent countries, and also a type of modesty which cannot be a response to the experience of abundance. However, its essence is not the way of life of a traditional community. Sustainable living based on self-restraint could be considered to be a symptom of the summit of cultural evolution to date. Between the 14 and 18 March 2016, the Institute for Ethics, History and Theory of Medicine, in cooperation with the Institute for Sociology at Ludwig-Maximilians-University, Munich, hosted an interdisciplinary workshop on migrant and refugee health in Germany and the UK. Fifteen participants from four countries met to discuss ethical issues surrounding the health of migrants and refugees in Europe, with particular emphasis on a comparison of the different approaches taken by Germany and the UK. The article aims to analyse the motivation and perception of security among the members of pro-defence organisations in Poland. The multidimensionality of threats and challenges in the area of national and international security necessitates the use of all forces and means. This also applies to using the potential, interest, and involvement of specific people within the state security system. In the case of Poland, a large role is played by numerous pro-defence organisations with many members, including young people. This article compares the career trajectories and mobility patterns of Nobel Laureates in economics with those of highly cited sociologists to evaluate a theory advanced by Richard Whitley that postulates a nexus between the overall intellectual structure of a discipline and the composition of its elite. The theory predicts that the most eminent scholars in internally fragmented disciplines such as sociology will vary in their departmental affiliations and academic career paths, while disciplines such as economics with strong linkages between specialties (...) and shared standards of excellence will be dominated by a more homogeneous elite. The comparison provides strong empirical evidence in favor of Whitley’s theory. The careers of the most eminent economists are closely tied to the top five departments of the discipline, whereas the career pathways to eminence in sociology are largely unpredictable. (shrink)

There were virtually no large-scale large-scale projects that purposefully investigated the religiosity of Ukrainians in its dynamics for many years by the standards generally used in modern sociology of religion. But the inclusion of Ukraine in international sociological research programs on the study of values ​​and religious and behavioral orientations, national projects aimed at (...) obtaining a socio-political, socio-demographic, socio-cultural portrait of the population of Ukraine, which would also include the study of his attitude to religion, research represented on the Ukrainian scale, nevertheless give a certain idea of ​​religiosity in Ukraine in recent years and tendencies of its development in comparison with other ymi countries. Abstract The accumulated case studies in the Sociology of Scientific Knowledge have been taken to establish the Strong Programme's thesis that beliefs have social causes in contradistinction to psychological ones. This externalism is essentially a commitment to the stimulus control of behaviour which was the principal tenet of orthodox Skinnerian Behaviorism. Offered as ?straight forward scientific hypotheses? these claims of social determination are asserted to be ?beyond dispute?. However, the causes of beliefs and especially their contents has also been the (...) subject of intense study in the quite different domain of cognitive science where internal states, images, rules, representations and schemas are postulated as explanatory constructs. Such explanations which postulate mental states are described by Bloor as infected by the ?disease? of ?psychologism? and Bloor has defined his Strong Programme in terms of its diametrical opposition to mentalistic theories. For example, Bloor has explicitly endorsed the Behaviourist rejection of mental representations such as images. Accordingly, a direct comparison of these radically divergent approaches to a common subject matter is of considerable interest. The paper attempts to reveal the unnoticed enormity and recidivism of the sociological programme, and how its vulnerability is betrayed in Bloor's response to criticism on central issues. (shrink)

This article examines the regulation of nonsteroidal anti-inflammatory drugs, with particular focus on products approved for marketing in the United Kingdom, while denied marketing approval in the United States on safety grounds, and then subsequently withdrawn from the UK market on those grounds. Using international comparison of regulatory data never before accessed outside government and companies, together with interviews with relevant industry scientists and regulators, the article demonstrates the importance of regulatory expectations, deficits and paradigms. It is argued (...) both that these sociological concepts can be enriched by their application to detailed comparative case study of regulatory science, and that they provide an important policy-relevant framework with which to understand discrepant drug regulatory processes in a sociohistorical context. It is found that regulatory expectations and paradigms may be regarded as mediating factors between political culture and structural interests, on the one hand, and the outcomes of regulatory science, on the other. The main aim of this article is to offer a sociological concept of crisis that, defined as the expected yet non-lineal outcome of the internal dynamics of modern societies, builds on the synergies between critical theory and systems theory. It contends that, notwithstanding important differences, both traditions concur in addressing crises as a form of self-reproduction of social systems as much as a form of engagement with the complexities and effects of such processes of reproduction. In order to make (...) our comparison exhaustive, this article explores critical and systems theories’ notions of crisis at three levels: (1) their conceptual delimitation of crises; (2) their methodological proposals to empirically observe crises; and (3) their normative attempts to contribute to their resolution. As crises remain a distinctive structural feature of the social world and a rich source of knowledge about it, reflexivity must be seen as a crucial form of engagement with the negative expressions of social life itself. This article reflects on the problem of false belief produced by the integrated psychological and algorithmic landscape humans now inhabit. Following the work of scholars such as Lee McIntyre (Post-Truth, MIT Press, 2018) or Cailin O’Connor and James Weatherall (The Misinformation Age: How False Beliefs Spread, Yale University Press, 2019) it combines recent discussions of fake news, post-truth, and science denialism across the disciplines of political science, computer science, sociology, psychology, and the history and philosophy of science that variously address (...) the ineffectiveness, in a digital era, of countering individual falsehoods with facts. Truth and falsehood, it argues, rather than being seen as properties or conditions attached to individual instances of content, should now be seen as collective, performative, and above all persuasive phenomena. They should be practically evaluated as networked systems and mechanisms of sharing in which individually targeted actions are combining with structural tendencies (both human and mechanical) in unprecedented ways. For example, the persuasive agency of apparent consensus (clicks, likes, bots, trolls) is newly important in a fractured environment that only appears to be, but is no longer ‘public’; the control of narratives, labels, and associations is a live, time-sensitive issue, a continuous contest, or ongoing cusp. Taking a social approach to truth yields observations of new relevance; from how current strategies of negative cohesion, blame, and enemy-creation depend crucially on binary ways of constructing the world, to how the offer of identity/community powerfully cooperates with the structural tendencies of algorithm-driven advertiser platforms towards polarisation. Remedies for these machine-learned and psychological tendencies lie in end-user education. So the Arts and Humanities, whether via comparisons with previous historical periods, or via principles of critical thinking and active reading, offer crucial resources to help counter what since 1997 silicon valley executives and scholars have called ‘persuasive technology’ (Fogg in Persuasive Technology: Using Computers to Change What we Think and Do, Morgan Kaufmann, 2003; Hamari et al. (eds) in Persuasive Technology, Springer International Publishing, 2014; Harris in How a Handful of Tech Companies Control Billions of Minds Every Day, 2017; Lanier in Who Owns the Future? Simon & Schuster, 2014 and Ten Arguments for Deleting your Social Media Accounts Right Now, Picador, 2019). The article proposes a paradigm shift in public understandings of this new social environment: from a culture of discovery, where what matters is what exists or is in fact the case, to a culture of iteration, where what matters is what gets repeated. The essay reconstructs the contradictory nature of the concept of cooperation, highlighting historically some of the antinomies that remain latent even in the modern usage of this concept. Through the analysis and comparison of the texts of Adam Smith, Karl Marx, Émile Durkheim and Alfred Marshall two problematic axes of the concept are particularly stressed: cooperation as an extension of the human potential in opposition to cooperation as objectification and exploitation; cooperation as social norm in opposition to the cooperation (...) of the cooperative movement. These antinomies are not exceeded in a harmonious and all-encompassing concept of cooperation, but instead are brought into play to return the complexity and the internal contradictions of a concept that runs through the sociological, economic and political contemporary debate. Photo by Hannah Busing on Unsplash INTRODUCTION Religion has long provided guidance that has led to standards reflected in some aspects of medical practices and traditions. The recent bioethical literature addresses numerous new problems posed by advancing medical technology and demonstrates an erosion of standards rooted in religion and long widely accepted as almost axiomatic. In the deep soul-searching that pervades the publications on bioethics, several disturbing and dangerous trends neglect some basic lessons of philosophy, logic, and history. The bioethics (...) discourse on medical aid in dying emphasizes similarity over previously recognized important distinguishing features. For example, it overplays a likeness between assistance in dying and the withdrawal of life-saving technology. In many bioethics’ topics, arguments based on a logical continuum are used to question the lines demarcating important moral differences. l. The Line Between Ethical and Not: Logic Based on Continuum Careful case selection, often either end of a continuum, allows the tearing down or ridiculing of many rules and codes across most professions and fields of interest. This situation holds true for traffic laws as well as medical ethics guidelines. It is relatively simple for those who desire to attack a particular viewpoint by selecting a case that makes that position seem untenable. In the ethics realm, good and bad medicine exist at opposite ends of an ethical continuum, with many practices lying in between. For example, much of medical ethics exists between the Nazi criminal physicians and the most sainted nurse or physician. A gradual progression occurred over less than two decades from a utilitarian position that supported limited euthanasia for those with certain mental illnesses to genocide. German society embraced a utilitarian ethic in which the value of human life no longer was intrinsic but instrumental.[1] Many morally significant points on a continuum were then ignored as the misguided utilitarian policy rampantly continued. A point in the continuum to distinguish between ethically justifiable and that which is not can be difficult to identify compared to the two extremes. This continuum is not unique to ethics but can be applied to almost any other aspect of human life and endeavor. Between a severely ill schizophrenic person and a superbly well-adjusted individual, there is a continuum of mental and psychological function. The existence of a continuum should not paralyze thinking and prevent us from drawing lines and identifying moral differences based on objective criteria as well as moral philosophy. Yet, by focusing on a continuum, many bioethicists use logic to disregard dividing lines between an "ethical" and an "unethical" act. Unfortunately, sometimes bioethicists draw revolutionary conclusions that would change the scope of medical practices which is accepted as ethical. There are many examples of similar shifts on the continuum. Many authors argue for the ethical permissibility of abortion by pointing out that the human fetus is no different in various characteristics, one arguing it is as like an ape or chick as it is like a person,[2] and does not achieve unique human and individual characteristics until well into the first year of life.[3] While human fetuses arguably do not have certain distinctive qualities of personhood, most people shy away from the logical next conclusion: permitting infanticide. For example, Joshua Lederberg condemns infanticide, in the face of biological illogic, because of our emotional commitment to infants, to me, a relatively weak explanation. Sir Francis Crick suggests we might consider birth at two days of life in order to decide whether an infant is a "suitable" member of society.[4] Giublini and Minerva suggest that infanticide should be permissible since late pregnancy abortions are permissible, arguing there is no significant difference between a fetus just before birth and an infant just after birth.[5] Clearly the continuum approach would allow for subjective arguments in favor of later infanticide at other points many days post-birth. Years ago, with a cynical tone, I mentioned infanticide as a further step on the continuum beyond abortion, and I was rightly shouted down as being deliberately provocative to assert the logic would ever stretch so far. While it is not an accepted mainstream position, the movement in academic settings from widespread condemnation to limited possible acceptance of infanticide has taken place in an incredibly short time. Public opinion and medical opinion in these areas have shifted dramatically in a short time. In another area, from a biological and chemical point of view, there is a continuum from man down to a single carbon atom. Yet, it would not seem logical to ignore the emotional differences, the meaning of personhood, or the moral distinction between killing an insect and killing a person. ll. A False Continuum: Medical Aid in Dying I assert that there has been an erosion of ethical guidelines in recent years attributable to using continuums to camouflage important distinctions. James Rachels’ work on active and passive euthanasia, which contends that the two are ethically identical, exemplifies that logic.[6] He illustrates this thesis, using a continuum to compare different scenarios with like consequences as morally equivalent, by comparing the deliberate drowning of a child with a deliberate failure to rescue a drowning child when easily able to do so. The author's comparison proposes that since much of the medical profession has already made peace with withholding treatment in order to hasten death, consistency inexorably demands that we permit active euthanasia as well.[7] When permission for active euthanasia was first introduced, it was limited exclusively to patients suffering severely from an intractable, incurable, and irreversible disease. These guidelines have been continuously eroded. There is now a substantial serious consideration for permitting active euthanasia of healthy elderly individuals who feel that they have completed their lives and are "tired of living."[8] There are many moral and factual differences along the ethical continuum. In human life, there is a difference between a live baby and a fetus, between a viable fetus and one that is not, between a fetus and a zygote, and between a zygote and a sperm cell. Similarly, there is a difference between pulling a trigger to kill someone and not interfering in preventing his death, which is reprehensible though both may be. There is a difference between not resuscitating an 80-year-old man with cancer when his heart stops and injecting him with a fatal dose of potassium chloride. I argue that an overt act of taking life repels civilized human beings is to be commended and encouraged as the reverence for human life or even for just a moment of human life is one of the great contributions of our civilization. CONCLUSION As an orthodox Jew, I feel that divinely inspired guidelines that have stood the test of centuries shape my beliefs, and such guidelines contradict medical aid in dying. I cannot speak to the viewpoint of those who do not access religion in defining their moral stance, nor do I implicate them in the current bioethics' trends, as I am not aware of the personal role of religion in the lives of most such authors. While many nonreligious people have a firm philosophical grounding and oppose medical aid in dying, I suggest that in the absence of any religious or other absolute standards, developing logically defensible ethical guidelines may be challenging. At the least, religion may play a role in defining the points on the continuums that are ethically meaningful and refuting the trending beliefs that if the endpoint is the same, allowing different methods of arriving at that end are somehow ethically equal. The continuum of ways death may result does not negate analysis of whether death is brought about in ways that recognize the importance of life. The German philosopher Hans Jonas said, "It is a question whether without restoring the category of the sacred, the category most thoroughly destroyed by the scientific enlightenment, we can have an ethics able to cope with the extreme powers that we possess today and constantly increase and are compelled to use."[9] While countries vary on the role of religion in policy, with many emphasizing freedoms of religion, a recent position paper released by a group of Jewish, Christian, and Moslem leaders suggested the need for agreement on the unique sanctity of human life.[10] I would recommend that such a document serve as an example of consensus on critical foundational bioethical guidelines for democratic secular societies. - [1] Alexander L Medical science under dictatorship. In this article we conclude, via a comparison of the 19th C. scientific publications concerning the Belgian parliament and the state of parliamentological research of the day, that Belgian writers achieved an international standard. In Belgium, as elsewhere in Europe, parliamentology was pursued from the standpoint of various complementary schools of thought. Modern political history provided very detailed information about the functioning of the parliamentary institution; constitutional law investigated the juridical aspects of it ; political science transcended these (...) juridical boundaries and took account of the political aspects as well ; this method was also pursued in the field of political economy which, from a methodological point of view, can be regarded as the fundamental current of parliamentary sociology.It can be asserted that these writers are the founders of modern parliamentology despite the rather weak methodological foundation of their studies, the relative lack of empirical data-collection and the infiuenceof political commitment. As is still the case today, so also in the 19th C, the formal-juridical approach was dominant ; however, it was also insight-fully recognized that the most important problems of power lay in the mutual relations of the members of parliament themselves and in their relation to the majority, the opposition and the executive power. These studies furnish, therefore, very interesting lines of inquiry for the diachronic treatment of the majority of the problems of contemporary parliamentology. (shrink)

A comparative perspective in the study of religion has recently been taken up more and more often. It goes along with a growing awareness of cultural and religious plurality as well as of the importance of religion in terms of its role in the social, political, and economic processes of the contemporary world. This also gave an impulse to organize the two-day international seminar on “Comparative Methodology in Religious Studies” held in Kraków on 23–24 May 2013, at the Pedagogical (...) University of Cracow, Department of Philosophy and Sociology, in co-operation with the Editors of Argument: Biannual Philosophical Journal. During the seminar a variety of methods applied in the comparative study of religion were discussed. The participants considered which of them seemed to be most beneficial or useful for a better understanding of the subject matter, and for capturing the uniqueness and divergence between Abrahamic, Indian (Dharmic), and other religious traditions. Some criteria for a proper comparison in the field of religion were defined and justified during this discussion. The presenters took into account both the sociological context of the analysis and philosophical consideration of the most fundamental questions within comparative methodology. (shrink)

Over the past few decades, scholars have conducted research that (...) increasingly explores children’s involvement with music in contexts outside of formal learning settings, utilizing methods and models from ethnomusicology, sociology, social psychology, and/or cultural psychology. Nine individually authored chapters in the volume, Children’s Home Musical Experiences Across the World, edited by Beatriz Ilari and Susan Young, convey results, applications, and extensions of one such project that reaches beyond the conventional ethnographic music education study.The bulk of this collection contains findings and interpretations from a collaborative project called MyPlace, MyMusic, followed by several additional chapters that provide descriptions and narratives from subsequent related projects. The original project included fourteen scholars from the International Society of Music Education-Early Childhood Commission, who conducted in-home observations and interviews with parents and children in order to examine the nature of, influences on, and meaning of musical activities that took place in the homes of middle-class seven-year-olds in diverse locations, including Brazil, Denmark, [End Page 105] Greece, Israel, Kenya, the Netherlands, Singapore, Spain, South Africa, Taiwan, the U.K., and the United States.Importantly, the project’s designers attempted to avoid complications of transcultural developments by asking each researcher to select children whose families had not recently migrated to their country/locality. The seventeen participating children from twelve countries were also of the same ethnicity and lived in the same “locality” as each researcher in order to ease communication during in-home observations and interviews. Results shed light on issues of children’s family life, schooling, identity, gender, and social class.This project presents a unique contribution to the field of music education in a number of ways. First, most previous studies of music in the homes of children have centered around preschoolers, toddlers, and infants, whereas the present project focuses on seven-year-old children, whose age places them on the cusp of crossing from early to middle childhood. Second, most previous music education researchers have considered issues of social class, ethnicity, and race as independent variables, but the methodology for this project calls for observation and description of each child in his or her home first, followed by comparison of the “cases” to each other. Third, the researchers utilize a Wiki platform to share and collaboratively interpret data collected from home lives of children (photographs, video and audio recordings, texts, and pdf files) among researchers from different countries.The volume is organized into three major sections. Susan Young and Jèssica Pérez-Moreno set the scene in the first two chapters by describing the theoretical underpinnings and methodology for the MyPlace, MyMusic project. The second section of the book includes four chapters in which several individual researchers interpret the project’s data based upon the themes of children’s private musical worlds; belonging/identity/gendered meanings of children’s music making; perspectives and influences of parents; and the role of social class on children’s musical lives. The last three chapters of the book provide detailed descriptions of projects and extensions that developed after the MyPlace, MyMusic project.Following the introductory chapter, in which Ilari and Young explain the background, rationale, goals, and methods of the MyPlace, MyMusic project and provide a reader-friendly table that presents the cultural background and “sources of musical stimulation in the home” for each participating child,1 Susan Young outlines the theoretical and analytical frameworks for the project in the first chapter. The purpose of the research is to conduct a detailed scientific and practical substantiation of the features of the humanitarian, philosophical, socio-legal aspects of information security and to investigate the socio-philosophical reflection of the phenomenon of information security as a leading factor in the development of consciousness and existence of society in the information age.Research methodology. The research used general scientific (generalization, comparison, induction and deduction) and empirical-theoretical methods (analysis, synthesis). It was determined that the growing attention to the humanitarian aspects of national and international security problems today can be explained by the following reasons: due to modern conditions, society is increasingly becoming aware of the fact that it is the person who is the main component of the wealth of any country; as a result of human activity, all the main threats that international and national security systems have to face appear. It has been found that the integrative understanding of the basis of information and communication processes and their meaningful dimension allows to more optimally solve the problems of ending the war on the territory of Ukraine and full reintegration of the population of the occupied territories. It has been established that information security is an important quality of the existence of the social system, due to the fact that it ensures essential connections that determine the stability and orderliness of the existence of Ukrainian society.Practical significance. The results of the research can be used to prepare a training course on information security, as well as to display individual topics within the framework of courses in political, legal science, philosophy, sociology, the theory of information society, and other disciplines of the social and humanitarian cycle. The practical significance of the results of humanitarian and socio-philosophical research on information security makes it possible to more fully understand the complex nature of the problem, to determine the impact of information security on the consciousness and existence of modern Ukrainian society. Using data from the China Education Panel Survey, which was a nationally representative sample of junior high school students, this study examined the association of internal migration with depression among migrant and left-behind children, while exploring the moderating effect of gender difference and the mediating effects of social relationships. The results showed that migrant children had a significantly lower level of depression than left-behind children. Further, the difference in mental health between migrant children and left-behind children was more prominent for (...) boys than girls. The mechanism analyses indicated that compared to left-behind children, internal migration positively predicted parent–child relationships and peer relationships of migrant children, which in turn reduced their depressive symptoms. Although migrant children suffered from a higher level of teacher discrimination than their left-behind counterparts, it had no significant relationship with depression after controlling for children’s social relationships with parents and peers. Our findings suggested that migrating with parents was helpful to reduce children’s depressive symptoms in comparison with being left behind. Therefore, actions should be implemented to reduce the occurrence of involuntary parent–child separation and the prevalence of children’s depressive disorders due to institutional constraints. In addition, necessary treatments are needed to improve the psychological wellbeing of disadvantaged children, especially among left-behind children with mental illness. (shrink)

However, investigations into the connection between nationality and ethical decision-making in the sciences have largely generated mixed results. In Study 1 of this paper, a measure of biases and compensatory strategies that could influence ethical decisions was administered. Results from this study indicated that graduate students from the United States and international graduate (...) students studying in the US are prone to different biases. Based on these findings, recommendations are made for developing ethics education interventions to target these decision-making biases. In Study 2, we employed an ethics training intervention based on ethical sensemaking and used a well-established measure of ethical decision-making that more fully captures the content of ethical judgment. Similar to Study 1, the results obtained in this study suggest differences do exist between graduate students from the US and international graduate students in ethical decision-making prior to taking the research ethics training. Pollitt and Bouckaert and their neo-Weberian state (NWS) have been chosen as the subject for this essay because the book has become a standard work in the public management movement. It is frequently cited and has been re-published in multiple editions (most recently in 2017). The authors also refer explicitly to Max Weber.This contribution seeks to draw attention to three important aspects, which inevitably overlap with one another:1. There is no Weber in the neo-Weberian State (introduction, 1; section II). Pollitt (...) and Bouckaert fail to grasp that Weber’s understanding of the state [the state as an “institution” (Anstalt); and the state as an “idea of validity” (Geltungsvorstellung)] is not identical to his ideal type of modern bureaucracy; it is the features of the latter on which they draw. The ideal type is a standard measure constructed in order to establish how close any concrete, given instance of bureaucracy comes to it (introduction, 3). Meanwhile, the “neutral official” insisted upon by Weber has “taken their leave” in Germany from important positions (section III, 3). Furthermore, Weber did not address those structures and processes internal to the administration which are precisely the object of interest for the new public management reformers. Weber’s lack of interest arises from the fact the members of anAnstalt, whether it is the state or the Church (WuG, § 15, no. 2), are subject to imposed orders (oktroyierte Ordnungen) and, as such, do not enjoy the “right to have a say”. Scharpf (1973a) was the first to pay particular attention to the problems brought about by specialisation and by the division of labour within the administration that are responsible for an incremental form of politics (section III, 3); even if he later ascribes advantages to the combination of “negative” and “positive coordination” (Scharpf 1991: 18ff.).2. The “legalistic culture” that characterises Germany will be considered in a more differentiated way, drawing on empirical studies which provide information, for example, on how laws (i.e. programmes)actuallyoriginate inside the ministerial apparatus (introduction, 2; section III, 2 and 3) or how use is made of the power of authority (Weisungsrecht) in practice (introduction, 2; section III, 2 and 3), even when, formally, it claims to have validity (section III). In this way, only empirical studies (Benz 1994; Bohne 1981; Dose 1997; Dose/Voigt 1995; Treiber 2007a) prove that the administration that implements laws has often, in practice, become a “negotiative administration” (introduction, 2). Such a phenomenon as a “co-operative administration”, which negotiates rather than rules, is a “foreign concept” in Weber’s discussion of the state and modern bureaucracy. Scharpf’s (1970) comparison between constitutional governance in Germany and legal relief in America is enlightening when it comes to the meaning of the constitutional state (Rechtsstaat) (introduction, 2; section III); the same applies to his discussion of the failed federalist reforms, which sought, among other things, to mitigate, if not entirely eliminate, the opportunities for blockades provided by political entanglement (Politikverflechtung) (section III). Neither was it possible to realise long overdue proposals to reform administrative law (Verwaltungsrecht) (section III, 1), which involved weakening or removing altogether three important assumptions in the dominant administrative doctrine (the “dogmatic normality”) and which also included the ambitious intention for the law to achieve tangible impact (Hoffmann-Riem 1994). Nonetheless, while no-one would dispute that reform of the federal government and administration remained “on the agenda” (Scharpf 1991, Mayntz/ Scharpf 1973), the priorities of such a reform were, and still are, different to those of new public management reform [the key terms here arePlanung(“planning”) and the term that replaced it,Steuerung(“management”)]1.3. Pollitt and Bouckaert ascribe to the neo-Weberian state extremely varied functions without providing any (theoretical) basis for them. In this way, the notion of public management reform that they present acquires the status of a “reformist philosophy” (introduction, 3; section IV). See Scharpf (1991) for a theoretically well-founded argumentation on the State’s ability to act in our days. Scharpf’s essay will be discussed briefly (section IV).ConclusionThere is no Weber in the neo-Weberian state. Background Ethics committees typically apply the common principles of autonomy, nonmaleficence, beneficence and justice to research proposals but with variable weighting and interpretation. This paper reports a comparison of ethical requirements in an international cross-cultural study and discusses their implications. Discussion The study was run concurrently in New Zealand, UK, Israel, Canada and USA and involved testing hypotheses about believability of testimonies regarding alleged child sexual abuse. Ethics committee requirements to conduct this study ranged from nil in Israel (...) to considerable amendments designed to minimise participant harm in New Zealand. Assessment of minimal risk is a complex and unreliable estimation further compounded by insufficient information on probabilities of particular individuals suffering harm. Estimating potential benefits/ risks ratio and protecting participants' autonomy similarly are not straightforward exercises. Summary Safeguarding moral/humane principles should be balanced with promotion of ethical research which does not impede research posing minimal risk to participants. In ensuring that ethical standards are met and research has scientific merit, ethics committees have obligations to participants (to meet their rights and protect them from harm); to society (to ensure good quality research is conducted); and to researchers (to treat their proposals with just consideration and respect). To facilitate meeting all these obligations, the preferable focus should be promotion of ethical research, rather than the prevention of unethical research, which inevitably results in the impediment of researchers from doing their work. How the ethical principles should be applied and balanced requires further consideration. (shrink)

We conduct quantitative and qualitative analysis of 33 cases of internal and external whistleblowers wrongfully fired for reporting wrongdoing. Our results show external whistleblowers have less tenure with the organization, greater evidence of wrongdoing, and they tend to be more effective in changing organizational practices. External whistleblowers also experience more extensive retaliation than internal whistleblowers, and patterns of retaliation by management against the whistleblower vary depending on whether the whistleblower reports internally or externally. We discuss implications for organizations and whistleblowers, (...) and we conclude that researchers need to develop different theoretical explanations of internal and external whistleblowing processes. This study investigates the differences in the way bribery and extortion is perceived by two different cultures — American and Nigerian. Two hundred and forty American business students and one hundred and eighty Nigerian business students were presented with three scenarios describing a businessman offering a bribe to a government official and three scenarios describing a businessman being forced to pay a bribe to an official in order to do business. The Reidenbach-Robin instrument was used to measure the ethical reactions (...) of the two samples to these scenarios. Results indicate that ethical reactions to bribery and extortion vary by (a) the nationality of the person offering the bribe, and (b) the country where the bribe is offered. In addition, Nigerians perceived some of the scenarios as being less unethical than did Americans. (shrink)

Sociologists of education often emphasize goods that result from a practice (external goods) rather than goods intrinsic to a practice (internal goods). The authors draw from John Dewey and Alasdair MacIntyre to describe how the same practice can be understood as producing “skills” that center external goods or as producing habits (Dewey) or virtues (MacIntyre), both of which center internal goods. The authors situate these concepts within sociology of education’s stratification paradigm and a renewed interest in the concept of alienation, (...) contrasting the concepts of skills, habits, and virtues to capital, credentials, and habitus. They close by connecting the argument to broader critiques of procedural liberalism and the ideology of meritocracy, then giving suggestions for an expanded sociology of education beyond the stratification paradigm. Millions of people in the developing world lack access to curative drugs. Pogge identifies the cause of this problem as a lack of redistribution across borders. In contrast, this article shows that institutional shortcomings within developing countries are the main issue. These different explanations are the result of diverging analytic approaches to ethics: a cosmopolitan approach versus an ordonomic approach. This article compares both approaches with regard to how they conceptualize and propose to solve the problem of providing life-saving pharmaceuticals (...) to the poor in developing countries. The aim of this study was to review the typical factors related to physician’s liability in obstetrics and gynecology departments, as compared to those in internal medicine and surgery, regarding a breach of the duty to explain.

The purpose of this paper is to analyze the financial turmoil of the US subprime loan crisis of mid-Noughties and to compare it with the Japanese asset bubble of late 1980s. While examining the two crises, it compares the monetary policies of both countries, focusing on the excess liquidity and expansion of bank loans that were seen. This paper develops several bubble indicators, including the ratio of real estate loans to total loans, the loan-to-GDP ratio, and housing affordability. In order (...) to develop these indicators, it is necessary to compare banking behavior in both Japan and the United States, as banks in both countries were making loans beyond the point of profit maximization. Property prices and monetary policy in both countries influenced banking behavior significantly. The bubble indicators developed in this paper can be used as early warning indicators for future bubbles. (shrink)

A standard problem in empirical inquiry is how to adjudicate between contending theories when they work from different fundamental assumptions. In the field of political sociology, several strategies are adopted, from metatheoretical and comparative historical approaches to the recent formal models of scientific growth proposed by Imre Lakatos and Larry Laudan. After considering the limitations of these approaches, I develop an alternative strategy—"second—order empiricism"—based on the idea that successor theories have an onus to explain the apparent success of their rivals, (...) not only their own and their rivals' anomalies. Such a strategy, I argue, underscores some of the most effective analysis and argument in political sociology, yet is obscured by the appeal to other methodologies. (shrink)

In this third article on the role of international comparative practices in the formation of national health care systems I discuss a familiar group of systems-builders--medical professional organisations--and so focus on some early comparisons undertaken by organised groups of doctors. So far in this series I have argued that any attempt to make international comparisons--whether in the 19th-century or today--is bound to be based on a 'characteristically national' understanding. Not infrequently such an understanding finds its clearest expression in (...) the very act of undertaking practical tasks like 'comparing'. Dependent on whether comparisons are carried out by individuals privately, collectively by larger groups within the medical profession, or by government agencies the descriptions of 'national characteristics' (of medical organisation, institutional formation, clinical practice, research, public health and education) will differ in emphasis. -/- The examination of collective professional attempts at international comparison can enhance our understanding of the cultural distinctions that were incorporated by emerging national medical professions. This process can show which aspects of foreign medical systems were deemed pertinent, and also reveals methodology. What did such collective endeavours add to the more biographically coloured comparisons undertaken by the individual mid-century authors I discussed in part II of this series? (shrink)
