Insurance claims fraud receives increasing attention in the insurance industry, in academic studies and in public policy spheres. Claims fraud is variously viewed as an economic-contractual problem, a moral-psychological problem, a moral-sociological problem or a criminal problem. This article discusses these theoretical perspectives on insurance claims fraud and reviews the empirical evidence on its nature and prevalence. Most research concludes that opportunistic soft fraud is more prevalent than planned criminal fraud, and that consumer ethics, attitudes and psychology (...) are important aspects of the insurance fraud problem. On the contrary, much of the policy focus on reducing fraud has been directed toward detecting and criminalizing fraud. In light of existing research, care must be taken in applying these approaches to address soft fraud. Greater focus on the social and psychological dimensions of insurance claims fraud may increase the success of soft fraud prevention and decrease the likelihood that the focus on fraud will impair insurance relationships. Improving such prevention efforts requires a better understanding of the various dimensions of fraud, the determinants of fraud behaviors and the relationship between fraud behavior and the institutional setting. Spanish legislation on insurance and reinsurance mediation stipulates that intermediary can only receive commissions and fees for the management of their policies and prohibits any other form of remuneration. However, it is possible that financial intermediaries who manage larger risks wait until the end of the legal deadline to settle with insurance companies. This common practice in the insurance market hides additional remuneration in defiance of the law. It also means that the risk is not covered within (...) the prescribed period and would, involve a commercial payment to the client, and, on the other hand, affect sustainable claims management. The two books discussed here make important contributions to our understanding of the role of spacetime concepts in physical theories and how that understanding has changed during the evolution of physics. Both emphasize what can be called a ‘dynamical’ account, according to which geometric structures should be understood in terms of their roles in the laws governing matter and force. I explore how the books contribute to such a project; while generally sympathetic, I offer criticisms of some historical claims concerning (...) This paper addresses two examples of overconfident presentations of utilitarian moral conclusions. First, there is Peter Singer’s widely discussed claim that if the consequences of a medical experiment are sufficiently good to justify the use of animals, then we should be prepared to perform the experiment on human beings with equivalent mental capacities. Second, I consider defences of infanticide or after-birth abortion. I do not challenge the soundness of these arguments. Rather, I accuse those who seek to translate these (...) conclusions into moral advice of a dangerous overconfidence. This paper offers an insurance policy that protects against some of the costs of mistaken moral reasoning. An interest in moral insurance is motivated by the recognition that, in the event that overconfident ethicists have reasoned incorrectly, some actions recommended by their conclusions are not just bad, but very bad. We should reject suggestions that we conduct medical experiments on humans or kill newborns. (shrink)

With their intensive use of data to classify and price risk, insurers have often been confronted with data-related issues of fairness and discrimination. This paper provides a comparative review of discrimination issues raised by traditional statistics versus machine learning in the context of insurance. We first examine historical contestations of insurance classification, showing that it was organized along three types of bias: pure stereotypes, non-causal correlations, or causal effects that a society chooses to protect against, are thus (...) the main sources of dispute. The lens of this typology then allows us to look anew at the potential biases in insurance pricing implied by big data and machine learning, showing that despite utopic claims, social stereotypes continue to plague data, thus threaten to unconsciously reproduce these discriminations in insurance. To counter these effects, algorithmic fairness attempts to define mathematical indicators of non-bias. We argue that this may prove insufficient, since as it assumes the existence of specific protected groups, which could only be made visible through public debate and contestation. These are less likely if the right to explanation is realized through personalized algorithms, which could reinforce the individualized perception of the social that blocks rather than encourages collective mobilization. Insurance claim fraud costs insurance companies, policymakers, and taxpayers billions of dollars every year and has been described as the second largest white collar crime. The most common insurance fraud activity and one that contributes a significant portion of dollar losses is the practice of padding claim amounts in the event of a loss. One of the largest issues insurance companies face is that policyholders often do not perceive insurance claim padding as (...) an unethical behavior. However, very little research has examined the factors that contribute to such perceptions. Considering how consumers often attempt to justify fraudulent behavior from a fairness perspective, the present work examines how the amount of the deductible in an insurance claim situation can influence feelings of fairness and ethicality. The results of an experimental study show that higher deductible amounts result in stronger perceptions that insurance claim padding is fair to the insurance company, weaker perceptions that the behavior is unethical, and higher proposed claim award amounts. The study also shows, however, that the deductible amount effects are attenuated for consumers who display higher ethical standards as reflected by their scores on the consumer ethics scale. Implications are discussed with respect to the insurance industry, deviant consumer behavior, and general business ethics theory. (shrink)

This paper copes with a real-world classification problem related to the management of claims received in an insurance company. The way to obtain the classifier is not easy due to the high amount of missing values as well as the inherent imbalanced scenario within class labels. Once the data partition has been done, the training set is submitted to an intensive double grid search in order to obtain the most promising type of missing value imputation approach and then a (...) step ahead is done using the best method and it starts the next round of data mining strategies which now falls into data rebalancing umbrella. Again, a grid search from an undersampling and oversampling family with different settings is done taking into account only seen data. The training data obtained after the first grid search are now submitted to the second step according the second grid search in order to get the ready training set for the further classifier training. The main objective of the work is to find the best combination of data mining techniques that suits the data set with a pipeline containing two types of data preparation methods coming from different families. As an outcome, first the problem of the presence of missing values has been addressed and then the data rebalancing techniques has been applied. The study focuses on obtaining classifiers based on Bayesian and lazy approaches as well as decision trees, evaluated on metrics such as the area under the ROC curve (AUC), Cohen’s kappa, Accuracy and the F-measure, among others. The imputation by the mean the mode is preferable to the Expectation Maximization Imputation in the scenario faced in this paper taking into account that the amount of missing values is higher than a forty percent for many features. This book is about the processing of information in face-to-face communication when a speaker makes both audible and visible information available to a perceiver. Both auditory and visual sources of information are evaluated and integrated to achieve speech perception. The evaluation of the information source provides information about the strength of alternative interpretations, rather than just all-or-none categorical information, as claimed by “categorical perception” theory. Information sources are evaluated independently; the integration process insures that the least ambiguous sources have the (...) most influences on the judgment. Similar processes occur in a variety of other behaviors, ranging from personality judgments and categorization to sentence interpretation and decision making. The experimental results are consistent with a fuzzy logical model of perception, positing three operations in perceptual (primary) recognition: feature evaluation, feature integration, and pattern classification. Continuously valued features are first evaluated, then integrated and matched against prototype descriptions in memory; finally, an identification decision is made on the basis of the relative goodness-of-match of the stimulus information with the relevant prototype descriptions. Hix sees certain writings in terms of Kübler-Ross’s five stages of grief: denial, anger, bargaining, depression, and acceptance. The grief is over cultural losses (the ashes of which are referred to in the book’s title) in our electronic information age.Hix is dead right when he argues that Derrida exemplifies the strategy of denial in “Plato’s Pharmacy.” Derrida, as Hix puts it, addresses yesterday’s problem. Hix also plausibly fits writers like Eco and Bloom into the stage of anger. His interpretation of Lyotard as dealing with grief by bargaining (“if I let consensus go, will you let me keep justice?”) is brilliant. There is something pathetic about Lyotard’s belief that if we give all people free access to information technology then this will insure justice. Hix matches Baudrillard, who laments the loss of four-dimensionality in the electronic era, with depression. Finally, Ong exemplifies acceptance since, for Ong, electronic [End Page 511] technologies bring us to a new oral age which fosters a communal sense and concentrates on the present. Hix then calls for a new Socrates who will take us beyond lament to forge a new ideal.“Postmodern Beauty” argues, contra Lyotard, that beauty is still possible in our computer age since artworks are eternally created here and now. We can have aesthetic friendships with a visionary superior such as Van Gogh. However the Van Gogh we are speaking of is not the real historical one but a created proxy who only exists discursively. Still, the great artist is divine and gives us his (Hix’s examples are all male) blessing.“Postmodern Obscenity” presents Baudrillard’s view that obscenity is to be found not in desire’s triumph but rather in its defeat. In this postmodern age we lose sexuality because penetration is no longer possible, and that is so because of the collapse of the distinction between surface and depth. Hix then contrasts a photograph by Mapplethorpe with a Victoria’s Secret catalog. The catalog fits the postmodern conception of obscenity nicely. The Mapplethorpe, although obscene in the traditional sense, is not in the postmodern sense.“Postmodern Color” is my favorite chapter. Here, Hix deconstructs Derrida’s own analysis of metaphor and metaphysics. He shows how Derrida must use metaphors of opacity and depth to make his point. These metaphors also entail the very view Derrida opposes. It is here that Hix develops his theme of the postmodern replacement of metaphors of time with those of space. Prior to our postmodern era the Other which constitutes our selves was historical (for example, ancestors) while the Other which threatened us was spatial (for example, foreigners). By contrast, in the postmodern era we are constituted by the spatial Other and are threatened by the temporal Other. This explains something that has puzzled me in recent curriculum debates. As Hix puts it, reasonable people like Lynne Cheney and Louis Gates understand the humanities differently in terms of these competing metaphors. Cheney takes the traditional view, using temporal metaphors of origin and tradition, while Gates takes the postmodern view, using spacial metaphors of decentering and marginality.“Postmodern Love” and “Postmodern Sex” fit together. The first argues that although postmodernists claim we lack a language of love, they actually believe that love and language are one. More importantly, they know but repress the idea that love is something that transcends language. Here Hix calls on postmodernism to recognize that what structures language is outside language. The second argues that sex in our postmodern era has been transformed into discourse and discourse into sex. Each is in exchange for the other. The objective of this study was to take a closer look at defense-related expenses for medical malpractice cases over time. We conducted a retrospective review of medical malpractice claims reported to the Physician Insurers Association of America's Data Sharing Project with a closing date between January 1, 1985 and December 31, 2008. On average a medical malpractice claim costs more than $27,000 to defend. Claims that go to trial are much more costly to defend than are those that (...) are dropped, withdrawn, or dismissed. However, since the overwhelming majority of claims are dropped, withdrawn, or dismissed, the total amount spent to defend them surpasses that spent on claims that go to trial. Defense attorney expenses account for the majority of defense-related expenses (74%), while expert witness expenses and other expenses split the remaining 26%. A strong association was also found between the average indemnity payment and the amount it costs to defend individual claims by specialty. Our study found that defense-related expenses for medical malpractice claims are not an insignificant cost. As state and federal governments debate how to repair the malpractice system, addressing the high cost of defending claims should not be ignored. (shrink)

The U.S. Supreme Court held, in American Manufacturers Mutual Insurance Co. v. Sullivan, 119 S. Ct. 988, that state workers’ compensation system insurers cannot be sued for withholding health care benefits for work-related injuries while they decide whether the treatment is “reasonable” and “necessary.” The respondents, ten employees and two organizations representing employees who received medical benefits under the Workers’ Compensation Act, brought a 42 U.S.C. § 1983 action against state officials, the Pennsylvania State Workers’ Insurance Fund, private (...) insurers, and the school district, alleging that their due process rights were violated by provisions of the Pennsylvania Workers’ Compensation Act, 77 Pa. Cons. Stat. Ann. § 1 et seq.. The Act permits suspension of benefits without notice or opportunity to be heard pursuant to a “utilization review” process.To control costs, Pennsylvania amended its workers’ compensation system in 1993. Somehow or other, students were exposed to this cold bath of scepticism as to the significance of the whole endeavor, and yet went on to caxry out, in his own sytle, those rather more dogmatic exercises in analysis for which he is famous. This curious combination of dogmatic claim and lingering doubt suffuses Moore's work, of course. Perhaps it is seen best here in his ready acceptance of a method in which problems will be resolved by showing what is entailed by what we say, yet admitting that in most cases how you decide that p entails q is not terribly clear. All in all this is a valuable extension of a portrait of a major figure in twentieth century philosophy; and Mr. Lewy is to be congratulated for his skillful editing, conveying the arguments while preserving the quality of Moore's mind. At the same time there is something a bit depressing about it all, something a little too arrogant about the insistence that the stuff he is doing has no significance apart from what other moral science lecturers are saying to other crowds of undergraduates and writing for other lecturers in moral science. Lacroix' Kant et ~e Kantisme is a concise, well argued defense of two theses: 1) The main import of Kant's work is metaphysical. 2) Kant's Critical programme derived its impetus from the desire to insure human freedom, morality, and religion against the fatalism or scepticism to which Kant felt Leibniz' and Wolff's dogmatic metaphysics or Hume's naturalism condemned them. The approach is not altogether new, particularly in Europe, but it has been largely overlooked in the United States and Britain. There are exceptions, such as Lewis White Beck, but generally English speaking philosophers have contended that Kant's motives were mainly epistemological. Lacroix argues that the three Critiques are parts of a single philosophical conception of man's place in the universe. Although his book is short, directed at the general (French) reader, and therefore necessarily concerned with the broad flow of Kant's thought, he does an admirable job of marshalling evidence from all the main works in the Kantian corpus, including the Opus Postumum. In the last, according to Lacroix, "... Kant a voulu ]ui-m~me synthdtiser les diverses Critiques et donner une rue d'ensemble de sa pens~e" (p. 9). The reader will, however, feel frustrated with Lacroix' documentation, for all the citations are to French translations, making them difficult to follow up. Inasmuch as Lacroix has a penchant for citing particularly pregnant passages and has written a book worthy of consideration by serious students of Kant, correlate citations to the Akademie Ausgabe are warranted. Atlanta: Scholars Press, 1996. 120 pp. The philosophers have only interpreted the world, in various ways; the point, however, is to change it.--Karl Marx, Eleventh Thesis on Feuerbach Healing Deconstruction, edited by David Loy, is a collection (...) of essays which are situated by and elaborate the intersection of radical Christian, Buddhist, and deconstructionist discourses. With the exception of "Mindfulness of the Selves" by Morny Joy, all of these essays were first presented at the Fourth International Buddhist-Christian [End Page 267] Dialogue conference in Boston in 1992. While each author addresses different aspects of problems associated with suffering, the self, language, and healing, they share certain poststructuralist sensibilities in common and, with the exception of Robert Magliola, share a commitment to developing "a more holistic praxis" (p. 2). The title of this volume is, says Loy, "intentionally ambiguous. The authors in Healing Deconstruction make diverse contributions to this end and provocatively stimulate our thinking about how we might best create an alternative mode of human existence.Their contributions suffer, however, from problems which are, among other things, symptomatic of the state of critical theory and politics as we begin the twenty-first century. It was proposed that ethical evaluation of insurance claim padding behavior would be affected by characteristics of the policyholder, insurance agent, and company. These three factors were manipulated in written scenarios and the premise was tested in a factorial experimental design. No significant support was found for an effect of any of the three factors on ethical perceptions of claim padding. However, females found claims padding to be significantly less ethical than males. Given a claim (...) scenario where the actual loss was $500 and the claimed amount was $3000, subjects awarded an average of $986.91 on the claim. Catastrophe insurance differs from regular insurance in that individual claims are correlated and insurers have to pay more clients at once, which creates a liquidity strain. In this paper, I show two related findings: first, that when customers know their claims are correlated, this correlation can cause positive-sloping demand at low prices, and second, that because of this, a catastrophe insurance market can fail. The BP neural network model is a hot issue in recent academic research, and it has been successfully applied to many other fields, but few researchers apply the BP neural network model to the field of automobile insurance. The main method that has been used in the prediction of the total claim amount in automobile insurance is the generalized linear model, where the BP neural network model could provide a different approach to estimate the total claim (...) loss. This paper uses a genetic algorithm to optimize the structure of the BP neural network at first, and the calculation speed is significantly improved. At the same time, by considering the overfitting problem, an early stop method is introduced to avoid the overfitting problem. In the model, a three-layer BP neural network model, which includes the input layer, hidden layer, and output layer, is trained. With consideration of various factors, a total claim amount prediction model is established, and the trained BP neural network model is used to predict the total claim amount of automobile insurance based on the data of the training set. The results show that the accuracy of the prediction by using the BP neural network model to both the data of Shandong Province and to the data of six cities is over 95%. Then, the predicted total claim amount is used to calculate premiums for five cities in Shandong Province according to credibility theory. The results show that the average premium of the five cities is slightly higher than the actual claim amount of the city. The combination of BP neural network and credibility theory can perform accurate claim amount estimation and pricing for automobile insurance, which can effectively improve the current situation of the automobile insurance business and promote the development of insurance industry. A resilient issue in research ethics is whether and when a placebo-controlled trial is justified if it deprives research subjects of a recognized treatment. The clinicians' moral duty to provide the best available care seems to require the use of ‘active’ controlled trials that use an established treatment as a control whenever such a therapy is available. In another regard, ACTs are supposedly methodologically inferior to PCTs. Hence, the moral duty of the clinical researcher to use the best methods will (...) favor PCTs. In this target article, I analyze the three reasons for believing that ACTs are inferior to PCTs namely: 1) ACTs lack ‘assay sensitivity’; 2) ACTs do not measure absolute effect size; and 3) ACTs require more participants; and I contend that none are acceptable. Consequently the tension between clinical and research ethics dissolves: the moral duty of the clinician to avoid PCTs is unopposed by methodological considerations. (shrink)

In his final years, Josiah Royce worked to develop his theories of community and interpretation in practical directions. In particular, he developed an account of insurance as a special community of interpretation, and proposed the creation of an international board of insurance as a deterrent for war. Rather than evaluating Royce’s policy recommendations, this paper explores how his conception of insurance clarifies his account of interpretation. For Royce, insurance provides the best model for communal interpretation thus (...) far because an insurer seeks to prevent loss in the face of risky action, in addition to adjudicating between competing claims. The debate on whether insurance companies should be allowed to use results of individuals’ genetic tests for underwriting purposes has been both lively and increasingly relevant over the past two decades. Yet there appears to be no widely agreed upon resolution regarding appropriate and effective regulation. There exists today a gamut of recommendations and actual practices addressing this phenomenon ranging from laissez-faire to voluntary industry moratoria to strict legal prohibition. One obvious reason for such a variance in views and (...) approaches is that there are competing bases for evaluating the outcomes of restricting insurers’ use of such information. For example, an outright ban on the use of genetic test results may seem the best method for protecting against unfair discrimination, while allowing their use may seem to be the best way to foster efficiency in the market for insurance. However, there is also a lack of understanding about how restricting the use of genetic information would play out in the market through the so-called phenomenon of adverse selection. Using economic analysis, we discuss how the type of adverse selection that occurs in insurance markets affects various arguments both in favour and against an outright ban on insurers’ use of genetic tests for pricing insurance. We review arguments based on moral principles . Practical concerns from the insurance industry based on actuarial principles and economic efficiency are also compared. Each perspective is shown to lead to a range of conflicting recommendations about how genetic information should be regulated and these conclusions depend critically on whether one conducts the analysis from the ex ante temporal perspective , from the interim temporal perspective , or from the ex post temporal perspective. Income redistribution and insurance are core functions of welfare states. What role should the EU play in this domain? I examine the purchase of normative theorizing on social justice on this question, focusing on the contrast between three models of EU involvement: the EU as Support, which implies the sharing of resources through intergovernmental transfers; the EU as Provider, which implies EU cross‐border transfers towards individual citizens; the EU as Norm‐setter, which implies that the EU formulates normative policy ideals. (...) I review different accounts of justice for the EU and how they bear on the choice between these models of EU involvement. Conceptions of “background justice” have some purchase in a debate on the EU's role, but that purchase is limited. They need to be complemented by shared conceptions of domestic justice and a degree of moral cosmopolitanism. I argue that a “European Social Union” should be a Support and Norm‐setter in the realm of insurance and redistribution. Through the establishment of interstate insurance, it would be a true “insurance union.” It would engage in interstate redistribution, but there are no compelling reasons of justice for it to become a direct Provider of insurance or redistribution towards individual citizens.
