Starting from 2009, national courts of the EU Member States for the first time gained a “real” right to request the EU Court of Justice for preliminary rulings in asylum matters. First judgments of this Court demonstrate equivocal tendencies: some are blaming the Court for incompetence in asylum matters, others believe that the adoption of authoritative decisions at the European level will assist in developing consistent practice of applying asylum law in the European Union, something that failed at international level (...) due to absence of a single authoritative body to provide guidance on interpretation and application of the 1951 Refugee Convention. Considering that the judgments of the EU Court are part of the EU law, the Member States should develop their national asylum law with due regard being taken to those judgments. By the beginning of 2012, the Court has issued eight judgments on the interpretation of various problematic issues of EU asylum law. This Article analyses the jurisprudence of the EU Court in asylum cases, related to the granting of refugee status and subsidiary protection. It also provides a critical evaluation of those judgments. The main objective of the Article is to familiarise the relevant Lithuanian institutions and lawyers with the first judgments of the EU Court in asylum cases and encourage discussions concerning the application of rules established by the Court in the Lithuanian context. Due to limited size, this Article presents the analysis of two EU Court judgments adopted on interpretation of the 2004 Qualification Directive: Elgafaji v. The Netherlands (2009) dealing with granting of subsidiary protection, and Abdulla and others v. Bundesrepublik Deutschland (2010), dealing with cessation of refugee status. The value of those judgments first of all lies in the guidance they provided to the Member States on such concepts as: protection in a situation of an armed conflict, agents of protection, effectiveness of protection; as well as determination of a relationship between refugee status and subsidiary protection, relationship of the Qualification Directive with the European Convention on Human Rights and Fundamental Freedoms (ECHR), also cessation of protection. Elgafaji decision, while quite liberal with regard to persons seeking international protection, is not so liberally applied in the Member States’ practice and does not in itself guarantee positive outcome of the application of a concrete individual fleeing from an armed conflict, or a liberal approach to granting subsidiary protection in the Member States. Based on Elgafaji judgment it is clear that: Art. 15(b) of the Qualification Directive correspond to Art. 3 ECHR, while Art. 15(c) provides additional protection and in that it expands the Member States’ obligations beyond the ECHR to provide protection to persons fleeing in situations of armed conflict. While not every person arriving from an armed conflict situation would automatically fall under the granting of subsidiary protection, in certain exceptional situations indiscriminate violence may amount to individual threat without invoking personal circumstances. The EU Court departed from the individualisation requirement applied by the European Court of Human Rights in Art. 3 cases and did not also rely on international humanitarian law, by introducing a “sliding scale” formula for establishing an individual threat in armed conflict situation instead. This formula addressed the alleged internal discrepancy between “individual threat” and “indiscriminate violence”. The Abdulla decision brought in the human rights and law enforcement perspectives to the interpretation of cessation clauses, however it represents a rather superficial approach in the context of the analysed concepts (e.g. towards effectiveness of protection provided by the multinational armed forces) and is likely to be incompatible with the latest legislative trends in the EU asylum instruments (e.g. determination of refugee status and subsidiary protection by means of a single procedure) and the recent jurisprudence under the ECHR (e.g. failure to ensure a minimum standard of living may violate the ECHR). Detection of the Greek intext, which befits the episode's amplified bilingual atmosphere, is encouraged by a number of textual cues. The article also suggests a ludic connection to Aratus’ Phaenomena.

Kurt Godel was the most outstanding logician of the twentieth century, famous for his work on the completeness of logic, the incompleteness of number theory, and the consistency of the axiom of choice and the continuum hypothesis. He is also noted for his work on constructivity, the decision problem, and the foundations of computation theory, as well as for the strong individuality of his writings on the philosophy of mathematics. Less well-known is his discovery of unusual cosmological models for Einstein's (...) equations, permitting "time-travel" into the past. This second volume of a comprehensive edition of Godel's works collects together all his publications from 1938 to 1974. Together with Volume I (Publications 1929-1936), it makes available for the first time in a single source all of his previously published work. Continuing the format established in the earlier volume, the present text includes introductory notes that provide extensive explanatory and historical commentary on each of the papers, a facing English translation of the one German original, and a complete bibliography. Succeeding volumes are to contain unpublished manuscripts, lectures, correspondence, and extracts from the notebooks. Collected Works is designed to be accessible and useful to as wide an audience as possible without sacrificing scientific or historical accuracy. The only complete edition available in English, it will be an essential part of the working library of professionals and students in logic, mathematics, philosophy, history of science, and computer science. The concepts expressed by social role terms such as artist and scientist are unique in that they seem to allow two independent criteria for categorization, one of which is inherently normative. This study presents and tests an account of the content and structure of the normative dimension of these “dual character concepts.” Experiment 1 suggests that the normative dimension of a social role concept represents the commitment to fulfill the idealized basic function associated with the role. Background information can affect (...) which basic function is associated with each social role. However, Experiment 2 indicates that the normative dimension always represents the relevant commitment as an end in itself. We argue that social role concepts represent the commitments to basic functions because that information is crucial to predict the future social roles and role-dependent behavior of others. (shrink)

Ian Rumfitt (2000) developed a bilateralist account of logic in which the meaning of the connectives is given by conditions on asserted and rejected sentences. An additional set of inference rules, the coordination principles, determines the interaction of assertion and rejection. Fernando Ferreira (2008) found this account defective, as Rumfitt must state the coordination principles for arbitrary complex sentences. Rumfitt (2008) has a reply, but we argue that the problem runs deeper than he acknowledges and is in fact related to (...) the challenge of establishing proof-theoretic harmony. We motivate a distinctively bilateral criterion for harmony and show how the bilateralist can meet it. This also resolves Ferreira's complaint. (shrink)

The search for mechanisms has been a common practice in scientific research. However, since the empiricist critique of causality, and especially during the second third of the twentieth century, other non-mechanistic perspectives—especially deductivism—gained predominance. But the sustained effort of authors such as Michael Scriven, Mario Bunge and especially Wesley Salmon contributed to restoring the respectability of causality and mechanisms in philosophy of science. Some members of the causal family, usually lumped under the name of “new mechanistic philosophy”, emphasize the description (...) of mechanisms, especially causal ones, as a central aspect of explanation and other research practices in several areas of science. This approach offers viable solutions to the various ontological and methodological objections that are opposed to the two traditional approaches. In this work the basic characteristics of three philosophies that highlight the description of mechanisms as a central element to explanation and their suitability for the science of ecology are discussed. Discussions in social psychology overlook an important way in which biases can be encoded in conceptual representations. Most accounts of implicit bias focus on ‘mere associations’ between features and representations of social groups. While some have argued that some implicit biases must have a richer conceptual structure, they have said little about what this richer structure might be. To address this lacuna, we build on research in philosophy and cognitive science demonstrating that concepts represent dependency relations between features. These relations, (...) in turn, determine the centrality of a feature f for a concept C: roughly, the more features of C depend on f, the more central f is for C. In this paper, we argue that the dependency networks that link features can encode significant biases. To support this claim, we present a series of studies that show how a particular brilliance-gender bias is encoded in the dependency networks which are part of the concepts of female and male academics. We also argue that biases which are encoded in dependency networks have unique implications for social cognition. (shrink)

El propósito de este estudio es redireccionar y actualizar la interpretación del discurso que se deriva de la Comisión de la Verdad y la Reconciliación (CVR) en torno al atentado originado en la residencia del embajador de Japón durante el Gobierno de Fujimori y la intervención respectiva con la operación Chavín de Huántar. Para ello, se utilizarán distintas estrategias de análisis del discurso histórico y archivístico del Informe final (2003) de la CVR y la inclusión de la categoría antropológica de (...) memoria de Elizabeth Jelin, que será trascendental para constatar el almacenamiento y la influencia de este hecho en los ciudadanos. Un resultado relevante de ese contexto es la insatisfacción ciudadana hacia el Estado, puesto que para aminorar ese atentado los militares y el Servicio de Inteligencia Nacional (SIN), autorizados por el Gobierno, transgredieron los derechos humanos, así como la prensa no se desempeñó con ética —reacción que no es ajena a la actualidad—. Con todo ello, se concluirá que no existen maneras coetáneas de establecer convenios con los opositores al Gobierno. A la vez, no se busca la concientización. Más bien, se recurren a mecanismos violentos. Ese problema debería solucionarse, más que preocuparse por una reconstrucción escrita e idónea de la historia. (shrink)

Este artículo examina La ciudad y los perros (1963) de Mario Vargas Llosa para fundamentar cómo se logra la estratificación teórica de estilos y técnicas que se emplean para abordar la violencia en el texto. Sobre la epistemología, recurre principalmente a Todorov, Hamburger, Lotman y Genette. Y, para argumentar la manifestación de la violencia, considera las eventualidades que padecen los personajes del Colegio Militar Leoncio Prado; en especial, el Jaguar, el Poeta y el Esclavo. Esas acciones serán justificadas por la (...) instrucción castrense, la evolución humana, la necesidad de una conducta hegemónica idónea y la búsqueda del efecto perlocutivo en el lector. Para sistematizar esas peculiaridades, se opta por una metodología adscrita al cotejo de información teórica para que sea confrontada con el discurso literario. El análisis que se desarrolla es complementado con fragmentos representativos para que las formulaciones sean más directas y convincentes. Como resultado, se confirma esa correspondencia entre las teorías heterogéneas, la novela y la interpretación, por lo que el concepto de violencia adoptaría una multidimensionalidad que evidencia su existencia y su requerimiento esencial en los personajes. Con ello, se sustenta como conclusión que la violencia en ese contexto debería ser permanente e imprescindible para subsistir. (shrink)

Recommender Systems (RecSys) have been around since the early days of the Internet, helping users navigate the vast ocean of information and the increasingly available options that have been available for us ever since. The range of tasks for which one could use a RecSys is expanding as the technical capabilities grow, with the disruption of Machine Learning representing a tipping point in this domain, as in many others. However, the increase of the technical capabilities of AI-powered RecSys did not (...) come with a thorough consideration of their ethical implications and, despite being a well-established technical domain, the potential impacts of RecSys on their users are still under-assessed. This paper aims at filling this gap in regards to one of the main impacts of RecSys: personal autonomy. We first describe how technology can affect human values and a suitable methodology to identify these effects and mitigate potential harms: Value Sensitive Design (VSD). We use VSD to carry out a conceptual investigation of personal autonomy in the context of a generic RecSys and draw on a nuanced account of procedural autonomy to focus on two components: competence and authenticity. We provide the results of our inquiry as a value hierarchy and apply it to the design of a speculative RecSys as an example. (shrink)

In this article an attempt is made to detect what could have been the dialectical reasons that impelled the Cār-vāka thinker Udbhatabhatta to revise and reformulate the classical materialistic concept of cognition. If indeed according to ancient Cārvākas cognition is an attribute entirely dependent on the physical body, for Udbhatabhatta cognition is an independent principle that, of course, needs the presence of a human body to manifest itself and for this very reason it is said to be a peculiarity of (...) the body. Therefore, Udbhatabhatta seems to de-scribe the cognizing faculty according to a double ontology: it is both a principle and a characteristic, both inde-pendent and dependent. Two philosophical contexts—Vaisesika and Nyāya schools—are here taken into account as possible anti-Cārvāka fault-finding points of view that spured Udbhatabhatta to reconsider the Cārvāka per-spective. Although we do not have so much textual material on this particular aspect of the ancient and medieval philosophical debate in India, it nonetheless can be supposed that Udbhatabhatta’s reformulation of the concept of cognition was a tentative response to the Vaisesika idea that cognition is not an attribute of the body, rather of the mind (which is here supposed to be eternal), and to the Naiyāyika perspective according to which cognition would be an attribute of an everlasting self. In the case of the Nyāya school, fortunately we have at our disposal the criticism put forward by Vātsyāyana against the materialistic conception of cognition during this time. By examining some Vātsyāyana’s objections, it will emerge that Udbhatabhatta’s idea of cognition really seems to have the aspect of a consistent answer to them, from a renewed materialistic point of view. The epistemic modal auxiliaries must and might are vehicles for expressing the force with which a proposition follows from some body of evidence or information. Standard approaches model these operators using quantificational modal logic, but probabilistic approaches are becoming increasingly influential. According to a traditional view, must is a maximally strong epistemic operator and might is a bare possibility one. A competing account—popular amongst proponents of a probabilisitic turn—says that, given a body of evidence, must \ entails that \\) is (...) high but non-maximal and might \ that \\) is significantly greater than 0. Drawing on several observations concerning the behavior of must, might and similar epistemic operators in evidential contexts, deductive inferences, downplaying and retractions scenarios, and expressions of epistemic tension, I argue that those two influential accounts have systematic descriptive shortcomings. To better make sense of their complex behavior, I propose instead a broadly Kratzerian account according to which must \ entails that \ = 1\) and might \ that \ > 0\), given a body of evidence and a set of normality assumptions about the world. From this perspective, must and might are vehicles for expressing a common mode of reasoning whereby we draw inferences from specific bits of evidence against a rich set of background assumptions—some of which we represent as defeasible—which capture our general expectations about the world. I will show that the predictions of this Kratzerian account can be substantially refined once it is combined with a specific yet independently motivated ‘grammatical’ approach to the computation of scalar implicatures. Finally, I discuss some implications of these results for more general discussions concerning the empirical and theoretical motivation to adopt a probabilisitic semantic framework. (shrink)

The article reviews some analyses of temporal language in logical approaches to natural language semantics. It considers some asymmetries between past and future, manifested in language, which motivate the “standard view” of the non-reversibility of time and the persistence of the past. It concludes with a puzzle about the changing past which challenges the standard view.

This target article presents an integrated evolutionary model of the development of attachment and human reproductive strategies. It is argued that sex differences in attachment emerge in middle childhood, have adaptive significance in both children and adults, and are part of sex-specific life history strategies. Early psychosocial stress and insecure attachment act as cues of environmental risk, and tend to switch development towards reproductive strategies favoring current reproduction and higher mating effort. However, due to sex differences in life history trade-offs (...) between mating and parenting, insecure males tend to adopt avoidant strategies, whereas insecure females tend to adopt anxious/ambivalent strategies, which maximize investment from kin and mates. Females are expected to shift to avoidant patterns when environmental risk is more severe. Avoidant and ambivalent attachment patterns also have different adaptive values for boys and girls, in the context of same-sex competition in the peer group: in particular, the competitive and aggressive traits related to avoidant attachment can be favored as a status-seeking strategy for males. Finally, adrenarche is proposed as the endocrine mechanism underlying the reorganization of attachment in middle childhood, and the implications for the relationship between attachment and sexual development are explored. Sex differences in the development of attachment can be fruitfully integrated within the broader framework of adaptive plasticity in life history strategies, thus contributing to a coherent evolutionary theory of human development. In this paper we discuss in some depth the main theorems pertaining to Carnot’s theory of transversals, their initial reception by Servois, and the applications that Brianchon made of them to the theory of conic sections. The contributions of these authors brought the long-forgotten theorems of Desargues and Pascal fully to light, renewed the interest in synthetic geometry in France, and prepared the ground from which projective geometry later developed.

El artículo se concentra en un aspecto del diálogo platónico Ión, a saber, aquel que señala a la inspiración del poeta como un estado de posesión. Este estado es descrito como un proceso irracional que descalifica al poeta en su pretensión de dominar tanto alguna técnica como de poseer algún saber. La descripción de este estado se encuentra en el primer discurso de Sócrates en el citado diálogo y la intención del artículo es mostrar cómo esta descripción platónica de la (...) inspiración poética responde más a una invención que a una descripción veraz del proceso poético, a pesar de que Platón diga lo contrario. --- “The Poet’s Inspiration and the Platonic Fiction”. The paper is concerned with one aspect of the Platonic dialogue Ion, namely that which considers the poet’s inspiration as a state of possession. This state is described as an irrational process that undermines the poet’s claims to be master of some technique as well as knowledge. The description of this state is placed in Socrates’ first discourse in the abovementioned dialogue, and the intention of the paper is to show how this Platonic description of poetic inspiration is due more to an invention than to a true description of the poetic process, despite Plato’s opposing claims. The argument against innatism at the heart of Cognitive Gadgets is provocative but premature, and is vitiated by dichotomous thinking, interpretive double standards, and evidence cherry-picking. I illustrate my criticism by addressing the heritability of imitation and mindreading, the relevance of twin studies, and the meaning of cross-cultural differences in theory of mind development. Reaching an integrative understanding of genetic inheritance, plasticity, and learning is a formidable task that demands a more nuanced evolutionary approach.

The primary aim of this article is to provide a case study of textual hermeneutics in the context of Vedic literature. It will be shown how some interpretative pitfalls, into which contemporary translators have fallen, can be avoided if we broaden the perspective beyond the semantics of words and apply a principle of plausibility. The case study concerns the analysis of Ṛgveda 10.28, with special reference to the wildlife episodes depicted in verses 10cd-11ab. A few modern translations in Western languages (...) of 10cd are here considered. Some of them show that a principle of plausibility has been actually taken into account by their authors while approaching the text, albeit the result does not seem always entirely satisfactory. Some other translations seem not to carefully consider the broader context, therefore failing to convincingly make sense of the original text. After an introduction on the general subject of the hymn as it emerges from verses 1-9, i.e., the Vedic sacrifice and the subsequent consumption of the sacrificial offerings, arguments and textual evidence are provided in order to show how the reading of 10cd acquires a cogent and very plausible meaning if regarded in light of verse 11ab. The Radical Machiavelli: Politics, Philosophy and Languageoffers a partial and even partisan reading of Machiavelli, whose thought continues to divide interpreters, forcing them to confront their responsibility as contemporary thinkers in a global society.

Denying the conclusion of a valid argument is not generally permissible if one suspends on one premise of the argument and believes the other premise. This can happen when one’s only critique of an argument is to undermine one premise. There is incoherence there. Here I examine how this is relevant to the debate on evolutionary debunking of our moral knowledge. I argue that one significant line of response to the debunker is unsuccessful: merely undermining the debunker’s empirical claim. It (...) is not rational to respond this way and believe one has moral knowledge. First I present evidence that prominent critics of the debunking argument merely undermine the debunker’s empirical claim. Then I argue for two premises: merely undermining a premise can only justify a middling amount of doubt towards the premise and we should have no more doubt about the conclusion of a valid argument than we do about the premises. Augusto Del Noce is widely considered one of Italy’s foremost philosophers and political thinkers in the second half of the twentieth century. He is also remembered as an original and profound cultural critic, and in particular as a great scholar of the process of secularization that took place in the West during the 1960s. A collection of eleven essays and lectures by Del Noce that originally appeared between 1964 and 1969, and which the author published as a book in 1971, (...) The Age of Secularization quickly became recognized as one of the most original and penetrating attempts to interpret the cultural and political turmoil of the period. In its pages Del Noce discusses, among other topics, the student protests of 1968, the counterculture of the 1960s, the significance of the sexual revolution, the nature of the technological society, and the relationship between Christianity and modern culture. The Age of Secularization documents the encounter between a key period of contemporary history and the full intellectual maturity of one of its most perceptive observers. It makes available to English-language readers a lasting reflection on the philosophical roots of contemporary culture, and it is just as illuminating and topical today as it was nearly fifty years ago. This paper defends the view that the Faculty of Language is compositional, i.e., that it computes the meaning of complex expressions from the meanings of their immediate constituents and their structure. I fargue that compositionality and other competing constraints on the way in which the Faculty of Language computes the meanings of complex expressions should be understood as hypotheses about innate constraints of the Faculty of Language. I then argue that, unlike compositionality, most of the currently available non-compositional constraints predict (...) incorrect patterns of early linguistic development. This supports the view that the Faculty of Language is com- positional. More generally, this paper presents a way of framing the compositionality debate (by focusing on its implications for language acquisition) that can lead to its even- tual resolution, so it will hopefully also interest theorists who disagree with its main conclusion.
