This paper presents a pedagogical framework for teaching cross-cultural clinical ethics. The approach, offered at the intersection of anthropology and bioethics, is innovative in that it takes on the “social sciences versus bioethics” debate that has been ongoing in North America for three decades. The argument is made that this debate is flawed on both sides and, moreover, that the application of cross-cultural thinking to clinical ethics requires using the tools of the social sciences within a principles-based framework for clinical (...) ethics. This paper introduces the curriculum and provides guidelines for how to teach cross-cultural clinical ethics. The learning points that are introduced emphasize culture in its relation to power and underscore the importance of viewing both biomedicine and bioethics as culturally constructed. (shrink)

This paper aims to increase the reader’s understanding of how the notion of the ‘bobby on the beat’ has been elevated to iconic, if not mythical, status within British policing. In doing so, the article utilises the semiotic idea of myth, as conceptualized by Roland Barthes, to explore how through representations of the ‘bobby on the beat’ police officers have been projected in a more avuncular re-assuring role to a public fearful of crime, which fails to do service to the (...) signifying practices that accompany and embody the visible police patrol. Indeed, police patrol work secures social space for the State and although it does re-assure anxious members of society that their social world is safe and secure, for others, it further illustrates how their social space is fragile and troubled. On another level, the ‘bobby’ narrative has also been harnessed as part of a broader mythologizing of ‘Englishness’ and quintessential British characteristics. (shrink)

This article looks at the similarities and differences between Karl Marx’s theory of value and J.S. Mill’s theory of value, where value is synonymous with ‘utility’. It explores how the authors treated the spheres of use and exchange; possibilities of revolutionary social praxis under each of their philosophies; and their respective ability to endure in relevance for the contemporary social world. This article also analyzes their methodologies for achieving utility, focusing on the humanistic and mechanistic aspects of both Marxism and (...) utilitarianism. Connections between their logical aims are also made in the field of ethics. Epistemic considerations are taken into account when making a value judgement on their works, in that materialist philosophy sometimes melds with idealist philosophy in the works of both authors. Finally, an idea will be given as to who was the ‘better philosopher’ judging by consistency of means and ends. (shrink)

We developed this study to examine the issue of parental refusal of treatment, looking at the issue through a cultural competence lens. Recent cases in Canada where courts have declined applications by clinicians for court orders to overrule parental refusal of treatment highlight the dispute in this area. This study analyses the 16 cases of a larger group of 24 cases that were selected by a literature review where cultural or religious beliefs or ethnic identity was described as important reasons (...) behind the refusal. The most significant finding was that nearly all of the cases cited unacceptable side effects as the main reason for declining treatment. We then analysed the detail of the cases and concluded that in the first instance a skilled clinical approach to develop an agreed management plan is by far the best approach. In the event that agreement cannot be reached we recommend engaging a mediator to help the clinician and parents/child to find an agreeable way forward. We argue that the option of se... (shrink)

This article describes a qualitative study of models of ethics consultation used by ethics consultants in Canada. We found four different models used by Canadian ethics consultants whom we interviewed, and one sub-variant. We describe the lone ethics consultant model, the hub-and-spokes sub-variant of this model; the ethics committee model; the capacity-building model; and the facilitated model. Previous empirical studies of ethics consultation describe only two or three of these models.

Die Gründe, die C. I. Lewis [5], [6] bewogen haben, neben der gewöhnlichen Implikation eine strikte Implikation einzuführen, sind bekannt. In der vorliegenden Arbeit wird aus ähnlichen Gründen eine strenge Implikation eingeführt, die jedoch einen engeren Begriff darstellt als die strikte Implikation. Mit einer Arbeit von Arnold Schmidt [7] hat meine nur geringe Berührungspunkte, da der Verfasser sich mit der strikten Implikation beschäftigt. Für diese wird ein relativ einfaches Axiomensystem angegeben und gezeigt, wie man durch geeignete Definitionen von Notwendigkeit und (...) Möglichkeit bei eventueller Hinzufügung von Zusatzaxiomen die bekannten Systeme des Modalitätenkalküls erhält. Den Hauptteil meiner Arbeit bildet die Einführung meines Implikationsbegriffs; im zweiten Teil der Arbeit komme ich dann auf dieser Basis auch zu einer Einführung der Modalitäten.Um die Art der Einführung des Kalküls zu motivieren, wollen wir kurz auf das eingehen, das uns mehr oder weniger deutlich vorschwebt, wenn wir von der strengen Implikation sprechen. In this study, Canadian healthcare ethics consultants describe their use of ethics decision-making frameworks. Our research finds that ethics consultants in Canada use multi-purpose ethics decision-making frameworks, as well as targeted frameworks that focus on reaching an ethical resolution to a particular healthcare issue, such as adverse event reporting, or difficult triage scenarios. Several interviewees mention the influence that the accreditation process in Canadian healthcare organizations has on the adoption and use of such frameworks. Some of the ethics consultants we (...) interviewed also report on their reluctance to use these tools. Limited empirical work has been done previously on the use of ethics decision-making frameworks. This study begins to fill this gap in our understanding of the work of healthcare ethics consultants. Using concepts developed by Bruno Latour and Pierre Bourdieu, we document the changing nature of the DAKO machine’s agency before, during, and after the controversy, and we make the ethical argument (...) that treating the machine as a scapegoat was harmful to patients. The mistreatment of patients was directly tied to a misrepresentation of the DAKO machine. This book explores the intellectual encounter of India and the West from pre-Alexandrian antiquity until the present. It examines India’s role in European philosophical thought, as well as the reception of European philosophy in Indian thought. Halbfass also considers the tension in India between a traditional and modern understanding of itself. Halbfass covers a wide variety of epochs and “cultures” in this study without oversimplification and without distracting shifts of tone. The volume’s methodological unity is reflected in Halbfass’ reliance on (...) the German hermeneutical tradition and his root characterization of the encounter between Indian and the West as dynamic. This book examines, above all, the relationship between reason and Vedic revelation, and the philosophical responses to the idea of the Veda. It deals with such topics as dharma, karma and rebirth, the role of man in the universe, the motivation and justification of human actions, the relationship between ritual norms and universal ethics, and reflections on the goals and sources of human knowledge. Halbfass presents previously unknown materials concerning the history of sectarian movements, including the notorious "Thags" (thaka), and (...) relations between Indian and Iranian thought. The approach is partly philosophical and partly historical and philological; to a certain extent, it is also comparative. The author explores indigenous Indian reflections on the sources, the structure and the meaning of the Hindu tradition, and traditional philosophical responses to social and historical realities. He does not deal with social and historical realities per se; rather, basing his work on the premise that to understand these realities the reflections and constructions of traditional Indian theorists are no less significant than the observations and paradigms of modern Western historians and social scientists, he explores the self-understanding of such leading thinkers as Sankara, Kumarila, Bhartrhari and Udayana. In der genannten Arbeit hatte ich, angeregt ursprünglich durch Gedankengänge von Herrn Behmann, ein typenfreies System der Logik aufgebaut, das allein auf dem Gedanken fußte, daß der Definitionsbereich der Prädikate im allgemeinen beschränkt ist, sodaß (...) nur bestimmte Zusammenstellungen von Prädikaten und Dingen sinnvolle, d.h. wahre oder falsche Aussagen ergeben, und das diesen Gesichtspunkt meiner Meinung nach konsequent durchführte. Eine anschließende Arbeit sollte dann die Widerspruchsfreiheit des Systems untersuchen. Diese Untersuchung ist inzwischen geschehen. Es zeigte sich, daß sich die Widerspruchsfreiheit des Systems nur dann beweisen ließ, falls die in ihm enthaltene Vollständigkeit von → die sich durch das Bestehen eines Deduktionstheorems zeigte, fallen gelassen wurde. Die Grundformeln (13) und (14) mußten wegbleiben. Die Widerspruchsfreiheit des restlichen Systems ließ sich dann durch eine dem System eigentümliche Methode der Beweistransformation zeigen.Diese anschließienden Untersuchungen, die ihrer Zeit nicht mehr veröffentlicht werden konnten, sind inzwischen durch die vorliegenden überholt. Es war das Unbefriedigende bei dem genannten Aufbau, daß hinterher doch wieder eine Einschränkung gemacht werden mußte, die sich nicht aus den zugrunde gelegten Prinzipien ergab, sondern von ihnen aus unvorhergesehen war. Diese Einschränkung bewirkte übrigens, daß keine volle Zahlentheorie in dem System zu gewinnen war. (shrink)
