The purpose of this study was to describe the extent to which nurses perceive the ethical dimensions of clinical practice situations involving patients, families and health care professionals. Using the composite theory of basic moral principles and the professional standard of care established by legal custom as a framework, situations involving ethical dilemmas were gleaned from the nursing literature. They were reviewed for content validity, clarity and representativeness in a two-stage process by expert panels. The situations were presented in a (...) written format to a convenience sample of nurses (n = 125), who were primarily staff nurses (65.6%). Respondents' judgements about whether the main issue of each situation concerned ethics ranged from a low of 0.8% to a high of 40%. From analyses of the categories into which the majority of subjects placed each situation, it was concluded that these nurses generally perceived ethics as the main issue in situations that directly involve patients' autonomy. Analysis yielded unanticipated findings about the themes in ethical situations to which nurses in practice may respond. (shrink)

Technology policy needs to be receptive to different social needs and realities to ensure that innovations are both ethically developed and accessible. This article proposes a new method to integrate social controversies into foresight scenarios as a means to enhance the trustworthiness and inclusivity of policymaking around Artificial Intelligence. Foresight exercises are used to anticipate future tech challenges and to inform policy development. However, the integration of social controversies within these exercises remains an unexplored area. This article aims to bridge (...) this gap by providing insights and guidelines on why and how we should incorporate social controversies into designing foresight scenarios. We emphasize the importance of considering social controversies, as they allow to understand non-mainstream perspectives, re-balance power dynamics, de-black box technologies and have accountable policymaking processes that are open to listening different social needs. Building on empirical research, we present a step-by-step method that involves identifying the key policy challenges and relevant controversies related to an emerging technology, deconstructing the identified controversies, and mapping them onto future scenarios to test policy options and build policy road mapping. Furthermore, we discuss the importance of strategically engaging involved stakeholders, including affected communities, civil society organizations, and experts, to ensure a comprehensive and inclusive perspective. Amit Sharma, Rajesh Ramanathan, Marc Posner, Robert A Fisher Hume-Lee Transplant Center, Virginia Commonwealth University, Richmond, VA, USA: Pediatric kidney transplantation is the preferred treatment for children with end-stage renal disease. The most common indications for transplantation in children are renal developmental anomalies, obstructive uropathy, and focal segmental glomerulosclerosis. Living donor kidney transplants are often performed pre-emptively and offer excellent graft function. Policy changes in deceased-donor kidney allocation have increased the proportion of such transplants in pediatric recipients. Adequate (...) pretransplant workup along with evaluation of urologic abnormalities is imperative in achieving good outcomes. Overall, patient and graft outcomes after kidney transplantation have improved, with five-year deceased donor and living donor graft survivals of 78.8% and 84.3%, respectively. Improvements in induction and maintenance immunosuppression have contributed to the gradual improvement in outcomes. Unique challenges in pediatric recipients include increased graft thrombosis, adverse growth, and abnormal development relating to immunosuppression, increased rejection due to nonadherence, increased susceptibility to opportunistic infections, and post-transplant malignancy. This review focuses on the current practices and outcomes in pediatric kidney transplantation in North America. We discuss the indications for transplantation, the evaluation process, some key surgical and immunologic considerations, and the common risk factors for graft dysfunction. Our goal in producing this special issue is to encourage our colleagues to incorporate topics related to LGBT populations into bioethics curricula and scholarship. Bioethics has only rarely examined the ways in which law and medicine have defined, regulated, and often oppressed sexual minorities. This is an error on the part of bioethics. Medicine and law have served in the past as society's enforcement arm toward sexual minorities, in ways that robbed many people of their dignity. We feel that bioethics (...) has an obligation to discuss that history and to help us as a society take responsibility for it.We can address only a small number of topics in this special issue of the Hastings Center Report, and we selected topics we believe will stimulate discourse. Andrew Solomon offers an elegant overview of the challenges that bioethics faces in articulating a solid basis for LGBT rights. Timothy F. Murphy asks whether bioethics still faces issues related to lesbian, gay, and bisexual people, given the deletion of homosexuality as a disease and the progress toward same‐sex marriage. Jamie Lindemann Nelson's essay addresses the search for identity for transgender persons and the role of science in that search. Two articles, those by Brendan S. Abel and by Jack Drescher and Jack Pula, take up the complex issue of medical treatment for children who reject their assigned birth gender. Celia B. Fisher and Brian Mustanski address the special challenges of engaging LGBT youth in research, balancing the need for better information about this vulnerable group against the existing restrictions on research involving children. Tia Powell and Edward Stein consider the merits of legal bans on psychotherapies intended to change sexual orientation, particularly in the light of current research on orientation. Mary Beth Foglia and Karen I. Fredricksen‐Goldsen highlight health disparities and resilience among LGBT older adults and then discuss the role of nonconscious bias in perpetuating disparities. Stephan Davis and Nancy Berlinger assess the challenges of access to care and health policy for transgender persons. Edward J. Callahan et al. tackle the ways in which diverse aspects of medicine should change to better incorporate the needs of LGBT patients, including through use of the electronic medical record, education of health professionals, and recruitment efforts for LGBT health professionals. Against the background assumptions that knowing what clinical ethics consultation represents to those with whom ethics consultants work most closely is a necessary component for being responsible in the practice of ethics consultation, and the complexities of soliciting and understanding colleague evaluations require another inherent responsibility for the methods by which ethics consultations are evaluated, in this article we report our experience soliciting, analyzing, and trying to understand retrospective evaluations of our Clinical Ethics Consultation Service. These evaluations were collected through (...) a quality assessment effort at our institution. Drawing from the qualitative elements of our survey instrument, we describe unexpected variations among the requests for ethics consultation and the retrospective reports from those colleagues making the requests. Focusing on just one aspect – the reason for request – raised several core questions about how we should evaluate those retrospective reports, what could be learned from the differences that we were now encountering, and what we could learn about the process of evaluating our practices. Working through these questions, we suggest several issues to consider in ongoing efforts to describe and evaluate clinical ethics consultation: the role of time and memory in evaluating retrospective evaluations, the importance of attending to the language of moral shift or disruption with which our colleagues describe their experiences, and how to understand the role of ethics consultation in creating ‘moral space’ for colleagues to process their moral experiences. Three experiments demonstrate that biological movement facilitates young infants’ recognition of the whole human form. A body discrimination task was used in which 6-, 9-, and 12-month-old infants were habituated to typical human bodies and then shown scrambled human bodies at the test. Recovery of interest to the scrambled bodies was observed in 9- and 12-month-old infants in Experiment 1, but only when the body images were animated to move in a biologically possible way. In Experiment 2, nonbiological movement was (...) incorporated into the typical and scrambled body images, but this did not facilitate body recognition in 9- and 12-month-olds. A preferential looking paradigm was used in Experiment 3 to determine if infants had a spontaneous preference for the scrambled versus typical body stimuli when these were both animated. The results showed that 12-month-olds preferred the scrambled body stimuli, 9-month-olds preferred the typical body stimuli and the 6-month-olds showed no preference for either type of body stimuli. These findings suggest that human body recognition involves integrating form and movement, possibly in the superior temporal sulcus, from as early as 9 months of life. (shrink)

This article focuses on the analysis of gossip that is done in a playful key, including laughter as a salient feature, drawing on extracts taken from two naturally occurring conversations among Galician female undergraduate students. The analysis indicates that gossip emerges as a form of indirect mockery in the data, which are commonly based on dramatized reported speech of the ‘victim’, including parodic stylization devices that are orientated to elicit laughter by making fun or through ridicule. The evaluation component also (...) reveals important differences in relation to serious gossip, as it is not necessarily negative and is not always explicitly established or developed. For this reason, this component can be ambiguous in some cases. From a functional perspective, the article emphasizes that sociability and entertainment are not the only functions that playful and humorous gossip can play; at a fundamental level, this discourse practice has other benefits for the participants: as a way of constructing group identity and getting group comfort for a feeling of envy; of increasing self-esteem from the problems of another party; and of degrading other people’s success. The common element behind these underlying functions is a comparative competition of the gossipers with the person who is the subject of their talk. Thus, gossip as mockery is not free of maliciousness and competitiveness. (shrink)

Clinical ethics consultants (CECs) work in complex environments ripe with multiple types of expectations. Significantly, some are due to the perspectives of professional colleagues and the patients and families with whom CECs consult and concern how CECs can, do, or should function, thus adding to the moral complexity faced by CECs in those particular circumstances. We outline six such common expectations: Ethics Police, Ethics Equalizer, Ethics Superhero, Ethics Expediter, Ethics Healer or Ameliorator, and, finally, Ethics Expert. Framed by examples of (...) requests for ethics consultation that illustrate each kind, along with brief descriptions, we argue that while these expectations ought to be resisted for clear and practical reasons, they also create opportunities for CECs to articulate, educate, and ultimately be responsible to the professional demands of clinical ethics work. Recognizing, acknowledging, and at times resisting those expectations thus become key activities and responsibilities in the performance of ethics consultation. (shrink)

We examine the role of professional jurisdiction in the convergence of science and business by exploring the relationship between professional jurisdiction and ethical decision-making. We apply the concept of professional jurisdiction (Abbott 1988) to the turf wars over vertebrate fossils among professional fossil collectors, vertebrate paleontologists, and the professional associations. We posit a series of hypotheses relating to how perceptions of professional jurisdiction influence stakeholders’ ethical decision-making frameworks concerning the sale and purchase of vertebrate fossils, as well as how professional (...) paleontologists who work with vertebrate fossils and other stakeholders differ in ethical decision-making if vertebrate fossils are perceived inside or outside of their professional jurisdiction. We develop a time-line of jurisdiction battles over vertebrate fossils and a model of the influence of professional jurisdiction perceptions on ethical decision-making. Background: Recent research demonstrates that people sometimes make different medical decisions for others than they would make for themselves. This finding is particularly relevant to end-of-life decisions, which are often made by surrogates and require a trade-off between prolonging life and maintaining quality of life. We examine the impact of decision role, patient age, decision maker age and multiple individual differences on these treatment decisions. Methods: Participants read a scenario about a terminally ill cancer patient faced with a choice between (...) an aggressive chemotherapy regimen that will extend life by two years and palliative treatments to control discomfort for one remaining month. Participants were randomly assigned to one of three decision roles (patient, physician, or an abstract other) and the scenario randomly varied whether the patient was described as 25 or 65-years old. Results: When deciding for a 65-year old patient, approximately 60% of participants selected aggressive chemotherapy regardless of decision role. When deciding for a 25-year old patient, however, participants were more likely to select chemotherapy for a patient (physician role) or another person (abstract other) than for themselves (70%, 67%, and 59%, respectively). In addition, confidence that powerful others (eg, physicians) control one’s health, as well as respondents’ age and race, consistently predicted treatment choices. Conclusions: Patient age appears to influence medical decisions made for others but not those that we make for ourselves. These findings may help to explain the discord that often occurs when younger cancer patients refuse life-extending treatments. (shrink)

It is relevant to global and political matters as well as to the personal relations that can most clearly exemplify care. It discusses the feminist roots of this moral approach and why the ethics of care can be a morality with universal appeal. Held examines what we mean by "care," and what a caring person is like. Where other moral theories demand impartiality above all, the ethics of care understands the moral import of our ties to our families and groups. It evaluates such ties, focusing on caring relations rather than simply on the virtues of individuals. The book proposes how such values as justice, equality, and individual rights can "fit together" with such values as care, trust, mutual consideration, and solidarity. In the second part of the book, Held examines the potential of the ethics of care for dealing with social issues. She shows how the ethics of care is more promising than Kantian moral theory and utilitarianism for advice on how expansive, or not, markets should be, and on when other values than market ones should prevail. Two studies investigated the development of infants' visual preferences for the human body shape. In Study 1, infants of 12,15 and 18 months were tested in a standard preferential looking experiment, in which they were shown paired line drawings of typical and scrambled bodies. Results indicated that the 18-month-olds had a reliable preference for the scrambled body shapes over typical body shapes, while the younger infants did not show differential responding. In Study 2, 12- and 18-month-olds were tested with the (...) same procedure, except that the typical and scrambled body stimuli were photographic images. The results of Study 2 again indicated that only the 18-month-olds had a reliable preference for the scrambled body shapes. This finding contrasts sharply with infants' precocious preferences for human faces, suggesting that infants' learning about human faces and human bodies follow different developmental trajectories. I use the psychological phenomenon of ‘attribute framing’ as a case study for exploring philosophical conceptions of semantics and the semantics-pragmatics divide. Attribute frames are pairs of sentences that use contradictory expressions to predicate the same property of an individual or object. Despite their equivalence, pairs of attribute frames have been observed to induce systematic variability in hearers’ responses. One explanation of such framing effects appeals to the distinct ‘reference point information’ conveyed by alternative frames. Although this information is taken (...) to be pragmatic, a live debate in the philosophy of language concerns the extent to which pragmatic information can really be held apart from semantics. Therefore, in this article I examine whether – and how – reference point information might be thought to intrude on the semantics of an attribute frame. I describe two ways in which the information might be considered broadly semantic, due to its being directly communicated or conventional. However, I argue that the framing data in fact support a narrower conception of semantics, and a semantics-pragmatics distinction that separates standing sentence meaning from enriched communicated meaning. How is feminism changing the way women and men think, feel, and act? Virginia Held explores how feminist theory is changing contemporary views of moral choice. We review major developmental evidence on the continuity from action to gesture to word and sign in human children, highlighting the important role of caregivers in the development of multimodal communication. In particular, the basic issues considered here and contributing to the current debate on the origins and development of the language-ready brain are: (1) links between early actions, gestures and words and similarities in representational strategies; (2) importance of multimodal communication and the interplay between gestures and spoken words; (3) (...) interconnections between early actions, gestures and signs. Drawing on all of Wollstonecraft's works and treating them (...) thematically rather than sequentially, Sapiro shows that Wollstonecraft's ideas about women's rights, feminism, and gender are elements of a broad and fully developed philosophy, one with significant implications for contemporary democratic and liberal theory. The issues raised speak to many current debates in theory, including those surrounding interpretation of the history of feminism, the relationship between liberalism and republicanism in the development of political philosophy, and the debate over the canon. For political scientists, most of whom know little about Wollstonecraft's thought, Sapiro's book is an excellent, nuanced introduction which will cause a reconsideration of her work and her significance both for her time and for today's concerns. For feminist scholars, Sapiro's book offers a rounded and unconventional analysis of Wollstonecraft's thought. In this paper, we review recent neuroimaging investigations of disorders of consciousness and different disciplines' understanding of consciousness itself. We consider potential tests of consciousness, their legal significance, and how they map onto broader themes in U.S. statutory law pertaining to advance directives and surrogate decision-making. In the process, we outline a taxonomy of themes to illustrate and clarify the variance in state-law definitions of consciousness. Finally, we discuss broader scientific, ethical, and legal issues associated with the advent of neuroimaging (...) for disorders of consciousness and conclude with policy recommendations that could help to mitigate confusion in this realm. Virginia Held's Feminist Morality defends the idea that it is possible to transform the "public" sphere by remaking it on the model of existing "private" relationships such as families. This paper challenges Held's optimism. It is argued that feminist moral inquiry can aid in transforming the public sphere only by showing just how much the allegedly "private" realms of families and personal relationships are shaped-and often misshapen-by public demands and concerns.
