White, Christensen, and Feldman have recently endorsed uniqueness, the thesis that given the same total evidence, two rational subjects cannot hold different views. Kelly, Schoenfield, and Meacham argue that White and others have at best only supported the weaker, merely intrapersonal view that, given the total evidence, there are no two views which a single rational agent could take. Here, we give a new argument for uniqueness, an argument with deliberate focus on the interpersonal element of the thesis. Analytic metaphysics has recently discovered biology as a means of grounding metaphysical theories. This has resulted in long-standing metaphysical puzzles, such as the problems of personal identity and material constitution, being increasingly addressed by appeal to a biological understanding of identity. This development within metaphysics is in significant tension with the growing tendency amongst philosophers of biology to regard biological identity as a deep puzzle in its own right, especially following recent advances in our understanding of symbiosis, the evolution of (...) multi-cellular organisms and the inherently dynamical character of living systems. Moreover, and building on these biological insights, the broadly substance ontological framework of metaphysical theories of biological identity appears problematic to a growing number of philosophers of biology who invoke process ontology instead. This volume addresses this tension, exploring to what extent it can be dissolved. For this purpose, the volume presents the first selection of essays exclusively focused on biological identity and written by experts in metaphysics, the philosophy of biology and biology. The resulting cross-disciplinary dialogue paves the way for a convincing account of biological identity that is both metaphysically constructive and scientifically informed, and will be of interest to metaphysicians, philosophers of biology and theoretical biologists. In an influential paper, L. A. Paul argues that one cannot rationally decide whether to have children. In particular, she argues that such a decision is intractable for standard decision theory. Paul's central argument in this paper rests on the claim that becoming a parent is ``epistemically transformative''---prior to becoming a parent, it is impossible to know what being a parent is like. Paul argues that because parenting is epistemically transformative, one cannot estimate the values of the various outcomes of (...) a decision whether to become a parent. In response, we argue that it is possible to estimate the value of epistemically transformative experiences. Therefore, there is no special difficulty involved in deciding whether to undergo epistemically transformative experiences. Insofar as major life decisions do pose a challenge to decision theory, we suggest that this is because they often involve separate, familiar problems. (shrink)

Alliant outils d'histoire intellectuelle et approche philosophique, cet ouvrage jette tout d'abord un éclairage nouveau sur le problème de l'historicisme du point de vue de sa dimension pratique et de son rapport avec la philosophie politique au cours des années 1930 de même que durant la période de l'après-guerre. L'approche novatrice du livre conjugue épistémologie de l'histoire et théorie politique et permet de mettre en contexte la mobilisation politique (...) et idéologique du concept d'historicisme et ses corollaires, le relativisme et le nihilisme. La seconde partie du manuscrit traite plus directement d'une question centrale en philosophie politique, celle des fondements de la rationalité politique. À partir d'une réflexion sur la réception de la philosophie des valeurs de Max Weber, l'ouvrage aborde la question des possibilités et limites du jugement politique en temps de crise. Ensuite, cet ouvrage examine une dimension peu étudiée des oeuvres respectives de Leo Strauss et Raymond Aron. D'un point de vue historiographique, le livre montre que la reconstruction du dialogue amorcé entre les deux penseurs (à partir de sources d'archives incluant correspondances, transcriptions de séminaires et textes inédits) permet de jeter une lumière nouvelle sur la façon dont on peut conceptualiser l'utilité de l'histoire pour la philosophie politique. Finalement, dans le champ disciplinaire de la philosophie politique contemporaine, la figure de Raymond Aron est souvent peu considérée. Human persons exist longer than a single moment in time; they persist through time. However, so far it has not been possible to make this natural and widespread assumption metaphysically comprehensible. The philosophical debate on personal identity is rather stuck in a dilemma: reductionist theories explain personal identity away, while non-reductionist theories fail to give any informative account at all. This chapter argues that this dilemma emerges from an underlying commitment, shared by both sides of in the debate, to an (...) ontology which that gives the priority to static unchanging things. The claim defended here is that the dilemma of personal identity can be overcome if we acknowledge the biological nature of human persons and switch to a process- ontological framework that takes process and change to be ontologically primary. Human persons are biological higher-order processes, rather than things, and their identity conditions can be scientifically investigated. (shrink)

In February 2020, the British Medical Association will be surveying members for their views on what the BMA’s position on physician-assisted dying should be. The BMA is currently opposed to physician-assisted dying in all its forms, a position that was agreed in 2006 at the annual representative meeting, the Association’s policy-making conference.1 As previously reported in Ethics briefing,2 the decision to survey members follows a motion passed at last year’s ARM which called on the BMA to “carry out a poll (...) of members to ascertain their views on whether the BMA should adopt a neutral position with respect to a change in the law on assisted dying”. The results from the survey will not determine BMA policy. Rather, the results be published ahead of this year’s ARM and provided to those attending to inform a debate and discussion on the BMA’s policy position. This paper aims to motivate a new beginning in metaphysical thinking about persistence by drawing attention to the disappearance of change in current accounts of persistence. I defend the claim that the debate is stuck in a dilemma which results from neglecting the constructive role of change for persistence. Neither of the two main competing views, perdurantism and endurantism, captures the idea of persistence as an identity through time. I identify the fundamental ontological reasons for this, namely the shared commitment (...) to what I call ‘thing ontology’: an ontology that gives the ontological priority to static things. I conclude by briefly indicating how switching to a process ontological framework that takes process and change to be ontologically primary may allow for overcoming the dilemma of persistence. This special issue addresses the debate on personal identity from a phenomenological viewpoint, especially contemporary phenomenological research on selfhood. In the introduction, we first offer a brief survey of the various classic questions related to personal identity according to Locke’s initial proposal and sketch out key concepts and distinctions of the debate that came after Locke. We then characterize the types of approach represented by post-Hegelian, German and French philosophies of the nineteenth and twentieth centuries. We argue that whereas the (...) Anglophone debates on personal identity were initially formed by the persistence question and the characterization question, the “Continental” tradition included remarkably intense debates on the individual or the self as being unique or “concrete,” deeply temporal and—as claimed by some philosophers, like Sartre and Foucault—unable to have any identity, if not one externally imposed. We describe the Continental line of thinking about the “self” as a reply and an adjustment to the post-Lockean “personal identity” question. These observations constitute the backdrop for our presentation of phenomenological approaches to personal identity. These approaches run along three lines: debates on the layers of the self, starting from embodiment and the minimal self and running all the way to the full-fledged concept of person; questions of temporal becoming, change and stability, as illustrated, for instance, by aging or transformative life-experiences; and the constitution of identity in the social, institutional, and normative space. The introduction thus establishes a structure for locating and connecting the different contributions in our special issue, which, as an ensemble, represent a strong and differentiated contribution to the debate on personal identity from a phenomenological perspective. Scholars agree that the environmental and societal impacts of consumption require greater attention, and need examining in more diverse market contexts. This editorial essay focuses on the nascent area of ethical/sustainable luxury, and critically considers how the scope of ethical/sustainable consumption can be broadened in the luxury sector. We address the compatibility of ethicality/sustainability and luxury by examining a range of opportunities and inherent tensions in relation to improving the ethical/sustainable consumption practices within the luxury sector. We also introduce several (...) original articles published as part of this Thematic Symposium, whose arguments underscore both the merits, and flaws, of ethical/sustainable luxury. On the basis of this and prior research, we present a balanced perspective by identifying various factors that facilitate or inhibit the acceptance and furtherance of ethicality/sustainability within sector. Thus, this essay serves as a springboard for further research and development in ethical/sustainable luxury whilst simultaneously highlighting the importance of the topic in general. (shrink)

Stephen Mumford has argued that dispositionalists ought to be endurantists because perdurantism, by breaking down persisting objects in sequences of static discrete existents, is at odds with a powers metaphysics. This has been contested by Neil Williams who offers his own version of ‘powerful’ perdurance where powers function as links between the temporal parts of persisting objects. Weighing up the arguments given by both sides, I show that the profile of ‘powerful’ persistence crucially depends on how one conceptualises the processes (...) involved in the manifestation of powers. As this turns out not to be determined per se by subscribing to some view labelled ‘powers view’, further discussion is needed as to what processes are and to what kind of process theory a powers metaphysics should commit itself in order to be convincing. I defend the claim that dispositionalism is best combined with a version of process ontology that is indeed incompatible with a perdurantist analysis of persistence. However, I argue that this does not imply that dispositionalists ought to be endurantists. (shrink)

Mathematical notation includes a vast array of signs. Most mathematical signs appear to be symbolic, in the sense that their meaning is arbitrarily related to their visual appearance. We explored the hypothesis that mathematical signs with iconic aspects—those which visually resemble in some way the concepts they represent—offer a cognitive advantage over those which are purely symbolic. An early formulation of this hypothesis was made by Christine Ladd in 1883 who suggested that symmetrical signs should be used to convey commutative (...) relations, because they visually resemble the mathematical concept they represent. Two controlled experiments provide the first empirical test of, and evidence for, Ladd's hypothesis. In Experiment 1 we find that participants are more likely to attribute commutativity to operations denoted by symmetric signs. In Experiment 2 we further show that using symmetric signs as notation for commutative operations can increase mathematical performance. (shrink)

ABSTRACT Refugees crossing the Mediterranean Sea in small boats has become a common sight in the media, particularly since the so-called ‘refugee crisis’ in 2015. The number of boats crossing the English Channel between the French and UK coasts has been increasing as other migration routes have been closed down. This article reports the findings of a discourse analysis of 96 UK newspaper articles published in December 2018 when the daily crossings were referred to as a ‘major crisis’. Adopting a (...) broadly critical discursive psychology perspective, we identify the use of three main interpretative repertoires used within the media reporting. Firstly, a ‘secure the borders’ repertoire which positions the UK’s borders as porous and easily breached, secondly, a ‘smuggling is immoral’ repertoire which works to position smugglers as to blame for the current ‘crisis’ and removes responsibility for the crisis from the Government, and finally, a ‘desperate people’ repertoire which worked to position the refugees themselves as vulnerable and in need of protection, but also as people who will engage in risky behaviours. We suggest that the use of these repertoires ultimately functions to obscure the need for safe and legal migration routes to the UK. (shrink)

What are persons and how do they exist? The predominant answer to this question in Western metaphysics is that persons, human and others, are, and exist as, substances, i.e., ontologically independent, well-demarcated things defined by an immutable (usually mental) essence. Change, on this view, is not essential for a person's identity; it is in fact more likely to be detrimental to it. In this chapter I want to suggest an alternative view of human persons which is motivated by an appreciation (...) of their biological nature. Organisms, human and non-human, are dynamical systems that for their existence and persistence depend on an ongoing interaction with the environment in which they are embedded. Taking seriously this most fundamental human condition leads to recognising human persons as processes, i.e., as entities for the identity of which change is essential. On 8 October 2020, the British Medical Association published the results of its survey of BMA members on physician-assisted dying. With 28 986 respondents, this was one of the largest surveys of medical opinion on this topic ever carried out. This represents 19.35% of those who received an invitation to participate and the respondents were broadly representative of the BMA’s overall membership. The BMA was clear throughout this process that the results of the survey would not determine its policy. Its (...) current policy of opposition to all forms of physician-assisted dying would remain unless and until the Representative Body, which makes BMA policy, decided otherwise. The survey results would, however, inform a future debate on policy, currently scheduled to take place in June 2021. When asked what the BMA’s position should be on whether there should be a change in the law to allow doctors to prescribe drugs for an eligible patient to self-administer to end their own life, 40% said the BMA should be supportive, 33% opposed, 21% thought the BMA should be neutral and 6% were undecided. In relation to their own personal views, 50% were supportive, 39% opposed and 11% undecided. When asked whether they would be willing to participate in some way in the process, if it were to be legalised, 36% said yes, 45% said no and 19% were undecided. The same three questions were asked about a change in the law to allow doctors to administer drugs to end the life of an eligible patient. In response, 40% thought the BMA should oppose such a change, 30% thought the BMA should be supportive and 23% thought the BMA should be neutral; 7% of members responding were undecided on this question. This event-related potential (ERP) study examined the impact of phonological variation resulting from a vowel merger on phoneme perception. The perception of the /e/–/ε/ contrast which does not exist in Southern French-speaking regions, and which is in the process of merging in Northern French-speaking regions, was compared to the /ø/–/y/ contrast, which is stable in all French-speaking regions. French-speaking participants from Switzerland for whom the /e/–/ε/ contrast is preserved, but who are exposed to different regional variants, had to perform a (...) same-different task. They first heard four phonemically identical but acoustically different syllables (e.g., /be/–/be/–/be/–/be/), and then heard the test syllable which was either phonemically identical to (/be/) or phonemically different from (/bε/) the preceding context stimuli. The results showed that the unstable /e/–/ε/ contrast only induced a mismatch negativity (MMN), whereas the /ø/–/y/ contrast elicited both a MMN and electrophysiological differences on the P200. These findings were in line with the behavioral results in which responses were slower and more error-prone in the /e/–/ε/ deviant condition than in the /ø/–/y/ deviant condition. Together these findings suggest that the regional variability in the speech input to which listeners are exposed affects the perception of speech sounds in their own accent. (shrink)

During the first UK wave of the pandemic, there were two areas of immediate ethical concern for the medical profession. The first was the possibility that life-saving resources could be overwhelmed. Early reports from hospitals in the Italian city of Bergamo suggested that ventilatory support might need rationing and emergency ‘battlefield’ triage was a real possibility.1 In the UK, several professional bodies, including the British Medical Association and the Royal College of Physicians rapidly developed guidance for doctors should triage become (...) a reality.2 The second issue was the acute shortage of personal protective equipment. Where doctors were unable to protect their patients – and themselves – from the risk of COVID-19, ethical challenges emerged. Ordinarily, doctors and patients do not present risks of significant harm to each other. To shift to a position where every patient – and every health professional – could potentially be a threat presented serious clinical and ethical challenges. To treat with inadequate PPE, so options for mitigating harms are radically reduced, deepens the challenges. Among the questions the BMA wrestled with was the extent of doctors’ duties to treat infected or potentially infected patients in the absence of effective PPE. The BMA was clear that despite obligations to treat, medicine is not a self-sacrificing profession: there were limits to the risk doctors could be required to expose themselves to.3 These issues no longer seem so pressing. In the UK at least, there is adequate PPE and with the second steep wave behind us, and significant numbers vaccinated, it is less likely that triage will be required in the UK. Within the philosophy of biology, recently promising steps have been made towards a biologically grounded concept of agency. Agency is described as bio-agency: the intrinsically normative adaptive behaviour of human and non-human organisms, arising from their biological autonomy. My paper assesses the bio-agency approach by examining criticism recently directed by its proponents against the project of embodied robotics. Defenders of the bio-agency approach have claimed that embodied robots do not, and for fundamental reasons cannot, qualify as artificial agents because they (...) do not fully realise biological autonomy. More particularly, it has been claimed that embodied robots fail to be agents because agency essentially requires metabolism. I shall argue that this criticism, while being valuable in bringing to the fore important differences between bio-agents and existing embodied robots, nevertheless is too strong. It relies on inferences from agency-as-we-know-it to agency-as-it-could-be which are justified neither empirically nor conceptually. (shrink)

In this monograph, I systematically analyse the debate in recent analytic metaphysics, with a special focus on recent biologically inspired (so-called animalist) theories of personal identity. I argue that the debate is stuck in a dilemma which is neither harmless nor new: the modern antagonism between the reductionist elimination of personal identity on the one hand and its non-reductionist mystification on the other rather repeats the antagonism between rationalist dogmatism and empirical scepticism in the 18th century’s debates on the soul. (...) This latter antagonism has been extensively examined by Kant who also sought for ways to overcome the dilemma. The systematic analysis of the modern ‘analytic’ debate is therefore followed by a presentation and critical discussion of the constructive approaches taken by Kant and post-Kantian ‘continental’ philosophers. From a Kantian perspective, what we are confronted with is a fundamental dialectic, originating in the very structure of human reason and threatening to turn metaphysics altogether into an arena of fruitless battles. The possibility of a satisfactory metaphysical account of transtemporal personal identity reveals itself to be contingent on the possibility of a ‘good’ metaphysics able to overcome that dialectic. According to dispositional realism, or dispositionalism, the entities inhabiting our world possess irreducibly dispositional properties – often called ‘powers’ – by means of which they are sources of change. Dispositionalism has become increasingly popular among metaphysicians in the last three decades as it offers a realist account of causation and provides novel avenues for understanding modality, laws of nature, agency, free will and other key concepts in metaphysics. At the same time, dispositionalism is receiving growing interest among philosophers of science. (...) This reflects the substantial role scientific findings play in arguments for dispositionalism which, as a metaphysics of science, aims to elucidate the very foundations of science. In this introductory chapter, I give an overview of the state of the debate and explain the twofold aim of the present collection of essays which is (i) to explore the ontological commitments of dispositionalism and (ii) to discuss these against the background of latest scientific research, by bringing together perspectives from both metaphysics and the philosophy of science. I finally provide a summary of this intellectual journey. (shrink)

After describing the three European strategies focused on social control, this essay will first demonstrate that the first two strategies try less to protect societies than to enforce efficient tools of governance. Additionally, they reinforce stereotypes harming Muslim immigrants. I show that diverse approaches in policing can make a difference in the communities where police forces operate. The third strategy, that of prevention requiring the cooperation of the citizens, may be more sustainable in the long term as it facilitates communication (...) among local politicians and involved actors. ObjectiveFreezing of gait is detrimental to patients with idiopathic Parkinson’s disease. Its pathophysiology represents a multilevel failure of motor processing in the cortical, subcortical, and brainstem circuits, ultimately resulting in ineffective motor output of the spinal pattern generator. Electrophysiological studies pointed to abnormalities of oscillatory activity in freezers that covered a broad frequency range including the theta, alpha, and beta bands. We explored muscular frequency domain activity with respect to freezing, and used deep brain stimulation to modulate these rhythms thereby (...) evaluating the supraspinal contributions to spinal motor neuron activity.MethodsWe analyzed 9 PD freezers and 16 healthy controls. We studied the patients after overnight withdrawal of dopaminergic medication with stimulation off, stimulation of the subthalamic nucleus or the substantia nigra pars reticulate, respectively. Patients performed a walking paradigm passing a narrow obstacle. We analyzed the frequency-domain spectra of the tibialis anterior and gastrocnemius muscles in ‘regular gait’ and during the ‘freezing’ episodes.ResultsIn stimulation off, PD freezers showed increased muscle activity of the alpha and low-beta band compared to HC in both TA and GA. This activity increase was present during straight walking and during the freezes to similar extent. STN- but not SNr-DBS decreased this activity and paralleled the clinical improvement of freezing.ConclusionWe found increased muscle activation of the alpha and lower beta band in PD freezers compared to HC, and this was attenuated with STN-DBS. Future studies may use combined recordings of local field potentials, electroencephalography, and electromyography to interrogate the supraspinal circuit mechanisms of the pathological activation pattern of the spinal pattern generator. On 7 April 2022 – coinciding with World Health Day – the British Medical Association launched its new report, Health and human rights in the new world order.1 Written during the global upheaval triggered by the COVID-19 pandemic, and published just weeks after the Russian invasion of Ukraine, the report responds to a range of emerging and intensifying threats to health-related human rights globally. As the report establishes, human rights in health and healthcare matter because human suffering, and its relief, (...) are fundamental moral issues. As relief of human suffering is the primary purpose of medicine, it follows that doctors and other health professionals are often active in times of human challenge and extremity. During conflict, humanitarian crises, and, as we have so recently seen, global public health emergencies, health professionals are essential to the response. But these crises – and the response to them – can put fundamental human rights and interests under pressure. The Russian invasion of Ukraine has seen sustained indiscriminate shelling of civilian infrastructure. Whether health facilities were directly targeted is moot – the indiscriminate nature of the assault means they will inevitably be hit. Not only is this a violation of the Geneva Conventions, it undermines fundamental human rights, not least of which the right to health. Destroying health infrastructure drives further suffering and delays post-conflict recovery. Public heath emergencies can rightly require draconian measures – social distancing, enforced isolation, location tracking, economic shutdown. Although we saw their necessity during the COVID-19 outbreak, concerns were raised about disproportionate restrictions on basic rights, including rights to privacy and liberty. Human Rights Watch drew attention to the way governments unlawfully exploited COVID-19 to crack down on fundamental rights.2 Although conflicts and public health emergencies are not new, the report also tracks a number of …. In this paper, I analyse the central ontological premise of this new approach and show that any hopes of rehabilitating in dispositionalist terms the idea of a potential to personhood inherent in human embryos are mistaken. The dispositionalist version of the potentiality argument navigates in (...) same metaphysical waters as its predecessor and, hence, collides just the same with biological facts concerning human embryogenesis. Several researchers point to disorganized attachment as a core feature of borderline personality disorder (BPD). However, recent studies suggest that specific internal working models (IWMs) of each parent combine to account for child outcomes and that a secure relationship with one parent can protect against the deleterious effects of an insecure relationship with the other parent. It was thus hypothesized that adolescents with BPD are more likely to be disorganized with both their parents, whereas non-clinical controls are more secure with (...) at least one of their caregivers. Thirty-six adolescents with BPD and 30 control participants (aged 13-19) were included. Psychiatrist diagnosis was verified with the SIDP-IV and comorbidity was assessed using the Kiddie-SADS. Reported trauma was assessed with the Childhood Trauma Questionnaire. Attachment IWMs of each parent were assessed with the Attachment Multiple Model Interview (AMMI), which enables separate coding for each attachment figure and in which disorganization is conceptualized as conflicting attachment strategies within a specific relationship. Results of a logistic regression analysis suggested that beyond insecure attachment, being disorganized not just with one but with both parents is particularly characteristic of adolescents with BPD. Conversely, belonging to the non-clinical group was predicted by higher security scores with the father and lower deactivation with the mother. Although higher levels of childhood abuse or neglect were reported by adolescents with BPD, the retained attachment dimensions predicted group membership over and above reported trauma. These findings have important implications for clinical intervention and highlight the protective role fathers may have. (shrink)

Elle lui propose un éventail d’analyses représentatives des différentes conceptions de la linguistique juridique ou jurilinguistique comme la dénomme nos collègues canadiens. Elle est dédiée au Doyen Cornu, qui fut, comme l’indique le Professeur Beauchard dans son hommage, une des personnalités juridiques les plus reconnues en France pour ses travaux dans le domaine de la langue et (...) du droit. Les articles sélectionnés dégagent l’essentiel de la linguistique juridique: ils soulignent certains aspects de recherches déjà avancées (Gémar, Goltzeberg) et d’autres débats encore peu explorés (Mattila, Lenoble-Pinson), permettant ainsi au lecteur de situer les enjeux actuels de la linguistique juridique tout en lui révélant les perspectives à venir. The aim of the 2008 Roundtable was to focus on the progress to date in the many facets—methodological, epistemological and conceptual—of the field of legal semiotics, specifically the contribution of different schools and forms of semiotics as well as emerging and emergent semiotics approaches which can be used in researching and interpreting law and legal phenomena. The participants sought primarily to engage with the epistemological and methodological challenges which the field currently faces and to discuss the implications of these.

Recent decades have seen an increasing tendency to exclude the phenomenon of personality from the metaphysical investigation of personal identity. We are advised not to confuse personal identity as a philosophical subject, namely as the metaphysical issue of specifying what it is that makes a person staying numerically self-identical over time, with the psychological question of 'personal identity' which asks what makes someone the individual person they are with their particular character and history. However, one might be unsatisfied with this. (...) If (as common sense takes for granted) persons are to be conceived as beings possessing a personality, should there not be some more than superficial connection between personality and personal identity in the philosophical sense? This paper investigates this question by revealing the guiding - metaphysical assumptions behind the claim that personality and personal identity must be treated separately as well as by presenting the metaphysical alternative brushed aside by the adherents of this claim. In fact, I argue, there are two opposing views of the relation between personality and personal identity, these being grounded in two opposing metaphysical models of what a person is: the substance model and the bundle model of the person. However, it turns out that ultimately both competing models fail for fundamental reasons, which raises the question of what a way out of the dilemma might look like. (shrink)

Solidarität ist einer der zentralen normativen Begriffe in Zeiten der Corona-Pandemie. Vor dem Hintergrund der philosophischen Debatte um Solidarität wird eine Heuristik entlang der Unterscheidung einer sozial-, politisch-philosophischen und ethischen Perspektive vorgeschlagen. Anhand dieser Heuristik wird der gegenwärtige gesellschaftliche Diskurs um Solidarität in der Pandemie rekonstruiert, analysiert und kritisiert. Solidarität, so die These, wird in Corona-Zeiten auf ihre soziale Dimension enggeführt, was einerseits zur Mobilisierung von Gemeinschaften und der Eindämmung der Pandemie führt, andererseits aber auch zu Schließungen und Exklusionen nach (...) innen und außen. Indem Politik als evidenzbasierte und alternativlose Technik etabliert wird, vollzieht sich eine fortschreitende Entpolitisierung, durch die soziale Ungleichheit sowohl lokal als auch global oft unhinterfragt reproduziert wird. Demgegenüber diskutiert der Beitrag mit Rückgriff auf Arendts Begriff des Politischen ein alternatives Verständnis von Solidarität in Zeiten der Pandemie. Dieses baut auf sozialer Relationalität auf und kritisiert eine mechanistische Logik des Politischen. Mit Arendt werden die Pluralität, das kritische Denken und der Neuanfang als zentrale Elemente des Politischen angesichts von Krisen betont. Dadurch wird das Konzept der Solidarität um eine politische Dimension erweitert und ein produktiver Umgang mit den gegenwärtigen Schließungen und Exklusionen in der Corona-Pandemie vorgeschlagen. Schließlich können die durch die Pandemie offenkundiger gewordenen Krisen des Kapitalismus und Liberalismus reflektiert und das Politische als ein offen-diskursiver Raum jenseits eng gefasster Grenzen neu gedacht werden. Cultural heritage can offer tangible and intangible traces of the past. A past that shapes cultural identity, but also a past from which one sometimes wishes to detach oneself and which nevertheless needs to be remembered, even commemorated. These themes of memory, history and oblivion are examined by the philosopher Paul Ricoeur in his work La mémoire, l’histoire, l’oubli. Inspired by these ideas, this paper analyses how they are closely linked to cultural heritage. Heritage serves as a support for memory, (...) even if it can be mishandled, which in turn can affect heritage policies. Memory and heritage can be abused as a result of wounds from the past or for reasons of ideological manipulation or because of a political will to force people to remember. Furthermore, heritage, as a vehicule of memory, contributes to historical knowledge, but can remain marked by a certain form of subjectivism during the heritage and conservation operation, for which heritage professionals are responsible. Yet, the responsibility for conserving cultural heritage also implies the need to avoid any loss of heritage, and to fight against oblivion. Nonetheless, this struggle cannot become totalitarian, nor can it deprive the community of a sometimes salutary oblivion to its own identity construction. These theoretical and philosophical concepts shall be examined in the light of legal discourse, and in particular in Belgian legislation regarding cultural heritage. It is clear that the shift from monument to heritage broadens the legal scope and consequently raises the question of who gets to decide what is considered heritage according to the law, and whether there is something such as a collective human right to cultural heritage. Nonetheless, this broadening of the legislation extends the State intervention into cultural heritage, which in turn entails certain risks, as will be analysed with Belgium’s colonial heritage. Freud, Winnicott, Meltzer et d’autres auteurs après Romain Rolland, inspirés par les pathologies précoces apparentées à l’autisme permettent un aperçu des liens entre ces expériences vécues et un mode psychique premier du « croire » marqué par son absence de limites.

This article focuses on Eurimages, the Council of Europe fund for the co-production, distribution and exhibition of European films. The core investigation of this paper relates to the benefits this public fund has had for the European film sector. Reflecting on the fund's twenty-year existence, what output has been realized, both in economic and cultural terms? Turning to the future, what are the fund's prospects now that the sector is facing the technological challenge of digitization? In order to evaluate the (...) performance of the fund, the author takes a closer look at the economic, cultural and technologically innovative results achieved by Eurimages and relates these to the objectives that were set at its establishment. This evaluation is carried out by using statistical data as well as insights gained from policy documents, literature and expert interviews. (shrink)
