Work requirements are the centerpiece of HHS's Trump Administration strategy to undo the ACA expansion for low income working age adults. This article examines the June 29, 2018 trial court opinion in Stewart v. Azar which held that HHS's approval of Kentucky's Section 1115 work demonstration was “arbitrary and capricious.” The purpose of Medicaid is to provide health coverage and HHS may not ignore the loss of coverage that will result from a work requirement.

The theme of this paper is that people in Northeast Brazil refuse to let a good person who helped them during his (or her) lifetime die. They do this through several of the religious traditions practiced in the region. Beings, human and other, now in another plane of reality established in modern thinking, cross the conceptual divide and return through mediums or other intermediaries to heal the living. We examine two religious traditions, “folk” or “popular” Catholicism and Kardecist‐Spiritism, focusing on (...) the spirit of Argeu Hebster, a medical doctor who lived in the municipality of Marangaupe in the state of Ceará until his death in 1977. The return of the doctor is told in stories told to the authors while doing ethnography that provide the data used in analyzing the enchanted worlds of the two religions. (shrink)

The French historian Auguste Bouché-Leclercq made major contributions to our knowledge of the Hellenistic period. A member of the Académie des Inscriptions et Belles-Lettres, he was also made an officer of the Légion d'Honneur. Bouché-Leclercq is also considered the first modern historian of astrology: he had developed a long-lasting interest in divination during his extensive researches on ancient Greek civilisation. This field had not been considered worthy of serious scholarly study until he published his Histoire de la divination (...) dans l'antiquité between 1879 and 1882. L'Astrologie grecque, first published in 1899, is another important work, still referred to today. Bouché-Leclercq looks back to the oriental roots of Greek astrology. He delves into the specific influence of the zodiac signs, and explains how the celestial sphere was divided in order to draw horoscopes. Other topics include astrology in Roman culture, as well as astrological medicine. (shrink)

According to the deductivist view of mathematics which became the rule during the nineteenth century, formal proofs working with symbolic formulas replaced the intuitive knowledge that used to be gained by the step-by-step construction of geometric fgures and diagrams. Twentieth century epistemological refection on symbolic formulas and formal proofs, however, took them to be diagrams respectively exhibiting formal relations and transformations. The claim was also made that, for such diagrams to be proofs, temporal displays of transformations—and of other speech acts—were (...) required. By returning to the signifcant elements of contemporary theories of mathematical proofs, we will here show how these proofs came to be a matter for semiotics and pragmatics as much as for formal logic. Once this is done, we will provide a few arguments against the standard objections to the ability of diagrams to present temporal order or perform speech acts. (shrink)

From peasants and communists in 1960s Italy, to movements and politics in contemporary western polities, to the global justice movement in the new century, the book argues that contentious actors are neither outside of nor completely within politics, but rather they occupy the uncertain territory between total opposition and integration into policy. ABSTRACTAdults use a variety of strategies to reason about fraction magnitudes, and this variability is adaptive. In two studies, we examined the relationships between mathematics anxiety, working memory, strategy variability and performance on two fraction tasks: fraction magnitude comparison and estimation. Adults with higher mathematics anxiety had lower accuracy on the comparison task and greater percentage absolute error on the estimation task. Unexpectedly, mathematics anxiety was not related to variable strategy use. However, variable strategy use was linked to more accurate (...) magnitude comparisons, especially among adults with lower working memory performance or those who use mathematics less frequently, as well as lower PAE on the estimation task. These findings shed light on the role of strategy variability in fraction problem solving and demonstrate a link between mathematics anxiety and fraction magnitude reasoning, a key predictor of general mathematics achievement. Health care reform that includes universal coverage could lower a major barrier to care for people of color and ethnic minorities—the inability to pay for care. But universal coverage alone, even with comparable fee-for-service payment or appropriately risk-adjusted capitated reimbursement, will not eradicate the racial and ethnic inequities in health care delivery. Restrictive admissions practices, geographic inaccessibility, culture, racial stereotypes, and the failure to employ minority health care professionals will still create barriers to minority health care. In addition to universal (...) financing, health care reform should include new civil rights legislation to address and reduce these noneconomic barriers to minority health care. (shrink)

Du fait de sa formation de philosophe, de ses incursions en anthropologie et en linguistique, de son souci constant d'analyser la dimension historique des faits sociaux, de son regard critique sur la science politique et le droit, de ses emprunts au vocabulaire économique, ainsi que de son intérêt marqué pour l'art et la littérature, Bourdieu n'a cessé de dialoguer mais aussi parfois de (...) "ferrailler" avec différentes disciplines des sciences sociales. Cet ouvrage collectif rend compte de manière inédite de l'étendue des réceptions et appropriations des travaux de Pierre Bourdieu dans les diverses sciences sociales. Il propose un éclairage original sur les usages du travail de Bourdieu en sociologie, anthropologie, histoire, philosophie, science politique, économie, droit, études littéraires et sciences de l'information et de la communication. A la fin du XVIIIe siècle, Emmanuel Kant pouvait encore voir dans les mathématiques le modèle même des jugements synthétiques a priori, c'est-à-dire dotés d'un contenu intuitif propre quoique non dérivé de l'expérience sensible. Des géométries non-euclidiennes à la théorie des transfinis de Cantor, les mathématiques du XIXe siècle vont cependant faire triompher des systèmes mathématiques résolument déductifs et non plus intuitifs. Sur fond d'interrogations quant à la légitimité de ces développements récents, interrogations renforcées par la découverte de paradoxes, d'âpres (...) débats vont alors opposer différentes écoles quant aux méthodes de preuve acceptables ainsi que quant à ce qui constitue le fondement même du savoir mathématique. Logicisme, formalisme et intuitionnisme ; ce sont, à l'époque, pas moins de trois conceptions des mathématiques (et trois programmes pour les mathématiques) qui s'affrontent, conceptions auxquelles il faut ajouter le psychologisme, qui se nourrit de l'essor des sciences humaines et de leurs prétentions épistémologiques. En collant au plus près des textes des principaux protagonistes, l'ouvrage présente de manière tout à la fois synthétique et précise les différentes positions en présence, en soulignant autant que possible leurs divergences, mais en montrant aussi les variations et inflexions qui ont marqué leur développement durant la période 1870-1930. C’est sans doute en estimant que « l’histoire de l’existence du Christ a un sens phénoménologique fondamental » que Michel Henry cautionne son projet de travail sur le christianisme. Cette dimension de son œuvre constitue sans doute une crux interpretandi pour les spécialistes et l’on sait combien elle peut les gêner. De fait, les interrogations sont nombreuses : quand Henry parle du christianisme, est-il resté phénoménologue, s’agit-il même tout simplement encore d’une philosophie et, corollairement, est-il justifiable au gré des œuvres (...) de la Raison de penser de la sorte les rapports historiques complexes entre ce que nous disons être le philosophique et le théologique? Ce sont ces questions qu’il faut au moins poser sereinement dans le cadre de ce travail d’édition des notes préparatoires que nous proposons ici et où il est évident que s’y cherche un support de réflexion sur cet « autre » du langage dont Henry cherche ultimement à comprendre la provenance. Franz Xaver Kappus foi um aspirante à poeta que pediu conselhos e sugestões ao renomado escritor Rainer Maria Rilke. Estes pedidos se deram por meio de cartas ao qual Kappus não recebe nenhuma sugestão quanto à estilística, métrica ou composição de poemas, mas sim, vários conselhos na perspectiva de construção de uma obra através das experiências mais singelas da vida. Após o falecimento de Rilke a coleção destas epistolas direcionadas a Kappus foi compilada em um livro, com o sugestivo nome (...) de “Cartas a um Jovem Poeta”. Desde então tem servido para muitos leitores como um livro basal ao entendimento pessoal, que versa sobre o pertencimento e de qual é o nosso lugar de atuação no mundo. Essa comunicação tange ao conteúdo dessas cartas, de que cunho são tais conselhos e o fundo filosófico que estes contém; com isso realiza-se uma analise desta emblemática obra do século XX. (shrink)

Mi meta en este trabajo es proponer un nuevo tipo de argumento en defensa del ideal deliberativo de reciprocidad de justificación —que fue inicialmente introducido por el liberalismo político de John Rawls—. Dicho argumento aspira a demostrar que, aun cuando aceptemos la hipótesis de que un grupo de ciudadanos dispone de una justificación pública apropiada para creer que determinada doctrina comprehensiva es verdadera o correcta, existen razones morales fundamentales para rechazar la pretensión de que el estado pueda estar justificado para (...) actuar sobre la base de esas creencias cuando las esencias constitucionales o cuestiones de justicia básica se encuentran en juego. As of the time of writing of this paper (January 2023), Russia’s invasion of Ukraine has caused a European refugee crisis, death and displacement of countless Ukrainians, worldwide food shortage, fuel crisis and inflation. By comparing the Ukrainian example and the book of Ruth, this paper demonstrates that the effects of forced migration, food shortage and arrested economic productivity are tilted against women. This results in sudden stati of family headship and breadwinner, inability to provide meals for or stabilise the (...) family, and difficulty in attempting to re-establish a livelihood due to the double burden of care. The methodology of the paper is qualitative and gendered. In its interpretation of the biblical text, it is also allegorical and literary while for gathering the Ukrainian data, it is textual. One of the key findings of the study is that during displacement and crisis, women, unlike their male counterparts, tend to carry the family with them wherever they go, which means that women bear the greater burdens of these variables by far. The discussions in the sections of the paper merge the gendered situations, mindsets and events of the book of Ruth with those of the Ukrainian context.Contribution: Using the examples of the Russo Ukrainian war and the character of the biblical book of Ruth, this article examines the effects of displacement, food crisis and arrested economic production on women. This topic is aligned with the journal’s focus on religion, gender equality and environmental preservation, all of which fall within the journal’s scope. (shrink)

El presente artículo propone algunas objeciones contra la concepción deliberativa de la democracia desarrollada por Carlos Nino. El blanco central de las objeciones es la tesis del filósofo argentino según la cual el valor del debate democrático derivaría, fundamentalmente, de sus virtudes epistémicas, es decir, de su capacidad para elevar las probabilidades de que el sistema político tome las decisiones correctas. Se cuestiona el modo en que el autor presenta su propuesta como una forma de superar las deficiencias que presentarían (...) las concepciones de John Rawls y Jürgen Habermas en el campo de la epistemología moral. Se intentará demostrar que el modelo de deliberación defendido por Nino no resulta aplicable a un contexto de pluralismo razonable filosófico, religioso y moral como el que resulta característico de las democracias liberales contemporáneas. Por último, se ofrece el esbozo de una concepción alternativa, práctica y moral, no epistémica, del valor de los procedimientos democráticos y de la naturaleza de la legitimidad política. This paper posits some objections against the deliberative conception of democracy developed by Carlos Nino. According to Nino, the value of democratic deliberation lies, basically, in its epistemic virtues. Public deliberation increases the probability that the political system will arrive at the correct decisions. We shall argue that the Argentinean philosopher fails to prove that his proposal is a solution to purported weaknesses in John Rawls’ and Jürgen Habermas’ positions in the field of moral epistemology. We shall try to demonstrate that the conception of deliberation posited by nino cannot be applied successfully in the context of moral, philosophical or religious reasonable pluralism that characterizes liberal contemporary democracies. Finally, we offer an outline of an alternative conception -practical and moral, non epistemic- of the value of democratic procedures and about the nature of political legitimacy. (shrink)

La meta del presente artículo es probar que existen contextos de acción en los que tiene lugar una escisión entre el conocimiento moral de los sujetos y la justificación, también moral, de sus acciones. Para que ello ocurra, según sostendremos, deben darse al menos dos condiciones: el costo de actuar sobre la base de creencias falsas debe ser muy elevado para el bienestar de los afectados y la probabilidad de que tal resultado se produzca efectivamente, aunque baja, debe ser significativa (...) o no trivial. Sostendremos que la escisión entre conocimiento y justificación de la acción referida tiene importantes consecuencias para la estructura de la deliberación moral. This paper is aimed at proving that in certain contexts of action there may be a cleavage between the moral knowledge of an agent and the moral justification of her actions. I will argue that this is so when two conditions obtain: first, acting on the basis of false beliefs may end-up being very costly in terms of the welfare of those affected; and second, even if low, the probability of such negative upshots are significant or not trivial. I shall claim that this cleavage between knowledge and justification of actions has important consequences for the structure of moral deliberation. (shrink)

Not long after the completion of Michael Mann’s “quadrilogy” on The Sources of Social Power (1986–2012), social scientists began to interrogate the meaning of his concepts of “despotic” and “infrastructural” power. While we know that the former is the most evident sign of danger in times of war, less well understood is the role of infrastructural power in state/civil society relations. Most important is the ambiguous relationship between the two types of power and the possibility that—especially in times of war—infrastructural (...) power can become the vehicle for despotic ends. But infrastructural power is also reciprocal, offering firms and civil society groups channels with which to contest the state’s projects. In this article, I first explicate the different meanings that Mann gave to his concept of infrastructural power. In the second section, I turn to how the concept has been “received” in political science and historical sociology. In the third part, I argue that the main danger to American democracy in wartime lies not in its becoming a despotic state, but in the use of the state’s infrastructural channels for the exercise of despotic ends. The fourth part illustrates the complexities of infrastructural power in business/government/civil society relations in cybersecurity, which Mann—for understandable reasons—did not examine in his encompassing work. The New Transnational Activism shows how even the most prosaic activities can assume broader political meanings when they provide ordinary people with the experience of crossing transnational space. This means that we cannot be satisfied with defining transnational activists through the ways they think. The defining feature of transnationalism in this book is relational, and not cognitive. This emphasis on activism's relational structure means that even as they make transnational claims, transnational activists draw on the resources, the networks, and the (...) opportunities in which they are embedded, and only then - if at all - on more distant transnational links. But we can no more sharply draw a line between domestic and international politics in studying transnational activism than we could ignore local politics in studying its national equivalent. Understanding the processes that link the local, the national and the international is the major undertaking of the book. (shrink)

El debate entre liberalismo y perfeccionismo ha sido uno de los ejes centrales de la Filosofía política durante los últimos veinte años. Este libro aspira a analizar críticamente y, en última instancia, a ofrecer una defensa del núcleo conceptual de la posicíon liberal. A lo largo del trabajo, se examina y discute una amplia serie de argumentos propuestos por filósofos contemporáneos "Rawls, Larmore, Barry, Kymlicka, Nagel y Ackerman, entre otros" en defensa de la neutralidad estatal. A su vez, se desarrollan (...) dos líneas de argumentacíon en defensa de las posiciones liberales que pretenden superar las falencias analizadas a lo largo del libro. La meta del primer argumento es demostrar que quien acepte las ideas fundamentales de la cultura política de las democracias contemporáneas deberá aceptar también las ideas básicas del liberalismo. Su punto de partida es una formulacíon del ideal ético-político de igual respeto por las personas y una reinterpretacíon y ampliacíon de lo que Rawls ha denominado las "cargas del juicio". El segundo argumento toma como punto de partida una idea arraigada en la tradicíon de pensamiento liberal: la necesidad de reconocer la falibilidad humana y sus consecuencias políticas y morales. El argumento combina la apelacíon a una premisa falibilista con una distincíon entre razones para afirmar una creencia y razones para estar justificado a actuar a partir de ella en contextos en los que cometer un error acarrearía un daño grave a terceros. Sobre esta base, se señala una serie de ventajas de las políticas que satisfacen los requisitos de justificacíon neutrales frente a las políticas perfeccionistas. (shrink)
