This article explores areas of law loosely within English equity and trusts law that have not conventionally been subject to feminist debate, and within the context of a discussion about feminist method. The particular areas examined are whistleblowing and trustees’ powers of investment, each of which calls for consideration of decision-making processes which have an ethical content. These sites are chosen because they take debate outside the all too familiar locations of woman or ‘the body of woman’, including the family (...) home, where feminist analysis in relation to equity and trusts tends to stray. In exploring these chosen fields, Hobby’s (Feminist Perspectives on Equity and Trusts, Cavendish Publishing, 2001, pp. 219–255) critique of gender dimensions in relation to whistleblowing and Dunn’s (Feminist Perspectives on Equity and Trusts, Cavendish Publishing, 2001, pp. 179–196) account of women trustees’ investment decisions are evaluated and developed. The debate within feminist legal criticism of the possibility of integrating an ‘ethics of care’ and an ‘ethics of rights’ is acknowledged. Whilst acknowledging of the difficulty of adopting an approach that recognises ‘mixed logics’, it is concluded that women (and men) do integrate the ethics of care and the ethics of rights in their decision-making. It is argued that the effort should be made to trace the specific weave in particular circumstances, thereby paying suspicious attention to the values that underlie courts’ analyses of ethical choices. This study examines ethics-related learning outcomes that emerged from an experience-based project in a personal selling and sales management course. Using qualitative research methods, we classified students’ experiences according to domains of ethical issues associated with personal selling and according to conceptualizations of learning identified in the education literature. Patterns we observed in our data suggest that the experience-based project encouraged learners to employ higher-order thinking about business ethics. Higher order problem-solving about ethical issues helps ensure that lessons students learn (...) about ethical decision making carry forward to their professional careers. Based on our findings, we recommend ways instructors can formulate ethics-related learning objectives, develop learning assessments that measure ethics-related learning outcomes, and design teaching and learning activities that help ensure students learn ethical concepts in a way that will carry forward to their careers. Ethical sensitivity triggers the entire ethical decision-making process (i.e., recognition of ethical content in work situations). In this article, five factors are examined that affect tax practitioners' professional ethical sensitivity. The five factors that were examined include role conflict, role ambiguity, job satisfaction, professional commitment, and ethical orientation. Ethical content in work situations is examined in relation to professional ethics as enumerated by the American Institute of Certified Public Accountant's (AICPA) Statements on Responsibilities in Tax Practice (SRTP). Utilizing Hunt and (...) Vitell's (1986, 1993) General Theory of Ethics, a model of ethical sensitivity was constructed and empirically tested. Role conflict negatively and job satisfaction positively influenced tax practitioners' ethical sensitivity. Also, the covariates of the tax practitioner's professional risk level and type of employer were found to be significant. The significant factors are job specific. The tax firm may have the best opportunity to positively change a tax practitioner's ethical recognition abilities. Professional accounting organizations may need to evaluate if resources should be used to formulate, maintain, and publicize codes of conduct because of the lack of significance of professional commitment. Global poverty measurement is important. It is used to allocate scarce resources, evaluate progress, and assess existing projects, policies, and institutional designs. But given the diversity of ways in which poverty is conceived, how can we settle on a conception and measure that can be used for interpersonal and inter-temporal global comparison? -/- This book lays out the key contemporary debates in poverty measurement, and provides a new analytical framework for thinking about poverty conception and measurement. Rather than trying to (...) find some essential meaning of poverty, the author recommends explicitly reflecting on the purposes served by the concept and the values that do and should inform our conceptions and measures. -/- After reviewing the strengths and weaknesses of five competing conceptions of poverty and their corresponding measures, the book concludes with specific recommendations for the future. Poverty measurement should be developed through a process of public reason that gives weight to the voices of those individuals who are most marginalized and deprived. In “Unity of Action in a Latin Social Model of the Trinity,” I objected to William Hasker’s Social Model of the Trinity (among others) on the grounds that it does not secure the necessary agreement between the divine persons. Further, I developed a Latin Social model of the Trinity. Hasker has responded by defending his Social Model and by raising seven objections against my Latin Social Model. Here I raise a new objection against Hasker on the grounds that it is (...) inconsistent with Conciliar Trinitarianism, and I respond to the seven objections and in so doing further develop the Latin Social Model. This paper offers an account of a fallacy we will call bothsiderism, which is to mistake disagreement on an issue for evidence that either a compromise on, suspension of judgment regarding, or continued discussion of the issue is in order. Our view is that this is a fallacy of a unique and heretofore untheorized type, a fallacy of meta-argumentation. The paper develops as follows. After a brief introduction, we examine a recent bothsiderist case in American politics. We use this as (...) a pivot point to survey the theoretical literature on the fallacy. The most prominent theory is that bothsiderism is a case of dialogue-shifting. This view fails, we maintain, to explain how bothsiderism might be persuasive. We argue, rather, bothsiderism is a kind of meta-argumentative fallacy. (shrink)

In this article I propose to reframe debates about ideals of emotion in medicine, abandoning the current binary setup of this debate as one between ‘clinical detachment’ and empathy. Inspired by observations from my own field work and drawing on Sky Gross’ anthropological work on rituals of practice as well as Henri Lefebvre’s notion of rhythm, I propose that the normative drive of clinical practice can be better understood through the notion of attunement. In this framework individual types of emotions (...) are not, as such, appropriate or inappropriate, but are evaluated depending on their synchronicity with the specific rhythms of the practice. To set up this proposal, I show how typical arguments about emotions in medicine—what I call emotion-entity focused frameworks—are insufficient. I then draw on ethnographic observations from two orthopaedic departments and interviews with medical practitioners to show (1) how clinical practice is driven by rhythmicity, shaped in the case of orthopaedic surgery by a clinical aim of efficient, controlled intervention, and (2) how clinicians continuously refer to this drive and the flow of rhythms when evaluating inappropriate or problematic emotion. I argue that the use of a rhythm framework rather than ideals of detachment or empathy allows for a sensitivity to the complexity and situation-dependent elements of emotional ideals in clinical practice; and I end by proposing the term ‘attuned concern’—which stresses the importance of regulation and adjustment to circumstances rather than of maintaining a constant distance/involvement—as a more fitting alternative to ‘clinical detachment’. Maureen Donnelly has recently argued that directionalism, the view that relations have a direction, applying to their relata in an order, is unable to properly treat certain symmetric relations. She alleges that it must count the application of such a relation to an appropriate number of objects in a given order as distinct from its application to those objects in any other ordering of them. I reply by showing how the directionalist can link the application conditions of any fixed arity (...) relation, no matter its arity or symmetry, and its converse(s) in such a way that directionalism will yield the correct ways in which it can apply. I thus establish that directionalism possesses the same advantage Donnelly's own account of relations, relative positionalism, has over traditional positionalist accounts of relations, which do not properly treat symmetric relations. I then note some advantages that directionalism has over its closest competitors. This includes Donnelly's relative positionalism, since directionalism is not, like relative positionalism, committed to the involvement of relative properties in every irreducibly relational claim. I close by conceding that, as Donnelly notes, directionalism is committed to the primitive relation of order-sensitive relational application. But I don't find this notion as mysterious as Donnelly does. I conclude that, even if one construes this feature of directionalism as a drawback, the two views are at worst at a draw, other things being equal, since this drawback is mitigated by the advantage directionalism has over relative positionalism. Lucretius follows his symmetry argument that one should not fear death with a dialectical strategy, the squandering argument. The dialectical presumption behind the squandering argument is that its audience is not an Epicurean, so squanders their life. The question is whether the squandering argument works on lives that by Epicurean standards are not squandered.

Deep disagreements are disagreements wherein the dialectical conditions for fruitful argumentative exchange do not obtain. One view from within these disagreements is that the other side has been duped or is so deeply ignorant of and complacent with some illusion, there is no hope for exchange. The Dark Enlightenment's critique of liberal democracy and progressive politics (which gave rise to the alt‐right movement) proceeds on this premise, calling their critical philosophy ‘the red pill’ and terming the opposition's program ‘the Cathedral’. (...) Despite the depth of their disagreement with progressives, there is evidence for an optimistic program of critical dialogue in this instance of deep disagreement. (shrink)

In the wake of colonial fragmentation and genocide, Indigenous ‘Khoisan resurgence’ movements in South Africa have mobilised subversive forms of authenticity, including heteroglossic and inventive translanguaging from fragments of Khoekhoegowab. In our analysis of video ethnographic texts produced in collaboration with the Gamtkwa Khoisan Council (GKC) in Hankey, the birthplace of Sarah Baartman, we explore how memory, language politics, and environmental activism are interwoven in acts of linguistic citizenship that constitute the ‘rememorying’ of a history that has remained persistently obscured. We argue that rememorying advances a politics of reminding which counters the Rainbow Nation’s institutionalised politics of forgetting, as well as anthropological accounts that consider Indigenous activist invocations of history as merely ‘therapeutic’. Through an engagement with the memory activism of the GKC, we identify how reconstructing word-histories, reliving historical traumas, retelling histories of sites of memory, seeing oneself mirrored in one’s ancestors, and the nexus of land, memory, and time form the basis for shared meaning-making, bringing impetus, focus, and intergenerational continuity to struggles for environmental and land justice. The project consists of a defense of the reductivist program generally and an application of the program to the theory of epistemic justification. ;Chapter One sets out the problem of reducing justification to other terms and defends the legitimacy of this problem against attacks by Quine in particular and supervenience theorists generally. Chapter Two is an explication and refutation of all possible theories which reduce justification-facts to facts about the reliability of cognitive processes. All such theories founder due to their (...) insensitivity to the perspectival component of thought. Chapter Three argues that this perspectival component is non-truth-theoretic and hence that the connection between justification and truth is much less important than has been generally supposed. Chapter Four lays out the structure of epistemic justification and proposes a reductive thesis entailing this structure. It is argued that essential elements of both coherence theories of justification and foundations theories of justification are present in rational thought and that this is explicable in terms of the teleology of human cognition. Stapleford (2007) identified Johann Nicolaus Tetens as the missing link between Reid’s common sense treatment of external world scepticism and Kant’s transcendental Refutation of Idealism. While that account is arguably correct, it failed to recognize the distinction between being justified in believing P and being justified in believing that my belief in P is justified. This paper corrects the oversight and explains its implications. Tetens emerges as a weak externalist regarding knowledge of external objects, situated roughly halfway between Reid’s moderate (...) externalism and Kant’s strong internalism. (shrink)

This chapter discusses the roles of ether and electrons in relativity theory. One of the most radical moves made by Albert Einstein was to dismiss the ether from electrodynamics. His fellow physicists felt challenged by Einstein’s view, and they came up with a variety of responses, ranging from enthusiastic approval, to dismissive rejection. Among the naysayers were the electron theorists, who were unanimous in their affirmation of the ether, even if they agreed with other aspects of Einstein’s theory of relativity. (...) The eventual success of the latter theory (circa 1911) owed much to Hermann Minkowski’s idea of four-dimensional spacetime, which was portrayed as a conceptual substitute of sorts for the ether.
