Is John Stuart Mill’s On liberty the source of present-day boundless self-tolerance and vacuous spontaneity and eccentricity? Professor Pedro Schwartz, in his work En busca de Montesquieu (2007), claims so. This article friendly discusses (o rather disputes) Schwartz’s views.

As a continuation of the work of the third author in [5], we make further observations on the features of Galois cohomology in the general model theoretic context. We make explicit the connection between forms of definable groups and first cohomology sets with coefficients in a suitable automorphism group. We then use a method of twisting cohomology (inspired by Serre’s algebraic twisting) to describe arbitrary fibres in cohomology sequences—yielding a useful “finiteness” result on cohomology sets. Applied to the special case (...) of differential fields and Kolchin’s constrained cohomology, we complete results from [3] by proving that the first constrained cohomology set of a differential algebraic group over a bounded, differentially large, field is countable. En los estudios sobre el pensamiento de René Girard, suele darse por supuesto que el deseo mimético es la concepción girardiana original sobre el deseo humano, de tal modo que el deseo mimético sería, cronológicamente, el primer descubrimiento de Girard. Asimismo, se asume que de tal hallazgo primigenio se derivarían posteriormente su antropología y su teoría sobre la religión. Sin embargo, mediante el presente estudio se ofrece una interpretación alternativa, que es la siguiente: en realidad, lo que finalmente Girard perfiló (...) como ‘deseo mimético’ fue hallado en un segundo momento, desde la antropología y los estudios sobre las religiones arcaicas. Así pues, se sostiene que el deseo mimético no es la concepción girardiana original sobre la órexis humana, sino el resultado de una desapercibida metamorfosis de las intuiciones primitivas de Girard al respecto (abandonadas finalmente por él) y que fueron expresadas en su primer libro, Mentira romántica y verdad novelesca. Let ‘semantic relevance’ be the thesis that the wide semantic properties of representational mental states (like beliefs and desires) are causally relevant to behavior. A popular way of arguing for semantic relevance runs as follows: start with a sufficient counterfactual condition for causal or explanatory relevance, and show that wide semantic properties meet it with respect to behavior (e.g., Loewer & Lepore (1987,1989), Rescorla (2014), Yablo (2003)).This paper discusses an in‐principle limitation of this strategy: even the most sophisticated counterfactual criteria (...) systematically misclassify irrelevant properties as relevant when they stand in certain kinds of modal co‐variation or ‘entanglement’ relations to genuinely relevant properties. This entanglement problem, I argue, is more general and more serious than proponents of the counterfactual strategy have recognized: it threatens recent interventionist arguments for semantic relevance, and is not easily solved by appeal to proportionality or naturalness. I end by suggesting that proponents of semantic relevance may need to shift their attention from patterns of counterfactuals to the lawful psychological generalizations that explain them. (shrink)

En este artículo se analiza un conjunto de obras sobre ríos y represas que pertenece a la serie titulada Represa /Represión (2012-) de la artista colombiana Carolina Caycedo. La pregunta de la que se ocupa esta investigación es ¿cómo las estrategias estéticas de estas obras identifican los problemas socio-ecológicos generados por las represas y contribuyen a articular imaginarios políticos de sostenibilidad? El argumento principal es que las obras de Caycedo sobre el río Yuma o Magdalena contribuyen con la construcción de (...) una memoria histórica ambiental, a partir de saberes populares, campesinos y cosmovisiones indígenas. Con este fin, este texto caracteriza el problema de las represas a partir de los conceptos de ‘extractivismo’, de Macarena Gómez-Barris, y ‘desterritorialización’, de Rob Nixon, para luego realizar un recorrido por las obras de la artista, de cuyo análisis se va construyendo una caracterización de la memoria histórica ambiental de un segmento del río Yuma. El marco conceptual del trabajo incluye las nociones de ‘seres-tierra’, de Marisol de la Cadena y ‘territorio’, de Arturo Escobar, así como ‘memoria de los ríos’, de Kristina Lyons. La metodología se basa en el análisis conceptual y técnico de las piezas de Caycedo en el marco interdisciplinar de las humanidades ambientales. El análisis concluye que las obras de Caycedo generan espacios de memoria histórica ambiental desde perspectivas trasnacionales y, en estos espacios de encuentro que constituyen las obras, se relacionan y rearticulan los extremos de falsos antagonismos como naturaleza/cultura, humano/no humano y ciencia/arte. The present paper tries to answer the question Is religious education compatible with the purposes of liberal education? This work argues that it is possible, and desirable, that democratic states built on liberal ideals include religious education in all schools since increasing the number of options among which the future citizen may choose the conception of the good with which he or she wishes to live is a condition for autonomy as one of its educational purposes. However, the proposal is (...) not based on religious confessional education, which by itself does not satisfy the liberal educational goals, but is redefined from the common principles compatible both religious confessions and non-religious views of morality and citizenship. The blooming desert or ‘El desierto florido’ in Spanish, is a millenarian climate pattern caused by El Niño that warms the surface waters in the eastern tropical Pacific Ocean and creates the conditions for rain in the Altiplano and the Atacama Desert, north of Chile. After some millimeters of abundant rain, a rich biotic community emerges, and in a matter of hours or days, the driest surface on Earth becomes an impressive colorful habitat for more than two hundred different species (...) of eye-catching flowers that host the desert biotic life. Unfortunately, this breathtaking display of colors coexists with less appealing but equally astonishing landscapes. The Atacama Desert harbors the largest accumulation of discarded clothing worldwide and the largest pools of lithium mining which require vast amounts of water for their production. Every year, approximately 56,000 tons of used clothing, predominantly consisting of fast fashion polyester products, water-intensive cotton fabrics, and equally polluting material scraps, are deposited, forming toxic mountains of waste. This article presents an interpretation of these distinct landscapes as interconnected realities of the dump that illustrate the impact of biocultural semiocides, whereby the loss of relationships and meanings with Earth materials is shaped by glocal forces. By making this argument, the article contends that the Atacama region replicates the conditions of the Earth as a global dumping and solastalgia, namely ‘the pain caused by the loss of solace and the sense of desolation connected to one´s home and territory.’. The Greek word mētis (μῆτις) traditionally refers to a particular form of wily intelligence associated with the arts of deception (dolos) and the knowledge of tricks (kerdē), subterfuges, and traps. Mētis evokes innovative and ground-breaking solutions, based on the capability to understand, anticipate, and possibly violate the others’ expectations. Most importantly, mētis presupposes practical wisdom, or prudence (phrόnesis), a dispositional quality that underpins all the virtues that deserve to be cultivated by sportspersons and that is pivotal to perfect sportspersons’ moral (...) character. Not only is prudence required to apply mētis profitably for winning a game, but it is also indispensable to perform consistently with the game’s norms—cognizant of sport values. This analysis of mētis is key to illuminate the embodied dimension of tactical and moral reasoning in contemporary sport practice. In this paper, we first argue that the strategic effectiveness of mētis proves that not only sensorimotor control but also higher forms of intelligence, like strategic reasoning, are embodied and inform skilful performance; second, we argue that relying on mētis is necessary not only to interpret the rules of the game in one’s own favor but also to respect the shared values that these rules uphold in the sport practice. This paper presents a pilot study that explores instances of objectless awareness during sleep: conscious experiences had during sleep that prima facie lack an object of awareness. This state of objectless awareness during sleep has been widely described by Indian contemplative traditions and has been characterised as a state of consciousness-as-such; while in it, there is nothing to be aware of, one is _merely_ conscious (cf. Evans-Wentz, 1960 ; Fremantle, 2001 ; Ponlop, 2006 ). While this phenomenon has received different (...) names in the literature, such as ‘witnessing-sleep’ and ‘clear light sleep’ among others, the specific phenomenological profile of this state has not yet been rigorously studied. This paper aims at presenting a preliminary investigation of objectless consciousness during sleep using a novel tool in qualitative research that can guide future research. Five participants experiencing objectless consciousness during sleep were interviewed following the _Micro-phenomenological Interview_ technique (MPI; Petitmengin, 2005, 2006 ). All participants reported an experience they had during sleep in which there was no scenery and no dream. This period labelled as ‘No Scenery/Void’ was either preceded by the dissolution of a lucid dream or by other forms of conscious mentation. The analysis of the results advances four experiential dimensions during this state of void, namely (1) Perception of absence, (2) Self-perception, (3) Perception of emotions, and (4) Perception of awareness. While the results are primarily explorative, they refer to themes found in the literature to describe objectless sleep and point at potential avenues of research. The results from this study are taken as indications to guide future operationalisations of this phenomenon. (shrink)

El presente trabajo de investigación tiene como objeto el estudio de la legislación penal en la República de Colombia desde 1890 hasta la actualidad con la ley 599 de 2000, este último conocido como el vigente Código Penal. Lo anterior, conforme a la siguiente pregunta problémica ¿se ha dado un desarrollo oportuno de la legislación penal colombiana que otorgue soluciones fehacientes a las necesidades de una política criminal sólida desde sus inicios hasta la actualidad? Con ello, se pretende analizar las (...) diversas escuelas que han influido en los legisladores a la promulgación y tipificación de los delitos y sus penas en el marco jurídico penal colombiano. Se destaca ante todo, el análisis que a lo largo del desarrollo del ordenamiento jurídico colombiano abarca el contexto constitucional, doctrinal y jurisprudencial, los cuales, han logrado evidenciar el carácter de un óptimo “derecho penal” a lo largo del contexto histórico del país en mención. Se destaca así, la gran influencia de las Escuelas Clásica, Positivista y Finalista, que a hoy han venido a establecerse con fuerza en Colombia a lo largo de su codificación, desde 1980 hasta la actual ley 599 del año 2000. The most recent work by Jürgen Habermas tries to revalue religion in today's society. For this he tries to find genealogical connections between secular content and the worldviews that emerged in the Axial Age, including Jewish monotheism. In this article we try to propose that a genealogical approach to monotheism from the perspective of those involved would have to start from the context of undetected origin that constitutes the ethical universalism of Judaism: the Noahide code. To do this, we analyze (...) narrative and conceptual elements of axial and non-axial cultures and show their parallels with the seven laws of the children of Noah as the moral core of humanity. While influential works since the 1970s have widely assumed that imitation is an innate skill in both human and non-human primate neonates, recent empirical studies and meta-analyses have challenged this view, indicating other forms of reward-based learning as relevant factors in the development of social behavior. The visual input translation into matching motor output that underlies imitation abilities instead seems to develop along with social interactions and sensorimotor experience during infancy and childhood. Recently, a new visual stream has been identified (...) in both human and non-human primate brains, updating the dual visual stream model. This third pathway is thought to be specialized for dynamics aspects of social perceptions such as eye-gaze, facial expression and crucially for audio-visual integration of speech. Here, we review empirical studies addressing an understudied but crucial aspect of speech and communication, namely the processing of visual orofacial cues and its integration with vocal auditory cues. Along this review, we offer new insights from our understanding of speech as the product of evolution and development of a rhythmic and multimodal organization of sensorimotor brain networks, supporting volitional motor control of the upper vocal tract and audio-visual voices-faces integration. Con este indicio, el artículo, en aras de enriquecer las discusiones académicas, se centra en dicha temática en cuentos centroamericanos escritos por mujeres, aspecto que en las últimas décadas ha venido tomando un lugar trascendental dentro de los estudios literarios. Despite the extensive research in both the determinants and the results of corporate social responsibility (CSR), relatively few studies have considered extra-legal institutions as potential determinants of CSR. Our work fills this gap by looking at how media attention affects CSR over a long-term period in a continental European setting. Our results show that media coverage positively affects CSR. Additional scrutiny triggered by media coverage encourages dominant owners to signal their commitment to limiting self-dealing transactions and their orientation toward stakeholders' (...) needs through CSR investments. Additionally, our results reveal that this signaling device offers greater benefits and lower costs in firms where controlling owners show a voting-cash flow wedge. Our results are relevant to different actors such as investors, auditors, and policy makers as they provide solid evidence that media coverage is an important driver of CSR orientation in a continental European setting. Recently, the construct ‘lucid dreamless sleep’ has been proposed to explain the state of ‘clear light’ described by Tibetan Buddhist traditions, a special state of consciousness during deep sleep in which we’re told to be able to recognise the nature or essence of our mind (Padmasambhava & Gyatrul 2008; Ponlop 2006; Wangyal 1998). To explain the sort of awareness experienced during this state, some authors have appealed to the sort of lucidity acquired during lucid dreaming and suggested a link between (...) both phenomena (Thompson 2014, 2015; Windt 2015a; Windt et al. 2016). Whilst these authors appeal to a non-conceptually mediated form of lucidity, which doesn’t consist of reflective awareness and propositional thought, the question as to whether the state of clear light should be considered a lucid state similar to lucid dreaming still arises. I argue that the concept ‘lucidity’ used to describe this sort of state is imprecise and that two theoretical notions of lucidity should be distinguished. The first one, which I call the technical notion, requires the recognition of the hallucinatory character of my current experience. The second, the broader notion, involves the seeming recognition of being directly acquainted with the phenomenal character of my experience. I spell out these two notions of lucidity and argue that only the latter could apply to the state of clear light sleep. (shrink)

Summary The paper follows the lives of Mateu Orfila and François Magendie in early nineteenth-century Paris, focusing on their common interest in poisons. The first part deals with the striking similarities of their early careers: their medical training, their popular private lectures, and their first publications. The next section explores their experimental work on poisons by analyzing their views on physical and vital forces in living organisms and their ideas about the significance of animal experiments in medicine. The last part (...) describes their contrasting research on the absorption of poisons and the divergences in their approaches, methods, aims, standards of proof, and intended audiences. The analysis highlights the connections between nineteenth-century courtrooms and experimental laboratories, and shows how forensic practice not only prompted animal experimentation but also provided a substantial body of information and new research methods for dealing with major theoretical issues like the absorption of poisons. This paper shows that philosophy and contemplation are integral parts of leisure and of a fully conscious educative experience. Through examination of the concepts of philosophy, the philosopher, and contemplation, it will be proposed that leisure is a necessary condition for philosophy and for education. To conceptually bring together philosophy and education with leisure, the act of teaching as “an overflow of contemplation,” following Yves Simon’s definition, will be considered. Supporting the philosophical view of education as constituting an inward transformation (...) of the individual, from which he or she can better regard the world and his or her place in it, a serious theory of education rooted on leisure is a timely and valuable idea to consider. Recent years have seen a heightened focus on the study of minimal forms of awareness during sleep to advance the study of consciousness and understand what makes a state conscious. This focus draws on an increased interest in anecdotical descriptions made by classic Indian philosophical traditions about unusual forms of awareness during sleep. For instance, in the so-called state of witnessing-sleep or luminosity sleep, one is said to reach a state that goes beyond ordinary dreaming and abide in a state (...) of just awareness, a state in which one is not aware of anything else other than one’s own awareness. Moreover, for these traditions, this state is taken to be the essence or background of consciousness. Reports on such a state opens the door to exciting new lines of research in the study of consciousness, such as inquiry into the so-called “objectless” awareness during sleep—states of awareness that lack an ordinary object of awareness. In this two-staged research project, we attempted to find the phenomenological blueprints of such forms of awareness during sleep in 18 participants by conducting phenomenological interviews, informed by a novel tool in qualitative research, the micro-phenomenological interview (MPI) method. Following a phenomenological analysis, we isolated a similar phase across 12 reported experiences labelled as ‘nothingness phase’ since it described what participants took to be an experience of ‘nothingness’. his common phase was characterised by minimal sense of self—a bodiless self, yet experienced as being ‘somewhere’—, the presence of non-modal sensations, relatively pleasant emotions, an absence of visual experience, wide and unfocused attention, and an awareness of the state as it unfolded. The intuitive distinction between natural and unnatural properties (e.g., green vs. grue) informs our theorizing not only in fundamental physics, but also in non-fundamental domains. This paper develops a reductive account of this broad notion of naturalness that covers non-fundamental properties: for a property to be natural, I propose, is for it to figure in a law of nature. After motivating the account, I defend it from a potential circularity charge. I argue that a suitably broad notion of lawhood can (...) be defined independently of naturalness, if we help ourselves to the notion of a fundamental physical property. I end by showing how the notions of naturalness and lawhood that my account delivers help illuminate a number of other important philosophical notions, like causation, reference/meaning, and rational induction. En el marco de los 800 años de la celebración del encuentro de San Francisco y el Sultán, convocado por la Orden Franciscana, el presente artículo pretende indagar sobre la concepción de la imagen del moro en la sociedad colonial y, particularmente reflejados en la serie de 54 cuadros de la vida de san Francisco del Museo de Arte Colonial de San Francisco, Santiago de Chile, confeccionada en el siglo XVII en un taller del Cuzco y cuyo destino fue el (...) Convento homónimo para la formación y contemplación de los religiosos, que nos permite descubrir su representación. El moro representa el signo del individuo o del territorio pagano, en acción o contexto de violencia, pero capaz de la conversión. Estos aspectos son comunes a los prejuicios traídos por los colonizadores, marcados por la larga lucha en la península contra ellos y las políticas de expulsión de esta comunidad desde España. El arte colonial, a su vez, fue un ejercicio de diálogo cultural que adaptó la cultura hispánica a la realidad del nuevo mundo, y, por tanto, permitió la lectura del moro trasladada a las dificultades y éxitos de la evangelización y a la violencia ejercida por los conquistadores. El artista chileno José Miguel Blanco tuvo un rol protagónico en la escena cultural del país durante la segunda mitad del siglo XIX. Aparte de su labor escultórica, traducida en una cantidad importante de obras, una buena parte de su quehacer estuvo vinculado con la escritura de arte, lo que se materializó, principalmente, en el periódico El Taller Ilustrado, el primer medio informativo en el país dedicado exclusivamente a temas de arte, que este escultor creó y dirigió por casi cinco (...) años. Desde esa tribuna Blanco promovió información, debates e iniciativas que favorecieron el desarrollo cultural del país. Este escultor es, sin lugar a dudas, el autor más prolífico en la escritura artística chilena de su tiempo. The Chilean artist José Miguel Blanco had a protagonic role in the culture scene in the country during the second half of the 19th century. Besides his works of sculpture, reflected in an important quantity of pieces of art, a great part of his work was related to the Artistic Writing, which was materialized, mainly in the newspapers called El Taller Ilustrado, the first informative media in the country dedicated exclusively to the topics of Art, that this sculptor created and managed for almost five years. From this tribune, Blanco promoted information, debates and initiatives that contributed to the development of culture in Chile. The sculptor is, without any doubt, the most prolific author in Chilean Artistic Writing in his time. (shrink)
