La intención de la obra es estudiar la polaridad exitente entre el paisaje com producto del afán destructor del hombre y el paisaje como fruto de la creación y como espacio con un gran potencial para curar.

The work of Emmanuel Levinas has been both abundantly recognized and criticized in moral philosophy. This Janus-faced attitude is also present in ecological theories, which find fertile ground in Levinas’ thought without being able to explain its apparent anthropocentrism. Opposing hermeneutical paths tend to focus either on otherness as an absolute alterity, implying a potentially unlimited responsibility for all alterities, or on otherness as a re-foundation of humanism, leading to the conclusion that responsibility is unlimited only among humans. Here I (...) seek to disentangle Levinas from these two extreme interpretations, first by reviewing ecological readings of his philosophy, in both the Francophone and Anglophone spheres, and second by analyzing specific Levinasian terms that might be particularly helpful for a non-anthropocentric or deep ecology. The main results of this investigation are a distinction between the ethics of responsibility and the ethics of vulnerability, an explanation of Levinasian compulsory or methodological humanism, and a schematic model of sensibility as enjoyment/vulnerability capable of supporting deep ecology without the traditional notions of free will, rights, or values. En este texto se trata de pensar el proyecto que Foucault inició con el análisis de la parrhesía. Se aborda ese problema en relación a otros dos elementos de su obra: la reflexión sobre la función de los intelectuales y sus escritos sobre la noción de crítica. Desde esa perspectiva trataré de mostrar que las investigaciones sobre la parrhesía reflejan el intento de pensar una nueva política de la verdad.

The Uniform Determination of Death Act (UDDA) provides that “an individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead.” We show that the UDDA contains two conflicting interpretations of the phrase “cessation of functions.” By one interpretation, what matters for the determination of death is the cessation of spontaneous functions only, regardless of their generation by artificial means. By the (...) other, what matters is the cessation of both spontaneous and artificially supported functions. Because each UDDA criterion uses a different interpretation, the law is conceptually inconsistent. A single consistent interpretation would lead to the conclusion that conscious individuals whose respiratory and circulatory functions are artificially supported are actually dead, or that individuals whose brain is entirely and irreversibly destroyed may be alive. Requiring family authorization for apnea testing subtracts health professionals control over death determination, a procedure that has traditionally been considered a matter of clinical expertise alone. In this commentary, we first provide evidence showing that health professionals’ (HPs) disposition to act on death determination without family’s prior consent could be much lower than that referred to by Berkowitz and Garrett (2020). We hypothesize that HPs may have reservations about their own expertise as regards death, and may thus hesitate to impose (...) their views on patients’ families. We then address the theoretical question of clinical expertise in death determination by distinguishing judgments about facts (e.g., the presence or absence of spontaneous breathing) from interpretations given of these facts (i.e., their meaning for the vital status of an individual). We argue that, while clinicians may claim some expert authority on the former, they hold no particular authority on the latter. (shrink)

Alireza Bagheri supports a policy on organ procurement where individuals could choose their own definition of death between two or more socially accepted alternatives. First, we claim that such a policy, without any criterion to distinguish accepted from acceptable definitions, easily leads to the slippery slope that Bagheri tries to avoid. Second, we suggest that a public discussion about the circumstances under which the dead donor rule could be violated is more productive of social trust than constantly moving the line (...) between life and death. En el presente ensayo se propone una lectura de la obra Taberna y otros lugares (1969) de Roque Dalton. Se considera que es oportuno pensar la figura del poeta salvadoreño a la luz, no simplemente de los exilios políticos, sino también de la privación (en términos genéricos) de la figura del poeta de sus antiguas funciones en –lo que Ángel Rama denominó– la ciudad letrada. La ciudad modernizada (Rama, 1984) expulsó al poeta de su lugar privilegiado, lo que provoca un (...) trauma y una búsqueda novedosa. En ese contexto, el poeta redefine su voz y la literatura sufre una reterritorialización, es decir, redefine sus márgenes. En América Latina, el problema fue abordado por José Martí que incluso propuso nuevos desafíos a la disciplina (como el problema de la identidad latinoamericana). Se cree que Taberna y otros lugares (1969) retoma estas búsquedas y se arriesga la hipótesis ue, al redefinir su campo, la obra de Dalton puede ser leída no solo en clave literaria, sino también historiográfica desde una mirada benjaminiana. El estudio examina mediante una revisión sistemática la literatura científica. La metodología se basó en la aplicación de los principios de la declaración PRISMA. Los resultados indicaron que la mayor producción de estudios fue en 2021, con predominancia de idioma inglés, España como el mayor productor, Reino Unido con el mayor número de revistas y el uso de realidad aumentada como la estrategia más estudiada. Desde la ruptura con la visión liberal decimonónica del fenómeno nacionalista, los autores emprenden la difícil tarea de reconstruir, aunque sólo programáticamente, el sentimiento nacionalista desde un punto de vista emancipatorio. Este es el único camino posible para enlazar con los nuevos movimientos sociales que, como el texto señala, generalmente rechazan el fenómeno nacionalista. En efecto, existe ya un nuevo nacionalismo, con un fuerte potencial emancipatorio y que está llamado a caminar junto a la idea de Ecología politica. La ruptura (...) con el nacionalismo decimonónico tiene lugar cuando los nuevos nacionalismos aparecen como un acto de disidencia contra el concepto de Estado-Nación. Este concepto cada vez más afectado por su crisis constitutiva y crónica-crisis de la participación política reducida a"democracia virtual", crisis de eficiencia y crisis cultural-, es el objetivo a combatir por parte de los nuevos nacionalismos. Aquí tiene lugar el encuentro con la Ecología política, en la disidencia del progreso, en la búsqueda de caminos de reconstrucción de identidades destruidas por el mercado. Incluso, la Etnopolítica y la Ecología política coinciden en el mismo campo -el de la disidencia, el de las vías alternativas, el de la emancipación-, con los mismos significados -pluralismo, urgencia vital, necesidad-; finalmente, buscan alcanzar objetivos en los que se coincide: seguridad ontológica y reconstrucción conjunta de las formas de vida ecológicas. En este artículo se presenta un abordaje general de la teoría de la justicia social de John Rawls. Revisamos algunas críticas desde diversos frentes teóricos. Consideramos que la justicia social permite enjuiciar las consecuencias regresivas para la humanidad del capitalismo en su fase neoliberal y comenzar a imaginar otros mundos posibles.

This article analyses the rationality of the principle of proportionality as a justificatory method for solving cases involving conflicts of constitutional principles. It addresses the “problem of comparability”: a set of arguments claiming that proportionalists fail to understand what happens when constitutional principles collide. The problem of comparability suggests that balancing cannot be done if some conflicts of constitutional principles are, in reality, cases of noncomparability, incommensurability, incomparability, or vagueness. In this article, I challenge the views of both proportionalists and (...) their skeptics. Against the skeptics, I argue that proportionality can survive the challenge posed by the problem of comparability. Against the proportionalists, I submit that proportionality cannot be understood as a system of tradeoffs between degrees of satisfaction of principles. If comparison among constitutional principles is to be rational, we need a different approach to normativity—one that allows for the possibility of parity. (shrink)

A principios de los años 80 se desató en Francia una polémica conocida como «el silencio de los intelectuales». En este texto abordaremos la singular postura de Michel Foucault al respecto. Para ello realizaremos una doble operación. Por un lado, planteamos la hipótesis siguiente: se pueden encontrar los fundamentos que sostienen su posición en los análisis que realizó sobre la parrhesía a partir de los años 80. En segundo lugar, realizaremos un recorrido por autores como Lyotard y Blanchot, quienes intervinieron (...) en dicha polémica con conocidos escritos, para mostrar las particularidades de la apuesta de Foucault. De esta manera, pretendemos, no solamente mostrar su original aportación al problema, sino señalar los desplazamientos respecto a la crítica del intelectual que había elaborado durante los años 70. The rise of mathematical developments in the theories of consciousness has led to new measures to detect consciousness in a system. The Integrated Information Theory is one of the best mathematical rooted attempts to quantify the level of consciousness in a system with Φ as the effective information generated in a system above its parts. Recently, the IIT has inspired the Perturbational Complexity Index to detect conscious states in patients with disorders of consciousness, and it has shown to have almost (...) perfect classification accuracy. In this study, we explore the statistical correspondence between the theoretical Φ and the experimental PCI through a neurocomputational model of coupled oscillators that can be artificially perturbed, which mainly focuses on the dynamics of collective synchronization between subsets of brain areas. Our results reveal that both measures are statistically related but, in principle, this relationship is far to be perfect. Rousseau has always had an uncertain relationship with the theory of constituent power. On the one hand, his distrust of political representation and support for popular sovereignty seem consistent with the idea of the people as a legally unlimited constitution-maker. On the other hand, if, from those views about representation and sovereignty, it follows that Rousseau is a proponent of direct democracy, then there seems to be no place in his thought for a theory that presupposes, above all, a separation (...) between those who exercise a delegated authority and those who possess an original constitution-making power. In a legal order in which all laws must be directly made by the people, such a separation is absent: the constituent and the legislative body are one and the same. It is therefore not surprising that Rousseau’s name is largely absent from contemporary literature on constituent power. In this article, however, I will show that once Rousseau’s particular conception of law, as well as his distinction between sovereignty and government, are properly understood, one finds in his work not only the first major formulation of the theory of constituent power, but also a careful exploration of its implications for actual constitutional practice. El artículo contextualiza e investiga los detalles del «Mes de Reflexión Episcopal» organizado por el Departamento de Pastoral de Conjunto del Celam en julio de 1971, que reunió providencialmente varios obispos, algunos de los cuales no estuvieron en la II Conferencia General tres años antes, y que darían testimonio del espíritu de Medellín hasta el martirio o hasta una muerte trágica en cumplimiento de su misión: Oscar Arnulfo Romero, Juan Gerardi Conedera, Gerardo Valencia Cano y Raúl Zambrano Camader. El encuentro (...) se describe a partir de la revisión documental de las actas y de los pocos informes impresos. La tesis central del artículo es que el diálogo informal entre obispos, teólogos y otros expertos en el «Mes de Reflexión Episcopal» es fuente de propuestas novedosas para una Pastoral de Conjunto, contra la clericalización y el autoritarismo en la Iglesia latinoamericana. Desafortunadamente, no hay una reunión posterior similar debido a una controversia con la Congregación romana para los obispos. (shrink)

¿Cuál es el estado de los debates académicos sobre el sexismo en los currículos universitarios de filosofía? La pregunta, así formulada, busca delimitar las principales disputas sobre la incorporación de enfoque de género en los currículos filosóficos en la literatura de la última década. Atendiendo a la revisión sistemática de literatura se realizaron búsquedas en Scopus, Web of Science, Springer, JSTOR, Taylor & Francis y Google Scholar, entre 2012-2022; la estrategia de análisis se centró en los debates recurrentes en el (...) campo. Se analizaron 98 estudios y cinco debates según los cuales las prácticas curriculares excluyentes no permiten la materialización de una educación filosófica inclusiva e intercultural: 1) sesgos implícitos, amenazas por estereotipos y clima hostil, 2) reconocimiento de las mujeres filósofas en el canon y la historia de la filosofía, 3) injusticias epistémicas en la filosofía académica, 4) voces de las mujeres negras en la profesión filosófica y 5) ausencia de las mujeres en la “normalización filosófica” latinoamericana. The Habermasian concept of ‘interest’ has had a profound effect on the characterization of scientific disciplines. Going beyond issues unrelated to the theory itself, intra‐theoretical interest characterizes the specific ways of approaching any science‐related discipline, defining research topics and methodologies. This approach was developed by Jürgen Habermas in relation to empirical–analytical sciences, historical–hermeneutics sciences, and critical sciences; however, he did not make any specific references to health sciences. This article aims to contribute to shaping a general epistemological framework for health (...) sciences, as well as its specific implications for the medical and nursing areas, via an analysis of the basic knowledge interests developed by Habermas. Se ofrece una reflexión sobre los avances y las tendencias de discusión en la historia de la tradición filosófica en Colombia y sus presupuestos historiográficos, como un aporte al debate sobre la relevancia de pensar las tradiciones filosóficas nacionales en el siglo XXI. A partir de las categorías valorativas de las diferentes producciones intelectuales se determina si hacen parte o no de la tradición filosófica nacional. El concepto de “normalización filosófica” es analizado como categoría interpretativa de la tradición colombiana y (...) se sugiere su obsolescencia dadas sus implicaciones; con el propósito de superar el reduccionismo, la exclusión y el sesgo al que conlleva esta categoría. Se propone la reivindicación de los intentos de análisis social del siglo XIX y de las producciones filosóficas regionales con el propósito de aportar a una reconstrucción decolonial, amplia y sin sesgos de la historia de la tradición de la filosofía colombiana. Denying the conclusion of a valid argument is not generally permissible if one suspends on one premise of the argument and believes the other premise. This can happen when one’s only critique of an argument is to undermine one premise. There is incoherence there. Here I examine how this is relevant to the debate on evolutionary debunking of our moral knowledge. I argue that one significant line of response to the debunker is unsuccessful: merely undermining the debunker’s empirical claim. It (...) is not rational to respond this way and believe one has moral knowledge. First I present evidence that prominent critics of the debunking argument merely undermine the debunker’s empirical claim. Then I argue for two premises: merely undermining a premise can only justify a middling amount of doubt towards the premise and we should have no more doubt about the conclusion of a valid argument than we do about the premises. Culture has traditionally been considered as a set of knowledge, beliefs, arts, laws, norms, and morals, acquired by a human being as a member of a group. Some anthropologists interpret this as a set of abstract representations, such as information or knowledge, while others interpret it as behavioral control mechanisms. These views assume that the contents of a particular culture must be processed by the minds of individuals, either in a direct way or by resorting to learned mental structures in (...) processes of symbolic socialization. Some critics suggest a problem with these perspectives since they do not provide a convincing explanation of the enculturation process beyond metaphorical images of transfer or internalization of symbolic cultural contents through linguistic transmission. The new embodied theories of cognition, especially enactivism, could give new ideas about what enculturation processes are like, through the concept of participatory sense-making in material culture environments. In this essay, we discuss how an enactive vision of culture could be, and what advantages it would have, as well as the challenges and weaknesses in explaining the culture and its learning processes. Este trabajo examina los diferentes reparos que el recurso a las ideas procedentes de la cultura pública como base de su concepción de la justicia le ha procurado a Rawls. Ese examen se propone establecer dos conclusiones. Primera, frente a quienes sugieren que, con la apelación a tales fundamentos, la solidez del método de justificación que Rawls articula se resiente gravemente y los que esgrimen que, con esa apelación, Rawls renuncia a las pretensiones de universalidad que son consustanciales a la (...) doctrina liberal, intenta poner de manifiesto que el papel que esas ideas cumplen en la justificación de una concepción política de la justicia como la suya únicamente muestra la congruencia que la obra de Rawls exhibe en la manera de entender la naturaleza de la justificación y la clase de elementos sobre los cuales se articula. Segunda, frente a quienes sostienen que el método de justificación empleado por Rawls entraña alguna forma de relativismo o etnocentrismo, trata de evidenciar que ese método no conduce a ese tipo de posiciones, por más que tome como base nuestros juicios considerados y nociones políticas fundamentales. Goal: To assess public knowledge and attitudes towards the family’s role in deceased organ donation in Europe. -/- Methods: A systematic search was conducted in CINHAL, MEDLINE, PAIS Index, Scopus, PsycINFO, and Web of Science on December 15th, 2017. Eligibility criteria were socio-empirical studies conducted in Europe from 2008 to 2017 addressing either knowledge or attitudes by the public towards the consent system, including the involvement of the family in the decision-making process, for post-mortem organ retrieval. Screening and data collection (...) were performed by two or more independent reviewers for each record. -/- Results: Of the 1482 results, 467 studies were assessed in full-text form, and 33 were included in this synthesis. When the deceased has not expressed any preference, a majority of the public support the family's role as a surrogate decision-maker. When the deceased expressly consented, the respondents' answers depend on whether they see themselves as potential donors or as a deceased's next-of-kin. Answers also depend on the relationship between the deceased and the decision-maker(s) within the family, and on their ethnic or cultural background. -/- Conclusions: Public views on the authority of the family in organ donation decision-making require further research. A common conceptual framework and validated well-designed questionnaires are needed for future studies. The findings should be considered in the development of Government policy and guidance regarding the role of families in deceased organ donation. (shrink)

The debate over the determination of death has been raging for more than fifty years. Since then, objections against the diagnosis of brain death from family members of those diagnosed as dead-have been increasing and are causing some countries to take novel steps to accommodate people’s beliefs and preferences in the determination of death. This, coupled with criticism by some academics of the brain death criterion, raises some questions about the issues surrounding the determination of death. In this paper, we (...) discuss some of the main approaches to death determination that have been theoretically proposed or currently put into practice and propose a new approach to death determination called "weak pluralism" as a reasonable ethical and political alternative to respect diversity in death determination. [ENGLISH] This article discusses the potential of synthetic biology to address fundamental questions in the philosophy of biology regarding the nature of life and biological functions. Synthetic biology aims to reduce living organisms to their simplest forms by identifying the minimal components of a cell and also to create novel life forms through genetic reprogramming, biobrick assembly, or novel proteins. However, the technical success of these endeavors does not guarantee their conceptual success in defining life. There is a lack of (...) consensus among researchers on how to define and classify the entities produced in the lab, whether they should be considered living or categorized differently. The criteria for minimal cells and minimal life are subject to arbitrary choices and varying interpretations. The concept of function, crucial to synthetic biology, is also difficult to define. The article highlights the need to consider the minimal set of functions that characterize life before determining the smallest genomes that code for those functions. The arbitrary nature of defining both life and function complicates the understanding and classification of these entities. The article suggests that the traditional dichotomy between the living and the non-living may no longer be valid and that the concept of life itself may not require precise scientific definition. As synthetic biology advances, the article emphasizes the importance of redefining or constructing new categories to encompass the expanding possibilities and creations in the field. The ability to create new life forms raises questions about recognition, identification, and ethical implications, requiring a conceptual and philosophical engagement beyond the technical achievements of synthetic biology. -/- [FRENCH] L'article aborde le potentiel de la biologie synthétique pour répondre à des questions fondamentales de la philosophie de la biologie concernant la nature de la vie et des fonctions biologiques. La biologie synthétique vise à réduire les organismes vivants à leurs formes les plus simples en identifiant les composants minimaux d'une cellule et à créer de nouvelles formes de vie grâce à la reprogrammation génétique, à l'assemblage de biobriques ou à des protéines nouvelles. Les critères des cellules minimales et de la vie minimale sont soumis à des choix arbitraires et à des interprétations variables. La notion de fonction, essentielle en biologie synthétique, est également difficile à définir. L'article met en évidence la nécessité de prendre en compte l'ensemble minimal de fonctions qui caractérisent la vie avant de déterminer les plus petits génomes qui codent ces fonctions. La nature arbitraire de la définition de la vie et de la fonction complique la compréhension et la classification de ces entités. L'article suggère que la dichotomie traditionnelle entre le vivant et le non-vivant pourrait ne plus être valable et que le concept même de vie ne nécessite pas une définition scientifique précise. À mesure que la biologie synthétique progresse, l'article souligne l'importance de redéfinir ou de construire de nouvelles catégories pour englober les possibilités et créations croissantes dans le domaine. La capacité à créer de nouvelles formes de vie soulève des questions de reconnaissance, d'identification et d'implications éthiques, nécessitant une réflexion conceptuelle et philosophique au-delà des avancées techniques de la biologie synthétique. La presencia del neoplatonismo en la fenomenología francesa contemporánea posee una pregnancia que atraviesa sus puntos más relevantes. La obra de (...) Jean-Luc Marion no escapa a esto. En este trabajo abordamos la apropiación marioniana del pensamiento de Nicolás de Cusa, a la luz de su escrito Certitudes négatives, con la intención de comprender la doctrina ignorante del Cusano como un modo de certeza negativa. Finality, design and purpose have started to be excluded from the language of the natural sciences since the XVIIth century. Darwin succeeded in excluding them from his theory of evolution appealing to a blind and mechanical natural selection. Today, the most usual definitions for the concept of biological function take for granted that functions: 1) are not dependent on a goal; 2) are not dependent on observers, but only on nature; 3) are explicable in causal terms, either with reference to (...) the causal history of the organ (etiological definition), or with reference to its present structure and causal capabilities (dispositional definition). However, we shall see that such presuppositions cannot take into account the normative character of the concept of biological function. We show that a generalization of the concept of scientific objectivity lets us affirm that functions: 1’) are dependent on a goal; 2’) are dependent on both observers and nature; 3’) cannot be reduced to causality, nor break the laws of physics; and yet, 4) are truly objective.
