Reinhart Koselleck is among the most original German theorists of history and historiography. His international reputation is due in part to his contributions as theorist and editor of the remarkable lexicon Geschichtliche Grundbegriffe (GG). The GG is an exceptional reference work that goes far towards realizing Koselleck's program and distinctive version of Begriffsgeschichte (the history of concepts, conceptual history). What is presented here is a translation in full of Koselleck's own entry on Krise (crisis). Few articles in the GG (...) demonstrate more successfully Koselleck's theoretical concerns, his method, and innovative use of sources. (shrink)

The purpose of this paper is, while discussing in detail Helmut Rüßmann's theory of judicial factfinding, to demonstrate how probability theory can be used in dealing with a situation where the court has not obtained full evidence, but probability assumptions are possible with regard to circumstantial evidence. After giving a brief overview of provisions of German law which include the concept of probability, elementary features of probability calculus and statistical inference are outlined. The focus of the discussion of Rüßmann's theory (...) is on evaluating testimony and on combining the impact of several pieces of evidence which bear on the same event or proposition; the relevant concepts of Ekelöf, Schreiber, Rüßmann and Dempster are analyzed and then compared with a new proposal. The paper concludes that alternative approaches to probability need not be invoked;,classical' probability calculus seems to best cope with the questions courts are confronted with in situations such as discussed in the paper. In the framework of the minimalist program, the assumption that wh-in-situ move covertly to be assigned wide scope is infeasible. Rather, it is assumed that they must be interpretable in situ, and that syntactic conditions like ‘superiority’ are effects of economy, which restricts overt rather than covert movement of a wh-element. The remaining syntactic problem for this line of reasoning is the putative ECP effects of adverbial wh-adjuncts, which were the strongest evidence for covert movement. A serious semantic problem is (...) that the interpretative procedures which have been proposed for wh-in-situ – unselective binding or absorption – fail to capture correctly their interpretation. I will argue first that both problems are solved if the interpretation in situ employs choice functions, and it is the function variable, rather than an individual variable, which is long-distance bound by the question existential operator. Adverbial adjuncts, which cannot be interpreted via choice functions, cannot, therefore, be interpreted in situ. However, the concept of economy underlying the account of overt superiority effects requires both theoretical and empirical clarification (as it leaves some empirical problems unaddressed). I argue, following a proposal by Golan (1993), that in this case the economy considerations apply at the interface (‘interface economy’) and that they consider not only different derivations out of the same numeration, but also their semantic representation. The unprecedented growth of the prison population in the United States is a result of complex political and social factors that have contributed to more punitive criminal justice policies. While there has been much attention devoted to examining the possibility of expanding the use of alternatives to incarceration as a means of reducing these numbers, there has been insufficient focus on addressing changes in the length of time served in prison as a strategy for reduced incarceration. The sharp increase in (...) time served in prison in recent years has had no significant effect on recidivism or deterrence, but has been very costly and has contributed to the eroding of ties between people in prison and their families and communities. This paper deals with the ‚description-thesis‘ (R. Schreiber 1962) according to which normative or prescriptive legal statements are reducible to, or translatable into, descriptive propositions. The arguments Schreiber produced in support of his thesis are briefly presented, followed by a discussion of the thesis against the background of Hume’s law and G. E. Moore’s open-question argument. In order to broaden the perspective, some other philosophical views are examined; emphasis is placed on how the is-ought relation was conceived, in conflicting ways, (...) by Hans Kelsen and Friedrich Müller respectively, as compared to the current state of discussion, and what are, according to Ernst Tugendhat and Christoph Möllers, the constituents of (social) norms. As a result, the paper suggests that the description-thesis can not be maintained in its entirety. A special version is presented which seems to respond to the criticism discussed while implying at least part of what Schreiber’s original version claimed. (shrink)

Previous research on sustainable entrepreneurship has mainly aimed to understand the antecedents of entrepreneurs’ sustainability-oriented behavior. Yet the literature lacks a more nuanced understanding of how entrepreneurs implement sustainability strategies when creating a new venture. Drawing on sustainability concepts, we first examine how entrepreneurs balance the economic, environmental, and social dimensions as part of their ventures’ strategic ambitions. We show that sustainable entrepreneurs prioritize the three sustainability dimensions and possibly reprioritize them in response to stakeholder interests. Applying a stakeholder theory (...) perspective, we theorize that how entrepreneurs balance their sustainability dimensions and goals depends on the degree of stakeholder involvement and of external expectations. Our contributions refine the growing sustainable entrepreneurship literature and call attention to the importance of including weightings and time when examining the dimensions of sustainability. No one, including Heidegger himself, disputes that he has completed a turn in the development of his thinking. Roughly put, this leads from human existence as something to be analyzed in phenomenological and transcendental philosophy to the “Being” which is to be proclaimed directly in its concealment and disclosure. Above all others, Löwith and Schulz have proposed the thesis that this turn involves at least a reinterpretation of the original tendency, if not an inversion or an erosion. Löwith’s book on (...) Heidegger gives a hint of the judgment presently widespread, that the latter has fallen back from his significant beginning in Being and Time and has stopped being a philosopher in order to give himself over to the mysticism of Being. According to Schulz, however, the turn has world-historical significance: Heidegger’s essay “What is Metaphysics?” is not merely the end of his first period of work, but is even “the metaphysical finale of traditional metaphysics.”.
