. 1. Introduĉão histórica ao pensamento jurídico, épocas medieval e moderna --.

Este libro alberga tres motivos entrelazados -uno estético, uno práctico y uno teórico-. El motivo estético consistió en llegar a exponer tres niveles de análisis en el interior de una sola gran historia. El motivo práctico gravitó en la reducción lógica del argumento, para poder darle "musculatura" al texto, y mostrar así su concepto de la manera más clara y directa posible. Ambos motivos quedaron relativamente bien resueltos. El problema teórico residió ante todo en poder hacer de la unidad un (...) movimiento de la libertad, cuestión que requirió primero elevar la unidad a su forma suprema. A partir de ese dilema apareció además la necesidad de responder a la pregunta ¿por qué Hegel? Dicho en pocas palabras, porque a partir de su filosofía es posible pensar la unidad como autodeterminación múltiple. De ahí que el objeto de este libro no sea tanto defender la "diferencia" y la "multitud", cuanto más bien se trata de mostrar que la unidad puede ser en sí misma libre y diferente. La realización de esta unidad negativa e infinita debe entonces conjugar con lo otro, razonar lo heredado, asumirse como la totalidad de las diferencias y considerar a aquella diferencia como su verdad. Pero estas formas de unidad desarrolladas -unidades masivas, relativas y plenas; unidades concomitantes, constituyentes y soberanas; unidades singulares, particulares y universales, o unidades silogísticas- tienen lugar únicamente cuando ha sido forjado un bastidor de tejidos programáticos, o un juego metódico de conceptos. En ellos se realiza entonces y al fin la circulación efectiva entre las esferas disyuntivas que despliegan la vitalidad creadora del "espíritu de un pueblo". Ship-type identification in a maritime context can be critical to the authorities to control the activities being carried out. Although Automatic Identification Systems has been mandatory for certain vessels, if a vessel does not have them voluntarily or not, it can lead to a whole set of problems, which is why the use of tracking alternatives such as radar is fully complementary for a vessel monitoring systems. However, radars provide positions, but not what they are detecting. Having systems capable of (...) adding categorical information to radar detections of vessels makes it possible to increase control of the activities being carried out, improve safety in maritime traffic, and optimize on-site inspection resources on the part of the authorities. This paper addresses the binary classification problem (fishing ships versus all other vessels) using unbalanced data from real vessel trajectories. It is performed from a deep learning approach comparing two of the main trends, Convolutional Neural Networks and Long Short-Term Memory. In this paper, it is proposed the weighted cross-entropy methodology and compared with classical data balancing strategies. Both networks show high performance when applying weighted cross-entropy compared with the classical machine learning approaches and classical balancing techniques. This work is shown to be a novel approach to the international problem of identifying fishing ships without context. (shrink)

Este artículo tiene por objetivo analizar la clasificación de virtudes que se encuentra en la Ysagoge in theologiam, un texto anónimo de mediados del siglo XII que puede considerarse como una de las primeras sumas sistemáticas de teología. El interés de esta clasificación es doble: por una parte, ella vale por sí misma en tanto tiene ciertas características originales; por otra, debido a su punto de partida. En efecto, en lugar de seguir la definición de virtud ofrecida por Hugo de (...) San Víctor –que será la adoptada, entre otros, por Pedro Lombardo–, es una de las pocas sumas de la época que toma la que propuso Pedro Abelardo. Ello la convierte no necesariamente es una rareza, pero sí en un eslabón de la historia de la ética cristiana bastante peculiar. (shrink)

María Egües (1917-2008) fue una investigadora y tecnóloga en el ámbito de los instrumentos ópticos; figura esencial para entender el desarrollo de la ingeniería óptica en las primeras décadas del franquismo. Partiendo de dos fotografías, hasta hace poco inéditas, que reflejan dos momentos cruciales de su vida profesional, este ensayo ofrece una reflexión sobre como una mujer como Egües se vio a sí misma en un tiempo en el que la mera presencia de una mujer en el sistema tecno-científico era, (...) en no pocas ocasiones, rechazada o ignorada. A partir del recurso metafórico de los periscopios submarinos, los cuales permiten ver sin ser vistos, aquella tecnóloga, cual submarino, pudo progresar en unas instituciones, el CSIC, la Universidad y el Ejército, auténticos resortes tecnológicos del Estado franquista, ante miradas hostiles o recelosas. Con todo, aquel régimen, que, parafraseando a Pedro Laín, con su «atroz desmoche», tanto había cercenado al árbol de la ciencia española, no podía permitirse despreciar la participación de algunas mujeres como Egües, imprescindibles en la reconstrucción de un sistema tecno-científico, tan necesario para la supervivencia del propio sistema, a pesar de ciertas retóricas atávicas. Así ocurrió con el desarrollo de una nada desdeñable industria de instrumentos ópticos, en especial, cómo no, aquellos de uso militar. Ámbito en el que María Egües, con forzada discreción y perseverante esfuerzo, alcanzaría uno de los más notables hitos: el diseño y fabricación de los primeros periscópios netamente españoles del siglo XX. In debates concerning the consequence argument, it has long been claimed that [McKay, T. J., and D. Johnson. 1996. “A Reconsideration of an Argument Against Compatibilism.” Philosophical Topics 24 (2): 113–122] demonstrated the invalidity of rule (β). Here, I argue that their result is not as robust as we might like to think. First, I argue that McKay and Johnson's counterexample is successful if one adopts a certain interpretation of ‘no choice about’ and if one is willing to deny the (...) conditional excluded middle principle. In order to make this point I demonstrate that (β) is valid on Stalnaker's theory of counterfactuals. This result is important and should not be neglected, I argue, because there is a particular line of objection to the revised formulations of the consequence argument that does not succeed against the original version. In this article, we seek to analyze some of the methodological assumptions that contribute to the understanding of Foucault’s nominalism, as well as some of the theoretical consequences of this nominalism. With this intent, in the first part, we deal with his “refusal” of universals, emphasizing the distinction, made in the first volume of the History of Sexuality, between sex and sexuality. In a second moment, we underline this option of Foucault’s method based on excerpts from Nietzsche that demarcate the (...) knowledge’s arbitrary and contingent character. (shrink)

Brian Cutter objected to the consequence argument due to its dependence on the principle that miracle workers are metaphysically impossible. A miracle worker is someone who has the ability to act in a way such that the laws of nature would be violated. While there is something to the thought that agents like us do not have this ability, Cutter claims that there is no compelling reason to regard miracle workers as metaphysically impossible. However, the paper contends that miracle workers (...) are indeed impossible according to well-known theories concerning the laws of nature. This result highlights the reliance of the consequence argument on a plausible premise, which is widely accepted by proponents of non-Humean views of laws. The paper also provides a way to explain away the intuition that miracle workers are possible, but this has the upshot that a recent, two-dimensional formulation of the consequence argument is unsound. The purpose of the present study is to examine the attitudes of Portuguese chartered accountants with respect to questions of ethical nature that can arise in their professional activity. Respondents were asked to respond to the Ethics Position Questionnaire developed by Forsyth (Journal of Personality and Social Psychology 39(1), 175–184, 1980), in order to determine their idealism and relativism levels. Subsequently, they answered questions about five scenarios related to accounting practices, with the objective of measuring their ethical judgments. Based on (...) the idealism and relativism levels of our respondents, they were classified into one of four groups, representing different ethical ideologies (absolutism, exceptionism, subjectivism, and situationism). The results indicated that age was the major determinant of relativism. Contrary to previous research, older respondents revealed themselves significantly more relativistic than younger ones. Gender seems to be the most important determinant of ethical judgments; against expectations, men evidenced significantly stricter judgments than women in two of the five scenarios. Findings also indicated that respondents’ ethical judgments did not differ significantly based on their ethical ideology, supporting the idea that ethical ideology is not an important determinant of ethical judgments. Rigidity does interesting philosophical work, with important consequences felt throughout metaphysics, epistemology, philosophy of mind, and so on. The authors’ aim in this article is to show that rigidity has yet another role to play, with surprising consequences for the problem of free will and determinism, for the phenomenon of rigidity has the upshot that some metaphysically necessary truths are up to us. The significance of this claim is shown in the context of influential arguments against free will. The authors (...) show that some virtually indisputable inference rules employed in formulations of the Consequence Argument, as well as in fatalistic arguments, fail with a variety of counter-examples. Ethical dilemmas affect several essential elements of humanitarian aid, such as the adequate selection of crises to which to provide aid and a selection of beneficiaries based on needs and not political or geostrategic criteria. Other challenges encompass maintaining neutrality against aggressors, deciding whether to collaborate with governments that violate human rights, and managing the allocation and prioritization of limited resources. Additionally, issues arise concerning the safety and protection of aid recipients, the need for cultural and political sensitivity, and recognition (...) of the importance of local knowledge, skills, and capacity. The appropriateness, sustainability, and long-term impact of actions; security risks for aid personnel; and the need for transparency and accountability are also crucial. Furthermore, humanitarian workers face the duty to report and engage in civil activism in response to human rights violations and the erosion of respect for international humanitarian law. Lastly, the rights of affected groups and local communities in the decision-making and implementation of humanitarian aid are vital. The traditional foundations and approaches of humanitarian aid appear insufficient in today’s landscape of disasters and crises, which are increasingly complex and divergent, marked by a diminished capacity and shifting roles of various actors in alleviating suffering. This article reviews the historical evolution of the conceptualization of humanitarian aid and addresses some of its ethical challenges and dilemmas. (shrink)

El presente artículo busca responder las siguientes preguntas: ¿Cómo fue que la idea del pensamiento infinito llegó a constituirse en el motivo central de la filosofía de Hegel?, y ¿cuál fue el derrotero que recorrió su pensamiento hasta alcanzar aquella concepción lógico-silogística de la filosofía, según la cual la Idea de esta Ciencia llega a ser la última determinación del Espíritu absoluto, y a su vez, este Espíritu absoluto se convierte en la unidad definitiva de la Ciencia enciclopédica? Una vía (...) plausible para responder a estas interrogantes consiste en poder caracterizar las configuraciones más importantes de aquella concepción de la filosofía, ocurridas al interior de la fase de pensamiento enciclopédico, a partir del seguimiento de sus conceptos culminantes –la Idea y el Espíritu absoluto. Este trabalho tem como principal foco de análise o currículo oficial português relacionado com a componente de História, para o Ensino Básico, em particular as ausências que aí mais sobressaem. Estas podem relacionar-se com os conhecimentos substantivos que se apartam da abordagem preconizada por variadas razões (passados incómodos? temas difíceis? grupos não poderosos? …) ou com as competências de pensamento histórico (multiperspetiva, significância, causalidade, empatia, …) que parecem ter sido esquecidas quando se estruturou certo percurso de aprendizagem para estudantes com (...) idades entre os 6 e os 15 anos. Como considerações maiores, constata-se, naqueles textos curriculares (denominado Aprendizagens Essenciais), uma aparente simplificação genérica da narrativa histórica que se conta aos mais jovens cidadãos do mundo atual. A inevitável seleção de determinados saberes em detrimento de outros, na verdade, contribui, acima de tudo, para o escamotear de uma literacia histórica que podia, e devia, alcançar outros níveis. O processo de ensino (e de aprendizagem) da História, desde o começo da escolaridade obrigatória, tem de orientar-se no sentido de uma formação cidadã, esclarecida, democrática, intertemporal. As inexistências no que concerne aos conteúdos considerados ou ao raciocínio potenciado, por sua vez, somente comprometem aquele desígnio. (shrink)

El análisis sobre la conocida posición de Mariano Menéndez Pelayo en torno a los mozárabes del siglo IX, podría ser tratado como un estudio de caso donde se pone de manifiesto una de las muchas instancias de persistente tradicionalismo ideológico que podemos encontrar en la historiografía española del siglo XIX ‒el artículo analiza algunas de sus raíces e implicaciones.

We argue for an account of chemical reactivities as chancy propensities, in accordance with the ‘complex nexus of chance’ defended by one of us in the past. Reactivities are typically quantified as proportions, and an expression such as “A + B → C” does not entail that under the right conditions some given amounts of A and B react to give the mass of C that theoretically corresponds to the stoichiometry of the reaction. Instead, what is produced is a fraction (...) α < 1 of this theoretical amount, and the corresponding percentage is usually known as the yield, which expresses the relative preponderance of its reaction. This is then routinely tested in a laboratory against the observed actual yields for the different reactions. Thus, on our account, reactivities ambiguously refer to three quantities at once. They first refer to the underlying propensities effectively acting in the reaction mechanisms, which in ‘chemical chemistry’ (Schummer in Hyle 4:129–162, 1998) are commonly represented by means of Lewis structures. Besides, reactivities represent the probabilities that these propensities give rise to, for any amount of the reactants to combine as prescribed. This last notion is hence best understood as a single case chance and corresponds to a theoretical stoichiometric yield. Finally, reactivities represent the actual yields observed in experimental runs, which account for and provide the requisite evidence for/against both the mechanisms and single case chances ascribed. O presente trabalho tem como tema central a educação científica antirracista. Fizemos uma problematização da Lei 10.639/2003 e da Resolução Consuni UFG nº 07/2015 para evidenciar que os referidos documentos transmitem uma ideia colonizadora. A pesquisa está fundamentada no pensamento decolonial, com destaque para as noções de colonialidade do saber e do poder. A metodologia empregada é a revisão bibliográfica, com ênfase nos principais pensadores do Grupo Modernidade/Colonialidade (M/C), como Aníbal Quijano (2005) e Ramón Grosfoguel (2016). A partir dessa base (...) teórica aplicada aos documentos legais, conclui-se que a Lei 10.639/2003 e a Resolução Consuni UFG nº 07/2015 possuem em seu texto ideias de natureza colonizadora, pois não se percebe no texto a voz daqueles que foram historicamente subjugados. Conclui-se também a importância de uma abordagem decolonial consistente na educação superior que para que se reconheça e valorize os saberes e conhecimentos dos povos marginalizados não apenas como objeto de estudo, mas como uma via para a construção de uma ciência antirracista mais consistente. The most controversial assumption of the argument is the thought that "not being responsible for" transfers across conditionals: if no one is (even partially) morally responsible for the fact that p is true, and no one is (even partially) morally responsible for the fact that p ⸧ q is true, then no one is (even partially) morally responsible for the fact that q is true. Here we (...) argue that the principle is true if one accepts a truth-maker account of the relationship between non-responsibility and propositions. While non-responsibility transfers across conditionals, one upshot of the truth-maker account is that it allows one to be responsible for necessary truths. (shrink)

In this paper, I intend to explore the 16th century Italian work entitled Divisione della filosofia (1895) by the writer Benedetto Varchi, by reflecting on concepts raised and discussed throughout the history of philosophy, such as art and science, while making a thorough analysis of the text and the conceptions exposed by the historian. From a historical-philosophical point of view, I intend to investigate a varchian corpus from the Renaissance period, thus, I examine the statements and inferences of the Florentine (...) writer, in order to make explicit his vision concerning the division and hierarchization of the areas of theoretical and practical knowledge of Philosophy. I then conclude how the classification that summarizes more than two thousand years of notions coming from Greek, medieval and renaissance philosophies could help in the formulation of the functions of knowledge and how they relate to the practical life of individuals in the Renaissance period. Parte de uma problematização sobre a política a partir da experiência do cotidiano afirma a importância da abordagem filosófica do problema e se situa como um pensar em sintonia com grupos que fazem oposição às perspectivas neoliberais que submetem a política ao econômico. Discute algumas ideias de John Holloway e Alain Badiou sobre ação política em composição com formulações relativas ao Estado e (...) a ação política como o anarquismo e Robert Nozick. A pesar de su carácter de mega-concentración, la JMJ tiene elementos suficientes para proporcionar una experiencia personalizada de fe. Todo depende, al final, de la disposición interna del participante. En la JMJ la fe es presentada no solo de un modo racional, sino apelando (...) a la afectividad, la imaginación y los sentidos. -/- // Abstract: The question «Did you go to World Youth Day?» is used as a line of reflection about the WYD in Rome in the year 2000 and about WYD in general. Despite being a mega-concentration of people, WYD has sufficient elements to provide a personalized experience of faith. Everything depends, in the end, on the internal disposition of the participant. In WYD faith is presented not only in its rational aspect, but also in a way that appeals to affectivity, the imagination and the senses. (shrink)

How does economics understand the human being? In this article, I present the current dominant conception of the human being in neoclassical theory, which is usually labelled as 'homo oeconomicus' (economic man). I describe the traits of this anthropology, and present the historical context in which it emerged. Then I make its critical evaluation. This is followed by a discussion of two recent alternative conceptions of the human being, which try to go beyond the individualist 'homo economicus' paradigm. I highlight (...) the recent contributions of John B. Davis and Luigino Bruni. Finally I reflect on some elements of Christian anthropology which can contribute to enrich the conception of the person in economics. (shrink)

A partir de dos hechos: las reiteradas referencias a la doctrina de los sentidos espirituales en los teólogos monásticos medievales y el olvido de la misma por parte de los autores posteriores, nos aproximamos a este "conocimiento experimental", desde la filosofía y la teología, partiendo de algunos testimonios de los siglos XI al XIII, especialmente los referidos a la lectio divina y al opus Dei, implorando también con ellos "Accende lumen sensíbus".

José Ortega y Gasset,, Spanish writer, philosopher and revolutionary was noted for his humanistic criticism of modern civilization. His best known work, The Revolt of the Masses earned him an international reputation. In it, he decried the destructive influence of the mass-minded, and therefore mediocre, people, who, if not directed by the intellectually and morally superior minority, encourage the rise of fascism and totalitarianism.

My dissertation is a critical study of Jose Ortega Y Gasset's attempt to reconcile his notion of lived-experience , which is fundamentally immediate experience, with his idea of life as vital-reason. But life as vital reason is, itself, best understood as consisting of life as a rational-existential project. This, in effect is Ortega's manner of fusing idealism and realism. The result of this mediation is to be interpreted as the self-with-things or what amounts to: I-in-the-world. Man is never what he (...) is in his immediacy and therefore he must create his essence through a self-conscious existential project. Thus, Ortega's notion of life as radical reality is the culmination of an underlying dialectic that is present throughout his work. That is, man's self-awareness of his life as a pre-reflective extranatural phenomenon vis-a-vis the material world can only be understood through reflection and therefore never in its immediacy. Therefore I conclude that for Ortega the synthesis of these apparently antithetical notions culminates in a form of subjective idealism given that primacy is necessarily attributed to the self over the external world. Even though I accept the fundamental tenets of his argument concerning the synthesis of Realism and Idealism and Rationalism and Vitalism, I have focused upon the inherent tension that exists in any such reflective endeavor. I believe that due to Ortega's emphasis that all reflection must originate and therefore concern itself with life as phenomenon, his philosophy necessarily gives primacy to the self over the material world . In arguing "Yo Soy Yo Y Mis Circumstancias" Ortega stresses the character of the Rational Vitalism that results from my self-awareness of my life as a problem for reflection that is forged through my necessary dealings with the world. The result of this self-knowledge is the foundation of a metaphysics of life that is best understood as man as radical reality. (shrink)

The text delivers a twofold analysis of negationism. On the one hand, it is taken as an ideological phenomenon characterized by a critique of modernity construed from the outside of its customary assumptions. On the other hand, an objective sort of negationism is found in the historical unfolding of the intrinsic limitations of modern socialization. These are brought forward by attention to the class content of the class character of the institutions regularly evoked by the apologetics of modernity – civil (...) society, science, the State. Progressivism, we suggest, the main target of negationism, is the tradition occupied with that apologetics, either promoting an intellectual critique of, or simply overlooking, the afore-mentioned class character, which, however, becomes historically undeniable to the common people, consistently victimized by it throughout modern history. In this sense, the modern social process is characterized as civil war. (shrink)
