A rational moral code must satisfy the condition of completeness. This same condition applies to a set of moral rights, where it takes the form of requiring that all the rights in that set be compossible: that their respective correlatively entailed duties be jointly fulfillable. Such joint fulfillability is guaranteed only by a set of fully differentiated individual domains. And if moral rights are to play any independent role in moral reasoning - any role logically independent of the values that (...) bring persons into conflict - those domains must be determined by rules which are not derived from those values. Health care reforms, in particular the expansion of public and/or private health care benefit coverage to some or all population groups, is becoming an increasingly hot topic for discussion—and in some cases for action—at all levels of government. With almost 16% of Americans estimated to be uninsured for at least part of the year, opinion polls show health care near the top of the general public’s list of concerns. Little wonder that presidential candidates for the 2008 election are incorporating ‘‘universal (...) health care coverage’’ proposals in their campaign platforms. Will ‘‘cradle-to-grave’’ coverage for all become a reality or will they just experience cradle-to-grave debates over this issue? That is essentially one of the questions posed in the following discussion on the role of nonprofit health care organizations in promoting, and operating under, universal health care coverage. Thomas Pogge's Global Resources Dividend relies on a flat tax on the use of natural resources to fund the eradication of world poverty. Hillel Steiner's Global Fund taxes the full rental value of owned natural resources and distributes the proceeds equally. The paper compares the Dividend and the Fund and defends the Global Share, a novel proposal that taxes either use or ownership, does so (when possible) progressively, and distributes the revenue according to a prioritarian rather than a sufficientarian (...) or egalitarian principle. Two of the greatest challenges facing humanity are environmental degradation and the persistence of poverty. Both can be met by instituting a Global Resources Dividend (GRD) that would slow pollution and natural-resource depletion while collecting funds to avert poverty worldwide. Unlike Hillel Steiner's Global Fund, which is presented as a fully just regime governing the use of planetary resources, the GRD is meant as merely a modest but widely acceptable and therefore realistic step toward justice. Paula Casal has (...) set forth various ways in which this step might be improved upon. Solid counter-arguments can be given to her criticisms and suggestions. But to specify the best (effective and realizable) design of an appropriate global institutional mechanism with some confidence, economists, political scientists, jurists, environmental scientists, and activists would need to be drawn in to help think through the immense empirical and political complexities posed by this urgent task. In this study, we investigated endorsement of two types of prescriptive views of aging, namely active aging and altruistic disengagement. The study comprised a large international sample of middle-aged and older adults, covering the age range from 40 to 90 years. Participants rated their personal endorsement of prescriptive views of active aging and altruistic disengagement targeting older adults in general. Findings showed that endorsement was higher for prescriptions for active aging than for prescriptions for altruistic disengagement. Age groups in the (...) sample differed regarding their endorsement of both prescriptive views of active aging and altruistic disengagement with older adults showing higher endorsement than middle-aged adults did. Prescriptive views of active aging and altruistic disengagement related positively to each other and to the superordinate social belief that older adults should not become a burden, which attests to their functional similarity. In contrast, prescriptive views of active aging and altruistic disengagement were associated with psychological adjustment in opposite ways, with endorsement of active aging being related to better adjustment outcomes such as life satisfaction and subjective health. Our findings highlight the internalization of prescriptive views of aging in older people and their implications for their development and well-being. (shrink)

In the last 30 years, the key issue in developmental Theory of Mind has been if and when children are capable of representing false beliefs. Moving away from this research question, the aim of this study was to investigate the role of attentional processes in false-belief tasks. We focused on the design of the test phase and investigated two factors that may be critical for 3-year-old children’s success: the form of the wh-question and the salience of the target object. The (...) results of two experiments confirmed that 3-year olds are able to explicitly choose the correct answer in a false-belief task provided that they are allowed to focus on the protagonist throughout the task. The salience of the target object, however, was a critical factor in the design of the test phase, as increasing it had a negative effect on children’s performance. These results suggest that the experimental record of the last 30 years may be skewed since standard false-belief tasks do not control for the relative salience of the wrong response, potentially hindering the performance of children under 4. We conclude that a careful investigation of performance factors in false-belief tasks has the potential to reveal deep insights into the development of Theory of Mind skills, even if not directly focused on children’s representation of beliefs. Morphophonological alternations, such as the voicing alternation that arises in a morphological paradigm due to final-devoicing in Dutch, are notoriously difficult for children to acquire. This has previously been attributed to their unpredictability. In fact, the presence or absence of a voicing alternation is partly predictable if the phonological context of the word is taken into account, and adults have been shown to use this information ( Ernestus and Baayen, 2003 ). This study investigates whether voicing alternations are predictable from (...) the child’s input, and whether children can make use of this information. A corpus study of child-directed speech establishes that the likelihood of a stem-final obstruent alternating is somewhat predictable on the basis of the phonological properties of the stem. In Experiment 1 Dutch 3-year-olds’ production accuracy in a plural-elicitation task is shown to be sensitive to the distributional statistics. However, distributional properties do not play a role in children’s sensitivity to mispronunciations of voicing in a Preferential Looking Task in Experiment 2. (shrink)

Participants scoring high and low on a measure of repressive coping style (Mendolia, 2002) first learned a series of related word pairs (cue–target). Half of the cues were homographs. In the subsequent think/no-think phase (Anderson & Green, 2001), they responded with targets on some trials and suppressed thoughts of targets on others. Suppressed targets were always emotionally negative, as were targets associated with baseline cues reserved for the final test. Some participants were provided with emotionally benign or positive substitutes to (...) help them suppress, and these substitutes were related to different meanings of the homographic cues, compared to those established by the targets. On the final test, all cues were presented for target recall. Only the repressors significantly benefited from the provision of positive substitutes to aid forgetting of the negative targets, regardless of the nature of the cues. (shrink)

Can work be done for pay, and still be loving? While many feminists believe that marketization inevitably leads to a degradation of social connections, we suggest that markets are themselves forms of social organization, and that even relationships of unequal power can sometimes include mutual respect. We call for increased attention to specific causes of suffering, such as greed, poverty, and subordination. We conclude with a summary of contributions to this Special Issue.

Parents have the autonomous right to choose or refuse a treatment for their child, even those that are life sustaining, if it is extraordinary or disproportionate and it is within the best interest and well-being of their child. Pediatric health care is practiced with the goal of promoting the best interests of the child to do so. Treatment is generally rendered under a presumption in favor of sustaining life. However, in some circumstances, the balance of benefits and burdens to the (...) child leads to an assessment that forgoing life-sustaining medical treatment (LSMT) is ethically supportable or advisable. Input from specialists in palliative care, ethics, pastoral care, and other disciplines enhances support for families and medical staff when decisions to forgo LSMT are being considered. (shrink)

O presente artigo tem por pretensão central discutir alguns aspectos fundamentais da crítica de Nietzsche à metafísica, já nas suas primeiras reflexões filosóficas. Para tanto, serão mobilizados alguns de seus principais argumentos contra o estabelecimento da vontade como coisa em si no pensamento de Arthur Schopenhauer, e, por conseguinte, contra o próprio estatuto da metafísica nesta filosofia, de tal modo que se possa demonstrar as soluções encontradas pelo próprio autor a favor da possibilidade da metafísica. O artigo conta ainda, desse (...) modo, poder contribuir para as discussões em torno da relação entre reflexões privadas e textos publicados do filósofo alemão, na medida em que defende a tese de que a partir de uma análise da crítica à metafísica em suas anotações pessoais se pode compreender os germes da mudança de postura em relação à mesma em seus textos publicados. In this study, we investigated explicit and implicit endorsement of prescriptive age stereotypes. To achieve that, we captured endorsement of a wide range of prescriptive expectations targeting both younger and older people. Younger and older adults participated in the study. We assessed implicit endorsement of prescriptive age stereotypes with the Propositional Evaluation Paradigm and used a direct measure to assess explicit endorsement. In general, we found strong support for age-specificity in both explicit and implicit endorsement of prescriptive age stereotypes: Sentences (...) ascribing expectations for young/old to the respective age group were endorsed much more strongly than sentences in which expectations for young/old were ascribed to the other age group. Age group differences in the endorsement of prescriptive age stereotypes were found. Compared to younger participants, older participants showed stronger endorsement for prescriptive beliefs targeting both younger and older targets. Explicit and implicit endorsement of prescriptive age stereotypes did not correlate with one another, thus revealing they might assess independent belief systems with different predictive potential. A large literature documents the correlates and causes of subjective well-being, or happiness. But few studies have investigated whether people choose happiness. Is happiness all that people want from life, or are they willing to sacrifice it for other attributes, such as income and health? Tackling this question has largely been the preserve of philosophers. In this article, we find out just how much happiness matters to ordinary citizens. Our sample consists of nearly 13,000 members of the UK and US (...) general populations. We ask them to choose between, and make judgments over, lives that are high in different types of happiness and low in income, physical health, family, career success, or education. We find that people by and large choose the life that is highest in happiness but health is by far the most important other concern, with considerable numbers of people choosing to be healthy rather than happy. La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. Es crucial que la regulación sea integral y adaptable para garantizar un sistema jurídico justo y equitativo en la era digital. (shrink)

O presente artigo tem por objetivo demonstrar como o Estado mínimo proposto por Robert Nozick invariavelmente tenderia a acabar, a menos que seus membros fossem coagidos pelo poder central a contribuir para sua manutenção. E, neste caso, obviamente violaria os direitos e liberdades que o mesmo Estado proposto pelo filósofo teria função de garantir. Analisaremos as falhas no modelo proposto por Nozick através de um viés econômico, demonstrando através da teoria dos jogos e da lógica da ação coletiva, como uma (...) organização provedora de bens públicos não-excludentes é vulnerável à atuação de free- riders, aumentando assim os custos de sua atuação, e diminuindo os incentivos para sua existência. This article aim to show the aesthetics and ethics values whose relation traces could be found in theological text studies. We use bibliographic review as methodology to this research. Considering these elements and how it was found we ask: how can we validate such elements to understand the theological text? When we are analyzing ethics behaviors can we consider the found results as intrinsic values in such discoveries and can it be compared in different times, in other words, it is (...) available if we bring it out to our time without prejudice considering criteria. We know values and beliefs can change according different times, but the main question that translates our doubt is: how can we consider the ethical and aesthetical values described in different times avoiding damage then to be impartial in the research? In spite of lots of doubts rose, what can support on our research reading are historic and current images we can validate as support line to comparative analysis considering ethics and aesthetics values found. El análisis interdisciplinar de la actual política de drogas brasileña, de carácter prohibicionista, lleva a la conclusión que ella ha frustrado las expectativas de aquellos que creían que la promulgación de la Ley 11.343/06 resultaría en un tratamiento distinto a los usuarios y a los traficantes de drogas. Es posible observar una dificultad en el acceso para uso médico a las sustancias que hoy son consideradas ilícitas, la ausencia de criterios legales objetivos para distinguir usuarios de traficantes, y el foco (...) de la persecución penal no está direccionada a los grandes traficantes de drogas, que siguen lucrando, sin que haya una reducción del consumo, ni del comercio. El modelo de seguridad pública está alejado de los principios y garantías previstos en la Constitución Federal, identificando personas pobres y negras como potencialmente criminales. Así, partiendo de la premisa de que la actual política de drogas está siendo regentada de manera irracional, violando los derechos humanos, y desde una perspectiva crítica, son propuestos caminos para la superación de los problemas identificados. O intuito é compreender a polêmica do pensador para além de uma mera querela dinamarquesa e paroquial, situando-a num contexto maior de crítica à imprensa e, nessa mesma direção, almeja compreender o quanto o autor dinamarquês se enquadraria no modelo do típico intelectual do século XIX. The relationship between law and morality is a topic which receives special importance and attention, especially in "liberal democracies" in which the law is supposed to regulate highly pluralized and fragmented societies. Under conditions of plurality of values, many social forces and legal theories require a certain kind of neutrality from the legal system, a means of compatibility of the many "world views" and "moral systems" that are present within the same social space. Such a conciliating commitment sounds particularly relevant (...) in times of the doctrinal ubiquity of ideas such as "peace based on human rights". This was the title of the 28th World Congress of the IVR in Lisbon, with the special workshop "Law and Morals" on which this book is based. O objetivo do presente artigo é analisar o quanto o chamado idealismo italiano de Croce e Gentile são, em verdade, dependentes da concepção religiosa italiana. Para tanto, nos deteremos, na primeira parte do nosso trabalho, principalmente numa análise das teses de Maurizio Viroli. Já no segundo parte do nosso artigo nos deteremos na análise dessa temática dentro do conceito de religião da liberdade em Croce. Assim, após tal inventário, teceremos nossas conclusões.

Clarice Lispector puts forth nothing less than a complete philosophy of time in her writings, that is, a cohesive philosophical examination of what time is, of its physics and metaphysics, of how humans and animals perceive time, and even an innovative aesthetic theory in which time is the inspiring force giving rise to literary and artistic creation. Her view of time is unique in the Western philosophical canon, offering original solutions to many of time’s classic difficulties. For Lispector, time is (...) pure actuality. Reality is an unwavering present that never stops being, is fully material, and is ceaselessly attentive to itself. The present, matter, and attention form the unquestionable unit of the real and the core of Lispector’s philosophy of time. Supporting this structure is her inventive metaphysics of time, anchored in her notion of the “fourth dimension of the instant-now,” which is given close attention. (shrink)

Based on an endorsement of the hypothesis of extended cognition , this paper proposes a criticism of the representationalist assumptions that still pertain to these contemporary models of cognition. I first rehearse some basic problems akin to any representationalist model of cognition, before proposing some more specific arguments directed against the necessity, the plausibility, and the coherence of the marriage between extended cognition and contemporary representationalism . Extended and distributed models of cognition have the resources to get rid of representationalism, (...) and they should better do it.
