An adequate account of laws should satisfy at least five desiderata: it should provide a unified account of laws and chances, it should yield plausible relations between laws and chances, it should vindicate numerical chance assignments, it should accommodate dynamical and non-dynamical chances, and it should accommodate a plausible range of nomic possibilities. No extant account of laws satisfies these desiderata. This paper presents a non-Humean account of laws, the Nomic Likelihood Account, that does.

Predation and escaping from predation through hiding are two fundamental phenomena in ecology. The most common approach to reducing the chance of predation is to use a refuge. Here, we consider a three species fishery model system with prey refuge induced by a Holling type-II functional response. These three species of fish populations are named prey, middle predator, and top predator. Harvesting is employed in most fishery models to achieve both ecological and commercial benefits. Research proves that non-linear harvesting (Michaelis–Menten (...) type) returns more realistic outcomes. So, we have combined the Michaelis–Menten type of harvesting efforts for all populations. Uniform boundedness conditions for the solutions of the model are discussed. The existence conditions for possible equilibrium points with stability are presented. We explain the dynamical behavior at each equilibrium point through bifurcation analysis. The persistent criteria of the system are examined. Bionomic equilibrium and optimal harvesting control using Pontryagin’s maximum principle are calculated. For validation of the model in the real world, we have implemented this in the freshwater ecosystem of Lake Victoria. Extraction of native fish species and ecological balances are the foremost solicitude of Lake Victoria. We may resolve this concern partially by implementing prey refuge, since it may sustain the ecology of Lake Victoria, and therefore also its economical importance. Lake Victoria is acclaimed worldwide for the trade of fishing. Also, it provides the largest employment in east-central Africa and is beneficial to fishing equipment manufacturers. So, the bionomic equilibrium and harvesting control have significant applications in the fisheries. All the analytical studies are verified by numerical simulations. We have plotted phase portraits, bifurcation diagrams, Lyapunov exponents to explore the dynamics of the proposed model. (shrink)

This article aims to highlight the extent to which Kant’s account of belief draws on the views of his contemporaries. Situating the non-evidentialist features of Crusius’s account of belief within his broader account, I argue that they include antecedents to both Kant’s distinction between pragmatic and moral belief and his conception of a postulate of pure practical reason. While moving us closer to Kant’s arguments for the first postulate, however, both Crusius’s and Meier’s arguments for the immortality of the soul (...) fail to anticipate the most important aspect of their Kantian counterparts. Developing the non-evidentialist features of Basedow’s account of belief, I distinguish it from its Pascalian and Jamesian relatives and argue that it is the clearest antecedent to Kant’s arguments for the first and second postulates. Finally, I consider the development of Kant’s account of belief after the first Critique in light of the foregoing, and discuss the broader implications of my analysis. (shrink)

Maxwell's deduction of the probability distribution over the velocity of gas molecules—one of the most important passages in physics (Truesdell)—presents a riddle: a physical discovery of the first importance was made in a single inferential leap without any apparent recourse to empirical evidence. -/- Tychomancy proposes that Maxwell's derivation was not made a priori; rather, he inferred his distribution from non-probabilistic facts about the dynamics of intermolecular collisions. Further, the inference is of the same sort as everyday reasoning about the (...) physical probabilities attached to such canonical chance setups as tossed coins or rolled dice. The structure of this reasoning is investigated and some simple rules for inferring physical probabilities from symmetries and other causally relevant properties of physical systems are proposed. -/- Not only physics but evolutionary biology and population ecology, the science of measurement error, and climate modeling have benefited enormously from the same kind of reasoning, the book goes on to argue. Inferences from dynamics to probability are so obvious to us, however, that their methodological importance has been largely overlooked. (shrink)

If the Past Hypothesis underlies the arrows of time, what is the status of the Past Hypothesis? In this paper, I examine the role of the Past Hypothesis in the Boltzmannian account and defend the view that the Past Hypothesis is a candidate fundamental law of nature. Such a view is known to be compatible with Humeanism about laws, but as I argue it is also supported by a minimal non-Humean "governing'' view. Some worries arise from the non-dynamical and (...) time-dependent character of the Past Hypothesis as a boundary condition, the intrinsic vagueness in its specification, and the nature of the initial probability distribution. I show that these worries do not have much force, and in any case they become less relevant in a new quantum framework for analyzing time's arrows---the Wentaculus. Hence, the view that the Past Hypothesis is a candidate fundamental law should be more widely accepted than it is now. (shrink)

Within the current mainstream research in the foundations of physics, much attention has been turned to the program of Axiomatic Reconstruction of Quantum Theory in terms of Information-Theoretic principles (ARQIT). ARQIT aims at finding a few general information-theoretic principles from which, once translated into mathematical terms, one can formally derive the structure of quantum theory. This chapter explores the role of mechanistic explanations and mathematical explanations (in particular, structural explanations) within ARQIT. With such considerations as a point of departure, we (...) investigate how ARQIT contributes to the explanation of quantum phenomena, and the possible prospects for explanations provided by mechanical interpretations of quantum theory. This paper examines the role of coherence of evidence in what I call the non-dynamic model of confirmation. It appears that other things being equal, a higher degree of coherence among pieces of evidence raises to a higher degree the probability of the proposition they support. I argue against this view on the basis of three related observations. First, we should be able to assess the impact of coherence on any hypothesis of interest the evidence supports. Second, the impact of (...) coherence among the pieces of evidence can be different on different hypotheses of interest they support. Third, when we assess the impact of coherence on a hypothesis of interest, other conditions that should be held equal for a fair assessment include the degrees of individual support which the propositions directly supported by the respective pieces of evidence provide for the hypothesis. Once we take these points into consideration, the impression that coherence of evidence plays a positive role in confirmation dissipates. In some cases it can be shown that other things being equal, a higher degree of coherence among the pieces of evidence reduces the degree of confirmation for the hypothesis they support. (shrink)

According to Humean theories of objective chance, the chances reduce to patterns in the history of occurrent events, such as frequencies. According to non-Humean accounts, the chances are metaphysically fundamental, existing independently of the "Humean Mosaic" of actually-occurring events. It is therefore possible, by the lights of non-Humeanism, for the chances and the frequencies to diverge wildly. Humeans often allege that this undermines the ability of non-Humean accounts of chance to rationalize adherence to David Lewis' Principal Principle (...) (PP), which states that an agent's degrees of belief should match what they take to be the objective chances. In this paper, I propose two approaches to justifying (PP) for non-Humean chance, hence defusing the Humean objection. The first approach justifies (PP) via the role it plays in informing outright beliefs about long-run frequencies. The second approach justifies (PP) by showing that adherence to (PP), even for non-Humean chance, maximizes expected epistemic utility according to the actual objective chance function. I then address an objection to this approach, concerning the alleged circularity of the derivations. (shrink)

Notions of complexity, non-linear dynamics and self-organization in the natural sciences seem to resonate with certain literary and social scientific traditions of thinking about cosmopolitan life in a sense that may be more than merely metaphorical. Just as science speaks of forms and patterns which come into being spontaneously, unpredictably and `from below', so too is there a resurgent interest in a `baroque' vision of modernity which foregrounds chance encounters and `underworld' associations. The parallels are still stronger if we take (...) a consider the life-world of embodied cosmopolitans as including not only other human beings and human artifacts, but also the many non-human life-forms that make themselves at home in our built environments, in our networks, and inside our own bodies. Contra theorists of risk society, fusion of complexity theory with cosmopolitan aesthetics raises the possibility of conceiving of runaway biological and technological events as both creative and destructive. I show that standard dynamic approaches to the semantics of epistemic modals invalidate the classical laws of excluded middle and non-contradiction, as well as the law of epistemic non-contradiction. I argue that these facts pose a serious challenge.

In this paper, we describe a framework for studying social agents’ individual decision making, that takes account of the environment and social dynamics. We describe a study in which we explored the efficiency of foraging strategies within a group of individuals faced with a resource-limited environment. We investigated to what extent cooperative and non-cooperative behaviors impacted on the survival rates of a population of individuals. In the experiment presented here, we considered two different types of individuals: selfish individuals who gather (...) energy for their own use, and cooperative individuals who share the energy they gather with others, thus reducing their own individual chances of survival. In order to study the trade-off between non-cooperative and cooperative behaviors in a pseudo-realistic two-dimensional environment, we introduced an agent-based modeling and simulation tool called ACACIA-ES, which simulated local interactions and spatial behavior for large numbers of individuals in complex environments. The main result from our simulation was that a group of cooperative individuals displayed better survival strategies than groups of selfish individuals when faced with a variety of environmental pressures; however, it was very unlikely that such cooperative strategies could resist competition from selfish individuals, if the outcome of past social interactions was memorized, even when a very small group of selfish individuals was introduced. This book examines in detail two of the fundamental questions raised by quantum mechanics. First, is the world indeterministic? Second, are there connections between spatially separated objects? In the first part, the author examines several interpretations, focusing on how each proposes to solve the measurement problem and on how each treats probability. In the second part, the relationship between probability (specifically determinism and indeterminism) and non-locality is examined, and it is argued that there is a non-trivial relationship between probability and (...) non-locality. The author then re-examines some of the interpretations of part one of the book in the light of this argument, and considers how they fare with regard to locality and Lorentz invariance. The book will appeal to anyone with an interest in the interpretation of quantum mechanics, including researchers in the philosophy of physics and theoretical physics, as well as graduate students in those fields. Our entire political and economic systems are based upon structures of symbolic representation that many times seem not only to embody monetary value but also to determine it. The connection between monetary (...) and linguistic exchanges is self-evident: the former requires the latter and develops in direct relation to it. Creative experimentation and design of digital systems of value exchange are blossoming on the web. Dr. Gilson Schwartz, an economist turned media theorist and professor at the University of São Paulo, adopted the concept of Iconomics, originally created by Michael Kaplan, an author concerned with the linguistics of economic value. Empowering local communities and unlocking new levels of value creation and representation via digital technologies are the main goals of Dr. Schwartz’s projects, aiming at the re-designing of our relationship to the economic value of imagination and the social control of property. Renata Lemos-Morais: You have recently produced and directed a short documentary about Creative Currencies in Latin America. Could you tell us a bit about its process and its findings? Gilson Schwartz: The “Creative Currencies” project is a work-in-progress platform which unfolds as an action research agenda connected both to the production of audiovisual content and the development of social currency software. The initiative dates back to 2003 when I led an experimental project supported by the Presidency of Brazil. At that time, we issued paper currency in a small, touristic village in the Northeast Region which stimulated local cultural projects. But it was only in 2009 that the Central Bank of Brazil acknowledged “social currencies” as a legitimate economic agenda, calling for more debate at the I Financial Inclusion Forum. This year, the monetary authorities organized a second forum that also opened the room to discussions on mobile payment systems and new perspectives on poverty alleviation via State subsidies. The Ministry of Culture funded the “Creative Currencies” project in 2009-2010 and our next stage in this discovery process is to be supported by the National Social and Economic Development Bank (BNDES). In short, there is genuine interest among public officials in different areas and public funding for social currencies is on the rise in Brazil. However, after all these years we are still at a very early stage of research and practice. Some of the most successful initiatives (such as Banco Palmas) actually evolved out of local monetary creation to become correspondent banking operations for commercial banks and other financial groups. After eight years of price stability and social inclusion, Brazil stands out as a major opportunity for social experimentation, even the Grameen Bank is now entering the Brazilian market and many NGOs are geared towards different forms of entrepreneurialism in the base of the pyramid, riding solidarity economic models, microfinance and microcredit for local development. It is yet to be seen, however, whether these developments are just one more stage of “bankarization”, that is to say, an extension of regular banking services or actually a new form of social and symbolic self-determination at the local level. So far, the Central Bank of Brazil is open to new forms of credit and local finance as long as they are strictly territorial and very close to barter among the poor. In other words, whether the process of monetary creation could be made to fit an open source paradigm is yet to be seen. Community banking and social currencies might as well end up as just another channel for access to and use of banking services. The “Creative Currencies” project aims at promoting the discussion of more fundamental issues, such as the limits of central banking, the prospects for local financial development and the possibility of creating and managing financial icons as cultural assets. The purpose of this project is to produce short documentaries that will bear testimony to this evolving regulatory framework while inducing more discussion about the fundamental iconomic issues concealed in the process of money and wealth creation. RLM: What new potential is there in applying digital technologies to currency creation? GS: Globalization is a result of the virtualization of money, that is, the overcoming of illusions such as the “gold standard”. Money is an icon created by institutions, not on supposedly natural or material foundations but out of political and financial interests. The “dollar standard” is an outstanding evidence of this phenomenon and Kaplan´s paper, the first to use the expression “iconomics”, insists on the rhetoric and semiotic effects associated to a supposedly scientific model of money creation and management. This is a fundamental change that was perceived and discussed much before the digitalization of the world by unorthodox economists such as John Maynard Keynes since the early 20th century. The digitalization of global financial flows accelerated this immateriality and the creation of the Euro was yet another evidence of the political foundations of currencies. The banking establishment, however, is keen on the idea that scientific formulae hold the key to sound money creation. Keynesianism has been repeatedly associated to “inflationism” while the supposedly sound monetary policies of the Orthodoxy serve well the political and financial interests of a technocratic elite. Corporate media also serve this fictitious depiction of the monetary process despite the cyclical bust of monetary rules and financial regulations. The internet, however, has created numerous opportunities for the disintermediation in industries such as film, music and commodities. There is no reason to doubt that the financial industry can also be transformed by Peer-to-Peer (P2P) infrastructures. Money is media as well. Credit is but confidence. Once people realize that the distributed computing power of networks can also be the platform to weave new monetary and credit operations, there is room for grassroots emancipation out of the established owners of monetary institutions. So far, however, there has been a privatization of monetary management and there is not a clear path or model for the emergent (P2P) property democratization that is inherent to the internet. Digital assets, however, clearly have an inherent potential to escape central control and proprietary regulatory frameworks. RLM: How are social networks transforming the ways in which we exchange value? Do you believe that online influence and reputation might be translated into a new kind of currency? GS: The foundation for social currencies as envisaged by solidarity economics is the territory. Authorities are willing to concede local monetary creation as long as it is restricted to poor neighborhoods, as a proxy to barter. In this relevant but limited context, reputation, personal knowledge and informal ties form the matrix of local or “proximity” finance which are expected to keep credit and leverage to a sustainable level. Anything beyond that should and would lead to an integration of local finance into the established banking system. However, inasmuch as the internet promotes virtual territories and reputation is now subject to all sorts of digital manipulation and stardom becomes an everyday cultural process among teenagers and elders alike, the territorial “foundation” is substituted for more complex patterns of solidarity, cooperation and exchange that reach beyond the physical territory and even the “human.” Digital assets embody knowledge, technology, cultural and educational values that are exchanged at a global scale beyond the control of democratic States (Chinese-like intervention is the exception, not the rule). Hacktivism is unstoppable and so is monetary hacktivism. Especially in the Third World, mobile communications fast became conveyors of money transfers and other appropriation strategies. Banking and telecom sectors already battle for the control of these emerging markets and, as a matter of fact, have so far contributed to the containment of these processes. Governments serve these moguls and have usually adopted a wait-and-see attitude. If open source hardware and grassroots social movements combine to challenge these proprietary battles, then social networks may evolve into new forms of social capital and thus form the ground on which to design and implement social currencies. The global financial crisis, as well as the dollar demise, are an event of such a proportion that social networks may open the path for emancipator subjects to seize the opportunity. RLM: What are some of the social experiments that you think are revolutionizing the way in which value is exchanged? GS: There is a broad evolution of economic systems towards the valuation of intangible assets such as knowledge, reputation and sustainability. There are many examples of local as well as global events that call the traditional systems of exchange into question, from carbon credits to educational bonuses, digital barter frameworks and locally based solidarity and fair trade networks. These emerging examples, no matter how different in nature or scale, represent a challenge to the traditional value creation schemes and theories which are based on use and exchange value, supply and demand. This is not to say that utility and labour or scarcity are to be totally dismissed, but there is now an emerging perception that value is also a function of behavioral codes, symbolic patterns and the energy of institutional frameworks. The plasticity of digital platforms is relevant insofar as intellectual property becomes the central source of value creation. But when you discuss the property rights of public goods such as the environment or basic social rights (of minorities or localities), then a new paradigm seems to emerge. RLM: Are gaming and online storytelling digital practices that might have an impact on the way new currencies are created and developed? GS: “Play money” has been one of the early and most intriguing phenomena associated to the diffusion of virtual worlds. These virtual currencies have also been prone to “boom and bust” dynamics, speculation and pure theft (Second Life scams were common and led to “intervention” by the owners of the game). Storytelling is a major source of value, that is, the value of attention and the markets for audience. There are plenty of private monies created and managed by corporate entertainment groups, telecom operators (via mobile virtual network operators) and marketing frameworks. The casino economy, as already depicted by Keynes and other unorthodox economists, is always storytelling about future states of the world, confidence building and leverage of animal spirits. The novelty of current events is not the fictitious nature of any form of capital, but the potential for digital democratization of controls over the imaginary nature of value creation. But this is just a potential, a possibility, a figment that more often than not is appropriated by centralized and opaque private powers. The game industry is a testbed for new connections between storytelling and money creation. RLM: Monetary value was originally connected to the scarcity of precious metals, such as gold. Our entire monetary system seems therefore to function according to a logic of scarcity. Do you believe it is possible to reverse this logic into a logic of abundance? GS: The gold standard was a fiction itself, the “scarcity” is always produced by institutions that regulate confidence and access to credit. The key issue is not to fabricate abundance, but to question the institutions which produce scarcity out of any standard, gold or whatever. Central banks are at the service of private banks in the creation and management of scarcity. RLM: The promise that nanotechnology holds for our future is one of radical abundance (or so say transhumanists). The possibility of creating any kind of material substance through nanoengineering seems each day more feasible. What would this possibility entail in terms of systems of value exchange? GS: Nanotechnology, environmental concerns and grassroots appropriation of distributed knowledge are the frontiers of a new horizon of energy creation and management. Social groups in charge of managing scarcity for the sake of wealth and power concentration must be held accountable for the destruction of our future. Once this key political conundrum is accounted for, new systems of value exchange and even a non-mercantile society will come into existence. Revolutionary theorists such as Marx envisaged transformation via the extreme clash of contradictions between capital and labour. This approach has never led to a change in the systemic logic of scarcity for the sake of social control. We are once again facing the threshold of large scale societal change, but the outcome of the current crisis should come from our imagination, not from yet another paradox of abundance and scarcity. As long as we remain attached to the materiality of value, the illusion of freedom will but reinforce the massive manipulation of necessity. RLM: What do you think is the role of crowdfunding in this context? GS: Crowdsourcing as well as crowdfunding are examples of the peer to peer opportunities that come along with distributed computer power. However, the power structure behind wealth and scarcity creation may or may not be changed by crowd management. But it should not be taken at face value, so to speak. The stock market of course is an early form of crowdfunding without calling into question the proprietary framework of the companies offering their investment projects to the market. Any market is a form of crowdsourcing, that is to say, of distributed forms of supply and demand matchmaking. The wealth of networks, however, depends on the contractual ecosystem, the institutional framework, the channeling of social imagination, not on the purely quantitative distribution of bids and offers. I see economics as supply, demand and code. Once you have access to the code, once openness becomes part of the game, then there is a chance of crowd behavior becoming collective intelligence and sustainable imagination. RLM: Is the development of digital currencies headed towards a pluralistic ecology in which many micro currency systems co-exist, or is it penetrating the mainstream monetary system? If it is affecting the mainstream financial system, what would be its effect in the long-term? GS: The same issue is at stake both at local and global levels. The global system is, as a matter of fact, an unstable ecosystem of “micro currencies” whereas the dollar has so far exerted an overwhelming influence. Local currencies and private monies coexist with national currencies only to the extent that the Central Bank admits, for instance, that grassroots monetary emissions remain territorial and strictly connected to poverty. However, the question of how new developments in digital technologies and nanotechnologies might alter not only our current monetary systems but also our understanding of value in itself, is still an open question. Chinua Achebe, the Nigerian novelist, is one of the outstanding figures in modern African literature whose works can be taken as early attempts in literature to move toward de-colonization. Achebe provides an alternative discourse which can depict not only an authentic picture of the native African life with all its complexity, but also dynamic native characters in such a context: real-life black characters with humane existential conflicts who can contemplate on what has been affecting their African pre-colonial identity. What makes (...) Achebe’s novels different from other novels is the way he relies on the notions of ‘Otherness’ and ‘hybridity’ in constructing his alternative non-Eurocentric discourse. This book studies four novels by Chinua Achebe i.e. Things Fall Apart, No Longer at Ease, Arrow of God, and A Man of People, so as to investigate how he has constructed his alternative discourse; a discourse which has been successful in providing a room where the colonized are given voices to speak and the reader has a chance to understand better their world and what they have confronted because of colonization. Since each novel focuses on a different colonial or postcolonial phase in Nigeria and Achebe has made use of different discursive strategies in each of them, it can be claimed that taking them as a tetralogy and studying them together can result in providing a vivid picture of Achebe’s discourse and what his novels seek to mirror about the Nigerian hybrid identity and the colonized man’s struggles in the way of dealing with ‘otherness’ and difference. Henry Shue’s latest book, The Pivotal Generation: Why We Have a Moral Responsibility to Slow Climate Change Right Now, is an excellent read, both clear and comprehensive. It is written in a way that makes it accessible to philosophers and non-philosophers alike. The book argues persuasively that the people alive today must take immediate and drastic action to tackle climate change, as the current decade will be crucial for determining how severe the impacts will become. Shue warns how a sharp (...) division into past, present, and future is misleading when it comes to climate change and can obfuscate the extent of the responsibility that the current generations bear. For us to acknowledge our responsibility, we must recognise how deeply intertwined our lives are with both the past and the future. One of these innate deep connections between generations is the extensive time period that carbon emissions can continue to contribute to climate change, for dozens of centuries. -/- The current generations have been bequeathed an energy system that relies on fossil fuels and that continues to add greenhouse gases to the atmosphere. For over two centuries now, the planet has been getting warmer as an unintended side effect of industrialisation. We are the first humans to understand the dynamics of the Earth’s climate and how human actions cause anthropogenic climate change. With the rapidly advanced scientific knowledge, it has become apparent that there is a need to quickly transition to a different energy regime. Shue points out that this knowledge has made us the first humans to recognise that action is required, but the urgency of the problem also makes us possibly the last to still be able to act before certain major threats are aggravated. With many irreversible climate change impacts, the date-of-last-opportunity to take action to prevent them might be very soon. According to Shue (2021, p. 6), “This gives us an awesome responsibility. Humans have accidentally set our own house on fire, and if we do not douse the flames while they are no more extensive than they are now, it may not be possible ever to extinguish them”. That is why we alive now are the pivotal generation. -/- Although a sense of urgency runs through the book and the seriousness of the situation is made very clear, Shue steers away from fearmongering. He does not think that human extinction is around the corner, but underlines that we cannot rule out such threats until we stop feeding the beast. Unless we cap emissions at a relatively safe level and transform our infrastructure to net zero, we will keep on increasing risks to future people by “adding continuously to the mushrooming danger” (p. 23). The book stresses that the possibility of passing several tipping points adds to the urgency and the risks because when positive feedback mechanisms are triggered, climate change accelerates. These positive feedbacks can feed into each other, such as when warming seawater melts even more ice, with the possibility of a cascade of feedbacks if enough tipping points are passed. Such changes are irreversible and could themselves become further positive feedbacks. Shue (pp. 24–25) warns that it is “likely that the near future is the last chance to avoid passing significant tipping points and entirely possible that the near future is the last chance to avoid provoking a cascade of tipping points” (emphasis in original). -/- While I applaud the general message of Shue’s book, I find that the brushstrokes he uses when identifying those responsible are a little too broad. The reason for this is twofold. Firstly, it is questionable as to how many of us really know enough about the risks we are leaving future generations with. Secondly, discussion in terms of generations underplays the big differences between the responsibility of different groups of actors within them. In what follows, I will elaborate on these points. I should note from the outset, however, that although I think that these are important issues, I find them to be points of clarification in an impressive and ambitious book on why our actions have such significance and why objections to urgent, large-scale climate action are misplaced. How should our beliefs change over time? The standard answer to this question is the Bayesian one. But while the Bayesian account works well with respect to beliefs about the world, it breaks down when applied to self-locating or de se beliefs. In this work I explore ways to extend Bayesianism in order to accommodate de se beliefs. I begin by assessing, and ultimately rejecting, attempts to resolve these issues by appealing to Dutch books and chance-credence principles. I then propose (...) and examine several accounts of the dynamics of de se beliefs. These examinations suggest that an extension of Bayesianism to de se beliefs will require some uncomfortable choices. Recently, social and political philosophers have shown increased interest in the ideological nature of ideal theory and the importance of non-ideal theory. Charles Mills, who sparked recent critiques of ideal theory, invokes the notion of “non-idealizing abstractions” and argues that these are helpful when applying non-ideal theory. In contrast, I argue that the notion of non-idealizing abstractions is not a helpful tool for non-ideal theory. I suspect that it pays insufficient attention to the actual power dynamics of oppression, which significantly (...) influence judgments about whose experiences and interests are worth being reflected by an abstraction. Failing to take account of the power differences among the oppressed, what Mills considers non-idealizing abstractions falls into ideology, which cannot reflect the experiences or interests of less-privileged minorities, and only concerns those of more-privileged minorities. I examine cases in which the concept of “patriarchy,” which Mills alleges to be a non-idealizing abstraction, functions as what I refer to as the “Colonialist Concept of Patriarchy” that marginalizes Third World women’s experiences of intersectional oppression. I suggest that a more suitable and less ideological way to apply non-ideal theory should avoid asserting that an abstraction is “non-idealizing” and should, instead, protect “resignifiability” of the abstraction. Dynamic Topological Logic () is a combination of , under its topological interpretation, and the temporal logic interpreted over the natural numbers. is used to reason about properties of dynamical systems based on topological spaces. Semantics are given by dynamic topological models, which are tuples , where is a topological space, f a function on X and V a truth valuation assigning subsets of X to propositional variables. Our main result is that the set of valid formulas of over (...) spaces with continuous functions is recursively enumerable. We show this by defining alternative semantics for . Under standard semantics, is not complete for Kripke frames. However, we introduce the notion of a non-deterministic quasimodel, where the function f is replaced by a binary relation g assigning to each world multiple temporal successors. We place restrictions on the successors so that the logic remains unchanged; under these alternative semantics, becomes Kripke-complete. We then apply model-search techniques to enumerate the set of all valid formulas. (shrink)

This article demonstrates that non-mechanistic, dynamical explanations are a viable approach to explanation in the special sciences. The claim that dynamical models can be explanatory without reference to mechanisms has previously been met with three lines of criticism from mechanists: the causal relevance concern, the genuine laws concern, and the charge of predictivism. I argue, however, that these mechanist criticisms fail to defeat non-mechanistic, dynamical explanation. Using the examples of Haken et al.’s model of bimanual coordination, and (...) Thelen et al.’s dynamical field model of infant perseverative reaching, I show how each mechanist criticism fails once the standards of Woodward’s interventionist framework are applied to dynamical models. Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by explicitly (...) proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

Yet, the very realms where these qualities reside seem to be above our ability to assess other than to say, "we know it when we experience it."3 Is there some realization that we have transcended the mundane, passed over to another plane of existence and gone beyond an egocentric mind-frame? And could subjective reports satisfy any objective criteria that the event truly happened? Moreover, could one's experience be distinguished qualitatively from another's? This is one of the quandaries when attempting to assess experience of such an elusive nature. Although, these questions lie at the foundation of such an inquiry as this, answers await additional investigation at a later time. For the present, this study will be limited to laying the groundwork for these future explorations.A clarification of terms preceding this essay is imperative. To begin, the discourse will use 'spirituality' and 'transcendence' interchangeably. Various readings suggest that there is sufficient agreement that these terms describe the same noumenal experience. For example, physicist Fritjof Capra states that:Spiritual experience is an experience of aliveness of mind and body as a unity. Moreover, this experience of unity transcends not only the separation of mind and body, but also the separation of self and world. The central awareness in these spiritual moments is a profound sense of oneness with all, a sense of belonging to the universe as a whole.4This essay continues in this vein and that of my previous article on the subject5 that the religious and doctrinal are not part of the discussion. Therefore, an effort will be made to distance spirituality, as used here, from religion. In that light, a brief comparison will prove helpful.Spirituality has its roots in the Latin: "in + spirare (Latin to breathe). Archaic: to breathe or blow into or upon; to infuse (as life) by breathing."6 This "blowing upon" is no better illustrated than in the account in Genesis. Chapter 2, verse 4, line 7 reads: "Then the Lord God formed man of dust from the ground, and breathed into his nostrils the breath of life; and man became a living being."7 Psyche in Greek and atman in Sanskrit have essentially the same meaning of breath and being alive, that is, embodying an animating force.This animating force, in my view, is not of metaphysical origins, but rather inherent in the evolution of the human species. Spirituality is a human quality as a product of supreme levels of consciousness. Additionally, it has the quality of knowing that we are conscious. C. G. Which goods should we be able to buy and sell on the market and, alternatively, which goods should remain sheltered from the market? For many goods in modern societies, this has proven to be a thorny question. Moreover, it is a question that cannot be answered by way of a theoretical shortcut, that is, by attributing certain general values (or disvalues) to the market and inferring from these general attributes that the market is (or isn’t) the best institution to govern (...) the provision of a specific good. Therefore, in the first part of this work, three theoretical building blocks are proposed to frame the way we should handle the market question. First, a social theory is formulated which treats the market as one out of five main socio-economic modes of provision, the others being public provision, professional provision, informal provision and self-provision. Second, in choosing the best institutional framework for a specific good, it is argued that we should not restrict ourselves to the option of implementing one of these modes of provision only. Special attention should be paid to the option of ‘institutional pluralism’, i.e. instituting a market and a non-market alternative simultaneously for the same good. Both the attractions and the limits of such an institutional pluralism are discussed. Third, in making institutional choices about these modes of provision, we need a normative theory providing the moral criteria to guide our choices. Here a capability theory is proposed, which consists of three central principles, parallel to a distinction between three types of capabilities: those that are ‘immoral’, those that are ‘morally required’ and those that are merely ‘morally permissible’. The principles prescribe avoiding the realization of the immoral capabilities and promoting the realization of morally required and permissible capabilities. In the second part, this threefold framework is applied to three specific goods. These are security (protection against criminal threats), media (mass communication by media such as television, radio and the press) and care (caring activities provided on a structural basis to dependents such as care for children, chronically ill and elderly people). For each of these goods a capability analysis shows that the most appropriate institutional framework is institutional pluralism. In the case of security this is a pluralism of market and public provision, in the case of media a pluralism of market and professional provision and in the case of care a pluralism of market and informal provision. In the final chapter I investigate the conditions that have to be fulfilled for these institutionally pluralist arrangements to be stable, that is, to have a robust chance of survival. The main challenge to stability comes from the dynamic toward capital accumulation that is inherent in contemporary capitalism, and if left unchecked requires an ongoing conversion of non-market practices into markets. Two solutions are proposed to counter this threat: a general working time reduction which reduces capital accumulation and a strategy of publicly funded investment of accumulated capital in non-market parts of institutionally pluralist practices. The article analyzes the problem of Ukraine's development since independence. A comparison of the way of organizing social reality in modern Ukraine and in the Soviet period is carried out. The main regulatory factor in the life of Soviet society was the principle of domination. Ukraine has inherited the principle of domination and retains its leading role in the current social order. Its various manifestations that determine the structure of Ukrainian society, in particular the growth of the bureaucratic class and (...) bureaucratic pressure on all spheres and sections of life, are analyzed. The dominance of bureaucracy contains latent violence, feeds corruption and minimizes social dynamics. It is also a phenomenon of power rent, which finds its expression in a kind of "privatization of the state." Another universal effect of the principle of domination is the doubling of social reality into apparent and hidden. The apparent reality becomes a space for the existence of ordinary citizens and the implementation of legal procedures, while the hidden one contains a system of real circulation of power, which is not regulated by any legal regulations, instead, controls all movements of the social body. The systemic role in the hidden society is played by cliques — informal groups of influential people who really control the course of events. The con- sequence of the principle of domination is the passivity and marginalization of the Ukrainian citizen, associated with the defect of political participation. Such non-participation in power is embodied in such forms of consciousness as hope, liking, and despair. Today, independence is not a given, but a chance that must be realized. The way to this is through the restoration of the role of the people as a sovereign power and the development of non-dominant regulatory factors of sociality. (shrink)

Denunciations of child sexual abuse in the sport context have been increasing in the last decades. Studies estimate that between 14 and 29% of athletes have been victim of at least one form of sexual violence in sport before the age of 18. However, studies suggest that many do not disclose their experience of CSA during childhood. This finding is alarming since studies have shown that the healing process usually starts with disclosure. Moreover, little is known about the healing process (...) of CSA experienced in the sport context. The aim of the study is to present a single case study of a CSA in sport to better understand the global experience over time from the perspective of the athlete. A narrative inquiry approach was adopted. Three non-structured interviews were conducted with the participant. Three pathways in the survivor journey have been identified through inductive thematic analysis: pathway to understanding, pathway to disclosure, and pathway to healing. These pathways represent distinct processes but are intertwined as they are dynamic and iterative. Indeed, the survivor explained how she had been, and is still, going back and forth between them. Results are consistent with those found in the literature on CSA in the general population. It suggests that theoretical models of CSA in the general population could be applied to CSA in sport. Practical implications include a need for education and clearer boundaries in the coach-athlete relationship. Sport stakeholders also need to be better equipped to recognize the signs of sexual violence in sport. Our results indicate that qualitative research could be a potential avenue to help victims heal from CSA. It gives them the chance to talk about and make sense of their abuse in a safe space. Finally, our results demonstrate the importance of reviewing the current justice system for victims. It should be based on a trauma-informed approach that places the victim at the center of the judicial process. (shrink)

Context: This paper is intended for readers familiar with Humberto Maturana’s theory of autopoietic systems and with the still unresolved debate concerning the existence of non-biological autopoietic systems. Because the seminal work of the Chilean biologist has not yet been fully and correctly understood in other disciplines, I consider that it is necessary to offer a more generalized concept of the autopoietic system, derived by implication from Maturana’s grounding definition. Problem: The above-mentioned debate is rooted in a deficient application of (...) some rigorous distinctions, definitions, and epistemological considerations introduced by Maturana when he coined the term “autopoiesis.” Some researchers think that social or economic organizations could be considered as autopoietic systems of a higher order because they appear to behave autonomously and be self-organized and self-producing. However, in practice some precise distinctions would need to be verified through observation in order to claim properly their autopoietic nature. These distinctions were defined by Varela, Maturana and Uribe in 1974 as a set of six decisional rules (“MV&U rules”) whereby an observer may possibly justify this stand. My aim is to pinpoint clearly the basic cognitive tasks that an observer should perform in order to ascertain such a claim. Method: I accomplish this with a thorough analysis of the entailments derived from each rule when applied to the most general case – when the observational domain where the system manifests itself is not specified. A bottom-up approach is used to avoid referring to “apparent autopoietic behavior” as a starting point distinction (top-down approach): the aim is to distinguish “autopoietic behavior” as an outcome of more basic distinctions, not as a premise for these. These may be used as abstract tools to facilitate a rigorous description of observations and lead to precise explanations of the emergence of complex self-generated dynamic systems. In theory, this conceptual frame is not limited to the macro-molecular domain and may therefore be applicable to non-biological systems. Results: According to MV&U rules, the most important distinctions are those that refer to intra-boundary phenomenology: this focus is necessary to explain how the key processes involved in the emergence of autopoiesis actually manifest themselves. These explanations are crucial to validating a claim about the “autopoietic nature” of an observed system. Implications: This work could help multidisciplinary researchers to apply properly the theory of autopoietic systems beyond the realm of biology and to settle ongoing debates. It could also help investigations related to the specifications of software simulation processes for modeling a minimal artificial autopoietic system. However, the rigorous focus on the role of intra-boundary phenomenology and self-production of components reveals that our chances of detecting “natural” meta-molecular autopoietic systems are scarce. How do people survive under extreme conditions? Will selfish, non-cooperating free-rider types – the solo players – have the best chances of surviving? Or would cooperating, hard-working types – the team players – have higher chances? All morale put aside, it is interesting to know whether non-cooperation or cooperation pays off in a game characterized by scarcity and hard competition for survival. A study of people in such a Hobbesian state of nature can also teach us important lessons (...) about social dynamics in contemporary, prosperous societies. An interesting case of ‘The survival game’ can be found in Solzhenitsyn’s (1963 [1962]) self-biographical book, One Day in the Life of Ivan Denisovich, depicting life in a Soviet Gulag prison camp in Siberia January 1951. We use Solzhenitsyn’s work as evidence of the interplay between five player types among prisoners: Cooperative blind-riders (BRs), hard-riders (HRs) and tough-riders (TRs), i.e. the so-called ‘toilers’; non-cooperative easy-riders (ERs), looked upon by the toilers as ‘bastards’, ‘screws’ and ‘errand boys’; and finally Low-riders (LRs), comprising ‘goners’ and ‘jackals’. The main research question addresses the successfulness of the survival strategies of the five player types. Apart from a Multiple Player Approach (MPA) that may be seen as a further development of second-generation theory of collective action (Ostrom & Ahn, 2009), we apply Goffman’s (1959) dramaturgical theory on our case. Hence, we argue that impression management at two different ‘stages’ – the Brigade stage and the Camp stage – is crucial for survival for hard-riding as well as for easy-riding players, in particular strategic masking. Seeking to unite Goffman and game-theoretic MPA, our overall purpose is to make a theoretical contribution to “game-related sociology” (Swedberg, 2001). (shrink)

In the literature on dynamical models in cognitive science, two issues have recently caused controversy. First, what is the relation between dynamical and mechanistic models? I will argue that dynamical models can be upgraded to be mechanistic as well, and that there are mechanistic and non-mechanistic dynamical models. Second, there is the issue of explanatory power. Since it is uncontested the mechanistic models can explain, I will focus on the non-mechanistic variety of dynamical models. It (...) is often claimed by proponents of mechanistic explanations that such models do not really explain cognitive phenomena . I will argue against this view. Although I agree that the three arguments usually offered to vindicate the explanatory power of non-mechanistic dynamical models are not enough, I consider a fourth argument, namely that such models provide understanding. – We offer a new motivation for imprecise probabilities. We argue that there are propositions to which precise probability cannot be assigned, but to which imprecise probability can be assigned. In such cases the alternative to imprecise probability is not precise probability, but no probability at all. And an imprecise probability is substantially better than no probability at all. Our argument is based on the mathematical phenomenon of non-measurable sets. Non-measurable propositions cannot receive precise probabilities, but there is a natural (...) way for them to receive imprecise probabilities. The mathematics of non-measurable sets is arcane, but its epistemological import is far-reaching; even apparently mundane propositions are liable to be affected by non-measurability. The phenomenon of non-measurability dramatically reshapes the dialectic between critics and proponents of imprecise credence. Non-measurability offers natural rejoinders to prominent critics of imprecise credence. Non-measurability even reverses some of the critics’ arguments—by the very lights that have been used to argue against imprecise credences, imprecise credences are better than precise credences. Quantum cognition in decision making is a recent and rapidly growing field. In this paper, we develop an expected utility theory in a context of non-classical uncertainty. We replace the classical state space with a Hilbert space which allows introducing the concept of quantum lottery. Within that framework, we formulate axioms on preferences over quantum lotteries to establish a representation theorem. We show that demanding the consistency of choice behavior conditional on new information is equivalent to the von Neumann–Lüders postulate (...) applied to beliefs. A dynamically consistent quantum-like agent may violate dynamic recursive consistency, however. This feature suggests interesting applications in behavioral economics as we illustrate in an example of persuasion. (shrink)

A first-order dynamic non-commutative logic, which has no structural rules and has some program operators, is introduced as a Gentzen-type sequent calculus. Decidability, cut-elimination and completeness theorems are shown for DN or its fragments. DN is intended to represent not only program-based, resource-sensitive, ordered, sequence-based, but also hierarchical reasoning.

Le sujet de l’étude est la relation entre le bonheur et la chance selon Aristote. Ce problème est abordé à partir de la question de savoir si la sagesse et la vertu suffisent au bonheur. Si tel était le cas, une personne pauvre et malade serait heureuse. Pour Aristote, au contraire, le bonheur nécessite des biens non moraux pour être complet. Le bonheur n’est pas seulement ce qui rend les autres choses bonnes, il est aussi ce qui est complet et (...) désirable. Dans ce cas, la question du rapport du bonheur à la chance se pose : le bonheur dépend-il de la chance? Ce problème est lui-même examiné dans le cas particulier d’un bien non moral : la fin de la vie. Aristote est-il d’accord avec le mot de Solon : « Ne pas dire “heureux” ceux qui sont encore vivants, mais seulement une fois la fin atteinte. » Peut-on dire qu’une vie est heureuse même si sa fin est inconnue? Peut-on dire qu’elle est heureuse maintenant, quand on sait qu’elle se terminera misérablement? L’auteur fait une lecture détaillée des deux traitements qu’Aristote donne à cette question en EE II 1 et EN I 10-11. Elle montre que, selon l’ Éthique à Nicomaque, il est possible de dire que quelqu’un est heureux même si l’on ne connaît pas la fin de sa vie. Le bonheur ne dépend pas du hasard dans la mesure où le bonheur dépend entièrement de l’activité vertueuse qui, à son tour, ne dépend que de l’agent. It is often claimed (1) that levels of nature are related by supervenience, and (2) that processes occurring at particular levels of nature should be studied using dynamical systems theory. However, there has been little consideration of how these claims are related. To address the issue, I show how supervenience relations give rise to ‘supervenience functions’, and use these functions to show how dynamical systems at different levels are related to one another. I then use this analysis to (...) describe a graded approach to non-reductive physicalism, and to critically assess Davidson’s arguments for psychological anomaly. I also show how this approach can inform empirical research in cognitive science. (shrink)

Contemporary debate over laws of nature centers around Humean supervenience, the thesis that everything supervenes on the distribution of non-nomic facts. The key ingredient of this thesis is the idea that nomic-like concepts—law, chance, causation, etc.—are expressible in terms of the regularities of non-nomic facts. Inherent to this idea is the tacit conviction that regularities, “constant conjunctions” of non-nomic facts do supervene on the distribution of non-nomic facts. This paper raises a challenge for this conviction. It will be pointed out (...) that the notion of regularity, understood as statistical correlation, has a necessary conceptual component not clearly identified before—I shall call this the “conjunctive relation” of the correlated events. On the other hand, it will be argued that there exists no unambiguous, non-circular way in which this relation could be determined. In this regard, the notion of correlation is similar to that of distant simultaneity where the necessary conceptual component is the one-way speed of light, whose value doesn’t seem to be determined by matters of facts. Introduction The article is focused on theoretical and methodological analysis of a number of social dynamics models that appeared on the basis of non-classical science. They are “challenge — response”, self-organization, a cycle of phase transitions “birth — life — death”, and “zone model”. The author reveals heuristic potential of each model, its strengths and weaknesses in the methodological aspect. The aim of the study is to consider the models of social dynamics that appeared on the basis of non-classical science (...) in social cognition, identify their methodological foundations; compare these theoretical constructs with each other, and to improve these structures in theoretical and methodological aspects. Methods The following general scientific methods were used in the study: modeling, structural-functional, systemic and comparative analysis. The scientific novelty of the study. The author traces evolution of how the models under consideration have been forming in the framework of social cognition, and points out the epistemological foundations of their occurrence. In the “challenge-response” model, the author identifies its basic ideas and classifies the sources that generate historical “challenges” and the entities that form “answers” to them. The author specifies that the model of self-organization appeared long before the 20th century, but only thanks to the systematic approach and synergetics it acquires the necessary theoretical level. The author also points out positive aspects and limitations of the self-organization model in relation to social cognition. The author specifies the full structure of the “zone model” in social cognition, which includes the following elements: the center, the middle part, the intermediate space, and the periphery. Modifications of this model are shown in the framework of the world-system approach and other social theories. Results. The study demonstrates that in relation to each model, empirical material was first accumulated, and only then it was theoretically generalized on the basis of non-classical science. It is shown that the main merit of the world-system analysis is creating a “zone” model of social dynamics. The author recognizes that the zone model to the maximum extent includes other theoretical constructions: “challenge - answer”, self-organization, the cycle of phase transitions “birth - life - death”. It is assumed that in the future, theoretical approaches in the humanities are more likely to include new methodological tools. Conclusions. The author reveals continuity of intellectual instruments among various non-classical models of social dynamics, shows separate stages of the models evolution. It is stated that in the framework of the non-classical methodology of social cognition, there is a place for the approaches generated by classical science (for example, the assumption of linearity as a way of developing society). In many applications of physics, boundary conditions have an essential role. The purpose of this paper is to examine from both a historical and philosophical perspective one such boundary condition, namely, the no-slip condition of fluid dynamics. The historical perspective is based on the works of George Stokes and serves as the foundation for the philosophical perspective. It is seen that historically the acceptance of the no-slip condition was problematic. Philosophically, the no-slip condition is interesting since the use of the (...) no-slip condition illustrates nicely the use of scientific models. But more importantly, both the use and justification of the no-slip condition illustrate clearly how theories can holistically approach the world through model construction. Further, since much of the debate over scientific realism occurs in the realm of models, a case is made that an understanding of the role of the no-slip condition has something to offer to this debate. This is an excellent book, by one of the philosophy of quantum theory's brightest stars. It combines a clear presentation of determinism, probability and non-locality in several current interpretations of quantum theory, with a good deal of detailed analysis, both reporting other people's and Dickson's own results, and developing his own ideas|which are often heterodox, but always well-defended and thought-provoking. The treatment is often concise, especially when reporting standard material or others' results. There are also frequent changes of gear; both (...) because the issues are complexly related to each other, and because Dickson sensibly does not aim for a de nitive treatment of issues that are at present so controversial|accordingly, he weaves about, not forcing his material into some single line of argument. So this is a monograph, not a textbook for teaching or a treatise summing up a conquered eld. But the style is clear and vigourous; the book is packed with information (sometimes about ancillary issues); and as we shall see, Dickson does have some provocative main claims, if not an overarching single line of argument. In this short space, I can only praise the book's general virtues and state some of the main claims. (shrink)

I argue against the common and influential view that non-trivial chances arise only when the fundamental laws are indeterministic. The problem with this view, I claim, is not that it conflicts with some antecedently plausible metaphysics of chance or that it fails to capture our everyday use of ‘chance’ and related terms, but rather that it is unstable. Any reason for adopting the position that non-trivial chances arise only when the fundamental laws are indeterministic is also a reason (...) for adopting a much stronger, and far less attractive, position. I suggest an alternative account, according to which chances are probabilities that play a certain explanatory role: they are probabilities that explain associated frequencies. (shrink)

Maybe there is something rather than nothing because the nothingness force acted on itself, and when the nothing nothings itself it produces something. Robert Nozick suggested this as a candidate explanation of the fact that there is something rather than nothing. If he is right that it is a candidate explanation, we should pay attention: there are not many candidates out there. But his "explanation" looks, instead, like a paradigm case of philosophical nonsense. In this paper I describe a "metaphysical (...) dynamics" that makes sense out of Nozick's apparent nonsense. This article examines Heidegger’s interpretation of Plato’s Sophist, focusing on his attempts to grasp Plato’s original thinking of being and non-being. Some contemporary thinkers and commentators argue that Heidegger’s view of Plato is simply based on his criticism against the traditional metaphysics of Platonism and its language. But a close reading of his lecture on the Sophist reveals that his view of Plato is grounded in Plato’s questioning struggle with the ambiguous nature of human speech or language. For Heidegger, Plato’s (...) way of philosophizing is deeper than the metaphysical understanding of Platonism which sees only fixed ideas of being. In the Sophist, dialectical thinking of Plato constantly confronts the questionable force of the logos which betrays the natural possibility of non-being based on the tension between movement and rest. Thus, from Plato’s original insight Heidegger uncovers the dynamic association of being and non-being as a natural ground of everyday living with others. However, although Heidegger’s understanding of the Sophist powerfully demonstrates the lively possibility of being beyond the customary perspective of Platonic metaphysics, his interpretation fails to further disclose Plato’s political question of being emerging in the Sophist, which seeks the true associative ground of human beings. The most familiar philosophical conception of objective chance renders determinism incompatible with non-trivial chances. This conception – associated in particular with the work of David Lewis – is not a good fit with our use of the word ‘chance’ and its cognates in ordinary discourse. In this paper we show how a generalized framework for chance can reconcile determinism with non-trivial chances, and provide for a more charitable interpretation of ordinary chance-talk. According to our proposal, variation in an (...) admissible ‘evidence base’ generates a spectrum of different chance functions. Successive coarse-grainings of the evidence base generates a partial ordering of chance functions, with finer trumping coarser if known. We suggest that chance-attributions in ordinary discourse express different chance functions in different contexts, and we sketch a potential contextual mechanism for making particular chance functions salient. The mechanism involves the idea that admissible evidence is available evidence: propositions that could be known. A consequence is that attributions of objective chances inherit the relatively familiar context-sensitivity associated with the modal ‘could’. We show how this context-dependency undermines certain arguments for the incompatibility of chance with determinism. (shrink)

Mental imagery is an important topic in classical and modern philosophy, as it is central to the study of knowledge; since subjects can recall features of perceptual experiences in different ways and times, even modifying their structure, in this brief essay we will focus on non-perceptive mental images and to this purpose we will analyse, on the one hand, the nature of perceptive mental images ; on the other hand, NPMI generation according to different strategic conditions and retrieval modalities and, (...) so, their structural relationships with PMI. Thus, we will clarify what NPMI amounts to and, to this purpose, we will address the issue of epistemic correlation and semantic reference. As regards the former, we will adopt the notion of ‘belief’, both to describe which attitude supports the use of an NPMI and to account for its relationship with a PMI. As regards the latter, we will talk about weak ontology between an NPMI and the world, to conceive ‘the way in which’ mental imagery, despite the absence of a sensorial modification, refers to physical objects. As the subject’s mental contents determine, but do not constrain, what NPMI is like, we will deal with the ‘involvement’ of prior knowledge and the notion of meaningful space to underline that its generation is always the result of a wide process which involves perceptive visual information already processed and stored together with further mental contents. So, though some Authors consider mental imagery to be a ‘percept-like’ image and, somehow, espouse the theory of reactivation, we will pose a challenge to this theory – i.e. to what we call mental imagery standard framework – describing an NPMI in terms of configurational setting and indeterminacy. Consequently, we will propose a non-linear dynamic framework of mental imagery generation , according to which an NPMI is not reducible to a mere recalling of figural features of a perceptive image. In this paper, we present a time-varying and non-stationary but non-hyperbolic discount function that explains dynamic preference reversal. The new discount function emerges from an analysis of intertemporal consumption and savings choices with mortality risk and an altruistic factor. Our analysis shows that the process of updating survival information may also account for dynamic preference reversal.
