When blame is understood to be emotion-based or affective, its emotional tone is standardly identified as one of anger. We argue that this conception of affective blame is overly restrictive. By attending to cases of blame that emerge against a background of a particular kind of hope invested in others, we identify a blaming response characterized not by anger but by sadness: reactive disappointment. We develop an account of reactive disappointment as affective blame, maintaining that while angry blame and disappointed (...) blame are both condemnatory responses, they have distinct evaluative foci and occupy different but complementary roles in our accountability practices. We discuss the evolution of the distributive double noun (quivis) in biblical Hebrew. This construction developed from an asyndeton in Classical Biblical Hebrew (e.g., איש איש) into a syndeton in Late Biblical Hebrew (e.g., איש ואיש), a process that makes it an important diachronic marker in classifying and analyzing these two varieties of the language.

This paper discusses the stem variance of the root ḥ­b­q in the Bible, suggesting that its inconsistent conjugation does not reflect the original Biblical Hebrew, but rather results from an anachronistic pronunciation created by the Masoretes. The paper reviews the research of Masoretic anachronisms and the methodologies developed to identify them, applying these to the case of the root ḥ­b­q. It concludes that ḥ­b­q belongs to a specific type of Masoretic anachronism, in which original Qal forms were misvocalized by the (...) Masoretes as Piel under the influence of Mishnaic Hebrew. After presenting biblical and extra-biblical evidence to support this conclusion, the paper briefly discusses some of its main implications for the diachronic study of ancient Hebrew: the "late spelling paradox," the scope of the phenomenon of substituting Piel for Qal, and the relation between Masoretic anachronisms and the scholarly debate about the linguistic reliability of the Masoretic text. We suggest a common ground for alternative proposals In different domains of cognitive science which have previously seemed to have little in common. The underlying common theme is associated with a redefinition of the basic unit of analysis in each domain of thought. Our framework suggests a definition of unity which is based not on inherent properties of the elements constituting the unit, but rather on dynamic patterns of correlation across the elements. We introduce a set of features that characterize (...) the new dynamic units, and distinguish them from traditional units of analysis. A conceptual connection is made with the identification of elementary units in modern physics theories, as well as with concepts and structures in the study of complex dynamical systems and connectionism. The paper analyses the evolution of the concept of unit in different domains of thought in cognitive science, and examines the proposed framework of “dynamic unity” with regard to various theoretical problems within each domain. The particular cognitive science issues discussed in the paper include: (1) the binding problem in the brain; (2) the mental unit of conceptual organization; (3) defining ‘wordhood’ in linguistics; and (4) identifying the unit of cognition in the natural environment. Ethical attitudes towards pregnant women were examined by using a questionnaire among 50 nurses, 50 midwives and 100 nursing students (third and fourth years). The main findings show that nurses and students differ in: (1) their knowledge of the Code of Ethics; (2) their protection of patients' rights with regard to secrecy and privacy; and (3) their reporting of mistakes. These findings highlight the need for more serious study of ethics among senior professional nurses.

The use of artificial intelligence (AI) to aid legal decision making has become prominent. This paper investigates the use of AI in a critical issue in employment law, the determination of a worker’s status—employee vs. independent contractor—in two common law countries (the U.S. and Canada). This legal question has been a contentious labor issue insofar as independent contractors are not eligible for the same benefits as employees. It has become an important societal issue due to the ubiquity of the gig (...) economy and the recent disruptions in employment arrangements. To address this problem, we collected, annotated, and structured the data for all Canadian and Californian court cases related to this legal question between 2002 and 2021, resulting in 538 Canadian cases and 217 U.S. cases. In contrast to legal literature focusing on complex and correlated characteristics of the employment relationship, our statistical analyses of the data show very strong correlations between the worker’s status and a small subset of quantifiable characteristics of the employment relationship. In fact, despite the variety of situations in the case law, we show that simple, off-the-shelf AI models classify the cases with an out-of-sample accuracy of more than 90%. Interestingly, the analysis of misclassified cases reveals consistent misclassification patterns by most algorithms. Legal analyses of these cases led us to identify how equity is ensured by judges in ambiguous situations. Finally, our findings have practical implications for access to legal advice and justice. We deployed our AI model via the open-access platform, https://MyOpenCourt.org/, to help users answer employment legal questions. This platform has already assisted many Canadian users, and we hope it will help democratize access to legal advice to large crowds. (shrink)

The research reported in this article examined the influence of nurses’ attitudes, subjective norms and perceived behavioral control on maintaining patients’ privacy during hospitalization. The data were gathered from 109 nurses in six internal medicine wards at an Israeli hospital. The research was based on the theories of reasoned action and planned behavior. A positive and significant correlation was shown between nurses’ attitude to promoting and maintaining patient privacy and their planned behavior, while perceived behavioral control was the best variable (...) for predicting the nurses’ behavior. Better educated nurses believed that they had fewer resources and anticipated more obstacles in acting to promote and maintain patient privacy. This research adds a new dimension to what is already known about nurses’ attitudes to maintaining patients’ privacy, nurses’ planned behavior and their actual behavior. The practical implications of the findings are the identification of factors that influence the attitudes and behavior of nursing staff, which, in turn, will enable allocation of resources for solving difficulties and removing obstacles. The results will allow the formulation of educational programs to guide staff and also the application of policies based on both patient and nursing staff needs. (shrink)

This work offers a systematic interpretation of the problematics of disinterest in the Critique of Aesthetic Judgment. It examines Kant's thesis that the judgement of taste is free of considerations of morality or utility. Dahan Fan carefully traces Kant's differentiation between the agreeable, the good, and the beautiful, thus casting the relationship between the interests of reason and aesthetic disinterest in a new light.

In this study, we examined the perception of actual and ideal ethical climate type among 95 nurses working in the internal medicine wards of one central hospital in the state of Israel. We also examined whether nurses’ demographic characteristics influence that perception and if a relationship between perceptions of an actual and an ideal ethical climate type influences nurses’ job satisfaction. A questionnaire composed of three subquestionnaires was administered and the responses analyzed using multiple linear regressions, analysis of variance and (...) Pearson’s correlation coefficient. The results demonstrated that demographic characteristics (such as: gender, job tenure and level of education) partially influence the perception of an ideal ethical climate. Incongruence in perceptions of ‘caring’ and ‘independence’ climate types indicated a decline in nurses’ job satisfaction, while perception of actual ‘caring’ and ‘service’ climates positively influenced all aspects of job satisfaction. We recommend constructing training programs emphasizing the ethics of nursing practice and also to help lead nurses to clarify an ethical framework and guide nursing staff in dealing with ethical dilemmas. Political honors are ubiquitous in public life, whether in the form of public monuments, street names, or national holidays. Yet such honors have received scant attention from normative political theorists. Tackling this gap, I begin by criticizing a desert-based approach to political honors. I then argue that morally appropriate honors are best understood as marking and reinforcing the moral commitments of the collective in whose name they are being awarded. I show how this thesis clarifies and organizes core intuitions regarding (...) a variety of honors, from those commemorating slave-owning founders of the United States to the Nobel Peace Prize. This paper discusses the occupational health nurse's dilemmas by illustrating two cases faced by nurses in occupational health practice and setting out their analysis according to a decision-making model. The counter-interests, which may offend the principles of conserving professional occupational ethics among service consumers and employers as well as fellow professionals, are emphasized. This paper also describes the complex problems involved in the worker's safety and the safeguarding of their autonomy, while preserving interpersonal relations among the various people concerned.

In contrast, I argue that liberal democracies should indeed stop trading with dictators and civil warriors, but for inward rather than outward looking reasons. We, the citizens of liberal democracies through our elected governments, ought to boycott (...) severely oppressive regimes for the sake of our own moral integrity*simply in order to stop being complicit in what is effectively massive scale armed robbery. This inward looking thesis is distinctive in three ways. First, it contrasts with the dominant assumption that global reform must be grounded in the achievement of better political and economic outcomes for others. Second, the inward look manages to avoid the profound empirical uncertainty associated with any attempt to predict the direct effects of global rule changes on domestic institutions. I present a new challenge to the Rawlsian insistence on ideal theory as a compass orienting concrete policy choices. My challenge, focusing on global politics, consists of three claims. First, I contend that our global ideal can become more ambitious over time. Second, I argue that Rawlsian ideal theory’s level of ambition might change because of concrete policy choices, responding to moral failures which can be identified and resolved without ideal theory. Third, I argue that we currently face such potentially (...) transformative choices. I conclude that these choices are analytically prior to, rather than derivative from, global ideal theory. There is a common refrain in the literature on punishment that presumes the mutual exclusivity of defending retribution and adopting a humanistic or welfare-oriented outlook. The refrain, that if we want to be humane, or care about human welfare, we must abandon retributive punishment, anger, and resentment is readily repeated, endorsed, and relied upon. This article suggests that this opposition is false: retribution and welfare-orientation can not only be endorsed concomitantly, but are complimentary projects, and may even be grounded in (...) the same normative basis, such that if we endorse one we are already committed to ideas that ground reason to care about the other.My primary target will be claims that aim to undermine retributivism by demonstrating the desirability of welfare-orientation. If both can live together, demonstrating the attractiveness of one goes nowhere toward displacing the other. Further, establishing this claim invites further inquiry into classic questions about the “barbaric,” or “morally repugnant” credentials of retributivism. Confronting these claims will elucidate the consistency of adopting both retributive and welfare-oriented views, which, I suggest, can be jointly adopted and pursued. (shrink)

Global justice seems to be all about "us" treating "them," especially "their" problem of extreme poverty. This article argues that there is such a thing as our problem of global justice, and that it must be both temporally and logically prior to the problem of global justice. In order to establish this thesis, I seek to corroborate three main claims: that our elected governments are actively complicit in dictators' de facto armed robbery of their population's resources; that each democracy as (...) a unitary agent has a duty, which holds independently of poverty questions, to stop profiting from this robbery by boycotting severely oppressive regimes; and that such "democratic disengagement" requires postponing an ideal theory of global justice to a later stage, since the implications of disengagement will be so unprecedented that philosophizing past them means jumping ahead of our time. This article aims at understanding how "ethical public issues" are created, and dealt within a public arena. Here, we view ethical public issues as social constructs, which are the results of issue framing contests. Such an approach will enable us to understand how ethical public issues emerge and are shaped by strategizing actors (including firms, NGOs, the media, and governments), in an attempt to impose their own definition and preferred solution to the issue. We also propose key factors which explain (...) the success of a framing attempt, and evidence of such success. The empirical case of the labor conditions in West Africa's cocoa industry is used to illustrate this theoretical framework and methodological approach. (shrink)

Wary of quick statist dismissal of their proposals, cosmopolitans have been careful not to associate themselves with a world state. I argue that this caution is mistaken: cosmopolitans should see the vision of a world state as strategically valuable in exposing weaknesses in statist accounts, particularly of the Rawlsian variety. This strategic value follows if the only cogent arguments against a world state belong to non-ideal theory which assumes non-compliance, rather than to ideal theory with its core assumption of full (...) compliance. If our only convincing reasons to reject a world state are non-ideal, then any liberal theory revolving around separate states must itself be considered a non-ideal theory. As a non-ideal theory, a statist law of peoples cannot be presented as an end-state, but is rather a transitional stage. Yet once seen as a transitional theory, the statist “realistic utopia” can no longer dodge the cosmopolitan charge that it is neither sufficiently realistic nor sufficiently utopian. (shrink)

The growing popularization of stakeholder theory among management scholars has offered a useful framework for understanding the multiple and interdependent roles of government and business in an increasingly challenging political and regulatory environment. Despite this trend, attention to the role and responsibility of government to protect citizen rights has been limited. To the two traditional stakeholder theory views of government where the focal organization remains the firm, we propose to add two views by pivoting the government’s place and making it (...) the focal organization. We thus describe governments as serving four roles in the business–government–society nexus. For each role, we analyze typical governmental activities/behaviors, relationships with firms’ stakeholders, as well as the challenges and limits to these roles. We also focus on the central notion of salience amplification, as a means of checks and balances across stakeholders in order to safeguard citizen rights and reveal the greater good. (shrink)

Purpose This study aims to examine the long-term effects of an Israeli digital literacy government program for disadvantaged populations, as they are perceived by participants of the program one year after completing the course. Design/methodology/approach Participants in the program were interviewed about the effects of participating in the program, their experiences and satisfaction, in retrospect, a year after they completed the program. Findings The main reasons for joining the program included cognitive motivations, mainly interest to become familiar with internet applications, (...) followed by employment aspiration. Positive benefits from participation included accumulated knowledge, confidence in using technology, empowerment and enhanced sense of self-efficacy. Interviewees also reported that as they could not practice or communicate with instructors once they completed the program, a significant portion of the accumulated gains faded. Social implications Social and practical implications: Digital technologies constitute key infrastructure to facilitate public participation, as well as for gaining social, political and economic capital. Therefore, there is a significant social value in reducing digital inequality by increasing digital literacy of disadvantaged populations, i.e. citizens with low socioeconomic status and low digital literacy. This study sheds light on the benefits gained from such programs, as perceived by past participants. Originality/value While previous studies evaluating digital literacy programs focus on specific technical improvements and short-term gains, this study investigates the long-term effects and shortcomings of the program as perceived by participants. This article presents the complicated ethical dilemmas that arise in the procedures and proceedings of the Nursing Disciplinary Committee, which deals with matters of life and death (e.g. patients' rights to quality. and safe care, professional integrity and account ability, and the nurse's future). The article also describes the composition and function of the Committee, the type of case it deliberates, its limitations, and the dilemmas its members may encounter.

ObjectiveThis study aimed to describe how parents and physicians experienced the informed consent interview and to investigate the aspects of the relationship that influenced parents’ decision during the consent process for a randomised clinical trial in a tertiary neonatal intensive care unit. Parents and physicians had a positive experience, and trust was one of the main reasons for parents to consent. Misunderstanding was the main reason for refusal.Before birth, three situations can compromise parents’ consent: the mother already consented to participate in other studies, the absence of the father during the interview and the feeling that the baby’s birth is not an imminent possibility.ConclusionsConfronting parents and physicians’ perspectives in research can help us reach answers to sensitive issues such as content and timing of information. This article analyzes the question of how the size of bribes should impact criminal sanctions. In contrast to the commonly held view that punishment should increase with the size of the bribe, we argue to the contrary: that the punishment of the bribee should decrease with the size of the bribe. Our conclusion is based both on a philosophical argument and an economic argument. We argue that all else being equal, as an agent’s reservation price for selling public interests decreases, (...) the culpability of the agent willing to receive a bribe increases. In addition, from an economic perspective, the expected social harm of an official acting with a low reservation price for bribes is much greater than one acting with a high reservation price: both the susceptibility of being bribed as well as the potential for social harm is much greater when the reservation price is low. The article presents a novel normative model of shared responsibility for remedying unjust labor conditions and protecting workers’ rights in global supply chains. While existing literature on labor governance in the globalized economy tends to focus on empirical and conceptual investigations, the article contributes to the emerging scholarship by proposing moral justifications for labor governance schemes that go beyond voluntary private regulations and include public enforcement mechanisms. Drawing on normative theories of justice and on empirical-legal research, our Labor Model of (...) Shared Responsibility introduces three main claims: First, that responsibility for protecting and promoting labor standards in global supply chains should be shared by all private and institutional actors involved (whether directly or indirectly) in the production and distribution processes. Second, we offer a normative model for allocating responsibility among the various actors, based on five principles: connectedness, contribution, benefit, capacity, and power. Last, we demonstrate how the normative model could be implemented through various national and international institutional mechanisms. (shrink)

Thomas Pogge has been challenging liberal thinking on global politics, often through critical engagement with John Rawls’ work. Pogge presents both normative and empirical arguments against Rawls: normatively, Rawls’ domestic Theory of Justice and global Law of Peoples are incompatible ideal theories; empirically, LP is too removed from the actual world to guide the foreign policy of liberal societies. My main purpose here is to contest the first, ideal theory criticism in order to direct more attention to the second, non-ideal (...) objection. I argue against Pogge that TJ and LP can be read as coherent, once one employs a Rousseauian rather than Pogge’s economic Kantian reading of TJ. The first two sections present Pogge’s view of TJ and contrast it with a Rousseauian alternative that is less cosmopolitan and economic and much more focused on the democratic and sovereign context of justice as fairness. The third section seeks to refute Pogge’s incoherence arguments, which encompass the identity of the parties to the international original position, their motivations and their decisions. Instead of a conclusion, the last section emphasizes LP’s non-ideal problems, and suggests that insofar as LP is the most robust liberal ideal theory of global politics, its empirical failure indicates the need to shift global justice theorizing even more to the non-ideal realm.Keywords: Rawls; Pogge; global justice; ideal theory; non-ideal theory; cosmopolitanism; statism; Rousseau; Kant; democracy. What counts as global ‘harm’? This article explores this question through critical engagement with Thomas Pogge’s conception of negative duties not to harm. My purpose here is to show that while Pogge is right to orient global moral claims around negative duties not to harm, he is mistaken in departing from the standard understanding of these duties. Pogge ties negative duties to global institutions, but I argue that truly negative duties cannot apply to such institutions. In order to retain the (...) global force of negative duties, we need to dissociate these duties from global institutions: each society’s negative duty to stop harming specific other societies ought to be seen as independent of global institutional change. In order to establish this thesis, I criticize both the features and the derivation of Pogge’s variant of negative duties. I conclude that one must see global negative duties as applying to the relations between specific sovereign societies as unitary agents rather than to global institutions. I then show how this view of negative duties can yield significant global reform, based on Pogge’s own accusations concerning democracies’ conferral of trading privileges upon dictators who embezzle state resources. After presenting the normative, empirical, and strategic advantages of such reform, I anticipate Poggean objections. (shrink)
