Outsourcing of Public-Services - Forms and Limitations Purpose of the article is to show how public services can be outsourced from communities and what legal, organizational or other limitations may have to be taken into account.Methodology used for this article is literature research, analysis and comparison. An in-depth look into the present status of research and literature will be interconnected to the basic research in this matter that has been done from the 1970's to the 1990's.Scientific aim is to show (...) the potential of the process as being important and helpful in creating better community-service and meanwhile relieve the communities from organizational and financial burdens that are more difficult to carry than ever before.Findings are that we have to determine between the different municipal economic activities and the legal basis of these activities. The intervening public-service is a prominent example for the restrictive regulatory system it is set in but also is seen as having a big potential for cooperation and outsourcing by contracting-out. Contrary to that the service-rendering public-service is less regulated and more open to a market approach.There are different spheres for these economic activities to take place. Different reasons for outsourcing depend on the specific sphere a certain task belongs to and can include economic, fiscal and political aspects. Two big groups of tasks are annex-tasks from within the public-service and characteristic public-services. There can be outsourcing by commissioning or by using submissions.With different legal forms of the outsourced entities and the legal limits that are set for every different kind of structure, it is clear that there is no solution that always fits all the needs and that this has to be carefully taken into account.Conclusions are that there is a high potential and big successes when outsourcing is done well planned and as a strategic activity. At the heart of ethics reside the concepts of good and bad; they are at work when we assess whether a person is virtuous or vicious, an act right or wrong, a decision defensible or indefensible, a goal desirable or undesirable. But there are many varieties of goodness and badness. At their core lie intrinsic goodness and badness, the sort of value that something has for its own sake. It is in virtue of intrinsic value that other types of value (...) may be understood, and hence that we can begin to come to terms with questions of virtue and vice, right and wrong, and so on. This book investigates the nature of intrinsic value: just what it is for something to be valuable for its own sake, just what sort of thing can have such value, just how such a value is to be computed. In the final chapter, the fruits of this investigation are applied to a discussion of pleasure, pain, and displeasure and also of moral virtue and vice, in order to determine just what value lies within these phenomena. The fact that Gilbert Ryle and J.L. Austin seem to disagree about the ordinary use of words such as ‘voluntary’, ‘involuntary’, ‘voluntarily’, and ‘involuntarily’ has been taken to cast doubt on the methods of ordinary language philosophy. As Benson Mates puts the worry, ‘if agreement about usage cannot be reached within so restricted a sample as the class of Oxford Professors of Philosophy, what are the prospects when the sample is enlarged?’ (Mates, Inquiry 1:161–171, 1958, p. 165). In this chapter, (...) we evaluate Mates’s criticism alongside Ryle’s and Austin’s specific claims about the ordinary use of these words, assessing these claims against actual examples of ordinary use drawn from the British National Corpus (BNC). Our evaluation consists in applying a combination of methods: first aggregating judgments about a large set of samples drawn from the corpus, and then using a clustering algorithm to uncover connections between different types of use. In applying these methods, we show where and to what extent Ryle’s and Austin’s accounts of the use of the target terms are accurate as well as where they miss important aspects of ordinary use, and we demonstrate the usefulness of this new combination of methods. At the heart of our approach is a commitment to the idea that systematically looking at actual uses of expressions is an essential component of any approach to ordinary language philosophy. (shrink)

Wolff's book defends the Kantian idea of a "general logic" whose principles underlie special systems of deductive logic. It thus undermines "logical pluralism," which tolerates the co-existence of divergent systems of modern logic without asking for consistent common principles. Part I of Wolff’s book identifies the formal language in which the most general principles of logic must be expressed. This language turns out to be a version of syllogistic language already used by Aristotle. The universal validity of logical principles, as (...) well as the translatability of other logical languages into this language, are shown to depend only on the meanings of its logical vocabulary. Part II of the book answers the metalogical question concerning the deductive relation between general logic and special logical systems, which also have their own (less general) principles. This part identifies the rules according to which logical rules can be derived from principles. The threat of terrorism once again raises some of the classic questions about constitutionalism: is it possible for constitutions to do what they aim to do—channel and control political power in such a way as to make it safe and beneficent for those under its rule but also competent to govern? Does not terrorism reraise the Schmittian problem of “the exception”, i.e., the situation of emergency that necessarily escapes all constitutional limitations? Although they did not face the problem of terrorism (...) as we know it, the American founders developed three different models of constitutionalism, embodying three different ways of responding to emergent circumstances and yet remaining bound to the constitutionalist aspiration. We develop the main outlines of the three models both conceptually and historically and show how they continue to be relevant to current discussions of constitutionalism in the age of terror. Finally, we make a tentative effort to judge which of the three models is most able to do what constitutions should do in difficult times. (shrink)

Formalised public participation in project approval procedures is rarely addressed in technology assessment. Empirical data about public participation processes are taken into account even more rarely. This article explores the practice of public participation in infrastructure projects in the Federal Republic of Germany on the basis of empirical data from the period of 1990 to 2010. The author compares the empirical data about participation processes with the targets of the public participation and asks for the reasons for the lack of (...) participation in formalised approval procedures. Furthermore, the author contrasts participation formats used in technology assessment with formalised public participation. In this paper I argue that Plato's Apology is the principal text on which Kierkegaard relies in arguing for the idea that Socrates is fundamentally an ironist. After providing an overview of the structure of this argument, I then consider Kierkegaard's more general discussion of irony, unpacking the distinction he draws between irony as a figure of speech and irony as a standpoint. I conclude by examining Kierkegaard's claim that the Apology itself is “splendidly suited for obtaining a clear concept (...) of Socrates' ironic activity,” considering in particular Kierkegaard's discussion of Socrates' remarks about death and his use of Friedrich Ast's commentary to help his readers to discover the irony that he contends runs throughout Socrates' defense speech. Doch was ist überhaupt gemeint, wenn von einem "Menschenbild" die Rede ist? Was sind die Inhalte dieser Bilder? Welche Funktion haben und welche Rolle spielen sie? Vor allem aber: Welche Auswirkungen haben Menschenbilder im Alltag? Sind Menschenbilder tatsächlich, wie manche meinen, das Fundament unserer moralischen und politischen, ja selbst der existenziellsten Orientierungen im Alltag? Fragen wie (...) diese sind bislang weitgehend unbeantwortet geblieben. Denn so beliebt und zentral der Begriff des Menschenbildes ist, so unbestimmt ist er; er besitzt kein wissenschaftliches Profil. The Danish philosopher Søren Kierkegaard (1813-1855) conceived of himself as the Socrates of nineteenth century Copenhagen. Having devoted the bulk of his first major work, *The Concept of Irony with Continual Reference to Socrates*, to the problem of the historical Socrates, Kierkegaard maintained at the end of his life that it is to Socrates that we must turn if we are to understand his own philosophical undertaking: "The only analogy I have before me is Socrates; my task is a Socratic (...) task." The overall aim of my dissertation is to examine and critically assess this claim, and ultimately to argue that the Socratic nature of Kierkegaard's endeavor finds its fullest expression in the activity and writings of one of his best-known literary creations, Johannes Climacus, the pseudonymous author of *Philosophical Fragments* and *Concluding Unscientific Postscript*. The first part of my dissertation addresses Kierkegaard's own status as a Socratic figure. I examine Kierkegaard's claim that his refusal to call himself a Christian--in a context where it was the social norm to do so--is methodologically analogous to Socrates' stance of ignorance. I also consider how the use of a pseudonymous manner of writing allows Kierkegaard to employ a Socratic method. In the second part of my dissertation I focus on Kierkegaard's pseudonym Johannes Climacus and his claim that his contemporaries suffer from a peculiar kind of ethical and religious forgetfulness. I argue that Climacus adopts two Socratic stances in order to address this condition. In *Philosophical Fragments* he adopts the stance of someone who has intentionally "forgotten" the phenomenon of Christianity, whereas in the *Postscript* he adopts the stance of someone who openly declares that he is not a Christian. In the process, he develops a conception of philosophy that places a premium on self-restraint and an individual's ability to employ the first personal "I." As Climacus emerges as Kierkegaard's Socratic pseudonym par excellence, we obtain two significant results: a deeper understanding of Kierkegaard's conception of Socrates and Socratic method, and a compelling conception of philosophy rooted in Greek antiquity. In this paper I take issue with James Conant’s claim that Johannes Climacus seeks to engage his reader in the Postscript by himself enacting the confusions to which he thinks his reader is prone. I contend that Conant’s way of reading the Postscript fosters a hermeneutic of suspicion that leads him (and those who follow his approach) to be unduly suspicious of some of Climacus’ philosophical activity. I argue that instead of serving as a mirror of his reader’s faults, Climacus (...) is better conceived of as a Socratic figure whose own philosophical activity represents a positive alternative to the Hegelian style of doing philosophy that is under attack in the Postscript. I close the paper by arguing that Climacus adopts two very different experimental stances in his two books: while in Fragments Climacus adopts the stance of someone who has “forgotten” about Christianity, in the Postscript he openly declares that he is not a Christian and then proceeds to investigate the question, appropriately cast in the first person, “How do I,Johannes Climacus, become a Christian?” I maintain that we will not be in a position to appreciate what makes the Postscript a profound work of philosophy until we obtain a better understanding of the various respects in which Climacus is a Socratic figure. Wittgenstein’s analogy between psychoanalysis and his later philosophical methods is explored and developed. Historical evidence supports the claim that Wittgenstein characterized an early version of his general remarks on philosophy (§§89-133 in the Philosophical Investigations) as a sustained comparison with psychoanalysis. A non-adversarial, therapeutic interpretation is adopted towards Wittgenstein which emphasizes his focus on dissolving the metaphysical puzzlement of particular troubled individuals. A “picture” of Freudian psychoanalysis is sketched which highlights several features of Freud’s therapeutic techniques and his conception of (...) a neurosis. This portrait of Freud’s methods is used as an “object of comparison” for drawing attention to important aspects of Wittgenstein’s later practice of philosophy. Wittgenstein’s therapeutic conception of philosophy, though concerned with ordinary linguistic practices, is held to focus primarily on rooting out the prejudices and dogmas which lie at the heart of the puzzled philosopher’s inclinations to make metaphysical assertions. Over the last century and a half, manners and formalities in the West have become less status-ridden, stiff and rigid. Debates around Norbert Elias' theory of civilising processes gave rise to questions of a change in direction of these patterns. The concept of informalisation, which describes these transformations, was first used to analyse the tumultuous changes of the 1960s and 1970s. This increasing informality, leniency and flexibility, comes hand-in-hand with a growing demand on individuals to self-regulate their emotions. This book (...) will stimulate debate around the changes in the standards of manners and emotion regulation, and will generate new avenues of enquiry that focus on issues involving informalisation. The chapters shed light on a variety of such moral and political issues over the last 150 years, offering a new and broader scope on the present social condition of humanity. Civilisation and Informalisation will be an important addition for students and scholars of figurational process sociology, and of broader interest to academics across sociology, social psychology and social history. Teaching, born of the period of the ancient sages, developed as the moral art of living that introduced humanity to teaching as a moral pursuit, to the formation of value, to a moral and religious mode of being, and to a set of moral principles that have survived into the modern day. The idea that the 'future of teaching' represents a technological disruption of moral traditions of teaching and what teaching might become has become a serious concern for the current (...) generation of philosophers in both China and the West. The “erasing race” effect is the reduction of the salience of “race” as an alliance cue when recalling coalition membership, once more accurate information about coalition structure is presented. We conducted a random-effects model meta-analysis of this effect using five United States studies (containing nine independent effect sizes). The effect was found (ρ = 0.137, K = 9, 95% CI = 0.085 to 0.188). However, no decline effect or moderation effects were found (a “decline effect” in this context would be (...) a decrease in the effect size over time). Furthermore, we found little evidence of publication bias. Synthetically correcting the effect size for bias stemming from the use of an older method for calculating error base rates reduced the magnitude of the effect, but the it remained significant. Taken together, these findings indicate that the “erasing race” effect generalizes quite well across experimental contexts and would, therefore, appear to be quite robust. We reinterpret the theoretical basis for these effects in line with Brunswikian evolutionary-developmental theory and present a series of predictions to guide future research in this area. (shrink)
