It is unclear whether the regulatory distinction between non-identifiable and identifiable information—information used to determine informed consent practices for the use of clinically derived samples for genetic research—is meaningful to patients. The objective of this study was to examine patients' attitudes and preferences regarding use of anonymous and identifiable clinical samples for genetic research. Telephone interviews were conducted with 1,193 patients recruited from general medicine, thoracic surgery, or medical oncology clinics at five United States academic medical centers. Wanting to know (...) about research being done was important to 72% of patients when samples would be anonymous and to 81% of patients when samples would be identifiable. Only 17% wanted to know about the identifiable scenario but not the anonymous scenario. Curiosity-based reasons were the most common among patients who wanted to know about anonymous samples. Of patients wanting to know about either scenario, approximately 57% would require researchers to seek permission, whereas 43% would be satisfied with notification only. Patients were more likely to support permission in the anonymous scenario if they had more education, were Black, less religious, in better health, more private, and less trusting of researchers. The sample, although not representative of the general population, does represent patients at academic medical centers whose clinical samples may be used for genetic research. Few patients expressed preferences consistent with the regulatory distinction between non-identifiable and identifiable information. Data from this study should cause policy-makers to question whether this distinction is useful in relation to research with previously collected clinically derived samples. (shrink)

A higher order potential analysis of moral status clarifies the issues that divide Human Being Theorists who oppose embryo research from Person Theorists who favor embryo research. Higher order potential personhood is transitive if it is active, identity preserving and morally relevant. If the transition from the Second Order Potential of the embryo to the First Order Potential of an infant is transitive, opponents of embryo research make a powerful case for the moral status of the embryo. Debates over the politicization of science have led some to claim that scientists have or should have a “right to research.” This article examines the political meaning and implications of the right to research with respect to different historical conceptions of rights. The more common “liberal” view sees rights as protections against social and political interference. The “republican” view, in contrast, conceives rights as claims to civic membership. Building on the republican view of rights, this article conceives the right to (...) research as embedding science more firmly and explicitly within society, rather than sheltering science from society. From this perspective, all citizens should enjoy a general right to free inquiry, but this right to inquiry does not necessarily encompass all scientific research. Because rights are most reliably protected when embedded within democratic culture and institutions, claims for a right to research should be considered in light of how the research in question contributes to democracy. By putting both research and rights in a social context, this article shows that the claim for a right to research is best understood, not as a guarantee for public support of science, but as a way to initiate public deliberation and debate about which sorts of inquiry deserve public support. The somatic integration definition of life is familiar from the debate on the determination of death, with some bioethicists arguing that it supports brain death while others argue that some brain‐dead bodies exhibit sufficient somatic integration for biological life. I argue that on either interpretation, the somatic integration definition of life implies that neither the preimplantation embryo nor the postimplantation embryo meet the somatic integration threshold condition for organismal human life. The earliest point at which a somatic integration determination of (...) life could be made would be the beginning of the fetal stage, 9 weeks postfertilization. Philip Kitcher is a leading figure in the philosophy of science, and he is part of a growing community of scholars who have turned their attention from the field’s long-time focus on questions of logic and epistemology to the relation between science and society. Kitcher’s book Science, Truth, and Democracy (2001) charted a course between relativism and realism, arguing that the aims of science emerge from not only scientific curiosity but also practical and public concerns. The book also drew on (...) John Rawls’s A Theory of Justice (1999) to develop an ideal of “well-ordered science,” and then applied the ideal to various aspects of the scientific research agenda. Ten years later, complex public issues like climate change have grown more urgent, and with many people questioning mainstream science on climate change, evolutionary biology, vaccines, stem cell research, and other topics, the tensions between science and democracy seem more pronounced than ever. Moral status ascribes equal obligations and rights to individuals on the basis of membership in a protected group. Substance change is an event that results in the origin or cessation of individuals who may be members of groups with equal moral status. In this paper, two substance changes that affect the moral status of human embryos are identified. The first substance change begins with fertilization and ends with the formation of the blastocyst, a biological individual with moral status comparable to (...) that ascribed to human organs. The second substance change begins at implantation and ends late in embryological development with the formation of the human body, an organism with moral status as a human being. The bioethical implications of each substance change are explored. The Two Substance Change theory is contrasted with continuity theories, which recognize no substance change in embryological development and with fertilization-only substance change theories. Many commentators today lament the politicization of bioethics, but some suggest distinguishing among different kinds of politicization. This essay pursues that idea with reference to three traditions of political thought: liberalism, communitarianism, and republicanism. After briefly discussing the concept of politicization itself, the essay examines how each of these political traditions manifests itself in recent bioethics scholarship, focusing on the implications of each tradition for the design of government bioethics councils. The liberal emphasis on the irreducible plurality of values and (...) interests in modern societies, and the communitarian concern with the social dimensions of biotechnology, offer important insights for bioethics councils. The essay finds the most promise in the republican tradition, however, which emphasizes institutional mechanisms that allow bioethics councils to enrich but not dominate public deliberation, while ensuring that government decisions on bioethical issues are publicly accountable and contestable. This paper investigates the semantic treatment of conditional obligation, explicit permission (often called positive permission), and prohibition based on models with agents and branched time. In such models branches (rather than moments) are taken as basic, and the branching provides a way to represent the indeterminism which is normally presupposed by talk of free will, responsibility, action and ability. Careful treatment of the relation between ability and responsibility avoids many common problems with accounts of conditional obligation. Recognition of the generality (...) often involved in conditional obligations makes possible a sensitive way of expressing some kinds of general prohibitions, which in turn makes it possible to account for the special role of explicit permission. Efforts to develop a coherent role for white people in racial justice initiatives in the USA are often stymied by the defensiveness, paternalism, and guilt of many white liberals. Such efforts are also undermined by critiques of whiteness that conflate white identity and white supremacy. I address this dilemma by developing an account of antiracist white identity politics, conceived of here as taking responsibility for the effects of being socially defined as white. I locate conceptual resources for this project in (...) James Baldwin’s reflections on tragedy, love, and identity. In contrast to those who invoke Baldwin to argue for abolishing white identity, I make a case for politicizing it. I draw on Baldwin’s articulation of a tragic sensibility to argue that white antiracism requires accepting a morally compromised identity one has not chosen. It also requires accepting that serious efforts to end white supremacy inevitably lead to mistakes, misunderstandings, and counterproductive outcomes. By adopting a tragic perspective on these aspects of white antiracism, white people would become more capable of forging antiracist white identities through robust engagement in struggles for racial justice. If personal identity consists in non-branching psychological continuity, then the sharp breaks in psychological connectedness characteristic of Multiple Personality Disorder implicitly commit psychological continuity theories to a metaphysically extravagant reification of alters. Animalist theories of personal identity avoid the reification of alternate personalities by interpreting multiple personality as a failure to integrate alternative autobiographical memory schemata. In the normal case, autobiographical memory cross-classifies a human life, and in so doing provides access to a variety of interpretative frameworks with their associated (...) clusters of general event memory and episodic memory. Multiples exhibit erratic behavior because they cannot access reliably the intersecting autobiographical memory schemata that permit graceful transitions between social roles, behavioral repertoire and emotional dispositions. Selves, in both normal and certain pathological cases, are best understood as semi-fictional narratives created by human animals to serve their social, emotional and physical needs. (shrink)

The recent move to naturalize phenomenology through a mathematical protocol is a significant advance in consciousness research. It enables a new and fruitful level of dialogue between the cognitive sciences and phenomenology of such a nuanced kind that it also prompts advancement in our phenomenological analyses. But precisely what is going on at this point of ‘dialogue’ between phenomenological descriptions and mathematical algorithms, the latter of which are based on dynamical systems theory? It will be shown that what is happening (...) is something more than a mere ‘passing of the baton’ from phenomenology to mathematics. For this sophisticated naturalization to prove a worthy endeavour it must produce more than just correlation, it must prove some form of interrelation to the extent that phenomenology is deterministic. But such interrelational and deterministic requirements are the start of a slippery slope, and it will be argued that this slope only loses more friction once a further demand of formal and precise descriptions is made of phenomenology. Such deterministic and formally precise demands misconstrue phenomenology’s ideal goal of a unification of genuine/originary reason and truth. Not a deductive and definitive discipline, phenomenology is rather from the outset descriptive and critical. Phenomenology’s descriptive beginnings will thus be employed as an essential barrier to the naturalization of phenomenology. (shrink)

Direct reprogramming of human skin cells makes available a source of pluripotent stem cells without the perceived evil of embryo destruction, but the advent of such a powerful biotechnology entangles stem cell research in other forms of moral complicity. Induced pluripotent stem cell (iPSC) research had its origins in human embryonic stem cell research and the projected biomedical applications of iPS cells almost certainly will require more embryonic stem cell research. Policies that inhibit iPSC research in order to avoid moral (...) complicity are themselves complicit in preventable harms to patients. Moral complicity may be unavoidable, but a Blue Ribbon Panel charged with assessing the need for additional embryonic stem cell lines may ease a transition from embryonic stem cell research to clinical applications of iPS cells. Normal systems of modal logic, interpreted as deontic logics, are unsuitable for a logic of conflicting obligations. By using modal operators based on a more complex semantics, however, we can provide for conflicting obligations, as in [9], which is formally similar to a fragment of the logic of ability later given in [2], Having gone that far, we may find it desirable to be able to express and consider claims about the comparative strengths, or degrees of urgency, of the conflicting (...) obligations under which we stand. This paper examines the central role of ethnology, the science of race, in the administration of colonial India. This occurred on two levels. First, from the late eighteenth century onwards, proto-scientists and administrators in India engaged with metropolitan theorists through the provision of data on native society and habits. Second, these same agents were continually and reciprocally influenced in the collection and use of such data by the political doctrines and scientific theories that developed over the course of this period. Among the central interests of ethnographer-administrators was the native criminal and this paper uses knowledge developed about native crime and criminality to illustrate the way science became integral to administration in the colonial domain. For branching-time temporal logic based on an Ockhamist semantics, we explore a temporal language extended with two additional syntactic tools. For reference to the set of all possible futures at a moment of time we use syntactically designated restricted variables called fan-names. For reference to all possible futures alternative to the actual one we use a modification of a difference modality, localized to the set of all possible futures at the actual moment of time.We construct an axiomatic system for this (...) extended branching-time logic and prove its soundness and completeness with respect to bundle tree semantics. Finally, we show how our axiomatic system can be extended with a variety of important additional operators, such as Since and Until, a global difference operator, operators for undivided and divided histories, reference pointers, etc. (shrink)

Recent advances in reprogramming technology do not bypass the ethical challenge of embryo sacrifice. Induced pluripotent stem cell (iPS) research has been and almost certainly will continue to be conducted within the context of embryo sacrifice. If human embryos have moral status as human beings, then participation in iPS research renders one morally complicit in their destruction; if human embryos have moral status as mere precursors of human beings, then advocacy of iPS research policy that is inhibited by embryo sacrifice (...) concerns renders one morally complicit in avoidable harms to persons. Steps may be taken to address these complicity concerns, but in the final analysis there is no alternative to achieving clarity with respect to the moral status of the human embryo. (shrink)

Brown, Ph.D.In “Moral Complicity in Induced Pluripotent Stem Cell Research” (MCIPS) (Brown 2009), I sketched the moral complicity implications of alternative national stem cell policies with respect to direct reprogramming techniques that appear to result in pluripotent stem cells derived from skin cells, hair cells, and possibly other somatic cells. This aspect of the stem cell debate was considered from the perspective of (...) those who are pro embryo life and who attribute to human embryos a complete set of basic human rights, including a stringent right to life; and from the perspective of advocates of embryonic stem cell research who do not recognize full moral equivalence between human embryos and human children and who do not ascribe to human embryos an inviolable right to life. The moral complicity concerns of embryonic stem cell research advocates focus upon the scope of medical beneficence with respect to patients whose quality of life and personal autonomy are negatively impacted by the interval between the time when they might have gotten effective medical treatment through unimpeded stem cell science and the time at which stem cell science constrained by pro embryo life moral complicity concerns arrives at a similar destination. The moral complicity concerns of embryo life proponents focus upon noncooperation in past and future destruction of human embryos in order to derive in vitro embryonic stem cell lines.Among the policy alternatives considered were proposals that would be responsive to the possibility that induced pluripotent stem cells (iPSC) at some point may provide a source of stem cell lines that would substitute for human embryonic stem [End Page 206] cell (hESC) lines in cell replacement therapy. If functional equivalence between iPSC lines and hESC lines for cell replacement purposes were confirmed, a national stem cell research policy might be crafted that could accommodate the central moral complicity concerns both of persons who are embryo life advocates and of advocates of embryonic stem cell research. Policy alternatives considered in MCIPS included those based upon the assumption that currently existing embryonic stem cell lines are sufficient to conduct iPSC/hESC functional equivalence studies and policy options based upon the assumption that currently existing hESC lines fall short of what would be required for methodologically sound validation studies. The moral complicity implications for those who are embryo life advocates of both sets of policies were outlined, as were the moral complicity implications of alternative policies for embryonic stem cell research advocates. Since moral complicity concerns are one factor that those who formulate national stem cell policy should consider, MCIPS was an attempt to provide some guidance to policymakers with respect to how alternative policies accommodate or fail to accommodate the moral complicity concerns of various constituencies.In a 2008 article, Malcolm Byrnes (2008, p. 286) appears to consider both empirical assumptions regarding the sufficiency of existing stem cell lines for meaningful functional equivalence studies, and for that reason I drew upon his paper to frame the moral complicity implications for advocates of embryo life of national stem cell policy based upon either assumption. In his paper, Byrnes refers both to stem cell scientists who “suggest” that the hESC lines approved by President Bush in 2001 are sufficient and to stem cell scientists who believe that more hESC lines are needed. Based on my reading of his paper, I erroneously included Byrnes in the group who were willing to consider new hESC derivations in order to complete functional equivalence studies. However, my description of the moral complicity implications for advocates of embryo life of policies that enable new hESC derivations was an exercise in contingency planning, and certainly not intended as “a condemnation” of Byrnes (2009, p. 203). Similarly, what Byrnes (2009, p. 204) sees as “ironic” is simply a description later in my paper of policy options based upon an alternative factual assumption.Byrnes’s position seems to be that existing hESC lines are sufficient to conduct iPSC/hESC functional equivalence studies and that no additional hESC lines should be derived. Although it appears that I did mischaracterize Byrnes’s view of the permissibility of deriving additional hESC lines for equivalence studies, I think my interpretation was... (shrink)

Clarifying the essential experiential structures at work in our everyday moral engagements promises both (1) to provide a perspicacious self-understanding, and (2) to significantly contribute to theoretical and practical matters of moral philosophy. Since the phenomenological enterprise is concerned with revealing the a priori structures of experience in general, it is then well positioned to discern the essential structures of moral experience specifically. Phenomenology can therefore significantly contribute to matters pertaining to moral philosophy. In this paper I would like to (...) contribute to the relatively small yet burgeoning field of phenomenological ethics. I endea­vour to do so by first identifying and consolidating the basic level of sense-bestowal, and then outlining the a priori structures of volition in order to demonstrate how such phenomenologically discerned structures are required for moral experience. Specifically, in section one I locate moral experience as at the level of meaning that is phenomenologically identified as the life-world, and then vindicate the life-world by illustrating how it is immune to naturalistic rationalisation. By thus both securing the level of meaning that is of concern and importantly delimiting the scope of our analysis, I proceed in section two to relate the volitional analyses of Aristotle, Husserl, and Heidegger. This relation is achieved thanks to a conceptual point of con­tinuity: ‘prohairesis’. By examining the function of this concept (as an intentional structure) and its phenomenological continuity, the ground is then prepared for further phenomenological analyses of the virtues. In his political philosophy, John Rawls has a normative notion of reasonable behaviour expected of citizens in a pluralist society. We interpret the various strands of this idea and introduce them to the discourse on stakeholder dialogue in order to address two shortcomings in the latter. The first shortcoming is an unnoticed, artificial separation of words from actions which neglects the communicative power of action. Second, in its proposed new role of the firm, the discourse of political CSR appeared to (...) offer a promising synthesis of deliberation and action. However, the discourse has been criticized for its shortcoming in failing to provide a regulatory environment for corporation—stakeholder dialogue. Through our interpretation of Rawls’ notion of reasonableness in citizens, the article makes two important theoretical contributions to the debate on stakeholder dialogue. First, we transfer Rawls’ injunction in insisting that dialogues between business corporations and their weaker stakeholders must be understood as consisting of both verbal exchanges and actions. Second, we propose that the coercive power of government ought to provide a necessary context for stakeholder dialogue, and that by doing so, it can provide a way forward for the discourse of political CSR. We illustrate the usefulness of this contribution from Rawls in an analysis of BP’s behaviour towards thousands of victims following the Deepwater Horizon blowout in 2010. (shrink)

This paper details methods for teaching a topic-based approach to an introductory philosophy course. The problem with course surveys is that they sacrifice depth because of their fast pace, which often leaves students behind. Students are unable to grasp the scope of survey courses and only high functioning students appear to benefit from the structure. The single topic method can serve as a point of entry to the history of philosophy and students can gain a more intimate relationship with the (...) material. The author outlines the benefits of teaching a topic-based course centered on the problem of evil. The course allows students to immediately gain an intimacy with the material because it has intellectual and emotional connections to their lives. This approach to philosophy on a personal level also allows students to branch out into larger philosophical issues, such as justice, epistemology, politics, and metaphysics. (shrink)

Over a century’s worth of research suggests that “perception” without awareness is a genuine phenomenon. However, relatively little research has explored the question of whether all visually presented information activates representations in long term memory without awareness. Two experiments explored the use of a figure–ground display consisting of competing views in which one view dominates the other such that subjects are unaware of the non-dominant view. Neither experiment provided evidence that the non-dominant view activated its representation in long term memory (...) when the subject failed to report being aware of the embedded word in that priming was not seen on a subsequent stem completion task. In contrast, priming was seen when subjects reported being aware of the embedded word. It is suggested that two competing figure–ground relations are not concurrently computed unconsciously. This essay first examines a few key aspects of the erosion of public university funding in the United States, showing how the ideal of value-free science has undermined efforts to defend a conception of universities as public goods. Then it considers how advocates of California's Proposition 30, a ballot initiative that restored some public university funding, frequently adopted the same logic of privatization they sought to counteract.

The chief goal of this dissertation is to attain some clarity with respect to the interconnected issues which constitute the problem of personal identity. The logical and linguistic categories developed by Saul Kripke provide the tools through which these issues can be separated and put into perspective. In the first two chapters I examine the modal and other semantic features of rigid singular terms and such rigid predicates as natural kind terms. I defend both the transworld identity of named individuals (...) and the real essence of genuine natural kinds. ;In the third chapter this linguistic framework is used to explicate the distinction between the numerical identity of individuals and the qualitative identity of properties. I suggest that individual identity consists in a principle of uniqueness typically supplied through indexical identification and a principle of individuation through which a given individual can be tracked through qualitative change. Property identity is explicated as a form of qualitative similarity. ;In the final two chapters I consider personal identity as a form of individual identity and personal identity as a form of property identity. I reject the former interpretation on the grounds that 'person' fails to supply a principle of individuation for actual persons. I adopt the latter interpretation and suggest that person designates a necessary dispositional property of actual persons. I consider alternative theories of personal identity from the standpoint of a property identity theory of personal identity and I argue that the property identity theory provides a compelling account of a series of widely discussed problem cases.
