We reedit in the dossier of this issue an essay of Luigi Luzzatti first came out in «Nuova Anthologia» in 1880. In it Luzzatti rereads the British constitutional history thanks to a set of biological metaphors and analogies, which are analyzed and historically framed in the introduction of Luca Ciancio. This approach of Luzzatti further enhances the reconstruction of history of Constitutions he offers analyzing the works of the greatest historians of his time.

Luca Ciancio discusses Luigi Luzzatti’s article starting from a reflection about the ubiquity of the biological metaphors used by him in order to reason on the method of constitutional science. Luzzatti bases on the classic distinction between historic "organic" constitutions, i.e. the British one, which is a true and spontaneous incarnation of the "national character", and abstract "mechanic" constitutions, artificially imposed by reason and therefore instable. In the late positivistic era the same recourse to a metaphorical evolutionistic (...) repertoire, like the one of the embryologic dynamic of the constitutions, on the one defines hand Luzzatti’s intent as a subscription to historicism and organicism, which is typical of his epoch, and on the other hand the free recourse to biology allows him to discuss cognitive strategies that are useful to constitutional science and freed from a dogmatic notion of scientificity. Through Luzzatti's text, though, Ciancio underlines the meaning and the function of an evolutionistic paradigm which defined in a rigid and ideological way the historic investigation and which Luzzatti uses to recall an idea of order, restoration and continuity. Tra essi, gli amici e i seguaci radicali e federalisti di Carlo Cattaneo, ma anche un moderato come Pasquale Villari, il maestro di Gaetano Salvemini. Tutti ebbero in comune la condivisione del pensiero filosofico e politico di John Stuart Mill e il proposito di favorirne la diffusione nella cultura del loro tempo. Mill fu uno degli autori più tradotti nell'Italia dell'Ottocento. (...) Se la sua filosofia ebbe pochissima fortuna, il suo liberalismo attraversò invece tutta la classe politica ed intellettuale italiana: fu come un crocevia di strade diverse per provenienza e destinazione. Ciò vale per Francesco Ferrara e per Vilfredo Pareto, per Marco Minghetti e per Luigi Luzzatti, per i liberisti della Società Adamo Smíth e per i vincolisti del Giornale degli economisti. Il confronto con Mill permette di individuare i caratteri della filosofia civile del liberalismo post-unitario, le sue aspirazioni di buon governo e di giustizia, la sua fiducia nella cultura della modernità. La ricostruzione dei dibattiti e delle polemiche che si susseguirono tra gli anni sessanta e settanta sul decentramento, sulla rappresentanza proporzionale, sul suffragio femminile, sui rapporti fra stato e società civile, sul metodo dell'economia politica, sul socialismo e sull'utilitarismo i temi essenziali del liberalismo milliano aiuta a cogliere il significato storico del complesso rapporto tra liberalismo e positivismo in Italia. Ne viene fuori, come mette in rilievo Norberto Bobbio nella prefazione al volume, il carattere tortuoso e difficile del liberalismo italiano; la sua difficoltà a divenire una base effettiva di riferimento del nuovo stato, dei suoi ceti dirigenti, delle sue elite intellettuali. In the last decades it has become clear that medicine must find some way to combine its scientific and humanistic sides. In other words, an adequate notion of medicine requires an integrative position that mediates between the analytic-reductionist and the normative-holistic tendencies we find therein. This is especially important as these different styles of reasoning separate “illness” (something perceived and managed by the whole individual in concert with their environment) and “disease” (a “mechanical failure” of a biological element within the (...) body). While the demand for an integrative view has typically been motivated by ethical concerns, we claim that it is also motivated, perhaps even more fundamentally, by epistemological and methodological reasons. Evidence-based bio-medicine employs experimental and statistical techniques which eliminate important differences in the ways that conscious humans evaluate, live with, and react to disease and illness. However, it is precisely these experiences that underpin the concepts and norms of bio-medicine. Humanistic disciplines, on the other hand, have the resources to investigate these experiences in an intersubjectively testable way. Medicine, therefore, cannot afford to ignore its nature as a human science; it must be concerned not only with disease and illness, but also with the ways in which patients as persons respond to malady. Insofar as attitudes and expectations influence the criteria of illness and disease, they must be studied as part of the genuine subject matter of medicine as a human science. In general, we urge that this is a necessary step to overcome today's trend to split evidence-based and clinical medicine. (shrink)

Falls are frequent in Myotonic Dystrophy type 1, but the pathophysiology of the balance impairment needs further exploration in this disease. The current work aims to provide a richer understanding of DM1 imbalance. Standing balance in 16 patients and 40 controls was tested in two posturographic tests. In the Sensory Organization Test, standstill balance was challenged by combining visual and environmental conditions. In the “react” test, reflexes induced by sudden shifts in the support base were studied. Oscillations of the body (...) centre of mass were measured. In the SOT, COM sway was larger in patients than controls in any condition, including firm support with eyes open. On sway-tuned support, COM oscillations when standing with closed eyes were larger in patients than controls even after taking into account the oscillations with eyes open. In the “react” paradigm, balance reflexes were delayed in patients. Results in both experimental paradigms are consistent with leg muscle weakness. This, however, is not a sufficient explanation. The SOT test highlighted that patients rely on vision more than controls to maintain static balance. Consistently enough, evidence is provided that an impairment of proprioceptive and vestibular systems contributes to falls in DM1. Rehabilitation programs targeted at reweighting sensory systems may be designed to improve safe mobility in DM1. (shrink)

Through a commentary of the letter sent by Husserl to the 8th International Congress of Philosophy in 1934, the essay intends to clarify the concept of “responsibility” as a “universal form” thanks to which the rational human being orients his acts according to a consciously ethical direction. By focusing on the dynamics that characterize the relationship between Logos and Ethos, is then pointed up Husserl’s aim to build a gnoseology that can’t be solved in an abstract intellectualism as it embodies (...) always a constructive criticism of the present and its aberrations. The appeal contained in the letter of 1934 for an epoché of every historical tradition becomes therefore the premise for an overcoming of past conceptual forms in order to reach the “implicit” concealed into every historical event and whose grasp and interpretation is possible only to the eidetic view of the phenomenologist. Le défi des antinomies joue un rôle décisif dans l'élaboration même de la pensée kantienne ; cela devient particulièrement significatif par rapport à l'Être absolument nécessaire, qui devrait dépasser le niveau des phénomènes même lorsque, comme l'on dit dans la thèse de la quatrième antinomie, l'on l'entend comme quelque chose du monde. Dans la structure même des antinomies nous sommes forcés à aller au-delà de l'expérience, à un Être qui dépasse radicalement le monde ; en ce sens, même à l'intérieur (...) de la pensée kantienne, l'analogie classique reste la structure spécifique de la métaphysique, surtout par la possibilité de dire la transcendance sans la réduire jamais au niveau des phénomènes. The challenge of the antinomies plays a decisive role in the development of Kantian thought. This becomes particularly significant with reference to the absolutely necessary Being, which should exceed the phenomenal domain even when, as Kant says in the fourth antinomy, it is considered as a part of the world. In the structure of the antinomies we are pushed beyond experience towards a Being which radically transcends the world; in this sense, even within Kantian thought, the classical analogy remains the specific structure of metaphysics, especially by virtue of the possibility of expressing transcendence without reducing it to the phenomenal level. Grodzinsky's Tree-Pruning Hypothesis can be extended to explain agrammatic comprehension disorders. Although agrammatism is evidence for syntactic modularity, there is no evidence for its anatomical modularity or for its localization in the frontal lobe. Agrammatism results from diffuse left hemisphere damage – allowing the emergence of the limited right hemisphere linguistic competence – rather than from damage to an anatomic module in the left hemisphere.

This article discusses the logic of the Epimenides Paradox using a graphical representation of the logical operators involved. The graphical representation of the Logical Operators is the one used in digital electronics. This method of investigation is very effective in revealing the hidden error in the reasoning that leads to the contradiction. The article explains the vicious circle that the mind goes through when trying to analyze the Paradox. Finally, the article proposes a solution of the Paradox with final conclusions (...) that are not paradoxical but simply counterintuitive. The endless deduction is generated by subsequent evaluations that take place on different levels. In its evaluation the Mind alternates a level of logical evaluation with a level of semantic evaluation. (shrink)

The paper surveys the possibility of keeping a neo-Kantian approach in the face of Loop Quantum Gravity. Together with a preliminary analysis of Cassirer’s re-interpretation of Kantian philosophy that allowed him to harmonize the a priori cognitions with the theory of relativity and quantum mechanics, it will focus on the distinction between constitutive and regulativea priori. In this way, the paper will suggest that despite Rovelli’s refutation of Kant’s interpretation of space and time, he seems, at least implicitly, to hold (...) to a couple of neo-Kantian assumptions: the usage of constitutivea priori principlessuch as granularity, indeterminism and partially relation, and the claim for functionalism as a rule in ordering the ‘appearances’. Literature on driving research suggests a relationship between cognition and driving performance in older and younger drivers. There is little research on adults and driving, despite them being the largest age cohort behind the wheel. Among the cognitive domains, visuospatial abilities are expected to be highly predictive of driving skills and driving fitness. The relationship between specific spatial mental transformation skills and driving performance has not yet been examined. The present study aimed to investigate the relationship between overall cognitive functioning, (...) self and object-based spatial mental transformation skills, and driving performance in a sample of younger and older adult drivers. Participants were comprised of one hundred younger and 83 older adult Italian drivers. Participants completed a computerized driving test assessing traffic stress resilience, visual and motor reaction time, and the ability to obtain an overview of the traffic scenario. The Mental Rotation Test and the Object Perspective Taking Test were administered in order to assess object-based and self-based spatial mental transformation skills. The Montreal Cognitive Assessment Test was administered control for global cognitive functioning. The effects of education and gender were also controlled in the analysis. The results of the present study suggested that: The effect of age, favoring younger participants, was found in DT, vRT, mRT, and ATAVT tests. The effect of global cognitive functioning was found in DT and ATAV tests. The effect of the spatial mental transformation tests was found in DT, vRT, and ATAVT tests. Taken together, these results suggest the specific contribution of spatial mental transformation skills in the execution of complex behaviors connected to the fitness to drive. Prospectively, the results of the present study relating spatial mental transformation skills and driving processes may be a valuable source of knowledge for researchers dealing with the relationship between cognitive resources and navigation aids. In this paper, I argue that Sellars’s conceptualist reading of Kant, though less radical than more contemporary approaches (e. g., Brandom, McDowell), relies on a controversial account of the relations between the givenness of intuitions, the productive imagination and the power of judgment. I will discuss: 1) how Sellars reconsidered Kant’s account of intuition; and 2) the kind of conceptualism he argues for. I will raise two main claims. First, Sellars’s conceptualist reading of intuition overlooks the role of space and (...) time as givenness conditions. Second, Sellars’s account of the productive imagination disregards the complementary significance of the power of judgment in a priori synthesis, the role of which is to grant synthetic unity. My aim is to reconstruct a consistent dialogue between Sellars and Kant by discussing Sellars’s reading of a priori synthesis and comparing his views to Kant’s original aims. (shrink)

Following the murder of George Floyd, the Black Lives Matter-movement (BLM) took to the streets to protest against institutional racism. In these protests, one could often hear the slogan “No Justice, No Peace”. Drawing on legal theory, speech act theory and phenomenology, this article investigates what kind of justice and peace are called upon and how the slogan functions as a claim addressed to the legal order. First, the article shows that the rule of law provides a comprehensive normative framework (...) to evaluate what went wrong during the arrest of George Floyd. Second, the article maintains that the slogan should be understood as a passionate utterance in the sense of Stanley Cavell. Finally, drawing on a responsive phenomenology of legal order inspired by the work of Bernhard Waldenfels, the article concludes that the slogan is an extraordinary claim questioning the legal order, showing its contingent origins. The point of view advocated, in the last ten years, by quantum probability about the foundations of quantum mechanics, is based on the investigation of the mathematical consequences of a deep and elementary idea developed by the founding fathers of quantum mechanics and accepted nowadays as a truism by most physicists, namely: one should be careful when applying the rules derived from the experience of macroscopic physics to experiments which are mutually incompatible in the sense of quantum mechanics.

In this paper I discuss some relevant theses of Caranti?s Kant?s Political Legacy, whose aim is to provide a consistent account of how we could develop Kant?s political thought and see to what extent Kant?s insights can help us to critically understand the 21st century?s political world. First, I will focus on autonomy as the ground of dignity and discuss Caranti?s arguments against the exclusiveness of the Categorical Imperative as the sole principle of true moral agency. Second, I will take (...) into account Caranti?s views on history and consider whether human rational nature can be regarded as containing teleological - though non-biological - elements, thereby questioning Caranti?s Separability Thesis. nema. Republicanism gives non-domination a central role. However, the modes of domination change over time. Expertise and anticipation have gained growing relevance in this respect. An emergent form of anticipation is pre-emption. This represents a peculiar ‘politics of time’, whereby an eschatological event is set and continuously postponed, past, present and future are no longer sequentially connected, and change reproduces the ruling order. Mainly addressed in relation to the military and security, pre-emption plays a growing role in the environmental field. The (...) paper discusses three examples: human enhancement, responsible innovation and the ‘ecomodernist’ take on the Anthropocene thesis. In all cases, what is promised on one side – respectively, empowerment, participation and care for nature – is denied on the other, hampering a transformative green politics. To circumvent this deadlock the paper explores the connection between non-domination and inoperosity. The latter does not mean passivity, resignation, but action free from the compulsion to achieve and expand. Non-domination requires recognition of limits as constitutive of the relationship with oneself and the world. On this view, a promising terrain of inquiry for civic republicanism is offered by ‘prefigurative’ mobilizations. (shrink)

We discuss how transgenerational communitarianism deals with public decisions involving tradeoffs between different generations’ wellbeing and having global consequences. Policies for tackling climate change are an example. Although there is a natural, evolutionary, basis for intergenerational altruism, most people lack the competencies for constituting a transgenerational community. Moreover, greater attention to future generations’ wellbeing need not substitute for collective action: a lower discount rate reflecting a stronger concern for future generations may even worsen their wellbeing. Finally, in a world of (...) irreducible value pluralism, there is no community of persons sharing moral values that can legitimize common policies for addressing global problems: only the common interest of avoiding destructive consequences may motivate collective action to face problems like climate change.
