L'exemple de Kant" s'emploie à montrer que l'examen de la fonction de l'exemple permet de situer les enjeux essentiels de la philosophie critique de Kant, aussi bien dans le domaine théorique que dans le domaine pratique. Nous examinons les rôles attribués par Kant aux exemples ("Darstellung" d'un objet, preuve de possibilité de la vertu, outil rhétorique ou encore œuvre de jugement politique), pour ensuite analyser les difficultés qu'il y a à justifier la possibilité de ces rôles dans les termes mêmes (...) de sa pensée. Cette étude est aussi un plaidoyer pour l'importance de la troisième "Critique" dans l'économie de l'œuvre kantienne puisqu'il s'agit de montrer d'une part, que c'est là que la méthode transcendantale fait l'épreuve de ses propres limites, et, d'autre part, que Kant y élabore une réponse originale au scepticisme - par le biais d'une théorie originale de l'exemple. Recent research on thick terms like “rude” and “friendly” has revealed a polarity effect, according to which the evaluative content of positive thick terms like “friendly” and “courageous” can be more easily canceled than the evaluative content of negative terms like “rude” and “selfish”. In this paper, we study the polarity effect in greater detail. We first demonstrate that the polarity effect is insensitive to manipulations of embeddings (Study 1). Second, we show that the effect occurs not only for thick (...) terms but also for thin terms such as “good” or “bad” (Study 2). We conclude that the polarity effect indicates a pervasive asymmetry between positive and negative evaluative terms. (shrink)

Three experiments examined whether the mere priming of potential action effects enhances people’s feeling of causing these effects when they occur. In a computer task, participants and the computer independently moved a rapidly moving square on a display. Participants had to press a key, thereby stopping the movement. However, the participant or the computer could have caused the square to stop on the observed position, and accordingly, the stopped position of the square could be conceived of as the potential effect (...) resulting from participants’ action of pressing the stop key. The location of this position was primed or not just before participants had to stop the movement. Results showed that priming of the position enhanced experienced authorship of stopping the square. Additional experimentation demonstrated that this priming of agency was not mediated by the goal or intention to produce the effect. (shrink)

It is generally assumed that storing predictive relations between two events in memory as bi-directional associations does not require conscious awareness of this relation, whereas the formation of unidirectional associations that capture the direction of the relation does. This study reports a set of experiments demonstrating that unidirectional associations can be formed even when awareness of the relation is actively prevented, if attention is “tuned” to process predictive relations. When participants engaged in predicting targets based on cues in an unrelated (...) task before the actual acquisition phase, unidirectional associations were formed during this acquisition phase even though E1 was presented subliminally. This suggests that although processing the relation between events may often be accompanied by awareness of this relation, awareness is not a prerequisite for the formation of unidirectional associations. The legal basis for processing personal data and some other types of Big Data is often the informed consent of the data subject involved. Many data controllers, such as social network sites, offer terms and conditions, privacy policies or similar documents to which a user can consent when registering as a user. There are many issues with such informed consent: people get too many consent requests to read everything, policy documents are often very long and difficult to understand and users (...) feel they do not have a real choice anyway. Furthermore, in the context of Big Data refusing consent may not prevent predicting missing data. Finally, consent is usually asked for when registering, but rarely is consent renewed. As a result, consenting once often implies consent forever. At the same time, given the rapid changes in Big Data and data analysis, consent may easily get outdated. This paper suggests expiry dates for consent, not to settle questions, but to put them on the table as a start for further discussion on this topic. Although such expiry dates may not solve all the issues of informed consent, they may be a useful tool in some situations. (shrink)

This article introduces a new pragmatic framework for dual character concepts and their expressions, offering an alternative to the received lexical‐semantic view. On the prevalent lexical‐semantic view, expressions such as “philosopher” or “scientist” are construed as lexical polysemes, comprising both a descriptive and a normative dimension. Thereby, this view prioritizes established norms, neglecting normative expressions emerging in specific contexts. In contrast, the pragmatic view integrates pragmatic modulation as a central element in explaining context‐dependent dual character concepts and expressions. Through the exponential growth in digital devices and computational capabilities, big data technologies are putting pressure upon the boundaries of what can or cannot be considered acceptable from an ethical perspective. Much of the literature on ethical issues related to big data and big data technologies focuses on separate values such as privacy, human dignity, justice or autonomy. More holistic approaches, allowing a more comprehensive view and better balancing of values, usually focus on either a design-based approach, in which it (...) is tried to implement values into the design of new technologies, or an application-based approach, in which it is tried to address the ways in which new technologies are used. Some integrated approaches do exist, but typically are more general in nature. This offers a broad scope of application, but may not always be tailored to the specific nature of big data related ethical issues. In this paper we distil a comprehensive set of ethical values from existing design-based and application-based ethical approaches for new technologies and further focus these values to the context of emerging big data technologies. A total of four value lists were selected for this. The integrated list consists of a total of ten values: human welfare, autonomy, non-maleficence, justice, accountability, trustworthiness, privacy, dignity, solidarity and environmental welfare. Together, this set of values provides a comprehensive and in-depth overview of the values that are to be taken into account for emerging big data technologies. (shrink)

In this landmark work of economic sociology, Lucien Karpik introduces the theory and practical tools needed to analyze markets for singularities. Singularities are goods and services that cannot be studied by standard methods because they are multidimensional, incommensurable, and of uncertain quality. Examples include movies, novels, music, artwork, fine wine, lawyers, and doctors. Valuing the Unique provides a theoretical framework to explain this important class of products and markets that for so long have eluded neoclassical economics. With this innovative (...) theory--called the economics of singularities--Karpik shows that, because of the uncertainty and the highly subjective valuation of singularities, these markets are necessarily equipped with what he calls "judgment devices"--such as labels, brands, guides, critics, and rankings--which provide consumers with the credible knowledge needed to make reasonable choices. He explains why these markets are characterized by the primacy of competition by qualities over competition by prices, and he identifies the conditions under which singularities are constructed or are in danger of losing their uniqueness. After demonstrating how combinations of the numerous and multiform judgment devices can be used to identify different market models, Karpik applies his analytical tools to the functioning of a large number of actual markets, including fine wines, movies, luxury goods, pop music, and legal services. This paper presents the results of two corpus studies investigating the discourse surrounding conspiracy theories and genuine theories. The results of these studies show that conspiracy theories lack the epistemic and scientific standing characteristic of theories more generally. Instead, our findings indicate that conspiracy theories are spread in a manner that resembles the dissemination of rumors and falsehoods. Based on these empirical results, we argue that it is time for both re-engineering conspiracy theory and for relabeling "conspiracy theory". We propose (...) relabelling conspiracy theories as either "conspiracy stories" or "conspiracy narratives" to more accurately convey their true nature. (shrink)

In this article we examine the effectiveness of consent in data protection legislation. We argue that the current legal framework for consent, which has its basis in the idea of autonomous authorisation, does not work in practice. In practice the legal requirements for consent lead to ‘consent desensitisation’, undermining privacy protection and trust in data processing. In particular we argue that stricter legal requirements for giving and obtaining consent as proposed in the European Data protection regulation will further weaken the (...) effectiveness of the consent mechanism. Building on Miller and Wertheimer’s ‘Fair Transaction’ model of consent we will examine alternatives to explicit consent. (shrink)

This collection of texts offers his lectures from the 1970s and 80s on Platos Parmenides, tracing the history of Greek philosophy through to Plotinus and the Neo-Platonists and Gnostics with wit and erudition. The present volume follows the recent critical edition and French translation of Parmenides. The reasonable person standard is key to both Criminal Law and Torts. What does and does not count as reasonable behavior and decision-making is frequently deter- mined by lay jurors. Hence, laypeople’s understanding of the term must be considered, especially whether they use it predominately in an evaluative fashion. In this corpus study based on supervised machine learning models, we investigate whether laypeople use the expression ‘reasonable’ mainly as a descriptive, an evaluative, or merely a value-associated term. We find that (...) ‘reasonable’ is predicted to be an evaluative term in the majority of cases. This supports prescriptive accounts, and challenges descriptive and hybrid accounts of the term—at least given the way we operationalize the latter. Interestingly, other expressions often used interchangeably in jury instructions (e.g. ‘careful,’ ‘ordinary,’ ‘prudent,’ etc), however, are predicted to be descriptive. This indicates a discrepancy between the intended use of the term ‘reasonable’ and the understanding lay jurors might bring into the court room. (shrink)

Technological developments increasingly enable monitoring and steering the behavior of individuals. Enforcement of the law by means of technology can be much more effective and pervasive than enforcement by humans, such as law enforcement officers. However, it can also bypass legislators and courts and minimize any room for civil disobedience. This significantly reduces the options to challenge legal rules. This, in turn, can impede the development of legal systems. In this paper, an analogy is made with evolutionary biology to illustrate (...) that the possibility to deviate from legal rules and existing norms is sometimes necessary for the further development of legal systems. Some room to break the law, for instance, through civil disobedience or imperfect enforcement of the law, will ensure sufficient variation. This allows for properly evolving legal systems that can continue to provide fair solutions, even when society and concepts of fairness further develop. (shrink)

This volume develops new conceptual and theoretical directions in the study of religion, conflict, and violence through a sharp focus on materiality, drawing upon two previously unrelated fields of scholarship: research on religion and conflict and the material turn within religious studies.

The history of mathematics can be read in two ways. On the one hand, unlike the history of physics, it does not proceed by conjectures and refutations. New theories rarely refute old theories, but give them new foundations, generalize them, and reinterpret them through new concepts. This reading is unifying, highlighting the unity of the history of mathematics from its origins, through the permanence of its truths. On the other hand, many contemporary historians of mathematics have insisted on the diversity (...) of methods, objects, and practices throughout history. They have shown that the objects of the past mathematics are not the same as those of today. That second reading shatters the illusion of unity. It disjoins what the first reading unifies.Rather than deciding between these two readings, this chapter examines what makes them both possible and legitimate, based on an analysis of the acts of reading that we have to perform when confronted with the pages of a mathematical text, its signs, diagrams and images, and the different language modalities it employs. Starting with a discussion of Husserl's theses in The Origin of Geometry on the role of writing in the history of mathematics, and using a number of historical examples, the chapter shows that any reading of a mathematical text involves at least three divisions, three delimitations made by the reader’s gaze: divisions between the true and the false, between language and image, and between what is inside mathematics and what is outside. For the same text, these divisions are traced by the gaze in different ways throughout history.The chapter develops an example in greater detail, concerning the status of the equation in Descartes’ Geometry. It discusses the contrasting recent readings of the equation by two historians of science, Henk Bos and Enrico Giusti. It shows the concepts of The Geometry and the ideas the philosopher develops on reading and the nature of the sign. It shows how these ideas can be used to reconstruct how Descartes might have read a mathematical text, and it explains how successive readings of The Geometry can at the same time insert it into the mathematics of later centuries. Increasing numbers of decisions about everyday life are made using algorithms. By algorithms we mean predictive models captured from historical data using data mining. Such models often decide prices we pay, select ads we see and news we read online, match job descriptions and candidate CVs, decide who gets a loan, who goes through an extra airport security check, or who gets released on parole. Yet growing evidence suggests that decision making by algorithms may discriminate people, even if the computing (...) process is fair and well-intentioned. This happens due to biased or non-representative learning data in combination with inadvertent modeling procedures. From the regulatory perspective there are two tendencies in relation to this issue: to ensure that data-driven decision making is not discriminatory, and to restrict overall collecting and storing of private data to a necessary minimum. This paper shows that from the computing perspective these two goals are contradictory. We demonstrate empirically and theoretically with standard regression models that in order to make sure that decision models are non-discriminatory, for instance, with respect to race, the sensitive racial information needs to be used in the model building process. Of course, after the model is ready, race should not be required as an input variable for decision making. From the regulatory perspective this has an important implication: collecting sensitive personal data is necessary in order to guarantee fairness of algorithms, and law making needs to find sensible ways to allow using such data in the modeling process. This article offers a novel account of a key concept in Hannah Arendt’s political thought: amor mundi. In political theory’s ethical turn, theorists have increasingly turned to amor mundi as a source of ethical guidance and inspiration for politics. However, in doing so, they have elided Arendt’s distinct understanding of care. This article recovers Arendt’s understanding of amor mundi as care for the world by reconstructing the central concerns of her dissertation, Der Liebesbegriff bei Augustin, and tracing them to the (...) “Crisis” essays of Between Past and Future. It shows that amor mundi emerges in the dissertation as part of a question: if love is our fundamental orientation toward the world, how can we love the world without instrumentalizing it? The two “Crisis” essays provide the following answer: if love is to avoid—and perhaps militate against—the instrumentalization of the world, it must take the form of care. Following this analysis, this article contends that the contribution of amor mundi to the ethical turn is best understood, not as the ethos needed to guide action in the political realm, but as a key pre- or nonpolitical ethos needed to conserve the world where politics takes place—and thus the very possibility of politics. Custers and Aarts demonstrated that whether predictive relations between two events are stored in memory as unidirectional or bi-directional structures does not depend on awareness, but on attention. Here, the role of attention and top-down processes in producing these effects are investigated more closely.

The conscious awareness of voluntary action is associated with systematic changes in time perception: The interval between actions and outcomes is experienced as compressed in time. Although this temporal binding is thought to result from voluntary movement and provides a window to the sense of agency, recent studies challenge this idea by demonstrating binding in involuntary movement. We offer a potential account for these findings by proposing that binding between involuntary actions and effects can occur when self-causation is implied. Participants (...) made temporal judgements concerning a key press and a tone, while they learned to consider themselves as the cause of the effect or not. Results showed that implied self-causation increased temporal binding. Since intrinsic motor cues of movement were absent, these results suggest that sensory evidence about the key press caused binding in retrospect and in line with the participant’s sense of being an agent. In this essay I take up and try to follow a tantalizing phrase, "ontological vehemence," that is strewn about Ricoeur's later hermeneutic phenomenology—especially The Rule of Metaphor, Oneself as Another, and Memory, History, Forgetting —and which is often accompanied, often silently, by various forms of "nonphilosophy." I find it telling because it appears to serve as Ricoeur's passage between thinking and acting, and also to allow his unabashed vitalism to dwell with and alongside frank encounters with darkness and brokenness. How evaluative are legal texts? Do legal scholars and jurists speak a more descriptive or perhaps a more evaluative language? In this paper, we present the results of a corpus study in which we examined the use of evaluative language in both the legal domain as well as public discourse. For this purpose, we created two corpora. Our legal professional corpus is based on court opinions from the U.S. Courts of Appeals. We compared this professional corpus to a public corpus, (...) which is based on blog discussions on the internet forum Reddit. While many linguistic phenomena can give insights into evaluativity, we investigated the use of a wide selection of evaluative adjectives (more specifically, thick adjectives) to gain a more comprehensive picture of the degree of evaluativity in the legal domain. Our analysis shows that legal professionals use thick terms less evaluatively than laypeople, which suggests that legal texts are less evaluative than ordinary discussions. This result, more generally, supports the philosophical idea that thick concepts may vary in their evaluative intensity. (shrink)

Responding to Elizabeth Rottenberg's invitation to consider good signs, I first raise a question about “good” and “too good” signs by referring to a letter of Louis Althusser's that describes the risk that “too good” signs will be misread. I then turn to the distinction Rottenberg makes between deconstructive signs and Immanuel Kant's historical signs. Borrowing an image from Jacques Derrida's The Animal That Therefore I Am (2008), I suggest that we think of the task of abolition of the death (...) penalty as requiring a particular kind of strangulation of Kantian discourse, a strangulation that would reach the center of its nervous system and disarm its powers without putting it to death. Finally, I turn to a recent initiative by a Belgian nongovernmental organization (Groupe d'action dans l'interet des animaux or Global Action in the Interest of Animals [GAIA]) in their campaign to abolish the practice of castrating piglets without anesthetic, reading it as an example of a strategy that mobilizes the discourse of rights while at the same time undermining the sovereign power that sustains it. This provides an image of the sort of stranglehold with a certain lightness of touch that, I argue, Derrida's work on the death penalty prescribes as the task for unconditional abolition. (shrink)

Un modèle de navire de terre cuite, long de 42 cm, propriété de la Fondation Piéridis, à Chypre, a été trouvé en mer par un pêcheur au large d'Amathonte. Sept personnages y sont représentés. Grâce au soin et aux connaissances du coroplaste, le modèle, dont l'état de conservation est remarquable, fournit d'utiles informations sur l'architecture navale chypriote vers 600, date probable de son exécution. La position et les attributs des personnages permettent de penser que trois d'entre eux participent à une (...) cérémonie rituelle de protection religieuse accordée au navire et à ses quatre autres occupants, formant l'équipage proprement dit. Par ailleurs, l'absence d'un pont complet, constatée aussi sur deux modèles apparentés, incite à s'interroger sur la fonction de certains modèles de navires chypriotes : réceptacles d'offrandes à une divinité marine, parfois jetés à la mer en guise d'ex-voto? The author explains that there is indeed necessary that there be some reference to the unconditional, an unconditional without sovereignty, and thus without cruelty, which is no doubt a very difficult thing to think”. The two terms he uses to describe the object of affirmation further reinforce the understanding that Derrida is taking on metaphysics both in the sense of adopting it, and in the sense of challenging it. Thus, if doing “without sovereignty” is one of Derrida's imperatives, then that (...) is an imperative to do without the metaphysical fulcrum. The author purposes in what follows will be to articulate in very general terms the manner in which Derrida transformed the Kantian heritage. He will emphasize that the transformation involves both opening a different perspective on some of Kant's key concepts and developing a new relation to the methodology which critical philosophy inaugurated. Der heutige wissenschaftstheoretische Reflexionsstand im allgemeinen legt auch eine Reflexion auf die Prinzipien dieses "zweiten Diskurses" nahe. Dazu sind Vorbedingung die effektive Kenntnis der "Geschichte der Philosophiegeschichte" selber wie auch der Prinzipien, die diese Historiographie steuern. Eine Reihe sich für eine solche "Philosophie der Philosophiegeschichte" stellender Fragen und Problem-Topoi wird genannt, deren Existenz die heute allgemein spürbare "Prinzipienkrise" der Philosophiegeschichtsschreibung ausmacht.
