Discussion about a dignified death has almost exclusively been applied to palliative care and people dying of cancer. As populations are getting older in the western world and living with chronic illnesses affecting their everyday lives, it is relevant to broaden the definition of palliative care to include other groups of people. The aim of the study was to explore the views on dignity at the end of life of 12 elderly people living in two nursing homes in Sweden. A (...) hermeneutic approach was used to interpret the material, which was gathered during semi-structured interviews. A total of 39 interviews were transcribed. The analysis revealed three themes: (1) the unrecognizable body; (2) fragility and dependency; and (3) inner strength and a sense of coherence. (shrink)

Adorno’s reading of Hegel’s theory of civil society shapes his way of addressing the core question of his critical theory of society: “Why do social crises not lead to social transformation?” Our chapter investigates the philosophical innovations at the heart of Hegel’s and Adorno’s respective approaches to the problems revealed by the antagonisms of civil society. We will do this by asking the questions: 1. How does Hegel conceive of the antagonistic structure of civil society? 2. How does Hegel conceive (...) of the way civil society addresses crises of legitimacy? 3. How does Adorno think of the way modern welfare states silence crises of legitimacy? 4. How does Adorno’s conception of Bannkreis aim to illuminate the root structure of how all antagonistic societies silence crises of legitimacy? We will thereby focus on the basic antagonism at work in both Adorno’s and Hegel’s theories of society: the antagonism between the overwhelming power of social orders over individuals, and the fragile power of individuals to demand legitimacy from their social orders. First, we will briefly sketch Adorno’s surprisingly affirmative reading of Hegel’s theory of civil society. We then go on to assess what role antagonism plays in the latter. We will argue that Hegel sees education (Bildung) as the central operator in reconciling the antagonisms of civil society. This will allow us to take a new look at Adorno’s social theory as tracing Bannkreis through a plurality of models, which discloses the reproduction of the social totality as a form of counter-education (Halbbildung). We ultimately argue that Adorno conceptualises Bannkreis as an answer to the question of Hegel’s account of world-spirit that revives the insights of Hegel’s conception of civil society. We conclude by taking a closer look at how Bildung turns into the counter-education of Bannkreis, and what potential for socially transformative practice this dialogue between Adorno and Hegel uncovers. A recent qualitative study published in Neuroethics by Schembs and colleagues explores how functional neurodiagnostics of consciousness inform surrogate decision making in cases of disorders of consciousness. In this commentary, we argue that the chosen methodology significantly limits the scope of the potential conclusions and suggest an embedded ethnographic approach of co-presence as an alternative.

The ML community recognizes the importance of anticipating and mitigating the potential negative impacts of benchmark research. In this position paper, we argue that more attention needs to be paid to areas of ethical risk that lie at the technical and scientific core of ML benchmarks. We identify overlooked structural similarities between human IQ and ML benchmarks. Human intelligence and ML benchmarks share similarities in setting standards for describing, evaluating and comparing performance on tasks relevant to intelligence. This enables us (...) to unlock lessons from feminist philosophy of science scholarship that need to be considered by the ML benchmark community. In recent years, policymakers have begun to problematize how legislation stands in the way of the digitalization of the public sector. We are witnessing the emergence of a new phenomenon, digital-ready legislation, which implies that, whenever possible, new legislation should build on simple rules and unambiguous terminology to reduce the need for professional discretion and allow for the extended use of automated case processing in public-sector organizations. Digital-ready legislation has potentially wide-ranging consequences because it creates the conditions for how public (...) organizations are digitalized. The processes, practices, choices, and responsibilities for drafting digital-ready legislation, however, are not well-described or debated. Digital-ready legislation is a dormant issue. This paper develops the notion of the “double darkness” of digitalization to account for this. Based on a qualitative study, the paper investigates how digital-ready legislation as a sociotechnical arrangement is shaped by policy tools and by a complex, collaborative process where responsibility for legislation is fragmented. It argues that although the policy tools are aimed at making actors responsible for digitalization and creating clarity about the process, actors seem to be reluctant to take on the responsibility for making political decisions related to digitalization. ABSTRACTLawyers are increasingly called upon to deal with older clients and have ethical responsibilities to attest to their capacity for legal decision-making. As witnesses to enduring documents, the making of wills and other significant advance planning transactions, lawyers play a role in preventing elder abuse and in upholding the rights of older people. To date however, there has been very little empirical research examining how lawyers assess an older person’s legal decision-making capacity. This article presents research examining three years of (...) capacity complaints made to the New South Wales Office of Legal Services Commissioner. Four case studies from the complaint files expose some common failings in the way that lawyers interact with older clients who have experienced cognitive impairment. Background: In this study, we aimed to investigate the effects of a mindfulness program including Mindfulness-Based Stress Reduction on the mental health of student teachers when offered at their educational institution in a real-life context.Methods: A parallel randomized controlled trial was conducted among self-selected student teachers at a Danish undergraduate program for teacher education in the autumns of 2019 and 2020. Participation was not recommended in case of clinical depression or a diagnosis of psychosis or schizophrenia, abuse of alcohol, drugs, (...) and/or medicine. Randomization was performed by a Statistician who was blinded to the identity of the students. Data was collected using self-reported questionnaires. The primary outcome was a change in perceived stress 3 months from baseline. Secondary outcome measures were symptoms of anxiety and depression, well-being, resilience, mindfulness, and thoughts and feelings during rest. The effects were analyzed according to the intention-to-treat principle using mixed-effect linear regression models. Mediating effects of mindfulness skills on the mental health outcomes were explored using structural equation modeling.Results: The study group included 67 student teachers with 34 allocated to the intervention group ; and 33 students allocated to a waiting list control group. At baseline, mean Perceived Stress Scale scores were 18.88 in the intervention group and 17.91 in the waiting list control group. A total of 56 students completed the questionnaire at a 3-month follow-up. Statistically significant effects of the intervention were found on perceived stress, symptoms of anxiety and depression, well-being, and on three of seven resting-state dimensions. No effects were found on resilience or mindfulness. Statistically significant mediated effects via resting-state dimensions were found.Conclusion The findings suggested that offering a mindfulness program at an undergraduate program for teacher education could significantly improve the mental health among self-selected students within 3 months. Responsible conduct of research and research integrity has become a key concern in both research policy and public media resulting in a number of soft law documents, such as codes of conduct at national and supranational levels. This article zooms in on the institutions that are supposed to translate these overall policies and guidelines into workable and recognizable structures for researchers, that is, the mediating layer between the policy articulations and the individual researchers and research groups; a perspective which has (...) been notably lacking in the literature on research integrity. Document analysis demonstrated how research organizations translated and integrated demands for research integrity measures differently, and interviews explored how department heads made sense of these organizational efforts. Results show that department heads did not seem to use organizational policies in their sensemaking around research integrity. To a much larger degree, they used disciplinary norms, systemic pressures and other cues to construct the meaning of integrity. The heads of department articulated integrity as a “non-problem” in their own local context, rather, it was other departments and other countries that experienced lack of research integrity. This meant that the origin of the problem of integrity is located in the system, but to a large extent the department heads describe the solution of the problem to be in the culture of research. The authors of the Samnyāsa Upanisads, manuals of ascetic lifestyle and practice, recommend that wanderers renounce behavioral standards of their formerly Brahmin householder life, including ritual purity and familial duties. Patrick Olivelle argues that these ascetics are thereafter considered impure and corpse– or ghoul–like, clearly lacking in dharma. However, these Upanisads counsel pursuing mental purity and moral behavior, and modeling oneself after the perfection of the Absolute. This essay investigates ascetic notions of purity and identity, and virtues such as non–violence (...) and kindness cultivated in forest isolation. Is ascetic dharma universal in intent, and is it conceptually opposed to householder dharma? What type of ethics is admired by the authors, what type deprecated? Olivelle’s position is reevaluated, as is Jeffrey Kripal’s notion that monistic mysticism does not support ethics adequately. (shrink)

Surgical castration of sex offenders has been used in several countries to prevent sexual recidivism and is still practiced in several states in the United States. In Europe, it has remained in limited use in Germany and in the Czech Republic (Douglas et al. 2013). Since the 1960s, most jurisdictions have replaced irreversible surgical castration of sex offenders with reversible chemical castration with anti-androgen drugs. In Denmark, use of surgical castration was stopped in 1970, and since the late 1980s, serious (...) sex offenders have on a trial basis been treated with anti-androgen drugs (Hansen and Lykke-Olesen 1997). In 1997, an official treatment program for sex offenders was introduced on a trial basis, and in 2011 this scheme was made permanent (Nielsen 2001).The first part of the scheme covers persons with a suspended sentence with conditions of sexological treatment. This program serves as an alternative to suspended sentences of up to one and a half years of prison for crimina. (shrink)

Conducting research in a prison setting is ethically challenging. Because history is full of unethical research conducted in prison settings, researchers are often afraid of doing research in this area. It is argued that too much emphasis has been put on the protection of prison inmates as a vulnerable population. Consequently, too little research is being conducted where the focus is on those factors which serve to make the prison population vulnerable. In this paper ethical questions, emerging when conducting a (...) study on literacy and mental health among Norwegian prison inmates, are presented and discussed. Relevant questions relate to topics which include ethical clearance of the research protocol, the consent procedure, clarification of roles and the publication of the results. The ethical questions are discussed in relation to the four principles of ‘respect for the client's rights and dignity’, ‘competence’, ‘responsibility’ and ‘integrity’ set out in the meta-code of ethics, formulated by the European Federation of Professional Psychologists Associations. The wider relationships between ethics in society, research ethics in general, and ethics when conducting research in a prison setting are also considered. (shrink)

BackgroundHealthcare professionals and surrogate decision-makers often face the difficult decision of whether to initiate or withhold antibiotics from people with dementia who have developed a life-threatening infection after losing decisional capacity.MethodsWe conducted a vignette-based survey among 1050 Quebec stakeholders (senior citizens, family caregivers, nurses and physicians; response rate 49.4%) to (1) assess their attitudes toward withholding antibiotics from people with dementia lacking decisional capacity; (2) compare attitudes between dementia stages and stakeholder groups; and (3) investigate other correlates of attitudes, including (...) support for continuous deep sedation (CDS) and medical assistance in dying (MAID). The vignettes feature a woman moving along the dementia trajectory, who has refused in writing all life-prolonging interventions and explicitly requested that a doctor end her life when she no longer recognizes her loved ones. Two stages were considered after she had lost capacity: the advanced stage, where she likely has several more years to live, and the terminal stage, where she is close to death.ResultsSupport for withholding antibiotics ranged from 75% among seniors and caregivers at the advanced stage, to 98% among physicians at the terminal stage. Using the generalized estimating equation approach, we found stakeholder group, religiosity, and support for CDS and MAID, to be associated with attitudes toward antibiotics.ConclusionsFindings underscore the importance for healthcare professionals of discussing underlying values and treatment goals with people at an early stage of dementia and their relatives, to help them anticipate future care decisions and better prepare surrogates for their role. Findings also have implications for the scope of MAID laws, in particular in Canada where the extension of MAID to persons lacking decisional capacity is currently being considered. (shrink)

One of the greatest challenges facing current generations is the environmental and climate crisis. Democracies, so far, have not distinguished themselves by their capacity to bring about appropriate political responses to these challenges. This is partly explicable in terms of a lack of state capacity in a globalized context. Yet we also argue that election-centered democracies suffer from several flaws that make them inapt to deal with this challenge properly: youth is not appropriately represented; parliaments suffer from a lack of (...) diversity; elected representatives’ time-horizon is too narrow; anti-regulation lobbies have too much influence. Considering this, we argue for rejuvenating our democratic systems by introducing a randomly selected legislative chamber, which would be permanently integrated to our political systems and would play a deliberative and scrutinizing role. We have identified four eco-political arguments in favor of such reform. The generational rebalancing argument, which we examine first, has some plausibility but is not the strongest. The other three arguments – its eco-epistemic promises; its wider time horizon; and the independence of its members from short-term corporate interests – however, appear to us to be much more convincing. The value of diaconia is difficult to measure, its immaterial assets not easily grasped. In this article, I contribute to the area in analysing the perspective of 22 deacons on what is most important in their job and what could potentially be of greatest value if there were no restrictions of money and other resources. Data were collected in the midst of the Corona crisis in 2021 in the Porvoo diocese in the Evangelical Lutheran Church of Finland. The timing of (...) data collection therefore coincides with a unique chance to rethink ways of doing things. International research shows that the religious heritage of diaconia has changed from merely supporting people in need to also advocating marginalized groups and building bridges to other actors. This intangible heritage is sensitive to changes in society, whereby latent sources of value creation may be traced. Key contributions are identifying new areas of development of this religious heritage and assessing the value creation taking place – now and in a potential future. For this, understanding the changed role of diaconia in society and in the church are central. (shrink)

In modern and well-structured universities, ethics centers are playing a key role in hosting, organizing, and managing activities to enrich and guide students’ ethical thinking and analysis. This paper presents a comprehensive survey of the goals, activities, and administration of ethics centers, as well as their role in promoting ethical thinking for academic, career, and business purposes. The paper also gives an overview of the most common activities organized by these hubs in order to highlight their contributions to pedagogy, student (...) learning and intellectual growth, research development, and community service. This study is based on an intensive review conducted on seventy-five ethics centers established in universities and colleges around the globe. First, it provides administrations of academic institutions with the basic knowledge needed to plan for potential new ethics centers. They can benefit from the present expertise of described ethics centers and project the practical methodologies on their university needs. In addition, directors and coordinators of established ethics centers would enhance their experience by including new activities and collaborations to their plans. Finally, ethics course instructors can benefit from the listed activities to increase student involvement by including practical methods and discussions beyond the classroom. (shrink)

An increasing number of regulations propose the notion of ‘AI audits’ as an enforcement mechanism for achieving transparency and accountability for artificial intelligence (AI) systems. Despite some converging norms around various forms of AI auditing, auditing for the purpose of compliance and assurance currently have little to no agreed upon practices, procedures, taxonomies, and standards. We propose the ‘criterion audit’ as an operationalizable compliance and assurance external audit framework. We model elements of this approach after financial auditing practices, and argue (...) that AI audits should similarly provide assurance to their stakeholders about AI organizations’ ability to govern their algorithms in ways that mitigate harms and uphold human values. We discuss the necessary conditions for the criterion audit, and provide a procedural blueprint for performing an audit engagement in practice. We illustrate how this framework can be adapted to current regulations by deriving the criteria on which ‘bias audits’ for hiring algorithms can be performed, as required by the recently effective New York City Local Law 144 of 2021. We conclude by offering critical discussion on the benefits, inherent limitations, and implementation challenges of applying practices of the more mature financial auditing industry to AI auditing where robust guardrails against quality assurance issues are only starting to emerge. Our discussion as informed by experiences in performing these audits in practice highlights the critical role that an audit ecosystem plays in ensuring the effectiveness of such methodology. In “The Mind Incarnate” Shapiro argues that research in the area of embodied, embedded mind and cognition undermines a functionalist program. In contrast Clark, in “Pressing the Flesh”, argues that embodied, embedded approaches can be viewed as extended functionalistic approaches. In the light of these arguments my thesis is devoted to elucidating the logical relation between functionalism and embodied, embedded approaches. I argue that the functionalist programme is not undermined by embodied and embedded approaches. Shapiro argues that research of embodied, (...) embedded cognition and mind shows that characteristics of embodiment determine characteristics of mind. I label this view the body-detail model. The consequence of this model is that the very same kind of mind cannot exist in bodies with different characteristics. Thus, having a humanlike mind requires a humanlike body. This conflicts with abstract versions of functionalism that endorse multiple realization: the idea that the same mind can exist in different kinds of bodies. I argue against the body-detail model, demonstrating that for each of the research projects presented by Shapiro the strong reading that one has to have a humanlike body to have a human mind is not justified. This paves the way for an alternative reading, represented by Clark, under which the body is recognized as being part of a larger system which overall operating profile determines mind. Arguments for this position involve argumentative extensions of functionalism. On this basis I conclude that functionalism is not undermined by embodied, embedded approaches. (shrink)

Προτείνεται η αποκατάσταση της κάτοψης ενός σπιτιού του οποίου ήλθαν στο φως ορισμένα δωμάτια. Τα δωμάτια αυτά παρουσιάζουν αρχιτεκτονικά χαρακτηριστικά της παλαιοανακτορικής περιόδου: τοίχους, θρανία και σκάλες από πηλόχωμα με επάλειψη (...) κονιάματος, δάπεδα από μεγάλες πλάκες σκληρού ασβεστόλιθου και αρμούς από κονίαμα κόκκινου χρώματος. This article provides a deeper understanding of how meaning can be created in everyday life at a nursing home. It is based on a primary study concerning dignity involving 12 older people living in two nursing homes in Sweden. A secondary analysis was carried out on data obtained from three of the primary participants interviewed over a period of time (18—24 months), with a total of 12 interviews carried out using an inductive hermeneutic approach. The study reveals that sources of (...) meaning were created by having a sense of: physical capability, cognitive capability, being needed, and belonging. Meaning was created through inner dialogue, communication and relationships with others. A second finding is that the experience of meaning can sometimes be hard to realize. (shrink)

A recent single cell mRNA sequencing study by Dueck et al. compares neuronal transcriptomes to the transcriptomes of adipocytes and cardiomyocytes. Single cell ‘omic approaches such as those used by the authors are at the leading edge of molecular and biophysical measurement. Many groups are currently employing single cell sequencing approaches to understand cellular heterogeneity in cancer and during normal development. These single cell approaches also are beginning to address long‐standing questions regarding nervous system diversity. Beyond an innate interest in (...) cataloging cell type diversity in the brain, single cell neuronal diversity has important implications for neurotypic neural circuit function and for neurological disease. Research linking reading literary fiction to empathy supports health humanities programs in which reflective writing accompanies close readings of texts, both to explore principles of storytelling and to promote an examination of biases in care. Little attention has been paid to the possible contribution of guided fiction-writing in health humanities curricula toward enhancing cultural competence among health professionals, both clinical and community-based. Through an analysis of the short story “Pie Dance” by Molly Giles, juxtaposed with descriptions of specific writing exercises, (...) this paper explains how the demands of writing fiction promote cultural competency. Since the beginning of the last century, the Swiss school opened special classes to educate the most vulnerable students. Measures were put in place to develop specific practices related to the role assigned to the special education teacher. An investigation of interactional type has covered the process for reporting student at a preschool and elementary school levels. Qualitative analysis of teacher reports was conducted following the model of Goffman. The results highlight the role of the specialist teacher at the school. (...)
