Organ trafficking is officially banned in several countries and by the main Nephrology Societies. However, this practice is widespread and is allowed or tolerated in many countries, hence, in the absence of a universal law, the caregiver may be asked for advice, placing him/her in a difficult balance between legal aspects, moral principles and ethical judgments.In spite of the Istanbul declaration, which is a widely shared position statement against organ trafficking, the controversy on mercenary organ donation is still open and (...) some experts argue against taking a negative stance. In the absence of clear evidence showing the clinical disadvantages of mercenary transplantation compared to chronic dialysis, self-determination of the patient may conflict with other ethical principles, first of all non-maleficence. The present paper was drawn up with the participation of the students, as part of the ethics course at our medical school. It discusses the situation in which the physician acts as a counselor for the patient in the way of a sort of “reverse” informed consent, in which the patient asks advice regarding a complex personal decision, and includes a peculiar application of the four principles to the donor and recipient parties. BackgroundEthics consult services are well established, but often remain underutilized. Our aim was to identify the barriers and perceptions of the Ethics consult service for physicians, advance practice providers (APPs), and nurses at our urban academic medical center which might contribute to underutilization.MethodsThis was a cross-sectional single-health system, anonymous written online survey, which was developed by the UCSD Health Clinical Ethics Committee and distributed by Survey Monkey. We compare responses between physicians, APPs, and nurses using standard parametric and non-parametric statistical (...) methods. Satisfaction with ethics consult and likelihood of calling Ethics service again were assessed using a 0–100 scale using a 5-likert response structured (0 being “not helpful at all” to 100 being “extremely helpful”) and results presented using box plots and interquartile ranges (IQR).ResultsFrom January to July 2019, approximately 3800 surveys were sent to all physicians, APPs and nurses with a return rate of 5.5—10%. Although the majority of respondents had encountered an ethical dilemma (85–92.1%) only approximately half had ever requested an Ethics consult. The primary reason for physicians never having requested a consult was that they never felt the need for help (41%). For APPs the primary reasons were not knowing an Ethics consult service was available (33.3%) or not knowing how to contact Ethics (27.8%). For nurses, it was not knowing how to contact the Ethics consult service (30.8%) or not feeling the need for help (26.2%). The median satisfaction score (IQR) for Ethics consult services rated on a 0–100 scale, from physicians was 76 (29), for AAPs 89 (49), and nurses 70 (40) (p = 0.62). The median (IQR) of likelihood of consulting Ethics in the future also on a 0–100 scale was 71 (47) for physicians, 69 (45) for APPs, and 61 (45) for nurses (p = 0.79). APP’s and nurses were significantly more likely than physicians to believe that the team did not act on the Ethics consult’s recommendations.ConclusionsBased on the results presented, we were able to identify actionable steps to better engage healthcare providers—and in particular APPs and nurses—and scale up institutional educational efforts to increase awareness of the role of the Ethics consult service at our institution. Actionable steps included implementing a system of ongoing feedback that is critical for the sustainability of the Ethics service role. We hope this project can serve as a blueprint for other hospital-based Ethics consult services to improve the quality of their programs. (shrink)

Although researchers have paid much attention to the widespread cheating by students during their college careers and the possible sources behind such unethical behaviors, there has been less attention given to the unethical behaviors of faculty. Research on the types of unethical behaviors of faculty has pointed out the unique nature of higher education and the particular pressures placed on faculty as potential drivers of such behavior. In this paper, we examine the factors and underlying cognitive processes that may drive (...) faculty to engage in such behaviors. Specifically, we identify potential drivers of faculty unethical behavior, the cognitive processes activated by these drivers, and the types of behaviors that are considered most ethically questionable among faculty as they carry out their professional roles. Introduction: People with Spinal Cord Injury are at risk of feeling socially disconnected. Competitive esports present an opportunity for people with SCI to remotely engage in a community. The aim of this study is to discuss barriers to esports participation for people with SCI, present adaptive solutions to these problems, and analyze self-reported changes in social connection.Materials and Methods: We presented a descriptive data collected in the process of a quality improvement initiative at Mount Sinai Hospital. In 2019, seven individuals (...) with cervical SCI and quadriplegia participated in a special interest group on esports. Group scores were then analyzed for evidence of between subjects variability using a single sample t-test. A Pearson's correlation was conducted to determine the relationship between social connectedness and demographic data.Results: All players experienced functional limitations as a result of their injury but managed to design personalized gaming setups with adaptive equipment that allowed them to successfully compete in esports. All players reported a positive change in perceived social connectedness after participating in the special interest group. Score on Social Connectedness Scale negatively correlated with Time since injury.Discussion: It is feasible to create adaptive gaming setups that can be used by people with differing degrees and severity of SCI in a competitive esports environment. Technology and adaptive competitive esports have a potential to improve social connectedness and inclusion in people with quadriplegia. Further research on efficacy and effectiveness of these inclusive environments and their effects on quality of life, activity, and participation is warranted. (shrink)

Lorraine Daston ha señalado la influencia que The emergence of probability de Ian Hacking ha tenido en su trayectoria intelectual y en su elección de la etiqueta epistemología histórica para describir su trabajo. Hacking, por su parte, ha respondido a estos señalamientos que, en primer lugar, Daston y sus colegas no hacen epistemología, sino que más bien estudian conceptos epistemológicos como objetos que evolucionan y mutan; en segundo lugar, que su trabajo sobre la probabilidad no es epistemología histórica sino, en (...) todo caso, lo que él llama metaepistemología histórica o, mejor aún, ontología histórica. En el presente trabajo, analizo en qué forma entienden Daston y Hacking el tipo de investigación que denominan respectivamente epistemología y metaepistemología histórica, y exploro sus convergencias y divergencias con el fin de establecer posibles relaciones, intereses y antecedentes compartidos. Por último, sostengo que la obra de Hacking puede ser visualizada como resultado de investigaciones que caracterizan a la epistemología histórica, como consecuencia de su interés, estimulado por la lectura de Michel Foucault, en el análisis de las condiciones históricas de posibilidad para la emergencia de conceptos y objetos científicos. Os sites institucionais das universidades são ferramentas importantes para que os estudantes acessem as informações referentes à instituição. Espera-se que as informações distribuídas nos sites sejam de fácil acesso e contemplem informações completas. Considera-se o cuidado com a saúde mental discente um assunto muito importante, mas pouco explorado e/ou investido. Esse estudo tem por objetivo problematizar e discutir sobre os serviços de saúde mental discente encontrados através das informações apresentadas nos sites institucionais das universidades e avaliar a facilidade de acesso (...) às informações. Foram escolhidas 11 universidades federais da região sul do Brasil por amostra de conveniência, sendo uma pesquisa qualitativa onde foi utilizado o método descritivo e interpretativo com o auxílio da etnografia virtual para construção dos dados. Ao longo da pesquisa, percebeu-se uma dificuldade em encontrar informações sobre suporte à saúde mental e informações completas sobre os serviços estudados. Durante o estudo houve o questionamento sobre a necessidade de pensar a saúde mental discente além do viés biomédico centralizado em dificuldades cognitivas e/ou possíveis adoecimentos no meio acadêmico. Existe uma urgência de criar propostas de prevenção e promoção à saúde mental universitária ampliando os campos de atuação do psicólogo escolar. (shrink)

An essential requirement for increasing human confidence in computer systems is knowing an event’s origin. Therefore, it is necessary to have an efficient method to record such information. It is especially challenging in robotics, where unexpected behaviours can have unpredictable consequences, endangering the interests of people or even their safety. Furthermore, to analyse an incident’s cause or anticipate future behaviours, we must identify the events that cause a specific action. Although it is common to use logging systems for such purposes, (...) issues such as partial recording of events, unhelpful data or the impact on robot performance suggest conceiving new accountability solutions that assist when determining the responsible entities or the provenance of specific information. This paper presents a general-purpose approach to developing an accountability system for autonomous robots. It consists of four main components: a system event logger, a message producer, a distributed event streaming platform and a database. Our proposal is completely decoupled from the monitored system and allows real-time analysis, improving flexibility, besides system protection and transparency. Finally, the need to reduce the impact of the audit process and logging tasks on robot performance has promoted the development of different assessment scenarios to determine the best strategy for providing accounting services. There are important synergies for the next generation of ethical leaders based on the alignment of modified or adjusted mental models. This entails a synergistic application of moral imagination through collaborative input and critique, rather than "me too" obedience. In this article, we will analyze the Milgram results using frameworks relating to mental models (Werhane et al., Profitable partnerships for poverty alleviation, 2009), as well as work by Moberg on "ethics blind spots'' (Organizational Studies 27(3): 413-428, 2006), and by Bazerman (...) and Chugh on "bounded awareness" (Harvard Business Review, 2006; Mind & Society 6: 1-18, 2007) Using these constructs to examine the Milgram experiment, we will argue that the ways in which the experiments are framed, the presence of an authority figure, the appeal to the authority of science, and the situation in which the naïve participant finds herself or himself, all create a bounded awareness, a narrow blind spot that encourages a climate for obedience, brackets out the opportunity to ask the moral question: "Am I hurting another fellow human being?" and may preclude the subject from utilizing moral imagination to opt out of the experiment. We will conclude that these forms of almost blind obedience to authority are correctable, but with difficulty. We will argue that linking the modification of mental models to an unbinding of awareness represents an important synergistic relationship and one that can build effectively on the lessons learned from our experience with moral imagination. Sus obras poseen un valor inestimable dentro de la literatura eclesiástica y de la filosofía cristiana de los primeros siglos de la Iglesia. El presente estudio aborda desde la antropología filosófica el pensamiento de Clemente de Alejandría sobre el matrimonio cristiano. Es cierto que el matrimonio no constituye (...) uno de los temas centrales en las obras del autor cristiano, no obstante, dedicó gran parte del tercer libro de los Stromata a refutar doctrinas heréticas surgidas en torno al matrimonio. Este trabajo presenta una reflexión de tipo filosófico sobre los textos que se encuentran en las obras de Clemente de Alejandría en las que fundamenta su visión sobre el matrimonio. La finalidad, características, dignidad del matrimonio así como las segundas nupcias son algunas de las cuestiones que se tratan en este estudio desde la antropología filosófica. (shrink)

Socioeconomic inequality is perpetuated and exacerbated by an overlooked yet serious epidemic of time theft: the act of causing others to lose their time without adequate cause, compensation, or consent. We explain why time theft goes unnoticed, how it drives socioeconomic inequality, and what businesses and policymakers can do to address it.

A normal state on a von Neumann algebra defines a countably additive probability measure over its projection lattice. The von Neumann algebras familiar from ordinary QM are algebras of all the bounded operators on a Hilbert space H, aka Type I factor von Neumann algebras. Their normal states are density operator states, and can be pure or mixed. In QFT and the thermodynamic limit of QSM, von Neumann algebras of more exotic types abound. Type III von Neumann algebras, for instance, (...) have no pure normal states; the pure states they do have fail to be countably additive. I will catalog a number of temptations to accord physical significance to non-normal states, and then give some reasons to resist these temptations: pure though they may be, non-normal states on non-Type I factor von Neumann algebras can't do the interpretive work we've come to expect from pure states on Type I factors; our best accounts of state preparation don't work for the preparation of non-normal states; there is a sense in which non-normal states fail to instantiate the laws of quantum mechanics. This paper draws on the philosophies of Maurice Merleau‐Ponty and Hannah Arendt in order to explore the nature of free action. Part one outlines three familiar ways in which we often understand the nature of freedom. Part two argues that these common understandings of freedom are rooted in impoverished conceptions of time and subjectivity. Part three engages with Arendt’s conception of natality alongside Merleau‐Ponty’s conception of expression in order to argue that the freely acting self draws in improvisational manners on (...) the resources of a shared past in order to open unprecedented spaces of meaning for the future, and in so doing at once discovers and institutes herself as the self that she is. Part four draws on an example of anti‐oppressive political action in order to argue that free action not only has the power to inaugurate new spaces of shared meaning for the future, but also to change the sens of the shared past. By the same token, free action is vulnerable in its ontological status and ethical meanings to the events and judgments of the future. Part five argues with both Merleau‐Ponty and Arendt that ethical‐political actors can do no better than to cultivate a political virtù while facing up to the inherently transgressive dimensions of free action in a shared historical world. Background While the theoretical benefits and harms of Artificial Intelligence (AI) have been widely discussed in academic literature, empirical evidence remains elusive regarding the practical ethical challenges of developing AI for healthcare. Bridging the gap between theory and practice is an essential step in understanding how to ethically align AI for healthcare. Therefore, this research examines the concerns and challenges perceived by experts in developing ethical AI that addresses the healthcare context and needs. Methods We conducted semi-structured interviews with 41 (...) AI experts and analyzed the data using reflective thematic analysis. Results We developed three themes that expressed the considerations perceived by experts as essential for ensuring AI aligns with ethical practices within healthcare. The first theme explores the ethical significance of introducing AI with a clear and purposeful objective. The second theme focuses on how experts are concerned about the tension that exists between economic incentives and the importance of prioritizing the interests of doctors and patients. The third theme illustrates the need to develop context-sensitive AI for healthcare that is informed by its underlying theoretical foundations. Conclusions The three themes collectively emphasized that beyond being innovative, AI must genuinely benefit healthcare and its stakeholders, meaning AI also aligns with intricate and context-specific healthcare practices. Our findings signal that instead of narrow product-specific AI guidance, ethical AI development may need a systemic, proactive perspective that includes the ethical considerations (objectives, actors, and context) and focuses on healthcare applications. Ethically developing AI involves a complex interplay between AI, ethics, healthcare, and multiple stakeholders. (shrink)

ABSTRACT Against empiricist and rationalist prejudices concerning the nature of issues related to “mental health,” this article offers a phenomenological account of identity as developed in a meaningful system with the environment or world. Drawing on the work of Merleau-Ponty and Dewey, I argue that behavioral and emotional health and illness must be understood in terms of the plasticity or rigidity, respectively, of the individual's responses in the face of new and threatening environmental demands. However, individual plasticity and rigidity are (...) not given qualities of the individual but are themselves developed in healthy or unhealthy interpersonal environments. I discuss three cases of emotional and behavioral trouble in order to explore the manner in which unhealthy self-environment systems can undermine individuals' powers of adaptability and growth. : Some feminist epistemologists make the radical claim that there are varieties of epistemically valid warrant that agents access only through having lived particular types of contingent history, varieties of epistemic warrant to which, moreover, the confirmation-theoretic accounts of warrant favored by some traditional epistemologists are inapplicable. I offer Aristotelian virtue as a model for warrant of this sort, and use loosely Aristotelian vocabulary to express, and begin to evaluate, a range of feminist epistemological positions.

Cuatro años después de la revisión de España por el Comitéde la Convención sobre los Derechos de las Personas con Discapacidad, se realiza un examen minucioso de las políticas y leyes implementadas por el gobierno español, desde una óptica de derechos humanos. We often think of normal childhood as a progressive development towards a fixed—and often tacitly individualistic and masculine—model of what it is to be an adult. By contrast, phenomenologists, psychoanalysts, sociology of childhood, and feminist thinkers have set out to offer richer accounts both of childhood development and of mature existence. This paper draws on accounts of childhood development from phenomenologist Maurice Merleau-Ponty and object relations theorist D. W. Winnicott in order to argue that childhood development takes place in “transitional (...) spaces”; explores typical gendered patterns in the formation of selfhood that “split” relationality and separateness into the “feminine” and the “masculine”; and offers a phenomenology of perception, love, and objectivity in order to show the manner in which, contra individualistic and masculine visions of adulthood, maturity requires an embrace rather than eschewal of ambiguity, and the capacity to continue to dwell in the transitional space between relatedness and separateness. In 2010, Connecticut implemented an offence prohibiting minors from engaging in sexting. This legislation was part of a range of reforms across the United States aiming to better tailor the criminal law’s response to youth sexting by distinguishing sexting from child abuse material. Drawing from submissions to the Connecticut General Assembly’s Sexting Bill, media reports and recent ‘sexting’ cases, this article adopts a feminist perspective and examines the justifications for and implications of this sexting statute. It argues that while aiming (...) to create a distinction between child abuse material and sexting through a ‘lesser’ offence, these paternalistic reforms are informed by some of the same logics shaping child pornography/child abuse material law. Therefore, this statute is situated on a continuum of paternalistic legislation which utilises the constitutive expressive function of the criminal law to register anxieties about young people’s sexual and technological practices. As a result, this statute conflates victims and perpetrators of image based sexual abuses and fails to meet its deterrent and protective aims. (shrink)

Van Fraassen's 1991 modal interpretation of Quantum Mechanics offers accounts of measurement and state preparation. I argue that both accounts overlook a class of interactions I call General Unitary Measurements, or GUMs. Ironically, GUMs are significant for van Fraassen's account of measurement because they challenge it, and significant for his account of preparation because they simplify it. Van Fraassen's oversight prompts a question about modal interpretations: developed to account for ideal measurement outcomes, can they consistently account as well for the (...) whole horizon of laboratory practices by which we investigate QM? Nancy Tuana holds that the nature/nurture dichotomy does not accurately represent the world and hence that a whole series of assumptions about human nature is mistaken. She rejects both biological determinism and alternative interactionist views. I argue that although her arguments and political concerns do rule out any kind of simple biological determinism, they do not show that the alternative interactionist view is untenable: in fact, she uses the distinction in her attempt to demolish it. The international organic agricultureand fair trade movements represent importantchallenges to the ecologically and sociallydestructive relations that characterize the globalagro-food system. Both movements critique conventionalagricultural production and consumption patterns andseek to create a more sustainable world agro-foodsystem. The international organic movement focuses onre-embedding crop and livestock production in ``naturalprocesses,'' encouraging trade in agriculturalcommodities produced under certified organicconditions and processed goods derived from thesecommodities. For its part, the fair trade movementfosters the re-embedding of international commodityproduction and distribution in ``equitable socialrelations,'' developing a (...) more stable and advantageoussystem of trade for agricultural and non-agriculturalgoods produced under favorable social andenvironmental conditions. The international market forboth organic and fair trade products has grownimpressively in recent years. Yet the success of thesemovements is perhaps better judged by their ability tochallenge the abstract capitalist relations that fuelexploitation in the global agro-food system. While theorganic movement currently goes further in revealingthe ecological conditions of production and the fairtrade movement goes further in revealing the socialconditions of production, there are signs that the twomovements are forging a common ground in definingminimum social and environmental requirements. I arguefrom a theoretical and empirical basis that what makesfair trade a more effective oppositional movement isits focus on the relations of agro-food trade anddistribution. By demystifying global relations ofexchange and challenging market competitiveness basedsolely on price, the fair trade movement creates aprogressive opening for bridging the wideningNorth/South divide and for wresting control of theagro-food system away from oligopolistic transnationalcorporations infamous for their socially andenvironmentally destructive business practices. In a working note to The Visible and the Invisible, Maurice Merleau-Ponty makes an enigmatic call for “a psychoanalysis of Nature.” This paper argues that there are two interrelated ways in which this call might be taken up. First, it might be taken as the demand to give voice to the deep sense of a nature, conceived in terms of unconscious desire rather than scientific rationality, that precedes and exceeds human life. Second, we might do a psychoanalysis of our relationship (...) to nature, of the ways in which modern thought tends to deny and repress the unconscious, organic desire at its heart. This paper addresses the psychoanalysis of nature in both these senses. The first part of this paper takes up Merleau-Ponty’s well-known discussion of the phantom limb in Phenomenology of Perception in order to give a critique the mind-body dualism implicit in traditional attempts to account for this and related phenomena, and in order to present Merleau-Ponty’s own account of the phantom limb in terms of being in the world. Second, I argue that being in the world requires that we repress not only aspects of our personal pasts, but also our organic nature itself. Third, I argue that much of modern scientific thinking tends to deny the bodily and unconscious dimensions of conscious life—it is this denial that calls for a psychoanalysis in the second sense of studying our troubled and repressive relationship to nature. This denial of our own naturalness is accompanied by a denial of the unconscious and irrational nature of nature itself; finally, I will speak to the ways in which psychoanalysis might go further back than we might expect—beyond our childhoods and to the organic heartbeat of life itself.
