In choosing between moral alternatives -- choosing between various forms of ethical action -- we typically make calculations of the following kind: A is better than B; B is better than C; therefore A is better than C. These inferences use the principle of transitivity and are fundamental to many forms of practical and theoretical theorizing, not just in moral and ethical theory but in economics. Indeed they are so common as to be almost invisible. What Larry Temkin's book (...) shows is that, shockingly, if we want to continue making plausible judgments, we cannot continue to make these assumptions. Temkin shows that we are committed to various moral ideals that are, surprisingly, fundamentally incompatible with the idea that "better than" can be transitive. His book develops many examples where value judgments that we accept and find attractive, are incompatible with transitivity. While this might seem to leave two options -- reject transitivity, or reject some of our normative commitments in order to keep it -- Temkin is neutral on which path to follow, only making the case that a choice is necessary, and that the cost either way will be high. Temkin's book is a very original and deeply unsettling work of skeptical philosophy that mounts an important new challenge to contemporary ethics. (shrink)

It has been over a decade and half since Christof Koch and the late Francis Crick first advocated the now popular NCC project, in which one tries to find the neural correlate of consciousness for perceptual processes. Here we critically take stock of what have actually been learned from these studies. Many authors have questioned whether looking for the neural correlates would eventually lead to an explanatory theory of consciousness, while the proponents of NCC research maintain that focusing on correlates (...) is a strategically sensible first step, given the complexity of the problem. My point here is not to argue whether studying the NCC is useful, but rather, to question whether we are really studying the NCC at all. I argue that in hoping to sidestep the difficult conceptual issues, we have sometimes also missed the phenomenon of perceptual consciousness itself. (shrink)

Necessity is a notoriously dangerous and slippery concept-dangerous because it contemplates virtually unrestrained killing in warfare and slippery when used in conflicting ways in different areas of international law. Jens David Ohlin and Larry May untangle these confusing strands and perform a descriptive mapping of the ways that necessity operates in legal and philosophical arguments in jus ad bellum, jus in bello, human rights, and criminal law. Although the term "necessity" is ever-present in discussions regarding the law and ethics (...) of killing, its meaning changes subtly depending on the context. It is sometimes an exception, at other times a constraint on government action, and most frequently a broad license in war that countenances the wholesale killing of enemy soldiers in battle. Is this legal status quo in war morally acceptable? Ohlin and May offer a normative and philosophical critique of international law's prevailing notion of jus in bello necessity and suggest ways that killing in warfare could be made more humane-not just against civilians but soldiers as well. Along the way, the authors apply their analysis to modern asymmetric conflicts with non-state actors and the military techniques most likely to be used against them. Presenting a rich tapestry of arguments from both contemporary and historical Just War theory, Necessity in International Law is the first full-length study of necessity as a legal and philosophical concept in international affairs. Spontaneous intrusive recollections follow traumatic events in clinical and non-clinical populations. To determine whether any relationship exists between SIRs and enhanced memory for emotional events, participants viewed emotional or neutral films, had their memory for the films tested two days later, and estimated the number of SIRs they experienced for each film. SIR frequency related positively to memory strength, an effect more pronounced in the emotional condition. These findings represent the first demonstration of a relationship between SIRs occurring after an (...) emotional experience and subsequent memory strength for that experience. The results are consistent with the possibility that emotional arousal leads both to elevated SIR frequency and better memory, and that the covert rehearsal associated with SIRs enhances memory for emotional relative to neutral stimuli. Additional evidence of menstrual cycle influences on SIR incidence in female participants appears to merit consideration in future work. (shrink)

Weighing Lives in War examines the core principles of the modern law of war: necessity, proportionality, and distinction, and provides new and innovative insights into the process of weighing lives implicit in all theories of jus in bello.

The comorbidity of chronic pain and opioid addiction is a serious problem that has been growing with the practice of prescribing opioids for chronic pain. Neuroimaging research has shown that chronic pain and opioid dependence both affect brain structure and function, but this is the first study to evaluate the neurophysiological alterations in patients with comorbid chronic pain and addiction. Eighteen participants with chronic low back pain and opioid addiction were compared with eighteen age- and sex-matched healthy individuals in a (...) pain-induction fMRI task. Unified structural equation modeling (SEM) with Lagrange multiplier (LM) testing yielded a network model of pain processing for patient and control groups based on 19 a priori defined regions. Tests of differences between groups on specific regression parameters were determined on a path-by-path basis using z-tests corrected for the number of comparisons. Patients with the chronic pain and addiction comorbidity had increased connection strengths; many of these connections were interhemispheric and spanned regions involved in sensory, affective, and cognitive processes. The affected regions included those that are commonly altered in chronic pain or addiction alone, indicating that this comorbidity manifests with neurological symptoms of both disorders. Understanding the neural mechanisms involved in the comorbidity is crucial to finding a comprehensive treatment, rather than treating the symptoms individually. (shrink)

We typically think of prosecutorial ethics as encompassing a special set of obligations for prosecutors during the pretrial and trial stages of a criminal case. In the literature and in rules of professional responsibility much attention is paid to the charging function, contact with unrepresented persons, plea negotiations, discovery, and courtroom decorum. Our concern with prosecutorial ethics at these stages is rooted primarily in due process and fairness to the accused. [W]hile he may strike hard blows, the Supreme Court wrote (...) in Berger v. United States, [a prosecutor] is not at liberty to strike foul ones. Whether it is a recognition that the prosecutor acts as a representative of the sovereign or that he or she possesses extraordinary power over people's lives, we speak about the prosecutor's ethical duties as special or additional to those of ordinary lawyers. By preventing a prosecutor from litigating unfairly, the aim is to protect a criminal defendant from an unjust or unwarranted conviction. What, then, are the ethical duties of prosecutors after the defendant has had his fair shot at trial, but lost? The literature and standards are surprisingly silent, with rare exception, on the post-conviction ethics of prosecutors. Constraints on the prosecutorial function seem to reach their apex at trial. Why? Are the reasons for special or additional ethics for prosecutors non-existent on appeal? Is the vast discretion, present at the pretrial and trial stages and thought by some to justify special ethical duties, absent on appeal? As a recent case from Texas illustrates, ethical issues still abound even after a jury returns a verdict of guilty. Nevertheless, the traditional discourse on pre-conviction duties can help us determine how prosecutorial discretion should be exercised after a conviction has been obtained. (shrink)

My pocket calculator (Cal) has certain arithmetical abilities: it seems Cal calculates. That calculating is thinking seems equally untendentious. Yet these two claims together provide premises for a seemingly valid syllogism whose conclusion -- Cal thinks -- most would deny. I consider several ways to avoid this conclusion, and find them mostly wanting. Either we ourselves can't be said to think or calculate if our calculation-like performances are judged by the standards proposed to rule out Cal; or the standards -- (...) e.g., autonomy and self-consciousness -- make it impossible to verify whether anything or anyone (save myself) meets them. While appeals to the intentionality of thought or the unity of minds provide more credible lines of resistance, available accounts of intentionality and mental unity are insufficiently clear and warranted to provide very substantial arguments against Cal's title to be called a thinking thing. Indeed, considerations favoring granting that title are more formidable than generally appreciated. (shrink)

Constitutivists about one's cognitive access to one's mental states often hold that for any rational subject S and mental state M falling into some specified range of types, necessarily, if S believes that she has M, then S has M. Some argue that such a principle applies to beliefs about all types of mental state. Others are more cautious, but offer no criterion by which the principle's range could be determined. In this paper I begin to develop such a criterion, (...) arguing that although the principle applies when M is a belief, it does not apply when M is an emotion. I account for this asymmetry by focusing on differences in the commitments that belief and emotion conceptually involve, and briefly sketch out a psychological explanation of those differences. I conclude that one can reasonably split one's epistemological loyalties between constitutivism regarding meta-beliefs and non- constitutivism regarding beliefs about one's emotions. (shrink)

The absence of linear progression from one generation to the next creates a sameness and equilibrium that thwart separation and individuality. Oedipus’s brothers/sons fail in their adult roles, because neither can overcome the other’s right to the throne of Thebes and the mastery of its royal household. They are enemy brothers locked in reciprocal violence.2 Antigone and Ismene have escaped notice not only as enemy sisters but even as products of the same incest. Audiences for Sophocles’s Antigone have viewed them as “normal” women and cooperated with his characters in emphasizing the differences between them. They have assumed from Antigone’s betrothal to Haemon and resistance to Creon that she is the elder, more mature sister.3 They tend to accept without question that Antigone engages in burial rituals with Polyneices’s corpse (241–58) and returns to it (442–35).4 Bernard M. W. Knox’s critically powerful concept of the “Sophoclean hero” has bolstered this view of Antigone while reducing Ismene to a foil, and abetted the tendency of modern producers of the play to cast an older or more famous actress in the role of Antigone.5 Naturalistic readings like that of C. M. Bowra—“seeing that Ismene is her only close relative in the world, Antigone is remarkably cold to her”6—have masked the source and hence the vehemence of Antigone’s fury.That the reciprocity of the violence between Ismene and Antigone has gone unnoticed is understandable in view of the familiarity of the conflict between their brothers. Males in Greek society pursued difference by striving to excel as aristoi (best) in competition for prestige, wealth, and power.7 Whenever Eteocles and Polyneices came together, each asserted a right to Oedipus’s household and throne that was equally matched, and violence ensued from the equilibrium. On the other hand, Greek women were not supposed to compete with one another for distinction. They wove wool for clothes, maintained the household, and cared for the children, the sick, and the dead, activities that required cooperation away from public view.8 Proximity to other women was the norm and desideratum. Moreover, lawgivers like Solon based their funeral legislation on the premise that every woman wanted to participate in mourning.9 For the sake of public tranquillity, legislators tried to limit the numbers of women participants by imposing restrictions according to degrees of kinship, for instance, to children of fifth cousins. Can one’s belief that one romantically loves another be false? If so, under what conditions may one come to reasonably doubt, or at least suspend belief, that one does so? To begin to answer these questions, I first outline an affective/volitional view of love similar to psychologist R. J. Sternberg’s “triangular theory”, which analyzes types of love in terms of the degrees to which they include states of passion, emotion, and commitment. I then outline two sources of potential bias that (...) may cause one to believe that one romantically loves another when one does not. Partly on the basis of those potential sources of bias and partly on the basis of more specific issues, I then argue that at least to the extent that one is aware of these issues, one may reasonably doubt that one is experiencing romantic love’s emotional feelings, and one may reasonably doubt that one is making romantic love’s commitments. Finally, I order by relative dubitability the propositions that must be true about one’s passions, emotions, and commitments toward another in order for one to romantically love them. (shrink)

The aim of this paper is to show the relationship between John XXIII and Robert K. Greenleaf’s understanding of leadership. By taking into consideration Greenleaf’s theory of servant-leadership – from conceptualization to model development – and Larry Spears’ influential rubric of ten servant-leadership characteristics, we will show how servant-leadership theory goes in line with that of John XXIII when both are based on a notion of the common good and human dignity.

This article examines the relationship between online dispute resolution (ODR) and trust. We discuss what trust is, why trust is important, and how trust develops. Our claim is that efforts to implement online dispute resolution on a site or service in a manner that promotes trust need to consider ODR as just one tool in a broader toolbox of trust-building tools and techniques. These techniques are amongst others marketing, education, trust seals, and transparency. By evaluating ODR in its proper context (...) as one component of a larger trust strategy, we can more accurately set expectations for its results and position our projects for success. (shrink)

Among moral philosophers, general disapproval of genetic enhancement has in recent years given way to the view that the permissibility of a eugenic policy depends only on its particular features. Buchanan, Brock, Daniels, and Wikler have extensively defended such a view. However, while these authors go so far as to argue that there are conditions under which parents are not only permitted but also obligated to procure genetic treatments for their intended child, they stop short of arguing that there are (...) conditions under which parents are required to procure enhancements. By contrast, David Heyd argues that parents are required to procure treatments or enhancements for their future child, but only if the intervention would not alter the future child’s personal identity. In this paper I take the case for genetic enhancement a step further by arguing that there are conditions under which parents are morally required to procure genetic interventions for their intended child, regardless of whether the intervention is a treatment or an enhancement, and regardless of whether it would alter the child’s personal identity. Humanoid beings that behave like us and may share our functional organizations and even, perhaps, our neurophysiological makeups without qualetative conscious experiences, zombies seem to meet every materialist condition for thought on offer and yet -- the wonted intuitions go -- are still disqualefied from being thinking things. I have a plan. Other zombies -- good zombies -- can battle their evil (...) cousins to a standoff. Perhaps even defeat them. Familiar zombies and supersmart zombies resist disqualefication, making the world safe, again, for materialism. Behavioristic materialism. Alas for functionalism, good zombies still eat programs. _The Chinese room argument_ - John Searle's (1980a) thought experiment and associated (1984) derivation - is one of the best known and widely credited counters to claims of artificial intelligence (AI), i.e., to claims that computers _do_ or at least _can_ (someday might) think. According to Searle's original presentation, the argument is based on two truths: _brains cause minds_ , and _syntax doesn't_ _suffice for semantics_ . Its target, Searle dubs "strong AI": "according to strong AI," according to Searle, "the (...) computer is not merely a tool in the study of the mind, rather the appropriately programmed computer really _is_ a mind in the sense that computers given the right programs can be literally said to _understand_ and have other cognitive states" (1980a, p. 417). John Searle's Chinese room argument is perhaps the most influential andwidely cited argument against artificial intelligence (AI). Understood astargeting AI proper – claims that computers can think or do think– Searle's argument, despite its rhetorical flash, is logically andscientifically a dud. Advertised as effective against AI proper, theargument, in its main outlines, is an ignoratio elenchi. It musterspersuasive force fallaciously by indirection fostered by equivocaldeployment of the phrase "strong AI" and reinforced by equivocation on thephrase "causal powers" (at least) equal (...) to those of brains." On a morecarefully crafted understanding – understood just to targetmetaphysical identification of thought with computation ("Functionalism"or "Computationalism") and not AI proper the argument is still unsound,though more interestingly so. It's unsound in ways difficult for high church– "someday my prince of an AI program will come" – believersin AI to acknowledge without undermining their high church beliefs. The adhominem bite of Searle's argument against the high church persuasions of somany cognitive scientists, I suggest, largely explains the undeserved reputethis really quite disreputable argument enjoys among them. Harnad''s proposed robotic upgrade of Turing''s Test (TT), from a test of linguistic capacity alone to a Total Turing Test (TTT) of linguisticand sensorimotor capacity, conflicts with his claim that no behavioral test provides even probable warrant for attributions of thought because there is no evidence of consciousness besides private experience. Intuitive, scientific, and philosophical considerations Harnad offers in favor of his proposed upgrade are unconvincing. I agree with Harnad that distinguishing real from as if thought on the basis of (...) (presence or lack of) consciousness (thus rejecting Turing (behavioral) testing as sufficient warrant for mental attribution)has the skeptical consequence Harnad accepts — there is in factno evidence for me that anyone else but me has a mind. I disagree with hisacceptance of it! It would be better to give up the neo-Cartesian faith in private conscious experience underlying Harnad''s allegiance to Searle''s controversial Chinese Room Experiment than give up all claim to know others think. It would be better to allow that (passing) Turing''s Test evidences — evenstrongly evidences — thought. (shrink)

Many philosophers have discussed problems of additive aggregation across lives. In this article, I suggest that anti-additive aggregationist principles sometimes apply within lives, as well as between lives, and hence that we should reject a widely accepted conception of individual self-interest. The article has eight sections. Section I is introductory. Section II offers a general account of aggregation. Section III presents two examples of problems of additive aggregation across lives: Derek Parfit's Repugnant Conclusion, and my Lollipops for Life Case Section (...) IV suggests that many may have misdiagnosed the source and scope of anti-additive aggregationist considerations, due to the influence of Rawls's and Nozick's claims about the separateness of individuals. Accordingly, many leave Sidgwick's conception of self-interest—which incorporates an additive aggregationist approach to valuing individual lives—unchallenged. Section V suggests that the separateness of individuals may have led some to conflate the issues of compensation and moral balancing. Section VI argues that an additive aggregationist approach is often deeply implausible for determining the overall value of a life. Section VII discusses a Single Life Repugnant Conclusion, first considered by McTaggart. Section VIII concludes with a summary, and a brief indication of work remaining. (shrink)
