Die Arbeiten von Voss, Hastedt und Kochinka zeigen durch ihren Gliederungs- und Argumentationsstil, wie weit verzweigt und beziehungsreich die emotionstheoretische Diskussion inzwischen ist. Extreme Meinungen sind seltener geworden, Referat und Integration bestimmen den Zugang zu vorhandenen Ansätzen. Emotionen sind heute, anders als in der Gefühlsphilosophie des 18. Jahrhunderts, kein originäres philosophisches Problem, sondern durch Defizite und Vermittlungsschwierigkeiten einzelner Diskussionskontexte in den Fokus der Aufmerksamkeit gerückt. Die Arbeiten, die in den letzten Jahren Gefühle im Titel führten, haben demzufolge oft bilanzierenden (...) Status. Herausfordernde, bizarre Thesen sind eher Sache metaphysisch tendierender Naturwissenschaftler geworden. Der soziokulturelle Kontext der gefühlstheoretischen Konjunktur ist in den explizit philosophisch gemeinten Werken nicht immer sichtbar. Geisteswissenschaftliche Synopsen wie die von Pulcini und Illouz machen verständlich, unter welchen kulturellen Rahmenbedingungen 'Gefühle` zum Objekt von Verlustängsten als auch philosophischen Interesses werden konnten. J.L. Austin has demonstrated that people can do things—bring about social facts — with words. Here we describe how some people do things with things. This is a study of the symbolic use and situated history of material objects during a business negotiation between two German entrepreneurs: of the practical transformation of things-at-hand from objects of use into exemplars, or into forms-at-hand that can be used for the construction of transitory symbolic artifacts. Arranging boxes in a particular fashion can be (...) the equivalent of an illocutionary act, but unlike words things remain on the scene as indexical monuments to prior interactional arrangements. In the Metaphysics of Morals Kant repeats Hamann's remark that “only the descent into the hell of self-cognition can pave the way to godliness”. This article pursues the question what Kant and Hamann meant by a “descent into the hell of self-cognition” and a “way to godliness”. It will be shown that they share an affinity in their assessment that evil is rooted in humanity and that moral improvement is necessary, but that their views nevertheless differ significantly. For this reason (...) Kant later distances himself from Hamann. Whereas Hamann's view is that the recognition of one's own depravity leads to an experience of one's dependence on God, with the consequence that the concept of godliness is understood as salvation through grace, Kant emphasizes the inscrutability of evil within us and calls for moral improvement through our own effort. In this way the divergent moral conceptions of the age of Enlightenment with their theological and philosophical aspects are reflected in the respective views of these two authors. (shrink)

Ziel dieses Aufsatzes ist es, einige Grenzen der Theorie der Gerechtigkeit von John Rawls zu skizzieren. Es wird gezeigt, dass seine Theorie der Gerechtigkeit von zwei Arten von Limitierungen bestimmt wird: Einerseits gibt es intendierte Begrenzungen seines postmetaphysischen und deontologischen Politischen Liberalismus, andererseits nicht gewollte Lücken. Besondere Beachtung wird Rawls' Rekurs auf Kant geschenkt: Rawls verdankt Kant die Konzeption einer Art moralischer Geometrie. In dieser Fundierung eines modernen Paradigmas der Gerechtigkeit fokussiert sich die Attraktivität von Rawls' Versuch, aber auch dessen (...) Grenzen. (shrink)

Die Moderne hat zwei widerstreitende Fundierungen, einerseits den Rationalismus und andererseits den Romantizismus. Indem er eine neoromantische Ordnung von Gütern rehabilitiert und Quellen des Selbst erschließt, versucht Taylor das punktuelle Selbst des Rationalismus zu überwinden. Dieser Versuch ist nicht ohne Vorbild: Schon Hegel versuchte, eine Lösung für dieses epochale Dilemma zu finden. Wir können heute Hegels Vorschlag einer Vermittlung von Rationalismus und Romantizismus nicht zustimmen, aber das Dilemma, das er lösen sollte, besteht weiterhin. Vor dem Hintergrund von Taylors genealogischen Studien (...) und mit einem Blick auf Isaiah Berlin und William James wird verdeutlicht, dass Taylor Hegels Scheitern kopiert, um zu zeigen: Hegels Dilemma ist immer noch unser Dilemma. According to the results of medieval studies, modern rationalism depends on late Medieval Age and medieval nominalism. Reconstructing some of Ockham's innovations it is possible to open a new view of the development of modern subjectivity: Ockham's ontological individualism, his thesis that unnecessary individuals are epistemologically prior to universals and that evident knowledge of individuals is possible, his theological nominalism and his expliction of God's omnipotence and his creation, his logic of supposition and the use of his ,,razor" are essential (...) innovations at the end of the Medieval Age. In this way, it can be substantiated, in contrast to the classical prejudicial view of history of philosophy, that the crystallization of modern subjectivity as a postmedieval rationalism was basically influenced by the innovations of Ockham's nominalism. Mit dem Anfang der 1990er Jahre für kommerzielle Zwecke entwickelten World Wide Web hat die Nutzung digitaler Kommunikationsmedien rasant zugenommen; deren Einsatz ist zu einem Massenphänomen geworden. Das hat erhebliche Auswirkungen auf das Gesundheitswesen, die Psychotherapie und nicht zuletzt auch die Psychoanalyse. Neben der grundsätzlichen Frage nach dem gesellschaftlichen Umgang mit Gesundheits- bzw. Krankheitsdaten, dem Persönlichkeitsrecht der Bürger sowie dem Datenschutz bei der Nutzung digitaler Medien stellen sich auch grundlegende ethische Fragen in der Psychotherapie und in der Psychoanalyse. Unabdingbar für (...) die implizite Ethik der Psychoanalyse bzw. der psychoanalytisch begründeten Verfahren ist der geschützte therapeutische Raum, dessen Vorhandensein (nach innen und außen) überhaupt erst ermöglicht, vor- und unbewusstes Material zu untersuchen. Auch wenn die digitale therapeutische Kommunikation geeignet ist, bei Analytiker und Analysand das Phantasma der Omnipräsenz zu befördern, greift die radikale Ablehnung ihres Einsatzes zu kurz. Umgekehrt muss man sich der Frage stellen, ob und wie das, was Psychoanalyse ausmacht, im »Bereich des Virtuellen« bzw. mit den Mitteln digitaler Kommunikationsmedien möglich ist. (shrink)

Analogy making from examples is a central task in intelligent system behavior. A lot of real world problems involve analogy making and generalization. Research investigates these questions by building computer models of human thinking concepts. These concepts can be divided into high level approaches as used in cognitive science and low level models as used in neural networks. Applications range over the spectrum of recognition, categorization and analogy reasoning. A major part of legal reasoning could be formally interpreted as an (...) analogy making process. Because it is not the same as reasoning in mathematics or the physical sciences, it is necessary to use a method, which incorporates first the ability to specify likelihood and second the opportunity of including known court decisions. We use for modelling the analogy making process in legal reasoning neural networks and fuzzy systems. In the first part of the paper a neural network is described to identify precedents of immaterial damages. The second application presents a fuzzy system for determining the required waiting period after traffic accidents. Both examples demonstrate how to model reasoning in legal applications analogous to recent decisions: first, by learning a system with court decisions, and second, by analyzing, modelling and testing the decision making with a fuzzy system. The essay deals with the question whether Fichte’s socio-economic model was a utopia, which missed the contemporary economic theories of Western Europe and neglected its historical realities, or whether Fichte developed socio-political guidelines based both on the experiences and ideas of his time. Additionally, it explores how his socio-economic theorems stood out against cameralistic and feudal-conservative discussions and to what extent they can be described as an early critique of capitalism. Is the essence of Fichte’s socio-economic ideas to be seen (...) in his model of state regulation or rather in his methodological claim of genetically developing the phenomena by showing their mediating links? Finally, the author criticizes a superficial „up-dating“ of Fichte’s theoretical or political-economical ideas, because this would presuppose a horizon of problems which emerged only later. What is however still relevant today is Fichte’s idea that human beings are not the objects or means of social relations but their subjects and aims. For this purpose, Fichte developed a concept of justice that is constitutive for his notion of society. Democracy aiming at an active use of reason and social justice are the two moments which depend on each other.Im Zentrum des Beitrags steht die Problemstellung: Ist Fichtes sozialökonomisches Modell eine sowohl an den entwickelten zeitgenössischen ökonomischen Lehren Westeuropas vorbeigehende und historische Realitäten missachtende geschichtsferne Utopie? Oder entwickelte Fichte ein sowohl erfahrungsbasiertes wie auch zeitgenössische Ideen aufnehmendes sozialpolitisches Handlungskonzept? Weiterhin wird untersucht, wie sich seine sozialökonomischen Theoreme von kameralistischen und feudal-konservativen Erörterungen unterscheiden und inwieweit die These einer bereits kapitalismuskritischen Position Fichtes haltbar ist. Darüber hinaus wird erörtert, ob das Wesentliche der fichteschen sozialökonomischen Ideen in seinem Modell staatlicher Regulation zu sehen ist oder in seinem mit der genetischen Darstellungsweise verbundenen Anspruch, die Erscheinungen durch den Nachweis ihrer Vermittlungsglieder in ihrem Wesenszusammenhang theoretisch zu entwickeln. Abschließend wendet sich der Autor gegen das Zuschreiben einer vordergründig theoretischen oder politisch-ökonomischen Aktualität der Fichteschen Ideen. Aktuell erscheint dagegen der Gedanke, wonach der Mensch nicht Objekt oder Mittel sozialer Beziehungen, sondern deren Subjekt und Zweck ist. Dazu entwickelt Fichte einen für seine Gesellschaftsauffassung konstitutiven Gerechtigkeitsbegriff: Auf eingreifenden Vernunftgebrauch abzielende Demokratie und soziale Gerechtigkeit sind dabei einander bedingende Momente. Zu den wohl unbestritten durch Fichte eingebrachten Fortschritten in das philosophische Denken der Neuzeit gehört die in der ICH-Konzeption geleistete Vereinigung von theoretischer und praktischer Philosophie. Bekanntlich hatte Kant mit der Formulierung des kategorischen Imperativs die Forderung aufgestellt, dass das Unbedingte, das Sittengesetz, sein soll, weil die Vernunft es erfordere. Deren praktische Selbstverwirklichung ist das Ziel, insofern sich die Vernunft nicht anders als durch sich selbst zu realisieren vermag. Das Unbedingte ist folglich nicht ein Seiendes, sondern ein Aufgegebenes, Gegenstand eines (...) hervorbringenden Handelns. This paper reports on a micro-ethnography of social interaction in an urban plaza in Colombia, focusing on the plaza’s role as an arena for the acquisition of interaction skills. We investigate how children of different ages initiate and sustain interactions with same-age and older peers and the efforts they make to be recognized and ‘visible’. We interpret our data in light of three theories of socialization: Corsaro’s conception of childhood as “interpretive reproduction”, Vygotsky’s model of the “zone of proximal development”, (...) and the “structural approach” to social cognition and development. While a social form like the plaza, which is collectively enacted by members of all age groups of the local community, provides children with an extraordinarily rich array of opportunities to develop social communication skills by interacting with older and younger peers, our analysis also demonstrates that children, as they are building zones of proximal development for themselves, play a central role in assembling, integrating, and sustaining the neighborhood as a face-to-face society. In this fashion, the paper illustrates how the micro-analysis of social interaction can contribute to the analysis of social ‘macro’ forms. (shrink)

Today's multimedia-world gives many opportunities to ignore poverty and to violate the rights of the poor. Therefore some strategies obtain considerable importance which strengthen the observation and the communicative process on matters of poverty and social exclusion. official poverty reports belong to these instruments. Even international programmes to combat poverty might gain considerable communicative relevance. United Nations World Summit on Social Development at Copenhague 1995 should not be underestimated in its potential importance.

O presente artigo discute a relação da ética do altruísmo, defendida por Thomas Nagel, com a ética kantiana. Segundo o próprio Nagel, sua posição é semelhante à de Kant sob dois aspectos: ela defende a tese da autonomia da motivação moral, e ela funda a moral numa determinada autoconcepção da pessoa. No entanto, diferentemente de Kant, o princípio da ética nageliana é apenas o pressuposto modesto de que uma pessoa essencialmente considera a si mesma como sendo uma numa pluralidade de (...) pessoas. Partindo do argumento nageliano em The Possibility of Altruísmo, mas contemplando também a posição mais recente de Nagel em The Last Word, argumenta-se que Nagel só pode defender sua concepção de uma ética racional de modo convincente, se ele se aproximar mais da fundamentação kantiana da ética do que ele pretende. Mit ihr hat Fichte eine Überzeugung zum Ausdruck gebracht, die er als Entfaltung einer ursprünglichen Evidenz verstand, die am Beginn seines philosophischen Lebensweges stand. In ihr sind der Sache nach auch jene Einreden gegen die frühe Fassung der Wissenschaftslehre berücksichtigt und aufgenommen, wie sie vor allem von Friedrich Heinrich Jacobi, Friedrich Hölderlin und Friedrich von Hardenberg vorgebracht worden sind. Sie alle kommen darin überein, daß das Fichtesche Prinzip des Wissens nicht selbstgenügsam ist und (...) seinen Grund in einem Sein hat, das dem Wissen und der Reflexion entzogen ist. Darüber hinaus steht Fichtes These von der Grenze des Wissens für die Alternative zu Hegels Überzeugung von der Reichweite und Leistungskraft der Philosophie. (shrink)
