The series, founded in 1970, publishes works which either combine studies in the history of philosophy with a systematic approach or bring together systematic studies with reconstructions from the history of philosophy. Monographs are published in English as well as in German. The founding editors are Erhard Scheibe (editor until 1991), Günther Patzig (until 1999) and Wolfgang Wieland (until 2003). From 1990 to 2007, the series had been co-edited by Jürgen Mittelstraß.

For a long time Romanticism stood in the shadow of German Idealism. Hegel's criticisms were particularly decisive. This extended essay on the constitution for Europe represents Habermas’s constructive engagement with the European project at a time when the crisis of the eurozone is threatening the very existence of the (...) There is a growing realization that the European treaty needs to be revised in order to deal with the structural defects of monetary union, but a clear perspective for the future is missing. Drawing on his analysis of European unification as a process in which international treaties have progressively taken on features of a democratic constitution, Habermas explains why the current proposals to transform the system of European governance into one of executive federalism is a mistake. His central argument is that the European project must realize its democratic potential by evolving from an international into a cosmopolitan community. The opening essay on the role played by the concept of human dignity in the genealogy of human rights in the modern era throws further important light on the philosophical foundations of Habermas’s theory of how democratic political institutions can be extended beyond the level of nation-states. In the Metaphysics of Morals Kant repeats Hamann's remark that “only the descent into the hell of self-cognition can pave the way to godliness”. This article pursues the question what Kant and Hamann meant by a “descent into the hell of self-cognition” and a “way to godliness”. It will be shown that they share an affinity in their assessment that evil is rooted in humanity and that moral improvement is necessary, but that their views nevertheless differ significantly. For this reason (...) Kant later distances himself from Hamann. Whereas Hamann's view is that the recognition of one's own depravity leads to an experience of one's dependence on God, with the consequence that the concept of godliness is understood as salvation through grace, Kant emphasizes the inscrutability of evil within us and calls for moral improvement through our own effort. In this way the divergent moral conceptions of the age of Enlightenment with their theological and philosophical aspects are reflected in the respective views of these two authors. (shrink)

Ziel dieses Aufsatzes ist es, einige Grenzen der Theorie der Gerechtigkeit von John Rawls zu skizzieren. Es wird gezeigt, dass seine Theorie der Gerechtigkeit von zwei Arten von Limitierungen bestimmt wird: Einerseits gibt es intendierte Begrenzungen seines postmetaphysischen und deontologischen Politischen Liberalismus, andererseits nicht gewollte Lücken. Besondere Beachtung wird Rawls' Rekurs auf Kant geschenkt: Rawls verdankt Kant die Konzeption einer Art moralischer Geometrie. In dieser Fundierung eines modernen Paradigmas der Gerechtigkeit fokussiert sich die Attraktivität von Rawls' Versuch, aber auch dessen (...) Grenzen. (shrink)

Die Moderne hat zwei widerstreitende Fundierungen, einerseits den Rationalismus und andererseits den Romantizismus. Indem er eine neoromantische Ordnung von Gütern rehabilitiert und Quellen des Selbst erschließt, versucht Taylor das punktuelle Selbst des Rationalismus zu überwinden. Dieser Versuch ist nicht ohne Vorbild: Schon Hegel versuchte, eine Lösung für dieses epochale Dilemma zu finden. Wir können heute Hegels Vorschlag einer Vermittlung von Rationalismus und Romantizismus nicht zustimmen, aber das Dilemma, das er lösen sollte, besteht weiterhin. Vor dem Hintergrund von Taylors genealogischen Studien (...) und mit einem Blick auf Isaiah Berlin und William James wird verdeutlicht, dass Taylor Hegels Scheitern kopiert, um zu zeigen: Hegels Dilemma ist immer noch unser Dilemma. According to the results of medieval studies, modern rationalism depends on late Medieval Age and medieval nominalism. Reconstructing some of Ockham's innovations it is possible to open a new view of the development of modern subjectivity: Ockham's ontological individualism, his thesis that unnecessary individuals are epistemologically prior to universals and that evident knowledge of individuals is possible, his theological nominalism and his expliction of God's omnipotence and his creation, his logic of supposition and the use of his ,,razor" are essential (...) innovations at the end of the Medieval Age. In this way, it can be substantiated, in contrast to the classical prejudicial view of history of philosophy, that the crystallization of modern subjectivity as a postmedieval rationalism was basically influenced by the innovations of Ockham's nominalism. Unmittelbarkeit bezeichnet in der philosophischen Tradition etwas, was keiner weiteren erklarenden Begrundung bedarf und sich von selbst versteht, also unmittelbar einleuchtet. Dialektisches Denken bricht diese Selbstverstandlichkeiten auf, indem es auch die Kategorie der Unmittelbarkeit vermittelt; die dialektische Kritik der Unmittelbarkeit ist Aufklarung im Begriff, die das Gegebene nicht fraglos hinnimmt. Dies wird im Ruckgang auf die Geschichte des Begriffs dargelegt. Ihren Wendepunkt hat diese Geschichte bei Hegel, der den Schein der Unmittelbarkeit aufzeigt, indem er Unmittelbarkeit selbst als vermittelt erweist. Hieran (...) knupft Marx an, wenn er mit und gegen Hegel ein Konzept gegenstandlicher Vermittlung entwickelt. Damit springt er aus dem Gleis der nachhegelschen Philosophie, die - wie auch Feuerbach und andere Junghegelianer - gegen Hegel wiederum unvermittelte Unmittelbarkeiten aufbietet. Die gegenstandliche Vermittlung in realwissenschaftlichen Kontexten, wie z. B. in der Kritik der politischen Okonomie, zeigt jedoch gegenuber der Bewegung des Begriffs in Hegels Wissenschaft der Logik auch Grenzen der Vermittlung auf: bestimmte Gegensatze, so Marx, konnten nicht vermittelt, sondern es konne nur ihre Existenzgrundlage abgeschafft werden, so z. B. der Gegensatz von Lohnarbeit und Kapital. Hegels und Marx' Kritik der unvermittelten Unmittelbarkeiten erweist sich, so die zentrale These des Buches, bis in die Gegenwart als aktuell; sie ist Kern dialektischer Kritik an der scheinbaren Selbstverstandlichkeit des Bestehenden. Das hat erhebliche Auswirkungen auf das Gesundheitswesen, die Psychotherapie und nicht zuletzt auch die Psychoanalyse. Neben der grundsätzlichen Frage nach dem gesellschaftlichen Umgang mit Gesundheits- bzw. Krankheitsdaten, dem Persönlichkeitsrecht der Bürger sowie dem Datenschutz bei der Nutzung digitaler Medien stellen sich auch grundlegende ethische Fragen in der Psychotherapie und in der Psychoanalyse. Unabdingbar für (...) die implizite Ethik der Psychoanalyse bzw. der psychoanalytisch begründeten Verfahren ist der geschützte therapeutische Raum, dessen Vorhandensein (nach innen und außen) überhaupt erst ermöglicht, vor- und unbewusstes Material zu untersuchen. Auch wenn die digitale therapeutische Kommunikation geeignet ist, bei Analytiker und Analysand das Phantasma der Omnipräsenz zu befördern, greift die radikale Ablehnung ihres Einsatzes zu kurz. Umgekehrt muss man sich der Frage stellen, ob und wie das, was Psychoanalyse ausmacht, im »Bereich des Virtuellen« bzw. mit den Mitteln digitaler Kommunikationsmedien möglich ist. (shrink)

Analogy making from examples is a central task in intelligent system behavior. A lot of real world problems involve analogy making and generalization. Research investigates these questions by building computer models of human thinking concepts. These concepts can be divided into high level approaches as used in cognitive science and low level models as used in neural networks. Applications range over the spectrum of recognition, categorization and analogy reasoning. A major part of legal reasoning could be formally interpreted as an (...) analogy making process. Because it is not the same as reasoning in mathematics or the physical sciences, it is necessary to use a method, which incorporates first the ability to specify likelihood and second the opportunity of including known court decisions. We use for modelling the analogy making process in legal reasoning neural networks and fuzzy systems. In the first part of the paper a neural network is described to identify precedents of immaterial damages. The second application presents a fuzzy system for determining the required waiting period after traffic accidents. Both examples demonstrate how to model reasoning in legal applications analogous to recent decisions: first, by learning a system with court decisions, and second, by analyzing, modelling and testing the decision making with a fuzzy system. Zu den wohl unbestritten durch Fichte eingebrachten Fortschritten in das philosophische Denken der Neuzeit gehört die in der ICH-Konzeption geleistete Vereinigung von theoretischer und praktischer Philosophie. Bekanntlich hatte Kant mit der Formulierung des kategorischen Imperativs die Forderung aufgestellt, dass das Unbedingte, das Sittengesetz, sein soll, weil die Vernunft es erfordere. Deren praktische Selbstverwirklichung ist das Ziel, insofern sich die Vernunft nicht anders als durch sich selbst zu realisieren vermag. Das Unbedingte ist folglich nicht ein Seiendes, sondern ein Aufgegebenes, Gegenstand eines (...) hervorbringenden Handelns. What is politics? How is politics different from other spheres of human life? What is behind the debasement of political life today? This book argues that the most illuminating answers to these questions have come from Hannah Arendt. Arendt held that Western philosophy has never had a 'pure concept of the political', and that political philosophers have been guided and misguided by the assumptions implicit in their metaphysical questions. Her project was 'to look at politics … with eyes unclouded by (...) philosophy', and to retrieve the non-theoretical understanding of politics implicit in ancient Greek literature and history. David Arndt's original and accessible study shows how Arendt reworked some of the basic concepts of political philosophy, which in turn led her to a re-interpretation of American political history and even to a profoundly original reading of the US Declaration of Independence. Weltgeschichte ist, nach Hegel, Fortschritt im Bewusstsein der Freiheit. Das Prinzip der Freiheit geht jedoch auf seine Realisierung, wie Hegel vor allem im Blick auf das christliche Freiheitsprinzip zeigt. Das Freiheitsbewusstsein wird somit zur kritischen Instanz gegenuber der gesellschaftlich-politischen Wirklichkeit. Hegel nimmt damit das junghegelianische Programm der Verwirklichung der Philosophie vorweg, in dem jedoch das Konzept der Freiheitsgeschichte weitgehend durch eine Entfremdungsgeschichte ersetzt wurde. Karl Marx dagegen greift Hegels Konzept an der Problematik auf, die Hegel gesehen, aber fur die er (...) keine Losung hatte: dem Verlust der Freiheit und des Rechts fur grosse Teile der Bevolkerung durch die Entwicklung der kapitalistischen Okonomie. Marx, so die zentrale These des Buches, schreibt Hegels Konzept der Freiheitsgeschichte fort, wobei er, mit Hegel, die Verwirklichung der individuellen Freiheit als Bedingung der Freiheit aller in den Mittelpunkt stellt.
