This article argues that effective corporate social responsibility (CSR) of multinational pharmaceutical companies in developing countries should reflect context, opportunity, proximity, time and impact in accordance with the social integration and ethical approaches to CSR. It proposes a CSR model expressed as CSR=COPTI+SI+E, which acknowledges access-to-medicines as a matter in the global public domain, a public choice problem and a moral responsibility issue for multinational pharmaceutical companies. This model recognises the globalisation of the principle of humanity in communities of place (...) and communities of interest as highlighted by the Global Economic Ethic Manifesto 2009 as an integral part of the responsibilities of multinational pharmaceutical companies. The model reflects a global application of the concept of disadvantaged consumer already known to some national laws. The article suggests an access-to-medicines CSR framework for pharmaceutical companies which may include pricing, patents, testing and clinical trials, research and development, joint public private initiative and appropriate use of drugs. Following the situation of poverty in the rights paradigm, this paper explores the links between the rights-based and corporate social responsibility approaches to the realization of socioeconomic rights in the broader context of an emerging recognition of CSR as private regulation of business behaviour. It examines complex theoretical and practical dimensions of responsibility and potential contributions of businesses to poverty alleviation and clarifies the apparent paradox of legal compulsion of essentially voluntary CSR activities. Rather than treat rights and CSR as (...) parallel approaches to protecting socioeconomic rights, it is argued that CSR can be part of a coherent framework of laws and policies for legally translating broad human rights commitments to poverty reduction into concrete programmes. The paper demonstrates how legally propped CSR arrangements can support poverty reduction and appropriate task-specific contextualised definitions and boundaries of CSR that complement the rights-based approach. It is argued that human rights principles have normative dimensions to guide and help formulate policies, programmes and practices, which in turn allow for a creative use of and legal prop to CSR. The conceptualization of human rights is not restricted to one implementation method, and CSR can partly satisfy states’ human rights obligations and transcend the narrow conventional human rights discourse on obligations of non-state actors. Corporate social responsibility (CSR) is increasingly becoming a popular business concept in developed economies. As typical of other business concepts, it is on its way to globalization through practices and structures of the globalized capitalist world order, typified in Multinational Corporations (MNCs). However, CSR often sits uncomfortably in this capitalist world order, as MNCs are often challenged by the global reach of their supply chains and the possible irresponsible practices inherent along these chains. The possibility of irresponsible practices puts global (...) firms under pressure to protect their brands even if it means assuming responsibilities for the practices of their suppliers. Pressure groups understand this burden on firms and try to take advantage of the situation. This article seeks to challenge the often taken-for-granted-assumption that firms should be accountable for the practices of their suppliers by espousing the moral (and sometimes legal) underpinnings of the concept of responsibility. Except where corporate control and or corporate grouping exist, it identifies the use of power as a critical factor to be considered in allocating responsibility in firm-supplier relationship; and suggests that the more powerful in this relationship has a responsibility to exert some moral influence on the weaker party. The article highlights the use of code of conducts, corporate culture, anti-pressure group campaigns, personnel training and value reorientation as possible sources of wielding positive moral influence along supply chains. Corporate social responsibility (CSR) is a relatively undeveloped concept despite its increasing importance to corporations. One difficulty is the possible inexactness of CSR. Another is the apparent reluctance by regulatory authorities and policy makers to intervene in the area. This is largely a result of inhibitions created by traditional approaches to company law with emphasis on shareholder protection and financial disclosure. The consequence is the stultification of independent development of CSR by tying social issues to financial performance. This attitude might (...) not be unconnected to the theoretical and practical challenges in justifying CSR and defining its scope. The underlying impediment is a factual and theoretical failure to distinguish ‘instrumental’ and ‘pure’ (ethical) CSR. This article demonstrates that ethical CSR highlights the role of regulation, and a principal stance is that regulation is neither incompatible nor irreconcilable with ethical CSR. The article argues that cognizance of the intrinsic moral justification of ‘pure’ CSR is required for delineating the scope of CSR as well as for clarifying the desirability and extent of its regulation. It argues that the dynamic history and visage of multinational corporate corruption illuminates the fluidity of the regulation–CSR relationship. The current and widening backlash against transnational corporate corruption is, arguably, a demonstration of the position that regulation and CSR are not mutually exclusive and absolute concepts. This article submits that recognition and application of this ‘ethical’ and ‘instrumental’ CSR distinction is fundamental to the development of CSR and resolution of connected questions of regulation. Richard Rorty’s idealization of public dialogue pits literature and narrative against objectivity and ethics, thus leaving non-intellectual practitioners in the lurch. The evolutionary arc of Rorty’s oeuvre merits an assessment of the historiography he uses to prevent figures like Michel Foucault and Cornel West from being full participants in public dialogue. Miranda Fricker’s account of the collective explains confidence and transparency in an ironized ethical tradition that mediates irony and objectivity. Fricker’s mediation positions West’s use of Foucault’s to re-narrate pragmatism (...) as a way to embrace the process of rendering ethical experience universalizable. Ironized post-philosophical cultures can be explained responsibly by ironists within critically reflective ethical traditions. Rorty’s account imagines dialogue as if the secularization of public political culture is inevitable. Buber’s account imagines a philosophy of dialogue in which religious considerations are unproblematic. In Plato's Theaetetus Socrates is portrayed as a midwife of the intellect. The comparison of Socratic questioning to midwifery had until recently been commonly attributed to Socrates himself. In 1977 M. F. Burnyeat published Socratic Midwifery, Platonic Inspiration, which transformed the way in which the dialogue has since been perceived. The author maintains that the midwife comparison is in no sense to be attributed to the historical Socrates.

The increasing prevalence of ecologically sustainable products in consumer markets, such as organic produce, are generally assumed to curtail anthropogenic impacts on the environment. Here I intend to present an alternative perspective on sustainable production by interpreting the relationship between recent rises in organic agriculture and greenhouse gas emissions from agricultural production. I construct two time series fixed-effects panel regressions to estimate how increases in organic farmland impact greenhouse gas emissions derived from agricultural production. My analysis finds that the rise (...) of certified organic production in the United States is not correlated with declines in greenhouse gas emissions derived specifically from agricultural production, and on the contrary is associated positively overall agricultural greenhouse gas emissions. To make sense of this finding, I embed my research within the conventionalization thesis. As a result I argue that the recent USDA certification of organic farming has generated a bifurcated organic market, where one form of organic farming works as a sustainable counterforce to conventional agriculture and the other works to increase the economic accessibility of organic farming through weakening practice standards most conducive to reducing agricultural greenhouse gas output. Additionally, I construct my own theoretical framework known as the displacement paradox to further interpret my findings. (shrink)

Diese Arbeit widmet sich einem Hauptproblem der kantischen Pflichtensystematik in der Tugendlehre: Der Unterscheidung von vollkommenen und unvollkommenen Pflichten und der resultierenden Spannung zwischen Einleitung und Elementarlehre. Während in der Einleitung in die Tugendlehre Tugendpflichten begrifflich nur als unvollkommene Pflichten eingeführt und abgeleitet werden, beginnt die Elementarlehre mit einem extensiven Abschnitt über vollkommene Pflichten, die dennoch Tugendpflichten sein sollen. Nach einer kurzen Betrachtung einschlägiger Vorschläge der Literatur zu diesem Problem, versucht die vorliegende Arbeit aus dem Konzept der Weite von Pflichten (...) Kriterien für die Zuordnung der verschiedenen Tugendpflichten zu gewinnen. Im Lichte dieser Kriterien erscheint Kants Beurteilung mancher verhandelter Pflichten als ‚vollkommen’ gerechtfertigt. Abschließend wird gezeigt, inwiefern sie dennoch zu den Tugendpflichten gehören können, indem Kants eher beiläufige Unterscheidung von Strebens- und Erhaltungspflichten in den Mittelpunkt gerückt wird. Unvollkommenheit einer Pflicht folgt nur aus ethischen Strebenspflichten, nicht aus gebotenen Maximen überhaupt. Das Ziel der Exposition aller relevanten Merkmale, die zu einer Tugendpflicht gehören können, lässt verstehen, warum die Einleitung nur auf Strebenspflichten zentriert ist.This essay is concerned with one of the main problems in Kant’s system of duties in the Tugendlehre: the difference between perfect and imperfect duties and the resulting inconsistency between introduction and Elementarlehre. Even though the introduction establishes and derives duties of virtue as imperfect duties only, the Elementarlehre begins with a long section concerning perfect duties, which nevertheless are supposed to be duties of virtue. After a brief consideration of other interpreter’s views on this topic, this essay tries to develop criteria for the categorisation of the different duties of virtue from the concept of a duty’s latitude. In light of these criteria, Kant’s categorizing some of the discussed duties as perfect seems justifiable. Finally I will show, why they can nevertheless be ‘duties of virtue’, by emphasizing Kant’s distinction between duties to strive and those to conserve. Imperfection of a duty follows from duties to strive only, not from obligatory maxims per se. The goal of introducing all relevant characteristics, a duty of virtue may have, can explain, why the introduction is only concerned with duties to strive. (shrink)

Originally published in 1990, this book centres on a certain way of surveying a variety of theories of language, and on outlining a new proposal of meaning within the framework set by the survey. One of the key features of both survey and proposal is the insistence on the need to locate theories of language within a large framework that includes questions about the nature of thought and about general ontological questions as well. The book deals in an interconnected way (...) with both very general and specific issues. I first characterize a moral mistake in coercion. The principle of independence with which I criticize coercion seems also to condemn exchange. I propose an account of exchange from which it follows that exchange upholds independence after all. In support of that account I argue that, of the accounts of exchange that occur to me, only this one has the consequence that, on general assumptions, a person can take part in exchange while acting, intending, and believing with sufficient reason. I (...) argue that the hiring of very poor people by very rich people for labor from which the rich draw a substantial surplus does not give rise to an exchange of this kind. Njega wa Gioko was one of the pioneer Chiefs in Kirinyaga county of Kenya. The other pioneer Chief in Kirinyaga county was Gutu wa Kibetu who reigned in the Eastern part of Kirinyaga county. Gioko reigned in the western part of Kirinyaga county that extended to some geographical parts of the present-day Nyeri county and the present-day Embu county. Njega also became the first paramount Chief of Embu district, which refers to the present-day Embu and Kirinyaga counties. As colonial hegemony (...) and the protestant missionary enterprises, and its resultant evangelical theology, began to shape up in the present-day Kirinyaga county and the surrounding areas between 1904 and 1906, it found Gioko and Kibetu as the Athamaki. The evangelical European missionaries who were comfortable with the colonial expansion, as it provided western governance structures that favoured their enterprises, employed Calvinistic theology in their dealings with the colonial government, and they dealt with the local leaders, who were eventually ‘promoted’ to the post of Chiefs in 1908 by the new rulers. Nevertheless, the missionary’s emphasis on unrealised eschatology differed sharply with those of Athamaki who were the custodians of African indigenous religion and its resultant emphasis on realised eschatology. As an agent of African religion, how did Gioko relate with the early 20th-century evangelical European missionaries and their Calvinistic tendencies that favoured the Church–State relationship as the way of God? The data for this research article are gathered through oral interviews, archival sources and extensive review of the relevant literature.Contribution: This article contributes to the journal’s vision and scope with its focus on the early protestant theologies of the European Missionaries of the 19th and 20th centuries, and their resultant clashes with the theologies of African indigenous religion. As a multidisciplinary article that builds on a theo-historical design, the article contributes to the ongoing discourses on gospel and culture. (shrink)

Morality is often thought of as non-rational or sub-rational. In Moral Notions, first published in 1967, Julius Kovesi argues that the rationality of morality is built into the way we construct moral concepts. In showing this he also resolves the old Humean conundrum of the relation between 'facts' and 'values'. And he puts forward a method of reasoning that might make 'applied ethics' (at present largely a hodge-podge of opinions) into a constructive discipline. Kovesi's general theory of concepts - (...) important in its own right - is indebted to his interpretation of Plato, and his three papers on Plato, first published here, explain this debt. This new edition of Moral Notions also includes a foreward by Philippa Foot, a biography of the author, and a substantial afterword in which the editors, Robert Ewin and Alan Tapper, explain the signficance of Kovesi's work. Suppose that U and U' are normal ultrafilters associated with some supercompact cardinal. How may we compare U and U'? In what ways are they similar, and in what ways are they different? Partial answers are given in [1], [2], [3], [5], [6], and [7]. In this paper, we continue this study. In [6], Menas introduced a combinatorial principle χ(U) of normal ultrafilters U associated with supercompact cardinals, and showed that normal ultrafilters satisfying this property also satisfying this property also (...) satisfy a partition property. In [5], Kunen and Pelletier showed that this partition property for U does not imply χ (U). Using results from [3], we present a different method of finding such normal ultrafilters which satisfy the partition property but do not satisfy χ (U). Our method yields a large collection of such normal ultrafilters. (shrink)

Moral rights feature prominently and are relied on substantially in debates in bioethics. Conceptually, however, duties can perform the logical work of rights, but not vice versa, and reference to rights is therefore inessential. Normatively, rights, like duties, depend on more basic moral values or principles, and attempts to establish the logical priority of rights over duties or the reverse are misguided. In practical decision making, however, an analysis in terms of duties is more fruitful than one based on rights. (...) A right may function as a proxy term for a consequentialist rule, or for a deontological constraint, but does not thereby enrich these concepts. Rights may also help in a purely expressive sense and may assist an initial focusing on a moral conflict. However, their role in bioethics discourse is more one of convenience than of necessity. Moreover, unless rights are firmly founded on fundamental moral values, their use encourages rhetoric rather than argument. (shrink)
