The paper critically reviews the challenges facing the European Court of Human Rights when hearing claims being brought under Article 2 of the European Convention on Human Rights in relation to the phenomena of enforced disappearances as a result of the internal armed conflicts of Turkey and Chechnya. The paper traces the phenomenal and, oftentimes, controversial evolution of the associated jurisprudence and provides evidence of judicial disparities and inconsistencies that are not easily rationalised. Such inconsistencies suggest that whilst Strasbourg’s intention (...) may be to ensure accountability in the face of adversity and human atrocities, its noble cause may be based on judicially unsubstantial foundations. The use of genomic testing in pregnancy is increasing, giving rise to questions over how the information that is generated should be offered and returned in clinical practice. While these tests provide important information for prenatal decision-making, they can also generate information of uncertain significance. This paper critically examines three models for approaching the disclosure of variants of uncertain significance (VUS), which can arise from forms of genomic testing such as prenatal chromosomal microarray analysis (CMA). Contrary to prevailing arguments, we (...) argue that respect for reproductive autonomy does not justify adopting a model on which an offer to disclose VUS is a routine part of genetic counselling. Instead, we contend that a commitment both to solidarity between healthcare providers and pregnant women and to the acceptance of a novel principle of caution under normative uncertainty means that we should instead adopt a model of VUS disclosure that imposes a strong presumption against offering to disclose VUS. The upshot of this is that it should be standard practice to only offer to disclose VUS when this is requested by the woman undergoing CMA. We defend our position against claims that arise from an alleged right to such information and that a presumption against an offer will lead to inequity. (shrink)

This essay re-examines Kierkegaard's view of Socrates. I consider the problem that arises from Kierkegaard's appeal to Socrates as an exemplar for irony. The problem is that he also appears to think that, as an exemplar for irony, Socrates cannot be represented. And part of the problem is the paradox of self-reference that immediately arises from trying to represent x as unrepresentable. On the solution I propose, Kierkegaard does not hold that, as an exemplar for irony, Socrates is in no (...) way representable. Rather, he holds that, as an exemplar for irony, Socrates cannot be represented in a purely disinterested way. I show how, in The Concept of Irony, Kierkegaard makes use of 'limiting cases' of representation in order to bring Socrates into view as one who defies purely disinterested representation. I also show how this approach to Socrates connects up with Kierkegaard's more general interest in the problem of ethical exemplarity, where the problem is how ethical exemplars can be given as such, that is, in such a way that purely disinterested contemplation is not the appropriate response to them. This article probes the philosophical and political significance of the relationships between wheelchair activists and their wheelchairs. Analyzing disability memoirs and the work of a professional wheelchair dancer, I argue that wheelers frequently experience complex relationality and queer kinships with their wheels. By bringing the artistry of disabled writers and dancers into conversation with the notions of human–material relations in the work of Donna Haraway, Jane Bennett, Stacy Alaimo, and Mel Chen, I show how alternative animacies shape wheelers’ conceptions of (...) interdependence and movement. The sensuous pleasure they take in their wheels queers conventional conceptions of how humans should relate to things. New materialist philosophy has increasingly drawn attention to the porous boundaries between the human and material world. But where posthumanist philosophers have largely aimed to dethrone the sovereignty of the human, disability activists use alternative animacies to raise up a devalued and discounted portion of humanity: to emphasize the agency and capacity of those whose lives are often cast as pitiable and powerless, to express a queer feminist disability culture and politics, and to claim the transgressive vitality and vibrant artistry of life with disability. To carry out this task it is necessary to define three points on which this paper will be about: first, the author will inform the reader about the old discussion among poetry and philosophy to understand the context of the crisis between these two forms of teaching; Second, criticism established in the book X on the lack of rigor in the search of knowledge that poets have will be addressed. Several accounts of the evolution of religion distinguish two phases: an earlier shamanic stage and a later doctrinal stage. Similarly, several theories of human cognition distinguish two cognitive modes: a phylogenetically older system that is largely intuitive and a later, more distinctively human system that is more rational and articulate. This article suggests that cognition in the earlier stage in the evolution of religion is largely at the level of intuition, whereas the cognition of doctrine or religion is more conceptual (...) and rational. Early religious cognition is more embodied and is more likely to carry healing benefits. The evolutionary origins of religion in humans seem to depend on developments in the cognitive architecture. It is further suggested that the cognition of early religion shows less conceptual differentiation, is characteristically participatory rather than objectifying and is less individualistic. The development of religion in recent centuries appears to show some approximate recapitulation of the stages through which religion originally evolved. (shrink)

This paper draws out from Kierkegaard’s work a distinctive critical perspective on an influential contemporary approach in moral philosophy: namely, Christine Korsgaard’s transcendental argument for the value of humanity. From Kierkegaard’s perspective, we argue, Korsgaard argument goes too far, in attributing absolute value to humanity – but also that she is required to make this claim if her transcendental argument is to work. From a Kierkegaardian perspective, to place this sort of value in humanity is problematic since it threatens to (...) make the relation between individuals too claustrophobic. Finally, we explore the possibility of a rival approach, in which we should view others as ethically significant because they too are related to the kind of ‘third’ which Kierkegaard argues is needed to bring stability to the structure of the self. In this way, we claim, a different and more successful transcendental argument to the value of humanity can be found in the work of Kierkegaard. (shrink)

Despite the growing body of literature on training in the responsible conduct of research, few studies have examined the effectiveness of delivery formats used in ethics courses. The present effort sought to address this gap in the literature through a meta-analytic review of 66 empirical studies, representing 106 ethics courses and 10,069 participants. The frequency and effectiveness of 67 instructional and process-based content areas were also assessed for each delivery format. Process-based contents were best delivered face-to-face, whereas contents delivered online (...) were most effective when restricted to compliance-based instructional contents. Overall, hybrid courses were found to be most effective, suggesting that ethics courses are best delivered using a blend of formats and content areas. Implications and recommendations for future development of ethics education courses in the sciences are discussed. (shrink)

The approach to mental health and well‐being taken here illustrates the complementary perspectives approach and assumes that there are useful and intersecting contributions from science (including medicine) and from religion and spirituality. What counts as poor mental well‐being depends on the interaction of relatively objective criteria with culturally contingent value judgments. I then discuss theological perspectives on depression, including a consideration of sources of hope and tolerance of dysphoria, and argue that depression can be part of a spiritual journey. I (...) then look at the relationship between psychosis and religion, including the work of Isabel Clarke, arguing that a spiritual approach to psychosis can complement a medical approach. Finally, I present a pastoral case study illustrating the interface between neurological and spiritual aspects of the sense of presence. From the middle of the twentieth‐century onwards, there has been a growing emphasis on the importance of relationality in what it means to be human, which we call a “relational turn.” This is found in various domains, including philosophical psychology, psychoanalysis, and theological anthropology. Many have seen a close connection between relationality and personhood. In the second half of the article, we consider the implications of this trend for artificial intelligence (AI) and robotics. So far, AI has largely neglected relational (...) intelligence, though that could perhaps be about to change. Cybernetics was rendered more open to assumptions about the contextuality of intelligence by its rather different assumptions from AI. Social robotics increasingly requires relational intelligence, and promising steps might be found in computational modeling of human relationships. Questions about whether robots can achieve personhood are difficult to resolve, though the possibility should not be ruled out. (shrink)

Søren Aabye Kierkegaard (b. 1813–d. 1855) left behind an extraordinary body of work that has had a major impact on European philosophy, and that continues to inform major debates within analytic philosophy as well. Utterly distinctive and often dazzling, Kierkegaard’s writings typically confront the reader with an enigmatic interplay between seriousness and jest and they bristle with original ideas. The range and sheer volume of these writings is difficult to take in: the output published in Kierkegaard’s lifetime alone extends to (...) over seventy books and articles and he left besides a voluminous collection of drafts, notes, and journals. Often billed as the “father of existentialism,” Kierkegaard’s influence is in evidence not least in the work of Heidegger, Adorno, Sartre, and Merleau-Ponty (but Heidegger, for one, was notoriously slow to acknowledge the debt). His work was also studied seriously by Wittgenstein, who learnt Danish for the task and went so far as to rank Kierkegaard first among 19th-century thinkers. The most obvious arena of his on-going influence is the philosophy of religion, where his work continues to inform debates around such central topics as the problem of evil, the role of evidence in religious belief and the phenomenology of religious experience. But in other areas of philosophy, too, Kierkegaard’s work has been fruitfully brought to bear; on topics such as the nature of selfhood and subjectivity, love and friendship, death and mourning, the role of literature in moral philosophy and the limits of language and thought. While his writings notably tend to cut across academic subject-divisions (and have certainly made their mark on other disciplines, too), this bibliographical entry aims to provide a guide to Kierkegaard’s reception by philosophers. I offer an approach to Dreyer's film Ordet as a contribution to the phenomenology of a certain kind of religious experience. The experience in question is one of a moment that disrupts the chronological flow of time and that, in the lived experience of it, is charged with eternal significance. [opening paragraph]: The first issue of the Journal of Consciousness Studies carried an interview with Francis Crick about his recent book, The Astonishing Hypothesis: The Scientific Search for the Soul. Both the book and the interview are a mixture of science and philosophy. Crick is interested in how visual processing in the brain leads to the experience of consciously `seeing' something. It is a good scientific question, and I agree with him that it is a timely one. The first two (...) parts of the book set the scene. Part one summarizes the psychology of perception, and part two presents comparable background about the physical brain. Crick does all this rather well, but there is nothing novel or remarkable in it. Then in part three comes the central question of what neuronal processes lead to conscious awareness. Here Crick is raising questions at the frontiers of current scientific understanding, and he takes us through what pointers he can find in recent scientific work. As he admits, he comes to no clear conclusions, though he makes a useful contribution to current scientific discussion. However, it is Crick's philosophy rather than his science that has attracted most attention, as I suspect he intended. Unfortunately, the philosophy is less competent than the science, and beset with imprecise and overly broad-brush positions. (shrink)

This paper examines the central theoretical concepts in the work of Rupert Sheldrake. The first section examines Sheldrake's account of morphic fields and questions whether difficulties arise when these concepts are extended upwards from the biological level. The second section reviews Sheldrake's concept of extended mind and considers the criticism that it is reductionist about mentality. In considering both of these criticisms it is argued that Sheldrake's theories can be taken in a reductive direction, but need not be. The third (...) and final section draws on the work of Joseph Bracken and David Ray Griffin to suggest a panpsychist metaphysics of field as one possible way that Sheldrake could sidestep these dangers and strengthen his approach. Packaging Post/Coloniality reads the marketing matter surrounding works of Francophone literature as an important though overlooked source in the cultural history of colonialism and the articulation of new identities in France and the Francophone world.

Adaptive preferences are both a central justification and continuing problem for the use of the capability approach. They are illustrated here with reference to a project examining the choices of young people who had rejected higher education. Jon Elster, Amartya Sen and Martha Nussbaum have all criticised utilitarianism on the grounds that a focus on preference-satisfaction fails to acknowledge the human tendency to adapt preferences under unfavourable circumstances and that self-assessments of well-being are therefore likely to be distorted by deprivation. (...) Elster’s addresses preference deformation through the sour grapes phenomenon and retroactive rationalisation. Sen and Nussbaum are more concerned with adaptation as self-abnegation. The capability approach developed by Sen and Nussbaum seeks to address the problem of adaptive preferences by taking into account not only what individuals value but what they have reason to value. However, clear distinctions need to be made between adaptations to the means of achieving well-being and adaptations to its ends. If Elster’s formulations are to be used in capability assessments, they need to articulate with the relative weightings given to relevant functionings and freedoms. This enables a more nuanced understanding of adaptive preferences that can account for the subtleties of the constraints they place upon individual freedoms. (shrink)
