Web legal information retrieval systems need the capability to reason with the knowledge modeled by legal ontologies. Using this knowledge it is possible to represent and to make inferences about the semantic content of legal documents. In this paper a methodology for applying NLP techniques to automatically create a legal ontology is proposed. The ontology is defined in the OWL semantic web language and it is used in a logic programming framework, EVOLP+ISCO, to allow users to query the semantic content (...) of the documents. ISCO allows an easy and efficient integration of declarative, object-oriented and constraint-based programming techniques with the capability to create connections with external databases. EVOLP is a dynamic logic programming framework allowing the definition of rules for actions and events. An application of the proposed methodology to the legal web information retrieval system of the Portuguese Attorney General’s Office is described. (shrink)

INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...) written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. But in Portuguese the words god (“deus”) and dog (“cão”) are not so closely linked. In fact, there is no direct mention of “deus” in Rosa’s text: Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Both are fascinating. In Rosa’s excerpt, the rhythm is unmistakable and precise, despite, of course, the indices of hesitation: the commas, the Eh, the uncomfortable way of searching through prolongation and wait. This is the sort of paradox Rosa can engage within a sentence. W.Martinez’s does this as well, at a scale that reverberates beyond the sentence, and with one noticeable addition: deus. What may appear to be an overstep, to add such a weighted word that draws out wordplay but is, nevertheless, not in the source text, is exemplary of risk. The translation buzzes because of it. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. This isn’t so different from what Rosa says himself: The Sir look…see: the most important and beautiful, of the world, is this: that the people are not always same, still were not completed — but that they go always shifting. This study examines how audiovisual brand stories both invite and enable consumers to enact heroic archetypes. Integrating research on the archetypal structure of narratives with research on the event structure of narratives, we distinguish singular plot stories (i.e. stories that show a Hero’s Journey) from embedded plot stories (i.e. stories that not only show but also tell one or more Hero’s Journeys) and develop a conceptual and narratological framework to analyze their structural elements. Application of the framework to 20 brand (...) stories representing 8 different brands reveals meaningful variation in elements between the singular plot stories and embedded plot stories. Differences in the expression of archetypes and event structure are argued to evoke different types of Hero enactment which in turn result in different outcomes. We specifically hypothesize that the enactment of heroic archetypes in singular plot stories primarily results in catharsis (pleasure), whereas the enactment of heroic archetypes in embedded plot stories primarily results in an outcome we describe as phronesis: a form of moral sense making of the self that advances one’s practical wisdom and prudence. The final section of the paper discusses how cathartic and phronetic outcomes of hero enactment may foster the psychological bonding between brand and consumer, and invite consumers to align their moral values with the values that are reflected by heroic character traits. The central aims of the analysis presented are to provide an exploration of narrative phenomena in a reasonably broad range of brand story videos and foremost to provide a conceptual framework with an applicable instrument suited to analyze relevant categories in these brand stories. The present study is interdisciplinary in its approach to a contemporary, developing marketing phenomenon, applying psychological modeling of archetypes and heroic values with narratological insights on perspective-taking and story structure. Its contribution is to systemize, from a narratological viewpoint, how various narrative archetypes in brand video stories may contribute to the development of brand-consumer relations. (shrink)

This study examines the linguistic construal and cognitive representation of time and viewpoint in the genre of news narratives. We present a model of mental spaces that involves a News Space in which the deictic center is construed of the news actors at the time the newsworthy events took place, and a Reality Space in which the deictic here-and-now center of journalist and reader is construed. This model explains how the dynamic representation of narrative news discourse, characterized by shifts in (...) time and viewpoint, is steered by linguistic devices. An analysis of Dutch news narratives shows that temporal adverbs such as yesterdayand shifts from present tense to past tense may signal a moveforwardin narrative time, to a viewpoint in the future relative to the narrative now-point, rather thanbackward. These atypical time shifts can be accounted for by presupposing an Intermediate Space located at a point in time between the News Space and the Reality Space where the progression of narrative time comes to a halt and experiences are rather relived than reported. The salience of the Intermediate Space may be signaled by quotative conditionals reflecting the viewpoints of implicitly quoted sources. These results clarify how tense and temporal deixis steer the linguistic construal of time and viewpoint in news narratives, demonstrating that time and viewpoint are closely linked in the cognitive representation of these narratives. This article studies the differences between traditional financial intermediaries (commercial banks, savings banks and cooperative banks) and ethical banks based on property rights, in which the owner decides the ideology, principles, standards and objectives of the organisation. In ethical banking, affinity centres on positive social and ethical values. The article consequendy focuses on an index proposed both to differentiate ethical banks from other types of banks, and also to pinpoint the differences between the various ethical banks themselves.This is the Radical (...) Affinity Index (RAI), which groups banks together in terms of their stance on ethical commitment, concentrating on ethical ideology and principles (information transparency, placement of assets, guarantees and participation) and using a sample of 114 European banks. The evidence shows that transparency of information and placement of assets are factors that differentiate ethical banks from other financial intermediaries.Guarantees and participation are characteristics specific to ethical banks; these variables, however, do not offer clear evidence to our analysis. Corporate social performance (CSP) has become a widely applied concept, discussed in most large firms’ corporate reports and the academic literature alike. Unfortunately, CSP has largely been employed as a way of demonstrating corporate social responsibility (CSR) in practice, or to justify the business case for CSR in academia by relating some measure of CSP to some measure of financial performance. In this article, we discuss multiple shortcomings to these approaches. We argue that (1) CSR activities need to be managed (...) and measured as projects and aggregated to the business or corporate level using a project portfolio; (2) appropriate measures need to be identified that move away from reporting the firm’s activities toward quantifying actual social outcomes achieved; and (3) given the types of projects prevalent in CSR, statistical evaluation methods common in other fields (ideally, pre-test post-test control group designs, such as used in medicine or propensity score matching for ongoing or past projects) should be employed to properly measure outcomes. We make a first, albeit imperfect, attempt at using such an approach with data collected on behalf of the Patrimonio Hoy project, a well-publicized CSR initiative carried out by Cemex in Mexico. We show that the results from this data reinforce concerns voiced earlier in this article. (shrink)

The publication of scientific papers has become increasingly problematic in the last decades. Even if we agree that a renewed model is needed for peer-reviewed scientific publication, we think the problem does not essentially lie in professional publishing—with economic incentives—but in the publish-or-perish culture that dominates the lives of researchers and academics.

RESUMO A percepção, o modo pelo qual sentimos o mundo, é comumente distinta da cognição, o modo pelo qual o pensamos. Entretanto, a percepção parece exercer um papel importante na justificação de crenças empíricas, ainda que haja divergência a respeito de como isso ocorre. A hipótese da penetrabilidade cognitiva da percepção problematiza ambas essas afirmações. Segundo essa teoria, estados cognitivos anteriores podem afetar a etiologia do conteúdo sensório da experiência, gerando, como efeito, uma espécie de insensibilidade aos estímulos externos. Como (...) resultado, lançam-se suspeitas quanto à isenção do “tribunal” da experiência. Este artigo tem o propósito de discutir casos de má penetrabilidade cognitiva como consequências de vícios intelectuais. Vícios intelectuais são traços de caráter, como dogmatismo e preconceito, que impedem o exercício apto e responsável da inquirição e outras práticas epistêmicas. Essa abordagem tem a dupla vantagem de, por um lado, elucidar esse “comércio ilegal” entre percepção e cognição, e por outro, responder ao problema da circularidade epistêmica, causado pela penetrabilidade cognitiva da percepção. ABSTRACT Perception, the way we experience the world, is often distinguished from cognition, the way we think about the world. However, even though there is no agreement about how it happens, perception seems to have an important role in the justification of empirical beliefs. The hypothesis of cognitive penetration ofperception contradicts such claims. According to such hypothesis, early cognitive states can affect the etiology of the contents of sensory experience, yielding a kind of insensibility to external stimuli. This casts doubts on impartiality of the “tribunal” of sense experience. The aim of this article is to discuss cases of bad cognitive penetrability which result from intellectual vices. Intellectual vices are character traits, such as dogmatism and prejudice, which prevent the apt and responsible exercise of inquiry and others epistemicpractices. This approach has two advantages: first, it elucidates “illegal trades” between perception and cognition, and second, it answers the problem of epistemic circularity, posed by the cognitive penetrability of perception. He opposes the claim that, in order to account for some key features of the practice of modeling in science, such as the existence of unsuccessful representations and also of successful yet inaccurate or idealized ones, it is necessary to accept fictional entities. Scholars have long debated whether leader's integrity affects managerial decision making with respect to social responsibility. In this paper, we propose a model in which transformational leadership mediates integrity and corporate social responsibility and examine the relationship between these concepts. A survey of 170 senior managers from 50 organizations was conducted. Results indicate that integrity is a predictor of transformational leadership behavior and that transformational leaders’ behaviors are linked to CSR practices. It was also found that leaders rated with higher (...) integrity are engaged in CSR because they exhibit more transformational leadership behaviors. These findings add to the extant literature by demonstrating that integrity is important as transformational leaders engage more actively on ‘responsible’ behaviors. Practical implications call for an understanding among corporate leaders of the benefits of integrity and how it relates to transformational leadership. Organizations can improve their selection and leadership development processes by focusing on these two dimensions. (shrink)

The apparently obviously true doctrine of opacity has been thought to be inconsistent with two others, to which many philosophers of language are also attracted: the referentialist account of the semantics of proper names and indexicals, on the one hand, and the principle of semantic innocence, on the other. I discuss here one of the most popular strategies for resolving the apparent inconsistency, namely Mark Richard’s theory of belief ascriptions, and raise three problems for it. Finally, I propose an alternative (...) theory of the semantics of belief-ascribing sentences that clearly avoids the three problems that trouble Richard’s theory, and advocate it as the best available strategy for resolving the apparent inconsistency between the doctrine of opacity, referentialism, and the principle of semantic innocence. This article analyses the nature of mental imagery in metaphoric thought as envisaged by the contemporary theory of metaphor in Cognitive Linguistics (Lakoff, Cambridge University Press, 1993). Our study of metaphor in the field of marine biology draws on two crucial aspects of mental imagery, namely dynamicity and pervasiveness. Image metaphors and behaviour-based metaphors have generally been regarded as two different types of resemblance metaphor. In our view, the dynamicity of certain mental images highlights inherent similarities between these two types (...) of metaphor, and makes the differences between them more apparent than real. For this reason, we propose a more refined description of resemblance metaphors in terms of the static or dynamic nature of the mental images underlying them. Our study also underlines the fact that mental images permeate all classes of metaphor, and that the pervasiveness and dynamicity of mental images affords insights into both resemblance metaphors and non-resemblance metaphors. Many studies of structure in present-day Western news texts have shown that the dominant structure is the inverted pyramid, even if the use of a chronological narrative structure is acknowledged. However, the relevant literature has exclusively investigated Western news texts. In this study, we challenge the dominance of the inverted news structure by including a non-Western and less-investigated culture and ask whether textual structure of news texts can differ between cultural contexts. In total, 100 crime news texts from national Iranian (...) and Dutch newspapers were analyzed for both the overall text and the journalists’ statements. Those texts that showed a hybrid structure were subsequently studied qualitatively to understand how chronology is applied in them. News texts from the two cultures were significantly different in their structure. Qualitative analysis of the journalistic statements uncovered a quotation-based structure, a way of news writing in Iranian journalistic statements in which the journalist mainly narrates reporting eventualities that are new to Western eyes. The study offers implications for further ethnography of news and communication, suggesting that the role, pattern and effects of communication can be culture-specific. (shrink)

This paper aims to deepen our understanding of so-called covert dogwhistles. I discuss whether a covert dogwhistle is a specific sort of mechanism of manipulation or whether, on the contrary, it draws on other already familiar linguistic mechanisms such as implicatures or presuppositions. I put forward a series of arguments aimed at illustrating that implicatures and presuppositions, on the one hand, and covert dogwhistles, on the other, differ in their linguistic behaviour concerning plausible deniability, cancellability, calculability and mutual acceptance. A violência é um dos conceitos mais importante do pensamento político de Arendt. No entanto, ela observa a falta de um estudo sistemática, bem como a banalização desse conceito, escondendo assim o seu caráter instrumental. O objetivo deste artigo é apresentar a compreensão de Arendt desse conceito no campo da política, como aparece em sua obra sobre a violência.

A partir da obra Origens do totalitarismo de Arendt, este estudo apresenta a ideia totalitária do “tudo é possível” e a sua colocação em prática no século XX, em nome de um projeto político de dominação total que considerou o homem como um ser supérfluo com o qual se poderia fazer qualquer coisa, inclusive transformá-lo em um indivíduo capaz de obedecer cegamente os princípios ideológicos do governo totalitário encarnados na pessoa do “chefe”. Mas, por outro lado também, este estudo apresenta (...) o posicionamento de Arendt que inverte a ideia totalitária do “tudo é possível” para pensar uma nova política que seja o inverso radical do totalitarismo, uma política na qual todos possam manifestar a sua liberdade através de ação e do discurso na presença de seus pares; para isso, a nossa autora aposta na capacidade humana de “começar algo novo” com seus próprios recursos. Wenn wir die Rolle unserer wissenschaftlichen Veröffentlichungen im Leben einer Kulturgesellschaft relativieren, dann (...) entdecken wir, daß die Angaben, die Klaus Christian Köhnke in seiner Arbeit »Philosophische Begriffe in wissenschaftsinterner und -externer Kommunikation. Am Beispiel der Fichte-Festreden des Jahres 1862« vorstellt, viel entscheidender sind. Dort lesen wir nämlich, daß obwohl 1862 keine Monographie über Fichte verfaßt wurde, doch etwas viel Wichtigeres geschah: jenes Jahr stellte einen Wandel in den Beziehungen zwischen Philosophie, Universität und Gesellschaft dar. Jeffrey King has famously argued that there are several prima facie problems with the direct reference theory of the semantics of complex demonstratives, three of which apparently resist solution. King concludes by observing that, if these outstanding problems cannot be solved, then the prospects for a direct reference semantics for complex demonstratives will be poor. I shall focus on just one of these outstanding problems—the objection from belief attributions—and suggest that it, at least, can be answered.

The present essay, of theoretical bibliographical nature, debates some fundamentals of the methodology employed in the analysis of Brazilian urban songs. The approach to the scarce debate involving an investigative method for folk songs relies on the chapter 14 of George Lukács’ Aesthetics. In particular, considering the aims of this essay, the item dedicated to music. Authors who investigate the particular scope of Brazilian urban folk song were consulted to approximate the specific elements of that music. The findings suggest that (...) the study of songs should refrain from dismissing the general categories of the aesthetics, however, their features demand certain cares, which also require a particular methodology to be applied to the contradictions inherent to Brazilian urban folk songs. El presente artículo discute algunos aspectos del nuevo paradigma del derecho de resistencia en diversas constituciones contemporáneas de Europa y América Latina. En primer lugar, abordamos el concepto y la regulación constitucional del derecho de resistencia en diferentes países. En segundo lugar, examinamos su carácter jurídico, esto es, si se trata de un derecho moral o un derecho propiamente jurídico. Para determinados autores, resulta plausible considerar el derecho a la resistencia como un derecho estrictamente jurídico, pero pensamos que ese argumento (...) es erróneo. Desde una perspectiva más amplia, nos pregun- tamos sobre el deber de resistir contra el Estado de derecho, incluso en el caso de que los poderes aparezcan como formalmente respetuosos de las reglas creadas por las institucio- nes democráticas. Se trata esencialmente de un problema acerca de la concepción de los derechos en las democracias consolidadas y no consolidadas. En este sentido, proponemos una perspectiva compatible con el Estado de derecho que distinga entre desobediencia civil y derecho de resistencia, evitando postular teorías sobre los derechos desde la f ilosofía política. En este contexto, nuestra tesis es más desobediencia civil y menos derecho de resistencia. Por último, la parte cuarta indica algunas conclusiones. (shrink)

Peirce’s triadic logic has been under discussion since its discovery in the 1960s by Fisch and Turquette. The experiments with matrices of three-valued logic are recorded in a few pages of unpublished manuscripts dated 1909, a decade before similar systems have been developed by logicians. The purposes of Peirce’s work on such logic, as well as semantical aspects of his system, are disputable. In the most extensive work about it, Turquette suggested that the matrices are related in dual pairs of (...) axiomatic Hilbert-style systems. In this paper, we present a simple tableau proof for a fragment of Peirce three-valued logic, called P3, based on similar approaches in many-valued literature. We demonstrated that this proof is sound and complete. Besides that, taking the false as the only undesignated value and adding non-classical negations to the calculus, we can explore paraconsistent and paracompleteness theories into P3. In 1909, Peirce recorded in a few pages of his logic notebook some experiments with matrices for three-valued propositional logic. These notes are today recognized as one of the first attempts to create non-classical formal systems. However, besides the articles published by Turquette in the 1970s and 1980s, very little progress has been made toward a comprehensive understanding of the formal aspects of Peirce's triadic logic (as he called it). This paper aims to propose a new approach to Peirce's matrices (...) for three-valued propositional logic. We suggested that his logical matrices give rise to three different systems, one of them - which we called P3 - is an original and non-explosive logic. Besides that, we will show that the P3 system can easily be transformed into paraconsistent and paracomplete calculi, adding to it, respectively, unary operators of consistency and intuitionistic negation. We conclude with a discussion about philosophical motivations. (shrink)
