The European Parliament rejected in 1995 the European Commission proposal to harmonize legal protection of biotechnological inventions. Although it did not seem initially the most contentious of the many issues involved in the current legal and ethical debate around biomedicine and genetics, patenting is now focusing bioethics in Europe.

Although issues of morals and ethics remain largely a national matter, the European Community (EC) and the Council of Europe have taken an increasing interest in identifying and harmonizing the often conflicting policies of the European countries on bioethical matters. This article examines the role these organizations are playing and identifies some of the initiatives that have been taken in specific areas.

Rationale, aims and objectives Given the increasing prevalence of cataract and demand for cataract extraction surgery, patients must often wait to undergo this procedure. We validated a previously developed priority scoring system in terms of clinical variables, pre-intervention health status, appropriateness of surgery and gain in visual acuity (VA) and health-related quality of life (HRQoL).Methods Explicit prioritization criteria for cataract extraction created by a variation of the Research and Development (RAND) and University of California Los Angeles appropriateness methodology were retrospectively (...) applied to a prospective cohort of 5257 patients on waiting lists to undergo cataract by phacoemulsification at 17 hospitals in Spain. Demographic data, clinical data and data related to surgical technique were collected by trained ophthalmologists. Patients were evaluated by their ophthalmologist before the intervention and 6 weeks afterward. They also completed, by mail, the Visual Function Index (VF-14) before the intervention and 3 months afterward.Results High-priority patients experienced greater improvement in VA and HRQoL than those classified as intermediate or low-priority (P < 0.0001), even after adjusting by VA and the VF-14 score at baseline. The time to intervention was the same for high-priority patients as it was for intermediate and low-priority patients.Conclusions The priority score we developed identified patients most likely to experience the greatest improvements from cataract extraction. Use of this tool could provide a fairer and more rational way to prioritize patients for cataract extraction. (shrink)

Reliabilist accounts of knowledge are widely seen as having the resources for blocking sceptical arguments, since these arguments appear to rely on assumptions about the nature of knowledge that are rendered illegitimate by reliabilist accounts. The goal of this book is to assess the main arguments against the possibility of knowledge, and its conclusions challenge this consensus. The book articulates and defends a theory of knowledge that belongs firmly in the truth-tracking tradition, and argues that although the theory has the (...) resources for blocking the main standard lines of sceptical reasoning, there is a sceptical argument against which the theory offers no defence, as it doesn’t rely on any assumptions that the theory would render illegitimate. The book ends with the suggestion that the problem might have a metaphysical solution—that although the sceptical argument may make no illegitimate epistemological assumptions, it does rest on a questionable account of the nature of cognition. In Wittgenstein on Rules and Private Language, Saul Kripke rejects some of the most popular accounts of what meaning facts consist in on the grounds that they fail to accommodate the normative character of meaning. I argue that a widespread interpretation of Kripke's argument is incorrect. I contend that the argument does not rest on the contrast between descriptive and normative facts, but on the thought that speakers' uses of linguistic expressions have to be justified. I suggest that the line (...) of reasoning that I attribute to Kripke can be seen as putting pressure on the idea that predicate satisfaction is to be explained in terms of a relation between predicates and properties. Education is essential to life, and the epidemic affected everything. Parents want to get their kids the most important teaching. However, since COVID-19 has affected schools and other institutions, providing education has become the most significant issue. Online learning pedagogy uses technology to provide high-quality learning environments for student-centered learning. Further, this study explores the experiences and challenges faced by Filipino tertiary students regarding the lack of gadgets amidst online learning. Employing the Interpretative Phenomenological Analysis, the findings of this study (...) were: Some college students still have difficulty with online learning. Attending online classes is difficult, especially for students with limited resources. Smartphones, other gadgets, and internet connections play a significant role in online classrooms because they are the ones that students utilize while learning online, which is essential for successful participation in online higher education as well as for solving a variety of other difficulties in the new normal. Further, College students face similar health challenges. Having an online learning setup is not just about students' struggles with learning resources but also about their health issues. When our respondents used their smartphones for an extended period, they reported eye aches and blurred vision. They also said that some of their body parts, such as their legs and back, are aching, and feel pressured because they tend to overthink things in their surroundings, which causes them incredible difficulty in performing their best in attending online classes. Even though college students continue to suffer from a lack of learning resources during online sessions, they do their best to manage their needs and the scarcity of learning resources. Students have unique coping methods for dealing with difficulties in online classes. (shrink)

The paper argues against Sosa’s claim that sensitivity cannot be differentially supported over safety as the right requirement for knowledge. Its main contention is that, although all sensitive beliefs that should be counted as knowledge are also safe, some insensitive true beliefs that shouldn’t be counted as knowledge are nevertheless safe.

Evolutionary game theory and public goods games offer an important framework to understand cooperation during pandemics. From this perspective, the COVID-19 situation can be conceptualized as a dilemma where people who neglect safety precautions act as free riders, because they get to enjoy the benefits of decreased health risk from others’ compliance with policies despite not contributing to or even undermining public safety themselves. At the same time, humans appear to carry a suite of evolved psychological mechanisms aimed at curbing (...) free riding in order to ensure the continued provision of public goods, which can be leveraged to develop more effective measures to promote compliance with regulations. We also highlight factors beyond free riding that reduce compliance rates, such as the emergence of conspiratorial thinking, which seriously undermine the effectiveness of measures to suppress free riding. Together, the current paper outlines the social dynamics that occur in public goods dilemmas involving the spread of infectious disease, highlights the utility and limits of evolutionary game-theoretic approaches for COVID-19 management, and suggests novel directions based on emerging challenges to cooperation. What information do corporations disclose on their websites? This paper investigates the environmental management policies and practices of the 200 largest corporations in the world. I take issue with Robert Brandom’s claim that on an analysis of knowledge based on objective probabilities it is not possible to provide a stable answer to the question whether a belief has the status of knowledge. I argue that the version of the problem of generality developed by Brandom doesn’t undermine a truth-tracking account of noninferential knowledge that construes truth-tacking in terms of conditional probabilities. I then consider Sherrilyn Roush’s claim that an account of knowledge based on probabilistic tracking (...) faces a version of the problem of generality. I argue that the problems she raises are specific to her account, and do not affect the version of the view that I have advanced. I then consider Brandom’s argument that the cases that motivate reliabilist epistemologies are in principle exceptional. I argue that he has failed to make a cogent case for this claim. I close with the suggestion that the representationalist approach to knowledge that I endorse and Brandom rejects is in principle compatible with the kind of pragmatist approach to belief and truth that both Brandom and I endorse. The Glivenko property is used to obtain a sequent calculus admitting cut-elimination for the variety of integrally closed residuated lattices and to establish the decidability, indeed PSPACE-completenes, of its equational theory. I provide a construal of the epistemic regress problem and I take issue with the contention that a foundationalist solution is incompatible with an internalist account of warrant. I sketch a foundationalist solution to the regress problem that respects a plausible version of internalism. I end with the suggestion that the strategy that I have presented is not available only to the traditional versions of foundationalism that ascribe foundational status to experiential beliefs. It can also be used to generate a (...) version of internalist foundationalism based on reliabilist principles. (shrink)

In this paper I assess the two central ingredients of Laurence BonJour’s position on empirical knowledge that have survived the transition from his earlier coherentist views to his current endorsement of the doctrine of the given: his construal of the problem of the epistemic regress and his rejection of an internalist solution to the problem. The bulk of the paper is devoted to a critical assessment of BonJour’s arguments against externalism. I argue that they fail to put real pressure on (...) externalism, as they rely on a highly questionable conception of epistemic rationality and responsibility. Then, more briefly, I take issue with BonJour’s endorsement of the irrelevance thesis—the claim that even if externalism were true it would not offer a satisfactory solution to the epistemic regress problem. I contend that he is not entitled to subscribe this thesis unless he is prepared to abandon his construal of the problem. (shrink)

O objetivo do artigo é explorar as conexões entre o problema da morte, o conceito de ideia e a tese da indestrutibilidade do nosso ser com a morte, em Schopenhauer. Como ponto de partida, é apresentada a crítica de Schopenhauer à compreensão empírica da morte como passagem ao não-ser. Passa-se, então às considerações do filósofo sobre a indestrutibilidade do nosso ser com a morte, por meio do destaque às suas considerações sobre o caráter de coisa, vinculado à sua intepretação das (...) ideias como formas eternas. Após discorrer pontualmente a respeito do sentido desta noção na filosofia platônica, são apresentados os principais elementos que configuram a apropriação schopenhaueriana da teoria platônica das ideias tendo em vista exclusivamente o problema elegido, qual seja, a morte e a indestrutibilidade do nosso ser. I use some ideas of Keith DeRose's to develop an (invariantist!) account of why sceptical reasoning doesn't show that I don't know that I'm not a brain in a vat. I argue that knowledge is subject to the risk-of-error constraint: a true belief won’t have the status of knowledge if there is a substantial risk of the belief being in error that hasn’t been brought under control. When a substantial risk of error is present (i.e. beliefs in propositions that are (...) false in nearby worlds), satisfying the constraint requires bringing the risk under control. This is achieved either by sensitivity, i.e. you wouldn’t have the belief if it were false, or by identifying evidence for the proposition. However, when the risk of error is not substantial (i.e. beliefs in propositions that are not false in nearby worlds), the constraint is satisfied by default. My belief that I am not a brain in a vat is insensitive and I have no evidence for it, but since it is not false in nearby worlds, it satisfies the constraint by default. (shrink)

According to actualism, modal reality is constructed out of valuations (combinations of truth values for all propositions). According to possibilism, modal reality consists in a set of possible worlds, conceived as independent objects that assign truth values to propositions. According to possibilism, accounts of modal reality can intelligibly disagree with each other even if they agree on which valuations are contained in modal reality. According to actualism, these disagreements (possibilist disagreements) are completely unintelligible. An essentially actualist semantics for modal propositional (...) logic specifies which sets of valuations are compatible with the meanings of the truth-functional connectives and modal operators without drawing on formal resources that would enable us to represent possibilist disagreements. The paper discusses the availability of an essentially actualist semantics for modal propositional logic. I argue that the standard Kripkean semantics is not essentially actualist and that other extant approaches also fail to provide a satisfactory essentially actualist semantics. Many interpreters of the Tractatus accept that the book endorses an argument for simples based on the reflection that, since complexes exist only contingently, if names referred to complexes the propositions in which they figure would lack sense if their referents went out of existence. More specifically, most interpreters read 2.0211-2.0212 as putting forward this argument. My main goal in this paper is to attack this reading and to put forward an alternative. I argue that there is no good reason (...) for thinking that the Tractatus advances this argument. I argue that 2.0211-2, in particular, should not be read in this way, and put forward an alternative reading of the passage. (shrink)

Analiza después la definición del arte que ofrece Danto, interpretando que es una definición poco específica, a falta de una mayor caracterización del símbolo artístico. David Lewis has argued that we cannot identify the fundamental properties. It is generally accepted that we can resist Lewis's conclusion if we are prepared to accept a structuralist account of fundamental properties, according to which their causal/nomological role is essential to their identity. I argue, to the contrary, that a structuralist construal of fundamental properties does not sustain a successful independent strategy for resisting Lewis's conclusion. The structuralist can vindicate our ability to identify fundamental properties only if she accepts (...) epistemic principles that suffice for blocking Lewis's conclusion even if fundamental properties are not construed along structuralist lines. The study examined the level of moral reasoning of first-year university students in Papua New Guinea; 583 students participated by answering one of the exercises or dilemmas formulated by Kohlberg. The analysis of data primarily focused on what the general level of moral reasoning of the students might be and whether there were differences in their levels of moral reasoning on the basis of gender, culture and religious affiliation. The study showed that around 50 per cent of both male and (...) female students came within the first level, but in the second stage of moral reasoning. Around 25 per cent of both genders came under the stage 4, that is, the law and order stage. A t-test comparison revealed no significant difference between the genders in their moral reasoning. The ‘faculty’ that the students belonged to is the only variable that indicated a statistically significant effect F = 2.159, p = 0.030, est η2 = 0.014923 on the level of moral reasoning. All other variables such as age, religion and the province that the students came from did not show a significant effect. Two new dimensions, ‘reference to God’ and the ‘need for negotiation’, in moral reasoning emerged from the study. (shrink)

This paper examines Gandhian philosophy and practice to reinterpret UNESCO's educational vision towards establishing stable and sustainable knowledge societies. The uniqueness of the Gandhian perspective is its ability to withstand the dominant political, philosophical and religious challenges with its contextually rooted, spiritually oriented, socially responsible and human person centred reinterpretations. UNESCO’s educational vision-Learning: The Treasure Within published in 1996 is a catalyst in establishing stable and sustainable knowledge societies. Consistent changes and challenges in knowledge societies necessitates the reinterpretation of this (...) educational vision. The four pillars of learning in this educational vision are analysed together with four aspects of Gandhian philosophy and practice: ‘learning to know’ and Nai Talim, ‘learning to do’ and ashrams, ‘learning to live together’ and constructive programme and ‘learning to be’ and swaraj. The paper discusses this confluence of the UNESCO’s theoretical approach of four pillars of education with Gandhian pragmatic philosophy and practice to offer a contextually rooted and future-oriented outlook for reinterpreting the educational vision for establishing stable and sustainable knowledge societies. Life is perpetuated through a single-cell bottleneck between generations in many organisms. Here, I highlight that this cell holds information in two distinct stores: in the linear DNA sequence that is replicated during cell divisions, and in the three-dimensional arrangement of molecules that can change during development but is recreated at the start of each generation. These two interdependent stores of information – one replicating with each cell division and the other cycling with a period of one generation – coevolve (...) while perpetuating an organism. Unlike the genome sequence, the arrangement of molecules, including DNA, RNAs, proteins, sugars, lipids, etc., is not well understood. Because this arrangement and the genome sequence are transmitted together from one generation to the next, analysis of both is necessary to understand evolution and origins of inherited diseases. Recent developments suggest that tools are in place to examine how all the information to build an organism is encoded within a single cell, and how this cell code is reproduced in every generation. Life relies on the information for making organisms that is encoded in single cells and transmitted between generations. These cell codes include interdependent stores of information that replicate and that cycle. Understanding evolution and the origins of inherited diseases requires analysis of cell codes. (shrink)

In this paper, we contend that the “Smith case” in Gettier’s attempt to refute the justified true belief (JTB) account of knowledge does not work. This is because the said case fails to satisfy the truth condition, and thus is not a case of JTB at all. We demonstrate this claim using the framework of Donnellan’s distinction between the referential and attributive uses of definite descriptions. Accordingly, the truth value of Smith’s proposition “The man who will get the job has (...) ten coins in his pocket” partly depends on how Smith uses the definite description “the man who will get the job” when he utters the proposition. Since, upon uttering the proposition, Smith has in mind a particular individual, namely Jones, and not just whoever will fit the attribute specified in the definite description, Smith uses the definite description referentially. And so when it turns out that it is Smith who eventually gets the job, the definite description fails to refer to Jones as intended by Smith, thereby making Smith’s proposition false. To think that Smith’s proposition is still true, in this regard, is to use the definite description attributively—that it is about whoever will fit the definite description. Apparently, when Gettier claims that Smith’s proposition is still true, to demonstrate that it is a case of JTB, he, in effect, imposes his attributive understanding of Smith’s usage of the definite description on Smith’s own epistemic situation. Th. W. Adorno y los demás autores de la Teoría Crítica supieron captar procesos sociales incipientes que no han hecho sino desplegarse y confirmarse con el tiempo. Frente a quienes denuncian sus supuestas aporías y exagerado negativismo, se reivindica aquí la actualidad de una de sus tesis más conocidas y discutidas, la de la aniquilación del individuo. El paso del capitalismo liberal al monopolista sirve de horizonte para analizar las contradicciones del individuo burgués y su constitución social. En una segunda (...) parte se aborda la «debilidad del yo» como aquella configuración psíquica que se corresponde con la liquidación del individuo en la sociedad tardocapitalista. En el centenario del nacimiento de Th. W. Adorno valgan estas reflexiones de homenaje a un pensador y un pensamiento cada día más imprescindibles. (shrink)
