This book discusses the question of whether legal interpretation is a scientific activity. The law’s dependency on language, at least for the usual communication purposes, not only makes legal interpretation the main task performed by those whose work involves the law, but also an unavoidable step in the process of resolving a legal case. This task of decoding the words and sentences used by normative authorities while enacting norms, carried out in compliance with the principles and rules of the natural (...) language adopted, is prone to all of the difficulties stemming from the uncertainty intrinsic to all linguistic conventions. In this context, seeking to determine whether legal interpretation can be scientific or, in other words, can comply with the requirements for scientific knowledge, becomes a central question. In fact, the coherent application of the law depends on a knowledge regarding the meaning of normative sentences that can be classified as being structured, systematically organized and tendentially objective. Accordingly, this book focuses on analyzing precisely these problems; its respective contributions offer a range of revealing perspectives on both the problems and their ramifications. (shrink)

Substantial advances in our understanding of the neural bases of emotional processing have been made over the past decades. Overall, studies in humans and other animals highlight the key role of the amygdala in the detection and evaluation of stimuli with affective value. Nonetheless, contradictory findings have been reported, especially in terms of the exact role of this structure in the processing of different emotions, giving rise to different neural models of emotion. For instance, although the amygdala has traditionally been (...) considered as exclusively involved in fear (and possibly anger), more recent work suggests that it may be important for processing other types of emotions, and even nonemotional information. A review of the main findings in this field is presented here, together with some of the hypotheses that have been put forward to interpret this literature and explain its inconsistencies. (shrink)

Research on Augmented Reality in education has demonstrated that AR applications designed with diverse components boost student motivation in educational settings. However, most of the research conducted to date, does not define exactly what those components are and how these components positively affect student motivation. This study, therefore, attempts to identify some of the components that positively affect student motivation in mobile AR learning experiences to contribute to the design and development of motivational AR learning experiences for the Vocational Education (...) and Training level of education. To identify these components, a research model constructed from the literature was empirically validated with data obtained from two sources: 35 students from four VET institutes interacting with an AR application for learning for a period of 20 days, and a self-report measure obtained from the Instructional Materials Motivation Survey. We found that the following variables: use of scaffolding, real-time feedback, degree of success, time on-task and learning outcomes are positively correlated with the four dimensions of the ARCS model of motivation: Attention, Relevance, Confidence, and Satisfaction. Introspection is a fundamental part of our mental lives. Nevertheless, its reliability and its underlying cognitive architecture have been widely disputed. Here, I propose a principled way to model introspection. By using time-tested principles from signal detection theory (SDT) and extrapolating them from perception to introspection, I offer a new framework for an introspective signal detection theory (iSDT). In SDT, the reliability of perceptual judgments is a function of the strength of an internal perceptual response (signal- to-noise ratio) which is, (...) to a large extent, driven by the intensity of the stimulus. In parallel to perception, iSDT models the reliability of introspective judgments as a function of the strength of an internal introspective response (signal-to-noise ratio) which is, to a large extent, driven by the intensity of conscious experiences. Thus, by modelling introspection after perception, iSDT can calibrate introspection’s reliability across a whole range of contexts. iSDT offers a novel, illuminating way of thinking about introspection and the cognitive processes that support it. O objetivo desse artigo é analisar a projeção visual do México Revolucionário no Brasil entre os anos de 1910 e 1950. Essa projeção ocorre através da fotografia, pintura mural e gravura. Essas imagens conformam um patrimônio visual que constitui uma plataforma de propaganda política e busca de legitimidade do México Revolucionário. Analiso as imagens como um vetor de intercâmbio do imaginário latino-americano, possibilitada por publicações, exposições e redes de sociabilidade de artistas e intelectuais.

As pesquisas sobre biopoder e biopolítica, cada vez mais, emergem e sobrevoam altitudes nunca antes vistas. A ressignificação destes termos, por parte de Michel Foucault, denota campos de saberes mútuos, ou, no mínimo, se apresentam sob diversas discussões de níveis acadêmicos variados. Deste modo, o intuito deste artigo é utilizar o aparato conceitual foucaultiano a respeito do biopoder e da biopolítica para analisarmos alguns fatos que acontecem na cidade de Belém do Pará. Para isso, elucidaremos o termo da obra de (...) Foucault, respondendo a 3 questões básicas: 1ª- O que é o biopoder? 2ª- Por que pensar o biopoder hoje? 3ª- Como a reflexão teórica do biopoder pode nos proporcionar um entendimento ou análise de mundo? O presente artigo apresenta a distinta teoria do conhecimento proposta por Walter Benjamin em seu projeto das Passagens. Tal proposta já encontra suas origens em seus textos de juventude, principalmente em seu Sobre o programa de uma filosofia vindoura. Levando isso em conta, articulamos os dois momentos da obra de Benjamin para demonstrar que esta nova teoria materialista, dialética e imagética do conhecimento pressupõe um conceito mais alto de experiência, assim como uma crítica contundente ao sujeito do conhecimento que se (...) encontra em vias de desagregação. Para nos aprofundarmos na proposição benjaminiana, adentramos a importante topografia conceitual presente nas Passagens, passando pelos temas da linguagem, do sonho, do despertar e das imagens dialéticas. QUEM É MESMO EMPREGADO? DILEMAS DA SUBORDINAÇÃO JURÍDICA E O RETORNO DA DEPENDÊNCIA.

The metamemory approach to memory confidence was extended and elaborated to deal with semantic memory tasks. The metamemory approach assumes that memory confidence is based on the products and processes of a completed memory task, as well as metamemory beliefs that individuals have about how their memory products and processes relate to memory accuracy. In two experiments participants were asked deceptive and nondeceptive questions involving geographical information. In both experiments, as predicted by the metamemory approach to memory confidence, there was (...) a positive confidence/ accuracy relationship for nondeceptive items and a negative relationship for deceptive items. Experiment 2 used items that constrained the memory strategies (e.g., hierarchical reasoning about spatial location) used by the participants. The results supported the hypothesis that the participants were aware of the levels of memory accuracy associated with the different strategies and used that information to generate their memory confidence judgments. Las primeras imágenes cinematográficas rodadas por los estadounidenses en Cuba se remontan a la Guerra Hispano cubana norteamericana, anterior al surgimiento de Hollywood y su consolidación como industria del espectáculo. Los filmes producidos en esta etapa constituyen el preámbulo del denominado cine de propaganda política que, según el historiador Román Gubern, ha llegado hasta la actualidad y, sobre todo, develan el carácter manipulador que desde sus inicios ha tenido el lenguaje cinematográfico. Entre las décadas del `30 y `40 los filmes (...) realizados por Hollywood en la isla han proyectado una imagen exótica y estereotipada sobre la identidad cubana. No solo se ha desvirtuado nuestra memoria histórica, sino también nuestros valores identitarios, imagen que se ha extendido hasta el contexto actual.En la extensa historia del cine hollywoodense no son pocas las cintas que han abordado aspectos de nuestra historia. Independientemente de la calidad de la gran mayoría de estos filmes, no se puede minimizar su importancia en el obsesivo intento por construir una imagen creíble y veraz sobre Cuba. Aunque la gran mayoría de las cintas realizadas por cineastas estadounidenses sobre la isla se encuentran limitadas por el hecho de haberse rodado en espacios y locaciones de otras naciones con semejanzas geográficas y culturales con Cuba, dicha limitación no es sinónimo de pobreza artística. El objetivo fundamental de este ensayo radica en el análisis de la representación de la imagen e identidad de Cuba en la industria de Hollywood, a partir del estallido de la Guerra Hispano-cubana-norteamericana el 15 de febrero de 1898 hasta la administración del presidente Barack Obama, período histórico conocido como el Deshielo, porque ambas naciones decidieron restablecer relaciones diplomáticas interrumpidas en plena Guerra Fría, específicamente en 1961. Metaphysics as the foundation of science, philosophy as an exact method to discover this foundation: These are central themes in the Kant-Friesian philosophy which, at the beginning of the 20th century, Leonard Nelson, using the methods of mathematical axiomatics, further developed into interdisciplinary research programmes. Nelson carried out this research programme in his ethics but his untimely death prevented a systematic presentation of his natural philosophy and his doctrine of method. The present volume contains four transcripts of his seminars on (...) natural philosophy which he held over a period of 15 years. Jorge Luis Borges: Well, I think that's an easy one. You might talk in terms of two: Berkeley and Schopenhauer. But I suppose Hume might be worked in (...) also, because, after all, Hume refutes Berkeley. Really, he comes from Berkeley—even if Berkeley comes from Locke. You might think of Locke, of Berkeley, and of Hume as being three links in an argument..... But I suppose that when someone refutes someone else in philosophy, he is carrying on the argument. P&L: And Schopenhauer? Borges: Schopenhauer is very different from Hume. Of course, Schopenhauer had his idea of the Will. That is not to be found in Hume.... The case of Berkeley was different. I suppose he thought of God as being aware of all things all the time, if I don't get him wrong. If we go away, does this room disappear? No, because God is thinking about it. Now, in the case of Schopenhauer, I was rereading Die Welt als Wille und Vorstellung, The World as Will and Idea, and I was rather taken aback, or baffled I should say, puzzled by something that keeps on recurring in Schopenhauer. Then I came to the idea of how fine it would be to think of an encyclopedia... a very rigorous one of course, of an imaginary world, where everything should be linked. For example, you would have a language and then a literature, and then a history and so on. Then I thought I would write a story of a fancy encyclopedia. A análise Arendtiana relaciona os contextos sociais e econômicos ao surgimento dos elementos que constituem a novidade do Totalitarismo como fenômeno político. O conceito de Totalitarismo mostra-se como um valioso recurso de identificação das estruturas políticas e sociais que antecedem a subida de governos totalitários. O objetivo deste trabalho é investigar o conceito de Totalitarismo na Obra Origens do Totalitarismo e no pensamento de Hannah Arendt. Com este propósito, seleciona-se a obra da autora como referência e realiza-se um levantamento bibliográfico (...) da literatura política como estratégia de estudo. Os resultados apontam que a fragmentação da vida política na modernidade e a emergência das massas atomizadas são fatores preponderantes para eclosão do Totalitarismo como forma de governo. Ao mesmo tempo em que as condições socioeconômicas constituem o fundamento ideológico da propaganda dos líderes e movimentos totalitários anteriores à sua ascensão, é evidente que a mentalidade totalitária se aproveita dos antagonismos sociais para instalar um estado de domínio total e controlar todas as dimensões da vida humana. O conceito de Totalitarismo de Arendt revela-se relevante para a compreensão dos eventos totalitários como destruidor do espaço sociopolítico e da despolitização do sujeito. O enfrentamento ao avanço do estado totalitário mostra-se possível através da ação não-violenta, da liberdade de expressão e pensamento. A organização política colegiada apresenta-se como uma alternativa democrática ao processo de destruição da vida política e dos ideais de felicidade pública.F. (shrink)

Artificial intelligence has been adopted in a wide range of domains. This shows the imperative need to contribute to making citizens insightful actors in debates and decisions involving the adoption of AI mechanisms. Currently, existing approaches to the teaching of basic AI concepts through programming treat machine intelligence as an external element/module. After being trained, that external module is coupled to the main application. Combining block-based programming and WiSARD weightless artificial neural networks, this article presents the conceptualization and design of (...) a new methodology, AI from concrete to abstract, to endow general people with a minimum understanding of what AI means. The main strategy adopted was to include AI training and classification primitives as blocks that compose an otherwise conventional computer program. This way, the programmer can use these blocks as he/she uses other programming constructs. In order to achieve this purpose, we also propose BlockWiSARD, a block-based programming environment designed to promote the demystification of artificial intelligence via practical activities related to the development of learning machines, as well as through the observation of their learning process. As a beneficial side effect of BlockWiSARD, the difference between a program capable of learning from data and a conventional computer program becomes more evident. In addition, the simplicity of the WiSARD weightless artificial neural network model enables easy visualization and understanding of training and classification tasks internal realization. (shrink)

Neste artigo indicaremos que a proposição fundamental dos cursos de Geografia física de Kant é: o homem é habitante da Terra. Para validar essa tese, alinharemos a metodologia utilizada por Kant nos cursos de Antropologia e de Geografia física, a fim de evidenciar as convergências e divergências desses cursos. Além disso, também compararemos a metodologia empregada por Kant na História natural e na Geografia física, porque a distinção entre essas ciências nos permitirá ratificar a tese aqui defendida e delimitar os (...) critérios de validade da proposição acima indicada. Em Physische Geographie, Kant diferencia as proposições dessas disciplinas da seguinte maneira: as proposições geográficas se referem aos homens como habitantes da Terra, mas os investiga sem nenhuma perspectiva histórica, ou seja, os investiga no tempo presente. Ao contrário disso, as proposições naturalistas investigam os seres humanos em uma linha temporal sucessiva, a fim de demonstrar o que natureza fez deles. Dito isso, o problema central da história natural é demonstrar que os diferentes povos possuem uma origem comum e o problema central da geografia física é demonstrar de que maneira o habitat influencia no processo civilizador, moralizador, político e religioso dos diferentes povos.
