The CISG is now being applied extensively both by international arbitral tribunals and by domestic courts of its more than 70 contracting states. But do they also apply it in the same manner? Although Article 7 of the CISG underscores "the need to promote uniformity in its application", it gives little guidance as to how to achieve this goal. Each judge and arbitrator is influenced by the legal methodology of his home jurisdiction. Therefore it is somewhat of a paradox that (...) whilst the number of contracting states is constantly increasing so too is the threat of variation in application. In this book the most important issues of the CISG's methodology are analysed by leading experts from five continents. In this challenging study, André Gallois proposes and defends a thesis about the character of our knowledge of our own intentional states. Taking up issues at the centre of attention in contemporary analytic philosophy of mind and epistemology, he examines accounts of self-knowledge by such philosophers as Donald Davidson, Tyler Burge and Crispin Wright, and advances his own view that, without relying on observation, we are able justifiably to attribute to ourselves propositional attitudes, such as belief, that we consciously (...) hold. Susan Stebbing (1885–1943), the UK’s first female professor of philosophy, was a key figure in the development of analytic philosophy. Stebbing wrote the world’s first accessible book on the new polyadic logic and its philosophy. She made major contributions to the philosophy of science, metaphysics, philosophical logic, critical thinking, and applied philosophy. Nonetheless she has remained largely neglected by historians of analytic philosophy. This Element provides a thorough yet accessible overview of Stebbing’s positive, original contributions, including her solution to the (...) paradox of analysis, her account of the relation of sense-data to physical objects, and her anti-idealist interpretation of the new Einsteinian physics. However, the reductionist project of these contemporary theories has not yet proved successful in explaining unobservable phenomena of the mind, such as consciousness, will and human subjectivity. In his book, Physical Relativity, Harvey Brown challenges the orthodox view that special relativity is preferable to those parts of Lorentz's classical ether theory it replaced because it revealed various phenomena that were given a dynamical explanation in Lorentz's theory to be purely kinematical. I want to defend this orthodoxy. The phenomena most commonly discussed in this context in the philosophical literature are length contraction and time dilation. I consider three other phenomena of this kind that played a role in (...) the early reception of special relativity in the physics literature: the Fresnel drag effect in the Fizeau experiment, the velocity dependence of electron mass in beta-ray deflection experiments by Kaufmann and others, and the delicately balanced torques on a moving charged capacitor in the Trouton-Noble experiment. I offer historical sketches of how Lorentz's dynamical explanations of these phenomena came to be replaced by their now standard kinematical explanations. I then take up the philosophical challenge posed by the work of Harvey Brown and Oliver Pooley and clarify how those kinematical explanations work. (shrink)

Twenty-first century critics frequently misread Quinean ontological commitment as a toothless doctrine of anti-metaphysical pragmatism. Janssen-Lauret's historical investigations reveal that they misinterpret the influence of Quine's naturalism. His naturalistic view of philosophy as continuous with science informs a much more interesting conception of ontological commitments as generated by indispensable explanatory roles. But Janssen-Lauret uncovers a previously undetected weakness in Quine's meta-ontology. Careful examination of his debate with another naturalistic nominalist, Ruth Barcan Marcus, reveals that his holism leaves him (...) blind to her acquaintance-based ontological commitment via proper names. Janssen-Lauret examines some crucial misunderstandings between Barcan Marcus and Quine, centring on their wildly different interpretations of proper names, quantification and identity, and argues that these are motivated by their diametrically opposed positions on epistemology. (1) Many modern historians of science are so preoccupied with local scientiªc practices that they fail to recognize important non-local elements. (2) Many modern philosophers of science make a sharp distinction between explanation and evidence, whereas in scientiªc practice explanatory power is routinely used as evidence for scientiªc claims. Susan Stebbing’s work on incomplete symbols and analysis was instrumental in clarifying, sharpening, and improving the project of logical constructions which was pivotal to early analytic philosophy. She dispelled use-mention confusions by restricting the term ‘incomplete symbol’ to expressions eliminable through analysis, rather than those expressions’ purported referents, and distinguished linguistic analysis from analysis of facts. In this paper I explore Stebbing’s role in analytic philosophy’s development from anti-holism, presupposing that analysis terminates in simples, to the more holist or foundherentist (...) analytic philosophy of the later 20th century. I read Stebbing as a transitional figure who made room for more holist analytic movements, e.g., applications of incomplete symbol theory to Quinean ontological commitment. Stebbing, I argue, is part of a historical narrative which starts with the holism of Bradley, an early influence on her, to which Moore and Russell’s logical analysis was a response. They countered Bradley’s holist reservations about facts with the view that the world is built up out of individually knowable simples. Stebbing, a more subtle and sympathetic reader of the British idealists, defends analysis, but with important refinements and caveats which prepared the way for a return to foundherentism and holism within analytic philosophy. Quine as well as historical, exegetical, and critical papers by several leading Quine scholars including Hylton, Ebbs, and Ben-Menahem, this volume aims to remedy the comparative lack of historical investigation of Quine and his philosophical context.

The relationship between Albert Einstein’s special theory of relativity and Hendrik A. Lorentz’s ether theory is best understood in terms of competing interpretations of Lorentz invariance. In the 1890s, Lorentz proved and exploited the Lorentz invariance of Maxwell’s equations, the laws governing electromagnetic fields in the ether, with what he called the theorem of corresponding states. To account for the negative results of attempts to detect the earth’s motion through the ether, Lorentz, in effect, had to assume that the laws (...) governing the matter interacting with the fields are Lorentz invariant as well. This additional assumption can be seen as a generalization of the well-known contraction hypothesis. In Lorentz’s theory, it remained an unexplained coincidence that both the laws governing fields and the laws governing matter should be Lorentz invariant. In special relativity, by contrast, the Lorentz invariance of all physical laws directly reflects the Minkowski space-time structure posited by the theory. One can use this observation to produce a common-cause argument to show that the relativistic interpretation of Lorentz invariance is preferable to Lorentz’s interpretation. (shrink)

This special issue brings together philosophical perspectives on the debate over cognitive ontology. We contextualize the papers in this issue by considering several different senses of the term “cognitive ontology” and linking those debates to traditional debates in philosophy of mind.

There are two principles which bear the name Frege''sprinciple: the principle of compositionality, and the contextprinciple. The aim of this contribution is to investigate whether thisis justified: did Frege accept both principles at the same time, did hehold the one principle but not the other, or did he, at some moment,change his opinion? The conclusion is as follows. There is a developmentin Frege''s position. In the period of Grundlagen he followed to a strict form of contextuality. He repeatedcontextuality in later (...) writings, but became less strict. From 1914 on,pushed by the needs of research, he comes close to compositionality. Readers of this volume will notice that it contains only a few papers on general relativity. This is because most papers documenting the genesis and early development of general relativity were not published in Annalen der Physik . After Einstein took up his new prestigious position at the Prussian Academy of Sciences in the spring of 1914, the Sitzungsberichte of the Berlin academy almost by default became the main outlet for his scientific production. Two of the more important papers on (...) general relativity, however, did find their way into the pages of the Annalen [35,41]. Although I shall discuss both papers in this essay, the main focus will be on [35], the first systematic exposition of general relativity, submitted in March 1916 and published in May of that year. What he showed was that phenomena seen as inertial effects in a space-time coordinate system in which the non-accelerating body is at rest can be seen as a combination of inertial and gravitational effects in a space-time coordinate system (...) in which the accelerating body is at rest. Two different relativity principles play a role in these accounts: the relativity of non-uniform motion, in the weak sense that the laws of physics are the same in the two space-time coordinate systems involved; what Einstein in 1920 called the relativity of the gravitational field, the notion that there is a unified inertio-gravitational field that splits differently into inertial and gravitational components in different coordinate systems. I provide a detailed reconstruction of Einstein's rather sketchy accounts of the twins and the bucket and examine the role of these two relativity principles. This paper intends to recover the “phenomenological” basis of Sartre’s trajectory since his very first reception of Edmund Husserl’s and Martin Heidegger’s philosophies until the moment in which the main synthesis of his existentialism is published, entitled Being and Nothingness (1943). In this sense, the paper situates the status of Husserl’s and Heidegger’s phenomenologies for Sartrean thought, as well as the originality of Being and Nothingness, which is also influenced by a very particular interpretation of Hegelian negation.

This volume is the first systematic presentation of the work of Albert Einstein, comprising fourteen essays by leading historians and philosophers of science that introduce readers to his work. Following an introduction that places Einstein's work in the context of his life and times, the book opens with essays on the papers of Einstein's 'miracle year', 1905, covering Brownian motion, light quanta, and special relativity, as well as his contributions to early quantum theory and the opposition to his light quantum (...) hypothesis. The book generalises earlier theories of belief change to cover all kinds of changes of sets by sets. The principal focus is still on changes of belief sets in response to new evidence, but the formal theory extends to all domains with a closure operation and a preference structure including, for example, systems of action. Contraction is the key notion; all other changes can be defined. Various new applications of the theory are outlined. A sentential version of contraction, subtraction, is (...) proposed as a formal counterpart to 'except'-locutions in natural language. Connections are emphasised with other areas at the interface between philosophical logic and artificial intelligence such as reasoning from default assumptions or from inconsistent premises. A relation of merge inference is proposed as a means of retrieving maximal but nontrivial information from inconsistent premises. Merge inference respects certain anti-Boolean intuitions while avoiding a revision of classical logic. (shrink)

In 1901 Russell had envisaged the new analytic philosophy as uniquely systematic, borrowing the methods of science and mathematics. A century later, have Russell’s hopes become reality? David Lewis is often celebrated as a great systematic metaphysician, his influence proof that we live in a heyday of systematic philosophy. But, we argue, this common belief is misguided: Lewis was not a systematic philosopher, and he didn’t want to be. Although some aspects of his philosophy are systematic, mainly his pluriverse of (...) possible worlds and its many applications, that systematicity was due to the influence of his teacher Quine, who really was an heir to Russell. Drawing upon Lewis’s posthumous papers and his correspondence as well as the published record, we show that Lewis’s non- Quinean influences, including G.E. Moore and D.M. Armstrong, led Lewis to an anti- systematic methodology which leaves each philosopher’s views and starting points to his or her own personal conscience. (shrink)
