The ethics of deceased organ procurement (OP) is supposedly based on individual consent to donate, either explicit (opt-in) or presumed (opt-out). However, in many cases, individuals fail to express any preference regarding donation after death. When this happens, the decision to remove or not to remove their organs depends on the policy’s default option or on family preferences. Several studies show that in most countries the family plays a significant and often decisive role in the process of decision-making for OP. (...) Depending on the country, the family may be allowed to take different kinds of actions in different situations, and this may be granted either by law or by clinical practice only. This adds much complexity to the usual classification of consent policies in two categories: opt-in and opt-out. Here we propose a novel and comprehensive taxonomy of the models of consent for OP according to three variables: (1) the deceased’s wishes, if any, (2) family wishes, if any, and (3) default policies. By analysing these models of consent, we show that they rely on at least three different concepts of autonomy: individual autonomy, relational autonomy, and family autonomy. In light of this analysis, we discuss the ethical debates surrounding two policy approaches: presumed consent and family veto. (shrink)

Families play an essential role in deceased organ procurement. As the person cannot directly communicate his or her wishes regarding donation, the family is often the only source of information regarding consent or refusal. We provide a systematic description and analysis of the different roles the family can play, and actions the family can take, in the organ procurement process across different jurisdictions and consent systems. First, families can inform or update healthcare professionals about a person’s donation wishes. Second, families (...) can authorize organ procurement in the absence of deceased’s preferences and the default is not to remove organs, and oppose donation where there is no evidence of preference but the default is to presume consent; in both cases, the decision could be based on their own wishes or what they think the deceased would have wanted. Finally, families can overrule the known wishes of the deceased, which can mean preventing donation, or permitting donation when the deceased refused it. We propose a schema of 4 levels on which to map these possible family roles: no role, witness, surrogate, and full decisional authority. We conclude by mapping different jurisdictions onto this schema to provide a more comprehensive understanding of the consent system for organ donation and some important nuances about the role of families. This classificatory model aims to account for the majority of the world’s consent systems. Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

The organ donation and transplantation (ODT) system heavily relies on the willingness of individuals to donate their organs. While it is widely believed that public trust plays a crucial role in shaping donation rates, the empirical support for this assumption remains limited. In order to bridge this knowledge gap, this article takes a foundational approach by elucidating the concept of trust within the context of ODT. By examining the stakeholders involved, identifying influential factors, and mapping the intricate trust relationships among (...) trustors, trustees, and objects of trust, we aim to provide a comprehensive understanding of trust dynamics in ODT. We employ maps and graphs to illustrate the functioning of these trust relationships, enabling a visual representation of the complex interactions within the ODT system. Through this conceptual groundwork, we pave the way for future empirical research to investigate the link between trust and organ donation rates, informed by a clarified understanding of trust in ODT. Objectives To increase postmortem organ donation rates, several countries are adopting an opt-out (presumed consent) policy, meaning that individuals are deemed donors unless they expressly refused so. Although opt-out countries tend to have higher donation rates, there is no conclusive evidence that this is caused by the policy itself. The main objective of this study is to better assess the direct impact of consent policy defaults per se on deceased organ recovery rates when considering the role of the family in (...) the decision-making process. This study does not take into account any indirect effects of defaults, such as potential psychological and behavioural effects on individuals and their relatives. -/- Design Based on previous work regarding consent policies, we created a conceptual model of the decision-making process for deceased organ recovery that included any scenario that could be directly influenced by opt-in or opt-out policies. We then applied this model to internationally published data of the consent process to determine how frequently policy defaults could apply. -/- Main outcome measures We measure the direct impact that opt-in and opt-out policies have per se on deceased organ recovery. -/- Results Our analysis shows that opt-in and opt-out have strictly identical outcomes in eight out of nine situations. They only differ when neither the deceased nor the family have expressed a preference and defaults therefore apply. The direct impact of consent policy defaults is typically circumscribed to a range of 0%–5% of all opportunities for organ recovery. Our study also shows that the intervention of the family improves organ retrieval under opt-in but hinders it under opt-out. -/- Conclusions This study may warn policy makers that, by emphasising the need to introduce presumed consent to increase organ recovery rates, they might be overestimating the influence of the default and underestimating the power granted to families. Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. Goal: To assess public knowledge and attitudes towards the family’s role in deceased organ donation in Europe. -/- Methods: A systematic search was conducted in CINHAL, MEDLINE, PAIS Index, Scopus, PsycINFO, and Web of Science on December 15th, 2017. Eligibility criteria were socio-empirical studies conducted in Europe from 2008 to 2017 addressing either knowledge or attitudes by the public towards the consent system, including the involvement of the family in the decision-making process, for post-mortem organ retrieval. Screening and data collection (...) were performed by two or more independent reviewers for each record. -/- Results: Of the 1482 results, 467 studies were assessed in full-text form, and 33 were included in this synthesis. When the deceased has not expressed any preference, a majority of the public support the family's role as a surrogate decision-maker. When the deceased expressly consented, the respondents' answers depend on whether they see themselves as potential donors or as a deceased's next-of-kin. Answers also depend on the relationship between the deceased and the decision-maker(s) within the family, and on their ethnic or cultural background. -/- Conclusions: Public views on the authority of the family in organ donation decision-making require further research. A common conceptual framework and validated well-designed questionnaires are needed for future studies. Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

Background: This research explores how public awareness and attitudes toward donation and transplantation policies may contribute to Spain's success in cadaveric organ donation. Materials and Methods: A representative sample of 813 people residing in Andalusia (Southern Spain) were surveyed by telephone or via Internet between October and December 2018. Results: Most participants trust Spain's donation and transplantation system (93%) and wish to donate their organs after death (76%). Among donors, a majority have expressed their consent (59%), and few nondonors have (...) expressed their refusal (14%). Only a minority are aware of the presumed consent system in force (28%) and feel sufficiently informed regarding the requirements needed to be an organ donor (16%). Participants mainly consider that relatives should represent the deceased's preferences and be consulted when the deceased's wishes are unknown, as is the case in Spain. Conclusion: Public trust in the transplant system may contribute to Spain's high performance in organ donation. High levels of societal support toward organ donation and transplantation do not correspond with similar levels of public awareness of donation and transplantation policies in Spain. (shrink)

Meanwhile, scientists have documented the harm done to women and blacks by the publication of such claims. Can anything be done to improve this situation? Freedom of research is universally recognized to be of first-rate importance. Yet, constraints on that freedom are also universally recognized. El presente artículo plantea una reflexión filosófica y pedagógica acerca de las condiciones para el Desarrollo humano y el empoderamiento ciudadano en contextos digitales. Vivir en plena era digital requiere de unas bases teóricas que orienten la educación cívica en entornos digitales y que apunten hacia el progreso social y democrático. No obstante, la idea de forjar un ethos intercultural y democrático en un mundo interconectado y mediático no es una tarea sencilla de abordar. Así, se propone como objetivo abordar (...) algunas preguntas cruciales en este sentido: ¿Cuáles son las capacidades y las virtudes cívicas en un entorno mediático radicalmente diverso? ¿Cómo fomentar la ciudadanía mediática frente a usos de las redes sociales ética y políticamente cuestionables? ¿Cómo promover una cultura digital en la línea del Desarrollo humano? Tras un análisis bibliográfico y hermenéutico, se articula una propuesta formativa para empoderar la ciudadanía mediática a partir del «enfoque de las capacidades» de Amartya Sen y Martha Nussbaum. A partir de estos presupuestos, y partiendo de la actual necesidad de reconstruir un ethos democrático para un mundo interconectado y globalizado, se formula un modelo teórico para cultivar la democracia en entornos digitales, a favor del Desarrollo humano y aprovechando el potencial de las redes sociales como estructura comunicativa reticular de alcance global e intercultural. Medical professionals routinely offer prenatal genetic testing services to their expecting patients. In theory, this testing helps expecting parents better prepare for the birth of their child: e.g., if the child will have a disability. In practice, however, such testing often leads to the termination of pregnancies that would produce a child who has a disability. Some bioethicists believe that in light of our society’s history of poor treatment of people who have disabilities, when expecting parents use prenatal testing for (...) selective abortion and when medical professionals promote the use of such testing, they express a disparaging message to and about extant disabled people: e.g., that disabled people’s lives are... Two decades of critique have sensitized historians and philosophers of science to the inadequacies of conventional dichotomies between theory and practice, thereby prompting the search for new ways of writing about science that are less beholden than the old ways to the epistemological mores of theoretical physics, and more faithful to the actual practices not only of physics but of all the natural sciences. The need for alternative descriptions seems particularly urgent if one is to understand the place of theory (...) in contemporary molecular biology, a science where, until now, no division between theory and experiment has obtained, and where distinctions between representing and intervening, and more generally, between basic and applied science, are daily becoming more blurred.Indeed, the very division between theory and experiment threatens to slight the extensive and sophisticated theoretical analyses on which experimental work in contemporary molecular biology so often depends. My aim in this paper is to find a way of talking about theoretical practices in biology that is directly rooted in the mix of conceptual and material work that biologists do. As an example of such theoretical practices, I choose for the focus of my analysis the development of a model for gene regulation out of the experimental work of Eric Davidson and his colleagues at Cal Tech. ABSTRACTType B, or a posteriori, physicalism is the view that phenomenal-physical identity statements can be necessarily true, even though they cannot be known a priori—and that the key to understanding their status is to understand the special features of our phenomenal concepts, those concepts of our experiential states acquired through introspection. This view was once regarded as a promising response to anti-physicalist arguments that maintain that an epistemic gap between phenomenal and physical concepts entails that phenomenal and physical properties are (...) distinct. More recently, however, many physicalists have lost confidence in the view, and have proposed less promising defences of physicalism—or have become outright sceptical about its prospects. I argue here that these physicalists have underestimated the resources of Type B physicalism and are thereby retreating too quickly—or fighting battles that have already been won. (shrink)

Most areas of Western philosophy tend not only to ignore women, but also to perpetuate long-standing anti-feminine biases of society as a whole. This book demonstrates that feminist philosophy is not a separate area. Rather, it relates to at least most of the major areas of philosophy, and its gains will stand to benefit all philosophers no matter what their field--or gender.

It is standard practice in philosophical inquiry to test a general thesis (of the form 'F iff G' or 'F only if G') by attempting to construct a counterexample to it. If we can imagine or conceive of1an F that isn't a G, then we have evidence that there could be an F that isn't a G — and thus evidence against the thesis in question; if not, then the thesis is (at least temporarily) secure. Or so it is standardly (...) claimed.But there is increasing skepticism about how seriously to take what we can imagine or conceive as evidence for (or against) a priori philosophical theses, given the many historical examples of now-questionable theses that once seemed impossible to doubt — and also the recent experimental research .. In this paper I discuss the claim (advanced in various ways by Joseph Levine, Frank Jackson and David Chalmers) that the successful reduction of qualitative to physical states requires some sort of intelligible connection between our qualitative and physical concepts, which in turn requires a conceptual analysis of our qualitative concepts in causal‐functional terms. While I defend this claim against some of its recent critics, I ultimately dispute it, and propose a different way to get the requisite intelligible connection between (...) qualitative and physical concepts. The United Nations Convention on the Rights of Persons with Disabilities, adopted on December 13, 2006, and entered into force on May 3, 2008, constitutes a key landmark in the emerging field of global health law and a critical milestone in the development of international law on the rights of persons with disabilities. At the time of its adoption, the U.N. High Commissioner for Human Rights heralded the CRPD as a rejection of the understanding of persons with disabilities “as objects (...) of charity, medical treatment and social protection” and an embrace of disabled people as “subjects of rights.”The text of the Convention itself, and the highly participatory process by which it was negotiated, signal a definitive break from previous international approaches that focused on disability within a medical model framework. In contrast to traditional approaches, the CRPD embraces a social model of disability, concentrating the disability experience not in individual deficiency, but in the socially constructed environment and the barriers that impede the participation of persons with disabilities in society. Through computational modeling, here we examine whether visual and task characteristics of writing systems alone can account for lateralization differences in visual word recognition between different languages without assuming influence from left hemisphere (LH) lateralized language processes. We apply a hemispheric processing model of face recognition to visual word recognition; the model implements a theory of hemispheric asymmetry in perception that posits low spatial frequency biases in the right hemisphere and high spatial frequency (HSF) biases in the LH. We show (...) two factors that can influence lateralization: (a) Visual similarity among words: The more similar the words in the lexicon look visually, the more HSF/LH processing is required to distinguish them, and (b) Requirement to decompose words into graphemes for grapheme-phoneme mapping: Alphabetic reading (involving grapheme-phoneme conversion) requires more HSF/LH processing than logographic reading (no grapheme-phoneme mapping). These factors may explain the difference in lateralization between English and Chinese orthographic processing. (shrink)

The main message of Philosophy of Science after Feminism is twofold: that philosophy of science needs to locate science within its wider societal context, ceasing to analyze science as if it existed in a social/political/economic vacuum; and correlatively, that philosophy of science needs to aim for an understanding of scientific rationality that is appropriate to that context, a scientific rationality that integrates the ethical with the epistemic. The ideal of socially responsible science that the book puts forward, in fact, maintains (...) that sound social values as well as sound epistemic values must control every aspect of the scientific research process, from the choice of research questions to the communication and application of results. And it is this that raises troubling questions for Matt Brown, Hugh Lacey, and Libby Potter. In this thoughtful, rich, and extremely ambitious book, Norton Nelkin develops a "Scientific Cartesian" theory of sensation and perception, consciousness, conceptual content, and concept formation. The theory is Cartesian primarily because its account of mental states is realist, individualist, and internalist; Nelkin also holds, with Descartes, that perceptions are spontaneous judgments and that at least some of our concepts are innate. But, unlike Descartes, Nelkin rejects dualism and treats the mind as something that can be studied by the same methods (...) as other natural phenomena; indeed, Nelkin goes further than many contemporary theorists in attempting to make his views consistent with, and informed by, studies in the cognitive sciences. El objetivo de este trabajo es presentar la noción de Imaginario Social de Cornelius Castoriadis y la pertinencia de su utilización para el estudio de los movimientos sociales. Para ello, se repasarán las principales perspectivas teóricas que han abordado este fenómeno social; algunas claves conceptuales en el pensamiento de Castoriadis y una propuesta para el abordaje empírico de los movimientos sociales con dicho andamiaje teórico.

El caso del Movimiento Arcoíris en Chile permite ilustrar en dos ámbitos, los significados atribuidos a la naturaleza y las formas que adquiere la acción colectiva contemporánea, las derivas y tensiones que se presentan al intentar materializar el mundo anhelado. Esta investigación, se efectuó por medio de una etnografía (2009-2022) y diez entrevistas semiestructuradas analizadas desde un enfoque hermenéutico. Tuvo como resultados nueve prácticas sedimentadas -de las cuales se presentan tres- y un conjunto heterogéneo de significaciones para cada una de (...) ellas. A modo de discusión y conclusión se propone que este Movimiento expande un tipo de vínculo afectivo/espiritual con la naturaleza que rehúye del modo de producción industrial y que sus formas de acción colectiva privilegian la autonomía y la horizontalidad entre sus miembros. Ambas cuestiones encuentran límites en la espontaneidad de las acciones, el capitalismo verde, en las dificultades para arribar a acuerdos y/o su escaso cumplimiento. (shrink)

This paper challenges some leading views about the conditions under which the ascription of beliefs and desires can make sense of, or provide reasons for, a creature's behavior. I argue that it is unnecessary for behavior to proceed from beliefs and desires according to the principles of logic and decision theory, or even from principles that generally get things right. I also deny that it is necessary for behavior to proceed from principles that, though perhaps subrational, are similar to those (...) that we ourselves use. I then propose some conditions that are considerably weaker, and argue that they fulfill the descriptive and explanatory requirements of intentional ascription. (shrink)

Janet Broughton In the introduction to the Treatise, Hume cautions the reader that the scientist of man cannot "go beyond experience" and "discover the ultimate original qualities of human nature."1 "[T]he only solid foundation we can give to this science," tie says, "must be laid on experience and observation" (Txvi). This methodological principle is a familiar Newtonian one; indeed Hume makes (...) a point of saying it applies to "all the sciences" (T xviii), not just to the science of man. Although the principle is familiar, just what it enjoins is not clear. We are to renounce investigations that go "beyond experience," and we are not to seek "ultimate" qualities. But exactly which investigations and qualities are these? The question is a difficult one for Newton as well as for Hume. But Hume's invocation of the familiar methodological principle raises two additional questions, ones that need not especially trouble Newton. When the scientist of man goes about his task ofgathering "experience and observation," what sort ofthing is he to observe? And how is he to make his observations? My mainaimin this paperisto answerthose two questionsas they arise for the early stages ofHume's investigation ofhuman nature in the Treatise. I hope also to persuade the reader that these questions are more difficult, and more important, than they may at first seem, andthattheyare connected with evenbroader questions aboutthe sort ofproject Hume undertook in the Treatise. "Perceptions" Without explanation, Hume begins the Treatise proper by distinguishing between two kinds of"perceptions ofthe human mind" and drawsthe distinction accordingtohow the perceptions"maketheir way into our thought or consciousness"(T 1). Afew pageslater, he asks which of these "impressions and ideas are causes and which effects" and then announces that the "full examination ofthis question is the subject of the present treatise" (T 4). The scientist ofman, then, is to observe perceptions in our consciousness. Most commentators assume therefore that Hume takes himselfto be studying what Locke called ideas: states of awareness whose 'immediate objects' are dependent for their existence on the existence Volume XVIII Number 2 155 JANETBROUGHTON ofthe states ofawareness themselves, and can be theimmediate objects of awareness for one mind only. Many commentators make the additional assumptionthatforHume, thepropersphere ofhis scientific investigations is really just his own Lockean ideas. That is, the only form of experience the scientist of man may consult is immediate experience; the only appropriateform ofobservationhe may undertake is introspection. Kemp Smith disagrees. He claims thatin the openingstages ofthe Treatise, Hume takes up a point of view that is "naively realistic."2 Kemp Smith prefers this readingbecause he thinks it explains Hume's general tendency, in the early parts ofbook 1, to slide between talking about objects and talking about ideas; before part 4's "Of scepticism withregard tothe senses," Kemp Smith claims, Hume himselfoccupies the position ofthe "vulgar"(for example, T 192), rather than that ofthe "philosophers." Kemp Smith reminds us that in part 4, after a long account of the position of the vulgar, Hume says that its inherent instability leads philosophers to change their system, and distinguish, (as we shall do for the future) betwixt perceptions and objects. (T 211, emphasis added) Only at this point, Kemp Smith says, does Hume adopt the Lockean theory ofideas. I also oppose the standard view, but unlike Kemp Smith I do not see our central interpretative task here as that of deciding whether Hume began his investigation ofhuman nature as a "naive realist" or as a Lockean theorist. For one thing, when Kemp Smith calls Hume a naive realist, he means that Hume begins by assuming that the Lockean is right about this much: when we see, hear, remember, and so on, we are "immediately" or "directly" aware of something—albeit objects, not ideas. But I do not think that Hume's account of the early phases of his investigation requires us to impute that assumption to him. I also see the choice Kemp Smith offers us as limiting in another way. Levin argues that the results of the most methodologically sound and philosophically relevant studies discussed in this volume [ Experimental Philosophy] could have been obtained from the armchair, and thus that experimental philosophy may not present a serious challenge to the traditional methods of analytic philosophy.

Among philosophers of science nearly a century ago the dominant attitude was that (in Rudolph Carnap’s words) philosophy of science was “like science itself, neutral with respect to practical aims, whether they are moral aims for the individual, or political aims for a society.” The dominant attitude today is not much different: our aim is still to articulate scientific rationality, and our understanding of that rationality still excludes the moral and political. A recent study published in Nature Neuroscience purports to have answered a question posed to Locke in 1688 by his friend William Molyneux, namely, whether ‘a man born blind and made to see’ would be able to identify, immediately and by vision alone, objects previously known only by touch. The answer, according to the researchers – and as predicted by Molyneux, as well as Locke, Berkeley, and others – is ‘likely negative. The newly sighted subjects did not exhibit an immediate (...) transfer of their tactile shape knowledge to the visual domain’. Since then, however, many commentators have argued that the answer is still not clear. Moreover, in the contemporary literature on Molyneux’s Question, and more generally on cross-modal perception and the individuation of the senses, it is sometimes hard to determine what question is being investigated.
