This article explores the profound impact of visualism and visual perception in the context of medical imaging diagnostics. It emphasizes the intricate interplay among vision, embodiment, subjectivity, language, and historicity within the realm of medical science and technology, with a specific focus on image consciousness. The study delves into the role of subjectivity in perception, facilitating the communication of opacity and historicity to the perceiving individual. Additionally, it scrutinizes the image interpretation process, drawing parallels to text interpretation and highlighting the (...) influence of personal biases and individuality in medical practice. By revisiting Husserl’s conceptualization of “image consciousness” and introducing the notion of “image theme”, the paper seeks to establish a theoretical framework for making sense of images within the context of technological interpretation. A key objective is to enhance the phenomenology of technology through a systematic analysis of medical imaging diagnosis, contributing to an expanded epistemological foundation for medical practice. The article recognizes that the construction of medical knowledge incorporates subjective elements, especially within a historical context. The interpretation of images involves both instrumental and expert interpretation, with human subjectivity playing a crucial role. Clinicians and administrators have a professional obligation to contribute to improvement of healthcare quality. At the same time, participation in embedded research poses risks to healthcare institutions. Disclosure of an institution’s sensitive information could endanger relationships with patients and undermine its reputation. The existing ethical framework for learning healthcare systems does not address the conflict between the OTC and institutional interests. Ethical guidance and policy regulation are needed to create a safe environment for embedded research. In this article we analyse (...) the EF for LHSs and the concept of professionalism. We suggest that the EF should be supplemented with an obligation to protect provider’s legitimate interests. We define legitimate interests as those that enable providers to discharge their primary duties. We argue that both the OTC and the obligation to protect legitimate interests are grounded in the concept of medical professionalism and can be understood as a matter of contract between a democratic society and medical professionals. The proposed supplemented EF can be implemented into a regulatory system in three different ways: the self-regulating: where providers decide themselves how to balance the ethical claims, the centralised: where a governmental institution decides the right balance between providers’ interests and interests of a health system; and the mediating: where medical professionals, the state and patients negotiate their interests. Our article contributes to the discussion on ethical relevance of providers’ interests and the regulatory model for weighing opposite interests in LHSs. (shrink)

The aim of this article is to look at an early 17th-century analysis of a prince’s management of an ‘agglomerate polity’ in order to obtain a view of its chief focuses, concerns, and terms of analysis. Four main types of issues appear (apart from Grotius’ general analysis of Philip’s person and policies, which are also discussed): 1. Acceptation and legitimacy of a prince who was perceived to ignore local customs, rights and interests of his various territories; 2. The king’s representatives (...) and intermediaries, their (mis)management of their task, or the King’s (mis)management of them; 3. The conflicting demands of international politics; 4. Controlling armies and the connected issue of financial resources. The ‘Tacitean’ mode of writing history was regarded as the most ‘true’ and ‘revealing’ historiography in Grotius’ time. However Tacitean perceptiveness and analysis were not about what historians today regard as deeper historical processes and causation (like those associated with the ‘philosophic’ histories from the Enlightenment onwards, e.g. in Edward Gibbon), but about understanding personal motives and (hidden) immediate causes and intentions behind particular events and decisions. This historic differences in historical explanation should be taken into account when judging the value of Grotius’ history of his own time. (shrink)

This is a short presentation by the Guest Editors of the series of Special Issues of the journal _Philosophies_ under the common title “Contemporary Natural Philosophy and Philosophies” in which we present Part 2. The series will continue, and the call for contributions to the next Special Issue will appear shortly.

When there are two lines of argument that contradict each other but still end up with the same conclusion, this conclusion is called a floating conclusion. It is an open topic in skeptical defeasible reasoning if floating conclusions ought to be accepted. Inter- estingly, the answer seems to be changing for different examples. In this paper, we propose a solution for explaining the different treatments of the floating conclusion in the various examples from the literature. We collect the examples from (...) the literature, extend them with additional examples and test various hypotheses for explaining the difference by means of the examples. We will argue for a framework that accepts a floating conclusion by default but allows for reasons to deviate from the default in order to reject it. These reasons nicely explain the different underlying patterns of our intuitions. (shrink)

Evaluation of clinical ethics support services (CESS) has attracted considerable interest in recent decades. However, few evaluation studies are explicit about normative presuppositions which underlie the goals and the research design of CESS evaluation. In this paper, we provide an account of normative premises of different approaches to CESS evaluation and argue that normativity should be a focus of considerations when designing and conducting evaluation research of CESS. In a first step, we present three different approaches to CESS evaluation from (...) published literature. Next to a brief sketch of the well-established approaches of ‘descriptive evaluation’ and ‘evaluation of outcomes’, we will give a more detailed description of a third approach to evaluation—‘reconstructing quality norms of CESS’—which is explicit about the normative presuppositions of its research (design). In the subsequent section, we will analyse the normative premises of each of the three approaches to CESS evaluation. We will conclude with a brief argument for more sensitivity towards the normativity of CESS and its evaluation research. (shrink)

ABSTRACT Ernst Fraenkel’s seminal study about Nazi law, in which he described the co-existence of a ‘normative state’ and a ‘prerogative state’ as principles of government, is to be rediscovered in the new age of the prerogative. Through a critical reading of The Dual State and other important texts by Fraenkel, this article seeks to contribute to the contemporary debate on regime types and governmental power in three regards: first, by clarifying Fraenkel’s concept of and perspective on law; second, by (...) discussing the methodological demands for the beneficial application of the dual state concept; and, third, by showing the usefulness of such an application, even beyond the field of authoritarian states in the narrower sense. Law-eroding prerogative developments cannot only be witnessed in hybrid regimes, but also in democratic states, which resort to reflections and practices of an ‘enemy criminal law’, and in the European Union’s recent crisis politics. This paper concerns exchangeable analogical predictions based on similarity relations between predicates, and deals with a restricted class of such relations. It describes a system of Carnapian λγ rules on underlying predicate families to model the analogical predictions for this restricted class. Instead of the usual axiomatic definition, the system is characterized with a Bayesian model that employs certain statistical hypotheses. Finally the paper argues that the Bayesian model can be generalized to cover cases outside the restricted class of similarity (...) relations. (shrink)

Liberty is what libertarians advocate. Both because of the inherent value of human liberty and because of the increasing wealth and welfare it brings to all. They see the aggressive coercion of the state as the main enemy of liberty. The solution is to roll back the state until there is little or no state left. Libertarianism has been rapidly growing since the 1970s. But it is still not commonly understood or even given a proper hearing. However, you will increasingly (...) come across it. Often it will be through state enthusiasts disingenuously claiming to be libertarians . At other times it will be through state enthusiasts attacking libertarianism as an extremist ideology. And very occasionally it will be real libertarians explaining and defending their views. J C Lester is a libertarian philosopher who has been writing about why liberty is preferable to politics for many years. This book contains many of his shorter writings on the subject. These range from the populist to the philosophical. Together they function as a miscellaneous introduction to libertarianism. Infinite regress arguments play an important role in all domains of philosophy. There are infinite regresses of reasons, obligations, rules, and disputes, and all are supposed to have their own moral. Yet most of them are involved in controversy. Bernard Bolzano is increasingly recognized as one of the greatest nineteenth-century philosophers. A philosopher and mathematician of rare talent, he made ground-breaking contributions to logic, the foundations and philosophy of mathematics, metaphysics, and the philosophy of religion. Many of the larger features of later analytic philosophy first appear in his work: for example, the separation of logic from psychology, his sophisticated understanding of mathematical proof, his definition of logical consequence, his work on the semantics of natural kind terms, or his (...) anticipations of Cantor's set theory, to name but a few. To his contemporaries, however, he was best known as an intelligent and determined advocate for reform of Church and State. Based in large part on a carefully argued utilitarian practical philosophy, he developed a program for the non-violent reform of the authoritarian institutions of the Hapsburg Empire, a program which he himself helped to set in motion through his teaching and other activities. Rarely has a philosopher had such a great impact on the political culture of his homeland. Persecuted in his lifetime by secular and ecclesiastical authorities, long ignored or misunderstood by philosophers, Bolzano's reputation has nevertheless steadily increased over the past century and a half. Much discussed and respected in Central Europe for over a century, he is finally beginning to receive the recognition he deserves in the English-speaking world. Here I reflect on the main themes of Global Culture, Nationalism, Globalization and Modernity. On these themes, where are we 30 years later? I sidestep the fine print of the 1990 conversations and share notes in brief format on where I have come to in the decades that have passed. I round off with notes on the 2020 conjuncture.

The catuṣkoṭi or tetralemma is an argumentative figure familiar to any reader of Buddhist philosophical literature. Roughly speaking it consists of the enumeration of four alternatives: that some propositions holds, that it fails to hold, that it both holds and fails to hold, that it neither holds nor fails to hold. The tetralemma also constitutes one of the more puzzling features of Buddhist philosophy as the use to which it is put in arguments is not immediately obvious and certainly not (...) uniform: sometimes one of the four possibilities is selected as ‘the right one’, sometimes all four are rejected, sometimes all four are affirmed. It seems that this confusion is only exacerbated by the plethora of treatments we find in the modern commentarial literature, many of which try to analyze the tetralemma by recourse to notions of modern logic. Despite some important work done during the last decades a comprehensive study of the origin and development of the catuṣkoṭi from its use in the earliest Buddhist literature up to its later employment in the Buddhist philosophical works of Tibet, China, and Japan remains yet to be written. The present paper is obviously not intended to fill this gap, but has the specific objective of giving an interpretation of Nāgārrjuna’s employment of the tetralemma which makes both logical sense and is in accordance with his general philosophical position. Among others, the term problem plays a major role in the various attempts to characterize interdisciplinarity or transdisciplinarity, as used synonymously in this paper. Interdisciplinarity is regarded as problem solving among science, technology and society and as problem orientation beyond disciplinary constraints. The point of departure of this paper is that the discourse and practice of ID have problems with the problem. The objective here is to shed some light on the vague notion of problem in order to advocate a (...) specific type of interdisciplinarity: problem-oriented interdisciplinarity. The outline is as follows: Taking an ex negativo approach, I will show what problem-oriented ID does not mean. Using references to well-established distinctions in philosophy of science, I will show three other types of ID that should not be placed under the umbrella term problem-oriented ID : object-oriented ID, theory-oriented ID, and method-oriented ID. Different philosophical thought traditions can be related to these distinguishable meanings. I will then clarify the notion of problem by looking at three systematic elements: an undesired state, a desired state, and the barriers in getting from the one to the other. These three elements include three related kinds of knowledge: systems, target, and transformation knowledge. This paper elaborates further methodological and epistemological elements of problem-oriented ID. It concludes by stressing that problem-oriented ID is the most needed as well as the most challenging type of ID. (shrink)

The effects of public announcements, private communications, deceptive messages to groups, and so on, can all be captured by a general mechanism of updating multi-agent models with update action models, now in widespread use. There is a natural extension of the definition of a bisimulation to action models. Surely enough, updating with bisimilar action models gives the same result (modulo bisimulation). But the converse turns out to be false: update models may have the same update effects without being bisimilar. We (...) propose action emulation as a notion of equivalence more appropriate for action models, and generalizing standard bisimulation. It is proved that action emulation provides a full characterization of update effect. We first concentrate on the general case, and next focus on the important case of action models with propositional preconditions. Our notion of action emulation yields a simplification procedure for action models, and it gives designers of multi-agent systems a useful tool for comparing different ways of representing a particular communicative action. Dieser Ausspruch Bonaventuras in einer Adventspredigt zu Joh 1,26-27 aus dem Jahre 1267 spiegelt die ganze Ambivalenz wider, die sich in seinen Schriften mit Bezug auf die Philosophie findet. Dem unverkennbaren philosophisch-spekulativen Impetus seines Denkens steht eine teilweise harsche Philosophen- und Philosophiekritik gegenüber. «Die (...) Philosophen gaben neun Wissenschaften und versprachen, eine zehnte zu geben, nämlich die Schau. Aber indem sich viele Philosophen von der Finsternis des Irrtums trennen wollten, verstrickten sie sich in größere Irrtümer; und indem sie sich weise nannten, wurden sie zu Toren; indem sie auf ihr Wissen stolz waren, wurden sie zu Gefolgsleuten Luzifers». This essay in honour of Carlos Steel examines a fundamental thesis behind the medieval metaphysics of the good, namely the «goodness of being» thesis, according to which everything that is is good. The basic text used is a Quodlibet disputed by the Parisian master Gerard of Bologna at the beginning of the fourteenth century, in which he discusses various determinations of the nature of the good. This discussion reveals the difficulties to which the metaphysics of the good can lead: is (...) it really the case that every being is good? (shrink)

The focus of this article is on an ambivalent conception in medieval thought, namely the term ‘transcendens’, which on the one hand signifies a reality beyond created beings, i.e. God, and on the other hand signifies something common to all beings. Armandus de Bellovisu, in his Declaratio difficilium terminorum, has thematized exactly this difference between transcendence that follows from ‘nobility of being’ and that which follows from ‘commonness of predication’. The medieval term ‘transcendens’, because of its ambiguity, thus includes two (...) fundamental concepts, which represent divergent philosophical tendencies concerning the specification of First Philosophy: the one understands it as «Philosophy of Transcendence», the other as «Transcendental Philosophy». The history of metaphysics is characterized by the tension between these two tendencies, but as we shall see, it also shows that they are intimately connected. (shrink)
