ABSTRACT Legal certainty is a central requirement for the rule of law. Legal systems should both enable those subject to law to predict human behaviour and institutional reactions and to prevent an arbitrary use of state power against them. The value of legal certainty is usually conceived as a formal value opposed to the values of freedom or equality. The purpose of this paper is to discuss this idea and to explore a less formal conception of the value of legal (...) certainty. In this sense, I will argue that we need to depart from a purely formal understanding of the requirements imposed by such value and to consider the need to provide them with a substantive content. So, legal certainty is not completely independent of legal substantive justice and it implies that it is impossible to define ex ante which concrete aspects of justice should not be the law’s concern. In this article, an attempt was made to identify the level of community social participation according to age, gender and the structural characteristics of the personal support networks in a population displaced by floods in the Colombian Caribbean. The research was based in a non-experimental methodology with an associative-relational strategy. An intentional non-probabilistic sample of 151 people affected by the winter wave in the south of the Department of Atlántico (Colombia) was selected. In total, the study included 42 males (27.8 (...) %) and 109 females (72.2 %) participants, with an average age of 37.48 (±14, Range 18 - 80) and average relocation time of 21.79 months (± 8.22, Range 5-36). The Arizona Social Support Interview Schedule (ASSIS) and Community Empowerment instruments were responded to with an instrument adapted from the leadership competence factor. The results show lower rates of intermediation in the older population, and the relationship between social participation and gender shows equally cohesive social support networks in men and women. This evidence is discussed to promote psychosocial interventions aimed to increase community engagement and empowerment of people that have experienced non-voluntary mobility processes. (shrink)

The development of Information and Communication Technologies has favored access to technological resources in adolescents. These tools provide access to information that can promote learning. However, they can also have a negative effect against people, as they can be used with other functionality, in which cyberbullying situations are caused during the interactions that arise when using social networks. The objective of this study was to determine the predictive value of the role of cyberbullying victims based on variables related to other (...) roles involved in cyberbullying and bullying, as well as personal characteristics, contextual characteristics and positive teamwork habits.. Information was collected from 227 students of the educational stages of Primary Education and Secondary Education, aged between 11 and 15 years, in a city with a high index of cultural diversity. The step-by-step technique was used to build the regression model. The results indicate that the model has a good goodness of fit coefficient. The role of cyberbully is the most important predictive variable of the role of the victim in cyberbullying and, to a lesser extent, the role of the witness in cyberbullying, the role of the witness in bullying, and the role of the victim of bullying. The role of the bullying aggressor and the variables sex, age, type of educational center, and teamwork habits are excluded in the predictive model. (shrink)

IntroductionIncorporating technology in cognitive interventions represents an innovation, making them more accessible, flexible, and cost-effective. This will not be feasible without adequate user-technology fit. Bearing in mind the importance of developing cognitive interventions whose technology is appropriate for elderly people with cognitive impairment, the objective of this systematic review was to find evidence about usability and user experience measurements and features of stimulation, training, and cognitive rehabilitation technologies for older adults with mild cognitive impairment or dementia.MethodThe Medline, PubMed, Scopus, ScienceDirect, (...) and PsycINFO databases were searched for literature published in the last 10 years, and three researchers independently reviewed potentially eligible studies, following specific inclusion criteria. A systematic review of the studies was conducted, presenting a qualitative synthesis of usability and UX measures with their outcomes, study characteristics and features of the cognitive intervention technologies.ResultsTen studies were selected: five were cognitive stimulation and five were cognitive training. Most of them were computer-based programs with a serious game format. Efficiency and effectiveness were the most frequent measurements used for collecting objective usability data, showing that elderly people with cognitive impairment require more time and help but can complete tasks. Regarding UX or subjective usability data, questionnaires and scales were the most used methods, reporting positive experience despite certain difficulties with the interface in five studies.ConclusionMeasuring usability and UX in cognitive intervention technologies for older adults with MCI or dementia provides an integrated view that can contribute to their development according to the needs and characteristics of the target population. More research is required to include this population group in usability and UX studies, as well as standardized tools and consensus on the relationship of these terms to guarantee the future effectiveness of cognitive intervention technologies.Review registrationThis review was registered in the PROSPERO International Register of Systematic Review Protocols. The current times call for reforms in educational processes. The Covid-19 pandemic had an unforeseen impact on the educational system in all countries. This need for change requires new pedagogies and new methods for teaching and learning. Potentia e potestas, embora sejam tipos de poder de natureza distinta - um, o poder físico que os corpos têm de produzir efeitos uns nos outros; outro, o poder jurídico, do qual resultam efeitos jurídicos como a própria justiça -, (...) estão mutuamente implicados na trama das representações jurídicas. In the first part of this article, we show that, contrary to the Gricean tradition, inter-clausal and is not semantically equivalent to logical conjunction and, contrary to temporal approaches such as Bar-Levand Palacas 1980, it is not temporallyloaded. We then explore a commonsenseidea – namely that while sentence juxtaposition might be interpreted either as discourse coordination or subordination, and indicates coordination. SDRT already includes notions of coordinating and subordinating discourse relations (cf. Lascarides and Asher 1993, Asher 1993), and the meaning (...) of and is related to this distinction. Similar distinctions that play a crucial role in anaphora resolution have also appeared in AI – cf. Scha and Polanyi 1988, or Webber 1991. However, this discourse-structure-based distinction has not been well defined yet, and our approach provides independent motivation for it. This paper argues that the semantics of and includes a notion of coordination expressed as the requirement of a Coordinated Discourse Topic (CDT).CDT characterizes aclass of discourse relations, among which are Narration and Result.Once the basic semanticcontribution of and is isolated, effects related to its presence such as changes in temporal structure, blocking of a Discourse Relation, or conditional meanings are shown to follow from the defeasiblearchitecture set up by SDRT. If personhood is the quality or condition of being an individual person, brainhood could name the quality or condition of being a brain. This ontological quality would define the `cerebral subject' that has, at least in industrialized and highly medicalized societies, gained numerous social inscriptions since the mid-20th century. This article explores the historical development of brainhood. It suggests that the brain is necessarily the location of the `modern self', and that, consequently, the cerebral subject is the anthropological figure inherent (...) to modernity (at least insofar as modernity gives supreme value to the individual as autonomous agent of choice and initiative). It further argues that the ideology of brainhood impelled neuroscientific investigation much more than it resulted from it, and sketches how an expanding constellation of neurocultural discourses and practices embodies and sustains that ideology. The aim of our research is to analyze how different religions influence business ethics. We develop an index of practices in the field of business ethics, made up of 19 items containing practices related to workers, consumers, products, human rights, management of ethical conflicts, and crime prevention. Also, we consider a wide range of religion affiliations. To undertake this research, we use a panel data sample composed of 11,956 firm‐year observations from 18 countries. Drawing on stakeholder theory, we posit some (...) hypotheses based on the religions considered. The results obtained show that a higher percentage of religious adherents in the country where a company does business usually involve the implementation of more ethical practices in the corporate field. These findings are obtained for Christian, Islamic, Jewish, and Hindu religions. In contrast, this does not stand for Buddhist and folk religions. Also, countries where there is no predominant religion do not show a confluence between religion and ethical corporate practices. (shrink)

In this article I shall propose María Zambrano's poetic reason as a suitable method for developing a knowledge of animal being. To do so, I will follow the analyses (Derrida, Coetzee) that place animal thinking in the poetic sphere, thus showing the need for a poetic/literary knowledge to make a philosophical knowledge of the animal possible. Animal writing expresses our nature in relation to animal nature; it discloses our animal interbeingness. Finally, I will point to some of the principles of (...) ecofeminist/animal ethics, like care and empathy, which arise both in what I propose to call animal writing and in Zambranian poetic reason. Due to the COVID-19 Pandemic, several changes have been forcibly made and observed in various fields and areas of society, one of which include the field of education; the foundation of the formation of intellect and knowledge. After two years of studying indoors and private educational institutions holding virtual classes, the time has finally come for students to be re- adjusted once more to the blended mode of learning; a combination of virtual and in-person classes. Thus, this study aimed to (...) investigate the development of students’ study habits and how these habits could potentially affect the students’ academic achievement or performance. The study utilized a descriptivecorrelational design to examine the impact of study habits to the academic performance of 137 senior high school students. The study made use of the Palsane and Sharma’s Study Habits Inventory, or also known as PSSHI, and using this instrument, the study has been able to procure sufficient results that will answer the present study’s problems. Using linear regression analysis, the present study found that there was a significance between the study habits and academic performance of the senior high school students, thus the study’s null hypothesis was eventually rejected. This paper demonstrates how argumentation schemes can be used in decision support systems that help clinicians in making treatment decisions. The work builds on the use of computational argumentation, a rigorous approach to reasoning with complex data that places strong emphasis on being able to justify and explain the decisions that are recommended. The main contribution of the paper is to present a novel set of specialised argumentation schemes that can be used in the context of a clinical decision support (...) system to assist in reasoning about what treatments to offer. These schemes provide a mechanism for capturing clinical reasoning in such a way that it can be handled by the formal reasoning mechanisms of formal argumentation. The paper describes how the integration between argumentation schemes and formal argumentation may be carried out, sketches how this is achieved by an implementation that we have created and illustrates the overall process on a small set of case studies. How can dispute records shed light on the study of dispute settlement processes and their social and political underpinnings? This article is autoethnographic, based upon the authors’ experiences and reflections upon encountered moments of ethical tension whilst conducting research in rural Malawi. Given that knowledge production, as a process, has been marred by colonial forms of power, the project was underpinned by efforts to achieve a decolonial approach to the research, including the research ethics. The authors share of their endeavours to counterbalance the challenges of power asymmetries whilst researching and working with an Indigenous community whose reality can be (...) marginalised by the Western canon. The authors attempted to ensure that the values and customs of the researched community were respected and central to the research approach. When researchers are guided by local culture and customs, the participants are able to drive the research approach, incorporate their voice and share knowledge that is true to their context and reality. In this way, the research study is illustrative of how an ethics of care can help to facilitate decolonial research practice. (shrink)

Philosophy lacks criteria to evaluate its philosophical theories. To fill this gap, this essay introduces nine criteria to compare worldviews, classified in three broad categories: objective criteria (objective consistency, scientificity, scope), subjective criteria (subjective consistency, personal utility, emotionality), and intersubjective criteria (intersubjective consistency, collective utility, narrativity). The essay first defines what a worldview is and exposes the heuristic used in the quest for criteria. After describing each criterion individually, it shows what happens when each of them is violated. From the (...) criteria, it derives assessment tests to compare and improve different worldviews. These include the is-ought, ought-act, and is-act first-order tests; the critical and dialectical second-order tests; the mixed-questions and first-second-order third-order tests; and the we-I, we-it, and it-I tests. The essay then applies these criteria and tests to a concrete example, comparing the Flying Spaghetti Monster deity with Intelligent Design. For another application, it draws more general fruitful suggestions for the dialogue between science and religion. (shrink)

If one were to make, not altogether seriously, such a distinction between types of philosophers, there is no doubt that Professor Feibleman would in many ways fall into the first category. The present volume is impressive in its scope: at one time or another it touches on practically every known field of philosophy, the sciences, the arts, theology, etc. Unfortunately, the development of this vast material is not adequate to the greatness of the themes. Mr. Feibleman has at times interesting, (...) original and provocative ideas; but the reader must, as it were, mine through a mountain of lesser material in order to come upon these occasional nuggets of precious metal. Philosophical doctrines which are palpably inconsistent are eclectically thrown together; arbitrary statements are made; and at times there is an almost incredible over-simplification of problems and lack of subtlety in analysis. To point out the numerous inconsistencies would be a task almost too easy, and one can only regret that Mr. Feibleman did not for his own sake more carefully revise the book before publishing it, so as at least to remove the most glaring of these. In its becoming, also, it is able to span the distance between the self it was and the self it is to become. Its transformation, then, can never become complete; it arises from a basis to which the person is always able in some measure to return.

To put one of Jordan's central thoughts briefly, forms or relations through the act become "clots" or plexus, i.e., intertwinings, and thus concrete things. Jordan has several descriptions of the act, the perfect act, the creative act, the cosmic act, the integrative act, the subjective act, and the intelligent act. Of these the integrative act is the most important metaphysically, and has many of the characteristics of the other acts.

Este trabalho tem como principal foco de análise o currículo oficial português relacionado com a componente de História, para o Ensino Básico, em particular as ausências que aí mais sobressaem. Estas podem relacionar-se com os conhecimentos substantivos que se apartam da abordagem preconizada por variadas razões (passados incómodos? temas difíceis? grupos não poderosos? …) ou com as competências de pensamento histórico (multiperspetiva, significância, causalidade, empatia, …) que parecem ter sido esquecidas quando se estruturou certo percurso de aprendizagem para estudantes com (...) idades entre os 6 e os 15 anos. Como considerações maiores, constata-se, naqueles textos curriculares (denominado Aprendizagens Essenciais), uma aparente simplificação genérica da narrativa histórica que se conta aos mais jovens cidadãos do mundo atual. A inevitável seleção de determinados saberes em detrimento de outros, na verdade, contribui, acima de tudo, para o escamotear de uma literacia histórica que podia, e devia, alcançar outros níveis. O processo de ensino (e de aprendizagem) da História, desde o começo da escolaridade obrigatória, tem de orientar-se no sentido de uma formação cidadã, esclarecida, democrática, intertemporal. As inexistências no que concerne aos conteúdos considerados ou ao raciocínio potenciado, por sua vez, somente comprometem aquele desígnio. (shrink)

Well into the 1940s, many French biologists rejected both Mendelian genetics and Darwinism in favour of neo-transformism, the claim that evolution proceeds by the inheritance of acquired characteristics. In 1931 the zoologist Maurice Caullery published Le Problème d’évolution, arguing that, while Lamarckian mechanisms could not be demonstrated in the present, they had nevertheless operated in the past. It was in this context that Raymond Aron expressed anxiety about the relationship between biology, history, and human autonomy in his 1938 Introduction à (...) la philosophie de l’histoire: essai sur les limites de l’objectivité historique, in which he rejected both neo-Kantian and biological accounts of human history. Aron aspired to a philosophy of history that could explain the dual nature of human existence as fundamentally rooted in the biological, and at the same time, as a radical transcendence of natural law. I argue that Aron’s encounter with evolutionary theory at this moment of epistemic crisis in evolutionary theory was crucial to the formation of his philosophy of history, and moreover that this case study demonstrates the importance of moving beyond the methodological divisions between intellectual history and history of science. This article compares political clientelism and datafied campaigning as two modes of relating politicians/parties and voters that are centred around voter surveillance. It contributes to the discussion on consequences of Big Data by showing similarities of datafied campaigns with a type of electoral politics that pre-dates the advent of mass media and is usually regarded as deficient. It thus departs from the predominant perspective on datafication and surveillance, which draws on Foucault, in order to identify the particular challenges that datafication (...) poses in the realm of democratic electoral politics. They are related to four major aspects in which datafied campaigning resembles political clientelism, as opposed to the combination of ideology, issue-based campaigning and media appeal that characterized Western European party politics in the second half of the 20th century. It personalizes the relationship between politicians and voters with the help of intermediaries; it is based on an asymmetric and iterative monitoring of voters; it implies a strong particularism and an affinity with populist appeals; and it is ambivalent with regard to the volition of voters. The identification of these similarities renders general concerns about the consequences of datafied campaigning for democracy more concrete. It offers a mirror in which seemingly novel practices are revealed to have implications that are well known to be problematic for the quality of democracy. (shrink)

For thousands of years, people have used nature to justify their political, moral, and social judgments. Such appeals to the moral authority of nature are still very much with us today, as heated debates over genetically modified organisms and human cloning testify. _The Moral Authority of Nature_ offers a wide-ranging account of how people have used nature to think about what counts as good, beautiful, just, or valuable. The eighteen essays cover a diverse array of topics, including the connection of (...) cosmic and human orders in ancient Greece, medieval notions of sexual disorder, early modern contexts for categorizing individuals and judging acts as "against nature," race and the origin of humans, ecological economics, and radical feminism. How much bacterial evolution occurs in our intestines and which factors control it are currently burning questions. The formation of new ecotypes, some of which capable of coexisting for long periods of time, is highly likely in our guts. Horizontal gene transfer driven by temperate phages that can perform lysogeny is also widespread in mammalian intestines. Yet, the roles of mutation and especially lysogeny as key drivers of gut bacterial adaptation remain poorly understood. The mammalian gut contains hundreds of bacterial (...) species, each with many strains and ecotypes, whose abundance varies along the lifetime of a host. A continuous high input of mutations and horizontal gene transfer events mediated by temperate phages drives that diversity. Future experiments to study the interaction between mutations that cause adaptation in microbiomes and lysogenic events with different costs and benefits will be key to understand the dynamic microbiomes of mammals. In this philosophical paper, we explore computational and biological analogies to address the fine-tuning problem in cosmology. We first clarify what it means for physical constants or initial conditions to be fine-tuned. We review important distinctions such as the dimensionless and dimensional physical constants, and the classification of constants proposed by Lévy-Leblond. Then we explore how two great analogies, computational and biological, can give new insights into our problem. This paper includes a preliminary study to examine the two analogies. The idea that our universe might be modelled as a computational entity is analysed, and we discuss the distinction between physical laws and initial conditions using algorithmic information theory. Despite tremendous advances in neuroscience, the topic “brain, sex and gender” remains a matter of misleading interpretations, that go well beyond the bounds of science. In the 19th century, the difference in brain sizes was a major argument to explain the hierarchy between men and women, and was supposed to reflect innate differences in mental capacity. Nowadays, our understanding of the human brain has progressed dramatically with the demonstration of cerebral plasticity. The new brain imaging techniques have revealed the role (...) of the environment in continually re-shaping our brain all along our lifetimes as it goes through new experiences and acquires new knowledge. However, the idea that biology is a major determining factor for cognition and behavioral gender differentiation, is still very much alive. The media are far from being the only guilty party. Some scientific circles actively promote the idea of an innate origin of a gender difference in mental capacities. Experimental data from brain imaging, cognitive tests or genetics are often distorted to serve deterministic ideas. Such abuse of “scientific discourses” have to be counteracted by effective communication of clear and unbiased information to the citizens. This paper presents a critical analysis of selected examples which emphasize sex differences in three fields e.g. skills in language and mathematics, testosterone and financial risk-taking behavior, moral cognition. To shed light on the data and the methods used in some papers, we can now—with today’s knowledge on cerebral plasticity—challenge even more strongly, many false interpretations. Our goal here is double: we want to provide evidence against archaic beliefs about the biological determinism of sex differences but also promote a positive image of scientific research. (shrink)

Hearing loss has been identified as a major modifiable risk factors for dementia. Adult candidates for cochlear implantation represent a population at risk of hearing loss-associated cognitive decline. This study investigated the effect of demographics, habits, and medical and psychological risk factors on cognition within such a cohort. Data from 34 consecutive adults with post-lingual deafness scheduled for CI were analyzed. Pure tone audiometry and Speech Discrimination Score were recorded. The Repeatable Battery for Assessment of Neuropsychological Status for Hearing impaired (...) individuals was used to measure cognition. Demographics, habits, and medical factors were evaluated. Depression was measured using the Hospital Anxiety and Depression Scale, and social inhibition with the Type D questionnaire. All participants suffered from severe to profound hearing loss. The mean RBANS-H total score was 83 ± 16. Participants reported a mean of years of formal education of 12 ± 5 years. The prevalence of habits and medical risk factors was: physical inactivity, body mass index >30, traumatic brain injury, hypertension, heavy alcohol consumption, smoking, and diabetes. Regarding psychological factors, the mean scores of social inhibition and depression were 10 ± 6 and 6 ± 5, respectively. The number of years of education was significantly correlated with the RBANS-H total score, and with the domains “Immediate memory”, “Visuospatial/constructional”, and “Attention”. The mean RBANS-H total score in participants who had university studies or higher level was 97 ± 9, with the remaining participants reporting a mean score of 75 ± 15. Men performed better in the “Visuospatial/constructional”. Physical inactivity was associated with lower scores in the “Delayed memory” ; hypertension correlated with lower RBANS-H total scores and “Attention”. Depression and social inhibition were negatively correlated with RBANS-H total score and with the “Immediate memory,” “Visuospatial/constructional,” and “Attention”. In adults with late-onset deafness scheduled to CI, educational level has a significant effect. Additionally, sex, physical inactivity, hypertension, and psychological traits of social inhibition and depression may also influence cognitive status. Long-term studies with more participants would enable us better understand the effects different risk factors on cognitive status. (shrink)
