This article discusses the manipulation and measurement of levels of situational self-focus, which is generally labeled ''self-awareness.'' A new scale was developed to quantify levels of public and private self-awareness. Five studies were conducted to assess the psychometric properties, reliability, and validity of the Situational Self-Awareness Scale (SSAS). The SSAS was found to have a reliable factor structure, to detect differences in public and private self-awareness produced by laboratory manipulations, and to be sensitive to changes in self-awareness within individuals over (...) time and across situations. The SSAS can be used as a manipulation check of laboratory self-awareness manipulations and as a means of assessing naturally occurring fluctuations in public and private self-awareness in order to clarify the relation between self-awareness and other variables (e.g., mood and memory). Emerging technologies like nanotechnologies are governed in different ways around the world. This article draws attention to an important element that can help to explain the emergence of this diversity in governance practices: the role of nanotechnology in nation-building. By investigating the relation between nanotechnology and the nation in India, the article demonstrates that various particularities of the Indian governance of nanotechnology can be explained by the relation between science, technology, and nation-building. The article discusses four instances in which the (...) governance of nanotechnology in India is informed by the role science and technology has in nation-building: the historical image of India as a country that can attain modernity and development by engaging with modern science and technology supported the government’s decision to free funds for nanotechnology research; the view of India as a country that cannot rely on foreign assistance to get access to the latest technologies reinforced the strategy to pro-actively pursue nanotechnology research and development itself; the historical use of science and technology as crucial elements in overcoming deeply rooted societal divisions enabled the science-centered way in which nanotechnology was governed; and the Indian ambition to become a global superpower informed the governance of nanotechnology as an object of international competition. In early 2013, the Indian government introduced new rules governing the conduct of clinical trials involving human participants. Among other provisions, the law requires that sponsors of research compensate participants who are injured during the course of their research participation. This article examines the effects of India's compensation law and the efforts that policymakers in India have made to tailor the law since its passage. I use the legal concept of acoustic separation as a framework to explain and justify (...) the approach that India has taken in refining its regulation of research related injuries. I conclude that India's example may provide useful lessons for research sponsors and lawmakers in other regulatory states seeking to promote a well-regulated biomedical research industry. (shrink)

This paper discusses the work of Ismat Chughtai (1911–1991), a controversial writer whose long literary career extending over four decades roughly corresponds to the formative stages of the Indian women's movement. It interprets Chughtai's novella The Heart Breaks Free (1966) to forward an anti-teleological enquiry of the women's movement in India. This progressive teleology often suggested by a discussion of the ‘waves’, ‘stages’ or ‘phases’ of the Euro-American women's movement and adopted to postcolonial women's movements, such as those in India, (...) Jamaica and South Africa, is belied by the piecemeal legislative gains won by activist efforts. Some of the questions governing my enquiry are: What lessons can a questioning of teleology teach us about the gains and losses of postcolonial women's movements? If the alternative to teleology is, as I suggest, a genealogy, then what constitutes a genealogical enquiry into the women's movement in India? In face of apparent and self-acknowledged losses and ineffectiveness in recent times, would the movement's apparent unity across religious differences be a way of initiating such an inquiry or is another mode of analysis required? The paper directs attention to the Indian women's movement's attempts at bringing together women of different religious persuasions, legislative, and religious edicts related to Muslim women's right to co-habitation and divorce, and ‘cases’ that serve as testing points of the movement's struggle against religious and state authority. It also points to the neglected factor of economic security for women as a way in which a genealogical inquiry can proceed so as to strengthen the legislation and the movement itself. (shrink)

Hasian, Condit, and Lucaites argue that there is "a need for investigating and implementing procedures that would democratize the legal system"i and that the boundaries of the law provide a fruitful site for such investigation. I would argue that one particularly relevant site to recover such procedures is American Indian law. American Indian treaties, although more so in terms of their negotiation rather than their final form, are hybrid documents, combining elements from both indigenous and Western law. Because treaties exist (...) at the boundaries between two systems of law, they are positioned not only to illuminate differences in practice but also to shed light on the balance of power between Indian nations and the U.S. government. Evidence of law's boundaries can be found, for example, in the adherence to, or abandonment of, indigenous practices of law over time. The journals of the proceedings in particular, which recorded the negotiation of the treaties, also documented cultural understandings of power, leadership, human relations, and attitudes toward the land. So if ever there were an opportunity to investigate and implement procedures leading to a more democratized legal system, this would be one. ;Traditional American Indian communication practices were not, and still are not, empty rituals or colorful customs of an exotic culture performed for the entertainment of outsiders. Neither are American Indian law practices the quaint customs of a long-gone past but living traditions still practiced today. I document this continuity in practice by investigating two sites: first, the historical journal of the proceedings from the 1825 Treaty of Prairie du Chien, and then in the contemporary rhetoric of their descendents, Anishinaabe environmental activists. Umesh Bagade’s historic critique of the caste blindness of the Subaltern Studies project retraces its emergence as a criticism of the Nationalist and Marxist schools of Indian history. He shows how the subaltern historians borrowed Antonio Gramsci’s concept of “subaltern” in order to retain a broadly Marxist framework without “class” but discarded the crucial Gramscian emphasis on oppression and economic exploitation. They grievously misread, confused, or omitted caste as a “system” when they constructed their model of the subaltern as subordinate (...) but autonomous. The caste system functioned as a graded inequality with close links to patriarchy in which the lower castes were oppressed, exploited, and subordinated rather than autonomous. A homogenized “subaltern” status thus lumped the oppressed lower-caste peasants and the tribal peasantry with upper-caste peasantry. It was not acknowledged that the “solidarity” that expanded the base of subaltern revolt was achieved through coercion of the lower castes and women. The subaltern cultural “consciousness” of caste Panchayats, which was central to the project’s epistemology, was governed by Brahmanical religion and culture. The kinship relations that comprised peasant solidarities were built on endogamous caste practices. Predictably, the Subaltern Studies project found a close affinity with postmodernism and eschewed the question of emancipatory politics. The project therefore excluded anticaste mobilizations from the purview of “subaltern revolts” and simultaneously rejected the need for a comprehensive historical interpretation in which the caste system and patriarchy could be analyzed and opposed. In exposing the biases and lacunae of subaltern historiography, Bagade provides a clinical observation of history with an eye on history’s ability to influence reality. He shows the path that was not taken, which anticaste scholarship is now forging. (shrink)

Contemporary notions of what constitutes tribal self government for Indigenous Peoples in the legal systems of the nation-states Canada, New Zealand and the United States of America have their origins in philosophies and theories developed by European nation-states generally, in relation to their colonial expansion into what is now called the Americas. This thesis examines the nature of these theories, and how they have formed the basis for legal precedent and public policy in the three nation-states. A representative analysis (...) of three contemporary issues will serve to illustrate the outcome of this legal/political history. I look at three sites. These are the British Columbia Treaty Process in Canada, the Waka Umanga legislation in New Zealand, and legal developments arising from the Indian Reorganization Act in the United States. Full sovereignty from an Indigenous Peoples worldview existed for Indigenous nations, and with it, self government. The notion of self government as a viable and contemporary public policy initiative is well grounded in law and history. It would seem that current initiatives to acknowledge this inherent right are more about preserving colonial hegemony rather then engaging in honest negotiation. Current initiatives are converging into a single public policy goal; namely the corporatisation of Indigenous Peoples legal personality and self governing capacity. What used to be distinct nation-state development now seems to be a four nation-state (CANZUS) unified plan being implemented on four different fronts. Clearly, from the legal history, self government is something fundamentally different from self-management. The advent of Legal Positivism has played a significant role in assumptions that inherent sovereignty and self government never existed under European legal systems. The framework of tribal self governance must be viewed in the context of the values of the specific People to be a true expression of an Indigenous Nation exercising self government. This fundamental distinction can be traced back to the legal history. The foundational laws regarding interactions with Indigenous Peoples were developed under theories of natural law. The contemporary state practice is conducted under positivist law, with a nod toward developing human rights standards. Only through continued advocacy for the legal recognition of inherent rights will the nation-states be challenged on their self management agenda. (shrink)

Social analysis of transplant organ demand often focuses on either small-scale (familial) tyrannies of the gift or large-scale (global) markets. Media accounts of the scandalous in transplant medicine stress the latter, a homogeneous model of flows of biovalue down gradients of economic and social capital. This article examines particular globalizations of tissue demand organized as much around claims of social similarity as gradients of social difference. To engage apparent ‘diasporic’ networks of organ purchase — Non-Resident Indians traveling to India (...) and Overseas Chinese to China — I elaborate a concept of bodily supplementarity. Supplementarity in this account is the ability of an individual or population to secure longevity through the mobilization or acquisition of the organic form of others. Diasporic tissue circuits are analyzed in the context of ‘experiments’ in supplementarity that proliferate with the transformation of the molecular conditions for supplementarity. The emergence of powerful immunosuppressants renders the scale of tissue recruitment flexible and contingent, and allows clinics to develop alternatives to brain death. These circuits emerge as situations that reorder the relation of the familial and the global in transplantation, in the service not only of migrant supplementarity but also efforts to reimagine the challenges of emigrant belonging within particular configurations of racialized life and its government. The Malaysian society, one of the successful and managed multi-ethnic societies, is replete of imbalances and there still underlie the racial and ethnic disproportions in geographical dwellings, educational and professional fields, and economic and political roles. The modern racial relation in Malaysia is the legacy of pre-colonial and colonial period of history dating back to fifteenth and sixteenth centuries. The unstable demographic balance, the unrestricted immigration policy or the policy of divide and rule by the colonial masters contributed besides other (...) reasons toward the troubled relations between ethnic communities of Malaysia- Malays, Chinese, Indians, and others. But the way the respective Malaysian governments have managed such sour relationship in their socio-economic and political spheres is the lesson that all multiethnic states can learn from. (shrink)

This study explored the relationship between egoistic, altruistic and biospheric values and pro-environmental attitudes, as well as their impact on the pro-environmental behaviours of Indian consumers. India is currently facing the burgeoning challenge of a rapidly increasing urban population, which is leading to waste segregation issues in households and the need for sustainable green products due to rising awareness among consumers. The goal of this research was to understand the effect of Indian consumers’ values and pro-environmental attitudes on the following (...) three specific behaviours: waste-sorting intention, green-consumption intention and social-activity intention. The authors found that values were positively related to pro-environmental attitudes, which in turn positively impacted the three pro-environmental behaviours. These findings suggest that, in order to strengthen individuals’ perceptions of the individual benefits of a cleaner and better environment, marketers should promote responsible consumption in tandem with government policymakers. Among the galaxy of scholars, Swami Vivekananda stands out as a majestic tower of light who has given a new tempo to the building up of a new sense of nationalism in modern India. The uniqueness of Vivekananda was his endeavour to translate every ounce of Vedanta into a social living and was never a cold theoretician or an abstract metaphysician. He was aware that India's life is governed by her sovereign sense of the inclusiveness which nourished her national life (...) and India has been a spiritual strength for her people, implanting the seeds that have continuously sprouted in her art, literature, religion, philosophy, science and politics. It is a civilization that should be seen, not as a closed system or as a product, but as a dynamic and unfolding process. Whatever the differences, India's spiritual heritage should be recognized as the focal point and to be appropriated in the conception of a new resurgent India. Regrettably, what we had been glorifying as the central value of this culture and civilization is disorientated today due to the brutal exhibition of barbarous instincts which were exhibited through the rivalry between religious groups. What is being experienced is the loss of inherited values and our inability in reinventing new values. By virtue of its characteristic pluralism and its continuously evolving synthesis, India represents a nation which is continuously unfolding its civilizational potentialities. In making of such an Indian ethos, the foundational ideal which has been the basis of Indian culture and civilization is the concept of Dharma and Vivekananda was able to comprehend and articulate the relation between morality and human affairs which are the concerns of practical Vedanta. This study provides evidence on the governance of CSR policies and activities by Indian central government-owned companies [i.e. Central Public Sector Enterprises ] within a unique mandatory regulatory setting. We utilise the multi-level ‘Logic of governance’ conceptual framework and draw upon interview data collected from 25 senior managers in 21 CPSEs to assess the dynamics of CSR implementation within CPSEs. Our findings indicate most managers believe that a mandatory policy has enhanced the accountability and commitment of governing boards and (...) senior management to CSR. However, CSR policy implementation within Indian CPSEs is still nascent, fraught with bureaucratic hurdles, insufficient human and knowledge resources, limited stakeholder analysis and over-emphasis on CSR budget utilisation as an outcome. Several key areas for improvements include the need for better translation of national CSR policy goals to firm-level strategies, more formal assessment of stakeholder needs, clearer communication lines with external service providers, such as NGOs and local government agencies, and the better evaluation of CSR outcomes. Since the 1990s, the relation between liberalism and colonialism has been one of the most important issues in Locke studies and also in the field of modern political thought. This present work is a unique contribution to discussion of this issue in that it elucidates Lockeâ (TM)s concept of the law of nature and his view of war. Lockeâ (TM)s law of nature includes, despite its ostensible universal validity, some particular rules which favour the rights of a European form of (...) political society and individualistic land-acquisition at the sacrifice of native traditional land-rights and subsistence. Concerning wars between settlers and the natives, Lockeâ (TM)s concept of â oepunishmentâ in state of nature allows the militarily superior side to make a war with the inferior in disregard for the latterâ (TM)s claim and nevertheless, after winning victory, proclaim its own just cause of war. By putting Lockeâ (TM)s discourse on colonization and war in the context of contemporary relations between English colonists and the natives, this book makes clear that the expansive element of his theory of property actually overbalanced his rule of limitation of property according to equitableness and that it, after all, undermines the general principles of freedom and equality of all in his law of nature. How Propaganda Became Public Relations pulls back the curtain on propaganda: how it was born, how it works, and how it has masked the bulk of its operations by rebranding itself as public relations. Cory Wimberly uses archival materials and wide variety of sources — Foucault’s work on governmentality, political economy, liberalism, mass psychology, and history — to mount a genealogical challenge to two commonplaces about propaganda. First, modern propaganda did not originate in the state and was never (...) primarily located in the state; instead, it began and flourished as a for-profit service for businesses. Further, propaganda is not focused on public beliefs and does not operate mainly through lies and deceit; propaganda is an apparatus of government that aims to create the publics that will freely undertake the conduct its clients’ desire. Businesses have used propaganda since the early twentieth century to construct the laboring, consuming, and voting publics that they needed to secure and grow their operations. Over that time, corporations have become the most numerous and well-funded apparatuses of government in the West, operating privately and without democratic accountability. Wimberly explains why liberal strategies of resistance have failed and a new focus on creating mass subjectivity through democratic means is essential to countering propaganda. This book offers a sophisticated analysis that will be of interest to scholars and advanced students working in social and political philosophy, Continental philosophy, political communication, the history of capitalism, and the history of public relations. Description: Ancient Indian logic by itself is a very vast subject. The ancient Sanskrit term nyaya which was first used in a different or in a much more general sense, was later specifically applied to the Nyaya school. The physics and physiology and psychology of the Nyaya doctrine are not specifically its own, being from the first indistinguishable from those of its sister Sastra, the Vaisesika. What characterizes it specifically is the development of the nyaya or five-membered method of demonstration (...) and its insistence on the four sources of knowledge, corresponding to the first four members of its demonstrative formula, or 'Syllogism.' The importance of Nyaya is in its doctrine of the pramanas, or sources of proof, and in its formulation of the nyaya, or method of demonstration. Indian Logic in its Early Schools by H.N. Randle is an interpretation of Indian logical theory in its historical development based on the study of original texts wherever reference to Nyaya as a method of logic has been made, and thus, covers a very wide field of Indian philosophy. An effect is typically explained by citing a cause, but not any cause will do. The oxygen and the spark were both causes of the fire, but normally only the spark explains it. What then distinguishes explanatory from unexplanatory causes? One might attempt to characterise this distinction in terms of intrinsic features of the causes. For example, some causes are changes while others are standing conditions, and one might claim that only the changes explain. Both the spark and the oxygen (...) are causes of the fire, but only the spark is a change, and perhaps this is the reason only the spark explains. On the other hand, one might attempt to characterise the distinction between explanatory and unexplanatory causes in terms of the relation between cause and effect. For example, only some causes are sufficient for their effects, and perhaps only sufficient causes explain. There is, however, an elementary feature of the distinction between explanatory and unexplanatory causes that neither an intrinsic nor a relational approach are well-suited to capture. This is the so-called `interest-relativity' of explanation: the very same cause may be explanatory for one person but not for another. When there is a famine in India, an Indian peasant may explain this by citing the drought, while a member of the World Health Organization may instead cite the failure of the Indian government to stock adequate reserves of food (Hart and Honore, 1985, pp. (shrink)

Major changes in the governance of higher education and the public sciences have taken place over the past 40 or so years in many OECD countries. These have affected the nature of authority relationships governing research priorities and the evaluation of results. In particular, the increasing exogeneity, formalisation and substantive nature of governance mechanisms, as well as the strength and extent of their enforcement, have altered the relative authority of different groups and organisations over research priorities and evaluations, as well (...) as creating some new ones. These shifts in authority have occurred to different degrees in differently organised public science systems. As a result, the diversity and longevity of many research projects, the intensity of competition for disciplinary reputations and the coordination of research goals and outcomes across universities and national boundaries have changed to different degrees in different countries. This paper examines the relationships between corporate governance and corporate sustainability by focusing on two main components of companies’ governance structure: boards of directors and investor relations officers. We propose an original empirical strategy based on the 120 biggest French capitalizations for the year 2013, allowing us to measure boards of directors’ independence and expertise, as well as investor relations officers’ convictions and communication on corporate sustainability. Our results show that corporate governance has an ambiguous impact on corporate (...) sustainability because of opposing forces: internal, external and intermediate forces. On the one hand, the higher the proportion of inside directors, the higher the company’s environmental and governance performance, while the higher the proportion of general experts in the board room, the lower the company’s governance performance. On the other hand, investor relations officers’ beliefs that corporate sustainability is primarily driven by investors’ ethical values appear negatively related to companies’ governance performance. In sum, corporate sustainability appears positively related to internal forces and negatively related to external forces. The results of this study demonstrate the need to carry out efforts to train BoDs and IROs to respond to corporate sustainability and to take more of a leadership role in this area. (shrink)

The present study investigates the interrelationship of corporate governance parameters like board independence and corporate board meetings. The other important control variables like age, leverage, firm's liquidity and size of the firm have been employed to analyse the alliance between corporate governance, vertical agency cost and performance of the firm. The study considers data corresponding to a panel of 76 non-financial firms during 2010-2019 listed in the National Stock Exchange, India. The study tries to empirically evaluate the association between corporate (...) governance parameters and performance of the firm. By selecting the static panel data regression, researchers found no significant impact of corporate board meeting and board independence on firm performance. The study also documents a positive and significant relationship between board independence and asset utilisation ratio. Further, corporate board meetings have a negative relationship with vertical agency crisis. (shrink)

In this introductory article we explore the relationship between statehood and governance, examining in more detail how non-state actors like MNCs, international NGOs, and indigenous authorities, often under conditions of extreme economic scarcity, ethnic diversity, social inequality and violence, take part in the making of rules and the provision of collective goods. Conceptually, we focus on the literature on Areas of Limited Statehood and discuss its usefulness in exploring how business-society relations are governed in the global South, and beyond. (...) Building on insights from this literature, among others, the four articles included in this special issue provide rich illustrations and critical reflections on the multiple, complex and often ambiguous roles of state and non-state actors operating in contemporary Syria, Nigeria, India and Palestine, with implications for conventional understandings of CSR, stakeholders, and related conceptualizations. Civil society organizations attempt to induce corporations to behave in more socially responsible ways, with a view to raising labour standards. A broader way of conceptualizing their efforts to influence the policies and practices of employers is desirable, one centred upon the concept of civil governance. This recognizes that CSOs not only attempt to shape the behaviour of employers through the forging of direct, collaborative relationships, but also try to do so indirectly, with interactions of various kinds with the state (...) being integral. Drawing on evidence derived from UK-based CSOs involved in work and employment relations, four types of civil governance are identified and characterized. By elaborating the concept of civil governance, and demonstrating how different types of civil governance operate, the research extends our knowledge and understanding of how CSOs, as increasingly prominent actors in the field of work and employment relations, operate within, and contribute to, systems of labour governance. Corporate governance involves balancing the interests of the many stakeholders in a corporation—from shareholders and management to customers and the larger society. Corporate governance also offers the framework for attaining a company’s vision and mission, providing guidance and oversight on a broad spectrum—action plans and internal controls to performance measurement and corporate disclosure. Companies’ Act 2013 has been introduced in India with the primary objective of improving corporate governance practices in Indian corporations. In this paper, we investigate the moderating role (...) of corporate governance practices in large Indian corporations on firm performance, post introduction of Companies’ Act 2013. Specifically, we study the influence of board’s involvement in company’s affairs, board’s diversity, CEO duality, board compensation, and promoters’ involvement in the board. We find sufficient evidence that board involvement and board diversity positively influence firm performance, while CEO duality, board compensation, and promoters’ presence do not have an influence on firm performance. Background Comprehensive commercial surrogacy became legal in India in 2002, and many foreigners, including individuals and same-sex couples, sought Indian surrogacy services due to their affordability. Numerous scandals resulted, with increasing calls for the government to eliminate the exploitation of women in lower social strata. In 2015, the Indian government decided to exclude foreign clients and commercial surrogacy remained legal for local Indian couples only. Furthermore, to eliminate exploitation, the concept of altruistic surrogacy was introduced in 2016. In (...) 2020, some restrictions within altruistic surrogacy practice were removed. Controversy remains, however, in various sectors, not least because surrogacy is a relatively new concept in India. In this paper, the advantages and disadvantages of both altruistic and commercial surrogacy in the Indian context are considered, and more appropriate policy concerning surrogacy practices is suggested. Methods This paper is based on fieldwork conducted in India from 2010 to 2018. Interview surveys were conducted among doctors, policy makers, activists, former surrogates, and brokers. Government documents and media reports were also important sources. Results Surrogacy for commercial purposes began in India in 2002, and stakeholders within the commercial surrogacy industry became well established. It was found that such stakeholders were strongly opposed to altruistic surrogacy as introduced in 2016. It was also found that women in lower social strata still sought some form of financial compensation from their reproductive labor. Controversies surrounding altruistic surrogacy continue within Indian society. Conclusion Policies and practices aimed at eliminating exploitive need to consider the Indian context carefully. Any surrogacy practice might potentially be exploitive, and the distinction between commercial and altruistic surrogacy is too simplistic to be useful, with more nuanced understanding required. It is of critical importance that investigation continues on how to eliminate the exploitation of Indian surrogate mothers throughout the process, regardless of monetary compensation. The entire surrogacy process should be managed with sensitivity, particularly in relation to the well-being of the mother and child. (shrink)

This article empirically examines how the performance of Indian manufacturing corporations is affected by corporate governance practices. The study has used panel data comprising of 76 manufacturing companies listed in BSE, for a consecutive six-year period, from 2015-2016 to 2020-2021. The study has applied panel data regression model to enquire the impact of ownership structure variables; and also board composition variables on firm performance using Tobin's Q and ROA. The findings reveal that ownership structure variables, board size and multiplicity of (...) the board positively affect both ROA and Tobin's Q. While independent board and women director show positive effect on Tobin's Q, the CEO-duality is negatively associated with Tobin's Q. The study suggests policymakers to enhance the multiplicity of directors and gender diversity, to maintain the right proportion of board independency, and to increase the size of board.
