들뢰즈와 아감벤은 철학의 영역에서 법을 사유하는 중요한 현대적 이론들을 제공하는 철학자들이다. 들뢰즈의 법에 대한 연구는 그 자신의 시간론과 밀접한 관계를 맺고 있다는 점에 그 특징이 있으며, 아감벤의 법에 대한 연구는 자신의 철학의 핵심 개념인 배제-포함 구조를 통해서 사유한다는 점에 그 특징이 있다. 그런데 두 사람은 모두 카프카를 경유하여 두 사람의 핵심적인 문제의식으로 나아간다. 먼저 들뢰즈는 카프카의 「법 앞에서」에서 우리에게 인식될 수 있도록 그 내용이 주어져 있지 않은 법이 우리에게 처벌을 내림으로써만 언표된다는 것을 읽어낸다. 더 나아가 『소송』에서 K에게 완전한 무죄판결이란 없으며 (...) 오직 판결을 ‘지연’시키는 방법만이 있을 수 있다고 말하는 화가 티토렐리에 주목하면서, 법과 시간의 문제를 탐구한다. 아감벤은 데리다의 「법 앞에서」에 대한 해석을 경유하여 카프카에 접근한다. 데리다는 열린 문 앞에서 들어가는 것이 ‘가능하지만 지금은 안 되는’ 바로 이 상황이 우리를 둘러 싼 법과 우리의 관계라는 점에 주목한 바 있다. 법에 대한 접근 가능성은 ‘지금은 안 된다’는 방식으로 무한히 지연된다는 것이다. 아감벤 역시 이러한 들어갈 수 있는 자유가 있음에도 불구하고 들어갈 수 없는, 그래서 자유롭지도 자유롭지 않지도 않은 법과 우리의 관계를 배제-포함 구조로 설명한다. 그렇기 때문에 아감벤의 카프카 읽기는 법이 그 내용이 주어져 있지 않음에도 우리를 강제하고 있음을 의미한다는 들뢰즈의 사유와 만나게 된다. 이 연구는 들뢰즈와 아감벤의 법 해석을 함께 탐구함으로써, 두 사람이 말하는 법의 강제로부터 우리를 해방시키는 방법과 그 의의를 밝혀본다. Import-Export says that a conditional 'If p, if q, r' is always equivalent to the conditional 'If p and q, r'. I argue that Import-Export does not sit well with a classical approach to conjunction: given some plausible and widely accepted principles about conditionals, Import-Export together with classical conjunction leads to absurd consequences. My main goal is to draw out these surprising connections. In concluding I argue that the right response is to reject Import-Export and adopt instead a limited version (...) which better fits natural language data; accounts for all the intuitions that motivate Import-Export in the first place; and fits better with a classical conjunction. Contemporary regulation of food safety incorporates principles of quality management and systemic performance objectives that used to characterize private standards. Conversely, private standards are covering ground that used to be the realm of regulation. The nature of the two is becoming increasingly indistinguishable. The case study of the Ugandan fish export industry highlights how management methods borrowed from private standards can be applied to public regulation to achieve seemingly conflicting objectives. In the late 1990s, the EU imposed repeated bans on (...) fish imported from Uganda on the basis of food safety concerns. However, the EU did not provide scientific proof that the fish were actually “unsafe.” Rather, the poor performance of Uganda’s regulatory and monitoring system was used as justification. Only by fixing “the system” and performing the ritual of laboratory testing for all consignments for export to the EU did the Ugandan industry regain its status as a “safe” source of fish. Yet, gaps and inconsistencies abound in the current Ugandan fish safety management system. Some operations are by necessity carried out as “rituals of verification.” Given the importance of microbiological tests and laboratories in the compliance system, “alchemic rituals” provide an appropriate metaphor. These rituals are part and parcel of a model that reassures the EU fish-eating public that all is under control in Uganda from boat to point of export. As a consequence, actual non-compliance from boat to landing site allows the fishery to survive as an artisanal operation. (shrink)

Besides 11 revised full papers, selected from the 24 submissions to the OCS workshop held in conjunction with the First International Conference on Principles and Practice of Constraint Programming, CP '95, held in Marseilles in September 1995, the book includes three comprehensive background papers of central importance for the workshop papers and the whole field. Also included is an introduction by (...) one of the volume editors together with a bibliography listing 243 entries. The Identity principle says that conditionals with the form 'If p, then p' are logical truths. Identity is overwhelmingly plausible, and has rarely been explicitly challenged. But a wide range of conditionals nonetheless invalidate it. I explain the problem, and argue that the culprit is the principle known as Import-Export, which we must thus reject. I then explore how we can reject Import-Export in a way that still makes sense of the intuitions that support it, arguing that the (...) differences between indicative and subjunctive conditionals play a key role in solving this puzzle. Secretion systems enable bacteria to import and secrete large macromolecules including DNA and proteins. While most components of these systems have been identified, the molecular mechanisms of macromolecular transport remain poorly understood. Recent findings suggest that various bacterial secretion systems make use of the translocation ratchet mechanism for transporting polymers across the cell envelope. Translocation ratchets are powered by chemical potential differences generated by concentration gradients of ions or molecules that are specific to the respective secretion systems. Bacteria employ these (...) potential differences for biasing Brownian motion of the macromolecules within the conduits of the secretion systems. Candidates for this mechanism include DNA import by the type II secretion/type IV pilus system, DNA export by the type IV secretion system, and protein export by the type I secretion system. Here, we propose that these three secretion systems employ different molecular implementations of the translocation ratchet mechanism. Brownian ratchets are often discussed in the context of directed molecular movement. Bacterial secretion systems transport molecules through membranes in a directed fashion. Here, we focus on recent experiments supporting a role of translocation ratchets in the secretion and import of proteins and DNA. (shrink)

We define a model for computing probabilities of right-nested conditionals in terms of graphs representing Markov chains. This is an extension of the model for simple conditionals from Wójtowicz and Wójtowicz. The model makes it possible to give a formal yet simple description of different interpretations of right-nested conditionals and to compute their probabilities in a mathematically rigorous way. In this study we focus on the problem of the probabilities of conditionals; we do not discuss questions concerning logical and metalogical (...) issues such as setting up an axiomatic framework, inference rules, defining semantics, proving completeness, soundness etc. Our theory is motivated by the possible-worlds approach ; however, our model is generally more flexible. In the paper we focus on right-nested conditionals, discussing them in detail. The graph model makes it possible to account in a unified way for both shallow and deep interpretations of right-nested conditionals. In particular, we discuss the status of the Import-Export Principle and PCCP. We briefly discuss some methodological constraints on admissible models and analyze our model with respect to them. The study also illustrates the general problem of finding formal explications of philosophically important notions and applying mathematical methods in analyzing philosophical issues. (shrink)

We analyze selected iterated conditionals in the framework of conditional random quantities. We point out that it is instructive to examine Lewis's triviality result, which shows the conditions a conditional must satisfy for its probability to be the conditional probability. In our approach, however, we avoid triviality because the import-export principle is invalid. We then analyze an example of reasoning under partial knowledge where, given a conditional if A then Cas information, the probability of A should intuitively increase. We (...) explain this intuition by making some implicit background information explicit. We consider several iterated conditionals, which allow us to formalize different kinds of latent information. We verify that for these iterated conditionals the prevision is greater than or equal to the probability of A. We also investigate the lower and upper bounds of the Affirmation of the Consequent inference. We conclude our study with some remarks on the supposed "independence" of two conditionals, and we interpret this property as uncorrelation between two random quantities. 2020 Elsevier Inc. In this paper we consider conditional random quantities (c.r.q.’s) in the setting of coherence. Based on betting scheme, a c.r.q. X|H is not looked at as a restriction but, in a more extended way, as \({XH + \mathbb{P}(X|H)H^c}\) ; in particular (the indicator of) a conditional event E|H is looked at as EH + P(E|H)H c . This extended notion of c.r.q. allows algebraic developments among c.r.q.’s even if the conditioning events are different; then, for instance, we can give a (...) meaning to the sum X|H + Y|K and we can define the iterated c.r.q. (X|H)|K. We analyze the conjunction of two conditional events, introduced by the authors in a recent work, in the setting of coherence. We show that the conjoined conditional is a conditional random quantity, which may be a conditional event when there are logical dependencies. Moreover, we introduce the negation of the conjunction and by applying De Morgan’s Law we obtain the disjoined conditional. Finally, we give the lower and upper bounds for the conjunction and disjunction of two conditional events, by showing that the usual probabilistic properties continue to hold. (shrink)

Inquiry into the meaning of logical terms in natural language (‘and’, ‘or’, ‘not’, ‘if’) has generally proceeded along two dimensions. On the one hand, semantic theories aim to predict native speaker intuitions about the natural language sentences involving those logical terms. On the other hand, logical theories explore the formal properties of the translations of those terms into formal languages. Sometimes, these two lines of inquiry appear to be in tension: for instance, our best logical investigation into conditional connectives may (...) show that there is no conditional operator that has all the properties native speaker intuitions suggest if has. Indicative conditionals have famously been the source of one such tension, ever since the triviality proofs of both Lewis (1976) and Gibbard (1981) established conclusions which are in prima facie tension with ordinary judgments about natural language indicative conditionals. In a recent series of papers, Branden Fitelson has strengthened both triviality results (Fitelson 2013, 2015, 2016), revealing a common culprit: a logical schema known as IMPORT-EXPORT. Fitelson’s results focus the tension between the logical results and ordinary judgments, since IMPORT-EXPORT seems to be supported by intuitions about natural language. In this paper, we argue that the intuitions which have been taken to support IMPORT-EXPORT are really evidence for a closely related, but subtly different, principle. We show that the two principles are independent by showing how, given a standard assumption about the conditional operator in the formal language in which IMPORT-EXPORT is stated, many existing theories of indicative conditionals validate one, but not the other. Moreover, we argue that once we clearly distinguish these principles, we can use propositional anaphora to show that IMPORT-EXPORT is in fact not valid for natural language indicative conditionals (given this assumption about the formal conditional operator). This gives us a principled and independently motivated way of rejecting a crucial premise in many triviality results, while still making sense of the speaker intuitions which appeared to motivate that premise. We suggest that this strategy has broad application and an important lesson: in theorizing about the logic of natural language, we must pay careful attention to the translation between the formal languages in which logical results are typically proved, and natural languages which are the subject matter of semantic theory. In a recent pair of publications, Richard Bradley has offered two novel no-go theorems involving the principle of Preservation for conditionals, which guarantees that one’s prior conditional beliefs will exhibit a certain degree of inertia in the face of a change in one’s non-conditional beliefs. We first note that Bradley’s original discussions of these results—in which he finds motivation for rejecting Preservation, first in a principle of Commutativity, then in a doxastic analogue of the rule of modus ponens (...) —are problematic in a significant number of respects. We then turn to a recent U-turn on his part, in which he winds up rescinding his commitment to modus ponens, on the grounds of a tension with the rule of Import-Export for conditionals. Here we offer an important positive contribution to the literature, settling the following crucial question that Bradley leaves unanswered: assuming that one gives up on full-blown modus ponens on the grounds of its incompatibility with Import-Export, what weakened version of the principle should one be settling for instead? Our discussion of the issue turns out to unearth an interesting connection between epistemic undermining and the apparent failures of modus ponens in McGee’s famous counterexamples. (shrink)

When genetically modified (GM) imported corn was found growing in Oaxaca and the Tehuacán Valley of Puebla, Mexico (2000–2002), it intensified the debate between activists, academics, and government officials about the effects of trade liberalization on Mexican corn farmers and maize biodiversity. In order to understand the challenges faced by corn farmers and in situ diversity, it is important to contextualize GM corn within the recent neoliberal corn regime and its regional manifestations. This essay offers a case study of how (...) indigenous corn farmers from the southern Tehuacán Valley have adapted to such neoliberal reforms and economic crisis by combining local corn production with US-bound labor migration. Global Prescriptions scrutinizes the movement to export a U.S.-oriented version of the " rule of law," found in the activities of philanthropic foundations, the World Bank, the U.S. Agency for International Development, and several other developmental organizations. Yves Dezalay and Bryant G. Garth have brought together a group of scholars from a variety of disciplines--anthropology, economics, history, law, political science, and sociology--to create tools for understanding this movement. In this article I maintain the importance of the Aristotelian concept of prudence or phronesis applied to business ethics, distinguishing its meaning from Solomon and Hartman’s approaches to Aristotelian business ethics. Whereas Solomon stresses the value of perception of particulars and Hartman criticizes the incapacity of Aristotelian phronesis to dwell with the interests of others, I advocate that Aristotelian virtue ethics is important because the concept of phronesis does three things: (a) stresses the rational calculation and general principles or rules (...) in virtue ethics, in general, and business ethics, in particular; (b) provides a communal-based ethics principle; and c) offers us a clear comprehension about what calculation or reasoning is in ethics. The purpose of the research is to develop a new methodological basis for identifying, analyzing and solving problems of international corporations export-import activities and to ground the directions for ensuring their business excellence. The approach originality provides introduction of a conceptual model that aims to eliminate the negative symptoms of international corporations export-import activities based on the results of comprehensive market research, effectiveness of export-import activities and calculation of the integrated indicator of business excellence. The leading corporations of Slovakia and (...) India in the production of bi-axially oriented polypropylene (BOPP) films were the primary basis for this study. The results of the research showed the need to implement a system of managerial innovation for reasoning the directions of ensuring international corporations business excellence. This is achieved because of using logically formalized methods and provides the improvement of organizational and structural interaction of management entities in the process of solving export-import activity problems. Important factors for ensuring business excellence are also the optimization of export and import costs, as well as an increase in export revenue for Slovak companies, and an increase in market share and cost optimization for Indian companies. The practical value of the obtained results is to develop a set of managerial innovations that can improve the efficiency of export-import activities and improve international corporations business. Law is a system of legal rules and legal principles. The distinction between them is a relative one. Always such definite major and minor premises are to be formed that the case can be subsumed under the rule and a conclusion, which includes the decision, can be drawn. This applies to legal principles that are operationalised by legal rules as well as to statutory forms of legal rules, which are often open as to their meaning and/or contain definitions that comprise (...) elements of principles. The basic characteristic of legal principles is that they are value measures directing the definition of legal rules as to their contents, the understanding of the rules, and the manner of their application. Legal principles aim at a goal, have weight, and define the scope of the meaning within which the legal rules move. The operationalisation of legal principles is the _ratio decidendi_ that the court has to achieve in order to be able to decide in a concrete case. Legal principles live through the rules that are the reasons for the decision in a concrete case. New cases can be solved by a new operationalisation of legal principles or by analogous application of precedents if the new cases, in their essential elements, correspond to cases that have already been decided. Philosophers, largely engrossed in their perennial problems, are hardly aware of the fact that, during the last two decades, there has been introduced into physical methodology a principle of utmost philosophical importance, easily rivaling that of relativity and, in some respects, indeed that of causality. Discovered by Pauli in 1925, it immediately elucidated a whole realm of physical facts and was accepted by (...) physicists with wide acclaim. Called the exclusion principle—or Pauli principle, or principle of anti-symmetry—it was embodied in the axiomatics of quantum mechanics; its peculiar methodological significance passed out of view. One of the main goals of multicultural education is to prepare young people to participate in meaningful pedagogical and social issues. To achieve this goal, educators need to cultivate the basic rudiments of compassion and goodwill in the younger generation, rooted in a sense of empathy for others. Without a sense of compassion, the younger generation is unlikely to be motivated to reflect and act on the needs of the people around them. Therefore, it is necessary to start by involving (...) students in getting to know different ethnic cultures, where they can show compassion not only to people, but also to certain situations. Such knowledge forms the basis for interaction with different points of view and worldviews, as well as with the causes of pedagogical, psychological and social problems and the ways taken to solve them. First published in 1903, _Principles of Mathematics_ was Bertrand Russell’s first major work in print. It was this title which saw him begin his ascent towards eminence. In this groundbreaking and important work, Bertrand Russell argues that mathematics and logic are, in fact, identical and what is commonly called mathematics is simply later deductions from logical premises. Highly influential and engaging, this important work led to Russell’s dominance of analytical logic on western philosophy in the twentieth century.

Ruth Tallman has recently offered a defense of the modified youngest first principle of scarce resource allocation [1]. According to Tallman, this principle calls for prioritizing adolescents and young adults between 15–40 years of age. In this article, I argue that Tallman’s defense of the modified youngest first principle is vulnerable to important objections, and that it is thus unsuitable as a basis for allocating resources. Moreover, Tallman makes claims about the badness of death for individuals at (...) different ages, but she lacks an account of the loss involved in dying to support her claims. To fill this gap in Tallman’s account, I propose a view on the badness of death that I call ‘Deprivationism’. I argue that this view explains why death is bad for those who die, and that it has some advantages over Tallman’s complete lives view in the context of scarce resource allocation. Finally, I consider some objections to the relevance of Deprivationism to resource allocation, and offer my responses. (shrink)

The article begins by reconstructing the just distribution of the social bases of self-respect, a principle of justice that is covert in Rawls’s writing. I argue that, for Rawls, justice mandates that each social basis for self-respect be equalized. Curiously, for Rawls, that principle ranks higher than Rawls’s two more famous principles of justice - equal liberty and the difference principle. I then recall Rawls’s well-known confusion between self-respect and another form of self-appraisal, namely, confidence in one’s (...) determinate plans and capacities. Correcting that confusion forces Rawls to accept objectionable and illiberal politics. Surprisingly, a consistent Rawls must endorse absolute economic equality, deny liberty any priority whatsoever, or sponsor still other illiberal political views - evidence of a flaw in the ethical basis of Rawls’s politics. _This study examines the proposition that exports cause growth in gross domestic product GDP in the economy of Pakistan from 1973 to 2022. The study intends to analyze the export promotion strategy that was adopted by Pakistan's economy in the 1990s. Cointegration test reveals there is a long-run relationship between these two variables. However, causality is proved in both short and long-run from GDP to exports. The Trade openness and export growth both are prolonged association but in case of Pakistan (...) persistent depreciation of PKR could not achieve desired level of export earning which implies that J-Curve theory does not exist in Pakistan. This implies that growth in the domestic production base is vital to expansion in exports. The government or policymakers should give importance to and incentivize various production sectors of an economy so that they can contribute to the expansion of export markets._. (shrink)

The fiscal imbalance between the central and local governments under fiscal centralization may motivate local governments to pass tax burdens on firms. The causal identification of the tax system reform and the sustainable export innovation behavior of firms are of great significance. This study uses the income tax sharing policy of China to examine the impact of fiscal centralization on the sustainable export innovation behavior of firms. We find that this tax reform has significantly inhibited the increase of the export (...) value-added rate of firms, and has an increasing trend with the share ratio between the Central Government and the local government. Moreover, this effect mainly comes from the crowding-out effect of imported intermediate goods on domestic intermediate goods. The tests show that the above conclusions are consistent with the general logic of local governments. When they face greater downward fiscal pressure, they will further pass the tax burden on local firms and force the firms to promote their export performance to expand the tax base. This short-sighted behavior of replacing “quality improvement” with “quantity increase” is an important factor that affects the sustainable export innovation behavior of firms and the climb in the global value chain. Evans has suggested that a subject must be able to discriminate his referent from all other entities in order to be able to do so; what he calls Russell's Principle. Evans' view has few followers, and he has been repeatedly accused of presenting no argument in its favour. In this paper I present what I take to be Evans' argument. I suggest that he has been (...) misinterpreted as introducing Russell's Principle for the purpose of fixing reference. Rather, he introduces it in order to ensure that our conceptual capacities have the functional complexity to allow for objective thought. I suggest that the logical types of our thought are constituted by their inferential potential and argue that, even though singular thought may be possible without the satisfaction of Russell's Principle, singular thought that forms part of an objective world view is not. This article is a response to the public consultation on the draft Code of Practice issued by the Human Tissue Authority on the import and export of human bodies, body parts and tissue. The question is whether the Draft Code and the Human Tissue Act go far enough to prevent the unethical acquisition and movement of human tissue. I conclude that the answer to this question is ‘no’ and go on to demonstrate how the identified deficiencies can be remedied.

Crises come and go, but it is good if, from the perspective of the past, we can point to some positives of the crisis that has just passed. Indeed, in the article we first find a snapshot of the export activity of the Polish economy in recent years, a picture which is positive, despite the very serious crises in the global economy. This picture may not be complete due to the scope of the study, but it shows what is most (...) important in author opinion – our place in the international division of labor over the last 15 years. This place has steadily improved, with particularly spectacular increases in importance observed during the years of the Covid-19 pandemic crisis and after the outbreak of war in Ukraine. The second section of the article presents an analysis of agri-food exports in a broader time frame, dating back to the 2000s. It aims to highlight the rise of agri-food exports as a proportion of GDP and total exports. Equally fascinating is the geographical and commodity structure and the mportance of Polish agri-food imports in the total of those made by selected countries. As a result, an interesting picture of Polish agri-food exports appears to have emerged, allowing positive assessments to be formulated. Quite optimistic prognoses for the future are also noticeable. Despite the immense societal importance of ethically designing artificial intelligence, little research on the public perceptions of ethical artificial intelligence principles exists. This becomes even more striking when considering that ethical artificial intelligence development has the aim to be human-centric and of benefit for the whole society. In this study, we investigate how ethical principles are weighted in comparison to each other. This is especially important, since simultaneously considering ethical principles is not only costly, but sometimes even impossible, as developers (...) must make specific trade-off decisions. In this paper, we give first answers on the relative importance of ethical principles given a specific use case—the use of artificial intelligence in tax fraud detection. The results of a large conjoint survey suggest that, by and large, German respondents evaluate the ethical principles as equally important. However, subsequent cluster analysis shows that different preference models for ethically designed systems exist among the German population. These clusters substantially differ not only in the preferred ethical principles but also in the importance levels of the principles themselves. We further describe how these groups are constituted in terms of sociodemographics as well as opinions on artificial intelligence. Societal implications, as well as design challenges, are discussed. In July 2007, Rwanda became the first country to provide a notification under the WTO General Council Decision 2003 of its intent to import a fixed-dose, triple combination HIV/AIDS drug manufactured by (...) the Canadian generic pharmaceutical manufacturer Apotex, Inc. In September 2007, Apotex was granted the first compulsory licence application under Canada's Access to Medicines Regime. This article considers the convoluted and protracted negotiations between the Government of Rwanda, Apotex and three patent holders, GlaxoSmithKline, Boehringer Ingleheim Canada and Shire BioChemical, Inc. It questions the efficiency of this process. This article considers the review of the Jean Chrétien Pledge to Africa Act 2004 (Canada). It is critical of the refusal of the Conservative Government of Canada to make any amendments to the legislation to improve the cost-effective delivery of essential medicines. This article queries the proposed Hong Kong Amendment to the TRIPS Agreement 1994, given the concerns of the Africa Group. It is submitted that it is undesirable to codify the WTO General Council Decision 2003, given its failure to provide a speedy, efficient and cost-effective delivery of essential medicines.
