BREVE RELATO DE UMA OUTRA EXPERIÊNCIA EDUCACIONAL: O ENSINO JURÍDICO NOS ESTADOS UNIDOS.

The article focuses on the crucial changes that science as an established social institution and an epistemological enterprise is undergoing, the key one is the loss of its monopoly on the production of socially useful knowledge and gradual transformation into something new, which, due to institutional and cultural reasons, we continue to call ‘science’. We suppose that the most appropriate conceptualization of the new phenomenon, which is replacing science as an institution, is “technoscience”, since the technical component in scientific practices (...) has now taken a dominant position and technology production has become more important than fundamental knowledge. Technoscience has at least two sources: 1) capitalization of scientific activity that has led to classical science has been replaced with technoscience developing on first-priority funded applied research; 2) theorization and autonomy of the techno sphere, which have resulted in instrumentalization of all levels of knowledge production as well as in technological / symbolic construction of reality and tangled ontology of technoscientific objects. We discuss both of these sources, with particular attention being paid to such trends as epistemic strategies transformation, modified reality, social sciences and humanities conformation to technoscience norms, and knowledge bearers egalitarianization. A crucial transformation of both science itself and its position in society breaks inevitably a demarcation line that separates scientific knowledge from other types of knowledge while promotes the replacement of scientific theory with discourses. Apparently, in “technoscience” an ethos of its own is being formed, where interaction with the “external environment” (with other social spheres) is crucial. In this context, scientific activity is becoming more and more transepistemic, transinstitutional practice, and accordingly ceases to be guided by the classical scientific ethos determined by the goals and objectives of academic community itself. Autorzy artykułu argumentują, że libertarianie (tacy jak Murray Rothbard, Stephan Kinsella), którzy jednocześnie podpisują się pod zasadą proporcjonalności w obronie własności prywatnej oraz pod poglądem, iż posiadanie prawa własności prywatnej oznacza posiadanie prawa do jej obrony, popadają tym samym w dylemat polegający na tym, iż jeżeli jedynym sposobem obrony prawa własności prywatnej jest jego nieproporcjonalna obrona, to to własności tej - wbrew temu, co ów pogląd głosi - nie towarzyszy prawo do jej obrony. Najlepiej uzasadnionym sposobem wyjścia z tego dylematu (...) jest osłabienie peremptoryjności praw własności prywatnej, czyli skonceptualizowanie tychże praw jako absolutnych jedynie w słabym sensie tego słowa (korzystając z dystynkcji zaproponowanej przez Matthew H. Kramera). Z kolei libertarianie, którzy tak jak Walter Block chcieliby wybrnąć z rzeczonego dylematu poprzez zastąpienie zasady proporcjonalności zasadą delikatności, popadają w innego rodzaju problemy (nieintuicyjność moralną czy ogólną niekoherencję), co jest tylko kolejnym argumentem na rzecz tezy, iż osłabienie wymogów praw własności prywatnej jest najlepiej uzasadnionym sposobem przezwyciężenia rozważanego tu dylematu. In “Evictionism and Libertarianism,” published in this journal, Walter Block defends the view that, although the fetus is a human being with all the rights to its body, it may nonetheless be evicted from the woman’s body as a trespasser, provided the pregnancy is unwanted. We argue that this view is untenable: the statement that the unwanted fetus is a trespasser does not follow from the premises that the fetus uninvitedly resides in the woman’s body and that the woman is (...) a full self-owner. For this statement to follow, one more statement would have to be true; namely, the woman would have to hold her self-ownership rights specifically against the fetus, and for this to be the case, the fetus would have to have a correlative duty to the woman to abstain from interfering with her body. The availability of free health care to all citizens has been regarded as a great achievement of the Soviet society. In recent decades, however, decreased funding of the state-run health care system has led to a deterioration in the quality and quantity of available medical equipment and services. More than 50 percent of the Russian population is dissatisfied with the health care system and the attitudes and moral standards of their health care providers. This paper summarizes the discussion on technoscience and its key question whether the phenomenon indicated by this term means a radical transformation of science and its replacement with some new social objectification. Based on the remarks of the discussion participants, we raise questions on mathematical rationality contribution in technoscience development, technical (magical) domination on nature (environment) and man as the leitmotif of the New European culture and the connection of techno-science, financial capital and liberal capitalism.

The article examines the content and process of forming the principles of a customer-oriented approach to the management of transport enterprises in the context of sustainable development. The author's definition of the concept of “principles of a customer-oriented approach to the management of transport enterprises” is given on the basis of its understanding as strategic and tactical areas of activity aimed at maximizing the satisfaction of customers' needs and expectations through the use of digital technologies and innovative approaches. The key (...) principles of a customer-oriented approach to managing transport enterprises in the context of sustainable development are developed, among which the following are highlighted: understanding customer needs; personalization of service; interaction at all stages; digital transformation of processes; data analysis and forecasting; creation of a digital environment; training and development of personnel; culture of service and open communication; continuous analysis and improvement; focus on the sustainability of relations, etc. The author's own model of digital transformation of transport enterprises using the principles of a customer-oriented approach is proposed. The paper discusses the peculiarities of the analytic approach to the history of Ancient philosophy in the context of other, more popular approaches and genres. This approach is based on finding out an implicit argumentation and problems in the philosophical texts, and establishing logical connections between them. The paper also considers the perspectives of application of this approach to patristic texts. In addition, it shows the necessity of formalization and symbolization in the analytic history of philosophy.

This is a broad and ambitious study of the entire history of humanity which takes as its point of departure Marx's theory of social evolution. However, Professor Diakonoff's theory of world history differs from Marx's in a number of ways. Firstly he has expanded Marx's five stages of development to eight. Secondly he denies that social evolution necessarily implies progress and shows how 'each progress is simultaneously a regress', and thirdly he demonstrates that the transition from one stage to another (...) is not necessarily marked by social conflict and that sometimes this is achieved peacefully and gracefully. As the book moves through these various stages, the reader is drawn into a remarkable and thought-provoking study of the process of the history of the human race which focuses on the wide range of factors (economic, social, military-technological, and socio-pyschological) which have influenced our development from palaeolithic times to the present day. Aim. Disclosure of the theoretical and spiritual-practical potential of the philosophy of management in training specialists in the field of public management and administration. Methodology. In the research process there were used such methods as: analysis, synthesis, systemic, comparative, structural-functional and dialectical. The application of the synergistic approach to study management made it possible to consider the latter as a complex and open system. Results. The authors have proved that today the philosophy of management is a theoretical and methodological basis (...) for modern managers’ training. The emphasis is also put on the fact that the philosophy of management is different from the theory of management, since traditional management tries to implement the training program for a single manager, who should independently manage large teams and organizations. The authors are convinced that this statement is utopian nowadays. That is why the philosophy of management should appear as the methodological basis in the new paradigm of training managers of any level. Scientific novelty. For the first time in the scientific discourse, the attempt has been made to establish the status of the philosophy of management as one of the basic and obligatory disciplines in specialists’ training for public and state administration and management. It is proved that the management of any systems becomes effective due to the interaction of three levels, namely: ideological, scientific-methodological and praxeological. The necessity of preparing managers as team members that adequately respond to current social challenges is identified as the main task of modern managerial education. The Practical Value. The research results should set the benchmarks for improving and creating a new system of modern managers’ training, where the manager is not considered as a single leader, but as a member of the team in which everyone is capital. The present paper formulates the principled anarcho-capitalist case against the state and investigates the possible minarchist replies thereto. It identifies three and only three logically available ways of undermining the anarcho-capitalist case and argues that none of them works for minarchism due to the premises from which this theory starts. The sketch of the analysis presented in the paper suggests that minarchist research program falls short of theoretical soundness or even of logical validity.

This article is designed to disclose the meaning of sacrifice as it is depicted in Andrey Tarkovsky’s film The Sacrifice. The film tells about a former classical actor named Alexander who in the face of the nuclear Apocalypse discovers his true calling – saving humanity from imminent destruction. In order to accomplish his calling, he has to sacrifice his “life”, exchanging it for peace that comes about as a reversal of time which happens in response to his prayer to God (...) as well as his intimate encounter with the local witch. The analysis of the film’s narrative imagery is carried out with Jacques Derrida whose essays on gift, name, and language demonstrate the uniqueness of the film maker’s vision of absolute duty and the call of conscience that restores the true faith in the soul of modern man at the time of the ultimate horror. A paper on how to adapt your probabilisitc beliefs when learning a conditional.

We focus here on the intercalary heterochromatin (IH) of Drosophila melanogaster and, in particular, its molecular properties. In the polytene chromosomes of Drosophila, IH is represented by a reproducible set of dense bands scattered along the euchromatic arms. IH contains mainly unique DNA sequences, and shares certain features with other heterochromatin types such as pericentric, telomeric, and PEV‐induced heterochromatin, the inactive mammalian X‐chromosome and the heterochromatized male chromosome set in coccids. These features are transcriptional silencing, chromatin compactness, late DNA replication, (...) underrreplication or elimination in somatic cells, and formation of the heterochromatin state in early embryogenesis. Post‐translational modification of histones and the specific nonhistone protein complexes are shown to participate in the establishment and maintenance of silencing for all heterochromatin types. Many IH regions contain binding sites for HP1 and/or Pc‐G proteins and all the regions are sites of heterochromatin‐associated SuUR protein. Some IH regions are known to contain homeotic genes. Conceptual spaces have become an increasingly popular modeling tool in cognitive psychology. The core idea of the conceptual spaces approach is that concepts can be represented as regions in similarity spaces. While it is generally acknowledged that not every region in such a space represents a natural concept, it is still an open question what distinguishes those regions that represent natural concepts from those that do not. The article introduces substructural epistemic logics of belief supported by evidence. The logics combine normal modal epistemic logics with distributive substructural logics. Pieces of evidence are represented by points in substructural models and availability of evidence is modelled by a function on the point set. The main technical result is a general completeness theorem. Axiomatisations are provided by means of two-sorted Hilbert-style calculi. It is also shown that the framework presents a natural solution to the problem of logical omniscience.

Natural language provides motivation for studying modal backwards-looking operators such as “now”, “then” and “actually” that evaluate their argument formula at some previously considered point instead of the current one. This paper investigates the expressive power over models of both propositional and first-order basic modal language enriched with such operators. Having defined an appropriate notion of bisimulation for first-order modal logic, I show that backwards-looking operators increase its expressive power quite mildly, contrary to beliefs widespread among philosophers of language and (...) formal semanticists. That in turn presents a strong argument for the use of operator-based systems in the semantics of natural language, instead of systems with explicit quantification over worlds and times that have become a de-facto standard for such applications. The popularity of such explicit-quantification systems is shown to be based on the misinterpretation of a claim by Cresswell, which led many philosophers and linguists to assume that introducing “now” and “then” is expressively equivalent to explicitly quantifying over worlds and times. The key focus of this essay is the experience of encountering divine wonder in things. The examination of the divine encounter is staged against the phenomenological backdrop. Specifically, the concept of the divine wonder is taken in its original, Husserlian, definition as Verwunderung and is traced via Levinas and his concept of face (le visage) to the early 20th century Russian philosopher, Pavel Florensky (1882–1943), whose 1922 essay “Iconostasis” approaches divine representation (лuк) in icon painting explicitly and consistently as a (...) phenomenon of wonder. More broadly, by connecting Florensky and his work to the phenomenological project at large, this essay aspires to show that the early 20th century Russian contributions to phenomenological thought go beyond adaptations and simulations of the traditional phenomenological prolegomena toward highly original philosophical encounters. This essay concerns itself with the Lawyer cartoon, a thematic subgenre of the “The New Yorker Magazine” cartoon, which focuses on the legal profession in the US context. An examination of the cultural meaning of this phenomenon is carried out on the strength of ethnography of communication, which discloses the cartoon as a cultural, social and rhetorical artifact. Among the findings of this study are the structural components, functions, and the rules of configuring the Lawyer cartoon toward it becoming a (...) matter of “risibility” as well as a matter of cultural symbolism. By presenting the attorney as an abnormal character with excessive and hypocritical characteristics, the Lawyer cartoon points to the ascriptions of a disrupted self, making the profession appear as fundamentally inauthentic. In this essay, I argue for the continuous influence of Gregory Bateson’s Communicology on the field of family therapy. My argument is based on a re-examination of Bateson’s Palo Alto research period. More specifically, I suggest that family therapy saw its genesis in Bateson’s work on the double bind paradox, which has become the matrix for the family’s communication system approach. In this essay I closely examine the paradox’s structure from two perspectives: systemic and semiotic. I show how several main (...) elements of the problem posed by Bateson translated into various approaches to family therapy thus constituting it as a self-sustaining paradigm. (shrink)

This article opposes a view widely accepted in studies concerning the history of modal logic, according to which (i) the approach of C. I. Lewis towards constructing modern modal logic was purely syntactical (i.e. limited to the construction of axiomatic systems S1-S5 of propositional modal logic), and (ii) the notion of a possible world was incorporated into modern logic and philosophy mainly by authors such as Rudolf Carnap and Saul Kripke. The article presents Lewis' definition of a possible world, and (...) his formulation of the truth-conditions of statements containing strict implication as their main connective in terms of possible worlds. The main question of the article is whether it is possible to consider Lewis' work in this area as an early stage of the development of possible world semantics, and if so, in what sense? The article concludes by answering affirmatively, due to soundness and completeness proofs with respect to S5 using Lewis' semantics. (shrink)

As cognitive enhancement research advances, important ethical questions regarding individual autonomy and freedom are raised. Advocates of cognitive enhancement frequently adopt a procedural approach to autonomy, arguing that enhancers improve an individual’s reasoning capabilities, which are quintessential to being an autonomous agent. On the other hand, critics adopt a more nuanced approach by considering matters of authenticity and self-identity, which go beyond the mere assessment of one’s reasoning capacities. Both positions, nevertheless, require further philosophical scrutiny. In this paper, we investigate (...) the ethics of cognitive enhancement through the lenses of political and philosophical arguments about autonomy and freedom. In so doing, we contend that a substantive, relational account of individual autonomy offers a more holistic understanding of the ethical concerns of cognitive enhancement. (shrink)

Our study explored the relationships between supply chain (SC) members and their local and global stakeholders in achieving sustainability goals based on requisite holistic analysis and system dynamics modeling, which goes beyond the previous attempts to improve SC sustainability. In this research, we first developed a model that addresses the basic holistic treatment of SC sustainability; in a second model of sustainable SC (SSC), we then considered requisite holistic interactions among its stakeholders. We used the theory-based viable system model to (...) diagnose the proposed holistic model of SSC. The results show that especially the low-tier SC members require supporting frameworks to develop and maintain the capacity for sustainable interactions with nature and society. These supportive frameworks should be provided by the regulatory bodies, society, and nature representatives to surpass the limited SC profit-oriented incentives and structures. The implications of the proposed models are aimed at developing supportive SC sustainable policies and improving the capacities of SC members to coexist with local social and natural environments. Regulators, society, and the natural environment representatives can apply the proposed models to establish new policies for sustainable interactions between SC members and other societal stakeholders. We give a negative solution to the problem, posed by A. Chagrov and M. Zakharyaschev, of whether every quasi-normal propositional modal logic can be axiomatized by an independent set of axioms, with the inference rules of Substitution and Modus Ponens.

The paper introduces a new kind of models for the logic of proofs LP, the group justification models. While being an elaboration of Fitting models, the group justification models are a special case of the models of general awareness. Soundness and completeness results of LP with respect to the new semantics are established. The paper also offers an interpretation of the group models, which pertains to awareness and group epistemic dynamics.
