Carl Schmitt, one of the most influential legal and political thinkers of the twentieth century, is known chiefly for his work on international law, sovereignty, and his doctrine of political exception. This book argues that greater prominence should be given to his early work in legal studies. Schmitt himself repeatedly identified as a jurist, and Hugo E. Herrera demonstrates how for Schmitt, law plays a key role as an intermediary between ideal, conceptual theory and the messiness (...) and complexity of practical, concrete situations. Law is concerned precisely with balancing the extremes of theory and reality, and in this respect, Schmitt associates it with philosophical thinking broadly as being able to understand and explain the tensions in human experience. Reviewing and analyzing prevailing interpretations of Schmitt by Jacques Derrida, Heinrich Meier, and others, Herrera argues that the importance of Schmitt's legal framework is both significant and overlooked. RESUMEN En este trabajo intento determinar, a partir de textos escogidos de todas las épocas de la producción teórica de Carl Schmitt, de qué manera este autor entiende la comprensión jurídica y de qué manera este modo de comprensión tiene alcances generales para la comprensión práctica. En la medida en que el derecho tematiza las condiciones y los polos de la comprensión, la posición del jurista se distancia tanto de la inclinación hacia el polo ideal, que Schmitt identifica (...) con la racionalidad tecnológica, cuanto de la inclinación hacia el polo real, que Schmitt liga a ciertas formas del romanticismo y el pensamiento teológico. RESUMO Neste artigo, tento determinar, a partir de textos selecionados de todos os períodos da produção teórica de Carl Schmitt, como esse autor entende a compreensão jurídica e como esse modo de compreensão tem alcance geral para a compreensão prática. Na medida em que o direito estuda as condições e os polos de compreensão, a posição do jurista distancia-se da inclinação para o polo ideal, que Schmitt identifica com a racionalidade tecnológica, bem como da inclinação para o polo real, que Schmitt conecta com certas formas de romantismo e pensamento teológico. According to mostly known interpretations (e.g.: Hofman, Strauss, Löwith or Kuhn), the legal and political thought of Carl Schmitt keeps distance from Aristotle's. This article intends to show that Schmitt's concept of law, despite developed in a different context, holds significant likelihood with Aristotle's comprehension of law. With the Purpose of building this proximity, the notion of entirety present in the Aristotelic concept of polis implies that political unit is the main way to accomplish law. (shrink)

1. Two Approaches to the EarthIn several postwar texts, the earth increasingly receives attention from Carl Schmitt.1 In The Nomos of the Earth, the most important of these texts, he refers to Friedrich Hölderlin, a much earlier, very different author, who also considers the subject of the earth. Even though the positions of both are, ultimately, quite similar, they maintain significant terminological differences. Schmitt and Hölderlin both employ the word “nomos,” but in very different ways. Hölderlin regards “nomos” (...) as “law” in the sense of “positive” norm or “Gesez.”2 This use of “nomos” as “Gesez” differs from a second notion of law as the meaning operating at the basis of what Hölderlin calls the “sphere.” The sphere is a meaningful whole in which man originally exists. Law is here the very relations of the sphere as a meaningful whole. Hölderlin calls it the law in a “negative” sense.3 This second notion of law by Hölderlin (negative law or law as the meaning at the basis of the sphere) coincides precisely with the Schmittian idea of “nomos” as an “order of meaning [Sinnreich],”4 what he also calls the law in an “ontonomous and existential” sense.5 The first use of law as “nomos” or “Gesez” by Hölderlin coincides with Schmitt’s use of “Gesetz”: of law as “positive” law. En el presente trabajo pretendo mostrar que el pensamiento de Carl Schmitt tiene un carácter marcadamente filosófico. Más precisamente: que en la base de él se halla una teoría de la comprensión. Esa teoría de la comprensión tiene la particularidad de que se desarrolla a partir de una teoría de la comprensión jurídica, pero se extiende, en su obra, a la comprensión en general.

Reaktionäres Denken ist wieder in Mode. Aber was ist das eigentlich? Wodurch unterscheidet es sich von anderen Formen des Denkens? Und welche philosophischen Instrumente können gegen dessen erneutes Erstarken wirken? Robert Hugo Ziegler analysiert beispielhaft Autoren wie Jünger, Heidegger, Schmitt und Rand und schlägt einen systematischen Begriff des reaktionären Denkens vor. Damit entmystifiziert er eine Diskursform, die letztlich nur in der eigenen Mystifizierung besteht, und bezieht auch politisch Stellung gegen das Wiederaufleben der Reaktion.

Through a discussion of Hugo Grotius’ conception of just war, this essay shows that within his critique of liberalism, Schmitt clashed with the very intellectual tradition he claimed to represent. Both historically and philosophically Schmitt's concept of the Ius Publicum Europaeum was a mirage. Indeed, his concept of the political was a rejection of the moral and civil philosophy that sees politics as the world of active citizens and commonwealths arguing with each other about fundamental questions of (...) justice and equity. The idea of free trade in Grotius's Mare liberum and his legal opinion De iure praedae has a strong theological basis. Grotius called the right to travel and trade freely a ius sanctissimum, a 'sacrosanct law'. He also perceived the Freedom of the Seas as being a direct result of the will of God. This theological background was strategically necessary because Grotius developed the Mare liberum and the De iure praedae to argue against Spanish-Portuguese claims to a trade monopoly that (...) also had theological underpinnings. But the theological aspect of Grotius's theory was also emphasized by the references he made to the Dominican friar Francisco de Vitoria's ius communicationis. This precursor to Grotius's Freedom of the Seas, which Vitoria had developed in his De indis, is connected to the legal justification of Christian mission and so has a clear theological connotation. In Grotius's work, Vitoria's concept of a universal right to Christian mission supervised by the pope was transformed into a theologically supported right to free trade. With this transformation of the ius communicationis into the principle of the Mare liberum, Grotius develops a theological basis not for politics but for economics. One can speak therefore, following Giorgio Agamben, of an 'economic theology' in regard to Grotius, a term that is, in turn, derived from Carl Schmitt's notion of 'political theology'. (shrink)

Writing in 1935 as "Hugo Fiala," Karl Löwith not only connected Martin Heidegger and Carl Schmitt to an apparently contentless "decisionism" but drew attention to the fact that his correspondent Leo Strauss had attacked Schmitt—like Heidegger an open Nazi since 1933— from the Right in 1932. In opposition to the views of Peter Eli Gordon, Heidegger's bellicose stance at the Davos Hochschule of 1929 is presented as "political" in Schmitt's sense of the term while Strauss's embrace (...) of Heidegger, never regretted, showed that he ceased to be Nietzsche's "Good European" in his thirtieth year. A more significant "change of orientation" is revealed in Strauss's 1932 version of the "second cave," a pseudo-Platonic image of Verjudung . Revelation had disrupted a nihilistic "natural ignorance" that could only be reversed by an elite's secret decision for a self-contradictory content: only an atheistic religion provides a post-liberal solution to "the theological-political problem.". When, if ever, do we wrong ourselves? The Self-Other Symmetric answer is: when we do to ourselves what would wrong a consenting other. The standard objection, which has gone unchallenged for decades, is that Symmetry seems to imply that we wrong ourselves in too many cases—where rights are unwaivable, or “self-consent” is lacking. We argue that Symmetry not only survives these would-be counterexamples; it explains and unifies them. The key to Symmetry is not, as critics have supposed, the bizarre claim (...) that we must literally give ourselves consent if we are to avoid wronging ourselves. Instead, it is that we authorize ourselves simply by making decisions, just as we can authorize others by making decisions jointly. (shrink)

"The king is dead. Long live the king!" In early modern Europe, the king's body was literally sovereign—and the right to rule was immediately transferrable to the next monarch in line upon the king's death. In The Royal Remains, Eric L. Santner argues that the "carnal" dimension of the structures and dynamics of sovereignty hasn't disappeared from politics. Instead, it migrated to a new location—the life of the people—where something royal continues to linger in the way we obsessively track and (...) measure the vicissitudes of our flesh. Santner demonstrates the ways in which democratic societies have continued many of the rituals and practices associated with kingship in displaced, distorted, and usually, unrecognizable forms. He proposes that those strange mental activities Freud first lumped under the category of the unconscious—which often manifest themselves in peculiar physical ways—are really the uncanny second life of these "royal remains," now animated in the body politic of modern neurotic subjects. Pairing Freud with Kafka, Carl Schmitt with Hugo von Hofmannsthal,and Ernst Kantorowicz with Rainer Maria Rilke, Santner generates brilliant readings of multiple texts and traditions of thought en route to reconsidering the sovereign imaginary. Ultimately, The Royal Remains locates much of modernity—from biopolitical controversies to modernist literary experiments—in this transition from subjecthood to secular citizenship. This major new work will make a bold and original contribution to discussions of politics, psychoanalysis, and modern art and literature. (shrink)

The state of the body is central to guiding motivational behaviours. Here we discuss how afferent information from face and viscera influence the processing and communication of emotional states. We highlight (a) the fine-grained impact that facial muscular and patterned visceral responses exert on emotional appraisal and communicative signals; (b) short-term changes in visceral state that bias brain responses to emotive stimuli; (c) the commonality of brain pathways and substrates mediating short- and long-term bodily effects on emotional processes; (d) how (...) topographically distinct representations of different bodily states are coupled to reported feelings associated with subtypes of disgust; and (e) how pupil signals contribute to affective exchange. Integrating these observations enriches our understanding of emotional processes and psychopathology. (shrink)

In 2019, a new national Ethics Review Authority (Etikprövningsmyndigheten, EPM) was created in Sweden. In 2020, Sweden’s Ethical Review of Research Involving Humans Act was revised, tightening this legislation, and increasing penalties for its infraction. This article draws on empirical material generated by artistic research conducted with a norm-critical contemporary music ensemble. Two of the musicians who collaborated with this research identify as disabled. Consequently, in accordance with EPM, my artistic research was subject to mandatory ethics review. Reflecting critically on (...) my own experience of seeking ethical approval for this artistic research project, I show how EPM’s process of ethics review enacts scientific boundary work in Sweden that privileges the interests of academic disciplines that are already well-established. As a corrective to EPM’s scientific boundary work I propose the application of an ethics of care that recognises the complex relationalities that exist between research institutions, researchers and research participants. S’il est vrai que Bentham était un adversaire des doctrines du droit naturel, il ne s’ensuit pas pour autant qu’il appartient au positivisme juridique; et les raisons qui pourraient justifier le (...) classement de Bentham parmi les juspositivistes militent aussi pour son association au jusnaturalisme. The persistence of multiple educational pathways into the nursing profession continues to occupy scholars internationally. In the Netherlands, various groups within the Dutch healthcare sector have tried to differentiate nursing practice on the basis of educational backgrounds for over 50 years. Proponents argue that such reforms are needed to retain bachelor‐trained nurses, improve quality of care and strengthen nurses' position in the sector. Opponents have actively resisted reforms because they would mainly benefit bachelor‐trained nurses and neglect practical experience and technical (...) skills. This historical case study aims to provide insight in this apparent stalemate. Our analysis of this debate is informed by literature on institutional work and current debates within the historiography of nursing. This study contributes to a better understanding of this contemporary debate by examining a broader timeframe than is usually studied, and by highlighting nurses' roles in complex processes of change. We argue that, rather than being stuck in their professional development, different groups of nurses have forged their own path forward in their professional development, albeit via different strategies. Schmitt allots a chapter to each of the main types of theories about truth: pragmatism, coherentism, deflationism, and the correspondence theory. He discusses various arguments for these positions and concludes that only the arguments supporting the correspondence theory are successful. Schmitt's positive case for correspondence makes up the least original part of the book. He explicitly credits Field and remarks that he is mainly concerned with making Field's difficult account more accessible —a task that he discharges honorably..) (...) class='Hi'>Schmitt also offers detailed discussions of about fifteen negative arguments aimed against pragmatism, coherentism, and deflationism. He finds most of them effective, with the result that the correspondence theory emerges as the only tenable account of truth.
