The persistence of multiple educational pathways into the nursing profession continues to occupy scholars internationally. In the Netherlands, various groups within the Dutch healthcare sector have tried to differentiate nursing practice on the basis of educational backgrounds for over 50 years. Proponents argue that such reforms are needed to retain bachelor‐trained nurses, improve quality of care and strengthen nurses' position in the sector. Opponents have actively resisted reforms because they would mainly benefit bachelor‐trained nurses and neglect practical experience and technical (...) skills. This historical case study aims to provide insight in this apparent stalemate. Our analysis of this debate is informed by literature on institutional work and current debates within the historiography of nursing. This study contributes to a better understanding of this contemporary debate by examining a broader timeframe than is usually studied, and by highlighting nurses' roles in complex processes of change. We argue that, rather than being stuck in their professional development, different groups of nurses have forged their own path forward in their professional development, albeit via different strategies. En philosophie du droit, on a coutume d’opposer juspositivisme et jusnaturalisme et de placer Jeremy Bentham dans la première catégorie. Plusieurs auteurs tiennent même Bentham pour le père du juspositivisme. Je prétends pour ma part que cette façon de classer Bentham est inadéquate et nécessite une importante mise au point. S’il est vrai que Bentham était un adversaire des doctrines du droit naturel, il ne s’ensuit pas pour autant qu’il appartient au positivisme juridique; et les raisons qui pourraient justifier le (...) classement de Bentham parmi les juspositivistes militent aussi pour son association au jusnaturalisme. Que faut-il entendre exactement par « positivisme juridique », et en quel sens Bentham y adhère-t-il? C’est à cette double question que le présent article est consacré. (shrink)

This collection of essays examines the ways in which disputes and controversies about the application of scientific knowledge are resolved. Four concrete examples of public controversy are considered in detail: the efficacy of Laetrile, the classification of homosexuality as a disease, the setting of safety standards in the workplace, and the utility of nuclear energy as a source of power. The essays in this volume show that debates about these cases are not confined to matters of empirical fact. Rather, as (...) is seen with most scientific and technical controversies, they focus on and are structured by complex ethical, economic, and political interests. Drs. El artículo presenta aspectos de la confrontación entre el pensamiento religioso y la racionalidad contemporánea, a partir de ideas de pensadores de nuestra época como Horckheimer, Habermas, Savater, y otros, quienes plantean que el presente panorama cultural en el cual la investigación científica y el progreso técnico difunden conocimientos y actitudes secularistas y cientificistas, se aleja de consideraciones éticas esenciales al ser humano. Pero la dimensión religiosa puede aportar criterios éticos para un principio de responsabilidad global frente al mundo y (...) el hombre, ya que esa es y sigue siendo función primaria y aun válida de la religiosidad. Die Fragestellungen der Metaphysik, so scheint es, sind nicht mehr zeitgemäß. Der Begriff erinnert an abgehobene Systeme ohne jeden Realitätssinn. Dabei gibt es kein Denken ohne Metaphysik. Unter Bezugnahme auf die Traditionen der Phänomenologie und der französischen Philosophie versteht Robert Hugo Ziegler Endlichkeit als eine positive Auszeichnung, während der Begriff der Zeitlichkeit die erste Dimension von Sein beschreibt. Sein grundlegender Beitrag zur Reflexion über Mensch und Welt zeigt, wie sich die Philosophie selbstbewusst einer Erneuerung der Metaphysik stellen kann.

This paper is concerned with the question of how the social and economic structure of cities affects the degree of political competition and how in turn these factors affect the degree of a political stability. It isbased on a comparative empirical study of the outcomes of the communal elections of 1952, 1958 and 1964 in 147 Belgian cities that had a population size of 10.000 or more in 1947.In the first place the following generalizations are made with regard to the (...) election outcomes in these cities during the 1952-1964 period. 1. A general proliferation of lists or parties participating in the elections from 1952 to 1964.2. A trend from one-party-control over the college of the city council toward coalition-control.3. A net increase in the number of catholic lists and a net decrease in the number of socialist and liberal lists participating in the colleges of these townships.4. An increase in the number of cities in which newer, smaller and nontraditional parties or lists participated in the college of the city council.Three measures of politica! competitions are employed :1. The average number of parties or lists, that entered the communal election of 1952, 1958 and 1964.2. The average number of lists that received at least ten per cent of the vote in these three elections, and3. The presence or absence of a coalition on the college of the city council in 1952.The two measures of politica! stability, which are also based on the results of the same elections, are :1. The degree of stability in the lists and parties participating in the college of the city council, and2. The degree of stability in the list or party controlling the college of the city council.In general, measures of structural differentiation, linguistic diversity, industrial diversity, and social heterogeneity are found to be positively related to the degree of competition in local politics. In turn, measures of each of these structural factors and the measures of political competition are found to be negatively related to measures of political stability. Regression analysis supports the interpretation that diversity and heterogeneity in the social structure of cities - specifically, population size, density, and the presence of many persons with high occupational status - contribute to greater politica! competition in local polities, but that it is the degree of political competition that most strongly affects the degree of political stability.The conclusion is drawn that cities with a high degree of social and economic heterogeneity have a greater amount of conflict and cleavage. This results in greater competition in the political arena whichin turn predisposes such cities to have a high degree of instability in the control of their city governments. (shrink)

This paper attempts to link the concepts of resistance and tactics present in the work of Michel de Certeau, that of Rodolfo Kusch coined by phagocytosis. The big story, defined by Kusch and bound by us to daily nature, operates as a horizon of understanding.We use for that a tour of some works of the authors, to which we add our own field experience, during our eight years in the foothills town of San Pedro de Atacama.

Wir sind Teil einer Natur, die uns übersteigt - Grund genug, die Natur wieder zum Gegenstand philosophischer Reflexionen zu machen. Durch den Essentialismus-Verdacht schien der Begriff bereits für die Philosophie disqualifiziert. Doch Robert Hugo Ziegler zeigt, gestützt unter anderem auf Lukrez und Spinoza, dass die Natur, sobald man sie ernsthaft ins Auge fasst, alles andere als essentialistisch ist. Er ordnet das philosophische Problem der Natur damit in eine Wiederentdeckung metaphysischer Fragestellungen ein, die er originell vorantreibt - und beweist, dass (...) sich die Philosophie dadurch nicht nur zur bloßen Kommentatorin der Naturwissenschaften machen muss. Con el objeto de dar cuenta de la dinámica del derecho, Alchourrón y Bulygin distinguen los conceptos de sistema jurídico y de orden jurídico. El primero hace referencia a un conjunto de enunciados que contiene todas sus consecuencias deductivas, entre las cuales hay normas cuyo contenido son actos coactivos. Se trata de una entidad estática. El orden jurídico, por su parte, es concebido como una secuencia de sistemas jurídicos enlazados por algún criterio de legalidad o validez, y conserva su identidad (...) a través de los cambios producidos por la sanción o derogación de normas. Es mi propósito presentar argumentos tendientes a sostener que la noción de orden jurídico no es adecuada para los fines que se propone y, además, su postulación, con el sentido que le atribuyen los autores, resulta innecesaria. Aiming to account for the dynamic nature of law, the Argentinian philosophers Carlos Alchourrón and Eugenio Bulygin discriminate the concepts of legal system and legal order. The first makes reference to a set of statements that includes all their deductive consequences, among which there are norms that prescribe coercive acts. It is a static entity. legal order, on the other hand, is conceived as a sequence of legal systems connected by some criterion of legal validity and keeps its identity through the changes produced by the passing or abrogation of laws. The aim of this paper is to present arguments leading to support that the notion of legal order is inadequate for its declared purpose and, furthermore, its conception, with the meaning the authors assign to it, is unnecessary.
