Leo Tolstoy's The Death of Ivan Ilyich might well be read as a narrative outworking of Pascal's observation that "We run heedless into the abyss after putting something in front of us to stop us seeing it."1 That Ivan Ilyich, an ambitious mid-level Russian legal official, plummets into the abyss is incontestable, for the novella opens by announcing his death. What is debated is how he does so: On his deathbed does he merely resign himself to nothingness, or does he (...) undergo some sort of religious conversion? The enlargement of the European Union to include eventually Turkey and the former communist countries is a major challenge for our understanding of the meaning of Europe as a geopolitical, social and cultural space. It is also a question of the identity of Europe as one shaped by social or systemic integration. With the diminishing significance of national borders within the EU, the outer territorial frontier is also losing its significance and Europe will become more and more postwestern. It thus (...) appears that the eastern frontier is more flexible than was previously thought. The EU is now at the decisive point of moving beyond postnationality to a transnational encounter with multiple civilizational forms. Enlargement is not just about getting bigger but is crucially a matter of cultural transformation and therefore it differs from all previous dynamics of Europeanization. Rather than tell the story of Europeanization exclusively as one of national histories and of closure, a civilizational analytic offers the possibility of multiple modernities and thus of a more appropriate theorization of the current situation. Computational dialectics is concerned with the formal representation of argument and dispute. The field emerged from developments in philosophy, artificial intelligence and legal theory. Its goal is to suggestalgorithms, procedures and protocols to investigate the tenability of logical claims, on the basis of information in the form of rules and cases. Currently, the field slowlyconverges to the opinion that dispute is the most fair and effective way to investigate claims. The basic assumption of this field is that dispute is the (...) most fair and effective way to investigate claims. The definition of a formal dispute varies throughout the literature, butis considered not to vary within one and the same logical system. In this paper it is shown that parts of the definition of a dispute may change within one logical system.To this end, the notion of partial protocol specification (PPS) is introduced. A PPS is a part of the definition of the protocol. A modification to the protocol, in the form of a PPS, can be put forward, disputed, established and incorporated as aneffective `point of order. The paper demonstrates the existence of self-undermining PPSs, it discusses the relevance of PPSs for dialectical models of legal argument and concludes with a description of how PPSs can be built into existing argumentation systems. Defeasible reasoning is concerned with the logics of non-deductive argument. As is described in the literature, the study of this type of reasoning is considerably more involved than the study of deductive argument, even so that, in realistic applications, there is often a lack of resources to perform an exhaustive analysis. It follows that, in a theory of defeasible reasoning, the order and direction in which arguments are developed, i.e. theprocedure, is important. The aim of this article is to show (...) that debate is the most efficient procedure to argue in the presence of limited resources. To do so, there is first some general theory on defeasible argumentation, which is followed by an introduction to the problem of dialectical search. The problem of dialectical search is (or at least, should be) the essential issue in every theory on argumentation, and emerges at every occasion that involves adjudication on competing arguments. Starting with an example, it is explained that dialectical search can be best scheduled according to classical debating techniques, that work along well-tried methods. These methods (which include various forms of curtailment, interruption, and interpretation) have proven their value in keeping debating efforts within reasonable bounds. How they apply in a theory of formal argument, will be shown in this article. (shrink)

HauserThe call for papers for this special issue of Philosophy and Rhetoric1 acknowledged the continuous centrality of human agency across the history of Western thought on rhetoric. At its ancient Greek origins, the Sophists and philosophers were at swords points over the question of what constituted responsible speech and who had responsibility for the consequences of moving the demos to public actions that bore on the (...) city-state and the lives of its citizens. On the one hand, sophistic understood the human world as indeterminate, progressing or regressing through appeals that would establish social and political reality for the community through the power of language and argument to move the minds and hearts of citizens. Protagoras expressed this vision with his aphorism, "Man is the measure of all things, of the things that are, that they are, and of the things that are not, that they are not." Central to their understanding of the human world was a recognition and exploration of language's psychogogic powers. For the philosophers, on the other hand, sophistic's position represented a problematic abandonment of the quest for Eternal Truth.The tension between the quest for contingent truth and Eternal Truth is illustrated by Xenophon's rendition of the aftermath of the Athenian naval victory at Arginoussai, in 406 BCE. In his Hellenika,2 he recounts how some of the victorious fleet's sailors became separated from it during the confusion of battle and were left behind. Although the commanders sent a group to rescue them, violent seas thwarted their efforts and the men drowned. Upon returning to Athens as victors, the commanders were arrested and charged with cowardice. The Ecclesia met to decide whether to bind them over for trial. The commanders seemed to have persuaded most of their innocence, but time ran out for that day's proceedings before a vote on whether to bind them over for a trial could be taken. That evening, at a festival in the city, opponents of the commanders attended dressed in [End Page 181] black mourning clothes and pretended to be grieving relatives of the lost sailors. Their displays of sorrow over the sailors' deaths were so convincing that they swung the emotions of many in the opposite direction.The next day, opponents of the commanders played upon the events of the night before and the citizens, remembering the displays of grief they had witnessed, were persuaded to try the commanders themselves, rather than deciding whether to bind them over to the courts for trial. Arguments went back and forth on how to interpret the tragic event—were the commanders brave but foiled by nature, or was their conduct spineless? Did they deserve a laurel wreath for their victory in battle, or to be executed for cowardice in allowing the stranded sailors to drown? Finally a vote was taken and, reversing their sentiment from the day before, the citizens voted to condemn the commanders. The military leaders were taken away to be executed. Soon thereafter, Xenophon tells us, the citizens had a change of heart and wished to reverse their verdict. However, since it was too late—the generals having already been put to death!—they lodged a complaint against those who had persuaded them to convict for "deceiving the People."The story may be read as a representative anecdote of rhetoric's fatal flaw or of rhetoric's constitutive powers of agency. On one reading, Athenian Ecclesiasts, convulsed with emotion, were stripped of their agency by arguments seeking the probable through sensory engagement structured by phantasia and mimesis3 while lacking a foundation in the Eternally True. However, it also may be read as disclosing the absence of Eternal Truth on which to ground a human world, and the agential power of language—of rhetoric—to constitute understanding and action.4 On one side, agency resided in the self-aware person who made responsible arguments with reference to pure reason and ideal justice. In recent years, the relationships between systems of symbolic representations and cities have given rise to an often rich and stimulating consideration among various specialists in human sciences, namely, historians, anthropologists, semiologists and sociologists, among others. Urban conglomerates can no longer be conceived as simple assemblages of more or less functional constructions. The city is as much a mental concept as it is a physical reality. It is made up of images that give it a meaning. It does not exist (...) independently of the sum of subjective interpretations that are continually made by its inhabitants. Our Western perception of the city may be influenced by romanesque literature or the memory of a painting, in other words, by imaginary worlds. It varies according to individual memory: each of us is attached to the different urban spaces of his souvenirs, emotions arising from family history or the duration of a lifetime. These personal projections are all the more important because they command a certain number of daily actions and furnish a framework of orientation to every citizen. They contribute to giving a moral quality to urban space and transform physical objects into concepts, into more or less determined signs. (shrink)

This paper focuses on how the practitioners of the exact and natural sciences can make a contribution to the project of the social sciences to break free of a reductive Eurocentrism in order to achieve a renewed universalism. Focusing in particular on the last 50 years, the paper: a) describes the 1955–60 turning point that can be perceived in techno-scientific development and its relationship with society; b) analyzes technical developments under the two modes of gigantism and miniaturization, putting them in (...) close relation with the political evolution of the world (Cold War and post-Cold War era) as well as with the phenomena of divergence/convergence among disciplines; c) explains the 'ethical movement in science' namely by introducing the idea of moral revaluation defined by similarity/contrast with the older and now well-accepted concept of scientific revolution; and d) sketches a typology of the scientific community's varied responses to the growing social protests around topics such as nuclear installations, health crises, genetically modified organisms, nanotechnologies and so on. For some thirty years, a handful of architects has been trying to call into question the primacy that the history of architecture has given to monumental buildings. The representatives of this trend want to get away from the short chronology, common since the Italian Renaissance, and react against the dominant international functionalism that has too little respect for the local cultural contexts. It is under the influence of this “vernacular” approach that the small traditional structure became as legitimate an object (...) of research as the well-known buildings. This approach, innovative and audacious as it was, broke with a Utopian vision of a large part of modern architecture. It led the architects concerned to turn toward non-European countries and to focus their attention on the connections between indigenous housing patterns and cultures. From this decentralization ethno-architecture was born by which we understand the study of preindustrial, “traditional” habitats and housing. Inspired by Panofsky, Eliade, and Lévi-Strauss and familiar with the social sciences, these researchers appropriated the conceptual tools of anthropology. They opened up important fields of research in Asia, Oceania, the Middle East, and Africa and reaped a rich harvest of ethnographic materials. It quickly became clear to them that the so-called “traditional” house developed, in imitation of palaces and temples, from the culture of a given population and that it was informed by the religious images of the inhabitants as much as by its most sacred buildings. It is a commonplace notion that the issue of human rights is a recent one, an inheritance of the Enlightenment. The teaching of the recent Popes, however, indicates that the issue of human rights is also an inheritance ofChristianity. The article demonstrates that, in fact, the essential structure of the notion of human rights was object of the attention of the earliest Christians, especially when the power of Rome accepted a wide variety of cults for the sake of its calm (...) scepticism, and at the same time opposed the Christian communities precisely because they were Christian. In this way, the concept of human rights found a first formulation regarding the protection of human beings and their dignity, not only in favor of Christians, but on the basis of universal norms founded in the unique Creator of all human beings. He was at the beginning of a career with exceptional promise and whose accomplishments had earned him the National Communication Association's Karl Wallace Award, given to support the research of a scholar within ten years of earning the doctorate. James was just beginning to place his (...) stamp on our book review section. His selection of books reflected his broad command of diverse literatures; his selection of reviewers showed a commitment to bringing fresh and welcome voices into our conversation. James touched the journal in other ways. His essay "Liberal Irony: A Program for Rhetoric" (35:4) was part of an important and ongoing intellectual exchange in P&R. I called on him frequently to review submissions, especially ones that needed a reader with an eye for making a manuscript better. His critiques were models of generosity, even when he disagreed with the author, and his comments, singularly insightful and intelligent, reflected judgment I came to trust. He was invaluable to me as journal editor and as a student of rhetoric.In addition to his work with the journal, I had come to know him as a valued colleague in Colorado's Communication department, a sublimely gifted teacher, an astute mentor of graduate students, a remarkable father, and a loyal and loving friend. In more ways than I dare mention, Jim made the journal better from his association with it and my life happy from the pleasure of his company. James Arnt Aune, who served on the editorial board of Philosophy and Rhetoric, died on 8 January 2013. Jim was an accomplished scholar of the first rank, whose articles, books, and papers reflected broad knowledge and deep insight. He left his mark on the journal through frequent and reliably rigorous reviews that were distinctive for their careful attention to arguments and extensive historical and bibliographic references aimed at improving work, even when he had profound intellectual differences with the author. His (...) comments to the editor often included his own concerns that he may have been too harsh or that his criticisms might be defeating to the author. He was appointed by the journal's founding editor, Henry Johnstone, and Henry regarded him as among the most talented minds writing about our common subject. Tom also was a publishing author in Philosophy and Rhetoric. His research (...) refl ected a deep understanding of the intersections of philosophical thought and rhetoric with respect to argumentation, language, speech acts, and political theory. His award-winning book, Norms of Rhetorical Culture (Yale, 1993), is a testament to the insights afforded by the rapprochement between philosophy and rhetoric that has been the journal's defi ning character. With his passing, the inter-discipline has lost one of its most eloquent and accomplished voices, the journal has lost a contributor and editorial advisor of the first rank, and those of us who knew Tom have lost a dear friend, whose intellect and wit always brightened our moments together.Copyright © 2006 The Pennsylvania State University... Board oversight of community benefit constitutes an ethical imperative for nonprofit health care organizations. By "ethical imperative" we mean a health care organization's duty to fulfill value-based obligations that transcend compliance requirements in order to be consistent with its basic sense of purpose. We consider three points here: the existence of a distinctively ethical imperative for board oversight, the fact that the imperative is organizational in nature, and practical ways to fulfill its obligations. For the contemporary reader of Psychoanalysis: Its Image and Its Public the analyses of communicative systems in the book provides a challenging occasion for reconsidering current social psychological thinking about the character of social groups. In Moscovici's careful delineation of the communicative systems of diffusion, propagation and propaganda through his content analysis of the French press, one can also see the description of different types of group structured through distinctive social psychological organisations. Moscovici himself suggests that the genres of diffusion, (...) propagation and propaganda are each linked to the construction of a specific type of social-psychological object, opinion, attitude and stereotype respectively. But one can also identify different forms of affiliation corresponding to each communicative genre, and consequently also different representations of the people who constitute both the in-group and the out-group in each instance.
