The so-called 'Dutroux-case'- the revelation of the kidnapping and the murder of four underaged girls and the apparent malfunctions of the judiciary and the police forces, was the most important issue on the 1997 political agenda. Unanimously, the Chamber of Representatives agreed upon the recommendations of a parliamentary inquiry into the bungled police investigation. Yet the unanimity disappeared quickly when the recommendations on the reorganisation of the police forces had to be implemented.New revelations of the Dassault-case, and the involvement of (...) both socialist parties, put the government underpressure. The events themselves, and the discontent they caused in some majority parties, urged the government to revise the governmental programme. Guy Spitaels, chairman of the Walloon parliament resigned. Guy Coëme, former minister of Defence, alleged ofpassive corruption in the Dassault-case, was referred to the Supreme Court of Appeal by decision of the Chamber of Representatives. (shrink)

ABSTRACT While a common view in the literature is that Nietzsche cannot successfully argue against Schopenhauer’s pessimism, a detailed explanation of why this is so is lacking. In this paper I provide such a detailed analysis. Specifically, a consideration of three of Nietzsche’s strategies for a revaluation of pain and suffering reveals two problems: the problem of ‘the direction of revaluation’ and the ‘dilemma of the intransigence of hedonism’. According to the first, the success of a revaluation cannot be guaranteed (...) on strictly argumentative grounds and can in principle bring about a revaluation that proceeds in the opposite direction than the one desired. According to the second, Nietzsche’s revaluations are of no significance since they either ground an un-Nietzschean affirmation of life, or they do not engage pessimism’s hedonistic perspective on the basis of which it condemns life. I then examine two strategies that Nietzsche can be seen to employ in his attempts to revalue the hedonistic perspective itself and explain why they too are unsatisfactory. The analysis illuminates the nature of the dialectical stand-off between Nietzsche and Schopenhauer and clarifies the limitations of Nietzschean revaluations as a philosophical tool. (shrink)

_Ressentiment_—the hateful desire for revenge—plays a pivotal role in Nietzsche’s _On the Genealogy of Morals_. _Ressentiment _explains the formation of bad conscience, guilt, asceticism, and, most importantly, it motivates the "slave revolt" that gives rise to Western morality’s values. _Ressentiment_, however, has not enjoyed a thorough treatment in the secondary literature. This book brings it sharply into focus and provides the first detailed examination of Nietzsche’s psychology of _ressentiment_. Unlike other books on the _Genealogy_, it uses _ressentiment_ as a key (...) to the _Genealogy_ and focuses on the intriguing relationship between _ressentiment_ and justice. It shows how _ressentiment_, despite its blindness to justice, gives rise to moral justice—the central target of Nietzsche’s critique. This critique notwithstanding, the _Genealogy_ shows Nietzsche’s enduring commitment to the virtue of _non-moral_ justice: a commitment that grounds his provocative view that moral justice spells the ‘end of justice’. The result provides a novel view of Nietzsche's moral psychology in the _Genealogy_, his critique of morality, and his views on justice. (shrink)

For decisions between many alternatives, the benchmark result is Hick's Law: that response time increases log-linearly with the number of choice alternatives. Even when Hick's Law is observed for response times, divergent results have been observed for error rates—sometimes error rates increase with the number of choice alternatives, and sometimes they are constant. We provide evidence from two experiments that error rates are mostly independent of the number of choice alternatives, unless context effects induce participants to trade speed for accuracy (...) across conditions. Error rate data have previously been used to discriminate between competing theoretical accounts of Hick's Law, and our results question the validity of those conclusions. We show that a previously dismissed optimal observer model might provide a parsimonious account of both response time and error rate data. The model suggests that people approximate Bayesian inference in multi-alternative choice, except for some perceptual limitations. (shrink)

Three observations contribute to this disappointment : a quasi-absence of such a problematic in Thomas Aquinas, contradictions between certain points of the theory as well as between the authors, and incompatibilities with certain central themes of the philosophy of Thomas Aquinas. As is well known, one of the central “existential” goals of Nietzsche’s philosophy was to combat the No-saying attitude to life,1 which he took to be an expression of what he variably called physiological exhaustion, decadence, or sickness.2 This No-saying—which he contrasted with his ideal of life affirmation 3—he supposed to lie at the core of various philosophical and religious views such as Christianity, Buddhism, and Schopenhauerian Pessimism. "What can guilt, the painful sting of the bad conscience, tell us about who we are as human beings? Being Guilty seeks to answer this question through an examination of the views of Kant, Schelling, Schopenhauer, Paul Rée, Nietzsche, and Heidegger on guilt, freedom, responsibility, and conscience. The concept of guilt has not received sufficient attention from scholars of the history of German philosophy. Being Guilty addresses this lacuna and shows how the philosophers' arguments can be more deeply grasped once (...) read in their historical context. A main claim of the book is that this history could be read as proceeding dialectically. Thus, in Kant, Schelling, and Schopenhauer, we find variations on the idea that guilt is justified because the human agent is a free cause of his or her own being-a causa sui-and thus responsible for his or her "ontological guilt." In contrast, in Rée and Nietzsche these ideas are rejected and the conclusion is reached that guilt is not justified, but is explainable psychologically. Finally, in Heidegger we find a synthesis of sorts, where the idea of causa sui is rejected, but ontological guilt is retained and guilt is seen as possible, because for Heidegger a condition of possibility of guilt is that we are ontologically guilty yet not causa sui. ABSTRACT:Nietzsche is mostly known for denying moral responsibility on account of lack of libertarian free will, thus betraying an incompatibilist approach to moral responsibility. In this paper, however, I focus on a different, less familiar argument by Nietzsche, one that I interpret as a critique of a compatibilist conception of moral responsibility. The critique shows why punishment and our moral sanctions in general are morally unjustified by the compatibilist's own lights. In addition, I articulate what I call Nietzsche's explanatory challenge, (...) which challenges the compatibilist to explain the performance of an immoral action without appealing to conditions that would exempt or excuse the wrongdoer or otherwise relieve the wrongdoer from responsibility and would thus make punishing the wrongdoer morally unjustified. By drawing on the work of R. Jay Wallace, I reconstruct Nietzsche's anticompatibilist argument and defend it against four possible objections. (shrink)

Nietzsche often appears, especially in his writings from the middle period, to endorse psychological egoism, namely the claim that all actions are motivated by, and are for the sake of, the agent’s own self-interest. I argue that Nietzsche’s position in Human, All Too Human should not be so understood. Rather, he is claiming, more weakly and more plausibly, that no action is entirely unegoistic, entirely free of egoistic motivations. Thus some actions might be motivated both by egoistic and unegoistic motives, (...) on his view. Nietzsche’s argument may, in other words, be understood to be directed specifically against Schopenhauer’s portrayal of moral motivation, as pure, entirely unalloyed altruism, to show that this sort of action is impossible, not to rule out the possibility of any altruistic motive whatsoever. In light of Schopenahuer’s moral psychology, to which Nietzsche to some extent adhered at that time, I develop a concept of motivation and reconstruct Nietzsche’s argument. (shrink)

An important question in Nietzsche studies is whether Nietzsche has an ethics to offer his readers; whether, that is, he has a concept of the good, or the just, or the virtuous that can serve as some sort of an ethical guide. An additional, methodological question is whether, in search of an answer, one should focus on a specific period in his thinking, study the evolution of his thought, or attempt to extract an over-arching view that draws on texts from (...) different stages of his thinking. The three works reviewed concern themselves with Nietzsche’s ethics by each adopting one of these three approaches, supplying us, accordingly, with different results. (shrink)

The paper provides a critical review of Martin Hägglund's influential Radical Atheism. The paper focuses on what Hägglund calls ‘radical atheism’: the view that according to Derrida ‘the best is the worst’. First, the paper critically examines Hägglund's reconstruction of Derrida's argument for the structure of the trace or ‘the spacing of time’. This analysis clarifies one of the central premises in Hägglund's argument for radical atheism: the ‘contamination’ claim, according to which anything temporal is open as such to the (...) future and is thus alterable in some way. The paper then turns to highlight some of Hägglund's rhetorical slippages that seem to be supported by the contamination claim but actually move beyond what it licenses. Next, the paper focuses critically on the argument for radical atheism and shows how it relies on an unwarranted premise that lies hidden in the discussion of the structure of the trace. Finally, the second central argument that informs Hägglund's work is questioned, that is, the argument for the view that what we are always and already committed to is to live on, that is, survive, so that it is this desire for the mortal that lies behind all our desires. Jeremy Fortier's book is concerned for the most part not with an analysis of Nietzsche's thought as such, but with Nietzsche's autobiographical and metaphilosophical reflections on his own philosophy and the various stages it underwent. With this second dialogue, Salviati wants to remove Simplicio’s difficulties on the actual distinction of essence and being as well as on the notion of the act of being (actus essendi). Feeling that he had skipped stages in their first dialogue, he suggests going back to the determination of the exact subject of metaphysics according to Thomas Aquinas. He will progress in two steps: the transition from «first perceived being» to «common being» or «being as being» by a judgment of (...) separation, and then the definition of the subject of metaphysics as «being negatively or neutrally immaterial». With this conclusion, Salviati intends to lead Simplicio to understand the autonomy of the principles of metaphysics towards philosophy of nature. Simplicio remains curious but dubious. Is not the negatively immaterial being a simple dialectical notion that Salviati would take for a metaphysical one? Is the independence of metaphysics from physics therefore also ensured? We provide the axiomatic underlying individual’s choice model, preliminary experimental results that support the idea, and an appealing allocation rule that uses the revealed desirability information along with the revealed-preference information.

L'Ambitieux Projet du professeur John Rawls dans son important ouvrage intitulé «A Theory of Justice» consiste essentiellement dans l'élaboration d'une théorie de la justice qui prétend offrir une «solution de rechange viable» aux doctrines traditionnelles de la justice représentées par l'utilitarisme, l'intuitionisme, les théories contractuelles, etc …, mais une théorie qui, en méme temps, se présente comme une tentative pour «généraliser et porter a un plus haut niveau d'abstraction la theorie traditionnelle du contrat social telle que representee par Locke, Rousseau (...) et Kant», de telle sorte qu'elle puisse parer aux objections les plus decisives qui ont ete faites a l'endroit de ces diverses formulations de la theorie contractuelle. En procédant ainsi, Rawls estime pouvoir offrir une approche systematique au probléme de la justice qui soit non seulement une alternative a 1'utilitarisme traditionnel, mais une synthése supérieure et plus valable pour une sociéte démocratique en méme temps qu'une approche de la justice sociale qui puisse servir de contrepartie ou de succedane a la perspective de Marx. Les idées de ces mondes, d'où sont-elles venues? D'ici et d'ailleurs? D'une procession allant des principes aux techniques, du nombre aux mathématiques utilitaires, du temps cyclique au temps de l'histoire, ce dont témoignerait l'hexagone de cire des abeilles que Kepler tenait pour un archétype? En recourant à la doctrine de la prédestination, version théologique du déterminisme scientifique, l'auteur entend mettre en évidence le caractère inéluctable du paradigme qui se cristallise à la Renaissance pour rendre manifeste aujourd'hui notre peu de possibles, sinon celui de nous regarder être agis. What is often lost sight of in these debates is the role of the sovereign individual in Nietzsche’s genealogy of guilt and bad conscience in the Genealogy’s second essay. I argue for the following claims. First, that the figure of the sovereign individual is not a singular occurrence in Nietzsche’s published writings but is present in sections (...) from Daybreak and The Gay Science that have not been pursued in this context in the Anglophone literature; sections that shed new light on the sovereign individual. Second, that examination of these texts reveals that the sovereign individual is for Nietzsche embodied by Socrates and the Socratic individual. Third, and most importantly, that with the sovereign individual there emerges individualized conscience – the capacity for self-laceration that concerns one’s misdeeds alone and involves the belief that one’s misdeeds are entirely one’s own individual fault, rather than the fault of the community or the gods. A fourth, rather negative consequence, is that at the end of the day Nietzsche, in the Genealogy, does not manage to provide us with a genealogy of moral guilt. (shrink)

This article aims at questioning in a historical perspective the way the French State has organized and adapted teacher training from the early 1990’s until today. It attempts to highlight the ambitions underlying the successive reforms and the way in which a new single occupation of “teacher trainer” came into existence and evolved. Having acquired a set of specific skills and a common culture, the various actors of teacher training, with different origins, educational backgrounds and competences, were carried into a (...) common process of professionalization until the middle of the 2000’s.This new profession was building at least partly on a series of breaks with the traditional features of the teaching profession. The new institutional framework of teacher training organized in academic master programmes might bring this construction process to an end. Therefore, it is necessary to assess the impact of this reform on trainers. (shrink)

This article examines how the historian deals with ‘information’ broadly conceived, especially its acquisition, retention and loss. Ammianus details a complex interplay between those who control information and those who must work with an information deficit. Just as this dialogue plays out within the text, however, so too does it with respect to the author's methodology, which dances between the poles of incomplete and complete information depending on circumstance. Ammianus thus becomes an author as hard to pin down as many (...) of his characters, by turns the omniscient narrator and the dumbfounded participant. (shrink)

Le droit à un emploi correctement rémunéré pour assurer les conditions concrètes d’existence est de moins en moins universel. Les États tentent de venir en aide à cette population qui, avec ou sans travail, n’arrive plus (...) à vivre décemment, par des mesures d’assistance, avec des aides conditionnées, complexes, stigmatisantes. En Europe comme dans le monde, des expérimentations d’aides versées inconditionnellement, ciblées, pendant une durée limitée, laissent déjà entrevoir les bienfaits d’une telle mesure. Il reste à franchir l’étape de l’universalité à l’échelle de toute une communauté politique pour évaluer ses effets, non seulement sur la partie la plus pauvre de la société, mais aussi son rôle transformateur de l’ensemble de la société.
